A common assumption in the selection of nonhuman animal subjects for research and the approval of research is that, if the risks of a procedure are too great for humans, and if there is a so-called scientific necessity, then it is permissible to use nonhuman animal subjects. I reject the common assumption as neglecting the central ethical issue of the permissibility of using nonhuman animal subjects and as being inconsistent with the principle of justice used in human subjects research (...) ethics. This principle requires that certain classes of individuals not be subjected to a disproportionate share of the burdens or risks of research. I argue for an extension of this principle to nonhuman animal research and show that a prima facie violation of the principle occurs because nonhuman animals bear an overwhelmingly disproportionate share of the risks of research without sufficient justification or reciprocal benefit. It is argued that two different types of concept are often intermingled in discussions of Aktionsart. The most common type of classification is one of situation types, relating to the potential actualisation of a situation, although some of the definitions have to do with the actual realization of the situation. This distinction, adequately captured by the notions (a)telicity and (un)boundedness (Declerck 1989), is explored and it is shown how NPs, PPs and tense influence a sentence''s classification as (un)bounded.

An identification is made of the core metaphilosophical, philosophical, and intellectual history theses in Richard Rorty's pragmatism. Their rationale is displayed and it is argued that his metaphilosophical theses are very much dependent on certain of his non‐metaphilosophical philosophical theses, most centrally his anti‐representationalism. Questions emerge about the status and justification of these theses. Rorty, in his programmatic pronouncements, resists providing a vindication of them. Seeking to avoid what has been called performative contradictions, he regards it as sufficient to provide (...) the best narrative going of what is to be said here. It is argued that a more straightforward defence can be provided that does not depart from his holism or his historicism with its setting aside of claims of necessity. (shrink)

In his _Being Known_ Peacocke sets himself the task of answering how we come to know about metaphysical necessities. He proposes a semantic principle-based conception consisting of, first, his Principles of Possibility which pro­vide necessary and sufficient conditions for a new concept 'admissibility', and second, characterizations of possibility and of necessity in terms of that new con­cept. I focus on one structural feature; viz. the recursive application involved in the specification of 'admissibility'. After sketching Peacocke’s proposal, I intro­duce a (...) fictional protagonist, Cautious Peacocke, whose coherence I claim shows that Peacocke s proposal cannot be made good. I conclude with the conjecture that similar failure will attend any such semantic-based attempts to ground the epistemology of metaphysical necessity. -/- Dans son livre intitulé Being Known, C. Locke and Leibniz are often classified as proponents of compatibilist theories of human freedom, since both maintain that freedom is consistent with determinism and that the difference between being and not being free turns on how one is determined. However, we will argue in this paper that their versions of compatibilism are essentially different and that they have significantly distinct commitments to compatibilism. To this end, we will first analyze the definitions and examples for freedom and necessity that Locke (...) and Leibniz present in sections 8-13 of chapter 21 of the Essay on Human Understanding and the Nouveaux essais respectively, and then conjecture how Locke and Leibniz would have continued the discussion, if they had had the opportunity to engage in an exchange of opinions. In this way, we believe, one will be in a position to understand why Leibniz thinks that Locke’s discussion of freedom “est un des plus prolixes et des plus subtils de son ouvrage.”. (shrink)

Interventions are medically necessary when they are vital in achieving the goal of medicine. However, with varying perspectives comes varying views on what interventions are (un)necessary and, thus, what potential treatment options are available for those suffering from the myriad of conditions, pathologies and disorders afflicting humanity. Medical necessity's teleological nature is perhaps best illustrated in cases where there is debate over using contentious medical interventions as a last resort. For example, whether it is appropriate for those suffering from (...) body integrity dysphoria to receive healthy limb amputations. This paper explores how one's perception of medicine's goal underpins whether interventions are necessary or unnecessary, using the controversial topic of therapeutic amputation as an example. By contrasting ‘classical’ amputations with their more contentious counterparts, it highlights how the idea of medical necessity influences and restrains clinical decision-making. The paper starts by giving an account of body integrity dysphoria, focusing on the debate concerning elective amputation's justifiability. It then introduces Georges Canguilhem's vitalist theory of health, paying particular attention to his emphasis on adaptability. Then, this paper uses his theory as a lens through which to evaluate the appropriateness of therapeutic amputation as a medically necessary procedure. Ultimately, the paper highlights how the label of medical necessity is withheld from potential therapeutic interventions because they fail to conform to pre-established ideas of medicine's purpose and that by doing so, potential harm befalls those who are left with no effective treatments and must look for solutions in the non-clinical world. This article addresses the issue of the legacy of Gramsci in current debates within critical theory on questions of social transformation, political struggle and social movements. A survey of the current state of the literature reveals the existence of a number of strikingly opposed interpretations and “translations” of Gramsci. On the one hand, scholars and intellectuals in phase with the “anarchist moment” characteristic of recent upsurges and struggles tend to regard Gramsci as an old-fashioned and totalitarian Marxist, due to his (...) insistence on the necessity of building a new hegemony. On the other hand, certain radical theorists focus on the possibility of using Gramsci’s theories as a tool for devising new forms of popular resistance and subaltern politics. The article argues that both positions rely on a partial understanding of Gramsci’s dialectical categories, hegemony/subaltern, political society/ civil society. More recently, the possibility of a resolution of these contradictions has become apparent thanks to the emergence of Gramscian approaches to contemporary political struggles which insist on the necessity of conceptualising a new political and cultural subject, a contemporary “modern prince”, capable of producing a new collective will. Depuis quelques années, nos sociétés de plus en plus marquées par les services et les contraintes des sciences et des techniques, voient se tendre les relations entre politiques et savants. Du coup, se trouve posée en termes nouveaux la question assez traditionnelle des rapports entre vérité et autorité. De façon plus urgente, c'est la question de la vérité qui doit être traitée dans la mouvance d'un triple héritage de conceptions : la conception de la vérité comme réalisme; la conception positiviste (...) en réaction au kantisme, et depuis le début des années 60, une conception qui doit redéfinir et repenser le réalisme. L'exploration historique et conceptuelle permet à la fois une critique des pratiques et des illusions de ces trois derniers siècles, et des questions nouvelles quant à l'avenir de la raison tant du côté des sciences que du côté du pouvoir. Car c'est de la commu­nauté humaine et de l'homme qu'il s'agit avant tout, ce qui interdit de faire définitivement l'impasse sur des problèmes qui sont avant tout la responsabilité d '« hommes finis », ce qui induit la nécessité de choisir une éthique et d'adopter une ontologie.For some years our societies, more and more marked by the services and restraints of the sciences and technology, find relations between politicians and scholars strained. As a result, the rather traditional ques­tion of the relationship between truth and authority has been put in new terms. In a more urgent way, it is the question of truth that should be treated in the sphere of a triple inheritance of ideas : the conception of truth as realism, the positivist conception in reaction to Kantianism, and, from the begiming of the 60's, a conception that would redefine and rethink realism. A historical and conceptual exploration allows both a critique of the practices and illusions of these last three centuries, and new questions as regards the future, both on the side of the sciences and on the side of power. For, above all, the concern is with the human community and man, and thus prohibits a definitive impasse concerning these problems, which are, above all, the responsibility of « finite men ». This leads to the necessity of choosing an ethic and of adopting an ontology. (shrink)

Some philosophers think that anti-realism about de re necessity entails anti-realism about the individuation and identity of objects. In this paper I address one argument for this view, due to Sidelle, according to which the only way in which a de re modal conventionalist can avoid being refuted by a well-known argument based on the contingency of conventions is by also accepting conventionalism about objects. I show that Sidelle’s argument is not successful and, in this way, I also show (...) that the combination of de re modal anti-realism and realism about objects is at least not threatened from this direction. Generally speaking, the dominant liberal paradigm defines individual agency in a purely rationalistic manner. Against this tradition, the present study argues for the necessity of rethinking and redefining this rationalistic concept of autonomy in light of psychological and philosophical developments that have complicated our understanding of subjectivity. For this purpose, the concept of relational autonomy, developed by feminist authors and some theorists of recognition, is most promising. This article aims to show that a relational understanding of autonomy is necessary to explain motivations for social cooperation and to understand justice and injustice in a way that corresponds to lived social experience. RésuméJ'examine dans cet article une notion assez spéciale de nécessité, celle de la nécessité matérielle, introduite explicitement pour la première fois par Adolf Reinach. Je soutiens que la variation libre joue un rôle important dans la découverte et la description de la nécessité matérielle et j'explore également quelques questions apparentées ayant trait à la présentation et à la signification, à la théorie des actes de discours, ainsi qu'à la qualité et à la matière de la présentation.

Dans le Contrat Social , Rousseau semble fonder la légitimité politique sur deux institutions : le Souverain, siège de la puissance législative et le Gouvernement, lieu de la puissance exécutive. Pourtant, dans le livre IV du même ouvrage, il définit la nécessité d'une troisième institution : le Tribunat, situé en tiers entre le Souverain et le Gouvernement. Pour quelle raison Rousseau détermine-t-il la nécessité de ce troisième pouvoir pour fonder la légitimité démocratique ? La raison provient de la dynamique initiée (...) par le Gouvernement qui, tout en étant une institution légitime et nécessaire, tend à s'approprier le pouvoir législatif. Rousseau développe une pensée politique qui prend conscience de la fragilité de la légitimité démocratique, fragilité qui peut se définir par sa tendance à créer, au travers de ses institutions, des volontés indépendantes des citoyens qui défendent des intérêts particuliers en prenant le masque de la volonté générale. Face à ce problème, Rousseau caractérise trois moyens politiques, afin de donner une consistance à la légitimité démocratique : le « Tribunat », « le Droit de Représentation » et enfin la circulation du pouvoir.In the Contrat Social , Rousseau seems to base political legitimacy on two institutions, the sovereign power, seat of legislative power and the government, place of executive power. Nevertheless, in the fourth book of the same work, he defines the necessity of a third political institution, the “Tribunat”, situated entirely between the sovereign power and the government. For what reason does Rousseau determine the necessity of this third power as the base of democratic legitimacy? The reason is the result of the dynamics initiated by the government who, while at the same time being a legitimate and necessary power, tend to take over the legislative power. Rousseau develops a political thinking which realises the fragility of democratic legitimacy, fragility which can be described by its tendency to create, through these institutions, citizen own independent wishes who are defending particular interests in taking the façade of the general will. Facing this problem, Rousseau characterises three political measures in order to give substance to the democratic legitimacy: the “Tribunat”, the “Droit de Représentation”, and finally the circulation of the power. This study provides evidence that personality traits associated with responsiveness to conscious reward cues also influence responsiveness to unconscious reward cues. Participants with low and high levels of Novelty Seeking performed updating tasks in which they could either gain 1 euro or 5 cents. Gains were presented either supraliminally or subliminally at the beginning of each trial. Results showed that low NS participants performed better in the high-reward than in the low-reward condition, whereas high NS participants’ performance did not differ (...) between reward conditions. Interestingly, we found that low NS participants performed significantly better when rewards were presented unconsciously, whereas high NS participants’ performance did not differ whether reward cues were presented subliminally or supraliminally. Our findings highlight the necessity of taking personality into account in unconscious cognition research. They also suggest that individual differences might determine whether implicit and explicit motives have similar or complementary influences. (shrink)

We study connections between four types of modal operators – necessity, possibility, un-necessity and impossibility – over intuitionitstic logic in terms of compositions of these modal operators with intuitionistic negation. We investigate which basic compositions, i.e. compositions of the form ¬δ, δ¬ or ¬δ¬, yield modal operators of the same type over intuitionistic logic as over classical logic. We say that such compositions behave classically. We study which modal properties correspond to each basic compositions behaving classically over intuitionistic (...) logic and also prove that KC constitutes the smallest superintuitionistic logic over which all basic compositions behave classically. The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both (...) paradigmatic examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. According to Ibn Khaldūn, man is a social entity deeply influenced by the geo-economics-politics of the environment in which he lives. The effect is seen as so strong that nearly all of these structures in their relationship to human beings are dominated by it. In this system, we see human beings as a creature who is both able to adapt himself to the environment and able to evolve in this harmony. From the perspective of Ibn Khaldūn, man cannot be evaluated (...) or defined separately from the environmental conditions, the technique and architecture he has developed. Ibn Khaldūn sees the primary source of this change to be the desire to make life both more prosperous and bearable. Therefore, the most natural motivations that affect man’s desire to alter the natural world are the environmental challenges that he encounters. The challenges that are imposed upon man in the natural world are those that have led to human progress. From badāwa (nomadic society) to ḥaḍāra (sedentary society) and so to the ceaseless drive of human progress that has served to make life more endurable, every effort in this sense leads to a physical and moral loosening as the incessant struggle to survive that defines human existence is made more bearable. Physical slack by breaking the resistance of man to resist the environmental conditions; and moral looseness by making man more vulnerable to the temptation of desires, pleasures and welfare that are the cause of moral dilemmas. Ibn Khaldūn’s moral thought with its social, political, and other fields of application are all contexts that enable an understanding of the devaluation of money-hedonist morality in all ways. This article aims to analyze the social, political and economic dilemmas and challenges that the capitalist, consumption-based money-hedonist morality (obesity, social media addiction, consumption, and moral devaluation in the face of financial, virtual and imagined valuations, etc.) from the perspective of Ibn Khaldūn. Summary: Man is endowed with both good and evil. Ibn Khaldūn notes that man tends to misuse these two orientations with a higher inclination towards evil, and that social conditions have an effect on this. He sees another characteristic of man, that they develop habits; accordingly, man is the child of his habits. Habits are second nature to man and affects all of his perceptions, particularly notions concerning truth. At the same time, human beings are under the constant influence of both habits, culture, and climate and geography; and all of these together affect our ethics, psychology and characteristics. Thus, man is a historical, social being that is changed, transformed and determined by adapting to these cultural, social, political and ecological conditions. The concept of Money-Hedonism is one that we have created by combining the terms monetarism, an economic concept, and hedonism, a concept in moral philosophy; the resulting term we seek to produce essentially translates as the adoration of Money. As is well known, hedonism refers to a philosophy of life that has its origins in the ancient Greek world which sees the purpose of life as one in which the pursuit of pleasure is the highest good. Whereas, Monetarism is an American-based economic view developed by Milton Friedman in 1970, linking all the balance in the economy to the supply and demand of money. According to this, the demand for money is operation, precaution and motives of speculation of individuals the amount of money they want to keep in cash on them. The power of an exchange tool increases with the amount and quality of what it is achievable in its utilization. In this respect, money has been an unprecedented source of power in modern society as a means by which change can be achieved. The increase in the power of money as an effective means as manifesting power has led to a socio-cultural and socio-economic superstructure around this power. In the life of an individual that is part of such a culture and is unable to isolate himself from the economy in which he lives, the values that can be expressed with money are consequently formed. In this structure, since the measure of life is money, money determines the quality of human life and human pleasure to a far greater degree than at any time in history. Thus, those living in this age have developed a new moral philosophy of value formed by the combination of these two concepts (monetarism and hedonism), which we have defined as Money-Hedonism. The money-hedonist individual is one that is in love with money, the joy of having it, the pleasure of using it, who desires it with immeasurable passion and ambition and is willing to use all legitimate and illegitimate methods of obtaining it. The most prominent characteristics of this type of individual is egoism, a desire to possess, hatred and mistrust. Ibn Khaldūn argues that the inhabitants of a city that live a settled life and who are living in the city have become economically prosperous and absorbed by consumption and pleasure, and, consequently morally degenerate as a result of the abuse of their evil nature. As can be understood from Ibn Khaldūn’s explanations, the basic element that determines the transition of people from the badāwi way of life to ḥaḍāri (settled) is the change in the livelihoods and related needs. He perceives this change as progressing from necessity to luxury, and, with this change, ethical concern in the nature of people being replaced by aesthetic care. In this way, since aesthetic concern reveals the dissatisfaction of the human self, man always pursues what is perceived to be better and more beautiful, and therefore he easily tends to any malignancy that may disrupt his religious and worldly peace. The ḥaḍāra community of Ibn Khaldūn versus the badāwa represent a modern society with a much more heterogeneous population, with a significant increase in lifestyle diversity along with urbanization. However, the determinative effect of the relationship with nature or the way in which society engage in economic activities have not changed. While modern people are urbanized, they are also heterogeneously shaped by psycho-social necessities demanded by urbanization. Man has created a new socio-psychological condition that not only affects the socio-economic but the way of forming a relationship through the accelerated development of new communication methods, facilitating access to information, and the opening of new methods of communication field between institutions. While man’s connection to nature has become disconnected, he no longer perceives himself as human being in nature but as a human within the city, the individual urban life and the law define this perception. The rupture from nature has created an inevitable result of alienation to nature as well as the estrangement of man with his own nature. The liberal policies adopted with capitalism have encouraged competition and free entrepreneurship. In the time that Ibn Khaldūn lived, man who created himself with his struggle in the nature brings himself / herself into the economic structure of competition in the modern period. Unlike in more traditional societies of the past, the modern way of life not only expresses itself in our new way of life and moral values, but also by statistical values. The exploitative and mathematical world, which forms the current economic science, shapes the socio-economic and socio-psychological structure of modern man. It is understood that the life brought by luxury renders the dynamic, subjective, disciplined sense of morality dysfunctional by destroying the moral values of man, particularly by reducing their feeling of shame. As a result, while the world of value of money-hedonism is solid, materialistic and cold; man in trying to exist in this world of value carries a flexible, spiritual and emotional nature. As such, human beings are pushed into social anomaly situations such as a constant conflict, dilemma, suicide, insecurity and solitude in this world of value. (shrink)

Animals have made possible to science the production of new knowledge within the fields of Biology and Physiology. This knowledge has allowed the development of methods of diagnosis and treatments that improve the quality of life of human beings and animals. Therefore, the use of animals for testing should be made with respect, and considering the possible reactions of the animals and their own ethology. Animal testing might remain under debate in the coming years due to the necessity to (...) adapt the care of the animals used for testing to the opportunities and challenges that might come in the future. Thus, it will be relevant for researchers to remain up to date with the progress of procedures. Bearing all this in mind, it is necessary to examine the ethical appropriateness of the legal aspects considered by Colombian regulations concerning scientific experimentation and testing. Such aspects are discussed in the article and a proposal for a National Legislation that takes into account all the technical, scientific and bioethical elements that are involved in animal testing is outlined. A simple line drawing can reproduce a vast collection of phenomenal discontinuities: optical, material, chromatic, and also of density, dimension, resistance. All these discontinuities correspond to physical realities quite different from each other. This fact leads us to consider that our brain can retrieve from a pencil stroke a broad and amazing lot information at several levels, from the physical to the phenomenological, from the logical to the cognitive. Drawing demonstrates the existence in our brain of a complex communication web (...) between the visual and action cortical areas and the zones of the paleo encephalon, indicating the biological necessity of establishing a continuity between vision and action, between representation and abstraction. Thus, drawing is a natural language, and represents a biological and expressive invariant; it is also a cultural language, the result of technical and symbolic development of a civilization; and it is, finally, an universal language, indeed the main communication system between different cultures. This essay examines the way in which the modal concept of necessity was discussed and analyzed in some eleventh- and early twelfth-century sources, such as Peter Damian’s De divina omnipotentia, Anselm of Canterbury’s Cur deus homo and several anonymous commentaries on Aristotle’s De interpretatione that were presumably composed in the first two decades of the twelfth century by logicians connected to William of Champeaux’s and Peter Abelard’s milieu. My aim is to offer a comparison of these different sources with (...) respect to their use of the Boethian distinction between two types or kinds of necessity, namely, the “absolute” or “simple” necessity that is involved in statements like “God is necessarily immortal” or “it is necessary for humans to be animals”, and the “conditional” or “temporal” necessity that is at stake when we say, for instance, that someone necessarily walks when he is walking. En el contexto de la pregunta por el destino de la Teoría Crítica, la discusión entre Axel Honneth y Jürgen Habermas sobre el cambio en el paradigma de la Filosofía Política y Social con la tesis "de la comunicación al reconocimiento" gira aquí en torno a una reconstrucción crítica de la filosofía de Immanuel Kant, un Kant ´moderado´ en un modelo ´explicativo´ o ´hermenéutico´, y así ´irrebasable´ del progreso moral, rompiendo su sistema, y un Kant ´destrascendentalizado´, apto para fundamentar la (...) necesidad de un diálogo entre la razón y la fe. ¿Por qué Kant y no Georg Hegel, central este último para los dos filósofos alemanes en su superación de las aporías de la primera generación de la Teoría Crítica? Pero ¿dónde queda Karl Marx, tan importante para los fundadores de la Escuela de Frankfurt? Y ¿no había exigido Habermas en 2009 con motivo del aniversario de su discípulo, que Honneth, después de su viaje de Marx a Hegel, hiciera el necesario regreso? De tal manera que en esta vuelta, Honneth trajera en su equipaje lo rescatado del Idealismo Alemán. Así la historia de la Teoría Crítica queda inconclusa. In the context of the question for the fate of the Critical Theory, the debate between Axel Honneth and Jürgen Habermas on the change in the paradigm of Social and Political Philosophy with the thesis "from communication to recognition" here revolves around a critical reconstruction of Immanuel Kant’s philosophy, a ‘moderated’ Kant in an ‘explanatory’ or ‘hermeneutic’ model, and so ‘unsurpassable’ moral progress, breaking his system, and a ‘distranscended’ Kant, suitable to substantiate the need for a dialogue between reason and faith. Why Kant and not Georg Hegel, the latter being central for the two German philosophers in their overcoming of the aporias of the first generation of the Critical Theory? But where it remains Karl Marx, so important to the founders of the Frankfurt School? And in 2009, on the occasion of the anniversary of his disciple, had not Habermas demanded that Honneth, after his journey from Marx to Hegel, made the necessary back? In such a way that in this return, Honneth brought the salvage of German Idealism in his luggage. This way the history of the Critical Theory remains incomplete. (shrink)

The author analyzes the interpretation of Boethius’ “timelessness solution” developed in contemporary Analytic Philosophy of Religion, and the main objections that have been moved to it, trying to draw some conclusions about its effectiveness (a) in solving the antinomy between omniscience and human freedom; (b) in weakening the argument of Open Theism. La nuova prospettiva teoretica proposta dall’Open Theism impone un approfondimento e una rivalutazione delle soluzioni “classiche” all’antinomia tra onniscienza divina e libertà umana. Tra queste “soluzioni” vi è, com’è (...) noto, quella di Boezio, ripresa e resa più sofisticata da molti autori nel dibattito contemporaneo, all’interno della filosofia analitica della religione. L’Autore intende analizzare, quindi, l’interpretazione della timelessness solution sviluppata in tale contesto e le principali obiezioni che le sono mosse, cercando di tracciare alcune conclusioni circa la sua efficacia nel risolvere l’antinomia e nell’indebolire le tesi dell’Open Theism. Teilhard has never given up on permanence behind change, whereas Blondel, although interested by permanence, presents a very keen consciousness of irreversibility. Blondel attempts to construct an ontology that integrates this fact of change or becoming. Would this have satisfied Teilhard? Blondel develops a "logic of moral life" insisting on the initial option right to the end of our destiny. Teilhard develops a consciousness of time with a direct hold on a world apprehended first by the senses, whereas Blondel is (...) suspicious of the sometimes misleading testimony of the senses. We thus see a Blondelian attempt to see where the will reach its limits from this only standpoint, while Teilhard admits the influence of a mystical vision. We thus find in both thinkers a primacy of eternal light and truths, strongly affirmed by Blondel, although present in Teilhard; a specificity of evolution, and the necessity of a complement to prevent thought to close itself off. Both thinkers agree on the idea that "Everything holds from above." They recognize that our humanity represents only a sketch, that it is infra-substantial. (shrink)

One of Michel Henry’s major contributions to the phenomenology of the body consists in his proposal, based on his reading of Maine de Biran, to understand the subjective corporeity from the angle of the ability of action. Subjective corporeity acquires its ontological autonomy and its reality only through its own temporality. In reference to several unpublished texts, this article tries to clarify the nexus between ability and time, and thus to emphasize the crucial importance of the past for a “phenomenology (...) of life”, in his paradoxical connection with the necessity to think a “coming in presence” of the world. Abstract: This working paper focuses on the question whether there is a therapeutic imperative that, in specific situations, would oblige us to perform genome editing at the germline level in the context of assisted reproduction. The answer to this central question is discussed primarily with reference to specific scenarios where preimplantation genetic diagnosis (PGD) does not represent an acceptable alternative to germline genome editing based on either medical, or ethical, or – from the perspective of the potential parents – moral (...) or religious grounds. This article deals with four different types of case constellations that result from these possible reasons against PGD as well as from the necessity or dispensability of a subsequent “control PGD.” These cases are discussed based on hypotheses concerning contextual factors and theoretical assumptions. In conclusion, we point out that if our assumptions are correct, there is probably no therapeutic imperative for genome editing at the germline level. We draw this rationale from the fact that germline interventions are likely not person-affecting. However, we caution the reader that our result is preliminary and needs to be more carefully examined in future work in light of the bioethical debate and potential objections. -/- // Abstract: Im Zentrum dieses Working Papers steht die Frage, ob es einen therapeutischen Imperativ geben kann, der uns, in bestimmten Situationen, verpflichten würde, eine Genomeditierung (genome editing) auf Keimbahnebene im Rahmen der assistierten Befruchtung vorzunehmen. Die Antwort auf diese zentrale Frage wird insbesondere mit Bezug auf Fälle diskutiert, in denen das Verfahren der Präimplantationsdiagnostik (PID) keine aus entweder medizinischen oder ethischen oder – aus Sicht der potentiellen Eltern – moralischen bzw. religiösen Gründen akzeptable Alternative zu einem Keimbahneingriff darstellt. Die möglichen Gründe gegen die PID sowie die Erforderlichkeit oder Verzichtbarkeit einer nachfolgenden «Kontroll-PID» ergeben vier verschiedene Fallkonstellationen, denen sich der Beitrag zuwendet. Auf Grundlage von Hypothesen zu kontextuellen Faktoren und theoretischen Annahmen diskutieren wir diese Fälle. Im Ergebnis verweisen wir darauf, dass es, wenn unsere Annahmen zutreffen, vermutlich keinen therapeutischen Imperativ zum genome editing auf Keimbahnebene gibt. Dies begründet sich daraus, dass der Keimbahneingriff vermutlich nicht als personenbezogen (person-affecting) zu bezeichnen ist. Wir weisen jedoch darauf hin, dass unser Ergebnis vorläufig ist und unter Berücksichtigung der bioethischen Debatte und möglicher Einwände genauer geprüft werden muss. -/- // Résumé: Ce Working Paper se concentre sur la question de l’existence d’un impératif thérapeutique qui, dans des situations spécifiques, nous obligerait à réaliser une édition du génome au niveau de la lignée germinale dans le cadre de la procréation assistée. Afin de répondre à cette question centrale nous développons quatre scénarios spécifiques dans lesquels le diagnostic préimplantatoire (DPI) ne représente pas une alternative acceptable à l’édition du génome germinal pour des raisons médicales, éthiques ou – du point de vue des futurs parents – morales ou religieuses. Cet article traite de quatre constellations différentes de cas résultant des raisons mises en avant pour s'opposer au DPI ainsi que de la nécessité ou de l’inutilité d’un ultérieur « DPI de contrôle » Ces cas sont discutés sur la base d’hypothèses portant sur les facteurs contextuels et sur les présupposés théoriques. En conclusion, nous soulignons que si nos hypothèses sont correctes, il n’y a probablement aucun impératif thérapeutique justifiant l’édition du génome au niveau de la lignée germinale. Nous arrivons à cette conclusion parce qu’une intervention au niveau de la lignée germinale n’est probablement pas susceptible d’affecter la personne. Cependant, nous mettons en garde le lecteur sur le fait que notre conclusion est préliminaire et qu’elle doit être examinée avec soin dans des futurs travaux instruits par le débat bioéthique et par les éventuelles objections. In this article, I discuss Plotinus. critique of the peripatetic idea of the divine intellect as first principle. As I am trying to show, Plotinus accepts the unity of the intellect as self-thinking, and, even more than Aristotle, he emphasizes this unity. Yet, he insists on the necessity of a principle that is even higher and simpler than the intellect. Eventually, intellect proves to be the unity of a plurality, though it is the most unitary being. I discuss the (...) dual nature of the intellect: both as thinking and as being, intellect is both unitary and plural. Starting from this, I analyze Plotinus' arguments of the absolute one as first principle, above intellect. (shrink)

The essay analyses the originality of Machiavelli's reflection about the conflict under the Prince's government, in order to point out concordances and differences with the role - more extensively studied - of conflict within a republic. The questions analysed are, first of ali, the Prince's necessity of foreseeing the institutional structures for the regulation of conflict; then, the issue of alliances for the Prince who, having taken the power with the support of the great or of the people, needs (...) popular support to maintain it; finally, the nature of the popular desire of not being oppressed, and particularly the fact that it is not only a negative desire, but rather contains an active tension to defend liberty. -/- . Si bien que, durant la période de paix intérieure relative qui suit l’accession d’Henri IV au pouvoir (1593-1594), la conscience d’une catastrophe juste passée s’impose, en particulier au théâtre et dans les tragédies. Une catastrophe à laquelle les contemporains se réfèrent comme événement radical du monde d’alors, un pire absolu de ce que l’humanité peut produire d’inhumain, une horreur qu’il faudrait peut-être oublier et/ou sur laquelle il est pourtant nécessaire de faire retour, pour tenter de la penser. This article is the first attempt to justify the "next" milestone in the development of legal realism: hyperrealism. The implications of digitalization have become the new fuel for the legal realist's jurisprudence prediction theory, that is, empirical research to predict the judge's or the court's decision. Indeed, that was impossible for American realists in the early twentieth century, and all the attempts failed. Therefore, tools such as Judicial Analytics allow us to prove that personal motives and prejudices affect a dispute's (...) resolution. Based on a systemic, comparative, and interdisciplinary analysis that intermingles legal theory, data analytics and digital technologies, the article substantiates the concept of hyperrealism itself. It evaluates the advantages and disadvantages of its primary tool—judicial analytics. The authors state the necessity of creating regulatory mechanisms of "curbing" to use them to improve justice and minimize the risk of rights violations. They propose using tools of expert evaluation, standardization, and ethical regulation of forensic analysis. (shrink)

In the debate about Composition as Identity (CI), a recurring pattern is to ask whether a certain feature of identity is also instantiated by composition. This recurring pattern is followed when, for example, the question is asked whether a whole and its parts are indiscernible. In following this pattern, it is methodologically desirable to assume the most standard account of the philosophical problems at stake. However, when the necessity of identity and the problem whether composition is as necessary as (...) identity are at stake, the literature about CI often violates this methodological principle, and resorts to non-standard views about modality, such as counterpart theory. In this paper, we purport to remedy this anomaly and to assess CI on the background of a standard, broadly Kripkean view of modality, and in particular of the contention that a single entity exists in more than one possible world. Given this contention, the backer of CI is forced to relativize composition and, as a consequence, identity to possible worlds, thereby introducing a non-standard kind of identity. We will discuss the charge of adhocness which might be raised against the resulting variety of CI. (shrink)
