This paper will examine the nature of mechanisms and the distinction between the relevant and irrelevant parts involved in a mechanism’s operation. I first consider Craver’s account of this distinction in his book on the nature of mechanisms, and explain some problems. I then offer a novel account of the distinction that appeals to some resources from Mackie’s theory of causation. I end by explaining how this account enables us to better understand what mechanisms are and their various features.

Alston, Searle, and Williamson advocate the restrictive model of assertion , according to which certain constitutive assertoric norms restrict which propositions one may assert. Sellars and Brandom advocate the dialectical model of assertion , which treats assertion as constituted by its role in the game of giving and asking for reasons. Sellars and Brandom develop a restrictive version of the dialectical model. I explore a non-restrictive version of the dialectical model. On such a view, constitutive assertoric norms constrain (...) how one must react if an interlocutor challenges one's assertion, but they do not constrain what one should assert in the first place. I argue that considerations pertaining to constitutive luck undermine historicism—the view that an agent’s history can determine whether or not she is morally responsible. The main way that historicists have motivated their view is by appealing to certain cases of manipulation. I argue, however, that since agents can be morally responsible for performing some actions from characters with respect to which they are entirely constitutively lucky, and since there is no relevant difference between these agents and agents who have (...) been manipulated into acting from a character bestowed upon them by their manipulators, we should give up historicism. After presenting this argument and defending it against some potential objections, I briefly criticize the standard structuralist alternative and propose a new structuralist position that is shaped by reflection on constitutive luck. Constitutive mechanistic explanations are said to refer to mechanisms that constitute the phenomenon-to-be-explained. The most prominent approach of how to understand this constitution relation is Carl Craver’s mutual manipulability approach to constitutive relevance. Recently, the mutual manipulability approach has come under attack (Leuridan 2012; Baumgartner and Gebharter 2015; Romero 2015; Harinen 2014; Casini and Baumgartner 2016). Roughly, it is argued that this approach is inconsistent because it is spelled out in terms of interventionism (which is an approach to (...) causation), whereas constitutive relevance is said to be a non-causal relation. In this paper, I will discuss a strategy of how to resolve this inconsistency, so-called fat-handedness approaches (Baumgartner and Gebharter 2015; Casini and Baumgartner 2016; Romero 2015). I will argue that these approaches are problematic. I will present a novel suggestion of how to consistently define constitutive relevance in terms of interventionism. My approach is based on a causal interpretation of mutual manipulability, where manipulability is interpreted as a causal relation between the mechanism’s components and temporal parts of the phenomenon. According to “voluntarists,” voluntary control is a necessary precondition on being blameworthy. According to “non-voluntarists,” it isn’t. I argue here that we ought to take seriously a type of voluntary control that both camps have tended to overlook. In addition to “direct” control over our behavior, and “indirect” control over some of the consequences of our behavior, we also possess “constitutive” control: the capacity to govern some of our attitudes and character traits by making choices about what to do (...) that constitute those attitudes and traits. Taking this sort of control seriously, I argue, ultimately tips the scale towards voluntarism. First, I address a non-voluntarist case in which an agent is putatively made blameworthy by the reasons for which she acts, even though the particular reasons for which she acts aren’t up to her. I argue that this case looks compelling only if we overlook constitutive control, and thereby miss how the agent’s motivating reasons are under her voluntary control even though non-voluntarists think they are not. I then use the notion of constitutive control to diffuse some of the best putative counterexamples to voluntarism: cases in which subjects are blameworthy either for caring inadequately about others or for wishing them ill. Two important philosophical questions about assertion concern its nature and normativity. This article defends the optimism about the constitutive norm account of assertion and sets out a constitutivity thesis that is much more modest than that proposed by Timothy Williamson. It starts by looking at the extant objections to Williamson’s Knowledge Account of Assertion and argues that they fail to hit their target in virtue of imposing implausible conditions on engaging in norm-constituted activities. Second, it makes a similar proposal (...) and shows how it does better than the competition. It suggests that Knowledge Norm of Assertion is not constitutive of the speech act of assertion in the same way in which rules of games are constitutive, and thus KAA comes out as too strong. The final section embarks on a rescue mission on behalf of KAA; it puts forth a weaker, functionalist constitutivity thesis. On this view, KNA is etiologically constitutively associated with the speech act of assertion, in virtue of its function of generating knowledge in hearers. (shrink)

Our epistemic access to mathematical objects, like numbers, is mediated through our external representations of them, like numerals. Nevertheless, the role of formal notations and, in particular, of the internal structure of these notations has not received much attention in philosophy of mathematics and cognitive science. While systems of number words and of numerals are often treated alike, I argue that they have crucial structural differences, and that one has to understand how the external representation works in order to form (...) an advanced conception of numbers. The relation between external representations and mathematical cognition will be discussed by drawing on experimental results from cognitive science and mathematics education, and I argue for the constitutive role of external representations for the development of an advanced conception of numbers. According to an influential hypothesis, the speech act of assertion is subject to a single 'constitutive' rule, that takes the form: "One must: assert that p only if p has C". Scholars working on assertion interpret the assumption that this rule is 'constitutive' in different ways. This disagreement, often unacknowledged, threatens the foundations of the philosophical debate on assertion. This paper reviews different interpretations of the claim that assertion is governed by a constitutive rule. Jeremy Fix, in ‘Two Sorts of Constitutivism’ (2021), makes a case for the possibility of contingent essential properties to account for the metaphysical status of constitutive standards of things. In this brief note, I will present an open problem affecting Fix's conception, namely, the explanation of the membership of particulars to a genus, which is necessary to identify particulars subject to standards.

The standard reply to the critique that narrative theories of the self are either chauvinistic or trivial is to “go implicit”. Implicit narratives, it is argued, are necessary for diachronically structured self-experience, but do not require that such narratives should be wholly articulable life stories. In this paper I argue that the standard approach, which puts forward a phenomenological conception of implicit narratives, is ultimately unable to get out of the clutches of the dilemma. In its place, I offer an (...) alternative approach that does avoid the dilemma, by construing implicit narrativity as an enabling condition for experiences, rather than as something that is itself present in experience. According to this constitutive account, the coherence and intelligibility of our experiences is due to the fact that they are anchored in a larger, diachronic context. Bio-heteronormative conceptions of the family have long reinforced a nuclear ideal of the family as a heterosexual marriage, with children who are the genetic progeny of that union. This ideal, however, has also long been resisted in light of recent social developments, exhibited through the increased incidence and acceptance of step-families, donor-conceived families, and so forth. Although to this end some might claim that the bio-heteronormative ideal is not necessary for a social unit to count as a family, a more (...) systematic conceptualization of the family—the kind of family that matters morally—is relatively underexplored in the philosophical literature. This paper makes a start at developing and defending an account of the family that is normatively attractive and in line with the growing prevalence of non-conventional families and methods of family-formation. Our account, which we call a constitutive-affirmative model of the family, takes the family to be constituted by an ongoing process of relevant affective and affirmative relations between the putative family members. Although the notion of constitutive rule has played an important role in the metaphysical debate in social and legal philosophy, several authors perceive it as somewhat mysterious and ambiguous: the idea of a specific kind of rules that are supposed to be “magically” constitutive of reality seems suspicious, more a rationalistic fiction than a genuine explanation. For these reasons, reductionist approaches have been put forward to deflate the explanatory role of this notion. In this paper, I will instead (...) try to defend constitutive rules. My thesis is that the notion of constitutive rule is explanatorily helpful because it gives a complete account of an important phenomenon in the social and legal domain, namely, that of artifactual entities endowed with statuses that can have emergent normative properties. Conceiving of these entities as rule-constituted artifacts is an important part of what H. L. A. Hart called “the internal point of view” toward law, and for this reason constitutive rules should be included in an explanation of that point of view as an integral part of the life of institutions. The structure of my argument will be as follows. First, I will provide an example of an important phenomenon in the internal point of view, namely, the fact that individuals can have normative reactions not about the specific regulation of an institution but about its underlying purpose and rationale—what in the legal domain is called the ratio of a norm. Then I will identify two reductionistic approaches on constitutive rules. The first approach is exemplified by Brian Epstein’s idea that the phenomena explained by constitutive rules are better explained in terms of metaphysical (grounding/anchoring) relations. The second kind of reductionism is instead exemplified by the idea (held by several authors, among whom Alf Ross, Riccardo Guastini, Frank Hindriks, and Francesco Guala) that the phenomena explained by constitutive rules can be accounted for in terms of regulative rules plus a certain terminology. I will try to show that neither of these approaches can explain normative reactions to the ratio of an institution from an internal point of view: While the first cannot explain the fact that the reaction is strongly normative, the second cannot explain the fact that the reaction is about the ratio of a normative entity. Constitutive rules can instead explain both things and should be preserved as an important notion for the analysis of institutional ontology. By way of constitutive rules we create something: immaterial, rule-based institutional artifacts that can have emergent normative properties. (shrink)

The similarity approach stands as a significant attempt to defend scientific realism from the attack of the pessimistic meta-induction. The strategy behind the similarity approach is to shift from an absolute notion of truth to the more flexible one of truthlikeness. Nonetheless, some authors are not satisfied with this attempt to defend realism and find that the notion of truthlikeness is not fully convincing. The aim of this paper is to analyze and understand the reasons of this dissatisfaction. Our thesis (...) is that the dissatisfaction with the notion of truthlikeness concerns the double role that this notion plays within the similarity approach: This notion plays both a regulative role in the conception of theories and a constitutive one in their selection. This paper defends the normativity of meaning thesis by clearing up a misunderstanding about what the thesis amounts to. The misunderstanding is that according to it, failing to use an expression in accordance with the norms which constitute its meaning amounts to changing the expression’s meaning. If this was what the thesis claimed, then it would indeed be easy to show that meaning norms do not yield prescriptions and cannot be followed. However, there is another reading: what is constitutive (...) of meaning is not the norm’s being followed, but the norm’s being applicable. On this reading, some standard arguments against the thesis lose their force. After discussing the alternative reading and its consequences, the paper goes on to sketch a model of how norms of meaning become applicable in the first place. This model supports the view that talk of meaning has its pragmatic home in contexts of linguistic calibration. (shrink)

One of the most influential arguments against the possibility of drawing a principled fact-convention distinction consists in the insight that because our beliefs are necessarily evaluated together, any statement can be retained or given up in the face of experience. The purpose of this paper is to establish that this argument does not undermine Poincaré s conventionalism in virtue of the fact that this doctrine does not simply amount to the claim that there are principles that are immune to revision. Must you respect basic logical laws (BLL) – such as the law of non-contradiction – in order to think? Frege wrote that one must “acknowledge” BLL in order not to “abandon judgement altogether”. Some have argued that Frege therefore thought of logic as somehow ‘constitutive’ of thinking. However, some interpreters contend, due to his strong commitment to logic’s normative status, that Frege held the opposite view, namely the non-constitutivist view that (systematic) ‘illogical’ thinking is possible and that one need (...) not accept or follow BLL in order to think as such, although one must do so in order to think correctly. The aim of this paper is to investigate the interpretative landscape regarding Frege’s view on logic’s constitutive role for thinking and suggest, against the non-constitutivist readings, that he indeed was committed to some version of the constitutivity thesis, but that this commitment is not, as some constitutivist interpretations suggest, inconsistent with the idea that logic is normative for thinking. I will, instead, propose to read his view in a soft and agent-relative sense, according to which it is a necessary condition for the possibility of thinking that the agent in question is sensitive to and acknowledges BLL. I can, given the right conditions, transmit my knowledge to you by telling you some information. If I know the time, and if all goes well, I can bring it about that you know it too. If conditions are right, all I have to do is assert to you what time it is. Paradigmatically, speakers use assertions to transmit what they know to their hearers. Clearly, assertion and testimony are tightly connected. The nature of this connection, however, is not so (...) clear. According to many accounts, assertion has an epistemic constitutive norm. This norm appears to be able to account for some important features of testimony: first, testimonial knowledge transmission, second, the reliability of testimony, and third, the epistemic rights exchanged in cases of testimony. In this paper, however, I argue against this apparent ability. Environmental ethicists will often say that in dealing with natural entities we need the guidance of an ethic rooted in 'the intrinsic value of nature'. They will add that subjectivist value theories are unable to account for the normativity of intrinsic value discourse. This preoccupation with normativity explains why many environmental ethicists favour value objectivism. As I see it, value theories must address not only the problem of normativity but also the problem of motivation. In fact, my approach to the (...) question as to which type of value theory does most justice to our intuition regarding the value of nature is primarily in terms of the motivational perspective. I argue that neither the usual objectivist theories nor their subjectivist counterparts can accommodate and explain the fact that those who agree that nature has intrinsic value may well differ in motivation to support its preservation. I suggest that such difference in kinds of motivation is related to distinct kinds of value judgement in which belief in the intrinsic value of nature is expressed. To clarify my view I discuss the subjectivist value theory of Gerald Gaus [1]. Gaus regards the distinction between personal and impersonal value judgements to be deeply embedded in his theory. His internalism about the relation between reason and motivation however, leads him to the mistaken conclusion that independent impersonal value judgements do not provide reasons for action. Next, I introduce the distinction between identity-neutral and identity-constitutive reasons. This distinction allows me to formulate more clearly the differences between the kinds of reasons provided by personal and impersonal value judgements. The resulting theory explains how it is that people who do not (personally) value nature may still be motivated to support nature preservation. It also explains why not everyone who endorses natural values will join movements for the preservation of nature. (shrink)

The received view of Kant’s moral philosophy is that it precludes all moral luck. But I offer a plausible interpretation according to which Kant embraces moral luck in circumstance and constitution. I interpret the unconditioned nature of transcendental freedom as a person’s ability to do the right thing no matter how she is inclined by her circumstantial and constitutive luck. I argue that various passages about degrees of difficulty relating to circumstantial and constitutive luck provide a reason to (...) accept a pro-moral luck interpretation of Kant. (shrink)

It is often debated whether what we ought, politically, to do is determined by standards that are independent of any actual political process or whether, by contrast, judgments reached in actual democratic processes have constitutive importance in determining what we should do. This paper argues that this is not an exclusive disjunction and that, consistently with there being independent standards, constitutively authoritative judgments can enter into the truth-conditions pertaining to claims about what we ought, politically, to do. The crucial (...) objection to constitutive judgment is that it involves an unacceptable form of bootstrapping, according to which reasons arise out of nothing. To circumvent this objection, the paper deploys John Broome's notion of a wide-scope 'normative requirement'. Normative requirements affect what ought to be done without altering the balance of reasons and defuse the bootstrapping objection by blocking the derivation of all-things-considered conclusions. To show that politics involves constitutive authority of this kind, the paper defends two illustrative normative requirements applicable to the political process that give constitutive roles to political judgments of various kinds. Throughout, the discussion is enlivened by comparisons to the judgments of a baseball umpire, which have been illuminatingly discussed by Robert Brandom. (shrink)

Despite its frequent appearances in sociological textbooks, dictionaries and theoretical opuses, ethnomethodology is still one of the most misunderstood and undervalued domains of sociological inquiry. This is particularly evident in the case of the central sociological question: social order. Harold Garfinkel, the founder of ethnomethodology, provided a unique answer to the question of order. His answer emphasized a contingent, situated character of constitutive practices of local order production. Initially a response to Talcott Parsons’ question about the conditions of the (...) stability of social order, Garfinkel’s conception of constitutive order was later radicalized and used as the foundation of the programme of empirical ethnomethodological studies. To properly understand the radical character of the conception and programme, it is necessary to reveal the core elements of it and to separate them from the historically changed components. One’s constitution—whether one is generous or miserly, temperate or intemperate, kind or mean, etc.—is beyond one’s control in significant respects. Yet one’s constitution affects how one acts. And how one acts affects one’s moral standing. The counterintuitive inference—the so-called problem of constitutive moral luck—is that one’s moral standing is, to some significant extent, beyond one’s control. This article grants the premises but resists the inference. It argues that one’s constitution should have no net impact on one’s moral standing. While (...) a bad constitution lowers the chance that one will act morally, it offers significant gains to moral standing should that chance materialize. A good constitution increases one’s chance of performing good acts but for correspondingly more modest gains. This effect should smooth out, and possibly eliminate, the expected impact of constitution on moral standing. (shrink)

I show that the way they spelled out this idea renders it inadequate and is the reason why it received some objections. I propose a different way in which their point could be understood, that rests on two general distinctions. The first is a distinction between the underlying mathematical apparatus used (...) to formulate a theory and a concept proposed by that theory. With the aid of a formal reconstruction of a population genetic model, I show that drift belongs to the first category. That is, that drift is constitutive of population genetics in the same sense that multiplication is constitutive in classical mechanics, or that circle is constitutive in Ptolemaic astronomy. The second distinction is between eliminating a concept from a theory and setting its value to zero. I will show that even though drift can be set to zero just like the rest of the evolutionary factors, eliminating drift is much harder than eliminating those other factors, since it would require changing the entire mathematical apparatus of standard population genetic theory. I defend the claim that in psychological theories concerned with theoretical or practical rationality there is a constitutive relation between normative and descriptive theories: Normative theories provide idealized descriptive accounts of rational agents. However, we need to resist the temptation to collapse descriptive theories with any specific normative theory. I show how a partial separation is possible.

A striking thesis lies at the core of Davidson's philosophy: when we attribute intentional content to another creature's mental states and speech acts, we must treat the creature as largely conforming to our own rational norms. I will discuss how this thesis informs Davidson's treatment of rationality and intentionality. After reviewing some historical background, I present basic aspects of Davidson's position. I then examine various worries about the position. I conclude by highlighting some key Davidsonian insights into rationality.

The purpose of this work is to provide a metaphysical theory of properties and scientific laws. This sentence will require some unpacking. By a ‘metaphysical’ theory here, I mean a theory of what exists in the world. In this investigation I am primarily concerned with a theory of what properties there are in the world and the role they play in scientific laws. This may be contrasted with a linguistic or epistemic project, as it is not primarily about our language, (...) ideas, or theorizing but rather about what is in the world itself. Properties are what we may pre-philosophically think of as the characteristics of an object: such as its height, weight, color, etc. Investigation may cause us to doubt whether some of these pre-philosophical properties are genuine in a metaphysical sense: whether or not the property is actually present as a feature of the world. By scientific laws, I mean the statements we make in the form of exceptionless generalities about the world within the sciences. Here I do not mean to evaluate how science comes about these generalizations, only that they do and how these generalizations may be grounded in a metaphysical theory of properties. The link between these two things: properties and scientific laws, comes about because our scientific laws prominently feature properties: velocity, temperature, charge, viscosity, etc. After a review of some of the theories currently proposed in the philosophical literature along with a treatment of some of the problems that arise out of these theories, I will propose a new theory. This theory, entitled ‘Constitutive Trope Theory’ is a form of a ‘bundle trope theory’ as it proposes that objects in the world are composed entirely out of particularized properties. However, rather than proposing a primitive relation that does the bundling, this theory will propose that, at least for the objects we are familiar with, properties arise out of relations between lower-level properties that instantiate them. For example, a mammal may exist because of the relationship between the organs that lead to its unique properties as a mammal. Those organs in turn exist because of relationships between their cells that lead to their unique properties as a particular kind of organ. And so on down the chain until we hit ‘foundational properties’: properties which are not dependent on any other properties for their existence. I will say very little about these properties as I do not believe that any such properties have currently been found and will argue that such theorizing is premature before such properties have been empirically identified. Following this account, I will consider some of the problems that must be overcome and some final considerations in favor of this theory over other competing theories of properties and scientific laws. The aim of the paper is to supply a contribution to the semantics of “constitutive,” as confined to the scope of judicial reasoning. More precisely, the aim of the paper is to inquire what links the use of “constitutive” in three distinct (seemingly unrelated) issues on adjudication, namely: (a) the procedural classification of different sorts of judicial decisions, (b) the epistemological debate on the very nature of judicial decisions, and (c) a logical query on the import constitutive (...) rules might be taken to have in affecting the sort and/or the nature of judicial decisions in which they might occur as the legal premiss, grounding the solution of the case. These are: the colloquy of the soul with itself, a single sentence, a proposing aloud, the enumeration of the constitutive elements of a whole and the giving of a specific difference; further, opinion and imagination. These meanings are then related to Plato's determination of knowledge and therewith truth and falsity. One can be said to possess knowledge only when the (...) universal contents of thought - dialogical thought - are set in relation to the perceivable, imagination or opinion. What becomes of our clearest theories of explanation, when faced with the unpalatable quantum phenomena that seem to undermine the direct conceptual connection between the fundamental material entities and the self-standing material objects of everyday parlance? The general explanatory theory advocates unification of explanatory concepts with everyday discourse, identification of essentially similar characteristics between direct experience and the hypothesised explanatory ontology, and a conceptualisation of phenomena in terms of objects enduring causally regulated change. On the other hand quantum theory feeds (...) antirealist suspicions about the worth of realist explanatory endeavour with examples of phenomena in which the structure of material separation and individuation based on spatial extension is insufficient for construction of deeper explanatory narratives. An example from history of science, that of Newton’s law-constitutive definition of objects in response to D escartes problem of bodies is used to suggest a possible strategy for explanations unifying the quantum and common-sense conceptual domains, provided the anti-realist challenge to such enterprise is read as questioning the epistemological justification of interpretation of experience in both cases.Što se događa s najjasnijim dostupnim teorijama objašnjenja kada se suoče s problematičnim kvantnim pojavama koje naizgled potkopavaju neposrednu konceptualnu poveznicu između fundamentalnih materijalnih entiteta i samoopstojnih materijalnih predmeta iz svakodnevnog govora? Opća teorija objašnjenja preporuča objedinjenje teoretskih eksplanatornih pojmova sa svakodnevnim govorom, određenje esencijalno sličnih karakteristika između neposrednog iskustva i hipotetske eksplanatorne ontologije te konceptualizaciju pojava kroz predmete koji istraju kroz uzročno regulirane promjene. S druge strane, kvantna teorija potkrjepljuje antirealistične sumnje o valjanosti eksplanatornog nastojanja realizma primjerima pojava u kojima je struktura materijalne razdvojenosti i individuacije temeljene na prostornoj protežnosti nedovoljna za izgradnju dubljih eksplanatornih narativa. Primjerom iz povijesti znanosti, Newtonovom definicijom predmeta temeljenom na zakonima kao odgovorom na Descartesov problem materijalnih tijela, daje se moguća strategija izgradnje objašnjenja koja objedinjuju kvantne i “zdravorazumske” konceptualne domene, ukoliko se antirealistična kritika te izgradnje u oba slučaja shvati kao propitivanje epistemološkog opravdanja tumačenja iskustva.
