Diversity is both an unavoidable aspect of twenty-first century living and a powerful challenge to older philosophical traditions that still assume as normatively universal a set of values, ways of thinking, institutions, and habits of living that emerged within earlier eras of more homogeneous cultures, less developed technologies, and more accepted forms of linguistic, legal, religious, economic, political, and military domination. Within recent years, new styles of philosophical discourse, including deconstruction, postmodernism, feminism, post-colonialism, and critical race theory, have (...) persuasively challenged these universalistic assumptions to reveal the important human differences they marginalize. Experience-based appreciation of the mutually educative potential of diverse standpoints as well as sober concern about the perils of our present times have led many thinkers to look for contemporary forms of pragmatism and cosmopolitanism as hospitable intellectual gathering places for urgently needed cross-difference conversations that may reflect and give substance to shared visions of democratic diversity. The eight authors in this volume engage in cross-difference conversations with other thinkers from earlier periods and other philosophical traditions, as well as with each other, in order to reconstruct pragmatism and cosmopolitanism in ways that are more attuned to our lived experience of diversity as well as our hopes for a diversity-appreciating democratic future. Although contemporary powers metaphysics largely understands itself as a metaphysical realist undertaking, recently powers have come to the surface also within an idealist context. This paper aims to characterize and motivate an absolute idealist conception of powers. I compare realist and idealist powers metaphysics in their respective responses to Humean scepticism concerning powers, thereby motivating the claim that the very idea of a power is actually best understood as an idealist idea. I continue to characterize the absolute idealist’s understanding of (...) power, for which it is necessary to see that the content of her power notion is inseparable from the way in which she arrives at that notion. I close with a brief reflection on the absolute idealist’s understanding of the power of thought, which is where idealist and realist powers metaphysics diverge most radically. (shrink)

Current theories of knowledge, art, and power are locked into sterile debates around the question of representation. This book examines the limits of antirepresentationalism in these fields and argues that the anarchist tradition can point the way beyond our contemporary crisis of representation. The author rereads the theory and practical experiences of anarchism from the nineteenth century to the present, proposing a radical revision of received notions of the subject - from the equation of anarchy with literary decadence to (...) the interpretation of anarchism as yet another discourse founded on a notion of the human essence. What emerges, instead, is a complex portrait of anarchism as a body of thought that provides the framework for a kind of critical realism, with implications for fields ranging from aesthetics to economics, from philosophy to politics. In this scholarly, well-planned, and well-documented number in the series "Seminar in the History of Ideas," Professor Boas, in these days of the People's Revolution, shows himself an unrepentant elitist. Illustrative of this attitude is his statement in the fourth essay: "Hideous as such a view seems to a modern reader softened by humanitarianism, it would be well if we could tell in advance whom God has chosen to be lettered. There is certainly little sense in wasting a college education (...) on anyone predestined to be an ass or an ox." Boas' wish to avoid the people as much as possible determines the orientation of many of the eight essays in this book about the history of the people in art, literature, music, and politics. In the second essay, "Who are the People?" he explores the various religious, social, and political contexts in which the term "People" has been used, and concludes that its reality is only nominalistic, since the term has had so many diverse meanings. In "The People as Poet," he creates a multi-faceted study of the rural muse, of national traits expressed in poetry, and of folk forms. But in doing so, he argues against the collectivist theory of creation and dismisses the poetic products of country-folk as strictly derivative. Boas barely alludes to the phenomenon of oral composition. He is evidently unaware that this tradition was as alive in twentieth-century Yugoslavia as in Homer's Greece. Consideration of such evidence might have caused him to modify his unqualified attribution of a monopoly on poetic creation to the individual poet. A good part of the penultimate essay, "The People as Musician," is devoted to a survey of nineteenth-century movements of cultural and political internationalism. The other half explores the possibility of artistic expression of the "national soul," an idea which the author particularly disparages in the case of music because of the limits of symbolism of the medium. In "Egalitarianism," Boas surveys the condition of the working man and pronounces that all is well; the lucky fellow works in modern, clean factories--no noisier than his TV-dominated home--and stands on the verge of full participation with management in the benefits of production. Despite its ideological naÏvetés, the book remains a model of scholarly talent and discipline, as well as a mine of standard and esoteric information on the history of the "People" in many fields. This volume brings the remarkable writings of Russian liberal thinker Boris Nikolaevich Chicherin to English-language readers for the first time. The collection includes key essays in which Chicherin addresses the central political and social problems that confronted Russia from 1855 to the opening years of the twentieth century. Chicherin’s ideological alternatives to the Bolshevik plan for revolutionary transformation of Russia not only provide valuable historical insights, but also are highly relevant to current political discussion of liberalism in Russia and (...) in the West. In a comprehensive introduction to the book, G. M. Hamburg discusses the development of Chicherin’s thought and places it in historical context. Chicherin, Hamburg says, was a powerful and sophisticated but often misunderstood defender of civil and political rights. Like his fellow liberals in Russia, Chicherin was heavily influenced by German idealism and particularly by Hegel. He departed from many, however, in favoring a market economy and advocating that reform efforts be tailored to local conditions and traditions. In this collection Chicherin explores such contemporary issues as the abolition of serfdom, Russian education, and the need for a constitution. He also tackles broad philosophical problems—the nature of liberty and equality, styles of political discourse—and comments on such philosophers as Plato, Aristotle, More, Machiavelli, Montesquieu, Hegel, and Marx. Power enthusiasts are engaged in two projects: developing a decent metaphysical account of powers, and applying that account in order to make progress on various other philosophical issues, ranging from narrowly related topics such as causality to further removed ones such as free will, reasoning, or perception. I argue that an intermediate step may be taken, one that explores ‘varieties of power’ while still staying within the realm of, of ‘pure’ powers metaphysics. Taking this intermediate step provides a much more (...) interesting basis for those involved in project, ‘applied’ powers metaphysics. I articulate four such varieties of power by exploring various dimensions in which the explanatory profile of a power can be extended. Humeans take reality to be devoid of ‘necessary connections’: things just happen. Laws of nature are to be understood in terms of what ‘just happens’, not vice versa. Here the Humean needs some conception of what it is that ‘just happens’ – a conception of the Humean mosaic. Lewis’s Humeanism incorporates such a conception in the form of a Lewis-style metaphysics of objects, properties, and modality. Newer versions of Humeanism about laws of nature, such as the Better Best Systems approach, (...) typically reject such a Lewisian metaphysics, but it remains unclear what they can offer in its place. By exploring different candidate conceptions, this paper sheds light on the limits of Humeanism about laws of nature: not all conceptions of the Humean mosaic form a suitable basis for a Humean theory of laws. In fact, only a metaphysics roughly in line with Lewis’s will do. The paper ends with a tentative generalization of this result, thus pointing to the ‘limit’ of Humeanism in general: taking the Humean way of thinking to its limit results in a rejection of the whole idea of such a mosaic – and hence of Humean mosaic-based accounts of anything. Life poses a threat to materialism. To understand the phenomena of animate nature, we make use of a teleological form of explanation that is peculiar to biology, of explanations in terms of what I call the ‘vital categories’ – and this holds even for accounts of underlying physico-chemical ‘mechanisms’. The materialist claims that this teleological form of explanation does not capture what is metaphysically fundamental, whereas her preferred physical form of explanation does. In this essay, I do three things. (1) (...) I argue that the ‘vital categories’, such as life form and life-process, do not reduce to the ‘physical categories’ and show that there are no grounds for the materialist's metaphysically limiting claim; (2) I sketch a positive view on how vital and physical explanations can both apply to a given phenomenon, and on how they interrelate; and (3) I show that this view meshes nicely with evolutionary theory, despite being committed to a form of ‘biological essentialism’. It is often claimed that principles of individuation imply essential properties of the things individuated. For example, sets are individuated by their members, hence sets have their members essentially. But how does this inference work? First I discuss the form of such inferences, and conclude that the essentialist inference is not a purely formal matter: although there is a form which all principles of individuation have in common, it is not true that any statement of that form is a principle (...) of individuation, and hence there is no valid inference based purely on that form. However, I argue that there is a viable version of the essentialist inference nonetheless. The resources for a proper reconstruction of this type of inference can be gathered from reflections upon the role principles of individuation play in the project of the ontologist: such principles turn out to carry a modal weight similar to that of definitions or conceptual truths. It follows that, no matter how austere the ontology, some portion of essentialist modality is inevitable. (shrink)

It is surprisingly hard to define presentism. Traditional definitions of the view, in terms of tensed existence statements, have turned out not to to be capable of convincingly distinguishing presentism from eternalism. Picking up on a recent proposal by Tallant, I suggest that we need to locate the break between eternalism and presentism on a much more fundamental level. The problem is that presentists have tried to express their view within a framework that is inherently eternalist. I call that framework (...) the Fregean nexus, as it is defined by Frege’s atemporal understanding of predication. In particular, I show that the tense-logical understanding of tense which is treated as common ground in the debate rests on this very same Fregean nexus, and is thus inadequate for a proper definition of presentism. I contrast the Fregean nexus with what I call the original temporal nexus, which is based on an alternative, inherently temporal form of predication. Finally, I propose to define presentism in terms of the original temporal nexus, yielding original presentism. According to original presentism, temporal propositions are distinguished from atemporal ones not by aspects of their content, as they are on views based on the Fregean nexus, but by their form—in particular, by their form of predication. Philosophical Thought in Russia in the Second Half of the 20th Century is the first book of its kind that offers a systematic overview of an often misrepresented period in Russia's philosophy. Focusing on philosophical ideas produced during the late 1950s – early 1990s, it reconstructs the development of genuine philosophical thought in the Soviet period and introduces those non-dogmatic Russian thinkers who saw in philosophy a means of reforming social and intellectual life. Covering such areas of philosophical inquiry (...) as philosophy of science, philosophical anthropology, the history of philosophy, activity approach as well as communication and dialogue studies, the volume presents and thoroughly discusses central topics and concepts developed by Soviet thinkers in that particular fields. Written by a team of internationally recognized scholars from Russia and abroad, it examines the work of well-known Soviet philosophers (such as Mikhail Bakhtin, Evald Ilyenkov and Merab Mamardashvili) as well as those important figures (such as Vladimir Bibler, Alexander Zinoviev, Yury Lotman, Georgy Shchedrovitsky, Genrich Batishchev, Sergey Rubinstein, and others) who have often been overlooked. This article aims to introduce Bell’s work to philosophical audiences while also presenting his work for consideration within our contemporary discussions of race and racism. Bell’s contributions to our understanding of race have gone largely unnoticed, and that those who consider themselves philosophers of race are unfamiliar with the contributions of the intellectual father of Critical Race Theory is not only a failure of intellectual scholarship, but it is also a missed opportunity to take seriously the claims of a legal, (...) political, and philosophical titan. The first section of this paper seeks to present Bell’s paradigm of racial realism and its constituent components. The second section explores what has led to Bell’s near complete exclusion from the discipline of philosophy, and philosophy of race specifically. The third section addresses the contributions that Bell’s theories can make to our contemporary discussions of race within the discipline of philosophy. (shrink)

Anscombe’s 1971 inaugural lecture at Cambridge, entitled ‘Causality and Determination’, has had a lasting influence on a remarkably broad range of philosophers and philosophical debates, touching on fundamental topics in philosophy of science, action theory, the free will debate, epistemology, philosophy of mind, and metaphysics. Especially where anti-reductionist or pluralist strands of philosophical thought are being seriously considered, one should not be surprised to find references to Anscombe’s lecture. Moreover, there appears to be a growing interest in Anscombe’s comprehensive philosophical (...) outlook, as attested by the recent publication of a weighty collection of essays spanning that outlook in its full breadth in the prestigious Routledge Philosophical Minds series. Against this background it is apt that now, 50 years after the original lecture, a Topical Collection sees the light, circling around the most central themes from Anscombe’s lecture, with a particular emphasis on the question how these hang together, how they form part of the larger philosophical project that Anscombe obviously intended the lecture to highlight. In the discourse of 18th-century British intellectuals the term 'luxury' held a well-recognized and much disputed place. Dispute arose chiefly around the problem of disentangling the economic, moral-theological and political strands of the term. The object of the present paper is to trace forward the history of debate over the concept along one develop ing line of specialization - that of 19th-century political economy. It will be seen how the term luxury (and related terms: necessity, decency, productive, (...) unproductive, etc.) adjusted meaning(s) as the economic, social and intellectual contexts in which it was embedded themselves mutated. In particular, it is argued, the changing significance attached to the term illustrates the extent to which a key 19th-century intellec tual elite managed to accommodate the implications of a transition from a society based on assumptions of scarcity and hierarchy to one that was beginning to contemplate the possibility of mass market abun dance. While the profession's leaders did develop a sharpened interest in aspiration to luxury consumption as a legitimate motor of economic growth, all registered their disapproval of certain forms of the aspira tion, revealing in the process a variety of class, gender and 'race' pre occupations - including (from J. S. Mill onwards) a particular distaste for positional or status-related consumption. (shrink)

BackgroundDefensive practice occurs when physicians provide services, such as tests, treatments and referrals, mainly to reduce their perceived legal or reputational risks, rather than to advance patient care. This behaviour is counter to physicians’ ethical responsibilities, yet is widely reported in surveys of doctors in various countries. There is a lack of qualitative research on the drivers of defensive practice, which is needed to inform strategies to prevent this ethically problematic behaviour.MethodsA qualitative interview study investigated the views and experiences of (...) physicians in Australia on defensive practice and its contribution to low value care. Interviewees were recruited based on interest in medico-legal issues or experience in a health service involved in ‘Choosing Wisely’ initiatives. Semi-structured interviews averaged 60 min in length. Data were coded using the Theoretical Domains Framework, which encapsulates theories of behaviour and behaviour change.ResultsAll participants (n = 17) perceived defensive practice as a problem and a contributor to low value care. Behavioural drivers of defensive practice spanned seven domains in the TDF: knowledge, focused on inadequate knowledge of the law and the risks of low value care; skills, emphasising patient communication and clinical decision-making skills; professional role and identity, particularly clinicians’ perception of patient expectations and concern for their professional reputation; beliefs about consequences, especially perceptions of the beneficial and harmful consequences of defensive practice; environmental context and resources, including processes for handling patient complaints; social influences, focused on group norms that encourage or discourage defensive behaviour; and emotions, especially fear of missing a diagnosis. Overall, defensive practice is motivated by physicians’ desire to avoid criticism or scrutiny from a range of sources, and censure from their professional peers can be a more potent driver than perceived legal consequences.ConclusionsThe findings call for strengthening knowledge and skills, for example, to improve clinicians’ understanding of the law and their awareness of the risks of low value care and using effective communication strategies with patients. Importantly, supportive cultures of practice and organisational environments are needed to create conditions in which clinicians feel confident in avoiding defensive practice and other forms of low value care. This essay offers a preliminary account of the ways in which alterations to the landscape of fourteenth- and fifteenth-century Sukhothai and Chiang Mai figured within the micro-politics of these city-states. I show how landscape alterations inspired by Lanka and mainland South Asia served the consolidation and projection of royal power within the context of local and regional competition, and how such alterations formed part of strategic royal engagement with Buddhist monastic lineages.

Its most famous appearance is of course, in Rousseau's political philosophy as the (...) expression, ideally embodied in the sovereign's commands, of what is in the common or public interest. The general will (la volonté générale) is, Rousseau says, the will of "the body of the people," that is, "the will that one has a citizen" for the common good. It thus stands in contrast to the "particular will" (la volonté particulière), the expression of one's individual and particularistic preference.1 In this political context, what gives the general will its generality is the universality of interest it represents. Its scope extends to all citizens and it specifies what is in the best interest of the members of the body politic as a whole. Although the general will may or may not coincide with each and every individual's private interest, all citizens are, as a matter of fact, properly served by its fulfillment.In his book The General Will Before Rousseau, Patrick Riley demonstrates how this central idea of eighteenth-century political thought actually has its origins in seventeenth-century theological debates over divine, not human, justice. The mystery [of the origins of the general will] is solved when one realizes that the term volonté générale was well established in the seventeenth-century, though not primarily as a political idea. In fact, the notion of "general will" was originally a theological one, referring to the kind of will that God (supposedly) had in deciding who would be granted grace sufficient for salvation and who would be consigned to hell. The [End Page 37] question at issue was: if "God wills that all men be saved"--as St. Paul asserts in a letter to his disciple Timothy--does he have a general will that produces universal salvation? And if he does not, why does he will particularly that some men not be saved? 2Part of the problem to which the appeal to God's general will was thought by some to afford a solution was the apparent injustice in the distribution of grace. Grace seemed to fall abundantly upon those who were not deserving of it and unprepared to use it properly and insufficiently, and all too rarely upon those who, it was believed, were most worthy of it. Malebranche, for one, believed that God wills, with a general volition, that all people be saved; other factors, however, hinder that "simple" volition from being carried out. But this question about divine aid was simply one element in a larger body of questions--extending across the realms of both nature and grace--about evil in God's creation: why is there sin, suffering, and imperfection in the world if the world was created and is governed by a wise, just, and omnipotent God? Purpose of the article is to highlight the peculiarities of the androgyny presentation in current visual culture, in particular in fashion and its philosophical and culturological comprehension. Determination of the leading trends associated with the offset of gender stereotypes and denial of the established separation into the feminine and masculine beginnings is due to the attention to the latest theories, such as transfeminism. Theoretical basis is the works of contemporary authors who develop such concepts as "gender", "gender identity", "androgyne" and (...) move within the limits of the theories of transfeminism and transgenderism. The leading French thinker J. Baudrillard outlines philosophical measurements related to the justification of fashion. The interaction issues of the feminist theory, aesthetics of gender and androgyny, which are manifested in visual images, are presented in the writings of P. Auslander, R. Crepax. Transformation of the androgyny idea is considered in the works of B. Řiháková, F. J. Galarte. S. Stryker, T. Bettcher and J. Halberstam also address the problem of transgenderism and transfeminism in their writings. Originality is to highlight the main aspects associated with actualization of androgyny, its visual presentations in fashion, and the connections with contemporary theoretical discourse. A number of concepts related to the transformation of gender stereotypes have been identified. It was revealed that the logical continuation of changes in society, science and technical development is the actualization of androgyny as an individual’s freedom in self-presentation and self-identification. It was emphasized that during the last century androgyny also serves as the basis for forming new trends in theoretical discourse, in particular, transfeminism, as well as it finds many visual manifestations in fashion and fashion industry. Conclusions contain the results of the study that describes the role of androgyny in the context of today’s culture as a measurement of personal freedom, aimed at avoiding gender stereotypes and the usual dichotomy of masculinity and femininity, which manifests itself in contemporary visual practices. In this article, the author concentrates on the space of contemporary Russian poetry and through the means of allusive proper names specifically focuses upon reflections of international culture. In this regard, expressive possibilities, text-formation role, as well as typological, semantic and functional characteristics of allusive proper names are considered. Attempts are made to analyze, formulate basic mechanisms of intertextual connections and identify the readers’ role in the creation of meaning of precedent anthroponyms in accordance with the context of the world (...) cultural heritage. The corpus of the texts, which we deal with, demonstrate that precedent anthroponyms function as an implement of parody and a way of ciphering some semantic of the intentions. Thus, a mechanism of contextual augmentation of cultural implications comes into effect at the readers’ perception of a connotative meaning of precedent names. Here at a close interaction between some common cultural and author’s individual connotations, which is provoked by consciousness of poet and reader and their creativity, are realized. References to ancient and Biblical heroes, as well as to other famous people, have a rich spectrum of connotations as a consequence and form a wide space for semantic games, interweaving and variations of meanings, which are typical for postmodern discourse and present day human’s world view. Such frames of mind on the one hand, explain the high frequency of desperate motives, ironic or sometimes even cynical attitude of the lyrical subject to the reality in which he lives. On the other hand, applying precedent names, using such anthroponyms, contemporary authors try to use cultural basic units, in order to save significant constants, guiding line, which the cultural inheritance of the past centuries generously provides. The article deals with the main ideas of the political philosophy of Abu Abdallah Ibn al-Azraq al-Garnati (1427-1491), a well-known Muslim statesman, supreme judge of Granada, lawyer, diplomat, supporter of Arab Muslim peripatetism, a student of the outstanding thinker of the Muslim Middle Ages Ibn Khaldun (1332-1406). In the history of the political philosophy of the Muslim East, a number of major transformations in the development of the Arab Caliphate from the Medina state of the prophet to the Sultanate in (...) the Abbasid period should be noted, which were reflected in the development of the theory of the Arab-Muslim state (caliphate). The main problem of the theory of the caliphate was connected with the question of the relationship between power and authority in the context of the moral foundations of the state. The creative heritage of Ibn al-Azraq is mainly known for his work in the genre of adab ("mirrors of princes") “Miracles on the way, or the Nature of dominion”. The treatise became a classic of the political philosophy of the Muslim Middle Ages, in which, under the influence of Aristotelian ideas, a special place was given to the moral foundations of power and the state, that is, ethics was considered as a political science. In the form of instructive parables, the rulers and heirs to the throne were explained the basics of state administration as part of their studies and education. His doctrine of the virtues can be viewed as ethical rationalism with a belief in the moral perfection of people in power and subjects of the state. Since morals are largely acquired and a person can control them, the task of purifying his own morals and curing them is entrusted to him. In addition, accordingly, it is possible and necessary to cultivate virtues in rulers, since the well-being of the state and the ummah depends on their morals. This article analyzes the change in the semantic field of the concept of revolution in the context of the perception of History. It is argued that the initial meanings of this concept first appeared in the early modern period at the intersection of the philosophy of history and the philosophy of politics to describe the radical new sociopolitical order and were closely associated with the concepts of social progress and emancipation. In many ways, the tragic experience of the twentieth (...) class='Hi'>century resulted in a significant correction in the interpretation of History, which led to a sharp criticism of the deterministic and progressive concepts of the historical process, and caused a transformation in the semantic field of the concept of revolution. This ushered in a conceptual rupture between the concept of revolution and the concepts of progress and emancipation. And indeed there is scarcely more than a passing mention of homosexuality in Foucault's scholarly writings. So why has Foucault, who died of AIDS in 1984, become a powerful source of both personal and political inspiration to an entire generation of gay activists? And why have his political philosophy and his personal life recently come under such withering, normalizing scrutiny by commentators as (...) diverse as Camille Paglia, Richard Mohr, Bruce Bawer, Roger Kimball, and biographer James Miller? David M. Halperin's Saint Foucault is an uncompromising and impassioned defense of the late French philosopher and historian as a galvanizing thinker whose career as a theorist and activist will continue to serve as a model for other gay intellectuals, activists, and scholars. A close reading of both Foucault and the increasing attacks on his life and work, it explains why straight liberals so often find in Foucault only counsels of despair on the subject of politics, whereas gay activists look to him not only for intellectual inspiration but also for a compelling example of political resistance. This book examines the concept of meaning and our general understanding of reality in a legal and philosophical context. Starting from the premise that meaning is a matter of linguistic and other forms of articulation, it considers the inherent philosophical consequences. Part I presents Klages', Derrida's, Von Hofmannsthal's and Wittgenstein's explorations of silence as a source of articulation and meaning. Debates about 20th century psychologism gave the attitude concept a pivotal role; it illustrates the importance of the discovery that (...) a word is globally qualified as 'the basic unit of language'. This is mirrored in the fact that we understand reality as a matter of particles and thus interpret the real as a component of an all-embracing 'particle story'. Each chapter of the book focuses on an aspect of legal semiotics related to the chapter's theme: for instance on the meaning of a Judge's 'Saying for Law', on law students training in varying attitudes or on the ties between law and language. Part II of the book illustrates our general understanding of reality as a matter of particles and partitioning, and examines texts that prove that particle thinking is basic for our meaning concept. It shows that physics, quantum theory, holism, and modern brain research focusing on human linguistic capabilities, confirm their ties to the particle story. In contrast, the book concludes that partitions and particles are neither a fact in the history of the cosmos nor a determinant of knowledge and the sciences, and that meaning is a process: a constellation rather than a fixation. This is manifest once one understands meaning as the result of continuously changing attitudes, which create our narratives on cosmos and creation. In lieu of an abstract, here is a brief excerpt of the content:Toleration and Justice in the Laozi:Engaging with Tao Jiang's Origins of Moral-Political Philosophy in Early ChinaAi Yuan (bio)IntroductionThis review article engages with Tao Jiang's ground-breaking monograph on the Origins of Moral-Political Philosophy in Early China with particular focus on the articulation of toleration and justice in the Laozi (otherwise called the Daodejing).1 Jiang discusses a naturalistic turn and the re-alignment of values in the Laozi, resulting in a naturalization (...) of justice (impartiality) by rejecting artificial humaneness and rigid hierarchical moral-political structures. In this Laozian just world, there is no room for human intervention and rigid top-down enforcement of values, thus leaving justice to naturalized Heaven or Dao as the ultimate source of the cosmos.Based on Jiang's interpretative context, I show that there is a twofold justification for the "paradoxical" and "elusive"2 value of political toleration.3 A negative expression of toleration focuses on non-interference with choices, and non-enforcement of values toward those whom one reasonably disagrees with and regards as morally wrong. Such an attitude of toleration results in practical advantages such as avoiding entrenchment in bloodshed, abandonment, and deprivation.A positive expression of toleration operating in the Laozian ideal world requires equal protection of people as capable knowers, including those to whom we object. Such protection includes their ways of expression and an unbiased recognition of them as equally capable knowers so that they are heard without bias and prejudice. Such a kind of toleration is revealed as a constituent component of justice since it enables equal contribution toward the shaping of society without discrimination. In other words, toleration is seen as naturalized justice in a Laozian world within which no one is "being wronged with the capacity as a knower"—a kind of epistemic justice articulated by Miranda Fricker (Fricker 2007).4 [End Page 466]This article discusses how Jiang's political reconstruction of Laozian philosophy contains the seeds for a discussion of toleration, a value associated with distributive justice and against epistemic injustice. First, it introduces Jiang's arguments on a naturalization of justice and impartiality as Heavenly attributes in the Laozi. Second, it articulates the value of tolerance in the Laozi. Finally, I compare Laozian toleration with Confucian toleration using youwei- wuwei metaethical criticism.Moral-Political Philosophy in the LaoziJiang's interpretative framework about the origins of distributive justice in the Laozi starts with a discussion of the cosmogonic-mystical worldviews that signal "a new understanding of the nature of the cosmos, as well as a broad reorientation in the Heaven-human relationship in the mid-Warring States period" (p. 192). Differing from the interests in the origins of human culture or civilization in the Ru and Mo traditions, Jiang agrees with Franklin Perkins and identifies a "cosmogonic turn" in the late fourth century b.c. that reveals a demotion of anthropomorphic Heaven. By paring Heaven with earth and accordingly decentering human beings in the intellectual discourse, the Laozi directs equal values to the ten thousand things, with humans as just one among them (Perkins 2016, quoted in Jiang 2021, p. 196).5 Laozi's philosophy thus stands out by rejecting Heaven as caring for human affairs while taking Dao as the ultimate origin of the cosmos, as claimed in chapter 5 of the received text: "Heaven and earth are not humane; they treat ten-thousand things in the world as straw dogs; the sage is not humane; he treats people as straw dogs" (p. 199).With Jiang's reading of a naturalistic heaven, we see a re-alignment between cosmos and the human since sage-rulers follow the Heaven-Dao. The Laozian Dao is "self-so-ing" (ziran 自然), "accommodating" (rong 容), and "impartial" (gong 公), and thus marks a sharp contrast to Confucian familial bias resulting in "actively intervening in human affairs on behalf of the (certain) humans by appointing them to carry out its mission" (p. 200). This paper outlines a theoretical context for research into ‘the subject of ethics’ in terms of how students come to see themselves as self-reflective actors. I maintain that the ‘subject of ethics’, or ethical subjectivity, has been overlooked as a necessary aspect of creating politically transformative spaces in education. At the heart of egalitarian politics lies a fundamental tension between the equality of voices and the notion that one way of being or one voice may be deemed more legitimate than (...) another; which in turn puts the equality of beings into question. Building from Michel Foucault’s work regarding ethics and subjectivity, I suggest that a ‘subject of ethics’ can be viewed, in part, as a series of relations of self that form the horizon upon which a subject comes to work on themselves relative to moral codes and power relations. Ethical relations of self can be a useful concept for those interested in educational research that furthers social and ecological justice. In the conclusion of this paper I also discuss the limitations of locating ethics entirely within a constituted human subject. (shrink)

Theoretical basis of the work is the contemplation of a person’s self-reflection in the context of his internal dialogue, through which his own human existence, his subjective and creative comprehension of the world manifest. New meanings are created and shared with others in this mental space, in particular, in crisis (...) periods of personal and social life. Therefore, the ancient Egyptian vision of man’s nature, consciousnesses and dialogism of the Self is viewed through the prism of modern philosophical concepts and as the basis for the emergence of a philosophical worldview itself. The analysis from the viewpoint of the philosophical anthropology in the text "The Dispute of a Man with His Ba" showed the opportunity of considering it not only in the context of internal dialogue, but also as a confirmed internal dialogue, which expresses itself in external speech. Comparing the mythical thinking of a man in his cohesiveness with others and the philosophical thinking of a dialogical Self, the authors come to the conclusion that it is necessary to distinguish between internal dialogues with oneself and with the introjects of others, which can be either Double or Interlocutor. It has been revealed that internal dialogues in ancient times played an important role both in structuring social chaos and in overcoming personal crisis states. This is precisely from such self-reflection that philosophy emerges as a certain discourse and a new type of thinking. Conclusions. The analysis of the text "The Dispute of a Man with His Ba" speaks about the emergence of philosophical discourse in the XXII-XXI centuries BC, on the basis of which we can conclude concerning the earlier, in comparison with K. Jaspers’s definition, the transition of mankind from the cognitive revolution to a new phase of the development. (shrink)

This volume provides a critical roadmap through the major historical sources of legal semiotics as we know them today. The history of legal semiotics, now at least a century old, has never been written (a non-event itself pregnant with semiotic possibility). As a consequence, its sources are seldom clearly exposed and, as word, object and meaning change, are sometimes lost. They reach from an English translation of the 1916 inaugural lecture of the first Chair in Legal Significs at the (...) Amsterdam University, via mid 20th century studies on "property" or "contract," to equally fascinating essays on contemporary semiotic problems produced by former students of the Roberta Kevelson Semiotics Roundtable Seminar at Penn State University 2012 and 2013. Together, the materials in this book weave the fabric of semiotics and significs, two names for the unfolding of semiotics in law and legal discourse at least until the second half of the 20th century, and both of which covered a lawyer's focus on sign and meaning in law. The latter is embedded within the cultural imperatives of the civilization that gave these terms meaning and made them an effective tool for the dissection of law, its reconstitution as an instrument to be used by the lawyer to advance the interests of her clients, and for judges as a means to restructure language as a narrative of law whose power could bend behavior to its strictures. Legal semiotics has become an indispensible part of the elite lawyer's toolkit and a fundamental approach to analysis of legal texts. Two previous volumes published in 2011 and 2012 explored the conceptual, methodological and epistemological progress in the field of legal semiotics, the modern forms of semiotics study, and the mechanics of meaning making processes by lawyers. Yet the great lessons of semiotics requires a focus on the origins of the concepts and frameworks that would become contemporary legal semiotics, its origins as an object of the consciousness of meaning making-one whose roots, as lessons for the oracular conversations of law, are expanded in this volume. The demons of racism, bigotry, and prejudice found in society at large are also found in the Christian Church. Despite the very nature of Christianity that calls on Christians to be a counter voice in the world against evil, many have capitulated to various strains of racism. Some Christian denominations have begun to explore racism in the Church and have developed responses to addressing the issues in both the Church and the world. This article examines the historical context of race (...) and religion in the Christian Church, and addresses the current efforts of some Christian denominations to become proactive in the struggle against racism. Jesus, in His Word, calls believers to pursue peace and oneness. The paper holds that racial harmony and racial unity are possible, but there are many false, old and d beliefs that will have to be crushed under the hammer of God's Word in order to get to a place of real peace. This text constitutes a reflection on politics, women, feminism and the future in the current global crisis. The civilizing crisis is total, universal and unstoppable. Here we try to sketch some ideas of what I think is really at stake: the definition of subject, person and rights, the idea of the future desirable society, and the foundations and regulation of social life, the concept of good life. In the context of an escalating global crisis and the growing feeling of being (...) in transition to nowhere, the question of whether the arrival of this new order will resist our rights is vital, ethical and politically fundamental. This document tries to collaborate with the process of answering it. The order of the world to come is being built today, in increasingly adverse conditions for the rights and freedoms of women and it is important to anticipate the reflection on some of its foreseeable consequences. In this chapter, I will explore the intersection of philosophy and childhood through the intriguing case study of J. S. Mill, who was almost completely denied a childhood—in the nineteenth-century sense of a qualitatively distinct period inclusive of greater play, imaginative freedom, flexibility, and education. For his part, Mill’s lack of such a childhood was the direct result of his father, James Mill (economic theorist and early proponent of Utilitarianism), who in a letter to Jeremy Bentham explicitly formulates a (...) plan to raise his son as an experiment in the Utilitarian “science” of ethics. More specifically, although James Mill’s end was to create a near-superhuman champion of Utilitarianism, his means to that end included denying John access to other children and the Romantic poetry of his contemporaries. Despite this oppressive lack of a childhood, however, J. S. Mill went on to become perhaps the most influential social and political reformer in British history, especially in regard to gender relations through his groundbreaking work for women’s suffrage. This begs the central question of this chapter, namely how could a philosopher’s tyrannized childhood nevertheless lead to his later overturning of such tyranny in the political sphere? (shrink)
