The tension between economic policy and health policy is a longstanding dilemma, but one that was brought to the fore with the World Trade Organization’s Trade-Related Aspects of Intellectual Property Rights Agreement in 1994. The pharmaceutical industry has long argued that intellectual property protection is vital for innovation. At the same time, there are those who counter that strong IPP negatively impacts the affordability and availability of essential medicines in developing countries. However, actors on both sides of the debate were (...) in agreement that something needed to be done to address the HIV/AIDS crisis, especially in developing countries. In response to sustained and significant pressure from civil society groups, members of the World Trade Organization agreed to the Declaration on the TRIPS Agreement and Public Health in 2001. The Declaration clarified that countries unable to manufacture the needed pharmaceuticals could obtain more affordable generics elsewhere if necessary. (shrink)

This paper examines two recent examples of compulsory licensing legislation: one globally embraced regime and one internationally controversial regime operating under the same WTO rules. In particular, we consider Canadian legislation and the use of compulsory licensing for HIV/AIDS drugs destined for a developing country. This is then contrasted with the conditions under which Thai authorities are pursuing compulsory licenses, the outcomes of their compulsory licenses, as well as the likely impact of the Thai policy. Finally, we construct a rubric (...) to evaluate characteristics of a successful regime. This is used to analyze the Canadian and Thai regimes and frame the expected implications of each national policy. It is hoped that the assessment will guide changes to compulsory licensing design to ensure that legitimate regimes are embraced while illegitimate ones are disallowed. (shrink)

Given the high prevalence and dramatic impact of being bullied at school, it is crucial to get more insight into how teachers can reduce bullying. So far, few instruments have measured elementary teachers’ responses to bullying. This study investigated the validity of the student-reported Teachers’ Responses to Bullying Questionnaire. The factor structure and measurement invariance were tested across two educational contexts among fourth and fifth grade students from Italy and Belgium. Furthermore, associations between student-perceived teachers’ responses and students’ bullying behavior (...) were examined. Confirmatory Factor Analysis supported the predicted five-factor structure, distinguishing Non-Intervention, Disciplinary Methods, Group Discussion, Mediation, and Victim Support. A partial factor means invariance model was found, allowing for valid comparisons between the Italian and Belgian educational contexts. Significant associations were found between self-reported, but not peer-nominated, bullying behavior and most student-perceived teachers’ responses. (shrink)

Das Thema Knochenverwertung wurde im Schulunterricht der NS-Zeit genutzt, um Jugendlichen die Relevanz des Vierjahresplans und der deutschen Autarkiepolitik zu verdeutlichen und sie zu motivieren, sich im Rahmen der Altstoffsammlungen an der heimischen Erfassung dieses Rohmaterials zu beteiligen. Diverse NS-Instanzen hatten ein differenziertes Spektrum von Lehrmitteln erarbeitet, um die Behandlung dieses Themas in der (...) Schule zu unterstützen. Der Artikel untersucht, welche Botschaften diese damals hochmodernen Unterrichtsmedien vermittelten und zeigt, wie auch weniger ideologieanfällig scheinende Fächer, etwa der Chemieunterricht, politisch instrumentalisiert wurden. This article reports a study exploring the meaning of the complex phenomenon of moral responsibility in nursing practice. Each of three focus groups with a total of 14 student nurses were conducted twice to gather their views on moral responsibility in nursing practice. The data were analysed by qualitative thematic content analysis. Moral responsibility was interpreted as a relational way of being, which involved guidance by one’s inner compass composed of ideals, values and knowledge that translate into a striving to (...) do good. It was concluded that, if student nurses are to continue striving to do good in a way that respects themselves and other people, it is important that they do not feel forced to compromise their values. Instead they should be given space and encouragement in their endeavours to do good in a relational way that advances nursing as a moral practice. (shrink)

This article is a critical review of Dale Jacquette's "Meinongian Logic. The Semantics of Existence and Nonexistence" (Berlin: de Gruyter, 1996). Every consistent Meinongian semantics contains either a distinction of two kinds of properties – "nuclear" and "extranuclear" ones – (Terence Parsons) or a modes of predication distinction (William Rapaport, Edward N. Zalta, and others). Jacquette claims that the former is conceptually prior to the latter and that only the former rids Meinong's theory of objects of some paradoxes. I argue (...) against these priority claims. Furthermore, I offer definitions of both distinctions, based on Meinong's concept of so-being. (shrink)

The aim of this book is to investigate the nature and ontological status of fictional characters on the one hand (i. e., entities like Sherlock Holmes, Hamlet, or Anna Karenina) and literary works on the other. The overall question is: What kinds of objects are fictional characters and literary works, and how are they related to our everyday world? Thomasson advocates a realist, non-reductionist theory of fictitious objects whose main principles are: Fictional characters exist – just as literary works exist. (...) Fictional characters as well as literary works are abstract objects (i. e., lack spatiotemporal location), are created (and thus contingent), are brought into existence through the intentional acts of an author, can go on existing without intentional acts of an author, and are existentially dependent objects in a variety of ways. Thomasson develops a subtle theory of ontological dependence. The review contains a detailed account of Thomasson's "artifactual theory" as well as detailed criticism of some pivotal points. While I am, in principle, sympathetic to the non-reductionist approach, I object against some of Thomasson's specific dependency claims. Furthermore, I defend so-called "Meinongian" theories of fiction against Thomasson's objections. Finally, I raise questions concerning, among other things, the relation between a literary work and its "text", the proposed identity conditions for literary works, the relation between a literary work and its (fictitious) objects. The objective of this paper is to characterize the rich interplay between automatic and cognitive control processes that we propose is the hallmark of skill, in contrast to habit, and what accounts for its flexibility. We argue that this interplay isn't entirely hierarchical and static, but rather heterarchical and dynamic. We further argue that it crucially depends on the acquisition of detailed and well-structured action representations and internal models, as well as the concomitant development of metacontrol processes that can be (...) used to shape and balance it. Ten years ago, one of us proposed a dynamic hierarchical model of intentions that brought together philosophical work on intentions and empirical work on motor representations and motor control (Pacherie, 2008). The model distinguished among Distal intentions, Proximal intentions, and Motor intentions operating at different levels of action control (hence the name DPM model). This model specified the representational and functional profiles of each type of intention, as well their local and global dynamics, and the ways in which they interact. (...) A core insight of the model was that action control is the result of integrated, coordinated activity across these levels of intention. Since the proposal of the model, empirical and theoretical works in philosophy and cognitive science have emerged that would seem to support and expand on this central insight. In particular, an updated understanding of the nature of sensorimotor processing and motor representations, as well as of how the different levels of intention and control interface and interact, allows for the further specification and precisification of the original DPM model. Elisabeth Porter's guide to the development of feminist thought on ethics & moral agency surveys feminist debates on the nature of feminist ethics, intimate relationships, professional ethics, politics, sexual politics, abortion and reproductive choices.

I argue that in order to solve the main difficulties confronted by the classical versions of the causal theory of action, it is necessary no just to make room for intentions, considered as irreducible to complexes of beliefs and desires, but also to distinguish among several types of intentions. I present a three-tiered theory of intentions that distinguishes among future-directed intentions, present-directed intentions and motor intentions. I characterize each kind of intention in terms of its functions, its type of content, (...) its dynamics and the rationality and time constraints that bear on it. Climate scientists have been engaged in a decades-long debate over the standing of satellite measurements of the temperature trends of the atmosphere above the surface of the earth. This is especially significant because skeptics of global warming and the greenhouse effect have utilized this debate to spread doubt about global climate models used to predict future states of climate. I use this case from an understudied science to illustrate two distinct philosophical approaches to the relations among data, scientist, measurement, models, (...) and theory. I argue that distinguishing between “direct” empiricist and “complex” empiricist approaches helps us understand and analyze this important scientific episode. I introduce a complex empiricist account of testing and evaluation, and contrast it with the basic hypothetico-deductive approach to the climate models used by the direct empiricists. This more developed complex empiricist approach will serve philosophy of science well, as computational models become more widespread in the sciences. (shrink)
