Wegen der engen Symbiose zwischen Mutter und Kind, die charakteristisch für die Schwangerschaft ist, können sich Interessenskonflikte zwischen den beiden Individuen entwickeln. Konflikte, bedingt durch die Bedrohung der mütterlichen Gesundheit einerseits und das Recht des Fetus auf Leben, stellen Ausnahmesituationen dar und können in der Regel ohne Opferung der Fetus gelöst werden. Bei unerwünschten Schwangerschaften stellt sich die Frage nach der Priorität von dem Recht der Mutter auf Autonomie und Wahrung ihrer psychosozialen Gesundheit und dem Recht auf Leben des Fetus. (...) Auch die frühzeitige Diagnose eines kranken Fetus mit Aussicht auf ein schwerbehindertes Kind kann – bedingt durch die psychische Belastung – als Bedrohung der mütterlichen Gesundheit aufgefaßt werden. Die gesetzlichen Vorgaben zur Lösung dieser Konflikte variieren zwischen verschiedenen Ländern und unterliegen ihrerseits Anpassungen und Veränderungen. In Anbetracht der verschiedenen kulturellen und religiösen Einflüsse moderner Gesellschaften kann es keinen übergreifenden Konsens zur Lösung dieser Konflikte geben, und die Entscheidung wird im Einzelfall in Abhängigkeit von den moralischen und religiösen Auffassungen der Betroffenen unter Beachtung der rechtlichen Rahmenbedingungen gefällt. In der Schweiz ist nach wie vor eines der ältesten und restriktivsten Gesetze über den Schwangerschaftsabbruch gültig, das eine Unterbrechung nur in Situationen ernsthafter Bedrohung des Lebens oder der Gesundheit der Mutter nach entsprechender Bestätigung durch einen medizinischen Fachexperten zuläßt. Die Anwendung bzw. die Auslegung des Gesetzes hat in den letzten 50 Jahre eine erhebliche Ausweitung erfahren und in der Mehrzahl der Kantone wird die psychosoziale Notlage im Zusammenhang mit einer unerwünschten Schwangerschaft als ernste Bedrohung der Gesundheit der Mutter akzeptiert, so daß der Schwangerschaftsabbrucht straffrei ist. Dem Parlament liegt eine neue Initiative zur Anpassung des Gesetzes an die herrschende Rechtspraxis vor, in dem der straffreie Schwangerschaftsabbruch bis zu 14 Wochen nach der letzten Periode auf Wunsch der Frau gefordert wird. Jenseits dieses Zeitpunkt wird dem Recht des Fetus auf Leben zunehmend Gewicht eingeräumt, so daß die Priorität des Rechtes der Mutter auf Autonomie und Selbstbestimmung nicht mehr gegeben ist. Der Schwangerschaftsabbruch beschränkt sich jenseits von 14 Wochen in der Regel auf Fälle mit schwerer nachgewiesener Pathologie des Fetus. Nach Erreichen der extrauterinen Lebensfähigkeit des Fetus (22–24 Wo-chen) wird der Abbruch auch bei nachgewiesener Pathologie des Fetus zunehmend restriktiv gehandhabt und beschränkt sich auf die Fälle mit schwerer Pathologie ohne Aussicht auf ein extrauterines Überleben oder ein Minimum an kognitiver Entwicklungsfähigkeit wie etwa bei Trisomie 13, 18, Anencephalus oder beidseitiger Nierenagenesie.Durch die Fortschritte der pränatalen Diagnostik ist eine präzise Abklärung fetaler Erkrankungen mit detaillierter Beurteilung der Prognose möglich. Die Methoden der Molekularbiologie ermöglichen den Nachweis oder Ausschluß von genetischen Erkrankungen wie auch von Virusbefall fetaler Zellen, so daß die Entscheidung für einen Schwangerschaftsabbruch in diesen Fällen nicht mehr auf Grund von Wahrscheinlichkeitsangaben, sondern abgestützt auf den definitiven Nachweis diskutiert werden kann.Die fetalen Erkrankungen, die einer intrauterinen Behandlung zugängig sind, bilden eine zunehmend länger werdende Liste, die mit der Transfusion von Blut bei Hämolyse wegen Rhesusinkompatibilität begonnen hat. Dazu kommt eine Reihe chirurgischer Eingriffe wie die Laserkoagulation kommunizierender Gefäße beim Zwillingstransfusionssyndrom oder die Ableitung von Flüssigkeit aus verschiedenen Körperhöhlen des Fetus in die Amnionhöhle. Diese Eingriffe werden unter Ultraschallsicht durchgeführt. Größere Eingriffe, die eine Eröffnung des Uterus erforderlich machen, beschränken sich auf Zwerchfellhernien, die Entfernung großer Teratome sowie auch die Behebung obstruktiver Uropathien. Die Erfolgsrate dieser invasiven Eingriffe, die nur in wenigen Zentren durchgeführt werden, bleibt begrenzt. Medizinische Behandlungen des Fetus können durch Verabreichung von Medikamenten an die Mutter mit transplazentarem Übertritt zu dem Fetus oder durch direkte Injektion in Nabelschnurgefäße erfolgen. Die häufigste Indikation stellen Tachyarrhythmien mit Herzinsuffizienz des Fetus dar. (shrink)

This special issue of the Journal of Medicine and Philosophy focuses on unintended intrauterine death (UID) and preterm delivery (both phenomena that are commonly—and unhelpfully—referred to as “miscarriage,” “spontaneous abortion,” and “early pregnancy loss”). In this essay, I do two things. First, I outline contributors’ arguments. Most contributors directly respond to “inconsistency arguments,” which purport to show that abortion opponents are unjustified in their comparative treatment of abortion and UID. Contributors to this issue show that such arguments often rely (...) on a grossly oversimplified picture of abortion opponents’ views. Furthermore, contributions in this issue weigh in on issues regarding UID with theoretical import and therapeutic implication beyond the inconsistency argument debate. These papers can be mined for principles that better inform us about anembryonic pregnancies (i.e., nonviable pregnancies in which a gestational sac exists but no embryonic pole can be seen via transvaginal ultrasound), UID-prevention research, the law concerning UID (especially post-Dobbs), policies for handling embryonic remains, and moral psychology as it relates to UID, emotion, and empathy. In each case, conceptual philosophical analysis might bring about therapeutic benefits for those affected by UID. Philosophers, therefore, are in position not only to provide clarity—careful analysis and discussion of UID and related phenomena—but are also in position to genuinely help people affected by UID. L’article examine l’utilisation du dessin pour un adolescent en thérapie selon trois axes : un mouvement régrédient de reprise de modalités subjectives précoces, sensori-rythmiques, l’expérimentation transitionnelle du squiggle et enfin l’ouverture vers une pensée figurative. La coconstruction créative des enveloppes psychiques, l’introjection d’un objet contenant seront le fil rouge de l’étude de ce processus.

Zur Verbesserung der Begutachtungspraxis muss die Prüfung von Forschungsvorhaben durch Ethikkommissionen als Abwägungsprozess verstanden werden. Die übergeordnete Aufgabe von Ethikkommissionen besteht darin, im Spannungsfeld von Therapie und Forschung möglichst hohen Schutz für Patientinnen und Patienten zu gewährleisten. Die naturwissenschaftliche Forschungsmethodik muss durch das Ziel der Therapie „gezähmt“ werden.

Dans la clinique psychanalytique des « pathologies de contenant généalogique », le processus narratif en thérapie familiale psychanalytique permet l’émergence d’un néocontenant narratif. Dans cet article, l’auteur part d’une séquence de thérapie familiale psychanalytique pour présenter les notions de remaillage narratif des contenants familiaux effractés. Le néo-contenant narratif a une fonction thérapeutique d’étayage et de reprise du contenant généalogique démaillé, troué ou déchiré. C’est l’expression, au niveau topique du préconscient groupal, d’une corêverie groupale famille-thérapeutes. Cette approche témoigne d’une créativité alternative (...) par rapport à la clinique du refoulement et de l’interprétation. Elle suppose une nouvelle posture psychanalytique, celle de l’accueil et de l’étayage. L’auteur l’illustre avec un exemple mobilisant un objet médiateur narratif. (shrink)

Les auteurs, thérapeutes familiaux, rapportent un travail avec une famille pour laquelle la relation d’emprise est le mode singulier et privilégié d’interaction entre les membres. À travers des éléments cliniques, les auteurs montrent comment la relation d’emprise côtoie l’indifférenciation des membres du groupe familial, celle des générations ainsi que la violence qui en découle. Enfin cet écrit montre comment, en utilisant la vulnérabilité des analystes, elle devient vecteur de l’efficacité thérapeutique à travers le transfert et le contre-transfert.

La psychanalyse de famille et de couple prend en compte le corporel pulsionnel, les ressentis, le sensoriel, les comportements, dans le champ transféro-contretransférentiel et intertransférentiel. Dans la rencontre intersubjective, patients et thérapeutes sont dans la co-émotionalité. La médiation, fréquemment utilisée en séance familiale ou de couple, vise à mobiliser dans l’ici et maintenant des affects, des sensations, pour aller vers l’émotion partagée. Elle permet de passer de l’indicible, innommable, impensable, à la figuration, l’imaginaire, puis à l’ordre symbolique grâce au récit.

Au confluent de la narratologie et de la psychologie, le concept de narrativité est un outil thérapeutique primordial. Dans le cadre de thérapies post-traumatiques, le thérapeute est l’interlocuteur dont l’écoute soutient les fonctions de l’enveloppe narrative du patient : cette élaboration qui transforme les éléments bruts d’un réel effractant en éléments pensables puise dans la vie fantasmatique qui préexistait à l’événement traumatique. Ces « mythèmes » organisateurs sont venus nourrir la structuration de ces contes à usage privé qui se construisent (...) dans le cadre de la thérapie. Mais ce travail engage un jeu particulier où les identités du témoin, de la victime et du coupable sont floues. Patient et thérapeute se retrouvent au coeur d’une valse-hésitation d’identifications projectives qu’il est nécessaire d’analyser. (shrink)

ZusammenfassungDer Einsatz von Psychopharmaka im Altenpflegeheim unterliegt aufgrund institutioneller und struktureller Besonderheiten dieses Versorgungsbereiches, aber auch aufgrund der großen Abhängigkeit und Vulnerabilität eines großen Teils der Altenpflegeheimbewohner in besonderer Weise der Gefahr, in inadäquater und missbräuchlicher Weise durchgeführt zu werden. Die Beachtung der ethischen Grundprinzipien des Wohltuns und des Nichtschadendürfens sowie des Respekts vor der Autonomie der Bewohner (bzw. der Patienten) sollte für alle an der Versorgung unmittelbar und mittelbar Beteiligten handlungsleitend sein. Zum Schutz der Heimbewohner, aber auch mit dem (...) Ziel die Versorgungsqualität in diesem Bereich nachprüfbar zu verbessern, werden in diesem Beitrag Kriterien zur Definition einer inadäquaten bzw. adäquaten Anwendung von Psychopharmaka explizit formuliert, sowie deren Implementierung in prozessorientierte Handlungsalgorithmen und Behandlungsleitlinien vorgeschlagen. Darüber hinaus sollen die Möglichkeiten und Grenzen nicht-pharmakologischer, psychologischer Interventionen als Alternative zur Psychopharmakamedikation diskutiert und hinsichtlich ihrer ethischen Implikationen reflektiert werden. Les problèmes qui se posent autour de l’argent vont donc recouper à plusieurs titres ceux qui sont posés dans les relations entre les générations. This study argues that the effect envisaged by the Christian sacrament of the sick consists of the healing of the rupture provoked by scientific medical procedures. The anointing of the sick re-establishes the fundamental unity of the human person as a symbolic completion of what other partial procedures may have begun to do as a result of illness : a symbolic completion that marks the Christian for the resurrection. We begin by highlighting the placebo as an ally of the medical (...) sciences, while noting that research on placebos points to the importance of ritual performance in treatment as well as the reformulation of the mind-body dualism. Then, in order to develop the dialectic between rite as therapy and therapy in its ritual aspects, we report on two complementary contributions : one from a specialist in ritual studies, Ronald L. Grimes, and the other from a theologian, Andrea Grillo. The utopian key of Gregory Baum is added, understood as a — reflexive — second-order discourse in relation to the first-order — symbolic, ritual and performative — articulation of the sacrament of anointing of the sick. The latter thus appears as a symbol of the future, that is, as an anticipation of eschatological salvation in the marking of the believer’s body for the resurrection. (shrink)

Here, I argue that Wittgensteinian therapy is what G. Lakoff and M. Johnson have (...) termed a “structural metaphor”. Thus we do not only obtain a better understanding of Wittgenstein’s metaphilosophy, but also of the role metaphor use plays within his methodology. I shall try to show that he uses therapeutic metaphors (akin to pictorial elements) as argumentative and epistemological devices and thereby investigates the philosophically problematic expression ‘philosophy’ grammatically. L’analyse des relations d’argent dans les cures psychanalytiques en couple reste souvent trop superficielle. La double fonction à la fois réelle et symbolique de l’argent suscite de faciles résistances coalisées entre les deux partenaires avec parfois une complicité du thérapeute. L’usage nécessaire de l’argent dans la réalité sert à masquer son rôle prépondérant dans les jeux de relation et notamment de pouvoir. Dépasser ces résistances implique d’analyser l’argent dans sa fonction de signifiant fondamental du lien de couple et en particulier (...) le croisement inconscient des représentations que s’en font les deux partenaires, quitte à exploiter des dispositifs adaptés. The present paper intends to study Avicenna’s and Nietzsche’s approaches to the relationship between philosophy and medicine by examining their understanding of the multiple analogous meanings of “sickness” and “health” with regard to human existence. Avicenna considers philosophy itself as a form of “medicine” insofar as it can cure the soul from the sceptical doubt concerning the possibility of knowing the truth and thus create a perfect harmony between body, soul, and spirit. But in a second step, he claims that (...) earthly life itself is an “illness” that keeps us from the perfect contemplation of God as supreme intelligible object and, therefore, has to be “cured” by death. Nietzsche shares with Avicenna not only the particular interest in dietetics but also the conviction that philosophy has a deeply therapeutic dimension. However, he replaces the vertical movement of metaphysical ascension towards absolute, divine truth with the horizontal journey of philosophical transformation that allows each human being to find their own inalienable concept of “sickness” and “health” and in doing so, become their own healer. The result and the duration of an analysis depend on how quickly a patient succeeds in penetrating the resistance which prevents the unconscious data from becoming conscious. In addition to the fears that the patient brings with him into the analysis, the attitude of the analyst is a factor strengthening or weakening the fears and, therefore, the resistance. It is not primarily relevant here what the analyst says or thinks consciously, but whether he unconsciously accepts the patient and his claim (...) to happiness unconditionally. Freud s attitude towards the patient might be characterized fundamentally as „tolerance“. He recommends facing the patient indifferently and coolly. The essay proceeds to demonstrate that this conscious liberalism involves unconsciously a strict repudiation and rejection of those impulses which are tabooed by bourgeois society, especially the sexual ones. Therefore, Freud in his authoritarian and patricentric character must be recognized as a typical representative of a society, which demands obedience and subjection. This attitude creates in the patient, despite its liberalism, new fears which make it more difficult to overcome the resistance and, therefore, blocks the success of the analysis.The liberal tolerance represents at the same time a conscious relativism towards all values and an unconscious recognition of the taboos of bourgeois society. To utilize the Freudian therapy in the best possible way, it is necessary to connect it with an independent philosophy to accept unconditionally the patient’s claim to happiness and eliminating from all valuations the taboos and abstract traits. Le succès et la durée de l’analyse dépendent de la rapidité avec laquelle le malade réussit à briser la résistance qui empêche les réalités inconscientes de parvenir à la conscience. Abstraction faite des angoisses avec lesquelles le malade arrive à l’analyse, l’attitude de l’analyste est elle-même un facteur susceptible de renforcer ou au contraire d’affaiblir les angoisses et, par suite, la résistance. Ce qui importe en première ligne ce n’est pas ce que l’analyste dit ou pense consciemment, l’essentiel est de savoir si, inconsciemment aussi, il prend une attitude entièrement favorable à T égard du malade et de la prétention au bonheur de celui-ci. L’attitude de Freud à l’égard du malade peut être caractérisée d’abord par le mot de „tolérance“. Il recommande de ne pas porter de jugements de valeur, d’être indifférent et froid à l’égard du malade. L’article montre que derrière ce libéralisme conscient se cache un refus brutal, une condamnation des désirs qui sont en opposition avec les tabous de la société, spécialement les tabous sexuels. En même temps Freud se révèle un représentant typique de la société actuelle par son caractère autoritaire „patrocentrique“ qui réclame obéissance et soumission. Cette attitude, en dépit de son libéralisme conscient, crée au malade de nouvelles angoisses qui augmentent la difficulté de l’effort pour surmonter les résistances et ainsi rendent plus difficile le succès de l’analyse.La tolérance libérale avec son double visage, relativisme conscient à l’égard de toutes les valeurs et respect inconscient des tabous bourgeois, marque les limites de la thérapeutique analytique. La mise en valeur maximum de la thérapeutique Freudienne ne serait assurée que si elle était liée à une philosophie indépendante. Accepter inconditionnellement l’exigence du bonheur du malade, dépouiller toutes les valeurs de leur caractère tabou et abstrait constitueraient les traits essentiels d’une telle mise en valeur. The Indakasutta, its commentary, and sub-commentary describe and discuss the phases of intrauterine development. By adopting a terminology remarkably comparable to that of other Buddhist and non-Buddhist texts, they illustrate fundamental Buddhist teachings like the non-self view and the dependent arising. I here offer a translation of these three texts, preceded by an introductory outline of their contents.

ZusammenfassungIm Jahr 1805 bezeichnete der Arzt Jean-Étienne Esquirol eine therapeutische Methode mit dem Begriff des „moralischen Schocks“ (sécousse morale). In vorliegendem Aufsatz wird dargestellt, inwiefern im Rahmen der Entwicklung der französischen Humanwissenschaften (sciences de l’homme, science social) um 1800 der Bezug auf den terreur konstitutiv für die Formierung dieser Behandlungsmethode war. Die psychiatrische und pädagogische Diskussion über diese nicht physische Einwirkung auf den Geist (esprit) von menschlichen Forschungsobjekten und Patient_innen bezog sich dabei wesentlich auf die Frage, ob das Volk durch (...) die schockartige Aufwallung der Revolution aus den unfreien Gewohnheiten des ancien régime befreit werden könne. Nach 1800, so wird im Folgenden gezeigt, bildete sich das professionelle Selbstverständnis der psychiatrischen und pädagogischen Expertise heraus, mit der Schocks in professionell kontrollierten Settings eingesetzt werden konnten, während die heilsame Wirkung des revolutionären Schocks negiert wurde. Im Aufsatz werden hierfür vier verschiedene Perspektiven auf die pathogenen oder heilsamen Wirkungen von Schocks unterschieden. Gestützt auf publizierte Texte und Material aus den Archives nationales sowie dem Institut national de jeunes sourds wird so im Aufsatz eine politische Geschichte der Entwicklung des moralischen Schocks entfaltet und die These vertreten, dass die Entwicklung von epistemischen und therapeutischen Techniken in den Humanwissenschaften wesentlich von der Abgrenzung von revolutionärer Gewalt sowie dem humanwissenschaftlichen Wunsch nach einer stabilen Regierung getragen war.
