I put forward four these concerning phenomenologically clarifying criteria to characterise social entities. The first thesis maintains that social entities have a sui generis ontological status: unlike natural and ideal entities, social entities depend existentially on individuals’ intentionality and are specifically normative entities. The second thesis claims that social entities existentially depend on heterotropic intentionality – i.e. on intentionality that involves at least two individuals –, and not on solitary intentionality. The third thesis identifies at least three different types of (...) heterotropic intentionality: collective, social and intersubjective intentionality. The fourth thesis states that all three types of heterotropic intentionality are effective: they create social entities, even if each of them creates social entities of different kinds. (shrink)

This book provides a discussion of the philosophy of being according to three major traditions in Western philosophy, the Analytic, the Continental, and the Thomistic. The origin of the point of view of each of these traditions is associated with a seminal figure, Gottlob Frege, Immanuel Kant, and Thomas Aquinas, respectively. The questions addressed in this book are constitutional for the philosophy of being, considering the meaning of being, the relationship between thinking and being, and the methods for using thought (...) to access being. On the one hand, the book honors diversity and pluralism, as it highlights how the three traditions may be clearly and distinctly differentiated regarding the philosophy of being. On the other hand, it honors a sense of solidarity and ecumenism, as it demonstrates how the methods and focal points of these traditions constitute, and continue to shape, the development of Western philosophy. This Research Topic aimed at deepening our understanding of the levels and explanations that are of interest for cognitive sci- entists, neuroscientists, psychologists, behavioral scientists, and philosophers of science. Indeed, contemporary developments in neuroscience and psy- chology suggest that scientists are likely to deal with a multiplicity of levels, where each of the different levels entails laws of behavior appropriate to that level (Berntson et al., 2012). Also, gathering and modeling data at the different levels of analysis is not suffi- (...) cient: the integration of information across levels of analysis is a crucial issue. Given such state of affairs, a number of interesting questions arise. How can the autonomy of explanatory levels be properly understood in behavioral explanation? Is reductionism a satis- factory strategy? How can high-level and low-level models be constrained in order to be actually explanatory of both behav- ioral and neurological or molecular evidence? This paper deals with phenomenological distinctions concerning empathy with real persons and empathy with fictional characters. We will introduce both contemporary accounts of our perception of others and Edith Stein’s account of empathy. These theories will turn out to be fruitful in defending our main thesis, i.e. that the differences between empathy with real people and empathy with fictional characters are not structural but just qualitative. We will argue that in both cases empathy is a direct act of perceiving others (...) and their lived experience. However, stemming from Stein’s work, we will underline that empathy with real persons is in principio more vivid and intense than empathy with fictional characters. In order to identify similarities and differences between empathy de vivo and empathy in fiction, we will focus on the following issues: the quality of perception; the motivational context and the “life-world context”; the ontological status of persons vs. characters. In this paper, I interview Francesca De Vecchi (Full Professor of Theoretical Philosophy in Vita-Salute San Raffaele University) about her qualitative ontology and its social and normative implications. If at the foundation of our lifeworld there are significantly qualitative experiences, phenomenology can investigate the most important contemporary issues, such as gender disparity, socio-virtuality depersonalizations and political urgencies.

In her Investigation Concerning the State, Edith Stein takes up some of the main ideas of the social ontology presented by Adolf Reinach, and develops a social ontology of the state, of the law and of social acts. I argue that Stein’s social ontology is an eidetics of the state, the law and social acts. Stein identifies the essential relations that constitute the state, the law and social acts, i.e. pinpoints the parts upon which the state, the law and social (...) acts existentially depend as wholes. In doing so, Stein applies Husserl’s account of wholes and parts to the social domain. I also suggest that Stein outlines a regional ontology of sociality that embodies Husserl’s idea of regional ontology. I focus on the intertwining of the wholes-parts relations, which characterize Stein’s regional ontology of sociality, and argue that there are not only necessary but also possible parts within the wholes. This makes Stein’s regional ontology of the sociality a dynamic ontology. (shrink)

In my paper, I will address two issues on the characterisation of social objects as subject-dependent objects: (i) Does phenomenological realism imply Platonism in social ontology? (ii) Which type of intentionality is the protagonist of social objects’ existential dependence on subjects? Both questions deal with Ferraris’ reception of Reinach’s phenomenological realism, on the one hand, and with the role played by the intentionality of social acts in the constitution of social objects, on the other (Reinach 1913, Ferraris 2009). According to (...) Ferraris, Reinach’s phenomenological realism becomes a sort of “social Platonism”, and the intentionality of social acts is an individual intentionality. On the contrary, I will maintain that phenomenological realism does not imply social Platonism in social ontology, and that social intentionality is not an individual and solitary intentionality: it is, rather, a heterotropic intentionality which necessarily refers to and depends on other subjects. The recent in vitro derivation of gamete‐like cells from mouse embryonic stem (mES) cells is a major breakthrough and lays down several challenges, both for the further scientific investigation and for the bioethical and biolegal discourse. We refer here to these cells as gamete‐like (sperm‐like or oocyte‐like, respectively), because at present there is still no evidence that these cells behave fully like bona fide sperm or oocytes, lacking the fundamental proof, i.e. combination with a normally derived gamete of the opposite (...) sex to yield a normal individual. However, the results published so far do show that these cells share some defining features of gametes. We discuss these results in the light of the bioethical and legal questions that are likely to arise would the same process become possible with human embryonic stem (hES) cells. (shrink)

This article identifies and formalizes the logical features of analogous terms that justify their use in deduction. After a survey of doctrines in Aristotle, Aquinas, and Cajetan, the criteria of “analogy of proper proportionality” are symbolized in first-order predicate logic. A common genus justifies use of a common term, but does not provide the inferential link required for deduction. Rather, the respective differentiae foster this link through their identical proportion. A natural-language argument by analogy is formalized so as to exhibit (...) these criteria, thereby showing the validity of analogical deduction. (shrink)

Algunas versiones del realismo jurídico pretenden compatibilizar la pretensión de que el derecho es un conjunto de normas con un fuerte compromiso con el empirismo. De conformidad con este último, el derecho no está constituido por entidades abstractas de ningún tipo sino por hechos empíricamente constatables. En vistas a llevar a cabo esta compatibilización, en varios trabajos Riccardo Guastini ha defendido una concepción de las proposiciones normativas, i.e. aserciones existenciales sobre normas jurídicas, como enunciados teóricos acerca del derecho vigente, necesariamente (...) referentes a ciertos hechos. Se concibe así al derecho vigente como el conjunto de textos que son resultado de interpretaciones estables, consolidadas y dominantes que los jueces han llevado a cabo en sus decisiones en el ordenamiento de que se trate. Partiendo de esta versión del realismo jurídico, este trabajo procura sembrar algunas dudas. Primero, sobre este modo de concebir a las proposiciones normativas. Segundo, sobre el modo en que, en consecuencia, queda configurada la teoría del derecho. Tercero, y más en general, sobre la pretensión de compatibilizar la visión del derecho como conjunto de normas con la tesis empirista. (shrink)

Biologists and philosophers often use the language of determination in order to describe the nature of developmental phenomena. Accounts in terms of determination have often been reductionist. One common idea is that DNA is supposed to play a special explanatory role in developmental explanations, namely, that DNA is a developmental determinant. In this article we try to make sense of determination claims in developmental biology. Adopting a manipulationist approach, we shall first argue that the notion of developmental determinant is causal. (...) We suggest that two different theses concerning developmental determination can be articulated: determination of occurrence and structural determination. We shall argue that, while the first thesis is problematic, the second, opportunely qualified, is feasible. Finally, we shall argue that an analysis of biological causation in terms of determination cannot account for entangled dynamics. Characterising causal entanglement as a particular kind of interactive causation whereby difference-making causes ascribable to different levels of biological organisation influence a particular ontogenetic outcome, we shall, via two illustrative examples, diagnose some potential limits of a reductionist, molecular and intra-level understanding of biological causation. The moving spotlight account (MS) is a view that combines an eternalist ontology and an A-theoretic metaphysics. The intuition underlying MS is that the present time is somehow privileged and experientially vivid, as if it were illuminated by a moving spotlight. According to MS-theorists, a key reason to prefer MS to B-theoretic eternalism is that our experience of time supports it. We argue that this is false. To this end, we formulate a new family of positions in the philosophy of (...) time, which differ from MS in that, intuitively, they admit a plurality of moving spotlights. We argue that these ‘deviant’ variants of MS cannot be dismissed as conceptually incoherent, and that they are as well-supported by our experience as is MS. One of these variants, however, is consistent with the B-theory. Thus, if our experience of time supports MS, then it supports the B-theory as well. (shrink)

The present work deals with the quality issue in social ontology: the fact that social entities not only can exist or not exist, but can also be more or less achieved and be subject to degrees of existence, and the fact that social entities can be bearers of varieties of ways of existence, that is, there are several ways in which a social entity of a certain type can be realized. In accordance with phenomenological eidetics, I show that modifications of (...) essential connections involve lacks or variations of essential parts of entities, which, respectively, imply degrees of existence and varieties of ways of existence which “enhance” the existence of social entities, and I argue that the modification issue hits the core of the quality of existence issue. Lastly, I focus on the essential connection of tendency as another case in which eidetics provides meaningful insights into the existential quality issue in social ontology. (shrink)

One of the foundational problems of biochemistry concerns the conceptualisation of the relationship between the composition, structure and function of macromolecules like proteins. Part of the recent philosophical literature displays a reductionist bias, that is, the endorsement of a form of microstructuralism mirroring an out-dated biochemical conceptualisation. We shall argue that such microstructuralist approaches are ultimately committed to a potentialist form of micro-predeterminism whereby the macrostructure and function of proteins is accounted for solely in terms of the intrinsic properties and (...) potentialities of the components of the primary structure as if they were self-contained or essentially immutable entities. We shall instead suggest that a conceptualisation of the relationship between proteins’ composition, structure and function consistent with contemporary biochemical practice should account also for the causal role of the cellular, organismal and environmental relations in protein development. The analysis of the folding process we propose suggests that microstructure-laden reductionist approaches are ontologically indefensible. Rather than a potentialist form of micro-predeterminism, our analysis ultimately supports a relational-construction-based view of protein development and potentialities formation, which requires an indispensable analysis of the dynamical interplay between the micro-level of the parts and the macro-level of the relational structures of their systems. Open futurism is the indeterministic position according to which the future is ‘open’, i.e., there is now no fact of the matter as to what future contingent events will actually obtain. Many open futurists hold a branching conception of time, in which a variety of possible futures exist. This paper introduces two challenges to branching-time open futurism, which are similar in spirit to a challenge posed by Fine to tense realism. The paper argues that, to address the new challenges, open (...) futurists must adopt an objective, non-perspectival notion of actuality and subscribe to an A-theoretic, dynamic conception of reality. Moreover, given a natural understanding of “actual future”, it is perfectly sensible for open futurists to hold that a unique, objectively actual future exists, contrary to a common assumption in the current debate. The paper also contends that recognising the existence of a unique actual future helps open futurists to avoid potential misconceptions. (shrink)

Sophisticated senator and legislative onion. Whether or not you have ever heard of these things, we all have some intuition that one of them makes much less sense than the other. In this paper, we introduce a large dataset of human judgments about novel adjective-noun phrases. We use these data to test an approach to semantic deviance based on phrase representations derived with compositional distributional semantic methods, that is, methods that derive word meanings from contextual information, and approximate phrase meanings (...) by combining word meanings. We present several simple measures extracted from distributional representations of words and phrases, and we show that they have a significant impact on predicting the acceptability of novel adjective-noun phrases even when a number of alternative measures classically employed in studies of compound processing and bigram plausibility are taken into account. Our results show that the extent to which an attributive adjective alters the distributional representation of the noun is the most significant factor in modeling the distinction between acceptable and deviant phrases. Our study extends current applications of compositional distributional semantic methods to linguistically and cognitively interesting problems, and it offers a new, quantitatively precise approach to the challenge of predicting when humans will find novel linguistic expressions acceptable and when they will not. The COVID-19 pandemic poses extraordinary public health challenges. In order to respond to such challenges, most democracies have relied on so-called ‘evidence-based’ policies, which supposedly devolve to science the burden of their justification. However, the biomedical sciences can only provide a theory-laden evidential basis, while reliable statistical data for policy support is often scarce. Therefore, scientific evidence alone cannot legitimise COVID-19 public health policies, which are ultimately based on political decisions. Given this inevitable input on policy-making, the risk of arbitrariness (...) is ubiquitous and democratic scrutiny becomes essential to counter it. During the COVID-19 pandemic, the standards of scientific and democratic scrutiny have been, as a matter of fact, substantially lowered. This erosion potentially damages democracy. (shrink)

This paper explores taste fragmentalism, a novel approach to matters of taste and faultless disagreement. The view is inspired by Kit Fine’s fragmentalism about time, according to which the temporal dimension can be constituted—in an absolute manner—by states that are pairwise incompatible, provided that they do not obtain together. In the present paper, we will apply this metaphysical framework to taste states. In our proposal, two incompatible taste states (such as the state of rhubarb’s being tasty and the state of (...) rhubarb’s being distasteful) can both constitute reality in an absolute manner, although no agent can have joint access to both states. We will then develop a formalised version of our view by means of an exact truthmaker semantics for taste assertions. Within this framework—we argue—our linguistic and inferential practices concerning cases of faultless disagreement are elegantly vindicated, thus suggesting that taste fragmentalism is worth of further consideration. I deal with the issue of the environmental crisis from the perspective of a phenomenologically embedded qualitative social ontology. The first point I make is that our environment is a «personal world», and not a «naturalistic world»: a world that is experienced in the «personalistic attitude» and as such is an ontologically qualitative world, in which both natural and social entities are given to us as essentially constituted by value-qualities and meanings, and not as merely material things. The second point (...) I argue for is that our environment is also a «common-surrounding world» whose personal collectives are its essential correlate: «common-surrounding world» and personal collectives existentially depend on one another, and human persons, both individual and collective, are responsible for the existence of their environment and its entities. I apply the tools of phenomenological eidetics to the ideas of «personal world» and «common-surrounding world», and inquire into the ontologically qualitative implications that they have for our environment and its crisis. Retracing the primary common aspects between anthropological and psychoanalytic thought, in this article, we will further discuss the main common points between the notions of the unconscious according to Carl Gustav Jung and Claude Lévi-Strauss, taking into account the thought of Erich Neumann. On the basis of very simple elementary logic considerations centered around the basic notion of the separation of opposites, our observations might be useful for speculations on the possible origins of rational thought and hence on the origins (...) of consciousness. Artefacts do not always do what they are supposed to, due to a variety of reasons, including manufacturing problems, poor maintenance, and normal wear-and-tear. Since software is an artefact, it should be subject to malfunctioning in the same sense in which other artefacts can malfunction. Yet, whether software is on a par with other artefacts when it comes to malfunctioning crucially depends on the abstraction used in the analysis. We distinguish between “negative” and “positive” notions of malfunction. A negative malfunction, (...) or dysfunction, occurs when an artefact token either does not or cannot do what it is supposed to. A positive malfunction, or misfunction, occurs when an artefact token may do what is supposed to but, at least occasionally, it also yields some unintended and undesirable effects. We argue that software, understood as type, may misfunction in some limited sense, but cannot dysfunction. Accordingly, one should distinguish software from other technical artefacts, in view of their design that makes dysfunction impossible for the former, while possible for the latter. (shrink)

A widespread opinion holds that norms and codes of conduct as such can only be established via words, that is, in some lexical form. This perspective can be criticized: some norms produced by human acts are not word-based at all. For example, many norms are actually conveyed through graphics (e. g. road signs and land-use maps), sounds (e. g. the referee’s whistle), a silent gesture (the traffic warden’s signal to halt). In this article, we will focus on the norms that (...) are created by means of drawings and can be termed “drawn norms” or “graphical norms.” Specifically, we will inquire into the phenomenon of graphical norms with particular regard to traffic signs and land-use plans, and we will discuss the philosophical and legal problems to which these phenomena give rise. This paper will critically assess Popper’s evolutionary philosophy. There exists a rich literature on the topic with which we have many reservations. We believe that Popper’s evolutionary philosophy should be assessed in light of the intriguing theoretical insights offered, during the last 10 years or so, by the philosophy of biology, evolutionary biology and molecular biology. We will argue that, when analysed in this manner, Popper’s ideas concerning the nature of selection, Lamarckism and the theoretical limits of neo-Darwinism can be (...) appreciated in their full biological and philosophical value. This book provides a general survey of the main concepts, questions and results that have been developed in the recent interactions between quantum information, quantum computation and logic. Divided into 10 chapters, the books starts with an introduction of the main concepts of the quantum-theoretic formalism used in quantum information. It then gives a synthetic presentation of the main “mathematical characters” of the quantum computational game: qubits, quregisters, mixtures of quregisters, quantum logical gates. Next, the book investigates the puzzling entanglement-phenomena (...) and logically analyses the Einstein–Podolsky–Rosen paradox and introduces the reader to quantum computational logics, and new forms of quantum logic. The middle chapters investigate the possibility of a quantum computational semantics for a language that can express sentences like “Alice knows that everybody knows that she is pretty”, explore the mathematical concept of quantum Turing machine, and illustrate some characteristic examples that arise in the framework of musical languages. The book concludes with an analysis of recent discussions, and contains a Mathematical Appendix which is a survey of the definitions of all main mathematical concepts used in the book. (shrink)

In this Introduction we lay out the context of a ‘Continental philosophy of biology’ and suggest why Georges Canguilhem’s place in such a philosophy is important. There is not one single program for Continental philosophy of biology, but Canguilhem’s vision, which he referred to at one stage as ‘biological philosophy’, is a significant one, located in between the classic holism-reductionism tensions, significantly overlapping with philosophy of medicine, philosophy of technology and other themes moving away from the more common existential and (...) phenomenological motifs of post-war European thought. Chapters examine (among other themes) his relation to Lebensphilosophie, to authors such as Kant, Nietzsche and Marjorie Grene, and to current theoretical biology. (shrink)

This book is a systematic analysis of John R. Searle’s philosophy of mind. Searle’s view of mind, as a set of subjective _and_ biologically embodied processes, can account for our being part of nature _qua_ mindful beings. This model finds support in neuroscience and offers reliable solutions to the problems of consciousness, mental causation, and the self.

This volume illustrates both theoretically and empirically the differences between religious diversity and religious pluralism. It highlights how the factual situation of cultural and religious diversity may lead to individual, social and political choices of organized and recognized pluralism. In the process, both individual and collective identities are redefined, incessantly moving along the continuum that ranges from exclusion to inclusion. The book starts by first detailing general issues related to religious pluralism. It makes the case for keeping the empirical, the (...) normative, the regulatory and the interactive dimensions of religious pluralism analytically distinct while recognizing that, in practice, they often overlap. It also underlines the importance of seeking connections between religious pluralism and other pluralisms. Next, the book explores how religious diversity can operate to contribute to legal pluralism and examines the different types of church-state relations: eradication, monopoly, oligopoly and pluralism. The second half of the book features case studies that provide a more specific look at the general issues, from ways to map and assess the religious diversity of a whole country to a comparison between Belgian-French views of religious and philosophical diversity, from religious pluralism in Italy to the shifting approach to ethnic and religious diversity in America, and from a sociological and historical perspective of religious plurality in Japan to an exploration of Brazilian religions, old and new. The transition from religious diversity to religious pluralism is one of the most important challenges that will reshape the role of religion in contemporary society.
