By returning on the legal, political and pragmatic foundations of this empire which cannot be called Empire (because this name belongs to the Holy Roman Empire of the cousins of Vienna), the article tries to seize better the internal functioning of this heterogeneous political set, by adopting two points of view: that of America (how the notion of Catholic Monarchy is understood in the reynos, (...) far from Madrid and Lisbon) and that of Rome (how Holy See reaches - or not - to exist in the heart of this space). The theory of beauty has always rested on the representation of the infinite, understood in its finite expression and perceptible through the senses. The relationship of beauty to truth, of art to science, is inevitably modified with the new way of treating the infinite in the modern conception of the world. Non-classical science works with the notions of “infinitely large” and “infinitely small,” modifying their meanings in terms of experimental observations. We put these words in quotation marks because the Whole (...) may be considered as finite or infinite according to the angle from which it is viewed: the “infinitely small” only becomes so in determined circumstances, for example, when we consider the extended and discrete elements of space and time in a macroscopic approximation, as infinitely small elements of perpetual motion. Modern science studies these two poles of being—the Whole and its parts—in their interaction, admitting the dependence of macroscopic and even cosmic processes with regard to the processes being created in infinitely small spheres (or, according to another interpretation, finite but extremely small). However, as characteristic of our time as these concepts are—most often hypothetical—they nonetheless express a very old historical tradition that contemporary retrospection, turned toward classical science and the past of science in general, allows us to discern very clearly. All the culture of the past was dominated by the principle of the authority of the Whole over its parts. In peripatetic cosmology and physics, individual processes depended on the cosmic harmony of the center and frontiers of the universe, on the spheres and places toward which bodies tend. This authority of the general law, of universal harmony, of the system hinging on individual processes, is confirmed in Aristotle's Physics, but not only there: we find it in almost all the thinkers of antiquity. On the plane of general logic, it received expression in the Hegelian concept of the true infinite, a concept constituting to a high degree the philosophical equivalent of classical science. In Hegel's time, this last was already drawing away somewhat from the idea of an absolute and strict subordination of elementary processes to integrating systems and general laws, laws being realized through the probability of microprocesses, thus statistical laws, and whose exact application ignored individual acts, for example, the mechanism of molecules in thermodynamics. The statistical theory of heat has rendered continual a discrete microcosm—for the movement of individual molecules it substituted the average speed of the molecules—and continual laws became supreme points determining macroscopic processes. These laws had a differential nature. In other words, they prescribed the defined relationships between the infinitely small increases in size. Also, the schema of the classic law consisted in defining infinitely small processes by an infinitely large integral legality because of the number of processes. The infinitely true of Hegel is the actual infinite being realized in each of its finite elements; it is the subjection of the finite element to the infinite. (shrink)

I propose a general alethic theory of epistemic risk according to which the riskiness of an agent’s credence function encodes her relative sensitivity to different types of graded error. After motivating and mathematically developing this approach, I show that the epistemic risk function is a scaled reflection of expected inaccuracy. This duality between risk and information enables us to explore the relationship between attitudes to epistemic risk, the choice of scoring rules in epistemic utility theory, and the selection of priors (...) in Bayesian epistemology more generally. Approximate coherentism suggests that imperfectly rational agents should hold approximately coherent credences. This norm is intended as a generalization of ordinary coherence. I argue that it may be unable to play this role by considering its application under learning experiences. While it is unclear how imperfect agents should revise their beliefs, I suggest a plausible route is through Bayesian updating. However, Bayesian updating can take an incoherent agent from relatively more coherent credences to relatively less coherent credences, depending on the (...) data observed. Thus, comparative rationality judgments among incoherent agents are unduly sensitive to luck. (shrink)

In this handbook, I put into practice my philosophical views on children's mathematics. The handbook contains brief instructions and examples of mathematical activities. In the INSTRUCTIONS section, instructions are given on how, and in part why that way, to help preschool children in their mathematical development. In the ACTIVITIES section, there are examples of activities through which the child develops her mathematical abilities.

In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people from (...) different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

Starting from the idea that functions are formally similar to actions in that they are described and explained in a similar way, so that both admit of an accordion effect, I turn to Anscombe’s insight that the point of practical reasoning is to render explicit the relation between the different descriptions of an action generated by the accordion effect. The upshot is, roughly, that an item has a function if what it does can be accounted for by functional reasoning. This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. This study investigates the use of specific educative features for supporting the teaching of nature of science during read-alouds of elementary science trade books. Educative features are components of educative curriculum materials that aim to increase teachers’ content knowledge and support effective instructional practices. Understanding how teachers use specific educative features is important for the future design of curriculum materials that can be used to improve teachers’ views of NOS in tandem with changing their teaching practices. Qualitative data from teacher (...) interviews and observations of read-alouds were used to determine which educative features teachers used and how effective they were perceived as being. Results indicate that teachers varied in their use of educative features and tended to focus on the ones that addressed specific teaching moves as opposed to those that supported understanding why the curriculum was developed as it was. Based on these findings, recommendations for future research that highlights the importance of all educative features are provided. (shrink)

While there are satisfactory answers to the question “How should we teach children mathematics?”, there are no satisfactory answers to the question “What mathematics should we teach children?”. This paper provides an answer to the last question for preschool children (early childhood), although the answer is also applicable to older children. This answer, together with an appropriate methodology on how to teach mathematics, gives a clear conception of the place of mathematics in the children’s world and our role in helping (...) children develop their mathematical abilities. Briefly, children’s mathematics consists of the world of children’s internal activities that they eventually purposefully organize in order to understand and control the outside world and organize their overall activities in it. We need to support a child in mathematical activities that she does spontaneously and in which she shows interest, and we need to teach her mathematics that she is interested in developing through these activities. In doing so, we must be fully aware that the child’s mathematics is part of the child’s world of internal activities and is not outside of it. We help the child develop mathematical abilities by developing them in the context of her world and not outside of it. From the point of view of this conception, the standards established today are limiting and too focused on numbers and geometric figures: these topics are too prominent and elaborated, and other mathematical contents are subordinated to them. Adhering to the standards, we drastically limit the mathematics of the child’s world, hamper the correct mathematical development of a child, and we can turn her away from mathematics. (shrink)

What about honesty? -- History of honesty in society -- Honesty and the Constitution -- Honesty in society today.

In this paper, we reflect on the connection between the notions of organism and organisation, with a specific interest in how this bears upon the issue of the reality of the organism. We do this by presenting the case of Buffon, who developed complex views about the relation between the notions of “organised” and “organic” matter. We argue that, contrary to what some interpreters have suggested, these notions are not orthogonal in his thought. Also, we argue that Buffon has a (...) view in which organisation is not just ubiquitous, but basic and fundamental in nature, and hence also fully natural. We suggest that he can hold this view because of his anti-mathematicism. Buffon’s case is interesting, in our view, because he can regard organisation, and organisms, as perfectly natural, and can admit their reality without invoking problematic supernaturalist views, and because he allows organisation and the organismal to come in kinds and degrees. Thus, his view tries to do justice to two cautionary notes for the debate on the reality of the organism: the need for a commitment to a broadly naturalist perspective, and the need to acknowledge the interesting features of organisms through which we make sense of them. Drawing from cognitive learning theories we hypothesize that exposure to nationalistic appeals that suggest consumers should shun foreign brands for moral reasons increases the general belief in consumers that buying foreign brands is morally wrong. In parallel, drawing from the theory of psychological reactance we posit that such appeals may, against their communication goal, increase the reputation of foreign luxury brands. We term the juxtaposition of these apparently contradictory effects the “Ambivalence Hypothesis.” Further, drawing from prior research on source-similarity effects (...) we posit that foreign luxury brands that communicate cultural proximity to target consumers (i.e., a local brand positioning) reinforce psychological reactance (“Clean Conscience Hypothesis”). We test these hypotheses experimentally in the context of luxury car brand advertising in China, a market that is heavily dominated by foreign brands, and therefore provides a breeding ground for ambivalent consumer reactions. Results show that exposure to nationalistic appeals enhances consumers’ national identity dispositions (patriotism, local identity), which results in higher levels of consumer ethnocentrism. Further, nationalistic appeals enhance the social responsibility associations that consumers hold for foreign luxury brands and their countries of origin, which results in a higher brand reputation. Finally, effects of nationalistic appeals on foreign luxury brand reputation are positively stronger for brands using a local vs. a foreign or a global positioning. These findings suggest that nationalistic appeals are a double-edged sword with important implications for ethics in political communication and luxury brand marketing. (shrink)

In this paper, I argue that Kant adopted, throughout his career, a position that is much more akin to classical accounts of epigenesis, although he does reject the more radical forms of epigenesis proposed in his own time, and does make use of preformationist sounding terms. I argue that this is because Kant thinks of what is pre-formed as a species, not an individual or a part of an individual; has no qualm with the idea of a specific, teleological principle (...) or force underlying generation, and conceives of germs and predispositions as specific constraints on such a principle or force. Neither of these conceptions of what is “preformed”, I argue, is in strict opposition to classical epigenesis. I further suggest that Kant’s lingering use of preformationist terminology is due to his belief that this is required to account for the specificity of the specific generative force; his resistance towards the unrestricted plasticity of the generative force in radical epigenesis, which violates species-fixism; and his insistence on the internal, organic basis of developmental plasticity and variation within species. I conclude by suggesting that this terminological and interpretative peculiarity is partly due to a larger shift in the natural philosophical concerns surrounding the debate on epigenesis and preformation. Specifically, it is a sign that the original reasons for resisting epigenesis, namely its use of specific, teleological principles and its commitment to the natural production of biological structure, became less of a concern, whereas unrestricted plasticity and its undermining of fixism became a real issue, thereby also becoming the focal point of the debate. Analysing several characteristic mathematical models: natural and real numbers, Euclidean geometry, group theory, and set theory, I argue that a mathematical model in its final form is a junction of a set of axioms and an internal partial interpretation of the corresponding language. It follows from the analysis that (i) mathematical objects do not exist in the external world: they are our internally imagined objects, some of which, at least approximately, we can realize or represent; (ii) mathematical truths are not (...) truths about the external world but specifications (formulations) of mathematical conceptions; (iii) mathematics is first and foremost our imagined tool by which, with certain assumptions about its applicability, we explore nature and synthesize our rational cognition of it. This paper analyzes the historical context and systematic importance of Kant's hypothetical use of reason. It does so by investigating the role of hypotheses in Kant's philosophy of science. We first situate Kant’s account of hypotheses in the context of eighteenth-century German philosophy of science, focusing on the works of Wolff, Meier, and Crusius. We contrast different conceptions of hypotheses of these authors and elucidate the different theories of probability informing them. We then adopt a more systematic perspective to discuss (...) Kant's idea that scientific hypotheses must articulate real possibilities. We argue that Kant's views on the intelligibility of scientific hypotheses constitute a valuable perspective on scientific understanding and the constraints it imposes on scientific rationality. This paper discusses a novel problem at the intersection of ethics and epistemology: there can be cases in which moral considerations seem to "encroach'' upon belief from multiple directions at once, and possibly to varying degrees, thereby leaving their overall effect on belief unclear. We introduce these cases -- cases of moral encroachment under moral uncertainty -- and show that they pose a problem for all predominant accounts of moral encroachment. We then address the problem, by developing a modular Bayesian (...) framework that, we argue, is sufficiently flexible and scaleable to accommodate the multifaceted uncertainty we describe while still generating clear recommendations for an agent's beliefs. Our framework has several practical upshots, and we close by articulating them: we derive insights about the relationship between moral character and doxastic behavior and make suggestions for how to encourage people to revise their doxastic states in morally laudable ways, without deviating from core Bayesian norms. Transformation of the Constitutional System of the Slovak Republic Purpose of the article is to analyze the Constitutional Act No. 356/2011 Z. Coll. amending the Constitution of the Slovak Republic in terms of its compatibility of the constitutional system of the Slovak Republic. The article analyzes the potential impact of amendment to the Constitution of the Slovak Republic on the Parliamentary form of the government of the Slovak Republic and examine the consistency of Art. 115 Para 3 of the Constitution (...) of the Slovak Republic with another provisions that relate to it. The purpose of the article is to identify some problems that brought amendment to the Constitution of the Slovak Republic by the Constitutional Act No. 356/2011 Coll. of Art. 115 Para 3 and points out its incompatibility with the constitutional text. This article also discusses a possible shift in the parliamentary constitutional system of the Slovak Republic which the Constitutional Act brought.Methodology/methods used in the article is the analysis of the Constitutional Act No. 356/2011coll. by induction from the concrete wording of Art. 115 Para 3 of the Constitution of the Slovak Republic to the conclusions in relation to the entire text of the Constitution of the Slovak Republic and to the whole constitutional system of the Slovak Republic Scientific aim is to point to the shortcomings of the Constitutional Act No. 356/2011 Z. Coll., not only from the perspective of constitutional interpretation, but potentially also in terms of practice and also show the wrong trend of breaking the internal unity and coherence of the constitutional system of the Slovak Republic by half-baked changes to the text of the Constitution of the Slovak Republic Findings are specific and severe systemic disorders that brought the amendment to the Constitution of the Slovak Republic by the Constitutional Act No. 356/2011 Coll. of Art. 115 Para 3. The Article identifies three concrete problems and the subsequent practice may bring some other issues that were not known at the time of processing of this Article Conclusions are directed to the fact, that the Constitutional Act No. 356/2011 Coll. means internal disturbance of the constitutional system of the Slovak Republic, brings more problems than constructive solutions and potentially deflects the parliamentary constitutional system of the Slovak Republic to the semi-presidential. In this autoethnographic essay, I reflect on my brief personal experiences of conducting field research on ways in which way a small group of Tibetan Buddhist monks enact a monastic total institution in Ladakh, India. More specifically, I analyze my experiences in view of the relationship between dual and nondual mind, as discussed by Henry Vyner (2002) in Anthropology of Consciousness, and use this analysis to develop preliminary insights into the ways in which a Tibetan Buddhist monastery is constituted.

Madonna Towers, Inc., the U.S. Court of Appeals for the Eighth Circuit held that the failure of a skilled nursing facility's executives to seek a legal opinion regarding a billing practice they considered valid did not meet the definition of knowingly presenting a false claim for payment to the federal government under the False Claims Act. Alleging that the facility that provided care to his aunt fraudulently submitted claims to Medicare for services provided (...) free of charge, the appellant brought this case qui tam on behalf of the federal government under the FCA.The FCA was passed by the legislature in an effort to punish and deter fraud against the federal government. The concept of inertial frame of reference in classical physics and special theory of relativity is analysed. It has been shown that this fundamental concept of physics is not clear enough. A definition of inertial frame of reference is proposed which expresses its key inherent property. The definition is operational and powerful. Many other properties of inertial frames follow from the definition, or it makes them plausible. In particular, the definition shows why physical laws obey space and time symmetries and (...) the principle of relativity, it resolves the problem of clock synchronization and the role of light in it, as well as the problem of the geometry of inertial frames.
