Within any organization (e.g. a hospital or clinic) the perception of the way things operate may vary dramatically as a function of one’s location in the organizational hierarchy as well as one’s professional discipline. Interorganizational variability depends on organizational coherence, safety, and stability. In this four-nation (Canada, Ireland, Australia, and Korea) qualitative study of 42 nurses, we explored their perception of how ethical decisions are made, the nurses’ hospital role, and the extent to which their voices were heard. These (...) nurses suggested that their voices were silenced (often voluntarily) or were not expressed in terms of ethical decision making. The Asher’s Bakery case raises questions around discrimination against political causes and freedom of religious conscience. Using the Asher’s case, this essay builds on Kasper Lippert-Rasmussen’s work to develop a theory of discrimination which accounts for discrimination of political causes. The essay explores the normative implications of this account including the rights members of salient political causes, and discusses various objections; in particular, how discrimination claims should be balanced against freedom of religious conscience in a liberal society and how religion’s (...) ‘specialness’ can be defended. By offering a critique of the Asher’s case, the essay aims to provide a framework for dealing with similar cases where claims of discrimination from political groups meet claims of religious discrimination. This paper aims to perform a multi-level analysis of the Irish public discourse on Covid-19. Despite widespread agreement that Ireland’s response was rapid and effective, the country’s journey through the pandemic has been no easy ride. In order to contain the virus, the Government’s emergency legislation imposed draconian measures including the detention and isolation of people deemed to be even “a potential source of infection” and a significant extension of An Garda Síochána’s power of arrest. In April 2020, journalists (...) John Waters and Gemma O’Doherty initiated judicial review proceedings before the High Court to challenge such legislation, which they defined as unconstitutional, “disproportionate” and based on “fraudulent science”. The proceedings attracted widespread media coverage in what soon became a debate on the legitimacy of emergency legislation and the notion of ‘fake news’ itself. After a brief survey of the legislative background to Ireland’s Covid response, the argumentative strategy is analysed through which the High Court eventually dismissed Mr Waters and Ms O’Doherty’s challenge. Focusing on the process of justification of the judicial decision, the paper provides a descriptive account of the argument structure of the Court’s decision. This sheds light on the pattern of multiple argumentation through which the Court interpreted relevant norms in the Constitution and at once re-established the primacy of “facts” informing political decision-making at a time of national emergency. Prior works in institutional theory are characterized by an assumption that the legal basis for authority of regulatory agencies is sufficient to ensure compliance by business organizations. From a business ethics standpoint, this would imply that regulatory oversight can hinder organizations’ pursuit of questionable business practices. However, the evidence for regulatory efficacy is far from clear as questionable business practices tend to persist despite regulatory monitoring. Drawing on the case of the regulatory failure to trigger a shift away from aggressive (...) banking practices in Ireland, which had serious social and economic costs, we highlight three barriers to deinstitutionalization: insufficient advocacy for change coupled with an inability to problematize the risks of extant business practices, unwillingness to impose change through the use of threats, power, or sanctions, and contradictions in the institutional environment that can obfuscate the regulators’ message. Thus, our study proposes that regulator-led change might not be as straightforward as previously theorized. In doing so, it advances prior theory through an explicit focus on the importance of three types of institutional work that are necessary for regulator-led deinstitutionalization. (shrink)

An awareness of the significance of location in the production and dissemination of scientific knowledge has brought a new dimension to recent work on the sociology of science. But the importance of speech in scientific enterprises has been less well developed. This article explores the idea of `spaces of speech' by underscoring the connections between location and locution. It develops a case study of how Darwinian evolution was talked about in different sites using examples from Ireland and the American (...) South during the latter part of the 19th century. These reveal how sites enable and constrain what may be said, and heard, about particular scientific claims, and how they are crucial to understanding the circulation of scientific claims in public arenas. Commentators in both the French and foreign press were quick to criticize Sarkozy’s vow to “flush (...) out [the thugs of La Corneuve] with a Kärcher [pressure washer]” (il faut [les] nettoyer au Kärcher).1 It was pointed out by Azouz Begag, as the newly appointed minister of equal opportunities, that such “warlike” language indiscriminately victimizes young people in the banlieue, while journalist Doug Ireland argued that Sarkozy’s comments conveyed hints of ethnic cleansing by equating urban youth, largely of Maghrebi origin, with dirt that needed to be violently removed from the otherwise smooth and clean civic spaces of the French Republic.2 The populist rage that Sarkozy articulated by using the term racaille (rabble, scum) received most of the attention, including an essay in Le Monde that explored the word’s etymology (intended as a lesson in the politics of language for the French interior minister).3It is the Kärcher reference, however, that most interests me here. Kärcher, a company based in Germany, whose own website touts it as “the most recognized and trusted name in high-pressure cleaning equipment,” manufactures machines used to clean city walls and public latrines. By proclaiming that he wanted to “kärcherize” the “racaille,” Sarkozy evoked a specific technology of urban cleansing that vividly illustrates the increasingly brutal approach to the banlieue that marks French urban policy since the 1980s. The Kärcher water blaster is not a mere metaphor, but an actual machine used to scour graffiti from a variety of hard-to-clean surfaces. Sarkozy’s comments thus equate banlieue youth (la racaille) with their signs of passage through urban space (le graff, as graffiti is often called). The young banlieusards themselves become illegible signs on the new smooth spaces of the HLM housing estates. The rhetorical dehumanization of young people from “troubled neighborhoods,” combined with hostility to graffiti, reveals the neo-logocentrism operative in the penal republican state that reiterates colonialism’s pseudo-scientific rationale for depriving supposedly illiterate peoples of history, reason, and even the very capacity for thought, a rationale that ultimately justifies their exclusion from the entire chain of civilizational benefits and rights attendant upon literacy and reason. One piece of anti-Sarkozy graffiti in Brest near the port de commerce, depicting Sarkozy as the national cop wielding a billy club, displays an explicit awareness of this interpretation of what nettoyer au Kärcher means (fig. 1). Text accompanying the cartoonish caricature reads, “Article 1: Nettoyage des graffitis au Kärcher” (Article 1: Cleaning graffiti with a Kärcher).4It would be an error, however, to suggest that the category, “banlieue youth,” exists independent of the statements that construct it as an identifiable group. Mustafa Dikeç’s recent demonstration of the way that French urban policy “produces” the banlieue as a space to be policed and contained also extends to the way that specific groups within these spaces are produced through the media, statistics, law, and other techniques.5 The [End Page 73] act of naming the racaille effectively produces them as a social category precisely at the same moment that the necessity of cleansing their living inscription from the cité is asserted. I am calling this nettoyage or erasure of these groups “neo-logocentric” because part of its target is graffiti, which, as I hope to demonstrate, represents an important emerging global practice of inscription that produces multiple transnational connections among ghettoized spaces around the world. Graffiti functions as a kind of alternative literacy that operates within a plane that connects with literacy in the narrow sense of the term, but remains independent from it. The strong reactions that graffiti elicits, as adduced by Sarkozy’s remarks (and one could cite dozens of other examples), suggest that the new technologies of thought, mobility, and inscription that graffiti engineers are what make it... Its publication in 2021 coincided with the fiftieth anniversary of the first publication of David Ireland’s The Unknown Industrial (...) Prisoner (1971). This experimental novel, centered on a “kaleidoscopic vision” of its characters and their lives, tells the story of a group of workers at the Puroil refinery in a fictionalized part of Sydney. In Heino’s own words, this project emerged from a desire to write about industrialization and representation in Australian fiction. Working primarily as a legal scholar and historian, this work represents his first foray into literary geography.At the heart of Heino’s argument is a question: What does literature know about space? In his pursuit of a spatially-directed reading of The Unknown Industrial Prisoner, Heino eschews work in literary geography that cultural geographers might recognize— particularly the writings of Sheila Hones, the doyenne of an emerging interdiscipline of literary geography, whose practitioners work at the interstices between literary studies and geography. Heino criticizes this interdisciplinary literary geography as being too focused on establishing the “sovereignty” or “imperialism” of fictional space at the expense of recognizing the [End Page 132] role of literature in the world. Arguably, such a stance is a misreading of the thinking within literary geography that “reading literature is essentially an experimental process in which the categorical distinction between the frames of ‘fact’ and ‘fiction’ become blurred,”1 and where the “ontological distinction between literary and non- literary spaces” is undermined.2 Neither of these statements supposes that reading literature is a practice by which the world falls away and nothing remains but the book. Instead, following Doreen Massey’s idea that space is a complicated process of events and happenings, literary geographers in this mold argue that fiction is a part of life as it happens, and reading is a constitutive practice in the co- production of space.In its place, Heino emphasizes a form of literary geographical thinking that understands literature’s role as being separate from, but intimately connected to, the actual world. His theoretical framework is multi-layered, borrowing from Marxist literary scholars, including Terry Eagleton and Fredric Jameson, and Marxist geographers, including Henri Lefebvre. In essence, however, it can be expressed neatly in the following quotation from geocritic Bertrand Westphal:Fiction does not reproduce the real, but actualises new virtualities that had remained unformulated, and then goes on to interact with the real according to the hypertextual logic of interfaces... fiction detects possibilities buried in the folds of the real, knowing that these folds have not been temporised.3I think that Heino’s rejection of what he characterizes as poststructural literary geography, of the kind represented in his analysis of Sheila Hones’s work, misses some opportunities. First, there are similarities between his conception of literary geography and those he leaves aside— not least, their shared acceptance of the productive tension that sits between literature as text and world as practical, non- representational, and exceeding narrative. Secondly, the shared aim of both approaches is to understand how “representation ‘takes place’ and precisely how texts are part of what happens.”4 This is particularly powerful in the light of Heino’s aim to understand the development and contents of literary texts in materialist terms. Assessing national levels of happiness has become an important research and policy issue in recent years. We examined happiness and satisfaction in Ireland using phone text messaging to collect large-scale longitudinal data from 3,093 members of the general Irish population. For six consecutive weeks participants’ happiness and satisfaction levels were assessed. For four consecutive weeks (weeks 2 to 5) a different random third of the sample got feedback on the previous week's mean happiness and satisfaction ratings. Text messaging proved (...) a feasible means of assessing happiness and satisfaction, with almost three quarters (73%) of participants completing all assessments. Those who received feedback on the previous week’s mean ratings were eight times more likely to complete the subsequent assessments than those not receiving feedback. Providing such feedback data on mean levels of happiness and satisfaction did not systematically bias subsequent ratings either towards or away from these normative anchors. Texting is a simple and effective means to collect population level happiness and satisfaction data. (shrink)

Background Since the UK Abortion Act (1967), women have travelled from Ireland to the UK for legal abortion. In 2011 >4000 women did so. Knowledge and attitudes of medical students towards abortion have been published, however, this is the first such report from Ireland. Objective To investigate medical students’ attitudes towards abortion in Ireland. Methods All medical students at the University of Limerick, and physicians who graduated from the university within the previous 12 months, were invited via (...) email to complete an anonymous online survey. The questionnaire comprised 17 questions. Quantitative and qualitative analyses were performed. Results Response rate was 45% (n=169; 55% women; 88.2% <30 years of age; 66.7% Irish; 29.2% North American). Outcomes were: abortion should not be legally available (7.1%), abortion should be allowed in limited circumstances only (35.5%), abortion should be legally available upon request (55%). 72.8% of respondents were moderately/strongly prochoice (74% of women/71% of men/72% and 76% of Irish and North American respondents, respectively). Students aged >30 years were less likely to be prochoice (55%). While 95.2% believed that education on abortion should be offered within medical school curricula, 28.8% stated that they would decline to terminate pregnancies even if legally permitted. While 58.8% indicated that they might perform legal abortions once qualified, 25.7% would do so under limited circumstances only. Conclusions The majority of participants wanted education regarding abortion. Despite being predominantly prochoice, considerably fewer students, irrespective of nationality, indicated that they would perform abortions. (shrink)

Part of the appeal of the biological approach to personal identity is that it does not have to countenance spatially coincident entities. But if the termination thesis is correct and the organism ceases to exist at death, then it appears that the corpse is a dead body that earlier was a living body and distinct from but spatially coincident with the organism. If the organism is identified with the body, then the unwelcome spatial coincidence could perhaps be avoided. It is (...) argued that such an identification would be a mistake. A living organism has a different part/whole relationship and persistence conditions than the alleged body. A case will be made that the concept ‘human body’ is a conceptual mess, vague in an unprincipled manner, and that an eliminativist stance towards dead bodies is the appropriate response. As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable.
