At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following article aims (...) to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Mindfulness-based training programs are highly established in competitive and recreational sports. One of the best-known approaches is the Mindfulness-Acceptance-Commitment Approach by Gardner and Moore), which integrates mindfulness aspects of awareness, non-judgmental attitude, and focus. Based on these aspects, Thienot and colleagues developed and validated an English language sport-specific questionnaire, the so-called Mindfulness Inventory for Sport, for the assessment of mindfulness skills in athletes. The aim of this study is to psychometrically test a German language version of the MIS. To assess (...) the psychometric properties, the MIS-D was examined in an online survey with an integrated test–retest design for reliability, validity, and measurement invariance. The present results support the psychometric quality of the German language version of the MIS. Could utopianism be what brings us together? Last summer (2022) we started asking ourselves these questions, and months later Green (...) Utopia Now! A Transdisciplinary Symposium on How to Deal with the Climate Crisis was our initial attempt at finding an answer. The symposium was an ambitious and challenging venture from the start. Our aspirations for it were perhaps still formulated best in the event program:Green Utopia Now! brings together an outstanding group of early career researchers (ECRs) working on climate and the environment in various fields of study. The symposium will provide a creative space where ECRs can share their transdisciplinary perspectives on how to challenge the limits of monodisciplinary views on sustainability, and how the sciences and the humanities can join forces to tackle the current climate crisis. Each of these scientific and cultural points of view will be brought together by a utopian impulse that insists on the role of collaboration, and the urgency of positive [End Page 368] climate action. In fact, this symposium is guided by our conviction about the importance of (1) transdisciplinary collaboration, (2) innovative research conducted by ECRs, and (3) utopian thinking and practice for engaging with global scale problems.Fortunately, eleven guest speakers accepted the challenge, and their answers were unsurprisingly diverse.1If we are to approach the vicissitudes of the climate crisis, we must, as Hannah Nelson-Teutsch and Lena Pfeifer recently called for, seek “new, entangled form(at)s of scholarship in the humanities.”1 These entanglements have become even more obvious in the ways in which research on the climate and environmental crises challenges the very limits of humanities and monodisciplinary scholarship. Not circumscribed to the humanities, then, Green Utopia Now! similarly aspired to “new, entangled form(at)s” of transdisciplinary research at the intersection of environmental and utopian studies. Thus, it follows that this briefing too should diverge from the conventional form(at) in an attempt to convey the professional, personal and collective entanglements of our projects.Green utopianism, as described in a recent issue of this journal, shares with political ecological movements a radical and urgent “need to live and embody better alternatives within the Now.”2 This idea of “nowness” inspired our symposium down to its title. It would be only fitting, then, that the author, Heather Alberro, would deliver the opening keynote of the Green Utopia Now! symposium. Alberro (Nottingham Trent) joined us online to, on the one hand, (re)introduce the idea of green utopianism and, on the other, propose a new iteration termed “terrestrial ecotopianism.” Drawn for a wide range of both fictional and nonfictional, imaginative and empirical sources, Alberro’s terrestrial ecotopianism redirects our focus toward the here and the now. Providing a further layer to this utopian project is the work being conducted in empirical ecocriticism, as made obvious by W. P. Małecki (Wrocław), who delivered the closing keynote, which was based on “hot off the press” research on environmental communication, environmental psychology, as well as affective (and, of course, empirical) ecocriticism. It inquired into the possibilities of utopian cli-fi in general, and Kim Stanley Robinson’s The Ministry for the Future (2020) in particular, to change attitudes toward the climate crisis. abstract The moral value of distributive equality constitutes one of the most contentious debates in political philosophy. Following Frankfurt, many philosophers have claimed that the intuitive appeal of equality is illusory and that egalitarian intuitions are fundamentally intuitions about the importance of satisfying basic needs. According to this argument, our intuitions tell us that inequality ceases to matter once a certain threshold has been reached. Despite the widespread appeal to intuitions regarding this issue, few empirical studies have tried to assess (...) whether Frankfurt and his followers are right in claiming the lack of intuitiveness of equality per se. In a series of three experiments, we show that experimental evidence does not allow us to settle the intuitiveness of each theory: laypeople are divided in the consideration of the respective importance of needs and equality. While our results do show that laypeople attach special importance to needs‐fulfilment, it also seems that they are divided when it comes to the importance they grant to equality once needs are fulfilled. No theory is unanimously backed by participants, and it seems that, fundamentally, divisions among philosophers reflect deep divisions among people. (shrink)

Rejuvenation of cells by reprogramming toward the pluripotent state raises increasing attention. In fact, generation of induced pluripotent stem cells (iPSCs) completely reverses age‐associated molecular features, including elongation of telomeres, resetting of epigenetic clocks and age‐associated transcriptomic changes, and even evasion of replicative senescence. However, reprogramming into iPSCs also entails complete de‐differentiation with loss of cellular identity, as well as the risk of teratoma formation in anti‐ageing treatment paradigms. Recent studies indicate that partial reprogramming by limited exposure to reprogramming factors (...) can reset epigenetic ageing clocks while maintaining cellular identity. So far, there is no commonly accepted definition of partial reprogramming, which is alternatively called interrupted reprogramming, and it remains to be elucidated how the process can be controlled and if it resembles a stable intermediate state. In this review, we discuss if the rejuvenation program can be uncoupled from the pluripotency program or if ageing and cell fate determination are inextricably linked. Alternative rejuvenation approaches with reprogramming into a pluripotent state, partial reprogramming, transdifferentiation, and the possibility of selective resetting of cellular clocks are also discussed. Sustainability challenges typically occur across sectoral boundaries, calling the state, market, and civil society to action. Although consensus exists on the merits of cross-sector collaboration, our understanding of whether and how it can create value for various, collaborating stakeholders is still limited. This special issue focuses on how new combined knowledge on cross-sector collaboration and business models for sustainability can inform the academic and practitioner debates about sustainability challenges and solutions. We discuss how cross-sector collaboration can play an important role (...) for the transition to new and potentially sustainability-driven business models given that value creation, delivery, and capture of organizations are intimately related to the collaborative ties with their stakeholders. Sustainable alternatives to conventional business models tend to adopt a more holistic perspective of business by broadening the spectrum of solutions and stakeholders and, when aligned with cross-sector collaboration, can contribute new ways of addressing the wicked sustainability problems humanity faces. Responsible business conduct (RBC)—the corporate activities and initiatives that proactively address corporate involvement in human rights, environmental, and governance threats—has become an increasingly used means to counteract and prevent adverse effects of global businesses. Unlike other business sectors whose adverse impacts and RBC efforts (or lack thereof) are well documented, a comprehensive understanding of the state of commodity trading (CT), has been missing. In response, this paper uses a multidisciplinary literature review to provide an integrative understanding of the current state (...) of research on the relationship between CT and RBC. Based on a review of 131 articles, we advance a granular understanding of the current and prospective role of commodity traders in RBC by grouping extant research into three overarching themes: (1) industry self-regulation and co-regulatory initiatives, (2) government-led regulatory initiatives and policy responses, and (3) company-level management strategies impacting RBC practices. In addition to illustrating the themes through existing research and identifying gaps along the overarching themes, we use our literature review to suggest avenues for future research. The paper’s overarching contribution is, first, to synthesize previously fragmented findings into a coherent framework of CT and RBC. And second, to offer guidance on how scholarship in this important domain can be developed into a more mature, legitimate and practical stream of research. (shrink)

Most research on risk aversion in behavioral science with human subjects has focused on a component of risk aversion that does not adapt itself to context. More recently, studies have explored risk aversion adaptation to changing circumstances in sequential decision-making tasks. It is an open question whether one can identify evidence, at the single subject level, for such risk aversion adaptation. We conducted a behavioral experiment on human subjects, using a sequential decision making task. We developed a model-based approach for (...) estimating the adaptation of risk-taking behavior with single-trial resolution by modelling a subject’s goals and internal representation of task contingencies. Using this model-based approach, we estimated the subject-specific adaptation of risk aversion depending on the current task context. We found striking inter-subject variations in the adaptation of risk-taking behavior. We show that these differences can be explained by differences in subjects’ internal representations of task contingencies and goals. We discuss that the proposed approach can be adapted to a wide range of experimental paradigms and be used to analyze behavioral measures other than risk aversion. (shrink)

Motivated by results on interactive proof systems we investigate an ∃-∀hierarchy over P using word quantifiers as well as two types of set quantifiers. This hierarchy, which extends the polynomial-time hierarchy, is called the analytic polynomial-time hierarchy. It is shown that every class of this hierarchy coincides with one of the following Classes: ∑math image, Πmath image , PSPACE, ∑math image or Πmath image . This improves previous results by Orponen [6] and allows interesting comparisons with the above mentioned results (...) on inter-active proof systems. (shrink)

This article is intended to provide a review of some modifications to the Drake equation, a 1961 concept presented by Frank Drake to determine the number of extra-terrestrial civilizations able to communicate. A reduced version of the Drake equation will then be presented. This can be used to estimate an important question for astrobiology, the frequency with which planets are habitable. Finally, a concept is presented that can also integrate the habitability of moons into the reduced Drake equation.

The notion of harmony has played a pivotal role in a number of debates in the philosophy of logic. Yet there is little agreement as to how the requirement of harmony should be spelled out in detail or even what purpose it is to serve. Most, if not all, conceptions of harmony can already be found in Michael Dummett's seminal discussion of the matter in The Logical Basis of Metaphysics. Hence, if we wish to gain a better understanding of the (...) notion of harmony, we do well to start here. Unfortunately, however, Dummett's discussion is not always easy to follow. The following is an attempt to disentangle the main strands of Dummett's treatment of harmony. The different variants of harmony as well as their interrelations are clarified and their individual shortcomings qua interpretations of harmony are demonstrated. Though no attempt is made to give a detailed alternative account of harmony here, it is hoped that our discussion will lay the ground for an adequate rigorous treatment of this central notion. It is commonly argued that natural language has the expressive power of quantifying over intensional entities, such as times, worlds, or situations. A standard way of modelling this assumes that there are unpronounced but syntactically represented variables of the corresponding type. Not all that much as has been said, however, about the exact syntactic location of these variables. Meanwhile, recent work has highlighted a number of problems that arise because the interpretive options for situation pronouns seem to be subject to (...) various restrictions. This paper is primarily concerned with situation pronouns inside of determiner phrases, arguing that they are introduced as arguments of (certain) determiners. Verbal predicates, on the other hand, are assumed to not combine with a situation pronoun. The various restrictions on their interpretation are shown to fall out from the semantic system that is developed based on that view. Further support for such an account comes from situation semantic analyses of donkey sentences as well as data on the temporal interpretation of nominal predicates. Its ability to account for this full range of data in a unified manner is shown to set it apart from previous proposals. The paper closes with an outlook on further extensions, including an account of quantifier domain restriction based on situation pronouns. (shrink)

The requirement of proof-theoretic harmony has played a pivotal role in a number of debates in the philosophy of logic. Different authors have attempted to precisify the notion in different ways. Among these, three proposals have been prominent in the literature: harmony–as–conservative extension, harmony–as–leveling procedure, and Tennant’s harmony–as–deductive equilibrium. In this paper I propose to clarify the logical relationships between these accounts. In particular, I demonstrate that what I call the equivalence conjecture —that these three notions essentially come to the (...) same thing—is erroneous. (shrink)

According to Michael Dummett, we may think of the meaning of an expression as given by the principles governing the use we make of it. The principles regulating our linguistic practices can then be grouped into two broad categories (Dummett 1973: 396, 1991: 211). We might state them as follows: I-principles: state the circumstances under which an assertion of a sentence containing the expression in question is warranted. E-principles: state the consequences of asserting a sentence containing the expression. In the (...) case of the logical constants, we may associate a constant's I-principles with the set of its introduction rules and its E-principles with the set of its elimination rules (Dummett 1973: 454).1. Dans cet article, nous proposons de montrer expérimentalement que le "sens commun" n'est en matière moral ni complètement objectiviste ni complètement relativiste, mais qu'un même individu peut être tantôt objectiviste tantôt relativiste. De même, nous montrons que les jugements de goût portant sur le prédicat "dégoûtant" ne sont pas toujours relativiste mais peuvent varier selon le contexte entre objectivisme et relativisme.

Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

In this paper I examine the question of logic’s normative status in the light of Carnap’s Principle of Tolerance. I begin by contrasting Carnap’s conception of the normativity of logic with that of his teacher, Frege. I identify two core features of Frege’s position: first, the normative force of the logical laws is grounded in their descriptive adequacy; second, norms implied by logic are constitutive for thinking as such. While Carnap breaks with Frege’s absolutism about logic and hence with the (...) notion that any system of logic should have a privileged claim to correctness, I argue that there is a sense in which Carnap’s framework-relative conception of logical norms has a constitutive role to play: though they are not constitutive for the conceptual activity for thinking, they do nevertheless set the ground rules that make certain forms of scientific inquiry possible in the first place. I conclude that Carnap’s principle of tolerance is tamer than one might have thought and that, despite remaining differences, Frege’s and Carnap’s conceptions of logic have more in common than one might have thought. This article offers an overview of inferential role semantics. We aim to provide a map of the terrain as well as challenging some of the inferentialist’s standard commitments. We begin by introducing inferentialism and placing it into the wider context of contemporary philosophy of language. §2 focuses on what is standardly considered both the most important test case for and the most natural application of inferential role semantics: the case of the logical constants. We discuss some of the (alleged) benefits (...) of logical inferentialism, chiefly with regards to the epistemology of logic, and consider a number of objections. §3 introduces and critically examines the most influential and most fully developed form of global inferentialism: Robert Brandom’s inferentialism about linguistic and conceptual content in general. Finally, in §4 we consider a number of general objections to IRS and consider possible responses on the inferentialist’s behalf. (shrink)

This paper argues that logical inferentialists should reject multiple-conclusion logics. Logical inferentialism is the position that the meanings of the logical constants are determined by the rules of inference they obey. As such, logical inferentialism requires a proof-theoretic framework within which to operate. However, in order to fulfil its semantic duties, a deductive system has to be suitably connected to our inferential practices. I argue that, contrary to an established tradition, multiple-conclusion systems are ill-suited for this purpose because they fail (...) to provide a 'natural' representation of our ordinary modes of inference. Moreover, the two most plausible attempts at bringing multiple conclusions into line with our ordinary forms of reasoning, the disjunctive reading and the bilateralist denial interpretation, are unacceptable by inferentialist standards. In emergency contexts, leaders’ ability to develop others’ trust in them is critical to leadership effectiveness. By integrating functional leadership and team process theories, we argue that democratic and autocratic leadership can create trust in the leader depending on the performance phase of the action team. We further argue that action and transition phases produce different task demands for leadership behavior to enhance trust in the leader, and different leader characteristics mediate these effects. The results of a scenario experiment and (...) field survey among firefighters revealed that autocratic rather than democratic leadership elevates trust in the leader during the action phase by increasing leader ability. In contrast, democratic rather than autocratic leadership enhances trust in the leader during the transition phase by elevating leader benevolence. These findings highlight the importance of leader characteristics in emergencies, demonstrating the value of mixing autocratic and democratic leadership behaviors across different team performance phases to build trust in the leader. According to tradition, logic is normative for reasoning. Gilbert Harman challenged the view that there is any straightforward connection between logical consequence and norms of reasoning. Authors including John MacFarlane and Hartry Field have sought to rehabilitate the traditional view. I argue that the debate is marred by a failure to distinguish three types of normative assessment, and hence three ways to understand the question of the normativity of logic. Logical principles might be thought to provide the reasoning agent with (...) first-personal directives; they might be thought to serve as third-personal evaluative standards; or they might underwrite our third-personal appraisals of others whereby we attribute praise and blame. I characterize the three normative functions in general terms and show how a failure to appreciate this threefold distinction has led disputants to talk past one another. I further show how the distinction encourages fruitful engagement with and, ultimately, resolution of the question. (shrink)

If feeling a genuine emotion requires believing that its object actually exists, and if this is a belief we are unlikely to have about fictional entities, then how could we feel genuine emotions towards these entities? This question lies at the core of the paradox of fiction. Since its original formulation, this paradox has generated a substantial literature. Until recently, the dominant strategy had consisted in trying to solve it. Yet, it is more and more frequent for scholars to try (...) to dismiss it using data and theories coming from psychology. In opposition to this trend, the present paper argues that the paradox of fiction cannot be dissolved in the ways recommended by the recent literature. We start by showing how contemporary attempts at dissolving the paradox assume that it emerges from theoretical commitments regarding the nature of emotions. Next, we argue that the paradox of fiction rather emerges from everyday observations, the validity of which is independent from any such commitment. This is why we then go on to claim that a mere appeal to psychology in order to discredit these theoretical commitments cannot dissolve the paradox. We bring our discussion to a close on a more positive note, by exploring how the paradox could in fact be solved by an adequate theory of the emotions. (shrink)

Carnap's ideal of explication has become a key concept in analytic philosophy and the basis of a method of analysis which may be considered as an alternative to various forms of naturalism, including Quine's conception of a naturalized epistemology. More recently, new light has been shed on this aspect of the classical Carnap-Quine debate by contemporary philosophers. Whereas Michael Friedman articulated a notion of relativized a priori which owes much to Carnap's internal/external distinction, André Carus attempted to restate Carnap's ideal (...) of explication in a way that bridges the gap between conceptual engineering and naturalism. On the other hand, Mark Wilson argued that concepts develop in unpredictable ways and cannot be planned in the way classical analytic philosophy has assumed from Frege and Russell onwards. Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

Logic has traditionally been construed as a normative discipline; it sets forth standards of correct reasoning. Explosion is a valid principle of classical logic. It states that an inconsistent set of propositions entails any proposition whatsoever. However, ordinary agents presumably do — occasionally, at least — have inconsistent belief sets. Yet it is false that such agents may, let alone ought to, believe any proposition they please. Therefore, our logic should not recognize explosion as a logical law. Call this the (...) ‘normative argument against explosion’. Arguments of this type play — implicitly or explicitly — a central role in motivating paraconsistent logics. Branden Fitelson, in a throwaway remark, has conjectured that there is no plausible ‘bridge principle’ articulating the normative link between logic and reasoning capable of supporting such arguments. This paper offers a critical evaluation of Fitelson’s conjecture, and hence of normative arguments for paraconsistency and the conceptions of logic’s normative status on which they repose. It is argued that Fitelson’s conjecture turns out to be correct: normative arguments for paraconsistency probably fail. (shrink)

ABSTRACT:Increasingly, global businesses are confronted with the question of complicity in human rights violations committed by abusive host governments. This contribution specifically looks at silent complicity and the way it challenges conventional interpretations of corporate responsibility. Silent complicity implies that corporations have moral obligations that reach beyond the negative realm of doing no harm. Essentially, it implies that corporations have a moral responsibility to help protect human rights by putting pressure on perpetrating host governments involved in human rights abuses. This (...) is a controversial claim, which this contribution proposes to analyze with a view to understanding and determining the underlying conditions that need to be met in order for moral agents to be said to have such responsibilities in the category of the duty to protect human rights.
