Continuing his quest to bring American philosophy back to its roots, Bruce Wilshire connects the work of such thinkers as Thoreau, Emerson, Dewey, and James with Native American beliefs and practices. His search is not for exact parallels, but rather for fundamental affinities between the equally "organismic" thought systems of indigenous peoples and classic American philosophers. Wilshire gives particular emphasis to the affinities between Black Elk’s view of the hoop of the world and Emerson’s notion of horizon, and also (...) between a shaman’s healing practices and James’s ideas of pure experience, willingness to believe, and a pluralistic universe. As these connections come into focus, the book shows how European phenomenology was inspired and influenced by the classic American philosophers, whose own work reveals the inspiration and influence of indigenous thought. Wilshire’s book also reveals how artificial are the walls that separate the sciences and the humanities in academia, and that separate Continental from Anglo-American thought within the single discipline of philosophy. In two recent papers, Christian List and Philip Pettit have argued that there is a problem in the aggregation of reasoned judgements that is akin to the aggregation of the preference problem in social choice theory. 1 Indeed, List and Pettit prove a new general impossibility theorem for the aggregation of judgements, and provide a propositional interpretation of the social choice problem that suggests it is a special case of their impossibility result. 2 Specifically, they show that no judgement aggregation (...) function for a group is possible if the group seeks to satisfy certain `minimal conditions' designed to ensure that the function is both responsive to the individually rational views of its members and collectively rational in the set of judgements it holds. In this article, I resist the List and Pettit claim that there is the same propensity for collective irrationality or incoherence in the aggregation of reasoned judgements as there is in the aggregation of preference. I argue that reason, because it has a logical structure that is lacking in mere preference, has the effect of giving priority to some aggregations over others, a priority that is not permitted by one of the conditions imposed by List and Pettit. This avoids the incoherence that would otherwise exist if these different aggregations, not consistent with one another, were to compete at the same level of priority. The priority of some aggregations is particularly apparent, I shall argue, if one views the aggregation of judgements through the lens of common law decision-making. Philosophers writing on the subject of human action have found it tempting to introduce their subject by raising Wittgenstein's question, 'What is left over if you subtract the fact that my arm goes up from the fact that I raise my arm?' The presumption is that something of particular interest is involved in an action of raising an arm that is not present in a mere bodily movement, and the philosopher's task is to specify just what this is. Unfortunately, such (...) an approach does not take us very far, since a person could properly be said to raise his (or her) arm while asleep or hypnotized even though he (or she) would not be performing an action in the sense of 'action' with which philosophers are particularly concerned. To avoid this kind of difficulty I shall approach the subject of human action is a more academic way: I shall expound some important rival theories of human action, and introduce the relevant issues by commenting critically on those theories. One of the issues I eventually introduce is a metaphysical one. A theory of action makes sense, I contend, only on the assumption that there are such 'things' as actions (or events). After considering some key arguments bearing on the issue I conclude that, as matters currently stand in philosophy, a metaphysically noncommittal attitude toward actions and events seems justified. Legal decision-making emphasizes, in a very self-conscious way, the justificatory significance of reasons. This paper argues that the obligation to provide reasons for choices, which must be articulated and structured around a set of generally shared and publicly comprehensible categories of thought, can serve to make the space of possible choices ‘concept sensitive’ in a very useful way. In particular, concept sensitivity has the effect of restricting certain movements within the choice space so that some of the systematic difficulties in (...) achieving an equilibrium in social choice which arise out of an excess of rational doing are avoided. The resulting equilibrium is path dependent. But because it is dependent on a choice path which ‘makes sense’ (or is ordered by thought precisely because it is concept sensitive), it is not the sort of arbitary path-dependent social choice which originally concerned Kenneth Arrow. This paper illustrates these points with examples from criminal law procedure, contract law and constitutional law. (shrink)

Arguments that claim opponents of abortion are inconsistent in some manner are becoming increasingly prevalent both in academic and public discourse. For example, it is common to claim that they spend considerable time and resources to oppose induced abortion, but show little concern regarding the far greater numbers of naturally occurring intrauterine deaths (miscarriages). Critics argue that if abortion opponents took their beliefs about the value of embryos and fetuses seriously, they would invest more time and resources combating these naturally (...) occurring deaths than those caused by induced abortion. The implication is that abortion opponents do not take their beliefs about embryos and fetuses seriously—and so why should anyone else? These “inconsistency arguments”, as we have called them, have considerable intuitive appeal: showing that someone is living inconsistently or holding beliefs that seem prima facie inconsistent seems to many to undermine those beliefs. However, upon closer examination, these arguments become less convincing. In short, we show that the inconsistency arguments we are aware of are severely flawed, and so, if critics wish to continue their criticism, they should abandon inconsistency arguments in favor of other styles of argument. We will proceed in four stages. First, we describe the basic form of inconsistency arguments against abortion opponents. Second, we outline specific instances of the inconsistency argument that have been advanced. Third, we outline specific responses to these arguments, noting ways in which responses also conform to set patterns. Finally, we assess the debate and suggest how it might progress in productive ways. (shrink)

I begin by distinguishing four different versions of the argument from evil that start from four different moral premises that in various ways link the existence of God to the absence of suffering. The version of the argument from evil that I defend starts from the premise that if God exists, he would not allow excessive, unnecessary suffering. The argument continues by denying the consequent of this conditional to conclude that God does not exist. I defend the argument against Skeptical (...) Theists who say we are in no position to judge that there is excessive, unnecessary suffering by arguing that this defense has absurd consequences. It allows Young Earthers to construct a parallel argument that concludes that we are in no position to judge that God did not create the earth recently. In the last section I consider whether theists can turn the argument from evil on its head by arguing that God exists. I first criticize Alvin Plantinga’s theory of warrant that one might try to use to argue for God’s existence. I then criticize Richard Swinburne’s Bayesian argument to the same conclusion. I conclude that my version of the argument from evil is a strong argument against the existence of God and that several important responses to it do not defeat it. (shrink)

In this paper I consider several versions of the argument from evil against the existence of a God who is omniscient, omnipotent and wholly good and raise some objections to them. Then I offer my own version of the argument from evil that says that if God exists, nothing happens that he should have prevented from happening and that he should have prevented the brutal rape and murder of a certain little girl if he exists. Since it was not prevented, (...) God does not exist. My conclusion rests on the claim that no outweighing good was served by allowing that murder, or any other instance of comparable evil, to occur. I take up the objection that my argument moves illicitly from apparently pointless suffering to the claim that there is reason to believe that there is pointless suffering. I offer an example to show that the existence of apparently pointless suffering counts to some extent against the existence of God and to show that no basic belief that God exists that rests on certain sorts of grounds can remain justified in the face of apparently pointless suffering. In this paper I argue that, according to a particular physicalist conception of information, information is both alethically neutral or non-alethic, and is intrinsically semantic. The conception of information presented is physicalist and reductionist, and is contrary to most current pluralist and non-reductionist philosophical opinion about the nature of information. The ontology assumed for this conception of information is based upon physicalist non-eliminative ontic structural realism. However, the argument of primary interest is that information so construed is intrinsically semantic on (...) a reductionist and non-alethic basis where semantic content is constituted by indication along causal pathways. Similar arguments have been presented by philosophers with respect to representation. I suggest the conception of information that I present is correct by the lights of the best applied mathematical and scientific theories of information. If so, there is no need for any separate theory of semantic information. Thus I present a theory of intrinsically semantic information which also constitutes an informational theory of truth where truth reduces to information. In the last section I discuss weakly and strongly semantic information, and reject them in favour of alethically neutral intrinsically semantic information. (shrink)

In this paper it is argued, firstly, that Kuhnian revolutions in mathematics are logically possible, in the sense of not being inconsistent with the nature of mathematics; and, secondly, that Kuhnian revolutions are actually possible, in the sense that a Kuhnian paradigm for mathematics can be exhibited which would, if accepted by the mathematical community, produce a full Kuhnian revolution. These two arguments depend on first proving that a shift from a classical conception of mathematics to an intuitionist conception would (...) be incommensurable, that is, that some classical statements, possessing meanings which cannot be preserved in the intuitionist language, would become unintelligible. The vague but intriguing thesis is then tentatively advanced that Kuhnian revolutions are even historically possible, in the sense that only what we might call ‘accidental’ historical factors may have prevented mathematics from undergoing just such a Kuhnian revolution in the early years of the twentieth century. Summary During the past decade, the cultural restorationist wing of the New Right has sought to impose its own anachronistic and sentimental conception of ?British culture? on schools and colleges. This conception, which is little more than a glib celebration of quintessential ?Englishness?, characterises the national culture in largely monolithic and ethnically undifferen?tiated terms. Concerned about the possible pernicious effects of educational policies inspired by such thinking, we present the findings of a recently completed ethnographic study of 8?11 year?olds? conceptions (...) of British national culture. Our paper considers the extent to which children's understanding of this complex form of collective identity may vary with age, and ethnicity. We conclude by exploring the implications of the findings for anti?racist and multicultural education. (shrink)
