The combination of the issue of return of individual genetic results/incidental findings and paediatric biobanks is not much discussed in ethical literature. The traditional arguments pro and con return of such findings focus on principles such as respect for persons, autonomy and solidarity. Two dimensions have been distilled from the discussion on return of individual results in a genetic research context: the respect for a participant’s autonomy and the duty of the researcher. Concepts such as autonomy and solidarity do not (...) fit easily in the discussion when paediatric biobanks are concerned. Although parents may be allowed to enrol children in minimal risk genetic research on stored tissue samples, they should not be given the option to opt out of receiving important health information. Also, children have a right to an open future: parents do not have the right to access any genetic data that a biobank holds on their children. In this respect, the guidelines on genetic testing of minors are applicable. With regard to the duty of the researcher the question of whether researchers have a more stringent duty to return important health information when their research subjects are children is more difficult to answer. A researcher’s primary duty is to perform useful research, a policy to return individual results must not hamper this task. The fact that vulnerable children are concerned, is an additional factor that should be considered when a policy of returning results is laid down for a specific collection or research project. From the beginning of this country’s history, the fine arts have been viewed as elitist and thus of no value to the larger society. “To America,” Ben Franklin wrote in the late 1700s, “one school master is worth a dozen poets, and the invention of a machine or the improvement of an implement is of more importance than a masterpiece of Raphael.”1 Given such longstanding and deep-seated suspicion of art among Americans, it is not surprising that both the champions and the staff of art museums insisted on the practical educational benefits museums provided to the public.By the late nineteenth century, at the height of immigration and the emergence of a strong working class and labor movement, a social dimension was added to the mission of museum education. Art museums, like public libraries, were seen as venues for achieving social balance. By the early twentieth century an aesthetic agenda was finally joined to these social and pragmatic ones.2While museums have responded to the needs created by cyclical changes in social, economic, political, and intellectual life, today’s art museum educators still deal with the tension among the museum’s aesthetic, educational, and social missions; only the context and delivery modes of museum education have changed. Die interdisziplinär angelegte Untersuchung befaßt sich mit John Barclays (1582-1621) neulateinischem Staatsroman "Argenis" (1621), einem tagespolitischen Schlüsselroman auf dem Hintergrund der französischen Religionskriege. Die "Argenis" ist ein parteipolitisches Pamphlet gegen die Monarchomachen, speziell gegen die militanten Hugenotten; zugleich wird untersucht, inwiefern dieser höchst komplexe Roman aber auch Entwurf und Utopie des idealen Staates, Fürstenspiegel für Ludwig XIII. sowie Manifest und Proklamation der absolutistischen Staatslehre ist. Grundlage der Interpretation, die den Roman im Kontext des politischen Denkens und der 'politischen' Schriften seines (...) Autors untersucht, ist die Beschäftigung mit denjenigen staatstheoretischen Werken aus Mittelalter und Früher Neuzeit, die Barclays Denken prägten (u.a. die Schriften seines Vaters William, Jean Bodins und Jakobs I. von England). Als unabdingbar erwies sich dabei auch eine gründliche Auseinandersetzung mit dem Themenkomplex Staatsrechtfertigung, also der Frage nach dem Grund und der Grenze des dem Staat geschuldeten Gehorsams, vor dem Hintergrund der konfessionellen Bürgerkriege und der Suprematieansprüche des Papsttums über die weltlichen Fürsten. Hier wurden erstmals auch die im vatikanischen Geheimarchiv und in der Vatikanbibliothek aufbewahrten Quellen zu Barclay herangezogen. (shrink)

Die Möglichkeit, Walter Benjamins Allegorie-Begriff in akademischen Untersuchungen mit der Prosa Jean Pauls in Verbindung zu bringen, wurde von Benjamin noch selbst abgewogen: in der Rezension einer frühen Abhandlung zu diesem Thema, die er für zu kurz gegriffen befand. Ein solches Vorhaben, das beste Chancen böte, dürfe sich nämlich nicht auf literaturwissenschaftliche und geistesgeschichtliche Perspektiven beschränken. Notwendig sei vielmehr, auch die Dimension der Alltagskultur einzubeziehen und Jean Pauls Hinabgreifen in Tiefen des Volkstums und der Tradition zu berücksichtigen. Diesem (...) Hinweis Benjamins folgt die vorliegende Untersuchung. Indem sie sich auf den Bereich der materiellen Kultur konzentriert, legt sie eine Geschichte der Theorie der Dingwelt offen. Jean Pauls ästhetische Überlegungen zur projektiven Belehnung der Dingwelt mit seelischen Regungen wurden von Aby Warburg aufgegriffen und für seine kulturwissenschaftliche Methode fruchtbar gemacht. Dabei erschliesst er unter anderem einen Traditionsstrang des Denkens von materieller Kultur im ästhetischen und kultur anthropologischen Kontext, der geprägt ist von aus der Antike herrührenden abergläubischen Vorstellungen über die Einflüsse der Planeten auf die menschliche Geistesverfassung wie etwa die Saturnfürchtigkeit. This paper critically examines non-adversarial feminist argumentation model specifically within the scope of politeness norms and cultural communicative practices. Asserting women typically have a particular mode of arguing which is often seen as ‘weak’ or docile within male dominated fields, the model argues that the feminine mode of arguing is actually more affiliative and community orientated, which should become the standard within argumentation as opposed to the Adversary Method. I argue that the nonadversarial feminist argumentation model (NAFAM) primarily focuses on (...) one demographic of women’s communicative styles – white women. Taking an intersectional approach, I examine practices within African American women’s speech communities to illustrate the ways in which the virtues and vices purported by the NAFAM fails to capture other ways of productive argumentation. Das Buch liefert neue Erkenntnisse zur Rolle der Philosophiekongresse in Prag 1934 und Paris 1937 sowie zur Bedeutung einzelner Akteure wie Marcel Boll, der die Rezeption des Logischen Empirismus in Frankreich beförderte. Die Spuren, die Ernst Mach, aber auch der weniger bekannte deutsche Physiologe und Hirnforscher Ewald (...) Hering in der französischen Wissenschaftsphilosophie hinterliessen, verfolgen die Autoren bis hin zu den Ideen Jean Piagets. Im Mittelpunkt des Buchs stehen Philosophen aus Frankreich, Deutschland und Österreich und ihre Leistung, die Wissenschaften nicht nur erkenntnistheoretisch und logisch durchleuchtet, sondern auch erkannt zu haben, dass ihre theoretische Struktur nur dann vollständig erfasst werden kann, wenn ihre praktische Dimension mit einbezogen wird. Dafür steht Henri Poincaré, der die tragende Rolle der Konventionen für die Theoriebildung in der Mathematik herausstellte. Sichtbar wird der Bezug zur Praxis auch in Moritz Schlicks Überlegungen zu einer auf Empirie basierenden Ethik oder in der Arbeit Otto Neuraths, der eine aus den modernen Wissenschaften gewonnene Konzeption menschlichen Erkennens für das Projekt der gesellschaftlichen Aufklärung fruchtbar machen wollte. When we discuss normative reasons, oughts, requirements of rationality, hypothetical imperatives (or “anankastic conditionals”), motivating reasons and so on, we often use verbs like “believe” and “want” to capture a relevant subject’s perspective. According to the received view about sentences involving these verbs, what they do is describe the subject’s mental states. Many puzzles concerning normative discourse have to do with the role that mental states consequently appear to play in this discourse. This book uses tools from formal semantics and (...) the philosophy of language to develop an alternative account of sentences involving these verbs. According to this view, which is called parentheticalism (in honour of J. O. Urmson), we very commonly use these verbs in a parenthetical sense. Used with this sense, these verbs themselves express backgrounded side-remarks on the contents they embed, and these latter, embedded contents constitute the at-issue contents of our utterances. This means that instead of speaking about the subject’s mental states, we often use sentences involving “believe” and “want” to speak about the world in a way that, in the conversational background, relates our utterances to her point of view. This idea is made precise, and it is used to solve various puzzles concerning normative discourse. The final result is a new, unified understanding of normative discourse, which gets by without postulating conceptual breaks between objective and subjective normative reasons, or normative reasons and rationality, or indeed between the reasons we ascribe to an agent and the reasons she herself can be expected to cite. Instead of being connected to either subjective mental states or objective facts, all of these normative statuses can be adequately articulated by citing worldly considerations from the subject’s point of view. Understanding and measuring levels of academic integrity within higher education institutions across the world is an important area of study in the era of educational internationalization. Developing a cross-cultural measure will undoubtedly assist in creating standardization processes and add to the discourse on cross-cultural understanding on what constitutes honest and dishonest action in the higher education context. This study has used a combination of exploratory and confirmatory factor analytical procedures to validate a previously published questionnaire, namely the cross-cultural academic integrity (...) questionnaire. Inspection of response distributions was also undertaken. Primary participants in this study were from Iran, and secondary reference participants were from New Zealand and Nigeria. The findings indicate that a revised questionnaire better represents the data obtained from all three regions. Three CCAIQ-2 domains are proposed: cheating, collusion and complying. However, the response distributions indicated differences among the three groups, further suggesting that the theoretical constructs developed through factors analysis may not represent equivalence in terms of cross-cultural understanding. This research will inevitably create international debate on the measurement of integrity and how this measurement process can be used to establish internationally recognized and accountable educational regulations. Organizations routinely make choices when addressing conflicting stakes of their stakeholders. As stakeholder theory continues to mature, scholars continue to seek ways to make it more usable, yet proponents continue to debate its legitimacy. Various scholarly attempts to ground stakeholder theory have not narrowed down this debate. We draw from the work of Juergen Habermas to theoretically advance stakeholder theory, and to provide practical examples to illustrate our approach. Specifically, we apply Habermas’ language-pragmatic approach to extend stakeholder theory by advancing (...) seven sets of normative axioms. We conclude that a deliberative approach, with its focus on the conditions of legitimation and deliberative democracy, has the potential to become a cornerstone of stakeholder theory. The need for global stakeholder discourse and its internalization in corporate structures and institutions is exemplified by a multitude of CSR and stakeholder initiatives that have mushroomed in response to global risk scenarios such as climate change, nuclear warfare, or terrorism. Further research may help to build a functioning global governance system in order to provide guidance for management in the 21st century. (shrink)

Hierarchical views of nature have for centuries been used to justify the enslaving of peoples perceived as inferior, the often violent and coercive “reeducation” of indigenous peoples, the patriarchal subjugation of women, the cruel use of nonhuman animals for often trivial purposes, and the wanton destruction of the natural world. I join those who condemned the oppressive nature of these forms of hierarchical thinking. Yet, I fear that, in their effort to right past wrongs, too many thinkers are in danger (...) of throwing the axiological baby out with the ontological bathwater. Though the aim at a great ontological leveling is certainly understandable, I fear that, in embracing the opposite extreme and rejecting all hierarchical thinking, some may be in danger of doing violence to the many real and even morally significant differences between individuals. My claim in this paper is that Alfred North Whitehead’s philosophy of organism provides a model for how to appreciate the many grades and types of beings in the world, while avoiding an invidious normative hierarchy that inevitably places everything at the whim of human beings. That is, I will argue that it is possible to defend hierarchy without anthroparchy. To provide context, I will begin with a brief analysis of Aristotle’s “Great Chain of Being” and will then contrast it with Whitehead’s process philosophy. Given this context, using the subtle and perceptive work of the ecofeminist Karen J. Warren, I will then present a model for how to recognize a “descriptive hierarchy” while rejecting a simplistic “prescriptive hierarchy.” . (shrink)

Hope is a central concept in nursing and other fields of health care. However, there is no consensus about the concept of hope. We argue that seeking consensus is futile given the multifaceted and multidimensional nature of the concept, but instead we encourage in‐depth studies of the assumptions behind talk about hope in specific contexts. Our approach to the ‘science of hope’ is inspired by philosophical pragmatism. We argue that hope is a concept that opens different rooms for action in (...) different contexts and that accordingly, all hope interventions are contextually sensitive. Careful attention to how the relative positions and power of nurses and patients influence what can be inferred from their different ways of talking about hope may make hopeful conversations more meaningful in health care relationships. This project develops and defends a holistic, organic ethical theory grounded firmly in Whitehead's aesthetico-metaphysics of process. The seminal insight of this ethic, which I refer to as the Ethics of Creativity, is the fundamental sense of beauty and value at the base of existence; there is no vacuous, valueless existence. As a result of this starting point, it is this project's contention that it is not enough for an ethical theory merely to prescribe how we ought to interact with (...) other human beings. Rather, insofar as everything is inherently valuable, ethics must be radically reconceived as directing how we ought to comport ourselves with everything to which we relate. Accordingly, rather than having one ethic for our interaction with inter-human relationships and another for the extra-human world, the Ethics of Creativity is at once an inter-human ethic and an environmental ethic; it is, in this sense, holistic. Thus, with William James, I believe that the aim of a truly adequate ethical theory is "to find an account of the moral relations that obtain among things, which will weave them into the unity of a stable system, and make of the world what one may call a genuine universe from the ethical point of view" . ;As there currently is no systematic development of an ethical theory based on a robust conception of Whitehead's metaphysics and aesthetics, this project has the potential to be a substantial contribution to the field of process philosophy. Furthermore, and perhaps more importantly, I engage established ethical theories with the hope of transforming their basic presuppositions and indicating the need to move toward a process model. This comment on Kocyba's article discusses both his economic and moral assumptions, arguing that the shift from industrial capitalism towards a 'new spirit' of more autonomous forms of work is not captured by Kocyba's comparison between producing things alone and creating services together. Consequently, the main problem is not, as Kocyba believes, the determination of an individual's share in the (intangible) product, but the competitive mindset of this new spirit, which has many undesired consequences. Concerning the 'moral presuppositions' it is (...) argued that the questionable self-restriction to 'immanent norms' induces a strong affirmative tendency which is at odds with Kocyba's critical aspirations. The idea that critical theory can only refer to norms which are already institutionalized needs to be dropped in order to revive the critical dimension. Arguments for moral consequentialism often appeal to an alleged structural similarity between consequentialist reasoning in ethics and rational decision-making in everyday life. Ordinary rational decision-making is seen as a paradigmatic case of goal-oriented, teleological decision-making, since it allegedly aims at maximizing the goal of preference satisfaction. This chapter describes and discusses a neglected type of preference change, “predictable preference accommodation.” This phenomenon leads to a number of critical cases in which the rationality of a particular choice does not depend on (...) features of the outcome of the chosen act. On the basis of these cases, it is argued that consequentialists cannot point to everyday decision-making as an uncontroversial example of consequentialist reasoning. On the contrary, it is suggested that an adequate account of rationality in prudential choice may need a Kantian notion of respect. (shrink)

Perfectionism is a new player in the field of political philosophy. It is often rejected by liberal philosophers for it seems to have a conservative or paternalist bias. However, this paper argues first that perfectionism can have different political tendencies: it can be both liberal and illiberal, equalizing or anti-egalitarian, and be based on both limited or open conceptions of human nature. So perfectionism is not intrinsically conservative. Establishing a reliable and valid measure of academic integrity that can be used in higher education institutions across the world is a challenging and ambitious task. However, solving this issue will likely have major ramifications for understanding dishonest action. It also enables the development of a standardised measure that can be used to assess the efficacy of interventions aimed at enhancing academic integrity that can be administered across regional boundaries and diverse cultural groups. This study has used a combination of (...) confirmatory factor analysis and item distribution inspection procedures to further validate the cross-cultural academic integrity questionnaire version 2. Primary participants in this study were from Saudi Arabia, and secondary reference participants were from New Zealand. The findings indicate that a revised 10-item questionnaire, the cross-cultural academic integrity questionnaire version 3, has better credibility in terms of construct validity than its predecessor. Three CCAIQ-3 domains are proposed: copying, cheating, and complying. This research will inevitably create further academic and international debate; however this measure is likely to be useful in terms of creating a research protocol for evaluating and measuring cross-cultural issues and interventions aimed at promoting academic integrity. Definition of the problem The creation and selection of children as tissue donors is ethically controversial. Critics often appeal to Kant’s Formula of Humanity, i.e. the requirement that people be treated not merely as means but as ends in themselves. As many defenders of the procedure point out, these appeals usually do not explain the sense of the requirement and hence remain obscure. Arguments This article proposes an interpretation of Kant’s principle, and it proposes that two different instrumental stances be (...) distinguished. I argue that the creation of “saviour children” is a form of instrumentalization that I dub “preemptive instrumentalization” and that it is categorically different from earlier forms of instrumental attitudes concerning human reproduction. Conclusion Critics are wrong to claim that Kant’s principle is either compatible with the selection of saviour siblings or too vague to serve as an ethical principle. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Preface: Virtual Entities in ScienceRobert Harlander, Jean-Philippe Martinez, Friedrich Steinle, and Adrian WüthrichIt is not only since the sudden increase of online communication due to the COVID-19 situation that the concept of the “virtual” has made its way into everyday language. In this context, it mostly denotes a digital substitute for a real object or process. Virtual reality is perhaps the best-known term in this respect. With these (...) digital connotations, “virtuality” has also been used in science and research: Chemists use virtual laboratories, biologists do virtual scanning of molecular structures, and geologists engage in virtual field trips. But the concept of the virtual has a much longer tradition, dating back to long before the dawn of the digital age. Virtual images and virtual displacements were introduced in classical physics already in the late seventeenth and eighteenth centuries, respectively. They represent auxiliary objects or processes without instantiation, with the purpose of efficiently describing specific physical systems. In today’s physics, the term “virtual” is mostly associated with the quantum world, first and foremost with the “virtual particle” of quantum field theory. It has become such an integral part of modern high energy physics that its ontological character may be considered to go beyond the purely auxiliary, which is typically associated with the virtual. [End Page 263]In other disciplines, however, use of the term virtual without a digital connotation is much rarer. While concepts like “virtual adrenaline” show up in physiological research around 1940s, and Charles Darwin, in a private note in January 1840,1 spoke of “virtual change” in the context of embryology, these examples seem to be singular occurrences of entities that were explicitly called “virtual.” The basic idea behind the terminology of the virtual, however, might be much more common, even outside of physics. The “invisible hand” in economics, or the “vital force” in biology, for instance, may carry aspects of a virtual entity, even if they have not been referred to that way.These different observations raise several questions about the status of virtual entities in science. What has led scientists to call one entity “virtual” and not another? Do all virtual entities in science have the same roots and meet the same characteristics? Are they more than auxiliary objects or processes? Why does physics seem to occupy a specific position with respect to the use of the notion of virtuality? These are some points that led us to discuss virtual entities in science during a workshop, out of which grew the present collection. We invited contributions that addressed the historical formation and philosophical interpretation of concepts of virtual entities in physics and other disciplines—in whatever terms they may come. The main goal of the workshop was to bring to the fore similarities and differences in the meanings and functions of these concepts, so as to be able to precisely characterize why certain entities are considered virtual in specific contexts, why a different terminology was often used in each individual case, and in what sense the virtual entities relate to the real world.The organization of the workshop was part of our project “The formation and development of the concept of virtual particles,” a subproject of the Research Unit “The Epistemology of the Large Hadron Collider,” funded by the Deutsche Forschungsgemeinschaft (DFG) and Der Wissenschaftsfonds (FWF). The aim of this essay is twofold. First, I examine the role of Alfred North Whitehead and process thinkers in bringing about and shaping the field of environmental ethics. As we will see, our job is not so much to develop the connections between Whitehead and environmental thought as to recover them. Second, given this genealogical work, I invite process scholars to reconsider their generally hostile reception of Aldo Leopold and his land ethic. Sensitivity to interpersonal timing was assessed in mother–infant interaction. In Study 1, 3-month-old infants interacted with their mothers over television and the mothers’ audio-visual presentation was either live or temporally delayed by 1 second. Infants gazed longer when the mother was presented live compared to delayed by 1 second, indicating that they detected the temporal delay. In Study 2, mothers interacted with their 3-month-old infants over television and the infants’ audio-visual presentation was either live or temporally delayed by 1 second. (...) Mothers’ behavior was not altered by a 1-second delay in their infants’ behavior compared to a live presentation. In Study 3 and 4, the results were replicated with 6-month-old infants. Whereas infants detected the temporal delay in maternal responses, mothers likely adjusted to the delay in infant behavior. My goal in this brief essay is not so much to defend White's controversial thesis, but to use it as a context for appreciating the significance of Pope Francis's new encyclical Laudato Si’. Considering it in the context of White’s thesis, will bring certain salient features into relief.

Perhaps more than any other aspect of his thought, Alfred North Whitehead’s rejection of the notion of “independent existence” or substance has been taken to define his philosophy of organism. Moreover, it is this rejection of substances which has been the source of some of the most significant objections to Whitehead’s thought. Many commentators often indicate sympathy with Whitehead’s project but ask, if the world is composed exclusively of microscopic events which neither endure nor have histories, then how can Whitehead (...) account for enduring, macroscopic individuals such as ourselves? That is, having rejected the notion of unchanging subjects of change, how can Whitehead’s account adequately capture the unity and self-identity of macroscopic individuals? The contemporary Neo-Thomist W. Norris Clarke gives voice to this potentially damaging objection. A close analysis of aspects of Clarke’s work will prove rewarding in several respects. Not only does Clarke provide a clear challenge to a non-substantial model of individuality by explicitly formulating and defending the objection that Whitehead’s system only allows for an attenuated conception of macroscopic individuality, Clarke’s own dynamic interpretation of the classical notion of substance seriously calls into question the very need for Whitehead’s “process turn” toward what Clarke sees as a misguided metaphysical atomism. Thus, engaging Clarke’s objection provides a valuable opportunity not only to evaluate the adequacy of his dynamic notion of substance, but also to respond to the common criticism that Whitehead’s system does not do justice to the unity of macroscopic individuals. In this article the work of a recent critic of moral vegetarianism (and veganism) is analyzed: Andrew F. Smith. Smith s work is significant for process thinkers who defend moral vegetarianism for various reasons. One of these is that he forces process thinkers to consider in more depth Whitehead’s view of plant ontology; another is that Smith adds insightfully to the conversation within process thought regarding the relationship between claims regarding animal rights and the ecoholistic concerns of environmental ethicists.

While most scholars readily recognize that Alfred North Whitehead had deep and penetrating misgivings about the substantial view of individuality, fewer note that these misgivings stem as much from axiological considerations as ontological ones. I contend that, taken in the context of the “classical interpretation” of his metaphysics, Whitehead’s bold affirmation that actuality and value are coextensive introduces a potentially serious problem for the adequacy and applicability of his axiology. For if actuality is coextensive with valuebut actuality is itself limited (...) to subjects of experience, then the objective world can have no intrinsic value. My aim is to demonstrate that, in order to respond to the very serious challenge which the problem of subjectivism represents and save Whitehead’s intendeduniverse of value, we must seek an alternative to the classical interpretation of Whitehead’s metaphysics. Despite there being deep lines of convergence between the philosophies of Alfred North Whitehead, C. S. Peirce, William James, John Dewey, and other classical American philosophers, it remains an open question whether Whitehead is a pragmatist, and conversation between pragmatists and Whitehead scholars have been limited. Indeed, it is difficult to find an anthology of classical American philosophy that includes Whitehead’s writings. These camps began separately, and so they remain. This volume questions the wisdom of that separation, exploring their connections, (...) both historical and in application. The essays in this volume embody original and creative work by leading scholars that not only furthers the understanding of American philosophy, but seeks to advance it by working at the intersection of experience and reality to incite novel and creative thought. This exploration is long overdue. Specific questions that are addressed are: Is Whitehead a pragmatist? What contrasts and affinities exist between American pragmatism and Whitehead’s thought?
