Sentimiento y perturbación son cosas distintas y producen comportamientos bien diferentes. Sin embargo, el amor puede experimentarse como una idea con tenaz persistencia y como un deseo incontrolable.

The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. En este texto argumento a favor de la consideración de la forma como sujeto y, por tanto, como responsable de la identidad del objeto a través del movimiento. Se consideran sucesivamente la prioridad de la forma como sustancia, su carácter particular y los distintos sentidos en los que algo puede ser sujeto, para concluir por qué en Z, 3, la forma es el mejor candidato no sólo para ser sustancia, sino para ser sujeto en sentido principal. El objeto del texto (...) es abordar la discusión en torno a por qué la forma satisface ontológicamente mejor que la materia o el compuesto el criterio de ser sujeto y las consecuencias filosóficas de esa postura. Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. Este artículo tiene como objetivo presentar, a partir de un enfoque hermenéutico, tres perfiles de sus vidas, los cuales tienen en común la búsqueda de la configuración de una forma de vida ético-estética en la que resulta esencial actuar conforme a lo que se piensa. En este artículo se presenta la importancia que le da Hannah Arendt al relato histórico y ficticio como vía para la reflexión ética y política. Se estudia, en primer lugar, cómo los relatos posibilitan la configuración de la identidad, tanto de un hombre como de una comunidad, ya que la narración permite dar sentido a la fragilidad y contingencia propia de las acciones humanas. En segundo lugar se analiza de qué manera la narración permite conservar en la memoria acciones para (...) que no sean olvidadas. Finalmente se estudia cómo el seguimiento de relatos contribuye a la comprensión del mundo humano y a potenciar la facultad de juzgar para superar pensamientos solipsistas, elemento necesario para el ejercicio de una concepción ética y política basada en el reconocimiento de la pluralidad humana. In the intellectual scene of 19th century Colombia, Soledad Acosta de Samper stands out for pioneering the recognition of the significance of women for society. This purpose can be found in her work as a journalist as well as in her essays and literary works. Thus, the aim of the article is to analyze from the standpoint of social criticism how are configured the female characters in the works Dolores: cuadros de la vida de una mujer y Teresa la limeña: (...) páginas de la vida de una peruana. Based on the analysis of these novels, the article seeks to show how she gives voice to the main characters of her work, thus looking into the intimacy of female thinking. With the latter, she not only contributed to the strengthening of the ideals of virtue fostered during 19th century, but also of the necessity of intellectual education of women as a fundamental requirement for the training of ideal female citizens. The Lasallian District of Medellin, Colombia requested Corporación Universitaria Lasallista to analyze the formation process received by postulants to De La Salle Brothers in Istmina, Colombia, from 2002 to 2010. Academic, religious, pedagogical, apostolic and personal formation experiences received there were analyzed in this case study –from a qualitative approach– by means of semi-structured interviews and focus groups. Personal and apostolic formations stand out among the results due to the characteristics of Istmina as a proper place for sensibilization and subjugation (...) in proof of vocation. However, the reach of integral formation is questioned because academic formation presented meaningful deficiencies. In conclusion, even though formation experiences in vulnerable contexts are appreciated –and contextualization of learning is deemed meaningful–, participants agree in the necessity of developing strong competences to face educational and apostolic practices. The article suggests an ethical-anthropological reading of Thoughts, magna opera of the French mathematician and philosopher Blaise Pascal, which was published after his death by his relatives and friends. Such a reading is presented in three moments: Firstly, an anthropological description aimed at answering the question ‘who is man?’; secondly, an analysis of Pascal’s erotic condition; and, finally, an ethical proposal as cura amoris. The main argument of the article is that every human being has a motivation in acting, that (...) of love and being loved. Thus, having a happy or unhappy life depends on the care for this erotic condition, and the latter is achieved through thought. (shrink)

En 2011 el señor Mario Posada Ochoa donó a la Universidad EAFIT una extensa y poco conocida colección de arte; acaso unos cuantos amigos habrían visto de cerca las 480 obras que recibió la Universidad, de artistas como Segundo Angelvis, Inés Acevedo Bernal, Sergio Trujillo Magnenat, Luis A. Rengifo y Ramón Vásquez, entre otros. Algunas de ellas carecían de la firma del autor o de un dato que comprobara la autoría, y estaban deterioradas, más que por el tiempo, por el (...) improvisado bodegaje: don Mario las había guardado durante cuarenta años en su hermosa casa de Maracaibo, en el centro de la ciudad. Gray zones, which develop wherever oppression is severe and lasting, are inhabited by victims of evil who become complicit in perpetrating on others the evils that threaten to engulf themselves. Women, who have inhabited many gray zones, present challenges for feminist theorists, who have long struggled with how resistance is possible under coercive institutions. Building on Primo Levi's reflections on the gray zone in Nazi death camps and ghettos, this essay argues that resistance is sometimes possible, although outsiders are rarely, (...) if ever, in a position to judge when. It also raises questions about the adequacy of ordinary moral concepts to mark the distinctions that would be helpful for thinking about how to respond in a gray zone. (shrink)

The opportunities to become a good person are not the same for everyone. Modern European ethical theory, especially Kantian ethics, assumes the same virtues are accessible to all who are capable of rational choice. Character development, however, is affected by circumstances, such as those of wealth and socially constructed categories of gender, race, and sexual orientation, which introduce factors beyond the control of individuals. Implications of these influences for morality have, since the work of Williams and Nagel in the seventies, (...) raised questions in philosophy about the concept of moral luck. In The Unnatural Lottery, Claudia Card examines how luck enters into moral character and considers how some of those who are oppressed can develop responsibility. Luck is often best appreciated by those who have known relatively bad luck and have been unable to escape steady comparison of their lot with those of others. The author takes as her paradigms the luck of middle and lower classes of women who face violence and exploitation, of lesbians who face continuing pressure to hide or self-destruct, of culturally Christian whites who have ethnic privilege, and of adult survivors of child abuse. How have such people been affected by luck in who they are and can become, the good lives available to them, the evils they may be liable to embody? Other philosophers have explored the luck of those who begin from privileged positions and then suffer reversals of fortune. Claudia Card focuses on the more common cases of those who begin from socially disadvantaged positions, and she considers some who find their good luck troubling when its source is the unnatural lottery of social injustice. The article introduces the problematics of the classical two-valued logic on which Western thought is generally based, outlining that under the conditions of its logical assumptions the subject I is situated in a world that it cannot address. In this context, the article outlines a short history of cybernetics and the shift from first- to second-order cybernetics. The basic principles of Gordon Pask’s 1976 Conversation Theory are introduced. It is argued that this second-order theory grants agency to others through a (...) re-conception of living beings as You logically transcending the I. The key principles of Conversation Theory are set in relation to the poetic forms of discourse that played a key role in art as well as philosophical thinking in China in the past. Second-order thinking, the article argues, is essentially poetic. It foregoes prediction in favour of the potentiality of encountering tomorrow’s delights. (shrink)

This article proposes a Kantian account of our reasons to forgive that situates our moral fallibility as their ultimate ground. I explore similarities and differences between Kant’s account in the Doctrine of Virtue and the more recent account offered by Garrard and McNaughton, 39–60, 2003). After tracing the connection between moral fallibility and moral luck, I discuss Kant’s argument for a duty to be forgiving. Kant’s strategy yields a plausible account of the normative status of forgiveness: Although we generally have (...) a moral reason to forgive others, forgiveness is not required in every case of wrongdoing. Kant’s argument is based on the assumption that we are all in need of forgiveness, the nature of which I go on to explain. Forgiveness has the power to relieve us of a burden that results from moral failure, which grounds both its standing as a duty and its importance in the lives of fallible moral agents. (shrink)

The dynamic organisational processes in businesses dilute the boundaries between the individual, organisational, and societal drivers of corporate philanthropy. This creates a complex framework in which charitable project selection occurs. Using the example of European tour operators, this study investigates the mechanisms through which companies invest in charitable projects in overseas destinations. Inextricably linked to this is the increasing contestation by local communities as to how they are able to engage effectively with tourism in order to realise the benefits tourism (...) development can bring. This research furthers such debates by exploring the processes through which tour operators facilitate community development through charitable giving. Findings show, with no formal frameworks in existence, project selection depends upon emergent strategies that connect the professional with the personal, with trust being positioned as a central driver of these informal processes. Discretionary responsibilities are reworked through business leaders’ commitment to responsible business practises and the ethical subjectivity guiding these processes. (shrink)

It finds that epithelial respiration in DK31 B100 is central to Empedocles’ conception of plants’ breathing, linked to their fructification, deciduousness, and overall life preservation. It also discusses plants’ respiration in relation to their body temperature in Menestor, then, concludes by analyzing Democritus’ psychological doctrine, arguing that the intake of fiery atoms pertained to all living (...) beings, plants included. This article explores the philosophically neglected topic of artistic integrity, situated within the literature on personal or moral integrity more generally. It argues that artists lack artistic integrity if, in the process of creation, they place some other—competing, distracting, or corrupting—value over the value of the artwork itself, in a way that violates their own artistic standards. It also argues, however, that artistic integrity does not require adamant refusal to acknowledge or act upon commitments to values other than single‐minded devotion (...) to one's art. Artists of integrity need not be inflexible fanatics. They can seek to earn a living through their art, alter their vision of a work to reach an audience, evolve their artistic standards as they grow as artists, and balance the energy devoted to their art against energy devoted to family, friends, and self‐care; they can honor the demands of morality. BackgroundDecisions about withdrawal of life support for infants have given rise to legal battles between physicians and parents creating intense media attention. It is unclear how we should evaluate when life is no longer worth living for an infant. Public attitudes towards treatment withdrawal and the role of parents in situations of disagreement have not previously been assessed.MethodsAn online survey was conducted with a sample of the UK public to assess public views about the benefit of life in hypothetical cases (...) similar to real cases heard by the UK courts. We then evaluated these public views in comparison with existing ethical frameworks for decision-making.ResultsOne hundred and thirty participants completed the survey. The majority agreed that an infant’s life may have no benefit when well-being falls below a critical level. Decisions to withdraw treatment were positively associated with the importance of use of medical resources, the infant’s ability to have emotional relationships, and mental abilities. Up to 50% of participants in each case believed it was permissible to either continue or withdraw treatment.ConclusionDespite the controversy, our findings indicate that in the most severe cases, most people agree that life is not worth living for a profoundly disabled infant. Our survey found wide acceptance of at least the permissibility of withdrawal of treatment across a range of cases, though also a reluctance to overrule parents’ decisions. These findings may be useful when constructing guidelines for clinical practice. (shrink)

In this paper, we argue that solutions to normative challenges associated with autonomous driving, such as real-world trolley cases or distributions of risk in mundane driving situations, face the problem of reasonable pluralism: Reasonable pluralism refers to the fact that there exists a plurality of reasonable yet incompatible comprehensive moral doctrines within liberal democracies. The corresponding problem is that a politically acceptable solution cannot refer to only one of these comprehensive doctrines. Yet a politically adequate solution to the normative challenges (...) of autonomous driving need not come at the expense of an ethical solution, if it is based on moral beliefs that are (1) shared in an overlapping consensus and (2) systematized through public reason. Therefore, we argue that a Rawlsian justificatory framework is able to adequately address the normative challenges of autonomous driving and elaborate on how such a framework might be employed for this purpose. In this article I address the imbalance in the production and circulation of knowledge in the dominant Anglo-American academic circuit, aiming to make visible feminist work in a decolonial vein carried out in Latin America, to recentre the decolonial option with regard to established postcolonial studies and to propose a way of understanding global postfeminist female subjectivity as mediated in mass media. The decolonial option offers a rich theoretical toolbox for exploring contemporary junctions of gender, race and the question of (...) representation. I propose a reworking of the concept of the ‘coloniality of gender’, and briefly discuss how Femen and the figure of the exoticised female pop icon exemplify coloniality at work. (shrink)

With a novel approach to Aristotle's zoology, this study looks at animals as creatures of nature and reveals a scientific discourse that, in response to his predecessors, exiles logos as reason and pursues the logos intrinsic to animals' bodies empowering them to sense the world and live. The volume explores Aristotle's conception of animals through a discussion of his ad hoc methodology to study them, including the pertinence of the soul to such a study, and the rise of zoology as (...) a branch of natural philosophy. For Aristotle, animal life stems from the body in the space of existence and revolves around sensation, which is entwined with pleasure, pain, and desire. Lack of human reason is irrelevant to an understanding of the richness of animal life and cognition. In sum, the reader will acquire knowledge of the animal as such, which lay at the core of Aristotle's agenda and required a study of its own, separate from plants and the elements. Paulo Freire consistently upheld humanization and mutuality as educational ideals. This article argues that conceptualizations of knowledge and how knowledge is sought and produced play a role in fostering humanization and mutuality in educational contexts. Drawing on Mary Shelley’s novel Frankenstein, this article focuses on the two central characters who ‘ardently’ pursue knowledge at all costs. It will be argued that the text suggests two possible outcomes from the pursuit of knowledge. One is mutuality; the other is social disconnectedness.

'During the course of the seventeenth century, within the scholastic tradition itself, commentaries on Aristotle's natural philosophical works increasingly gave way to textbooks and compendia organized along thematic lines' (Dear 1985, 161).

This paper focuses on the cognitive/computational and evolutionary levels. It describes three proposals to make cognition computationally tractable, namely: Resource Rationality, the Adaptive Toolbox and Massive Modularity. While each of these proposals appeals to evolutionary considerations to dissolve the intractability of cognition, Rich, Blokpoel, de Haan, and van Rooij argue that, in each case, the intractability challenge is not resolved, but just relocated to the level of evolution.

Health-care goods are goods with peculiar properties, and where they are scarce, societies face potentially explosive distributional conflicts. Animated public and academic debates on the necessity and possible justice of limit-setting in health care have taken place in the last decades and have recently taken a turn toward procedural rather than substantial criteria for justice. This article argues that the most influential account of procedural justice in health-care rationing, presented by Daniels and Sabin, is indeterminate where concrete properties of rationing (...) institutions are concerned. Such properties inscribe substantial norms into institutions. These norms can derive validity only from democratic majority decisions, which must be seen as an instance of pure procedural justice. We therefore have to move the discussion to a meta-level and ask how concrete properties of institutions are being chosen. I suggest four criteria for sufficiently democratic institutional design choice and conclude that as institutional properties are likely to have effects on the resulting distribution of health care, design choices should be empirically informed and taken both democratically and deliberately.
