Current understanding of the development of quantity representations is based primarily on performance in the number‐line task. We posit that the data from number‐line tasks reflect the observer's underlying representation of quantity, together with the cognitive strategies and skills required to equate line length and quantity. Here, we specify a unified theory linking the underlying psychological representation of quantity and the associated strategies in four variations of the number‐line task: the production and estimation variations of the bounded and unbounded number‐line (...) tasks. Comparison of performance in the bounded and unbounded number‐line tasks provides a unique and direct way to assess the role of strategy in number‐line completion. Each task produces a distinct pattern of data, yet each pattern is hypothesized to arise, at least in part, from the same underlying psychological representation of quantity. Our model predicts that the estimated biases from each task should be equivalent if the different completion strategies are modeled appropriately and no other influences are at play. We test this equivalence hypothesis in two experiments. The data reveal all variations of the number‐line task produce equivalent biases except for one: the estimation variation of the bounded number‐line task. Scholars looking back to the earliest stirrings of the philosophical tradition in ancient Greece have often seen a rational approach to nature cleaving itself off from an older approach, that of the mythographer. If this account were right, we would have here a major (and perhaps the ?rst major) drawing of an epistemic boundary. There are, however, mounting reasons to question this narrative that have been accumulating across several modern disciplines. This paper explores the most important challenges to the myth-to-science (...) narrative and suggests that the different ways of framing the ancient debates have much to do with the boundaries between modern disciplines and/or academic cultures. ABSTRACT:This paper re-examines the import of Rawls’s theory of justice for private sector institutions in the face of the decline of the welfare state. The argument is based on a Rawlsian conception of justice as the establishment of a basic structure of society that guarantees a fair distribution of primary goods. We propose that the decline of the welfare state witnessed in Western countries over the past forty years prompts a reassessment of the boundaries of the basic structure in order (...) to include additional corporate institutions. A discussion centered on the primary good of self-respect, but extensible to power and prerogatives as well as income and wealth, examines how the legislator should intervene in private sector institutions to counterbalance any unfairness that results from the decline of the welfare state. In the current study, we examine the changes in disclosure practices on compliance and the fight against corruption at Siemens AG, a large German multinational corporation, over the period 2000–2011 during which a major corruption scandal was revealed. More specifically, we conduct a content analysis of the company’s annual reports and sustainability reports during that period to investigate the changes of Siemens’ corruption and compliance disclosure using both quantitative and qualitative methods. Through the lens of legitimacy theory, stakeholder analysis, and (...) organizational façades, we find evidence that Siemens changed its compliance and corruption disclosure practices to repair its legitimacy in the wake of the 2006 corruption scandal. We analyze these strategies more closely by using the rational, progressive, and reputation façades framework. Our primary findings suggest that the annual reports show peaks of disclosure amounts on corruption and compliance disclosures earlier than sustainability reports, which can be partly explained by analyzing the disclosures made about—and to—the different stakeholder groups. We find that the annual report focuses more on internal stakeholders such as employees, while the sustainability report focuses more on external stakeholders such as suppliers. We also find that the company uses the façades differently depending on which report is being analyzed. (shrink)

ABSTRACT:Singer has recently argued that questions related to corporate governance are beyond the reach of Rawls’s political conception of justice. This is because justice applies to the basic structure of society, understood as society’s legally coercive structures, and because corporate governance cannot be considered part of this structure in political liberalism. This commentary challenges the second part of the argument. First, it suggests that the criterion used to exclude corporate governance from the basic structure—whether employees can exit economic organizations—is not (...) conclusive for corporate governance, notably as institutionalized in corporate law. Second, even if the focus were on corporate governance, it would still be possible to argue that it legally coerces citizens, if not employees, in a relevant way. Thus, the argument is not successful in demonstrating that political liberalism goes beyond its legitimate boundaries when considering that aspects of corporate governance may be matters of justice. The philosophical tradition in the West has always subjected life to conceptual divisions and questions about meaning. In Vital Nourishment, François Jullien contends that although this process has given rise to a rich history of inquiry, it proceeds too fast. In their anxiety about meaning, Western thinkers since Plato have forgotten simply to experience life. In this installment of his continuing project of plumbing the philosophical divide between Eastern and Western thought, Jullien slows down, and, using the third and fourth (...) century B.C.E. Chinese thinker Zhuanghi as a foil, begins to think about life from a point outside of Western inquiry.The question of how to "feed life," or nourish it, is the point of departure for the Chinese tradition that Jullien locates in Zhuanghi. Life passes through each of us, and we have a duty to become amenable to its ebbs and flows. We must cultivate a sense of being adequate to it so that we can house it. Exploring notions of breath, energy, and immanence, Jullien reopens a vibrant space of intellectual exchange between East and West. In doing so, he refuses to commit to a rigid framework of meaning, and his text unfolds as an elegant process that mirrors the very type of thought he explores. Committees multiply in firms, whether stakeholder boards or committees, multi-stakeholder initiatives, ethics committees, or oversight boards. These arrangements aim to organise and legitimise the social and political activities of corporations. This article raises the question of the appropriate form of such governance structures. The examples above illustrate three possible ways of legitimising corporate quasi-public social and political activities: deliberation within the company, deliberation outside, and an approach we label _corporate constitutionalism_. While the first two models have been tested in practice (...) and assessed in theory, the third one is comparatively more recent, both in practice and in theory. This article focuses on the latter model and asks whether corporate constitutionalism offers a suitable addition, or alternative, to deliberation (with or within firms) for legitimising corporate quasi-public social and political activities. It examines the respective merits of the three models and argues that a corporate constitutional court may mitigate some of the limits of deliberative practices alone. It argues the court is needed in weak regulatory environments, whether they are failing or inherently limited. (shrink)

What did the Romans know about their world? Quite a lot, as Daryn Lehoux makes clear in this fascinating and much-needed contribution to the history and philosophy of ancient science. Lehoux contends that even though many of the Romans’ views about the natural world have no place in modern science—the umbrella-footed monsters and dog-headed people that roamed the earth and the stars that foretold human destinies—their claims turn out not to be so radically different from our own. Lehoux draws (...) upon a wide range of sources from what is unquestionably the most prolific period of ancient science, from the first century BC to the second century AD. He begins with Cicero’s theologico-philosophical trilogy _On the Nature of the Gods_, _On Divination_, and _On Fate_, illustrating how Cicero’s engagement with nature is closely related to his concerns in politics, religion, and law. Lehoux then guides readers through highly technical works by Galen and Ptolemy, as well as the more philosophically oriented physics and cosmologies of Lucretius, Plutarch, and Seneca, all the while exploring the complex interrelationships between the objects of scientific inquiry and the norms, processes, and structures of that inquiry. This includes not only the tools and methods the Romans used to investigate nature, but also the Romans’ cultural, intellectual, political, and religious perspectives. Lehoux concludes by sketching a methodology that uses the historical material he has carefully explained to directly engage the philosophical questions of incommensurability, realism, and relativism. By situating Roman arguments about the natural world in their larger philosophical, political, and rhetorical contexts, _What Did the Romans Know?_ demonstrates that the Romans had sophisticated and novel approaches to nature, approaches that were empirically rigorous, philosophically rich, and epistemologically complex. Cet article clarifie le statut de l’entreprise par rapport à la structure de base rawlsienne. Ce statut est ambigu, du fait d’incertitudes liées à la conception rawlsienne de l’entreprise ainsi qu’à sa définition de la structure de base. L’article identifie deux représentations principales de l’entreprise chez Rawls : l’une inclusiviste, qui définit l’entreprise comme une entité ontologiquement distincte de la structure de base ; l’autre constitutiviste, qui l’appréhende comme une institution susceptible d’appartenir à la structure de base. L’article recense ensuite (...) différentes interprétations de la structure de base avant d’en proposer une plus large, y intégrant notamment certaines structures informelles. Articulée à la conception institutionnaliste de l’entreprise, cette définition large de la structure de base débouche sur une représentation constitutiviste étendue de l’entreprise, permettant ainsi au libéralisme égalitaire de considérer cette dernière d’un œil plus critique. This paper assesses employees’ moral agency within corporate capitalism from a politically liberal standpoint. While political liberalism has spelt out its key institutional implications at state level, it has neglected moral agency at work, assuming that a rights-based state that secures freedom of contract, free choice of occupation and a free labour market within a fair context would protect it sufficiently. Yet two features of corporate capitalism constrain employees’ moral agency: the relation of authority that forms part of the work (...) contract and organisations’ fragmented decision-making processes. Both seem at odds with the liberal ideal of allowing people to live by their own conception of the good. Consequently, this paper examines whether political liberalism should recommend greater safeguards for protecting workers’ moral agency. It proposes a criterion for assessing corporate capitalism: the ‘moral space’ defined as the socially shaped opportunities for action that can be enacted or endorsed from a comprehensive perspective. It argues that liberals should favour arrangements that widen workers’ moral space and suggests institutional designs that may achieve this while remaining within liberal boundaries. (shrink)

This article asks whether firms should exempt employees when they object to elements of their work that go against their conscience. Fairness requires that we follow the rules of an organization we have joined voluntarily only if these rules express mutual advantage. In corporations, I argue that subordination and exemption provides for mutual advantage better than subordination plus right of exit. This is because agents want to protect their conscientious convictions, even in hierarchical organizations geared towards efficient preference satisfaction. Paris is firing all its ammunition into the August night. Against a vast backdrop of water and stone, on both sides of a river awash with history, freedom's barricades are once again being erected. Once again justice must be redeemed with men's blood.Albert Camus wrote these words in August 1944, as Paris was being liberated from German occupation. Although best known for his novels including The Stranger and The Plague, it was his vivid descriptions of the horrors of the occupation (...) and his passionate defense of freedom that in fact launched his public fame. Now, for the first time in English, Camus at 'Combat' presents all of Camus' World War II resistance and early postwar writings published in Combat, the resistance newspaper where he served as editor-in-chief and editorial writer between 1944 and 1947. These 165 articles and editorials show how Camus' thinking evolved from support of a revolutionary transformation of postwar society to a wariness of the radical left alongside his longstanding strident opposition to the reactionary right. These are poignant depictions of issues ranging from the liberation, deportation, justice for collaborators, the return of POWs, and food and housing shortages, to the postwar role of international institutions, colonial injustices, and the situation of a free press in democracies. The ideas that shaped the vision of this Nobel-prize winning novelist and essayist are on abundant display. In large-scale assessments, disengaged participants might rapidly guess on items or skip items, which can affect the score interpretation’s validity. This study analyzes data from a linear computer-based assessment to evaluate a micro-intervention that blocked the possibility to respond for 2 s. The blocked response was implemented to prevent participants from accidental navigation and as a naive attempt to prevent rapid guesses and rapid omissions. The response process was analyzed by interpreting log event sequences within a finite-state machine approach. Responses (...) were assigned to different response classes based on the event sequence. Additionally, post hoc methods for detecting rapid responses based on response time thresholds were applied to validate the classification. Rapid guesses and rapid omissions could be distinguished from accidental clicks by the log events following the micro-intervention. Results showed that the blocked response interfered with rapid responses but hardly led to behavioral changes. However, the blocked response could improve the post hoc detection of rapid responding by identifying responses that narrowly exceed time-bound thresholds. In an assessment context, it is desirable to prevent participants from accidentally skipping items, which in itself may lead to an increasing popularity of initially blocking responses. If, however, data from those assessments is analyzed for rapid responses, additional log data information should be considered. (shrink)

This article asks whether firms should contribute to the costs of procreation and parenthood. We explore two sets of arguments. First, we ask what the principle of fair play – central in parental justice debates – implies. We argue that if one defends a pro-sharing view, firms are required to shoulder part of the costs of procreation and parenthood. Second, we turn to the principle of fair equality of opportunity. We argue that compensating firms for costs they incur because their (...) employees decide to procreate or parent may undermine some of the incentives leading to (statistical) discrimination in the workplace. The relationship between conceptions of law and conceptions of nature is a complex one, and proceeds on what appear to be two distinct fronts. On the one hand, we frequently talk of nature as being lawlike or as obeying laws. On the other hand there are schools of philosophy that seek to justify ethics generally, or legal theory specifically, in conceptions of nature. Questions about the historical origins and development of claims that nature is lawlike are generally treated as entirely (...) distinct from the development of ethical natural law theories. By looking at the many intersections of law and nature in antiquity, this paper shows that such a sharp distinction is overly simplistic, and often relies crucially on the imposition of an artificial and anachronistic suppression of the role of gods or divinity in the worlds of ancient natural philosophy. Furthermore, by tightening up the terms of the debate, we see that the common claim that a conception of ‘laws of nature’ only emerges in the Scientific Revolution is built on a superficial reading of the ancient evidence.Keywords: Ancient science; Philosophy of science; Philosophy of law; Ancient theology; Scientific Revolution. This text addresses some difficulties encountered reading Deleuze and Guattari “in situation”, in order to suggest a “symptomal reading” of their historico-conceptual moment. It first reexamines the distinction between a “history of revolutions” and “revolutionary-becoming”, in order to explain the meaning of the latter in connection with the Deleuzian concept of event and in the context of the historical sequence which demanded this new concept. The concept of event involves a foreclosed reference to the problem of the revolutionary situation in (...) Marxism; it acknowledges the theoretical difficulties of elaborating a materialist notion of revolutionary situation, but also the political impasses which, in the post-war decades, had brought about a crisis in the representation of the revolutionary subject which Marxism believed it could guarantee. In the light of this double crisis, theoretical and political, the article concludes with an examination of the contemporary reflections of Althusser and Guattari concerning the connection between revolutionary circumstances and political subjectivation. Concluding his discussion of bee reproduction in Book 3 ofGeneration of Animals, Aristotle makes a famous methodological pronouncement about the relationship between sense perception and theory in natural history. In the very next sentence, he casually remarks that the unique method of reproduction that he finds in bees should not be surprising, since bees have something ‘divine’ about them. Although the methodological pronouncement gets a fair bit of scholarly attention, and although Aristotle's theological commitments in cosmology and metaphysics are well (...) known, scholars have almost universally passed over the comment about bees and divinity in silence. This paper aims to show why that comment is no mere throwaway, and offers an exploration and elaboration of the ways in which divinity operates even at fairly mundane levels in his natural philosophy, as an important Aristotelian explanation for order, proportion and rationality, even in the lowest of animals. De plus, ces objections ne sont pas capables de proposer une alternative convaincante et débouchent sur des impasses comme celles qui sont propres aux théories des systèmes double ou triple.
