This work serves as an introduction to both the theoretical and practical aspects of using computers to improve the delivery of social services. Though many practitioners believe that computerization dehumanizes clients and should be avoided, John Murphy and John Pardeck demonstrate how, through a holistic approach to computer use, this problem, and others like it, can be averted. By providing practitioners the opportunity to sharpen their conceptual skills in computer technology, this book promotes a rational understanding of the possible (...) uses and limitations of computers in social service agencies. Unlike other, technically-oriented works in this field, Murphy and Pardeck's work focuses on the philosophical justification of computer use, along with the conceptual or symbolic nature of computerization. They fully illustrate how to create the organizational conditions necessary for computers to improve social-service delivery, and they do so in a manner that is easily accessible for both general classroom and professional use. Among the topics addressed are the technological world-view, Western philosophy, and knowledge; computer mediated therapy; ethical issues related to computerized service delivery; and construction of a socially responsible technology. This work will be a unique and important resource for courses in computer applications, policy analysis, and social service administration, as well as a useful reference source for human service agencies and practitioners. In this thesis I argue that what we tend to see in contemporary accounts of human service practice in the relevant literature is a ‘common-sense’ informed by a complex mix of neoliberal political and policy imperatives and various kinds of technical-rational styles of administration and management. These accounts of practice can inadvertently contribute to the problems they are meant to address and can do more harm than good. Common-sense accounts of practice also align with how human services (...) are typically regulated and they align with prevailing ways the education of human services takes place, including in universities. Consequently, the same types of problems that take place with human service practice also take place with the institutionalisation and reproduction of human services. If we are serious about achieving good practice in human services, then we need to think more clearly about what practice in human services is. <br /><br />There is a good case for articulating a theory of human service practice to inspire new and better ways of achieving good practice. The theory of good practice outlined here draws on the philosophy of Aristotle and neo-Aristotelian accounts of practice. It draws especially on Dunne who argues that a theory of practice should offer a defensible account of how we should conceptualise the stuff that human services deal with, and the sorts of knowing, action and ends that best accord with such conceptualisations. <br /><br />I argue that the beings at the centre of human services should be understood as complex, emergent, unpredictable, and ‘wicked’ in the sense that Rittel and Webber talk about. This highlights the possibility that the people, problems and practices of human services can be revealed in multiple and contrary ways. Accordingly, human services hold both promises and dangers for people and good practice is far from self-evident and is highly contestable in each individual case. <br /><br />I argue that phronesis (practical wisdom) is the way of knowing that best corresponds to and is most suited to deal with the uncertain, messy, contingent and context-dependent beings of human services, which require and deserve ongoing deliberations and good determinations on each occasion that are at the same time always tentative and remain open to other suggestions and modification especially because our knowledge may be erroneous and incomplete. I argue that good practice also requires reflexivity and value rationality to help identify and alleviate the problems associated with neoliberal approaches to practice and as an alternative to technical rationality and value neutrality. <br /><br />I make the case for praxis (good action) along with a range of other human activities including value-rational deliberation as the forms of action that best align with and are most appropriate for dealing with the ever-changing, often inexplicable and always difficult beings of human services. Praxis is in accordance with phronesis and can be understood in part as durable practice and in part as responding to each case in new ways. In particular, it involves figuring out and enacting the most desirable course of action in each instance of practice while at the same time remaining receptive to other possibilities and to doing things differently particularly because we might not always be immediately aware of what we are doing, and our actions could be doing more harm than good. <br /><br />I show that clarity about our telos will help to re-orient human services to pursuing preferred ends and securing goods that are better suited to the entities of human services compared to instrumentally designed relations between widely applicable and transferable techniques and pre-determined outcomes. I argue for the telos of youth work to be enabling young people to live the good life. Following my accounts of phronesis and praxis this orientation of human services towards more desirable and ethical purposes takes the form of a commitment that is always carefully reconsidered at the same time as determinedly pursued. However, unlike outputs that can be wholly predetermined, efficiently sought after and completely achieved, this is an end that is never fully attained. This is especially the case because there is always more that can be known and done and because there are always disagreements on the goods to be secured. <br /><br />This theory of practice should correspond to and supports the education of people for professional practice. In particular, the education of human services needs to reproduce how the beings of human services are to be conceptualised and the ways of knowing, forms of action and ends that cohere. At the same time, university-based human service education should support the development, exercise and experience of good practice-as-praxis guided by phronesis. <br />. (shrink)

Nick Bostrom’s recently patched ‘‘simulation argument’’ (Bostrom in Philos Q 53:243–255, 2003; Bos- trom and Kulczycki in Analysis 71:54–61, 2011) purports to demonstrate the probability that we ‘‘live’’ now in an ‘‘ancestor simulation’’—that is as a simulation of a period prior to that in which a civilization more advanced than our own—‘‘post-human’’—becomes able to simulate such a state of affairs as ours. As such simulations under consid- eration resemble ‘‘brains in vats’’ (BIVs) and may appear open to similar objections, (...) the paper begins by reviewing objections to BIV-type proposals, specifically those due a presumed mad envatter. In counter example, we explore the motivating rationale behind current work in the development of psychologically realistic social simula- tions. Further concerns about rendering human cognition in a computational medium are confronted through review of current dynamic systems models of cognitive agency. In these models, aspects of the human condition are repro- duced that may in other forms be considered incomputable, i.e., political voice, predictive planning, and consciousness. The paper then argues that simulations afford a unique potential to secure a post-human future, and may be nec- essary for a pre-post-human civilization like our own to achieve and to maintain a post-human situation. Long-s- tanding philosophical interest in tools of this nature for Aristotle’s ‘‘statesman’’ and more recently for E.O. Wilson in the 1990s is observed. Self-extinction-level threats from State and individual levels of organization are compared, and a likely dependence on large-scale psychologically realistic simulations to get past self-extinction-level threats is projected. This article explores Carter G. Woodson’s The Mis‐Education of the Negro in terms of its political philosophical content. It examines how Woodson’s account of the miseducation of Black people and the accordant miseducation of whites is involved in the production and reproduction of an unjust basic structure, with reference to John Rawls and Frantz Fanon. It then turns to Woodson’s critique of leadership and its relationship to miseducation, drawing on E. Franklin Frazier’s study of the Black bourgeoisie and the political (...) philosophy of Enrique Dussel. Finally, it examines miseducation as a site for the reproduction of racist knowledge production in light of the work of Anténor Firmin and examines how, for Woodson, rigor in the human sciences was essential for counteracting miseducation and serving the greater cause of liberation. One of the responses to the attacks upon the contemporary university, particularly upon the humanities, has been to encourage faculty to engage in so-called ‘public intellectualism.’ In this paper I urge philosophers to embrace this turn, but only if the academy can effectively address how to credit such work in the tenure and promotion process. Currently, public philosophy is typically placed under ‘service’, even though the work is often more intellectually and philosophically rigorous than committee work, even sometimes more than (...) publications. I address this problem by providing an analysis of what is academically valuable about good scholarship and then showing how much of public philosophy achieves those goods. From this I argue that the academy should abandon the traditional categories of teaching/research/service and replace them with a holistic and qualitative single category of “teacher-scholar.” I then recommend that evaluation criteria should be very inclusive, giving credit to the wide range of activities in which faculty participate and I provide some suggestions for how those criteria should read. Ultimately life arose in a world of dynamic organic chemistry, and complexity exploded with wondrous new potential. Fast forward to human evolution, and a tension that had existed for billions of years now played out in an unprecedented (...) arena of conscious calculation and cultural diversity. Cooperation interleaving with competition; intimacy oscillating with integrity—we dwell in a world where yin meets yang in human affairs on many levels. In The Fractal Self, John Culliney and David Jones uncover surprising intersections between science and philosophy. Connecting evidence from evolutionary science with early insights of Daoist and Buddhist thinkers, among others, they maintain that sagely behavior, envisioned in these ancient traditions, represents a pinnacle of human achievement emerging out of our evolutionary heritage. They identify an archetype, “the fractal self,” a person in any walk of life who cultivates a cooperative spirit. A fractal self is a sage in training, who joins others in common cause, leads from within, and achieves personal satisfaction in coordinating smooth performance of the group, team, or institution in which he or she is embedded. Fractal selves commonly operate with dedication and compassionate practice in the service of human society or in conserving our planet. But the competitive side of human nature is susceptible to greed and aggression. Self-aggrandizement, dictatorial power, and ego-driven enforcement of will are the goals of those following a self-serving path—individuals the authors identify as antisages. Terrorist leaders are an especially murderous breed, but aggrandizers can be found throughout business, religion, educational institutions, and governments. Humanity has reached an existential tipping point: will the horizon already in view expand with cooperative progress toward godlike emergent opportunities or contract in the thrall of corrupt oligarchs and tribal animosities? We have brought ourselves to a chaotic edge between immense promise and existential danger and are even now making our greatest choice. (shrink)

In recent times, the American Philosophical Association has been exposed in a serious way to the issue of pluralism in philosophy curriculums in the departments of philosophy of American universities and colleges. This conversation brings to the fore the fact that what is at issue in the prospect of pluralizing American philosophy departments is not merely the matter of deciding the discipline's boundaries of intellectual formation relative to the current generation of students, but the unforeseeen consequences of pluralism which challenge (...) both 'the American canon' and the profession's self-understanding vis-à-vis a 'Western' intellectual heritage that distinguishes the 'essential' from the 'marginal' by privileging essential figures, problems, and time-honored methodological commitments. Yet, to the degree that there is a quest for relation of differences, this need not presuppose the universality of philosophical discourse, comparative philosophy moving inevitably within a logic of opposition rather than a logic of mutuality. Our thinking is surely problematic if at this World Congress we find an occasion for a confrontation between 'the West' and 'the margin,' the latter construed negatively as a 'mute, growing and menacing pressure.'. Kant’s practical philosophy revolves around the concepts of pure reason, autonomy, law and obligation. But for them, terms such as humanity and self-mastery (Selbstherrschaft) are also of great importance. According to Kant, these terms concretize the reason and goal of our ethical and legal-political actions. In a first step, the meaning of these terms at the end of the four Kantian questions (What can I know? What should I do? What can I hope? What is man?) is explained. In a (...) second step, Martin Heidegger’s criticism of humanism (and thus also of Kant) is presented and in a third step the consequences that his view of thinking has for law and politics are discussed: Heidegger’s thinking stands with his negation of philosophy, ethics and science in the service of a politics of immaturity. One of the first kidney grafts in the world (with short-term success), in 1953, and the first dialysis session in France, in 1955, were performed under his guidance. His achievements as a writer were at least comparable: Hamburger was awarded several important literary prizes, including prix Femina, prix (...) Balzac and the Cino del Duca prize (1979), awarded, among others, to Jorge Luis Borges and Konrad Lorenz.Here we would like to offer a selected reading of a "golden" book, "Conseils aux etudiants en medicine de mon service" ("Advice to the Medical Students in my Service"), the first book dedicated to patient-physician relationship in Nephrology, written when dialysis and transplantation were becoming clinical options (1963). The themes include: the central role of the patient, who should be known by name, profession, life style, and not by disease; the importance of the setting of the care; the need for truth-telling and for leaving hope; the role of research not only in the progression of science, but also in the daily clinical practice. Two lecture styles were examined to determine which was more effective for enhancing content learning in college students. The same experienced guest lecturer presented information about bipolar disorder (a combination of depression and mania) to college students in human service-related fields. Students in classes assigned to the control group received a standard, didactic lecture. In classes assigned to the experimental group, the presenter began the lecture by informing the students that she had bipolar disorder and enhanced the standard didactic (...) lecture by interspersing descriptions of her personal experiences living with bipolar disorder. Content-specific pre-tests and post-tests developed by the researchers were used to compare acquisition of knowledge about the disorder across groups of students. Results showed that students who received the personal/experiential lecture acquired significantly more knowledge about bipolar disorder than did students who received the standard, didactic lecture. Theories and procedures that may enhance student learning and thinking in related areas are discussed. (shrink)

This article is guided by principles and practices of bioethics and public health ethics focused on health care reform within the context of promoting Optimal Health. The Tuskegee University National Center for Bioethics in Research and Health Care is moving beyond the traditions of bioethics to incorporate public health ethics and Optimal Health. It is imperative to remember the legacy of the ill-fated research entitled Tuskegee Study of Untreated Syphilis in the Negro Male. Human participant research and health care (...) must be connected to principles of bioethics and public health ethics if the Affordable Care Act is expected to positively impact on the health of people living in the United States. Optimal Health describes a strategy to achieve individual and population health. Health care reform offers an opportunity to shift from the traditional pathology focus of managing diseases to target disease prevention and health promotion with a new set of tools. Transformational change is possible if the lessons learned from the U.S. Public Health Service Syphilis Study at Tuskegee are considered and strategies in bioethics and public heath ethics are employed. This article provides a review of sociology student’s reflection papers discussing their service-learning hours with the College Brides Walk (CBW). CBW is a campus-community collaboration in its fifth year. Based in South Florida, the initiative is intended to help raise awareness about domestic and dating violence and to inspire a community response. It is designed as a form of Human Rights Education (HRE). Student papers show that most gained knowledge of sociological concepts and theories as well as personal insights (...) through their participation. Many also expressed desire for continued effort with this or related initiatives. Despite these positive findings, the paper shows that there are significant differences in how students connect their service to course material and gaps in students’ ability to articulate what has been learned. Recommendations for organizers and others involved in similar campaigns are provided. (shrink)

The article examines the place and role of the conception of the so-called educational services in the Russian legislation, which is one of the topical ideological problems of modern Russian educational policy. The author argues that the discussion of this issue in Russian society, in scientific publications and media as well as in government structure does not have a purely theoretical content but includes the most important practice-oriented aspects and raises the issues of the goals of education, of the (...) essence of the evolving system of educational relations, and, moreover, of the nature of the social system that has developed in Russia in general. According to the author, the conception of services is largely based on the desire to exclude the human factor from education, and it contradicts the specificity of educational relations, which implies the influence of a person on a person, the formation of a person by a person. The main content of the article is the analysis of alternative bills aimed at partial or complete exclusion of the conception of educational services from the legislation. The article analyzes the history of the issue, the arguments of supporters and opponents of the conception of educational services, as well as the parliamentary struggle and its results. The author substantiates that the discussed amendments to the Federal Law On Education in the Russian Federation is at best a half-way solution to the problem, and the work to improve federal legislation in this direction should be continued. Environmental ethics has persistently aspired to be public philosophy. The decades between the philosophers’ crisis of conscience and present‐day activities witnessed a proliferation of professional practices that blur the boundaries between public and academic philosophy, between what environments are worthy of moral consideration and which are mere human artifacts, and between what we call philosophy versus anthropology, or educational research, or sustainability science. The authors also focus on currents motivated by “wicked” environmental problems, practiced in the “field,” and advanced (...) in service to environmental justice. In contemporary positive law there are legal institutions, such as conscientious objection in the context of military service or “conscience clauses” in medical law, which for the sake of respect for judgments of conscience aim at restricting legal obligations. Such restrictions are postulated to protect human freedom in general. On the basis of Thomas Aquinas’ philosophy, it shall be argued that human dignity, understood as the existential perfection of a human being based on special unity, provides a (...) foundation for imposing limitations on the scope of legal obligations in general. Human freedom plays a crucial role in understanding dignity as perfection based on the special individuality of a personal being, which in turn is based on the free choice to pursue a unique way of life. Therefore, Aquinas’ argumentation is, at its core, liberal – the perfection rather than the imperfection of a human being underlies the requirement to limit legal obligations. Dignity understood as the special unity of a person also provides the basis for limiting obligations in the case of conscientious objection; however, in that case, such limitations aim at safeguarding internal integrity rather than the individualisation of a given way of life. _This project was financed with funds from the National Science Centre allocated on the basis of the decision number DEC-2013/09/B/HS5/04232._. Non-institutional humanities, philosophical practice, and informal education are “a family like” phenomena that are outside the social institution of science and education and are adjacent to socio-cultural activities and social work. The purpose of the article is to outline the contours of the informal educational creative industry in the postmodern society, which combines non-institutional humanities, philosophical practice, and informal education. Methods. The author uses the methods of autobiographical reflection, comparative analysis, empirical observation and analysis of the primary sources of (...) non-institutional humanities. Scientific novelty of the research. The transition to nonmaterial work of the postmodern era is the reason for the relevance of the area under study. The growing demand of a contemporary for such issues as the meaning of life, happiness, the growth of the precariat, the ousting of philosophy from formal education constitute a new social reality that determines the novelty of the research in the informal educational creative industry. Results. The author classifies non-institutional humanities according to the spheres of its existence and the strategies of subject genesis presented in the teachings. The concept of dedifferentiation is considered as an explanation of the area under study in postmodernism. The specificity of the philosophical approach in the work of a practicing philosopher is considered. Conclusions. The author connects the prospects of the informal educational creative industry with institutionalization in the way of leisure, entertainment, and other personal services. The American Society for Bioethics and Humanities poses a chal­lenge in Core Competencies for Healthcare Ethics Consultation: health care ethics consultation services “should be able to demonstrate their value to those who pay for the service, as well as to those whom the service is intended to serve.” To respond to this challenge, this article provides a brief review of the literature on evaluating ethics consultation in its traditional frameworks of quality outcomes. The author follows this discussion with a (...) new methodology to evaluate ethics consultation on the basis of the intrinsic good of the service. Are humans rational? Various experiments performed over the last several decades have been interpreted as showing that humans are irrational we make significant and consistent errors in logical reasoning, probabilistic reasoning, similarity judgements, and risk-assessment, to name a few areas. But can these experiments establish human irrationality, or is it a conceptual truth that humans must be rational, as various philosophers have argued? In this book, Edward Stein offers a clear critical account of this debate about rationality in philosophy (...) and cognitive science. It may be commonplace hearing people accuse the discipline of philosophy of irrelevance, especially when it comes to societal issues. Hannah Arendt, a contemporary political thinker, remarked that philosophy and political action are irreconcilable spheres of thought—that the space for contemplation is nowhere near the space for action. Granting Arendt’s observation, how can philosophy courses cross the chasm brought about by disciplinal borders? How can philosophy classes help produce active and more engaged citizens? In this paper, I dispute the former (...) claim by way of undertaking two tasks. First, to lay down the groundwork, I provide a philosophical analysis that underlines Hannah Arendt’s political position and most important ideas, particularly those that surface in one of her greatest works, “The Human Condition.” Second, I point out how Arendt’s notions inspire some practices in education and pedagogy, thus paving the way for a genuine application of a philosophical theory to society. By drawing on experiences in teaching philosophy by employing social reconstructionist education and its corollary pedagogical tool, service-learning, this paper hopes to bring back some space to a reconsideration of philosophy as a relevant discipline in society, particularly in education. In the end, I conclude that philosophy and action, contrary to the claim of Arendt herself, are fully compatible. In doing philosophy, the germ of genuine action may be found. (shrink)

This text aims to rethink educational activity inspired by the thought of the philosopher Ignacio Ellacuría, in what we have synthesised as a pedagogy of poverty. This should be understood as a pedagogy that, in the neoliberal context of Western societies, takes poverty as its motor—its efficient cause—and as its essence or fundamental structure—its formal cause –, in the duality of dimensions of its genitive. It is concretised in what is presented as Problem-Based Service-Learning (PB-SL). Through specific pedagogical guidelines for (...) implementing this methodology, this study indicates how the teaching action can show the learner what is immediate, what is not constructed, what consciousness does not establish but rather encounters: reality—weak, limited, imperfect, needy; in short, poor—as a problem and, in its deficiency and insufficiency, as a task towards which the subject has a responsibility. This reveals the fundamental anthropological structure to the learner: its intrinsic relational character—its reality as a being-in-a-suffering-world, who lives-with and lives-to save the needy who share its humanity. It is then possible to perceive the scale of the ultimate aim of PB-SL: the need to create the social conditions for a praxis that enables a dignification of reality. (shrink)

Recent discussions in the various circles of feminism, postmodernism, and environmentalism have begun to make clear that ontology and epistemology without ethics is deadly - oppressive to women, oppressive to men, oppressive to the earth. In response to this crisis of reason in modernity, this collection of essays suggests the importance of knowing other-wise, non-rational ways of knowing which are wise to the "other" - a spiritual knowing of the heart with the passionate eye of love. Knowing Otherwise calls into (...) question the Western philosophical tradition of giving pride of place to reason in the acquisition of knowledge. Reasoning is only one of many ways in which we engage, i.e. know, the world. We know more than we think. We know by touch, by feel, by taste, by sight, by sounds, by smell, by symbols, by sex, by trust - by means of every modality of human experience. Philosophy becomes, in the fashion of Levinas, "the wisdom of love at the service of love. Tracing connections between epistemology, ethics, and spirituality - between "knowing" and the "other," between an other and the Other - all the essays serve as points of convergence between postmodern discussions and the Calvinian spirituality which is the home for writers in this collection. In particular, this collection explores the contributions of feminist thought and thinkers such as Emmanuel Levinas, Richard Rorty, Jacqes Derrida, and John D. This article aims at giving insight into Norwegian mental health service by exploring the ideologies of two diametrical philosophers, the American Robert Nozick (1938–2002) and the German Axel Honneth (1949‐). Nozick proposes as an ideal a minimal state in which citizens have a “negative right” to the absence of interference and to follow their own interests without restriction from the state. On the other side, Axel Honneth claims that there is no freedom without state interference. In his view, governmental involvement (...) is understood as a prerequisite for personal freedom. We may call this state an opposite of the minimal state; a maximal state. To get a better understanding of these opposite philosophies, we use texts written from conversations with people suffering from mental health problems, nurses and other caregivers in four Norwegian municipalities. Nozick's notion of the minimal state and Honneth's political philosophy of freedom and recognition were used as analytical tools. Among patients and helpers, there were different opinions about good care and how much caregivers should intervene. Some emphasized autonomy, independency, minimal involvement in human contact by nurses and other caregivers, similar a minimal state. Others perceived good care as bonding between helpers and service‐users. They underlined equal and personal relationships, as well as helping with practicalities, similar a maximal state. In the discussion, we focus on how people with chronic illnesses are supposed to transform themselves into self‐cared individuals, able to manage their own condition successfully with minimal help from public welfare and at a lower cost. Finally, we express concerns about who will care for disempowered patients without family and other resources in a minimal state. (shrink)

In patient care, the judicial doctrines of consent and informed (...) consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. As our work is ever evolving from agrarian to more service-oriented tasks, the rise of machine learning is the advent of an intelligence that contrasts with the natural intelligence exhibited by humans.
