The right to buy and sell human organs is challenged by the authors within the framework of a broad Christian perspective. Opposition to organ sales is argued in the light of the developing underclass of poor organ donors throughout the world who sell their organs to the rich. Very often neither the donors nor the recipients are fully informed about the medical risks involved in the procedure of organ transplantation.

In this article I explore a tantalising definition of cinematic belief as a belief without belief by briefly considering the way in which film theory and film-philosophy have engaged with the question of belief in cinema. I also take into account Simon Critchley’s discussion of religious belief in The Faith of the Faithless (2012) within the context of anthropological studies of religion such as that by Émile Durkheim. In addition, I discuss Sigmund Freud’s 1927 reflection on religion in “The (...) Future of an Illusion”. I then show that this line of thought can be linked to the philosophical discussion around the so-called paradox of fiction and introduce the idea that belief can be understood itself as an emotion or mood. I argue in favour of the solution to the paradox that claims that emotions experienced in response to fictional entities are quasi-emotions but radicalise this claim by showing that this must imply that all emotions are in fact structured like quasi-emotions and that we do not require an essentialist understanding of emotion in the first place. Throughout I use the example of the various cinematic representations of the life of St Francis to flesh out the argument, including Roberto Rossellini’s Francesco, giullare di Dio / Francesco, God’s Jester / The Flowers of St Francis (1950) but particularly Franco Zeffirelli’s much maligned Brother Sun, Sister Moon (1972). Philosophers from Hart to Lewis, Johnston and Bennett have expressed various degrees of reservation concerning the doctrine of double effect. A common concern is that, with regard to many activities that double effect is traditionally thought to prohibit, what might at first look to be a directly intended bad effect is really, on closer examination, a directly intended neutral effect that is closely connected to a foreseen bad effect. This essay examines the extent to which the commonsense concept of intention (...) supports a reasonably consistent and coherent application of double effect. Two important conclusions are these: (1) a number of traditionally proscribed activities involve a kind of “targeting” of innocents that can be taken to exhibit a direct intention to harm them; (2) a direct intention to harm need not involve a desire to harm in any ordinary sense of the latter expression. Strawson described ‘descriptive metaphysics’, Bach described ‘natural language metaphysics’, Sapir and Whorf describe, well, Sapir-Whorfianism. And there are other views concerning the relation between correct semantic analysis of linguistic phenomena and the “reality” that is supposed to be thereby described. I think some considerations from the analyses of the mass-count distinction can shed some light on that very dark topic.

Ecology's reputation as a holistic science is partly due to widespread misconceptions of its nature as well as shortcomings in its methodology. This article argues that the pursuit of empirical laws of ecology can foster the emergence of a more unified and predictive science based on complementary modes of explanation. Numerical analyses of population dynamics have a distinguished pedigree, spatial analyses generate predictive laws of macroecology, and physical analyses are typically pursued by the ecosystem paradigm. The most characteristically ecological laws, (...) however, are found in biotic analyses in the functional trait paradigm. Holistic credentials for ecology may thus be restored on two bases: its accommodating complementary modes of analysis and explanation, and its having some laws within the least reductionistic mode consistent with its subject matter. These claims, grounded in the aspectual theory of Herman Dooyeweerd, lead to some suggestions for enhancing the versatility and usefulness of ecology—and other sciences—by balancing different research paradigms under a holistic vision. Engelhardt is correct in thinking that potentiality implies continuity. The central purpose of the Aristotelian notion of potency is to explain continuity, both in becoming and in generation-corruption. If one denies continuity in change, he will have little use for potentiality, at least little use for the Aristotelian types. And there are types that should not be conflated: one to account for continuity in becoming and generation, another to account for continuity of a being going from not acting to acting. (...) ABSTRACT Dystopian settings are often dominated by fear and despair. As instruments and symbols of fear, guns, especially deployed in gendered ways, reinforce the dystopian setting. This article explores how guns and gender roles are represented in three dystopian novels and three dystopian films. Examining how phallocentric aggression and toxic masculinity shape how guns are wielded by a number of characters in several of these films and novels, the article also suggests how critical dystopias offer insights into the conditions that (...) create dystopia and impede alternative and better futures. By providing interpretive interventions into the constructions of the specific dystopian settings and the deployment of guns, the article offers new insights into the interface between gender, guns, and dystopia. Ternary exclusive or is the truth function that is true just in case exactly one of its three arguments is true. This is an interesting truth function, not definable in terms of the binary exclusive or alone, although the binary case is definable in terms of the ternary case. This article investigates the types of truth functions that can be defined by ternary exclusive or, and relates these findings to the seminal work of Emil Post.

We investigate the notion of relevance as it pertains to ‘commonsense’, subjunctive conditionals. Relevance is taken here as a relation between a property (such as having a broken wing) and a conditional (such as birds typically fly). Specifically, we explore a notion of ‘causative’ relevance, distinct from ‘evidential’ relevance found, for example, in probabilistic approaches. A series of postulates characterising a minimal, parsimonious concept of relevance is developed. Along the way we argue that no purely logical account of relevance (even (...) at the metalevel) is possible. Finally, and with minimal restrictions, an explicit definition that agrees with the postulates is given. (shrink)

TisoA retreat program designed by the participants in the ongoing Ch'an/Zen-Catholic Dialogue explored the dialogue of religious experience and the dialogue of life, set amid the redwoods of Guerneville, California. The 28–31 January 2009 meeting was cochaired by the Rev. Heng Sure of the Berkeley Buddhist Monastery and the Institute for World Religions, Berkeley, California, and by (...) Most Rev. John C. Wester, Bishop of Salt Lake City, Utah.Sr. Mary Ann Donovan of the Jesuit School of Theology, Berkeley, led an experience of lectio divina based on John 15:1–17, Jesus's simile of the vine and the branches. Rev. Victoria Austin of the San Francisco Zen Center gave an "encouragement talk," which would typically be delivered to Zen retreatants. She referred to the Gospel passage, noting: "We don't prune the vine because it is dead, but because it has the capacity to be fruitful. We don't purify the mind to get rid of dirt, but to return to the mind's original purity, which is the source of our conscience and is the true life within us." Rev. Jan Chosen Bays of Great Vow Zen Monastery in Oregon observed that "Vows make our life energy more focused, keeping us from losing purpose and meaning. Vows prune away unnecessary things. When we ask for help with the challenge of being faithful to our vows, we call up and encounter unexpected sources of support and 'grace.' "The Ch'an Buddhist presentation focused on meditation experience, which was described as "recovering the natural state of the mind." Prof. Martin Verhoeven of the Pacific School of Religion pointed out that in meditation "we are returning to the origin, not moving forward to 'gain something.'" Linking ethical engagement with contemplation, he said, "When the mind of a meditator is motivated to act out of genuine compassion, its action is accurate and correct. Action is neither driven nor obstructed by ego or sentiment." These comments resonated with Rev. Heng Sure's presentation on the statement on the environment from the recent Gethsemane III conference "Simple and Sufficient," in which Buddhist and Christian monastics embraced an ecologically valid way of life. Urging the group to notice the connections between contemplation and ethical action, Bishop John C. Wester commented: "This [End Page 145] work embodies mercy by lifting people up; it embodies justice as it arises out of our common humanity."Because of the financial challenges that all three sponsoring institutions are facing, it was decided to conclude formal sponsorship of the Ch'an/Zen-Catholic Dialogue with this meeting. A steering committee was designated to undertake new logistical arrangements and to draft a narrative of the previous seven years of dialogue for posting on our respective websites. The growing use of interoperable electronic health records is likely to have significant effects on the physician-patient relationship. This relationship involves two-way trust: of the physician in patients, and of the patients in their providers. Interoperable records opens up this relationship to further view, with consequences that may both enhance and undermine trust. On the one hand, physicians may learn that information from their patients is — or is not — to be trusted. On the other hand, patients may learn (...) from the increased oversight made possible by electronic records that their trust in their physicians is — or is not — warranted. Release of information through new methods of surveillance may also undermine patient trust. The article concludes that because trust is fragile, attention to transparency and confidentiality in the use of interoperable electronic records is essential. (shrink)

There is a mystery, present from conception, namely, how the human person, who transcends the individual elements of sperm and ovum, can nevertheless come to exist at the first instant of the sperm’s interaction with the ovum, an event marked by the formation of an “embryonic skin,” or wall. In this essay, the author holds that the full complexity of the human person implies such a profound unity-in-diversity of human being that we must, in the end, let the dialogue between (...) reason and revelation lead us to conclude that the first instant of embryonic life is the first instant that the person comes to exist: that the first sign of embryonic life is a “natural sacrament” of the internal act of God which brings the person to exist, one in soul and body. This paper examines the role of managerial self-interest in the merger market. It looks at factors influencing managers'' merger decisions by analyzing managerial expense preference factors on cross-sectional data employing non-parametric statistical methods. The same factors are examined for acquiring, acquired, and merging firms, and control groups used in each case. The results support the authors'' contention that managerial discretion is a significant motivating factor for mergers. The changes in expense preference factors indicate management decisions which provide conditions allowing management (...) to indulge in management preferred expenditures, while reducing risk to their career. The authors then provide a moral/philosophic framework of ethical analysis for examining manager''s merger decisions, using teleological and deontological theories. They conclude that merger decisions motivated or influenced by self-interest are unethical and, in the process, provide managers facing a merger decision with a framework for making an ethical decision. Statutes criminalizing behavior that risks transmission of HIV/AIDS exemplify use of the criminal law against individuals who are victims of infectious disease. These statutes, despite their frequency, are misguided in terms of the goals of the criminal law and the public health aim of reducing overall burdens of disease, for at least three important reasons. First, they identify individual offenders for punishment, a paradigm that is misplaced in the most typical contexts of transmission of infectious disease and even for HIV/AIDS, (...) despite claims of AIDS exceptionalism. Second, although there are examples of individuals who transmit infectious disease in a manner that fits the criminal law paradigm of identification of individual offenders for deterrence or retribution, these examples are limited and can be accommodated by existing criminal laws not devoted specifically to infectious disease. Third, and most importantly, the current criminal laws regarding HIV/AIDS, like many other criminal laws applied to infectious disease transmission, have been misguided in focusing on punishment of the diseased individual as a wrongful transmitter. Instead of individual offenders, activities that enhance the scale of disease transmission—behaviors that might be characterized as ‘transmission facilitation’—are a more appropriate target for the criminal law. Examples are trafficking in human beings (including sex trafficking, organ trafficking, and labor trafficking), suppression of information about the emergence of infection in circumstances in which there is a legally established obligation to disclose, and intentional or reckless activities to discourage disease treatment or prevention. Difficulties remain with justifications for criminalizing even these behaviors, however, most importantly the need for trust in reducing overall burdens of disease, problems in identifying individual responsible offenders, and potential misalignment between static criminal law and the changing nature of infectious disease. The article suggests that the position ascribed to thrasymachus in book i of plato's "republic" may be confused but need not be self-contradictory. A formal argument is constructed that derives his conclusion from premisses based on things he says, though not always in the language he uses. It is not suggested that plato ascribes this argument to thrasymachus, but only that it is consistent and intelligible in itself and compatible with what thrasymachus does say.

Vagueness: an expression is vague if and only if it is possible that it give rise to a “borderline case.” A borderline case is a situation in which the application of a particular expression to a (name of) a particular object does not generate an expression with a definite TRUTH-VALUE. That is, the piece of language in question neither applies to the object nor fails to apply. Although such a formulation leaves it open what the pieces of language might be (...) (whole sentences, individual words, NAMES or SINGULAR TERMS, PREDICATES or GENERAL TERMS), most discussions have focussed on vague general terms and have considered other types of terms to be non-vague. (Exceptions to this have called attention to the possibility of vague objects, thereby making the designation relation for singular terms be vague). The formulation also leaves open the possible causes for the expression not to have a definite truth value. If this indeterminacy is due to there being insufficient information available to determine applicability or non-applicability of the term (that is, we’re convinced the term either does or doesn’t apply, but we just don’t have enough information to determine which), then this is sometimes called “epistemic vagueness.” It is somewhat misleading to call this vagueness, for unlike true vagueness, this epistemic vagueness disappears if more information is brought into the situation. (‘There are 1.89∞106 stars in the sky’ epistemically vague but is not vague in the generally accepted sense of the term). ‘Vagueness’ may also be used to characterize non-linguistic items such as CONCEPTS, MEMORIES, and OBJECTS ... as well as such semi-linguistic items as STATEMENTS and PROPOSITIONS. Many of the issues involved in discussing the topic of vagueness impinge upon other philosophical topics, such as the existence of TRUTH-VALUE GAPS (declarative sentences which are neither TRUE nor FALSE) and the plausibility of MANY-VALUED LOGIC.. In this paper, I present the recently much discussed Value Challenge for Theories of Knowledge and formulate Generic Theistic reliabilism as a theory, which can answer this challenge, with respect to Theism and the proposition ”God exists’.

In this paper we explore a class of belief update operators, in which the definition of the operator is compositional with respect to the sentence to be added. The goal is to provide an update operator that is intuitive, in that its definition is based on a recursive decomposition of the update sentence’s structure, and that may be reasonably implemented. In addressing update, we first provide a definition phrased in terms of the models of a knowledge base. While this operator (...) satisfies a core group of the benchmark Katsuno Mendelzon update postulates, not all of the postulates are satisfied. Other Katsuno Mendelzon postulates can be obtained by suitably restricting the syntactic form of the sentence for update, as we show. In restricting the syntactic form of the sentence for update, we also obtain a hierarchy of update operators with Winslett’s standard semantics as the most basic interesting approach captured. We subsequently give an algorithm which captures this approach; in the general case the algorithm is exponential, but with some not unreasonable assumptions we obtain an algorithm that is linear in the size of the knowledge base. Hence the resulting approach has much better complexity characteristics than other operators in some situations. We also explore other compositional belief change operators: erasure is developed as a dual operator to update; we show that a forget operator is definable in terms of update; and we give a definition of the compositional revision operator. We obtain that compositional revision, under the most natural definition, yields the Satoh revision operator. (shrink)
