The combination of the issue of return of individual genetic results/incidental findings and paediatric biobanks is not much discussed in ethical literature. The traditional arguments pro and con return of such findings focus on principles such as respect for persons, autonomy and solidarity. Two dimensions have been distilled from the discussion on return of individual results in a genetic research context: the respect for a participant’s autonomy and the duty of the researcher. Concepts such as autonomy and solidarity do not (...) fit easily in the discussion when paediatric biobanks are concerned. Although parents may be allowed to enrol children in minimal risk genetic research on stored tissue samples, they should not be given the option to opt out of receiving important health information. Also, children have a right to an open future: parents do not have the right to access any genetic data that a biobank holds on their children. In this respect, the guidelines on genetic testing of minors are applicable. With regard to the duty of the researcher the question of whether researchers have a more stringent duty to return important health information when their research subjects are children is more difficult to answer. A researcher’s primary duty is to perform useful research, a policy to return individual results must not hamper this task. The fact that vulnerable children are concerned, is an additional factor that should be considered when a policy of returning results is laid down for a specific collection or research project. For a significant number of patients, there exists no, or only little, interest in developing a treatment for their disease or condition. Especially with regard to rare diseases, the lack of commercial interest in drug development is a burning issue. Several interventions have been made in the regulatory field in order to address the commercial disinterest in these conditions. However, existing regulations mainly focus on the provision of incentives to the sponsors of clinical trials of orphan drugs, and leave unanswered (...) the overarching question about the rightful place of orphan drugs in resource allocation systems. In this article, we analyse the ethical aspects of funding research and development in the field of rare diseases. We then propose an ethical framework that can help health policy makers move forward in the difficult matter of fairly allocating resources for the prevention, diagnosis and treatment of rare diseases. Le faux s'entend de multiples façons et ne désigne pas seulement le résultat d'une opération de falsification menée à des fins privées et, à ce titre, réprimée plus ou moins efficacement par le droit pénal. Il fait aussi partie des contraintes nécessaires au bon fonctionnement du système juridique: on ne peut se passer des fictions ou des présomptions ; il faut compter aussi avec les approximations nécessaires du langage juridique: jamais il n'est question de "décrire" une réalité, mais bien plutôt (...) de la schématiser ou d'énoncer un devoir-être la concernant. Ce qui a pour effet de placer le législateur et ses alliés objectifs dans une situation de tension permanente entre ce qui existe en fait ou risque d'advenir et les exigences énoncées par la règle juridique. Ce décalage nécessaire affecte tous les secteurs du droit, pas seulement les plus sensibles au changement social. On a donc essayé d'en prendre la mesure, dans certains d'entre eux - droit économique, droit des assurances, droit de l'environnement, protection des oeuvres de l'esprit, droit international et européen, droit des nouvelles technologies -, sans oublier que le droit n'est à tout prendre qu'un laboratoire des oppositions et conflits d'intérêts qui travaillent la société dans son ensemble et que, par conséquent, comme tout système de communication, il se doit pour continuer d'exister et de remplir cette fonction implicite, de maintenir une part d'ombre sur sa propre nature. Comme dans tous les colloques organisés par le Centre d'études et de recherches sur les contentieux, cette question juridique par excellence a été étudiée par des juristes, bien sûr, mais aussi par des collègues apparemment étrangers à la chose juridique mais directement concernés par les problèmes de la communication entre les hommes. Le colloque dont les actes sont ici reproduits s'inscrit dans la continuité d'un travail entrepris il y a quelques années dans le cadre du Centre d'études et de recherches sur les contentieux. Cet article vise deux objectifs : 1) mieux comprendre ce que le petit-fils de Ben Sira dit au sujet de la traduction du livre de son grand-père ; 2) comparer sa conception de la traduction avec celles que l’on trouve dans d’autres textes judéens et alexandrins relatifs à la traduction de la Bible hébraïque en grec, afin de mettre en (...) évidence le caractère singulier des propos du petit-fils de Ben Sira. In this study, originally published in 1985, the author provides a history of _délire_, tracing its influence on philosophy, linguistics, literature and psychoanalysis. The author argues that _délire _provides a new approach to the classic philosophical problem of sense and nonsense.

Si en su “Discurso sobre las ciencias y las artes” (1750) y en su “Discurso sobre el origen de la desigualdad” (1755) –publicados en un solo volumen en esta colección– Jean-Jacques Rousseau (1712-1778) fue sentando las bases de su pensamiento filosófico y social, el trabajo fundamental que acabó alumbrando el autor en el campo del pensamiento político fue “Del Contrato social”, publicado en 1762. Esta obra, en la que toman cuerpo las inquietudes políticas y la fe en la (...) razón de la corriente ilustrada, puede considerarse la fundadora del derecho político. Su análisis teórico de la soberanía de los Estados como producto de la voluntad general se fundamenta en un contrato por el que el individuo enajena su libertad natural a cambio de convertirse en ciudadano, recibir los derechos inalienables de igualdad jurídica e igualdad moral, y asegurar la libertad de todos los miembros de la sociedad. “Del Contrato social” es uno de los textos capitales para entender el nacimiento de las sociedades modernas. Esta obra, conocida también como Segundo discurso, se publicó en Francia en 1755 y responde a una pregunta planteada por la Academia de Dijon: “¿Cuál es el origen de la desigualdad entre los hombres, está respaldada por la ley natural?”. Rousseau se opone principalmente a la tesis de Hobbes, que consideraba al hombre malo por naturaleza, y critica que este no retrocede lo suficiente en el tiempo para comprender al hombre natural. Así, el autor francés busca un conocimiento más profundo (...) y llega a la conclusión de que el hombre natural es “un buen salvaje que vive disperso entre los animales” y que no está condicionado por el miedo a la muerte porque no puede concebir ese final. Rousseau analiza dos tipos de desigualdad: la natural o física y la ética o política y argumenta que la segunda se establece por convención en sociedades civiles que son una trampa perpetuada por los poderosos sobre los débiles para mantener sus privilegios.
