An investigation into the concept of life in Michel Foucault's work leads both to a more precise understanding of the development of his work and to the elaboration of a critical look at recent interpretations of his thought, especially in relation to the readings of the concept of biopolitics that oscillate between a positive and a negative interpretation of this concept. The analyzes of this term, which have proliferated among recent readings of Foucault's work, seem to lack a more accurate (...) understanding of the problem of life, from which largely results the very acuity of Foucault's reflections on biopower. What above all guides this brief and incipient reflection on Foucault’s notion of life is Muhle's (2021) finding that Foucault does not attribute an ontological status to the notion of life and that this life plays a double role (Gegenstand and Funktionsmodell) regarding its implication in biopower, as well as Mauer's assumption (2015) that Foucault turns to the notion of life in order to deviate from the concept of man, i.e., from humanism. These two hypotheses help us not only to shed light on the elaboration of Foucault's thought as a whole, particularly with regard to biopower, but also on recent readings of the notion of biopolitics. Este artigo se divide em quatro partes. Inicialmente apresentamos a noção de biopolítica de modo introdutório, considerando a relação entre poder soberano e biopoder. Voltamo-nos para a elaboração foucaultiana do termo de modo a esclarecer, em linhas gerais, seu sentido. Essa breve análise da noção de biopolítica encaminha-nos para o conceito de tanatopolítica, que aparece, na segunda parte do texto, como epíteto da derivação funesta da biopolítica. Na terceira parte, a partir de uma perspectiva biopolítica, lançamos luz sobre a crise (...) que enfrentamos. Trata-se de um esforço de evidenciar o sentido biopolítico da crise atual, considerando o conteúdo das reflexões de Foucault. Finalmente, na quarta parte, atualizamos o debate acerca da biopolítica por meio de uma análise da noção de imunidade formulada por Esposito, a qual fornece uma importante chave interpretativa da pandemia atual. The processing of sensitive information in the health field is subject to rigorous standards that guarantee the protection of information confidentiality. Recently, the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) stated their formal opinion on a standard procedure in dental offices involving the submission of a questionnaire that includes the patient's health status. HIV infection status is included on the form. The Authority has stated that all health data collection must be in accordance with the current (...) Italian normative framework for personal data protection and respect the patient's freedom. This freedom allows the patient to decide, in a conscious and responsible way, whether to share health information with health personnel without experiencing any prejudice in the provision of healthcare requested. Moreover, data collection must be relevant and cannot exceed the principles of treatment goals with reference to the specific care of the concerned person. However, the need for recording information regarding HIV infection at the first appointment, regardless of the clinical intervention or therapeutic plan that needs to be conducted, should not alter the standard protection measures of the healthcare staff. Animals navigate through three-dimensional environments, but we argue that the way they encode three-dimensional spatial information is shaped by how they use the vertical component of space. We agree with Jeffery et al. that the representation of three-dimensional space in vertebrates is probably bicoded (with separation of the plane of locomotion and its orthogonal axis), but we believe that their suggestion that the vertical axis is stored (that is, not containing distance or direction metrics usable for novel computations) is unlikely, (...) and as yet unsupported. Neuropsychological dissociations between regular and irregular English past-tense morphology have been reported using a lexical decision task in which past-tense primes immediately precede present-tense targets. We present N400 event-related potential data from healthy participants using the same design. Both regular and irregular past-tense forms primed corresponding present-tense forms, but with a longer duration for irregular verbs. Phonological control conditions suggested that differences in formal overlap between prime and target contribute to, but do not account for, this difference, suggesting a link (...) between irregular morphology and semantics. Further analysis dividing the irregular verbs into two categories (weak irregular and strong) revealed that priming for strong verbs was reliably stronger than that for weak irregular and regular verbs, which were statistically indistinguishable from one another. We argue that, although we observe a regular-irregular dissociation, the nature of this dissociation is more consistent with single- than with dual-system models of inflectional morphology. (shrink)

The Adverse Outcome Pathway (AOP) concept is a knowledge assembly and communication tool to facilitate the transparent translation of mechanistic information into outcomes meaningful to the regulatory assessment of chemicals. The AOP framework and associated knowledgebases (KBs) have received significant attention and use in the regulatory toxicology community. However, it is increasingly apparent that the potential stakeholder community for the AOP concept and AOP KBs is broader than scientists and regulators directly involved in chemical safety assessment. In this paper we (...) identify and describe those stakeholders who currently—or in the future—could benefit from the application of the AOP framework and knowledge to specific problems. We also summarize the challenges faced in implementing pathway-based approaches such as the AOP framework in biological sciences, and provide a series of recommendations to meet critical needs to ensure further progression of the framework as a useful, sustainable and dependable tool supporting assessments of both human health and the environment. Although the AOP concept has the potential to significantly impact the organization and interpretation of biological information in a variety of disciplines/applications, this promise can only be fully realized through the active engagement of, and input from multiple stakeholders, requiring multi-pronged substantive long-term planning and strategies. The purpose of this article is to analyse how the background knowledge of travellers from the Old World have determined how they would experience American space. Such knowledge is more specifically directed in my study towards religion and politics, as my analysis intends to scrutinise how such realms made – and still make – subjects get to questionable conclusions since both Christianity and capitalism have had the normative tradition of disregarding the possibility of any meanings to deviate from their main (...) epistemes. My specific context, in this sense, concerns the travel book A Journey in Brazil and Maria Helena Machado’s compilation of William James’ diary – Brazil through the Eyes of William James – both written during the same trip to the Amazon. Main findings are: Louis Agassiz ambitious projects in America – more specifically the Amazon – prevented him from being as challenged by the journey as William James ends up being; there is enough literary evidence to assume that, in overall terms, his Christian bigotry made him immobile and unflappable when facing difference. A volume with 14 chapters on various aspects of the relationship between responsibility and healthcare, plus a substantial introduction that offers a comprehensive overview of the relevant debates and how they relate to one another. Questions of responsibility arise at all levels of health care. Most prominent has been the issue of patient responsibility. Some health conditions that risk death or serious harm are partly the result of lifestyle behaviours such as smoking, lack of exercise, or extreme sports. Are patients (...) with such conditions responsible for them? If so, might healthcare providers, be they state-run systems or private entities, be justified in treating such patients differently? And if they are, which forms of differential treatment are justified? Responsibility isn’t just relevant for patients. Even when individuals affect their health through voluntary behaviour, other influences are also at work before, during, and after the patient’s interaction with the health care system. What are the responsibilities of individual clinicians and other medical professionals, when thinking about individual and public health? What about institutions such as governments or national health care services, or society as a whole? This collection brings together work by world-renowned experts in population ethics, distributive justice, philosophy of action, cognitive science, and medical ethics in order to push the debate forward by elucidating our understanding of these questions, their possible answers, and how they are related. I defend an interpretation of Aristotle’s Posterior Analytics Book I which distinguishes between two projects in different passages of that work: (i) to explain what a given science is and (ii) to explain what properly scientific knowledge is. I present Aristotle’s theory in answer to ii, with special attention to his definition of scientific knowledge in 71b9-12 and showing how this is developed on chapters I.2-9 and I.13 into a solid Theory of Scientific Demonstration. The main point of this theory (...) is that demonstrations need to capture relevant explanations. Some formal requirements of the demonstration (as the syllogistic structure and coextension between terms) are unfoldings of the main project, i.e., to capture and present properly relevant causal-explanatory relations. The current work investigated whether differences in phonological overlap between the past- and present-tense forms of regular and irregular verbs can account for the graded neurophysiological effects of verb regularity observed in past-tense priming designs. Event-related potentials were recorded from 16 healthy participants who performed a lexical-decision task in which past-tense primes immediately preceded present-tense targets. To minimize intra-modal phonological priming effects, cross-modal presentation between auditory primes and visual targets was employed, and results were compared to a companion intra-modal auditory (...) study (Justus, T., Larsen, J., de Mornay Davies, P., Swick, D. (2008). Interpreting dissociations between regular and irregular past-tense morphology: evidence from event-related potentials. Cognitive, Affective, Behavioral Neuroscience, 8, 178–194.). For both regular and irregular verbs, faster response times and reduced N400 components were observed for present-tense forms when primed by the corresponding past-tense forms. Although behavioral facilitation was observed with a pseudopast phonological control condition, neither this condition nor an orthographic-phonological control produced significant N400 priming effects. Instead, these two types of priming were associated with a post-lexical anterior negativity (PLAN). Results are discussed with regard to dual- and single-system theories of inflectional morphology, as well as intra- and cross-modal prelexical priming. (shrink)

El documento afirma que existe una fuerte obligación moral de garantizar que los participantes enfermos de un estudio clínico hagan una transición después del estudio hacia una atención de la salud apropiada. Con “atención de la salud apropiada” se hace referencia al acceso para los participantes a la (...) atención de la salud, proporcionada principalmente por el National Health Service (en adelante NHS), el sistema de salud del Reino Unido, y/o a la intervención en estudio, también llamada producto o tratamiento en investigación. Las guías “Atención después de la investigación” están dirigidas principalmente a los miembros de los 79 comités de ética de investigación del NHS y a quienes presentan sus estudios de investigación ante estos comités. The guides "Care after research" are mainly directed to members of the 79 NHS committees of research ethics (RECs) and to those who submit their research to these committees. This is a very advanced draft document, worked in several meetings, for more than three years, that has been discussed with study participants and community members, members and chairs of RECs in the UK, international specialists in research ethics, industry representatives and other stakeholders. The drafting of the guidelines is the result of the collaboration of Neema Sofaer and Penney Lewis, both researchers at King's College London, at the Centre of Medical Law and Ethics of Dickson Poon School of Law, and Hugh Davies, Research Ethics Advisor of the Health Research Authority (HRA) of the NHS. Los _Sermones _de Cromacio de Aquilea nos ofrecen evidencia directa de su experiencia episcopal y literaria, que se divide entre la exégesis más destacada y el objetivo pastoral. La simplicidad estructural y lingüística, y la referencia a algunos autores contemporáneos, características de la tercera de estas composiciones homiléticas, nos ofrecen la oportunidad para analizar los propósitos más íntimos y prácticos de este texto. De hecho, la estrecha relación con su audiencia y el intento de guiarla por el justo camino cristiano (...) son los evidentes protagonistas en todo el discurrir del sermón. Sin embargo, al mismo tiempo se observa también la exégesis escritural de Cromacio y su profundización doctrinal: el Obispo trata de ofrecer un pequeño pero útil bagaje para el camino de quien lo escucha, en una poderosa valorización de la acción humana. La _vita activa _que se suma a la _lex naturae _inherente al alma humana constituye, de hecho, el tema más evidente de la homilía íntegra, que expone el de Aquilea sobre todo con el objetivo de fortalecer la unidad y la identidad de quienes escuchan cuando enfrentan presiones externas. La referencia escritural es fuerte y está presente en todo el sermón: el pasaje, seguramente leído justo antes de la exposición, se expone casi en su totalidad a los fieles, para fijarlo mejor en la memoria de aquellos que asisten a la lectura. Utilitarianism has an apparent pedigree when it comes to animal welfare. It supports the view that animal welfare matters just as much as human welfare. And many utilitarians support and oppose various practices in line with more mainstream concern over animal welfare, such as that we should not kill animals for food or other uses, and that we ought not to torture animals for fun. This relationship has come under tension from many directions. The aim of this article is to (...) add further considerations in support of that tension. I suggest three ways in which utilitarianism comes significantly apart from mainstream concerns with animal welfare. First, utilitarianism opposes animal cruelty only when it offers an inefficient ratio of pleasure to pain; while this may be true of eating animal products, it is not obviously true of other abuses. Second, utilitarianism faces a familiar problem of the inefficacy of individual decisions; I consider a common response to this worry, and offer further concerns. Finally, the common utilitarian argument against animal cruelty ignores various pleasures that humans may get from the superior status that a structure supporting exploitation confers. (shrink)

The well-established pattern of Executive expansionism and limited oversight of Executive action in times of terrorism is problematic from the civil libertarian point of view. How to limit such action has been the subject of much scholarship, a large amount of which focuses on perceptions of institutional competence rather than effectiveness. For the authors, the effective control of security-focused state action is to be judged by the extent to which it consists only of action that is necessary and proportionate and (...) thereby strikes an appropriate balance between security exigencies and individual rights. This article, written and structured in dialectic form, presents competing perspectives on effective oversight mechanisms: on the one hand, an extra-constitutionalism perspective, proposing a limited role for the Judiciary and emphasizing the need for legislative and democratic controls; and on the other, an argument for judicial muscularity. It has been suggested that damage to anterior regions of the left hemisphere results in a dissociation in the perception and lexical activation of past-tense forms. Specifically, in a lexical-decision task in which past-tense primes immediately precede present-tense targets, such patients demonstrate significant priming for irregular verbs (spoke–speak), but, unlike control participants, fail to do so for regular verbs (looked–look). Here, this behavioral dissociation was first confirmed in a group of eleven patients with damage to the pars opercularis (BA 44) (...) and pars triangularis (BA 45) of the left inferior frontal gyrus (i.e., Broca's area). Two conditions containing word-onset orthographic–phonological overlap (bead–bee, barge–bar) demonstrated that the disrupted regular-verb priming was accompanied by, and covaried with, disrupted ortho-phonological priming, regardless of whether prime stimuli contained the regular inflectional rhyme pattern. Further, the dissociation between impaired regular-verb and preserved irregular-verb priming was shown to be continuous rather than categorical; priming for weak-irregular verbs (spent–spend) was intermediate in size between that of regular verbs and strong verbs. Such continuous dissociations grounded in ortho-phonological relationships between present- and past-tense forms are predicted by single-system, connectionist approaches to inflectional morphology and not predicted by current dual-system, rule-based models. Event-related potential data demonstrated that N400 priming effects were intact for both regular and irregular verbs, suggesting that the absence of significant regular-verb priming in the response time data did not result from a disruption of lexical access, and may have stemmed instead from post-lexical events such as covert articulation, segmentation strategies, and/or cognitive control. Strong evidence shows that exposure and engagement with the natural world not only improve human wellbeing but can also help promote environmentally friendly behaviors. Human-nature relationships are at the heart of global agendas promoted by international organizations including the World Health Organization’s “One Health” and the United Nations “Ocean Decade.” These agendas demand collaborative multisector interdisciplinary efforts at local, national, and global levels. However, while global agendas highlight global goals for a sustainable world, developing science that directly addresses these agendas (...) from design through to delivery and outputs does not come without its challenges. In this article, we present the outcomes of international meetings between researchers, stakeholders, and policymakers from the United Kingdom and Brazil. We propose a model for interdisciplinary work under such global agendas, particularly the interface between One Health and the UN Ocean Decade and identify three priority research areas closely linked to each other: human-nature connection, conservation-human behavior, and implementation strategies. Em suas reflexões sobre a filosofia do direito, Alysson Leandro Mascaro destacou que atualmente G.W.F. Hegel é uma estação fundamental para qualquer estudioso dessa ciência. De fato, o autor alemão mostra-se de fundamental importância por pensarmos a sociedade civil burguesa e o Estado como aspectos inseparáveis para a necessária determinação do direito na era moderna (e contemporânea). Ao contrário da proposta jusnaturalista, Hegel coloca a questão do direito no interior da querela sobre o Estado moderno, esvaziando de sentido a ode (...) ao individualismo, de fundo romântico. Assim, a máquina pública surge como expressão concreta de um momento histórico muito particular, leia-se, como fruto da era das profundas revoluções sociais na Europa. Destarte, nossa hipótese é que a filosofia do direito hegeliana não se limita à uma consciência tardia, que sempre se apresenta como post festum, mas, sim, desenvolve-se como uma reflexão capaz de antever aspectos importantes de toda uma formação histórica em emergência, através dos seus primeiros sinais. Essa perspectiva nos permite argumentar que esse autor buscou se apresentar como síntese dialética da realidade e dos conceitos que conheceu, fitando não se dobrar às complexidades e/ou à vulgata do momento que tinha sob os olhos. Este artigo irá examinar a concepção de Agostinho de Hipona sobre o coração humano, visto que, ocupando o lugar de um cardiologista, Agostinho prescreve um tratamento terapêutico intensivo. Serão considerados três movimentos essenciais do cor agostiniano. Primeiramente, Agostinho propõe uma busca pelo coração, a câmara secreta, o centro vital interior que necessita ser reencontrado. Uma vez localizado o coração, somos levados a um segundo movimento: o retorno ao coração. Depois de diagnosticar sua própria doença cardíaca, um coração vazio, Agostinho propõe (...) uma terapia, a volta ao coração no encontro com um terapeuta divino, o Cristo; e um remédio potente, o esmagamento do coração. Terceiro, ascende-se com seu coração: o coração se eleva ao alto, sursum cor. Um coração saudável é um coração ascendente, com o amor como seu marca-passo. Retornar ao coração significa, portanto, voltar ao núcleo de uma autêntica existência, no chamado para não se fechar em si mesmo, para ascender em uma abertura de amor a uma alteridade, Deus e ao próximo. Como epílogo, iremos explorar de forma concisa dois contextos relacionados, nos quais Agostinho utiliza a imagem do coração: vida comunitária e espiritualidade. (shrink)

Abstract The article criticizes the trend of reformulating the traditional just-war criterion of Proper Authority, which was designed to de-legitimize force by non-state actors, into a requirement that decisions to resort to force be multilateral. The article illustrates several shortcomings of the judgment processes of the UN Security Council and General Assembly, the World Court, and states? populations, and argues among other things that reformulating Proper Authority would render other criteria meaningless, especially Just Cause. Finally, the article rebuts the strongest (...) objection to a system in which states judge their own causes for war: the problem of invincible ignorance. (shrink)

This paper is one of the four interrelated action agenda papers resulting from the National Summit on Public Health Legal Preparedness convened in June 2007 by the Centers for Disease Control and Prevention and multi-disciplinary partners. Each of the action agenda papers deals with one of the four core elements of public health legal preparedness: laws and legal authorities; competency in using those laws; coordination of law-based public health actions; and information. Options presented in this paper are for consideration by (...) policy makers and practitioners — in all jurisdictions and all relevant sectors and disciplines — with responsibilities for all-hazards emergency preparedness.Advancing and protecting the public's health depends upon the coordination of actions by many, diverse partners. For effective public health preparedness, there must be effective coordination of legal tools and law-based strategies across local, state, tribal, and federal jurisdictions, and also across sectors such as public health, health care, emergency management, education, law enforcement, community design, and academia. Las nuevas técnicas de neuroimagen, que están comprendidas en el gran campo de las neurociencias, nos permiten indagar el estudio de la funcionalidad cerebral en el momento en el cual realizamos una determinada tarea o elaboramos un pensamiento. Además del estudio de los estados post-coma, se ha abierto así el gran capítulo de las así llamadas "neurociencias cognitivas", es decir, el estudio de las funciones simbólicas superiores que caracterizan a la persona humana. Somos hoy capaces de trazar el mapa de (...) la áreas cerebrales que están implicadas en la memoria, en las percepciones y en las emociones, en la elaboración del proceso decisional, hasta llegar a la conducta ética. El indudable enorme valor científico de estas investigaciones lleva consigo el riesgo de una peligrosa "invasión de campo", en argumentos de alcance ético que conciernen a otras disciplinas, de la filosofía a la antropología, de la teología a la psicología. La tentación de reducir la complejidad de la persona humana a una "máquina" neurológicamente predeterminada, con una arquitectura neuronal construida sobre la estructura genética no modificable, lleva en sí el pesado redimensionamiento de grandes instancias éticas como la decisión libre y la responsabilidad. Ha nacido una nueva disciplina, la neuroética, que se propone leer al hombre, en su individualidad y totalidad, a la luz de la neurobiología documentada de las neurociencias. En realidad, precisamente partiendo de los datos científicos, genéticos y neurológicos, podemos rigurosamente demostrar y afirmar que esta impostación es reductiva, limitada, con lagunas y, por tanto, objetivamente inaceptable. Se requiere la fundación de una ética de la neurociencias, más que la actual derivación de las neurociencias de la ética.The new neuroimaging technology allows us to investigate the study of brain function at the moment in which a specific task is executed or a thought is elaborated. In this way, the vast chapter on the so called "cognitive neurosciences" has been opened. Today we are able to map the areas of the brain involved in memory, perception and emotions, in the elaboration of the decisional process, all the way to ethical conduct. The temptation to reduce the complexity of humans to a neurologically predetermined "machine" with an unalterable genetic structure built with a neuronal architecture carries with it a heavy downsizing of important ethical issues, such as freedom of choice and personal responsibility. In reality, starting precisely from scientific, genetic and neurological data, we can state and rigorously demonstrate that this formulation is reductive, limited and faulty and therefore unacceptable objectively. We request the formulation of an ethics for neurosciences rather than the existing neurosciences of ethics into which we have draft. (shrink)
