What are we to make of Western Buddhism? Glenn Wallis argues that in aligning their tradition with the contemporary self-help industry, Western Buddhists evade the consequences of Buddhist thought. This book shows that with concepts such as vanishing, nihility, extinction, contingency, and no-self, Buddhism, like all potent systems of thought, articulates a notion of the "real." Raw, unflinching acceptance of this real is held by Buddhism to be at the very core of human "awakening." Yet these preeminent human truths (...) are universally shored up against in contemporary Buddhist practice, which contradicts the very heart of Buddhism. The author's critique of Western Buddhism is threefold. It is immanent, in emerging out of Buddhist thought but taking it beyond what it itself publicly concedes; negative, in employing the "democratizing" deconstructive methods of François Laruelle's non-philosophy; and re-descriptive, in applying Laruelle's concept of philofiction. Through applying resources of Continental philosophy to Western Buddhism, A Critique of Western Buddhism suggests a possible practice for our time, an "anthropotechnic", or religion transposed from its seductive, but misguiding, idealist haven. How have we come by our worldviews, and what influence did Christianity have on those that are common to Western civilization?

According to philosophical orthodoxy, the parties to moral or legal disputes genuinely disagree only if their uses of key normative terms in the dispute express the same meaning. Recently, however, this orthodoxy has been challenged. According to an influential alternative view, genuine moral and legal disagreements should be understood as metalinguistic negotiations over which meaning a given term should have. In this paper, we argue that the shared meaning view is motivated by much deeper considerations than its recent critics recognize, (...) and that much would be lost in opting for the explanation of normative disputes as metalinguistic negotiations. ABSTRACTWhat does it take for lawyers and others to think or talk about the same legal topic—e.g., defamation, culpability? We argue that people are able to think or talk about the same topic not when they possess a matching substantive understanding of the topic, as traditional metasemantics says, but instead when their thoughts or utterances are related to each other in certain ways. And what determines the content of thoughts and utterances is what would best serve the core purposes of (...) the representational practice within which the thought or utterance is located. In thus favoring a “relational model” in metasemantics, we share Ronald Dworkin's goal of explaining fundamental legal disagreements, and also his reliance on constructive interpretation. But what we delineate is a far more general and explanatorily resourceful metasemantics than what Dworkin articulated, which also bypasses some controversial implications for the nature of law that Dworkin alleged. According to H.L.A. Hart's analysis, to utter an internal legal statement is partly to express an acceptance of a set of norms. This article attempts to defend Hart's conception of internal legal discourse by responding to the following three lines of criticism that can be found in Joseph Raz's writings: (i) that Hart's analysis fails to account for what Raz calls ‘detached legal statements’; (ii) that Hart's deployment of the notion of acceptance in his analysis vitiates his legal positivist project (...) because such acceptance necessarily amounts to moral endorsement; and (iii) that Hart is wrong to assume that normative practices, including discursive legal practices, can be characterized satisfactorily by deploying only descriptive statements. I argue that Hart's theory, or at least a theory along the lines that Hart developed, has sufficient resources to handle satisfactorily these criticisms. His world is a noonday world in which sharply outlined figures, most of them more than a little singular, act in describable ways against perceptible backgrounds. Understood one way, the branch of contemporary philosophical ethics that goes by the label “metaethics” concerns certain second-order questions about ethics—questions not in ethics, but rather ones about our thought and talk about ethics, and how the ethical facts (insofar as there are any) fit into reality. Analogously, the branch of contemporary philosophy of law that is often called “general jurisprudence” deals with certain second-order questions about law—questions not in the law, but rather ones about our thought and talk about (...) the law, and how legal facts (insofar as there are any) fit into reality. Put more roughly (and using an alternative spatial metaphor), metaethics concerns a range of foundational questions about ethics, whereas general jurisprudence concerns analogous questions about law. As these characterizations suggest, the two sub-disciplines have much in common, and could be thought to run parallel to each other. Yet, the connections between the two are currently mostly ignored by philosophers, or at least under-scrutinized. The new essays collected in this volume are aimed at changing this state of affairs. The volume collects together works by metaethicists and legal philosophers that address a number of issues that are of common interest, with the goal of accomplishing a new rapprochement between the two sub-disciplines. The nature of the relation between jurisprudential theories and first-order legal judgments is a strangely uncontroversial matter in contemporary legal philosophy. There is one dominant conception of the relation according to which jurisprudential theories are second-order or meta-legal theories that specify the ultimate grounds of first-order legal judgments. According to this conception, difficult first-order legal disputes are to be resolved by jurisprudential theorizing. According to an alternative conception that Ronald Dworkin has influentially advocated, jurisprudential theories are not second-order theories about (...) the nature of law, but instead covert first-order legal theories. These two conceptions of the relation between jurisprudential theories and first-order legal judgments dominate the contemporary legal philosophical scene and crowd out other possible conceptions. This article scrutinizes the two conceptions, and in the process raises the possibility of a different and arguably more credible conception. According to this new conception, our first-order legal views and a jurisprudential theory that we accept are supposed to form a mutually disciplining and supporting set of views that we accept in our pursuit of the epistemic ideal of wide reflective equilibrium. The two sets of views are supposed to constrain and discipline each other; but neither is meant to underwrite, certify, or ultimately determine the contents of the other. This new conception, which allows the relation between jurisprudential theories and first-order legal judgments to be much looser, untidier, and more complex than what the two dominant conceptions imply, should facilitate progress in legal philosophy and in first-order legal thinking. I compare Frith and colleagues’ influential comparator account of how the sense of agency is elicited to the multifactorial weighting model advocated by Synofzik and colleagues. I defend the comparator model from the common objection that the actual sensory consequences of action are not needed to elicit the sense of agency. I examine the comparator model’s ability to explain the performance of healthy subjects and those suffering from delusions of alien control on various self-attribution tasks. It transpires that the comparator (...) model needs case-by-case adjustment to deal with problematic data. In response to this, the multifactorial weighting model of Synofzik and colleagues is introduced. Although this model is incomplete, it is more naturally constrained by the cases that are problematic for the comparator model. However, this model may be untestable. I conclude that currently the comparator model approach has stronger support than the multifactorial weighting model approach. (shrink)

The sense of embodiment is vital for self recognition. An examination of anosognosia for hemiplegia—the inability to recognise that one is paralysed down one side of one’s body—suggests the existence of ‘online’ and ‘offline’ representations of the body. Online representations of the body are representations of the body as it is currently, are newly constructed moment by moment and are directly “plugged into” current perception of the body. In contrast, offline representations of the body are representations of what the body (...) is usually like, are relatively stable and are constructed from online representations. This distinction is supported by an analysis of phantom limb—the feeling that an amputated limb is still present—phenomena. Initially it seems that the sense of embodiment may arise from either of these types of representation; however, an integrated representation of the body seems to be required. It is suggested information from vision and emotions is involved in generating these representations. A lack of access to online representations of the body does not necessarily lead to a loss in the sense of embodiment. An integrated offline representation of the body could account for the sense of embodiment and perform the functions attributed to this sense. (shrink)

One of the core goals of Digital Health Technologies (DHT) is to transform healthcare services and delivery by shifting primary care from hospitals into the community. However, achieving this goal will rely on the collection, use and storage of large datasets. Some of these datasets will be linked to multiple sources, and may include highly sensitive health information that needs to be transferred across institutional and jurisdictional boundaries. The growth of DHT has outpaced the establishment of clear legal pathways to (...) facilitate the collection, use and transfer of potentially sensitive health data. Our study aimed to address this gap with an ethical code to guide researchers developing DHT with international collaborative partners in Singapore. We generated this code using a modified Policy Delphi process designed to engage stakeholders in the deliberation of health data ethics and governance. This paper reports the outcomes of this process along with the key components of the code and identifies areas for future research. (shrink)

This article examines the argument that biodiversity is crucial for well-functioning ecosystems and that such ecosystems provide important goods and services to our human societies, in short the ecosystem services argument (ESA). While the ESA can be a powerful argument for nature preservation, we argue that its dominant functionalist interpretation is confronted with three significant problems. First, the ESA seems unable to preserve the nature it claims to preserve. Second, the ESA cannot explain why those caring about nature want to (...) preserve it. Third, the ESA might undermine its own goal because it potentially decreases environmental motivations. (shrink)

Understanding more about how the brain functionsshouldhelp us understand economic behaviour. But some would have us believe that it has done this already, and that insights from neuroscience have already provided insights in economics that we would not otherwise have. Much of this is just academic marketing hype, and to get down to substantive issues we need to identify that fluff for what it is. After we clear away the distractions, what is left? The answer is that a lot is (...) left, but it is still all potential. That is not a bad thing, or a reason to stop the effort, but it does point to the need for a serious reconsideration of what neuroeconomics is and what passes for explanation in this literature. I argue that neuroeconomics can be a valuable field, but not the way it is being developed and “sold” now. The same is true more generally of behavioural economics, which shares many of the methodological flaws of neuroeconomics. (shrink)

According to a widely held view, people's commitments to laws are dependent on the existence in their community of a conventional practice of complying with certain fundamental laws. This conventionalism has significantly hampered our attempts to explain the normative practice of law. Ronald Dworkin has argued against conventionalism by bringing up the phenomenon of persistent fundamental legal controversies, but neither Dworkin nor his legal positivist respondents have correctly understood the real significance of such controversies. This article argues that such controversies (...) pose a deep challenge to any conception of our legal practice as a genuinely normative, rule-mediated, practice. The article also argues that what is needed to deflect this challenge is a new understanding – different from the widely held conventionalist understanding – of how people's commitments to laws are predicated on their fellows’ like commitments. Conspiracy theories have largely been framed by the academy as a stigmatised form of knowledge. Yet recent scholarship has included calls to take conspiracy theories more seriously as an area of study with a desire to judge them on their own merits rather than an a priori dismissal of them as a class of explanation. This paper argues that the debates within the philosophy of religion, long overlooked by scholars of conspiracy theories, can help sow the seeds for re-examining our (...) understanding of conspiracy theories in a more balanced and nuanced way. The nature of religious belief is elemental to understanding the epistemological foundations of the conspiracy theorising worldview amidst what we may call ‘conspiratorial ambiguity’. Specifically, R.M. Hare's concept of bliks, which are unfalsifiable but meaningful worldviews, offers a way forward to reframe our approach towards the theory of conspiracy theories. (shrink)

This essay is about the ethical propriety and practical efficacy of a range of policy undertakings which, in the last twenty years, has come to be referred to as “affirmative action.” These policies have been contentious and problematic, and a variety of arguments have been advanced in their support. Here I try to close a gap, as I see it, in this “literature of justification” which has grown up around the practice of preferential treatment. My principal argument along these lines (...) is offered in the next section. I then consider how some forms of argument in support of preferential treatment, distinctly different from that offered here, not only fail to justify the practice but, even worse, work to undermine the basis for cooperation among different ethnic groups in the American democracy. Finally, I observe that as a practical matter the use of group preference can, under circumstances detailed in the sequel, produce results far different from the egalitarian objectives which most often motivate their adoption. It may seem fatuous in the extreme to raise as a serious matter, in the contemporary United States, the question “Why should we care about group inequality?” Is not the historical and moral imperative of such concern self-evident? Must not those who value the pursuit of justice be intensely concerned about economic disparities among groups of persons? The most obvious answer to the title question would seem, then, to be: “We should care because such inequality is the external manifestation of the oppression of individuals on the basis of their group identity.”. Responses to the COVID-19 pandemic prompted people and institutions to turn to online virtual environments for a wide variety of social gatherings. In this perspectives article, we draw upon our previous work and interviews with Ghanaian Christian leaders to consider implications of this shift. Specifically, we propose that the shift from physical to virtual interactions mimics and amplifies the neoliberal individualist experience of abstraction from place associated with Eurocentric modernity. On the positive side, the shift from physical to virtual environments (...) liberates people to selectively pursue the most fulfilling interactions, free from constraints of physical distance. On the negative side, the move from physical to virtual space necessitates a shift from material care and tangible engagement with the local community to the psychologization of care and pursuit of emotional intimacy in relations of one’s choosing—a dynamic that further marginalizes people who are already on the margins. The disruptions of the pandemic provide an opportunity to re-set social relations, to design ways of being that better promote sustainable collective well-being rather than fleeting personal fulfillment. In this paper, I reinterpret the conflict between rewilders and those who want to preserve traditional agricultural landscapes. By showing that underlying both positions is a common outlook in which nature preservation can be described as a primarily interpretative act geared towards the preservation of meaning by establishing a successful contact with external reality, I hope to refocus the debate away from the current stalemate. Too often, the debate ends in a dispute about what counts as 'real nature'. By interpreting (...) nature preservation - whether it is directed at rewilding or at preserving old agricultural landscapes - as an act that is a response to nature's meanings, we will refocus attention on the real issue underlying preservation: articulating the ways nature is meaningful to us. In spite of his reputations as an impractical skeptic or dogmatic idealist, Plato’s Socrates is often an impressive example of a critical thinker, and we can use Plato’s dialogues to promote such skills in the college classroom. This essay summarizes recent institutional motivations for promoting critical thinking in a student-centered, active-learning pedagogy; compares Plato’s core model of education and fundamental rationale for it; shares an essay–presentation–discussion assignment that serves those modern and ancient goals; and discusses how this flexible type of (...) assignment is especially well suited for Plato’s dialogues, serving students and teachers in a Socratic manner. The first two sections thus situate Plato’s dialogues in relation to the heart of critical thinking in higher education generally. The later sections and Appendix explain a way to “follow the arguments” with Socrates that’s informed both by recent best practices and by much of what we see in Plato’s dialogues. (shrink)

Fake news is a worrying phenomenon which is growing increasingly widespread, partly because of the ease with which it is disseminated online. Combating the spread of fake news requires a clear understanding of the nature of fake news. However, the use of the term in everyday language is heterogenous and has no fixed meaning. Despite increasing philosophical attention to the topic, there is no consensus on the correct definition of “fake news” within philosophy either. This paper aims to bring clarity (...) to the philosophical debate of fake news in two ways: Firstly, by providing an overview of existing philosophical definitions and secondly, by developing a new account of fake news. This paper will identify where there is agreement within the philosophical debate of definitions of “fake news” and isolate four key questions on which there is genuine disagreement. These concern the intentionality underlying fake news, its truth value, the question of whether fake news needs to reach a minimum audience, and the question of whether an account of fake news needs to be dynamic. By answering these four questions, I provide a novel account of defining “fake news”. This new definition hinges upon the fact that fake news has the function of being deliberately misleading about its own status as news. (shrink)

When considering the value of friendship, most philosophers ignore the negatives. Most assume that humans need friends to flourish, and some argue that friendships can be good, no matter the risks entailed. This makes conversations about the value of friendship one-sided. Here, I argue that Cynics and Pessimists have an important view on friendship, despite it being ignored. They hold that: (a) friendship is unnecessary for flourishing, and (b) friendship presents ethical risks, especially to one’s own self-sufficiency. I defend these (...) views. Then I conclude with reflections on why Cynics and Pessimists actually make great friends. By helping people to focus on vulgar human nature and the flaws that humans have, they create an unpretentious basis for friendship. (shrink)

Conceived as a solution to clinical dilemmas, and now required by organizations for hospital accreditation, ethics committees have been subject only to small-scale studies. The wide use of ethics committees and the diverse roles they play compel study. In 1999 the University of Pennsylvania Ethics Committee Research Group (ECRG) completed the first national survey of the presence, composition, and activities of U.S. healthcare ethics committees (HECs). Ethics committees are relatively young, on average seven years in operation. Eighty-six percent of ethics (...) committees report that they play a role in ongoing clinical decision making through clinical ethics consultation. All are engaged in developing institutional clinical policy. Although 4.5% of HECs write policy on managed care, 50% of HEC chairs feel inadequately prepared to address managed care. The power and activity of ethics committees parallels the composition of those committees and the relationship of members to their institutions. The role of ethics committees across the nation in making policies about clinical care is greater than was known, and ethics committees will likely continue to play an important role in the debate and resolution of clinical cases and clinical policies. Gottfried Wilhelm Leibniz was one of the central figures of seventeenth-century philosophy, and a huge intellectual figure in his age. This book from Glenn A. Hartz is an advanced study of Leibniz's metaphysics. Hartz analyzes a very complicated topic, widely discussed in contemporary commentaries on Leibniz, namely the question of whether Leibniz was a metaphysical idealist, realist, or whether he tried to reconcile both trends in his mature philosophy. Because Leibniz is notoriously unclear about this, much has been written (...) on the subject. In recent years, the debate has centered on whether it is possible to maintain compatibility between the two trends. In this controversial book, Hartz demonstrates that it is not possible to maintain compatibility of idealist and realist views - they must be understood as completely separate theories. As the first major work on realism in Leibniz's metaphysics, this key text will interest international Leibniz scholars, as well as students at the graduate level. (shrink)

I offer a new metacognitive account of the feeling of agency over bodily actions. On this model the feeling of agency is the metacognitive monitoring of two cues: i) smoothness of action: done via monitoring the output of the comparison between actual and predicted sensory consequences of action and ii) action outcome: done via monitoring the outcome of action and its success relative to a prior intention. Previous research has shown that the comparator model offers a powerful explanation of the (...) feeling of agency. However, within the literature there is a growing sense of unease with the model; a consensus seems to be building that the model is not up to the task of explaining all of the new discoveries made regarding the feeling of agency since its inception. Most problematically there are paradigms which deeply challenge the comparator model by suggesting that a weak feeling of agency can be elicited even when no motor prediction is formed. The new account offered here inherits the explanatory power of the comparator model whilst avoiding this problem. (shrink)

This paper compares the ethical decisions and attitudes of business students and practitioners. Recent unpublished data from a national study of over 1600 students are contrasted with information reported previously. Students are found consistently to make less ethical choices than practitioners, and there is some indication that students are making less ethical choices in the 1980s than in the 1960s. In addition, both students and practitioners agree that buyers should beware, view the role of business more narrowly, and find fewer (...) incentives to behave ethically over time. Codes of ethics appear to be less influential than the individual's strong personal value system and one's superiors behaving ethically; support for codes is declining. The paper concludes with observations about the limitations and possibilities for survey research in this area drawing on other studies that used the same instrument utilized for this paper. The sense of agency, that is the sense that one is the agent of one’s bodily actions, is one component of our self-consciousness. Recently, Wegner and colleagues have developed a model of the causal history of this sense. Their model takes it that the sense of agency is elicited for an action when one infers that one or other of one’s mental states caused that action. In their terms, the sense of agency is elicited by the inference to apparent mental (...) state causation. Here, I argue that this model is inconsistent with data from developmental psychology that suggests children can identify the agent behind an action without being capable of understanding the relationship between their intentions and actions. Furthermore, I argue that this model is inconsistent with the preserved sense of agency in autism. In general, the problem is that there are cases where subjects can experience themselves as the agent behind their actions despite lacking the resources to make the inference to apparent mental state causation. Introduction. The sense of agency over thoughts is the experience of oneself qua agent of mental action. Those suffering certain psychotic symptoms are thought to have a deficient sense of agency. Here I seek to explain this sense of agency in terms of metacognition. Method. I start with the proposal that the sense of agency is elicited by metacognitive monitoring representations that are used in the intentional inhibition of thoughts. I apply this model to verbal hallucinations and the like and (...) examine the plausibility of this model explaining deficits associated with these symptoms. Results. By tying the sense of agency to metacognitive inhibition I propose that the loss of a sense of agency in certain psychotic symptoms is accompanied by a particular deficit in the patient’s ability to control their own thinking. This is consistent with the experiences of those at high risk of developing hallucinations, who report more intrusive thoughts than controls. The model I present is able to explain why those at risk of developing verbal hallucinations and those suffering from verbal hallucinations have deficits in the intentional inhibition of thought. I defend this account from a possible objection by distinguishing the form of the intentional inhibition deficit displayed by those suffering verbal hallucination from that displayed by those suffering from orbital-frontal cortex lesions and posttraumatic stress disorder. Conclusion. A plausible hypothesis is that the sense of agency over thoughts is elicited by the metacognitive monitoring representation used to intentionally inhibit. (shrink)
