Non-invasive prenatal testing is an emerging form of prenatal genetic testing that provides information about the genetic constitution of a foetus without the risk of pregnancy loss as a direct result of the test procedure. As with other prenatal tests, information from NIPT can help to make a decision about termination of pregnancy, plan contingencies for birth or prepare parents to raise a child with a genetic condition. NIPT can also be used by women and couples to test purely ‘for (...) information’. Here, no particular action is envisaged following the test; it is motivated entirely by an interest in the result. The fact that NIPT can be performed without posing a risk to the pregnancy could give rise to an increase in such requests. In this paper, we examine the ethical aspects of using NIPT ‘purely for information’, including the competing interests of the prospective parents and the future child, and the acceptability of testing for ‘frivolous’ reasons. Drawing on several clinical scenarios, we claim that arguments about testing children for genetic conditions are relevant to this debate. In addition, we raise ethical concerns over the potential for objectification of the child. We conclude that, in most cases, using NIPT to test for adult-onset conditions, carrier status or non-serious traits presenting in childhood would be unacceptable. (shrink)

Currently, in the United States, there is no legal obligation for medical professionals or civil courts to uphold patients’ Advance Directives (ADs) regarding end-of-life care. The applicability and standing of ADs prepared by Alzheimer’s patients is a persistent issue in bioethics. Those who argue against giving ADs full status take two main approaches: (1) appealing to beneficence on behalf of the Alzheimer’s patient and (2) claiming that there is no longer any personal equivalence between the AD’s creator and the subject (...) of the AD. In this paper, I present profound arguments against both approaches. Firstly, I argue that the principle of beneficence cannot apply in the case of Alzheimer’s patients, and, secondly, that the moral and legal authority of the AD need not depend on strict equivalence of personal identity. I conclude by arguing that valid ADs protect the dignity and autonomy of Alzheimer’s patients and that, therefore, there are moral obligations to uphold ADs which should be reflected in public policy and legislation. Economic policy evaluations require social welfare functions for variable-size populations. Two important candidates are critical-level generalized utilitarianism (CLGU) and rank-discounted critical-level generalized utilitarianism, which was recently characterized by Asheim and Zuber (2014) (AZ). AZ introduce a novel axiom, existence of egalitarian equivalence (EEE). First, we show that, under some uncontroversial criteria for a plausible social welfare relation, EEE suffices to rule out the Repugnant Conclusion of population ethics (without AZ’s other novel axioms). Second, we provide a new characterization of CLGU: (...) AZ’s set of axioms is equivalent to CLGU when EEE is replaced by the axiom same-number independence. (shrink)

“Modern slavery,” a term used to describe severe forms of labor exploitation, is beginning to spark growing interest within business and society research. As a novel phenomenon, it offers potential for innovative theoretical and empirical pathways to a range of business and management research questions. And yet, development into what we might call a “field” of modern slavery research in business and management remains significantly, and disappointingly, underdeveloped. To explore this, we elaborate on the developments to date, the potential drawbacks, (...) and the possible future deviations that might evolve within six subdisciplinary areas of business and management. We also examine the value that nonmanagement disciplines can bring to research on modern slavery and business, examining the connections, critiques, and catalysts evident in research from political science, law, and history. These, we suggest, offer significant potential for building toward a more substantial subfield of research. (shrink)

Based on archival and ethnographic data, this article analyzes the iconic-making, iconoclastic unmaking, and iconographic remaking of national identifications. The window into these processes is the career of Saint John the Baptist, patron saint of French Canadians and national icon from the mid-nineteenth century until 1969, when his statue was destroyed by protesters during the annual parade in his honor in Montréal. Relying on literatures on visuality and materiality, I analyze how the saint and his attending symbols were deployed in (...) processions, parades, and protests. From this analysis, I develop the sociological concept of aesthetic revolt, a process whereby social actors rework iconic symbols, redefining national identity in the process. The article offers a theoretical articulation and an empirical demonstration of how the context, content, and the form of specific cultural objects and symbols—national icons—are intertwined in public performance to produce eventful change, and shows why and how the internal material logic and the social life of these icons shape the articulation of new national identities. Background independence is generally considered to be ‘the mark of distinction’ of general relativity. However, there is still confusion over exactly what background independence is and how, if at all, it serves to distinguish general relativity from other theories. There is also some confusion over the philosophical implications of background independence, stemming in part from the definitional problems. In this paper I attempt to make some headway on both issues. In each case I argue that a proper account of the (...) observables of such theories goes a long way in clarifying matters. Further, I argue, against common claims to the contrary, that the fact that these observables are relational has no bearing on the debate between substantivalists and relationalists, though I do think it recommends a structuralist ontology, as I shall endeavour to explain. This pragmatic study addresses the question of the plural realities that emerge from perception, based on an empirical analysis of the tasting activity of wine amateurs and olfactory experts. Though they share the same requirement of rooting taste in the product under scrutiny, they also significantly differ regarding the constraints with which their tasting results have to comply: repeatability for experts’ tasting results, and activity contiunuation for amateurs. Both therefore foster the emergence of two contrasting realities: a stabilized one for (...) experts; an ‘un-stabilized’ one for amateurs. Both happen to fit with the ‘fiction’ and the ‘reference’ modes of existence of Latour’s inventory, which extends and relaunches the analysis of the coexistence of activities initiated by the works on ‘boundary objects’ some decades ago. Finally, the notion of taste is reinterpreted as a translation operator between tasting realities. (shrink)

The sociology of science has shown that the scientific quest for truth, framed by the search for objectivity was granting objects of knowledge the form of independent and autonomous things, “data” already given and preexisting their observation. But do “real” objects only fit the form of data or things? If not, to which other form and objectivity do they fit? The author considers the question by examining the dispute between scientists and vintners on the issue of terroir, a complex combination (...) of viticulture and wine-making practices and agro-climactic factors, which gives wines a particular taste, or terroir typicity. For scientists who are unable to reduce it to a stable list of determining factors, terroir is an unfounded notion, an imaginary social construction, and an economic barrier. Producers, on the other hand, along with the wider distribution network of terroir wines, consider terroir as a real object, although one whose manifestations cannot be evaluated using the same procedures as those of scientists. By analyzing how proof of terroir is implemented, the author uncovers a regime of existence of objects different from the scientific regime: a pluralist one governed by critical discussion from which objects emerge as distributed results of a production process. If humans have an evolved moral psychology, then we should not expect it to function in an identical way between individuals. Instead, we should expect a diversity in the function of our moral psychology between individuals that varies along genetic lines, and a corresponding diversity of moral attitudes and moral judgements that emerge from it. This is because there was no one psychological type that would reliably produce adaptive social behaviour in the highly heterogeneous environments in which our minds evolved. (...) As such, there was no single psychological type towards which evolution could gravitate. Instead we evolved a stable polymorphism of psychological types, maintained by frequency-dependent selection, each predisposed towards particular social and moral attitudes and behaviours. This can help explain the existence of moral diversity, particularly intra-cultural moral diversity, and seemingly intractable moral disagreement. (shrink)

The starting point of this study is the observation of a new importance of philosophy « in the post-metaphysical era » (according to the expression of J.-L. Schlegel) in the analysis of the religious fact and the significance of the Bible in Western culture, including the most contemporary. The recent Chilean film El Cristo ciego/Blind Christ by director Christopher Murray (2016) offers an emblematic example of the problems posed by the interpretation of a work that questions the mystery of transcendence (...) in a context marked both by the radical immanence of the characters’ experience and by the explicit and massive reference to the New Testament. The short narratives of the main character will be analyzed as parables (exegetic approach) and will be interpreted in the light of the Christology of liberation (cf. Jon Sobrino) and the philosophy of deconstruction (cf. J.-L. Nancy), which will lead to the question of the epistemological coherence of the proposed analysis. (shrink)

The idea that liberal democratic legitimacy presupposes the final authority of the state in solving the juridictional boundary question depends upon the argument according to which Westphalian sovereignty has evolved in a liberal democratic direction. From this point of view, sovereignty is internally limited by liberal democratic principles. However, I argue that it is rather public politics, more than Westphalian sovereignty, that has been transformed, in liberal states, and that hence, there is an enduring tension between democratic legitimacy and state (...) sovereignty. Hoerl & McCormack claim that the temporal updating system only represents the world as present. This generates puzzles regarding the phenomenology of temporal experience. We argue that recent models of reinforcement learning suggest that temporal updating must have a minimal temporal structure; and we suggest that this helps to clarify what it means to experience the world as temporally structured.

Le « féminisme de la subsistance », à l’intersection du féminisme, de l’écologie et de l’anticapitalisme, a été remis en lumière par des théoricien·nes et activistes du Nord et du Sud dans les années 2010. L’étude des sociétés paysannes montre que l’accomplissement par les femmes des tâches vitales pour le groupe a été sous-estimé et leur confère puissance, sacralité et autonomie, en particulier pour assurer l’égale répartition des biens de subsistance. Face aux critiques dénonçant cet essentialisme, l’auteure propose un « (...) écoféminisme vernaculaire » qui s’appuie sur les pratiques concrètes des femmes intégrant agriculture, artisanat, travaux de mécanique et de maçonnerie, agirs familiaux. Car, sous sa forme moderne, le travail domestique est doublement aliéné : non seulement, il n’est pas rémunéré, mais il est coupé de ses potentialités productives de subsistance pour se cantonner à la consommation et au care. Les écoféministes de la subsistance veulent s’opposer aux vocations « naturelles » des femmes et imaginer des perspectives : se réapproprier et partager collectivement des fonctions nourricières de base dans un monde où s’impose de façon accélérée l’aménagement agro-industriel de la planète. This study provides an evaluation of ethical business perception of busIness students from three countries: Australia, Taiwan and the United States. Although statistically significant differences do exist there is significant agreement with the way students perceive ethical/unethical practices in business. The findings of this paper indicate a universality of business ethical perceptions.

We focus here on some familiar kinds of cases of conflict between friendship and morality, and, on the basis of our account of the nature of friendship, argue for the following two claims: first, that in some cases where we are led morally astray by virtue of a relationship that makes its own demands on us, the relationship in question is properly called a friendship; second, that relationships of this kind are valuable in their own right.

Property dualism is enjoying a slight resurgence in popularity, these days; substance dualism, not so much. But it is not as easy as one might think to be a property dualist and a substance materialist. The reasons for being a property dualist support the idea that some phenomenal properties (or qualia) are as fundamental as the most basic physical properties; but what material objects could be the bearers of the qualia? If even some qualia require an adverbial construal (if they (...) are modifications of the thing that is conscious because of them, not properties of something else to which the subject of consciousness is related), then the property dualist can be driven to speculative forms of materialism none of which, at this point, looks more likely to be true than the more modest versions of emergent dualism defended by contemporary substance dualists. In Understanding Moral Obligation: Kant, Hegel, Kierkegaard, Robert Stern argues that Hegel has a social command view of obligation. On this view, there is an element of social command or social sanction that must be added to a judgment of the good in order to bring about an obligation. I argue to the contrary that Hegel's conception of conscience, and thus the individual's role in obligation, is more central to his account than the social dimension. While agreeing with Stern that (...) Hegel's conception of Sittlichkeit does preserve a role for obligation, and that the social plays an important part in that account, I argue that there is no extra social component that converts the morally good into obligation. Rather, Hegel's conception of Sittlichkeit as the “living good” means that judgments of the moral facts are simultaneously judgments of obligation. (shrink)

Situé dans une approche interactionniste du développement du langage, l’article propose une démarche méthodologique pour étudier l’étayage dans sa dynamique dialogique, pour laquelle le recours à un corpus s’avère indispensable. L’article comprend plusieurs parties : sont présentées d’une part les différentes facettes de l’étayage d’un point de vue théorique, d’autre part la construction d’un outil opérationnel sous la forme d’une grille d’analyse des conduites étayantes des adultes et des réactions des enfants. Enfin, quelques résultats issus d’une recherche sur les interactions (...) mère-enfant, à titre illustratif de la démarche, montrent la façon dont les activités effectuées par les participants façonnent leurs conduites. Over 50,000 youth, mostly between the ages of 13 and 17 years, migrated to the United States without familial accompaniment in the fiscal year 2018. The tripartite process of pre-flight, flight, and resettlement exposes these unaccompanied immigrant children to multiple, and often ongoing, traumatic events that can significantly and adversely impact their mental health into adulthood. However, the ethical considerations for psychologists working with this growing population, with limited exceptions, remain largely unaddressed. As more and more UIC flee their home (...) countries due to violence, abuse, and economic instability only to experience further stressors during the processes of detainment, custodial placement, and acculturative adjustment in the US, there is an increasing need for psychological services; thus, the importance of preparation of mental health providers is increasingly significant. Psychologists must have the requisite skills and knowledge of the complex experiences of UIC, and of how these intersect with salient cultural, developmental, and systemic factors, as a means of providing competent and ethical mental health treatment. The present article highlights several ethical issues that arise when providing psychological services to UIC, with particular consideration paid to the embeddedness of UIC in various organizational entities with which psychologists will likely need to interface when working with this population. Implications and recommendations for practicing psychologists and training programs are discussed. (shrink)

An increasing number of studies about teacher’s induction issues mention that it is essential to take into account the types of support needs of beginning teachers to offer them adequate support. Few researchers have accurately portrayed the types of support needs felt by novice teachers and focused on the degree of agreement between the type of support needs felt and the perceived support received. This research used data drawn from a French-language survey (n = 156) and semi-directed interviews (n = (...) 10) conducted in Quebec with novice teachers. Quantitative analyzes using association measures on types of support needs and perception of support received indicate that the support perceived by teachers is largely inconsistent with the types of support needs felt. The interviews provide a better understanding of the quantitative results and suggest some possible solutions. (shrink)
