In nonstandard measure theory the standard part map is very useful to represent standard measures by Loeb measures. We give here a different method of representing measures using the concept of a σ -homomorphism. As an application a measure extension theorem is derived. Finally a nonstandard proof of a result of Pták is given showing that his assumption of nonmeasurable cardinality is redundant.

Decision-making capacity is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs from (...) existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)

This article argues that many (often Anglophone) interpreters of the Deduction have mistakenly identified Kant's aim as vindicating ordinary knowledge of objects and as refuting Hume's (alleged) skepticism about such knowledge. Instead, the article contends that Kant's aims were primarily negative. His primary mission (in the Deduction) was not to justify application of the categories to experience, but to show that any use beyond the domain of experience could not be justified. To do this, he needed to show that their (...) proper use in attaining metaphysical knowledge was restricted to (actual and possible) experience. The central theoretical claims of previous metaphysics were thus rendered void. Kant was not out to save ordinary knowledge from the skeptic, at least not originally, since he did not think such knowledge was in danger. Rather, he wanted to sustain the skeptical claim that we cannot justify metaphysical claims about things in themselves, hence that we cannot gain metaphysical knowledge about the existence of God, the immortality of the soul, the beginning of time, and the least parts of matter. He wanted to achieve this result in a more theoretically satisfying manner than had skeptical authors. Doing so would also allow him to curb certain forms of skeptical empiricism, by showing that we cannot disprove, or rule out as unintelligible, human freedom, an afterlife, or divine providence. The article ends by considering the retrospective rereadings of the Deduction by Hermann Cohen and P. F. Strawson, concluding that these rereadings force Kant's text into an alien mold, thereby diminishing its philosophical value as a work with its own distinctive aims and methods. (shrink)

This book offers a new interpretation of Hermann von Helmholtz's work on the epistemology of geometry. A detailed analysis of the philosophical arguments of Helmholtz's Erhaltung der Kraft shows that he took physical theories to be constrained by a regulative ideal. They must render nature "completely comprehensible", which implies that all physical magnitudes must be relations among empirically given phenomena. This conviction eventually forced Helmholtz to explain how geometry itself could be so construed. Hyder shows how Helmholtz answered (...) this question by drawing on the theory of magnitudes developed in his research on the colour-space. He argues against the dominant interpretation of Helmholtz's work by suggesting that for the latter, it is less the inductive character of geometry that makes it empirical, and rather the regulative requirement that the system of natural science be empirically closed. Assuming that there is moral progress, and assuming that the abolition of slavery is an example of it, how does moral progress occur? Is it mainly driven by specific individuals who have gained new moral insights, or by changes in the socio‐economic and epistemic conditions in which agents morally judge the norms and practices of their society, and act upon these judgements? In this paper, I argue that moral progress is a complex process in which changes at the level of (...) belief and changes at the level of institutions and social practices are deeply intertwined, and that changes in the socio‐economic and epistemic conditions of moral agency constitute the main motor of moral progress. I develop my view of moral progress by way of grappling with Michelle Moody‐Adams’ prominent philosophical account of it. My view is less intellectualistic and individualistic than hers, does not presuppose meta‐ethical moral realism, and blurs her distinction between moral progress in beliefs and moral progress in social practices. I point out the limits of humans to progress morally, which are partly grounded in our evolutionary history, and argue that moral progress is always of a ‘local’ nature. (shrink)

Introduction This paper is an attempt to apply René Girard's mimetic theory to the origins of historical writing, specifically the composing ofIsrael's story, vis- à-vis the origin of kingship. What I do not intend to deal with is the exact chronological beginning of historical narrative in ancient Israel. Whether or not this sort (...) of writing began immediately, it is quite clear that kingship is a problem in a way that no other office or role was in the scriptural texts. In the study of Israelite historiography and Israel's understanding of history there are many issues that have been discussed and debated. Among English speaking scholars the works of John Van Seters have been, in recent years, the most widely read on this topic.l Van Seters himself argues that the "Court History" or "Succession Narrative" in 2 Samuel and the Yahwist (J) narrative ofthe Pentateuch, or Torah, which scholars have commonly thought to be the oldest ancient Israelite history works, were composed in the exilic period (after c. 586 B.C.E.) subsequent to the completion of the "Deuteronomic work" (Josh., Judg., Books of Sam., Books of Kings). A Greek model of history writing was by then known and used by the authors of these histories previously and wrongly understood to be so old. However, prior to these historical works influenced by a Greek model was the work ofthe Deuteronomist, i.e., the books ofJoshua through Samuel, which integrated various earlier sources and traditions into a view of Israel's past that was informed by a definite theology ofhistory. This history is that of "the first known historian 1 In his approach to the texts Van Seters does not deal with any of the questions raised in the recent readings and hermeneutic approaches informed by literary theory. 92James G. Williams in Western civilization truly to deserve that designation" (Van Seters, "Search" 362). My purpose is not to argue with most of Van Seters's conclusions. In my judgment he is right to question the thesis of Hermann Gunkel and Gerhard von Rad that history writing evolved from earlier legend (Saga). I likewise agree that although there are many parallels among Israelite, Mesopotamian, Egyptian, and Hittite texts (including divine intervention in history, as shown by Bertil Albrektson), one still does not find among these other peoples a genre that could be called historiography. Van Seters borrows Johan Huizinga 's definition of history as "the intellectual form in which a civilization renders account to itself of its past" ("Search" 1). I think the definition is helpful but it lacks both a generative center and a delimitation of literary form. I propose that it be changed by extending it in two respects: (1) The intellectual form of self-understanding is rooted in the sacred as its primary problematic. In this essay I will try to show that the beginning of history writing in ancient Israel both starts from and attempts to break from the ancient sacred order as mediated through the sacral institution ofkingship. (2) Concerning literary form, history in the sense intended here requires a narrative about a nation and specific individuals (even if the divine and miracles are part of this world) that is long and continuous enough to form a coherent picture ofthe significant past. There was clearly no writing like that prior to Israelite historiography. I think the main problem in Van Seters's approach is that he misses the impulse ofhistory writing. That impulse is kingship. I don't mean this simply in the older sense, going back to L. Rost and Gerhard von Rad, that history writing begins with the cultural efflorescence that emerged in the reign of Solomon (c. 960-922 B.CE.) and used even earlier sources stemming from the period of David's rule (c. 1000-960 B.CE.).2 Kingship was, rather, an office created by the fundamental dynamic of culture, namely the sacred and its mechanisms. Corporate governance scholarship focuses on executive malfeasance, specifically its antecedents and consequences. Academic efforts primarily focus on prevention while practitioners are often left to hold firms and executives (including directors) accountable through a variety of sanctions. Even so, executive malfea­sance still occurs even in the face of the vast resources used to monitor, control, and penalize firms and executives. In this paper, we posit equity markets do not adequately penalize firms for inaccurate earnings reports. Using a sample of 129 firms (...) identified by the U.S. General Accounting Office for reporting fraudulent earnings in 10K filings, we found support for our assertion. Consequently, the one party who may benefit but escape accountability is firm shareholders. Moreover, we find little empirical evidence that the subset of firms sanctioned by the SEC is penalized more heavily than the full sample by markets at the time they report and correct their 10K filings. Our results raise serious questions whether such mana­gerial opportunism can be eradicated given the apparent lack of consequences in equity markets for investors. We also question whether the SEC is able to discern between fraud and error in financial reporting and its implications. (shrink)

The drawback of the substantial opportunities AI systems and applications provide in marketing are ethical controversies. Building on the literature on AI ethics, the authors systematically scrutinize the ethical challenges of deploying AI in marketing from a multi-stakeholder perspective. By revealing interdependencies and tensions between ethical principles, the authors shed light on the applicability of a purely principled, deontological approach to AI ethics in marketing. On Moral Certainty, Justification and Practice presents a view of morality that is inspired by the later Wittgenstein. Hermann explores the ethical implications of Wittgenstein's remarks on doubt, justification, rule-following, certainty and training, offering an alternative to interpretations of Wittgenstein's work that view it as being intrinsically ethical. The book scrutinises cases in which doubt and justification do not make sense, and contrasts certain justificatory demands made by philosophers with the role of moral justification in concrete situations. It offers (...) an account of moral certainty, which is linked to a view of moral competence. Contrary to the views propounded by philosophers who emphasise the importance of moral principles, it is argued that moral agency is first and foremost a matter of having certain capacities. The book takes an anti-intellectualist stance and remains close to concrete practices. The practice-based view of morality it endorses has implications for moral education, intercultural moral dialogue and the prospects for moral agreement, change and progress. (shrink)

First published in 1749, Hartley's great work was abridged by Priestley in 1775 and reissued as a whole by Joseph Johnson in 1791. To Priestley, who founded his Unitarianism on the Observations, it seemed that Hartley was the greatest of human beings with the single exception of Jesus. Coleridge adopted his associationist theology in the mid 1790s, naming his eldest son David Hartley Coleridge, and passing on to Wordsworth the theory of mind that underlies 'Tintern Abbey', the early Prelude and (...) the 1800 Preface to Lyrical Ballads. This book is the scholarly & fully annotated edition of the award-winning _The Illustrated To Think Like God.__ _To Think Like God_ focuses on the emergence of philosophy as a speculative science, tracing its origins to the Greek colonies of Southern Italy, from the late 6th century to mid-5th century B.C. Special attention is paid to the sage Pythagoras and his movement, the poet Xenophanes of Colophon, and the lawmaker Parmenides of Elea. In their own ways, each thinker held that (...) true insight, whether as wisdom or certainty, belonged not to mortal human beings but to the gods. The Pythagoreans sought to approach this otherwordly knowledge by studying numerical relationships, believing them to govern the universe, and that those who know the number of a thing know its true nature. Yet their quest was a hopeless one, bogged down by cultism, numerology, political conspiracies, bloody uprisings, and exile. Above all, number did not turn out as the most reliable of mediums; it was certainly not a key to the realm of the divine. Thus, their contributions to philosophy's inception, while much better-publicized, was not the most significant. That particular role was reserved for an unusual challenge and the elaborate reaction it provoked. The challenge came from Xenophanes, who had argued that reliable truth was beyond mortal reach, because even if by accident a human being should state what is exactly the case, he had no way of knowing that he did, all things being susceptible to opinion. This dilemma is sure to have bothered a legislative mind like that of Parmenides, and we find him introducing techniques for testing the veracity of statements. These methods were meant to be carried out by reasoning and argument alone, without relying in physical evidence or mortal sense-perception, which was deemed untrustworthy. Reason was that one faculty shared by gods and humans alike. In time, Parmenides' ingenious arguments have earned him the titled of the first logician and metaphysician whose influence on subsequent thinkers was immeasurable. Parmenides taught us that philosophy was not about claims but about proof, which also makes him the father of theoretical science -- which, curiously, began as a quest into the mind of God. Was bringt einen Menschen dazu, sich auf das einzulassen, was man "Glauben" nennt, sein Leben also auf anderes zu setzen als auf das, dessen man sich verfügend sicher sein kann? Hermann Pius Siller macht deutlich: In der Theologie ist die Beachtung der eigenen Lebenserfahrung und der Lebenserfahrung des Gesprächspartners unverzichtbar. Für das, was das Wort "Gott" benennen soll, muss eine bestimmte Erfahrung beschrieben werden können. Mit "Gewissen", "Geheimnis" und "reine Gabe" benennt er dabei exemplarisch drei elementare Zugänge zu "letzten (...) Erfahrungen", wie sie im Leben von John Henry Newman, Karl Rahner und Paulus von Tarsus gemacht, gelebt und theologisch durchdacht wurden. Vor dem Hintergrund der gegenwärtigen Gottes- und Kirchenkrise, also der fehlenden Glaubwürdigkeit kirchlicher Rede von Gott in der Gesellschaft, leistet er damit einen wichtigen Beitrag verantworteter, die lebensgeschichtlichen Voraussetzungen berücksichtigender Gottesrede. Hermann Pfütze und Christoph Menke stellen in dem Podiumsgespräch die Frage nach den widerständigen Potentialen der Kunst. Was ist das Spezifische der Kunst gegenüber anderen sozialen Feldern oder Praxisformen? Was lässt sich unter Ästhetischem Widerstand genau verstehen? Auch wenn die Kunst nicht über Gewaltmittel verfügt, so könnte es doch einen Wettstreit um die Idee der Kunst geben. Ästhetischer Widerstand ist dann der Widerstand einer Kunstform gegen eine andere. Oder ist die ästhetische Erfahrung gerade nicht antagonistisch organisiert? Dann könnte Kunst (...) als eine heilende Praxis erscheinen, die anderen Antagonismen entgegenwirkt und so Angst und Schrecken bannt. Nach Hermann Pfütze weist das Ästhetische eine Nähe zur Demokratie auf, da Kunst wie Demokratie die Unabgeschlossenheit der Welt betonen und von Angst und Schrecken befreien wollen. Dieser an Judith Shklar gewonnene Demokratiebegriff ist für Christoph Menke zu defensiv. Kunst scheint für Menke in unserer Gegenwartsgesellschaft eher der spezifische Ort eines utopischen Potentials zu sein, denn die Kunst kritisiert durch ihren Versuch der Darstellung von Lebendigkeit unbelebte Praxisformen, wie etwa die entfremdete Arbeit. The article explores the construction of boundaries, alterity and otherness in modern science-fiction films. Boundaries, understood as real state borders, territoriality and sovereignty, as well as the construction of the other beyond an imagined border and delimited space, have a significant meaning in the dystopian settings of SF. Even though SF topics are not bound to the contemporary environment, be it of a historical, technical or ethical nature, they do relate to the present-day world and transcend our well-known problems. Therefore, (...) SF offers a pronounced discourse about current social challenges under extreme conditions such as future technological leaps, encounters with the alien other or the end of the world. At the same time the genre enables us to play through future challenges that might really happen. Films like Equilibrium, Code 46, Children of Men and District 9 show that in freely constructed cinematic settings we are not only unable to escape from our border conflicts, but quite the contrary, we take them everywhere with us, even to an alternative present or into the future, where new precarious situations of otherness are constructed.
