This paper describes a tool for assisting lawyers and paralegal teams during document review in eDiscovery. The tool combines a machine learning technology (CategoriX) and advanced multi-touch interface capable of not only addressing the usual cost, time and accuracy issues in document review, but also of facilitating the work of the review teams by capitalizing on the intelligence of the reviewers and enabling collaborative work.

If finance is a service activity, it is important to specify what services it renders, to whom, in return for what, and for what purpose. ISBN: 9781739798314.Fénelon’s 1699 novel The Adventures of Telemachus—or more precisely, the epic poem in prose—was one of the major bestsellers in many European (...) countries for nearly two centuries. The book inspired paintings, operas, fashions, and even wallpaper motifs. It gave birth to a literary subgenre, the “archeological novel,” such as Terrasson’s Sethos (1731) or Bernardin de Saint-Pierre’s L’Arcadie (1788), in which the action is located in an antique setting. Still part of French schools’ syllabi a century ago, this book mainly owes its survival today to highly specialized academic research, stimulated from time to time when an “Agrégation” program generates new publications, papers, and conferences, as happened in 2009–10. The situation is similar in English-speaking countries, if perhaps just a bit worse: new editions are scarce and generally based more or less on revised versions of eighteenth-century translations, such as those editions by John Hawkesworth’s (1768) or Tobias Smollett’s (1776).The publication by A. J. B. Cremer of an entirely new translation, featuring a close rendering of the French text into modern English and preserving the original’s formal dignity without resorting to a pastiche of the classical language, is therefore a landmark in the history of Fénelon’s reception, and in the valuation of Telemachus particularly. This edition, while intended for the general reader, includes most of what is expected of a scholarly edition. In a comparatively short introduction, the editor recalls the essential facts about the author’s background (as a descendent of high nobility) and about his ecclesiastic career, which was compromised by both his involvement in mystical spirituality (the quarrel over Quietism) and his critical attitude toward the absolutism of Louis XIV’s régime. [End Page 140]In fact, Fénelon’s appointment as Archbishop of Cambrai (1695) was a kind of exile. In 1689, however, he was appointed tutor to Louis XIV’s seven-year-old grandson, the young Duke of Burgundy, second in the line of succession to the throne after his father (though both died prematurely). Fénelon wrote for this boy The Adventures of Telemachus as an educative fiction in the tradition of the “mirrors of Princes.” Of course, such a book was not intended for publication, and when it appeared in 1699—strangely enough, in a fully legal manner and with a printing privilege—it was against Fénelon’s will and in a very faulty form, which was corrected in later editions. An editor today therefore faces solving some highly complex textual problems, and choosing between the manuscript traditions. Cremer’s translation is based upon Jacques Le Brun’s authoritative text, published in Fénelon’s Œuvres, tome II (Paris: Gallimard, “Pléiade,” 1997).1After surveying the critical reception of Telemachus, particularly in England, starting at the text’s first publication and reaching the present time, the introduction discreetly hints at an apparent trend, among some interpretations, toward Christian allegory. If the figure of Mentor obviously “represents Fénelon” in his tutorial role, Cremer notes, this character, also an incarnation of Minerva, embodies humanity and divinity simultaneously, and thus may be seen as a “Christ-figure,” with Telemachus as his disciple and Ulysses, with his pursuit of a never-ending quest, as the symbolic form of the Divine. These observations are not entirely new; they have been formulated before by various critics. We seem to be abandoning the codes that told previous generations who they should love. But now that many of us are free to choose whoever we want, nothing is less certain. The proliferation of divorces and separations reveal a dynamic we would rather not see: others sometimes reject us as passionately as we are attracted to them. Our desire makes us sick. The throes of rivalry are at the heart of our attraction to one another. An essential feature of the quantum mechanical formalism, entanglement is widely thought to imply nonlocality or nonseparability as a puzzling trait of our ‘quantum world’. The notion of entanglement is reviewed and the question is addressed of whether invoking nonlocal influences, or perhaps time-reversed causation, is warranted in such ‘applications’ as quantum teleportation and entanglement swapping.

For thousands of years, political leaders have unified communities by aligning them against common enemies. However, today more than ever, the search for “common” enemies results in anything but unanimity. Scapegoats like Saddam Hussein, for example, led to a stark polarization in the United States. Renowned neuropsychiatrist and psychologist Jean-Michel Oughourlian proposes that the only authentic enemy is the one responsible for both everyday frustrations and global dangers, such as climate change—ourselves. _Melanie Klein and Marcelle Spira: Their Correspondence and Context__ _includes 45 letters Melanie Klein wrote to the Swiss psychoanalyst Marcelle Spira between 1955 and 1960, as well as six rough drafts from Spira. They were discovered in Spira’s library after her death in 2006. As only a few of the letters that Klein wrote to her colleagues have been preserved, this moving, historically important correspondence sheds new light upon the last five years of Klein’s creative life. The common theme of (...) the letters is their discussion of the French translation of _The Psycho-Analysis of Children_ by Boulanger in collaboration with Spira. The translation, first undertaken by Lacan, went through many ups and downs until it was published in 1959 by the Presses Universitaires de France. Klein also discusses her current work, in particular _Envy and Gratitude_. She encourages her pioneering Swiss colleague Spira to be patient in the face of the resistance shown towards Kleinian thinking. Identifying herself to some extent with her younger follower, Klein reveals a very touching autobiographical account of the difficulties that she herself had encountered in her work and how she overcame them. In _Melanie Klein and Marcelle Spira: Their Correspondence and Context_, Jean-Michel Quinodoz brings together these important letters. This rare collection of their correspondence is a valuable contribution to the history of psychoanalysis and will be essential reading for psychoanalysts, trainee psychoanalysts and lay readers with an interest in the work of Klein and Spira. Over the past twenty years, Husserlian phenomenology has increasingly drawn the attention of the cognitive community, thereby leading to the emergence of what might be called a phenomenological trend within contemporary cognitive studies. What this phenomenological trend really amounts to is however a matter of debate. The reason is that it embodies, in fact, a multifaceted reflection about the relevance of Husserlian phenomenology to the current efforts towards a scientific theory of cognition, and, to a lesser degree, about the reciprocal (...) relevance of these efforts to the fate of the Husserlian tradition. Indeed, it covers a wide array of perspectives on these questions, ranging from tentative demonstrations of the cognitively misleading character of Husserl's ideas, inasmuch as they would incarnate the same foundational errors as cognitivism (Hall and Dreyfus 1982), to diametrically opposed views arguing that the naturalist bent of contemporary cognitive science is ill-conceived, and that only the brand of transcendentalism defended by Husserl can provide it with adequate foundations (cf., for instance, Villela-Petit 1999). Despite its internal divisions and the uncertainty surrounding many of its foundations, there is a growing consensus that the on‐going search for an alternative model of the mind finds a minimal theoretical identity in the pursuit of an anti‐Cartesian conception of mental phenomena. Nevertheless, this anti‐Cartesianism remains more or less explicitly committed to the neo‐Brentanian idea that intentionality is an essential feature of the mental—an idea that has prevailed since the advent of modern cognitive science in the 1950s. An issue (...) of compatibility is thereby raised, as neo‐Brentanism arguably sides with cognitive Cartesianism. The main goal of the paper is to put into full light one specific aspect of this largely unperceived problem of compatibility by arguing that the neo‐Brentanian property of intentionality is an essentially representational one that runs counter to the salient anti‐representationalism of anti‐Cartesianism. And, that this representational essence confronts the search for alternative models of the mind of an anti‐Cartesian kind with the following theoretical issue: To what extent is it possible to devise a non‐Brentanian property of intentionality, particularly one that is fully dissociated from the property of representation? This issue is shown to be much deeper and more difficult than it looks once the nature of representation is properly apprehended; it seems to be still waiting for an answer in the current search for an alternative model of the mind, if only because it has not yet be set in fully adequate terms. A-t-il trahi les siens celui qui a survécu à la torture? A-t-elle trop facilement cédé celle qui a connu le viol? Ces survivants suspects ont-ils sacrifié leur honneur à leur survie? Questions traumatisantes, disent certains. Questions pourtant posées avec une surprenante récurrence pendant des siècles et des siècles, comme l'explique Jean-Michel Chaumont. Or, depuis quelques (...) décennies, dans les sociétés occidentales, ces codes d'honneur sont frontalement contestés, et sont même perçus comme d'intolérables blâmes adressés aux victimes. In lieu of an abstract, here is a brief excerpt of the content:Commentary on “Edmund Husserl’s Influence on Karl Jaspers’s Phenomenology”Jean Naudin (bio) and Jean-Michel Azorin (bio)Keywordsphenomenology, intentionality, intuition, empathy, ambiguitySchwartz and Wiggins’s paper clearly shows that Jaspers’s comprehensive psychiatry draws mainly from Husserl’s phenomenology. This thesis enters a current debate opened by Chris Walker and German Berrios about the influence of Husserlian philosophy on Jaspers’s work. This debate, which emerged at the end of the so-called decade (...) of the brain, could be considered perfectly obsolete. But its topicality relies on taking up the challenge of the scientific bases of comprehension in psychiatric experience. Wiggins and Schwartz perfectly achieve this aim by opposing a theory of seeing and a theory of thinking. Works such as Walker’s are grounded on thinking; they are works about theory. They are not works about experience, but rather epistemological or historical works. In contrast, Wiggins and Schwartz suggest to see, as Jaspers did, and not to think, following Husserl by grounding their psychopathology on intuition and presuppositionlessness. They emphasize Jaspers’s method of “making present” by doing a perfect analysis of the issues of translation of vergegenwärtigung as a co-experiencing of mental processes as if they were directly given. These main principles of direct-givenness, presuppositionlessness, and making present pull the Jaspersian concepts to the Husserlian phenomenological reduction and seem like the foremost principle in Husserlian phenomenology: the intuition of the thing in itself. Whereas Jaspers refuted the principle of eidetic reduction, Wiggins and Schwartz clearly show how much he grounded on the basis of the concept of intentionality, discovered and enlightened during Husserl’s life within the horizon of phenomenological reduction. Actually, it seems that the authors take the side of Jaspers to better support their own vision of psychiatric experience, which they more explicitly argued in Husserlian terms of the later period in some other papers (Schwartz and Wiggins 1985; Wiggins and Schwartz 1988, 1991; Wiggins, Schwartz, and Northoff 1990). However, they take care here to struggle exclusively with the epistemological field of their opponents, considering only Jaspers’s own writings and the Husserlian texts that were accessible to Jaspers when he wrote his psychopathology. There is no room for Kant in Jaspers’s main [End Page 37] principles, and this assumption must lead us to consider the horizon opened by Jaspers, that is, the horizon of a science of meaning essentially built on the lived experiences and the bracketing of any kind of a priori. In contrast to the slight influence of Kant, one idea that emerges is that of the straight impact of Dilthey on both Jaspers and Husserl. We perfectly agree with Wiggins and Schwartz that Jaspers, grounding both on Husserl and Dilthey, arrives at a methodological principle that is all his own, by considering both the connections of the life-stories and the objectivity of symptoms. In other words, we can find the originality and maybe the astonishing modernity of Jaspers in his perfect description of the balance between comprehension and observation, between empathy and its limits, that are obviously found in psychotic processes.We thus focused our comments on the following critiques to Jaspers, although they were already well argued in the brief conclusion of Wiggins and Schwartz: (a) the issue of empathy, (b) the limits of Jaspersian phenomenology, and (c) the merits of its genuine ambiguity.The Issue of Empathy. Indeed we have no reliable scientific mean to guarantee the correctness of our intuitions of the other’s mental life, and this problem might lead one to globally reject the method. The discussion of this problem, classical in the Continental literature since the twenties, led the Continental psychiatrists to unfortunately abandon their own traditions. And it is surprising for a Continental psychiatrist to see this debate coming back into the English-speaking literature. When we address the issue of empathy, we have no easy means to abandon folk psychology. Using philosophical slang weakens the attempt to enlighten its foundations instead of describing its values. The suspicion regarding empathy is partially legitimated by the prejudices of Jaspers himself. As psychiatrists, we have to carry on the Jaspersian research by progressively abandoning it and coming back... (shrink)

La pensée du cinéma ne rencontre d'ordinaire Jean-François Lyotard, dans ses textes sur le cinéma ou non, que par le biais de deux activateurs : l'acinéma et le figurai. Ces deux activateurs, au demeurant, sont fortement représentatifs de la position paradoxale de Lyotard pour les études cinématographiques : si l'acinéma a été le plus souvent critiqué pour sa radicalité voire son sectarisme, n'ayant de fait guère de postérité, il en va tout autrement du figurai, lequel a trouvé dans les (...) films un terrain fertile d'investigation. De plus, cette dualité est étudiée du point de vue de l’interférence de la mathématique avec elle, dans plusieurs contextes. Sont ainsi successivement analysés : le conflit entre les deux « modèles » du Mind, le computationnaliste et le (...) dynamiciste; la définition philosophique et la définition épistémologique du Geist ; le jeu entre Mind et Geist dans les recherches cognitives contemporaines ; l’ambivalence de la logique et des mathématiques vis-à-vis de l’opposition Mind/Geist. Dans la partie finale, on propose une définition personnelle du Geist–en termes d’adresse et de sujet–dont dérive une détermination du Mind. The issue raised is to know whether the opinio communis according to which elements of the pagan culture were “assimilated” to and by the Christian culture is a biased representation based on a more or less unconscious apologetic construction or if it relies on a historically attested reality. In May 2000 a group of researchers, university teachers and publishers met to consider the impact of the new media for knowledge transmission on the intellectual world and listed the projects ongoing in France for publishing content electronically. Eighteen months later no one is able to say whether there will one day be a significant body of electronic publishing with French content. Such a transformation calls for a moment's consideration. So what has happened?

Turning away from entities and focusing instead exclusively on ‘structural’ aspects of scientific theories has been advocated as a cogent response to objections levelled at realist conceptions of the aim and success of science. Physical theories whose (predictive) past successes are genuine would, in particular, share with their successors structural traits that would ultimately latch on to ‘structural’ features of the natural world. Motives for subscribing to Structural Realism are reviewed and discussed. It is argued that structural retention claims lose (...) their force if one gives up merely historical readings of the transition from Galilean-relativistic classical mechanics to the ‘special’ theory of relativity, heeding instead basic requirements that lead to their common derivation. Further cause for scepticism is found upon realising that the basic mathematical framework of quantum theory essentially reflects its predictive purpose, without any necessary input, be it of a ‘structural’ kind, from the physical world. The history of the African slave trade, despite its importance and role in world development, was not scientifically studied until 1930, and even since then few books and papers have been devoted to the subject. Beginning in the nineteenth century, however, this history has been the focus of sensational publications that underline and broadly interpret a smattering of highly emotional events. Several international conferences have brought together white and black historians. The Anneaux de la mémoire (Chains of Memory) exposition in Nantes enjoyed considerable success, and in 1994 UNESCO launched a decade-long cultural program called La Route de l'esclave (The Path of Slavery). This article discusses Alfred Jarry as a precursor of French modernism. With a particular focus on Messaline, Roman de l’ancienne Rome and Le Surmâle, Roman moderne, I analyse the subtle ways in which the past and the future are intertwined and Jarry’s philosophy of sexual excess. In both novels, the main characters seek a paroxysmal erotic pleasure from which they die after reaching world records in sex-making. Read together, the novels work to create a lemniscate, the symbol of infinity symbolically (...) represented, in modernism, by the speeding bicycle. In both novels, sexual excess leads to a superhuman transformation of women and men into a rigid phallus, underlying which is the fantasy of bisexualism. (shrink)

Se argumenta examinando el caso particular de la psicopatología cognitiva de la esquizofrenia y del contenido de la experiencia del delirio de control, mostrando cómo la teoría de Henri Ey, así como la del automatismo mental del siglo xix en la cual tiene sus raíces, contienen (...) herramientas descriptivas importantes para establecer que la experiencia de un delirio de control es esencialmente diferente de la experiencia de una simple ilusión de control. The following pages contend that, in spite of its intensive development, contemporary cognitive science has recently entered a phase of fairly acute uncertainty and confusion regarding some of its most essential foundations. They emphasize two aspects of this foundational crisis, specifically vindicating the existence of a crisis of naturalism and of a crisis of representationalism. Like any foundational crisis, this situation constitutes a serious threat to the significance of the empirical achievements of cognitive science. A threat calling for renewed efforts (...) to provide it with secure foundations that can only be obtained through acloser collaboration between empirical and foundational investigations, or, more concretely, between cognitive scientists and philosophers. They also outline a general strategy to address this threat, and illustrate itabout one aspect of particular importance of the naturalist crisis, namely the emergentist challenge to the orthodoxy of non reductive functionalism. They argue for the rejection of one version of this emergentist challenge,and they lay out a minimal condition that any other version of emergentism must meet. It is still unclear whether this condition is yet satisfactorily met by some version, and in particular by the sort of emergentism associated with the notion of dynamical system. Clarifyingthis issue should accordingly be seen as a top priority on the agenda of cognitive philosophy. (shrink)

Résumé Confronté à l’orientation tendanciellement matérialiste des sciences de la nature dans le dernier tiers du xix e siècle, Hermann Cohen s’efforça d’offrir une fondation idéaliste de ces sciences en recourant à la philosophie transcendantale kantienne. Il fut en accord avec Friedrich Albert Lange dans le refus de toute métaphysique dogmatique, mais il ne partagea pas son naturalisme, et l’idéalisme poético-fictif qui le complétait. Alors que Lange, dans son Histoire du matérialisme, avait eu pour but de décrire l’autodissolution de la (...) métaphysique matérialiste, Cohen voulut montrer comment le matérialisme débouchait dans un idéalisme méthodique, de provenance kantienne. En fin de compte, la distance dans le temps par rapport à Lange s’accroissant, il en vint à prêter un tel idéalisme à Lange lui-même ; ce qui est problématique. (shrink)

Indem er das Schreiben und die Reflexion des Schreibens unauflöslich miteinander verbindet, stellt Valéry alles in Frage, was die geistige Tätigkeit herkömmlicherweise auszeichnet: die Mythen des Hervorbringens, der Darstellung, der Originalität, der Wahrheitsfindung.

Jacques Derrida n'est pas seulement un membre de la generation subversive des annees 60-70, il a en quelque sorte regne sur ce moment philosophique. Sa maniere etait plus austere, son propos moins exaltant, mais il passait pour le plus brillant, s'averait comme le plus fecond et devancait les autres dans la reconnaissance internationale. Les adeptes de chacun des autres le connaissaient et reconnaissaient il les reunissait, en un sens. Il fut compte, d'ailleurs, comme le plus exasperant par tous ceux qui (...) sentaient dans ce moment un jeu trouble a l'egard de la rationalite. Il est encore trop proche de nos vies pour que l'on puisse pretendre rendre entierement justice aux milliers de lignes de son oeuvre. Avec le present ouvrage, on entend seulement offrir aux amateurs une introduction a une pensee difficile, accomplir un premier reperage de ce qu'elle a fait, de la maniere dont elle nous a marques et dont elle peut nous inspirer. On commence par exposer la pensee centrale de Derrida, celle dont le mot deconstruction signigie le programme. On raconte ensuite quelque chose du parcours de Derrida, du voyage de son ecriture parmi les pays et les enjeux de la culture. Puis on decrit Derrida dans l'activite chez lui fondamentale de la lecture des philosophes, en prenant l'exemple de ses discussions de Husserl, Levinas et Heidegger. Enfin, on evoque sa posterite et les prolongements que sa pensee pourraient connaitre. (shrink)
