This study provides novel evidence of the impact of corporate social responsibility (CSR) on investment sensitivity to cash flows. This study examines the R&D investment behaviour of different types of family-controlled firms with the moderating role of ownership discrepancy between cash-flow rights and excess voting rights by using the sufficiency conditions’ theoretical framework of ability and willingness developed by De Massis. It uses data from family firms that have issued A-shares from 2008 to 2018. They used pooled OLS regression for data analysis and Tobit regression for robustness checks. This study classifies family firm types into (...) two categories, namely, the lone-controller family firms (LCFFs) and the multi-controller family firms (MCFFs), with each being further classified as “excess” or “no excess” voting rights. Both LCFFs without excess voting rights and MCFFs with excess voting rights have the “ability” and “willingness” toward R&D investment. LCFFs with excess voting rights and MCFFs without excess voting rights only have the ability but low willingness to invest in R&D. The study also establishes that Chinese family-controlled firms are heterogeneous toward risky investment. To the best of our knowledge, this study is the first to differentiate Chinese family firms by their unique ownership structure characteristics in investigating the effect of the family firm structure on R&D investment. The study is a novel attempt to test the willingness and ability framework of LCFFs and MCFFs. Previous studies based on agency theory have tacitly assumed that ability and willingness exist in family-controlled firms. However, this study challenges this implicit assumption. (shrink)

Using empirical evidence gathered from Chinese listed companies, this article explores the relationship between micro-governance mechanisms and corporate philanthropy from a corporate governance perspective. In China’s emerging market, ultimate controlling shareholders of state-owned enterprises are reluctant to donate their assets or resources to charitable organizations; in private enterprises marked by more deviation in voting and cash flow rights, such donations tend to be more likely. However, the ultimate controllers in PEs refuse to donate assets or resources they (...) control or own, which implies that corporate philanthropy by PEs comes at the cost of others, through assets or resources owned by minority shareholders. Even after devastating natural disasters such as the 2008 Wenchuan Earthquake, the controlling shareholders continue to express reluctance to donate any assets they control. Despite widespread evidence that corporate philanthropy boosts corporate growth and profitability, these ultimate controllers indicate no intention to donate their own money as a means to improve corporate performance. The purpose of this study is to extend prior research on this topic by investigating whether the impact of ownership concentration moderates the link between corporate social performance and financial performance. This study uses a set of unique, hand-collected pollution control data to measure CSP, based on a sample of Taiwanese listed companies during the period from 1996 to 2006. Can firms overcome credit constraints with a corporate culture of high integrity? We empirically address this question by studying their investment–cash flow sensitivities. We identify firms with a culture of integrity through textual analysis of public documents in a sample of Chinese listed firms and also through corporate culture statements. Our results show that firms with an integrity-focused culture have lower investment–cash flow sensitivity, even after we address endogeneity concerns. However, we also find that for the (...) culture to reduce the investment–cash flow sensitivity, external stakeholders must be able to verify this culture through a low information asymmetry environment. The purpose of the study is to reveal theoretical and methodological approaches to optimizing the formation of cash flows of enterprises. The article presents an analysis of the process of integrating the optimization of the company's cash flows into the overall sequence of their management, as well as the conditions for the application of complex measures for subsequent financial recovery. The scientific novelty of the obtained results lies in the development and refinement of theoretical provisions, schemes for optimizing (...) cash flows and determining the directions for evaluating the optimization of cash flows. As a result, the main directions of optimization of cash flows are identified. As a result, it is revealed that the optimization process is formed on the basis of a logical sequence, the process of implementing management decisions regarding the optimization of the cash flows of the enterprise is justified. We consider future cash flows that are contingent both on dates in time and on uncertain states. The decision maker (DM) values the cash flows according to its decision criterion: Here, the payoffs’ expectation with respect to a capacity measure. The subjective measure grasps the DM’s behaviour in front of the future, in the spirit of de Finetti’s (1930) and of Yaari’s (1987) Dual Theory in the case of risk. Decomposition of the criterion into two criteria that represent (...) the DM’s preferences on uncertain payoffs and time contingent payoffs are derived from Ghirardato’s (1997) results. Conditional Choquet integrals are defined by dynamic consistency (DC) requirements and conditional capacities are derived, under some conditions on information. It has been widely assumed and proven that a firm’s research and development investment is limited if the availability of cash flow is constrained. The purpose of this study is to verify the opposite proposition: whether firms invest heavily in R&D when more cash flow is available. This paper discusses the heterogeneous relationship between cash flow from different sources and the R&D investment of firms. The study divides the firm’s cash flow into (...) three categories according to the business activities that generate firm finance: cash flow from operating activities, cash flow from investing activities, and cash flow from financing activities. On this basis, a dynamic R&D investment model is constructed, and the relevant data for Chinese listed firms are used for the empirical research. The study finds that Chinese listed firms do not necessarily spend more cash on R&D investment, even if the availability of cash flow is not constrained. For young firms, CFO and CFI do not significantly correlate with R&D investment, and CFF significantly negatively correlates with R&D investment. For mature firms, the correlations between cash flow generated from different activities and R&D investment are nonsignificant. (shrink)

A cash-flow viability model is used to evaluate the impacts of land-use zoning on farm households in New Jersey. Findings suggest that zoning results in increased production expenses, lower efficiency and profitability, and the devaluation of land assets. Cash flow and economic viability are, thus, reduced. Impacts of zoning on farm incomes, off-farm incomes, revenues from land sales, indebtedness, and farm sizes were not statistically significant. The results suggest that the use of land-use zoning statutes to (...) guarantee the existence of agriculture may not be equitable unless transferable development rights or other methods of compensating farmers for their losses are simultaneously implemented. This paper investigates the effect of corporate social responsibility (CSR) on firm value and seeks to identify the source of that value, by disaggregating the effects on forecasted profitability, long-term growth and the cost of capital. The study explores the possible risk (reducing) effects of CSR and their implications for financial measures of performance. For individual dimensions of CSR, in general strengths are positively valued and concerns are negatively valued, although the effect is not universal across all dimensions of CSR. (...) The results are supportive of the positive incentive hypothesis and the negative entrenchment hypothesis put forth by La Porta et al. and Claessen et al.. The negative relation between equity investment and firm's value further supports the agency postulation that corporate excess and abnormal equity investments represent a leeway for controlling shareholder to exploit wealth of minority shareholders. This study potentially contributes to the literature of business ethics by portraying an empirically testable linkage from controlling owner's ethical choices to his actions and therefore firm's value. In this paper, we examine the information content of insider transactions in China and analyze how ownership structures shape market reaction to these transactions. We find that the cumulative abnormal return to insider purchases is a convex function of the percentage of shares owned by the largest shareholder. Further, the CAR to insider purchases is lower when the largest shareholder is government-related, or when the control rights of the largest shareholder exceed its cash flow rights. We (...) also find that the market reaction to insider purchases is more positive for firms audited by Big4 auditors. However, we do not find a significant relationship between an ownership structure and the market reaction to insider sales. Our results are remarkably robust to alternative model specifications, corporate insider identities, and recent corporate news releases on price-sensitive events. Finally, we show that market reaction to insider purchases is larger for firms with less severe expropriations, as captured by the use of other receivables. (shrink)

This study fills an important gap in the literature by providing causal evidence of the impact of relaxing financial constraints on corporate social responsibility (CSR). To isolate this causal link, we examine the enactment of anti-recharacterization laws in some U.S. states, an exogenous shock that has strengthened creditor rights and eased financial constraints of the treated firms. Our difference-in-difference analysis suggests that relaxing financial constraints leads to higher CSR. This evidence is more pronounced in financially constrained firms, firms with (...) more analyst dispersion and increased volatility of cash flows. We also find that the most impacted firms are those with increased post-shock debt financing. In sum, our evidence suggests that easing access to external finance drives corporate goodness, in particular in firms that value external financing. (shrink)

Learning objective: Participants learn about the invasive nature of corruption and its effect on human rights, but more specifically about the role of a multinational versus the role of the government when trying to deal with such issues. Participants will also learn a great deal about the complexity of sustainability issues for corporations, particularly human rights issues. Responding to these impacts will require the implementation of environmental and social policies that are both environmentally effective and consistent with the (...) equality and liberty of populations to which they are applied. This article considers whether global emissions trading, namely, the creation of a global market for tradable allowances conferring the right to emit a certain amount of greenhouse gas over a specified time period, is normatively defensible from a liberal egalitarian perspective. After a brief review of the theory and practice of emissions trading, a number of normative objections to the international trade in emissions allowances are analysed. These objections appeal to one, or a combination, of two claims. First, emissions trading schemes are likely to produce undesirable outcomes, such as environmental neglect, in the further future. I call these ‘instrumental objections’. Second, emissions trading schemes violate non‐consequential norms of justice and fairness. I call these ‘intrinsic objections’. It is argued that, when combined, instrumental and intrinsic objections indicate that instituting a global network of emissions trading schemes, as envisioned by a number of parties to the Kyoto Protocol and Copenhagen Accord, would be illegitimate in absence of significant procedural and consequential safeguards. Pipe flow has been a challenge that gave rise to investigations on turbulence—long before turbulence was discerned as a research problem in its own right. The discharge of water from elevated reservoirs through long conduits such as for the fountains at Versailles suggested investigations about the resistance in relation to the different diameters and lengths of the pipes as well as the speed of flow. Despite numerous measurements of hydraulic engineers, the data could not be reproduced by a (...) commonly accepted formula, not to mention a theoretical derivation. The resistance of air flow in long pipes for the supply of blast furnaces or mine air appeared even more inaccessible to rational elaboration. In the nineteenth century, it became gradually clear that there were two modes of pipe flow, laminar and turbulent. While the former could be accommodated under the roof of hydrodynamic theory, the latter proved elusive. When the wealth of turbulent pipe flow data in smooth tubes was displayed as a function of the Reynolds number, the empirically observed friction factor served as a guide for the search of a fundamental law about turbulent skin friction. By 1930, a logarithmic “wall law” seemed to resolve this quest. Yet pipe flow has not been exhausted as a research subject. It still ranks high on the agenda of turbulence research—both the transition from laminar to turbulent flow and fully developed turbulence at very large Reynolds numbers. (shrink)

The presumption is that a broker executing a stock trade for a retail investor will get the investor the best possible price execution for the transaction. In fact, the broker often sells the retail investor’s trade to an intermediary for cash payment. The broker’s motivation to generate dealer profits seems to overcome the broker’s fiduciary responsibility to obtain the best execution price for the customer, raising ethical questions. This study examines how local Protestant belief, as one type of social norms, affects corporate cash policies. We find that firms located in areas with more Protestants hold less cash reserves. The influence of local Protestant belief on cash holdings is more profound for firms with weak corporate governance and firms with one geographic segment. In addition, we find that the difference in cash deployment is reflected in the difference in firms’ investment and payout policies. Relation between physicians and pharmaceutical industry is required for the benefit of the patient. But it may turn into business and overthrow the patients’ benefit. The relation might be in question at present and in future. Several questions are flowing in Bangladesh. To solve these queries we have explored the situation in developed and developing countries. The physicians and associations of pharmaceutical industries developed several ethical guidelines in those countries. They have addressed the long lasting issues on gift provided to (...) physician, cash back, sample, industry sponsored scientific meetings, research and hospitality. There are huge restrictions to ensure the right of the patient’s e.g. limitation of inexpensive gift by the pharmaceuticals, avoiding expensive medicine instead of equally effective low priced medicine. We are lacking behind to protect the patient right properly: regulation, adherence to existing guide line, lack of guidance from statutory bodies. The current scenario is far behind the right of patient. In Bangladesh it is not yet addressed either by professionals or by pharmaceutical associations. Conditional cash transfers represent an innovation in social assistance policy by conditioning welfare benefits on recipients’ behaviors associated with human capital development. Although social assistance has expanded throughout the developing world in the 21st century, the political logic guiding CCT adoption differs sharply from that of unconditional cash transfers, and from the politics of social insurance development. Striking spatial and temporal correlations in their adoption also raise the specter of policy interdependence. A dynamic logit analysis of social assistance (...) reforms in developing nations from 1990 to 2011 reveals that although CCTs have been impelled by democratization in developing countries, the model is not embraced systematically by the left or the right of the political spectrum. Rather, CCTs are more likely to be adopted in contexts of divided government and where regional neighbors, and more democratic countries in the region, have previously adopted them. (shrink)

A set of axioms implicitly defining the standard, though not instant-based but interval-based, time topology is used as a basis to build a temporal modal logic of events. The whole apparatus contains neither past, present, and future operators nor indexicals, but only B-series relations and modal operators interpreted in the standard way. Determinism and indeterminism are then introduced into the logic of events via corresponding axioms. It is shown that, if determinism and indeterminism are understood in accordance with their core (...) meaning, the way in which they are formally introduced here represents the only right way to do this, given that we restrict ourselves to one real world and make no use of the many real worlds assumption. But then the result is that the very truth conditions for sentences about indeterministic events imply the existence of tensed truths, in spite of the fact that these conditions are formulated (in the indeterministic axiom) in terms of tenseless language. Covenantal Rights is a groundbreaking work of political theory: a comprehensive, philosophically sophisticated attempt to bring insights from the Jewish political tradition into current political and legal debates about rights and to bring rights discourse more fully into Jewish thought. David Novak pursues these aims by presenting a theory of rights founded on the covenant between God and the Jewish people as that covenant is constituted by Scripture and the rabbinic tradition. In doing so, he presents (...) a powerful challenge to prevailing liberal and conservative positions on rights and duties and opens a new chapter in contemporary Jewish political thinking.For Novak, "covenantal rights" are rooted in God's primary rights as creator of the universe and as the elector of a particular community whose members relate to this God as their sovereign. The subsequent rights of individuals and communities flow from God's covenantal promises, which function as irrevocable entitlements. This presents a sharp contrast to the liberal tradition, in which rights flow above all from individuals. It also challenges the conservative idea that duties can take precedence over rights, since Novak argues that there are no covenantal duties that are not backed by correlative rights. Novak explains carefully and clearly how this theory of covenantal rights fits into Jewish tradition and applies to the relationships among God, the covenanted community, and individuals. Such criticisms are founded in misunderstandings of the ways in which rights operate and may be met by an adequate theory of rights. (...) Nonetheless, our understanding of moral rights must be revised in order to realize this potential. The usual attribution of moral rights is structurally arbitrary because obligations arising from others’ rights are unjustifiably distinguished from other sorts of obligations for which the same sorts of justificatory bases obtain. Once this arbitrariness is recognized, there remains little reason not to extend a continuous framework of entitlement toward nonhuman animals and nature more generally. Reassessing moral rights according to a basic principle of respect delivers an integrated account of our moral obligations toward one another, and a satisfactory basis from which to account for our diverse obligations toward nonhuman animals and the environment. Naturally we have endeavored to give her a suitable tribute in this issue, which we hope you will appreciate.In addition to these achievements, Vicky developed and practiced a pedagogy that consistently complemented her philosophical perspective, and in the issue's opening piece, Cecilia Herles reflects personally on the enduring legacy and influence of Vicky Davion's teaching work, and the rich heritage that has flowed out of it for her students, encouraging egalitarian dialogue, interdisciplinarity, and a practicality that extended beyond the University and into the wider community. It is surely appropriate to begin our special issue with such an appreciation of the ways that Vicky touched and lifted up so many lives.These reflections are built upon in Chaone Mallory's essay, which takes Davion's key essay "Is Ecofeminism Feminist?" as its touchstone, examining that essay's vital influence on scholarship and activism as well as its key role in defining contemporary ecofeminism itself. Drawing upon Davion's arguments, Mallory tracks a series of vital questions for the development of the field. She demonstrates how Davion's early critical insights have helped sort the wheat from the chaff in dealing with concerns such as spirituality, irrationality, essentialism, and sexism within environmentalism, concerns that made ecofeminism questionable in some feminists' eyes, and she concludes with a positive exposition as to why "all feminisms, whether named this or not, should in some sense, be eco."From here we move to Ronnie Hawkins' extensive and detailed application of Davion's work to the neurobiological, cultural, and axiological roots of our contemporary ecological situation, in which Hawkins invokes [End Page 1] and applies the insights of Davion's 2002 essay "Anthropocentrism, Artificial Intelligence, and Moral Network Theory: An Ecofeminist Perspective." Drawing upon Davion's inventive use of Val Plumwood's account of dualisms, Hawkins stresses Davion's pioneering work in avoiding the reason/nature dualistic fracture, and uses this work to critique the predominant current discourses of AI and neuroscience, in the process further expounding Davion's critiques of anthropocentrism and logocentrism. Cashing out the wider implications of Davion's perspective for our models of the mind, Hawkins connects these to Iain McGilchrist's recent work on the neuropsychology of perception and morality, arguing that this new account of the interaction of the two cerebral hemispheres and their role in generating an orientation to the world for cognition and valuing is consistent with Davion's insights, and can both help explain the environmental failings of modern Western culture and give support for non-instrumentalizing and nonanthropocentric alternatives.Finally, Trish Glazebrook and Emmanuela Opoku offer an extended ecofeminist examination of the roles, significance, dangers, and current status of environmental protectors in contemporary global environmental politics. In a paper dedicated to Davion that addresses many of her concerns with the interlocking character of forms of oppression, they systematically investigate and elucidate the importance of environmental protectors, the struggles that they engage in, the increasing threats of violence that they face, and their significance in the fight against climate change, ultimately arguing that the UN should extend explicit protection to land and environmental defenders under its human rights umbrella.We think these contributions are a fitting tribute to our founding editor, and offer you this special issue with the wish that her legacy will endure. I argue that Schopenhauer’s ascription of (moral) rights to animals flows naturally from his distinctive analysis of the concept of a right. In contrast to those who regard rights as fundamental and then cast wrongdoing as a matter of violating rights, he takes wrong (Unrecht) to be the more fundamental notion and defines the concept of a right (Recht) in its terms. He then offers an account of wrongdoing which makes it plausible to suppose that at least (...) many animals can be wronged and thus, by extension, have rights. The result, I argue, is a perspective on the nature of moral rights in general, and the idea of animal rights in particular, that constitutes an important and plausible alternative to the more familiar views advanced by philosophers in recent decades. Visual phenomenology is highly elusive. One attempt to operationalize or to measure it is to use ‘cognitive accessibility’ to track its degrees. However, if Ned Block is right about the overflow phenomenon, then this way of operationalizing visual phenomenology is bound to fail. This thesis does not directly challenge Block’s view; rather it motivates a notion of cognitive accessibility different from Block’s one, and argues that given this notion, degrees of visual phenomenology can be tracked by degrees of cognitive accessibility. (...) Block points out that in the psychology literature, ‘cognitive accessibility’ is often regarded as either all or nothing. However, the notion motivated in the thesis captures the important fact that accessibility comes in degrees (consider the visual field from fovea the periphery). Different legitimate notions of accessibility might be adopted for different purposes. The notion of accessibility motivated here is weaker than Block’s ‘identification’ (2007) but is stronger than Tye’s ‘demonstration’ (2007). The moral drawn from the discussion of Block can be applied to the debate between Dretske and Tye on the speckled-hen style examples. Dretske’s view is even stronger than Block’s, but his arguments from various figures he provides do not support his conclusion since he does not have right ideas about fixation and attention. Tye’s picture is more plausible but his notion of accessibility is so weak that he reaches the excessive conclusion that accessibility overflows phenomenology. Three ramifications might be considered in the final part of the thesis. The first is the relation between this debate and the one concerning higher-order/same-order theories of consciousness. The second is about John McDowell’s early proposal about demonstrative concepts in visual experiences. The third is the relation between the interpretation of the Sperling case proposed here and McDowell new view of experiential contents, i.e., his story about how we carve out conceptual contents out of intuitional contents without falling pray to the Myth of the Given. One of the much debated issues around the evolving human genetics is the question of the right to know versus the right not to know. The core question of this theme is whether an individual has the right to know about her own genetic constitution and further, does she also have the right to remain in ignorance. Within liberal traditions it is usually held that people, if they so wish, have the right to all the knowledge available about themselves. This (...) right is based on the value of autonomy or on the right of self‐determination, and it is sometimes partly justified as a countermeasure to the authorities' control over people. I do not wish to deny the right to genetic knowledge (about oneself). I think that its existence is self‐evident. The argument I want to put forth in this paper is that in liberal societies we should acknowledge people’s right to remain in ignorance as well. The only reason for not doing this would be that grave harm to others would follow if people were allowed to make these seemingly self‐regarding decisions. Arguments presented against the right to ignorance are twofold. First there are those arguing against the right to ignorance on the grounds of harm to others, that is, philosophers who do not deny people’s right to ignorance in self‐related matters but wish to state that genetic ignorance causes harm to others, and this is one of the most commonly accepted reason for restricting people’s freedom. The other line of argument flows from the Kantian view that not even merely self‐regarding foolishness (in the eyes of others) should be allowed. (shrink)

The field of left–right (LR) patterning—the study of molecular mechanisms that yield directed morphological asymmetries in otherwise symmetrical organisms—is in disarray. On one hand is the undeniably elegant hypothesis that rotary beating of inclined cilia is the primary symmetry‐breaking step: they create an asymmetric extracellular flow across the embryonic midline. On the other hand lurk many early symmetry‐breaking steps that, even in some vertebrates, precede the onset of ciliary flow. We highlight an intracellular model of LR patterning where (...) gene expression is initiated by physiological asymmetries that arise from subcellular asymmetries (e.g. motor‐protein function along oriented cytoskeletal tracks). A survey of symmetry breaking in eukaryotes ranging from protists to vertebrates suggests that intracellular cytoskeletal elements are ancient and primary LR cues. Evolutionarily, quirky effectors like ciliary motion were likely added later in vertebrates. In some species (like mice), developmentally earlier cues may have been abandoned entirely. Late‐developing asymmetries pose a challenge to the intracellular model, but early mid‐plane determination in many groups increases its plausibility. Multiple experimental tests are possible. Background: Flow states are considered a positive, subjective experience during an optimal balance between skills and task demands. Previously, experimentally induced flow experiences have relied solely on adaptive tasks. Objective: To investigate whether cathodal transcranial direct current stimulation (tDCS) over the left dorsolateral prefrontal cortex (DLPFC) area and anodal tDCS over the right parietal cortex area during video game play will promote an increased experience of flow states. Methods: Two studies had participants play Tetris or first-person shooter (...) (FPS) video games while receiving either real tDCS or sham stimulation. Tetris recruited nineteen untrained players who infrequently played video games while the ten FPS participants played FPS frequently. Flow experience was assessed before and after stimulation. Results: Compared to sham stimulation, real stimulation increased flow experience for both untrained Tetris and trained FPS players. No ceiling effects were noticed between trained and untrained groups. Conclusion: Cathodal and anodal tDCS over the left DLPFC and right parietal areas respectively may encourage flow experiences in complex real-life motor tasks that occur during sports, games and everyday life. ABSTRACTPeople have procedural rights because states are under a duty of political morality to provide them with fair procedures for settling disputes about the application of the laws. This obligation flows from the state's duty to treat each person as a free and equal member of the legal order. Yet adherence to procedural rights can impede accuracy in fact-finding, which in turn can result in poor protection for substantive rights. So the state also has a duty to (...) provide a reasonable degree of accuracy in fact-finding. The legal order should therefore strive to improve the accuracy of fact-finding, within the constraints imposed by procedural rights people have. Nevertheless, the duty to provide reasonably accurate procedures is subordinate to the duty to provide procedural rights because the settlement of disputes among free persons must be conducted in a manner that respects their status as free persons. This is a direct challenge to the notion of library neutrality, especially in the present context of war, revolution, and social change. This book locates library and information workers as participants and interventionists in social conflicts. The strategies for social action worldwide were chosen because of their connection to elements of the Universal Declaration of Human Rights (1948) that relate particularly to core library values, information ethics, and global information justice. This book also encourages readers to pay attention to (...) links between library and information work and the following solidarity rights not currently incorporated into any legally-binding human rights framework. The aim is primarily at librarians, archivists, educators and students. Content consists of essential concepts presented in accessible terms (e.g., critical librarianship, information ethics, global information justice, human rights), along with a practical orientation to action on contemporary issues (e.g., intellectual freedom, intellectual property, preservation, cultural destruction, censorship, public access to government information, commercialization, academic freedom, workplace speech, international relations, anonymity, privacy, confidentiality, human security, national security policies, transborder data flow, and information poverty). The seed system is a major component of traditional management of crop genetic diversity in developing countries. Seed flows are an important part of this system. They have been poorly studied for minor Andean crops, especially those that are propagated vegetatively. We examine the seed exchanges of Oxalis tuberosa Mol., a vegetatively propagated crop capable of sexual reproduction. We studied the seed exchanges of four rural communities in Candelaria district at the international and local levels, emphasizing the spread of new (...) sexually-produced genotypes through these exchanges. Interviews with 44 farmers generated socioeconomic, agronomic, crop diversity and seed exchange information, and data on the potential incorporation of new sexually-produced genotypes in the crop germplasm. We interviewed merchants to evaluate the input and output of genetic diversity in the communities studied. Results showed a positive effect of the farmers’ wealth on the diversity cultivated and on seed exchanges. Most seed exchanges occurred at market, creating a distinction between cash and self-consumption landraces. Cash landraces were intensively exchanged; self-consumption landraces were isolated at the farmer level and prone to genetic drift and complete loss. Merchants exported seeds of cash landraces across Bolivia and into Peru and Argentina. New sexually produced genotypes are less incorporated into cash landraces than in self-consumed landraces. However, new genotypes incorporated into cash landraces are diffused faster and better, being more intensively exchanged. We propose conservation strategies that can be applied to other vegetatively propagated and minor Andean crops. (shrink)

The analysis of data from electronic health records aspires to facilitate healthcare efficiencies and biomedical innovation. There are also ethical, legal and social implications from the handling of sensitive patient information. The paper explores the concerns, expectations and implications of the National Health Service England care.data programme: a national data sharing initiative of linked electronic health records for healthcare and other research purposes. Using Nissenbaum’s contextual integrity of privacy framework through a critical Science and Technology Studies lens, it examines the (...) way technologies and policies are developed to promote sustainability, governance and economic growth as the de facto social values, while reducing privacy to an individualistic preference. The state, acting as a new, central data broker reappropriates public ownership rights and establishes those information flows and transmission principles that facilitate the assetisation of NHS datasets for the knowledge economy. Various actors and processes from other contexts attempt to erode the public healthcare sector and privilege new information recipients. However, such data sharing initiatives in healthcare will be resisted if we continue to focus only on the monetary and scientific values of these datasets and keep ignoring their equally important social and ethical values. Scholars addressing the moral status of corporations are motivated by a pair of conflicting anxieties: If corporations are not moral agents, we will be unable to blame them for their wrongs. But if corporations are moral agents, we will have to recognize corporate moral rights, and the legal rights that flow therefrom. In early and under-appreciated work, Tom Donaldson sought to allay both concerns at once: Corporations, he argued, are not moral persons, and so are not eligible (...) for many of the rights that persons enjoy; but they are moral agents, and so ought to bear responsibility in many of the ways that persons do. This article offers a sympathetic critique of the Donaldsonian strategy. I argue that, as it has been elaborated, the strategy necessarily fails. Nonetheless the strategy embodies a worthy aim and so I seek to provide an alternative way to vindicate it. (shrink)

Addresses the issues at the heart of international medicine and social responsibility. A number of international declarations have proclaimed that health care is a fundamental human right. But if we accept this broad commitment, how should we concretely define the state’s responsibility for the health of its citizens? Although there is growing debate over this issue, there are few books for general readers that provide engaging accounts of critical incidents, practices, and ideas in the field of human rights, health (...) care, and medicine. Included in the book are case studies of such issues as AIDS among orphans in Romania, organ trafficking, prison conditions, health care rationing, medical research in the third world, and South Africa’s constitutionally guaranteed right of access to health care. It uses these topics to address themes of protection of vulnerable populations, equity and fairness in delivering competent medical care, informed consent and the free flow of information, and state responsibility for ensuring physical, mental, and social well-being. For Kant right and ethics are two formally distinct departments of a single morality of reason and freedom. Unlike ethics, right involves an authorization to coerce, and this coercion serves as a pathological incentive. I argue that for Kant the distinctive character of right flows from the fact that juridical obligation has a different relational structure than ethical obligation. I argue that this relational structure explains the connection of right to coercion, and also explains how a categorical imperative can be (...) known a priori to issue in both a pathological and non-pathological incentive. Thus the justification of coercion and its special role as incentive are rooted in the relational character of juridical obligations, and so ultimately in categorical imperatives of reason. Since this pathological incentive has a moral basis in the structure of juridical obligations, and so ultimately in a representation of moral laws, I argue that Kant’s discussion of the juridical incentive of coercion is more continuous with his main discussion of moral incentives in the Critique of Practical Reason than it might at first appear. I illustrate the consequences of this reading by discussing the propensity to injustice, as Kant understands it, and the unique way in which the juridical incentive undermines it. (shrink)

This Reply offers my answers to Cheshire Calhoun’s, Elizabeth Brake’s, and Monika Betzler’s wonderful contributions to the Criminal Law and Philosophy symposium on Being Sure of Each Other (2020). Their contributions focus respectively on the conceptual and normative foundations of my defence of our human rights to have adequate social inclusion, the harms that might flow from recognising such rights as human rights, and the impact such rights can have on our most intimate relations. My (...) replies aim both to clarify and solidify the argumentative basis for my account and to show that whatever harms and wrongs might dog the recognition of social human rights are nothing compared to the injustices that flow–and have long-flowed–from ignoring or attacking these rights.
