Many guidelines and commentators endorse the view that clinical research is ethically acceptable only when it has social value, in the sense of collecting data which might be used to improve health. A version of this social value requirement is included in the Declaration of Helsinki and the Nuremberg Code, and is codified in many national research regulations. At the same time, there have been no systematic analyses of why social value is an ethical requirement for clinical (...) research. Recognizing this gap in the literature, recent articles by Alan Wertheimer and David Resnik argue that the extant justifications for the social value requirement are unpersuasive. Both authors conclude, contrary to almost all current guidelines and regulations, that it can be acceptable across a broad range of cases to conduct clinical research which is known prospectively to have no social value. The present article assesses this conclusion by critically evaluating the ethical and policy considerations relevant to the claim that clinical research must have social value. This analysis supports the standard view that social value is an ethical requirement for the vast majority of clinical research studies and should be mandated by applicable guidelines and policies. Abstract:This article sets out two central theses. Both theses primarily involve a fundamental criticism of current contractarian business ethics (CBE), but if these can be sustained, they also constitute two boundary conditions for any future contractarian theory of business ethics. The first, which I label the self-discipline thesis, claims that current CBE would gain considerably in focus if more attention were paid to the logic of the social contract argument. By this I mean the aims set by the theorist (...) and method of reasoning by which normative conclusions are drawn in the contract model. The second, to which I refer as the domain-specificity thesis, argues that current CBE needs to be better adapted to its field of application and the specific goals which it aims to establish. I will substantiate these two theses on the basis of a comparative analysis of CBE with two earlier families of social contract theories. (shrink)

I clarify recently developed phenomenological approaches to social cognition. These are approaches that, drawing on developmental science, social neuroscience, and dynamic systems theory, emphasize the involvement of embodied and enactive processes together with communicative and narrative practices in contexts of intersubjective understanding. I review some of the evidence that supports these approaches. I consider a variety of criticisms leveled against them, and defend the role of phenomenology in the explanation of social cognition. Though many agree that we need to account for the role that social factors play in inquiry, developing a viable social epistemology has proved to be difficult. According to Longino, it is the processes that make inquiry possible that are aptly described as "social," for they require a number of people to sustain them. These processes, she claims, not only facilitate inquiry, but also ensure that the results of inquiry are more than mere subjective opinions, and thus (...) deserve to be called "knowledge." In this paper, I (a) explain Longino's epistemology, and (b) defend it against charges that have recently been raised by Kitcher, Schmitt, and Solomon. Longino rightly recognizes that not all social factors have the same (adverse) affect on inquiry. Although most researchers are familiar with the application of the Common Rule in research, fewer are aware of specific requirements and restrictions for conducting human subjects research when employees of the US Department of Defense will be participants. Because of the additional regulations concerning DoD employees as participants, federal regulations and research policies require researchers to submit their human subjects research proposals through a DoD review process to ensure compliance with DoD research policies, regardless of a non-DoD IRB’s approval. These (...) research policies recognize the vulnerability of military subjects within a hierarchical organization to potential coercion and abuse during research studies. This article describes some of the unique requirements to conduct human subjects research within the DoD. Many critics have questioned the ethics of advertising as an institution in current American society. The purpose of this paper is to critically examine three negative social trends that have been attributed to advertising: (a) the elevation of consumption over other social values, (b) the increasing use of goods to satisfy social needs, and (c) the increasing dissatisfaction of individual consumers. This explanation yields a defense of advertising which argues that the underlying cause of these negative trends (...) is not advertising, but a larger social factor - capitalism. En este trabajo muestro que la tesis anterior es disputable y ofrezco argumentos que desde la tradición liberal permiten defender la constitucionalización de los derechos sociales. En términos (...) generales, los argumentos presentados giran en tornos a dos ideas matrices del pensamiento de Rawls vinculadas a su concepción de los ciudadanos como personas que deberían gozar de autonomía, así como a su concepción de sociedad. En términos particulares el trabajo presenta una lectura sistemática de los dos principios de la justicia y un análisis de las nociones de sociedad como sistema de mutua cooperación, así como de las ideas de autorrespeto y poderes morales. Abstract Social rights have been considered positive rights that do not require them to be part of the constitution. The most common objection against constitutional social rights holds that social rights are welfare rights and that, by nature, the Constitution should protect only rights of non-interference. In this paper, I show that the previous thesis is debatable, and I offer a liberal argument to defend the constitutionalisation of social rights. In general terms, the arguments presented rest on two main ideas of Rawls's thought linked to his conception of citizens as autonomous persons, as well as to his conception of society. In particular, the paper proposes a systematic understanding of the two principles of justice and an analysis of the notions of society as a system of mutual cooperation, as well as the ideas of self-respect and moral powers. This article responds to Tibor Machan's criticisms of government provision for needy citizens. It argues that although charity may be morally worthy, private charity is inadequate to the task of providing our fellow citizens with the security they deserve; the tremendous social good of secure access to a life of dignity can only be produced by a public social safety net. Moreover, individual rights to property do not stand in the way of providing a public social safety (...) net. Since there are social inputs in wealth creation, reasonable levels of taxation do not violate people's rights to their wealth. (shrink)

Like the navigation tools that freed ancient sailors from the need to stay close to the shoreline—eventually affording the discovery of new worlds—Big Data might open us up to new sociological possibilities by freeing us from the shackles of hypothesis testing. But for that to happen we need forensic social science: the careful compilation of evidence from unstructured digital traces as a means to generate new theories.

The purpose of the present article is to argue against the minimalist theory of social responsibility (i.e., that the sole responsibility of business is to maximize profit in conformity with law), particularly as it is advanced by Butler D. Shaffer. Against this view, I argue that such a theory does not necessarily support or achieve greater levels of corporate efficiency than does a more demanding theory of social responsibility, and that the argument for the former view is no (...) more valueneutral than for the latter. Finally, I argue that Shaffer fails to show that the more maximal theory demands too much from executives and is too unclear to be applicable to their decision-making. (shrink)

Social media platforms have been rapidly increasing the number of informational labels they are appending to user-generated content in order to indicate the disputed nature of messages or to provide context. The rise of this practice constitutes an important new chapter in social media governance, as companies are often choosing this new “middle way” between a laissez-faire approach and more drastic remedies such as removing or downranking content. Yet information labeling as a practice has, thus far, been mostly (...) tactical, reactive, and without strategic underpinnings. In this paper, we argue against defining success as merely the curbing of misinformation spread. The key to thinking about labeling strategically is to consider it from an epistemic perspective and to take as a starting point the “social” dimension of online social networks. The strategy we articulate emphasizes how the moderation system needs to improve the epistemic position and relationships of platform users — i.e., their ability to make good judgements about the sources and quality of the information with which they interact on the platform — while also appropriately respecting sources, seekers, and subjects of information. A systematic and normatively grounded approach can improve content moderation efforts by providing clearer accounts of what the goals are, how success should be defined and measured, and where ethical considerations should be taken into consideration. We consider implications for the policies of social media companies, propose new potential metrics for success, and review research and innovation agendas in this regard. (shrink)

Explanatory pluralism has been defended by several philosophers of history and social science, recently, for example, by Tor Egil Førland in this journal. In this article, we provide a better argument for explanatory pluralism, based on the pragmatist idea of epistemic interests. Second, we show that there are three quite different senses in which one can be an explanatory pluralist: one can be a pluralist about questions, a pluralist about answers to questions, and a pluralist about both. We defend (...) the last position. Finally, our third aim is to argue that pluralism should not be equated with “anything goes”: we will argue for non-relativistic explanatory pluralism. This pluralism will be illustrated by examples from history and social science in which different forms of explanation (for example, structural, functional, and intentional explanations) are discussed, and the fruitfulness of our framework for understanding explanatory pluralism is shown. I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social (...) media preserves the relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

Though the commentaries on my review welcomed its focus on the social dimension of emotion and emotion regulation, they also revealed important misinterpretation. The social standpoint was not developed at the expense of the individual. On the contrary, this perspective is in line with dynamic emotions systems views. Despite variations in modalities, I argue that emotion sharing is universal because it concerns culturally-shaped knowledge and constructions when they are shattered by emotional events. Predictions regarding the recovery effects of (...) private disclosure are formulated, particularly in reference to the notions of speech styles and psychological differentiation. Finally, differentiating cognition and emotion is becoming more and more foggy and I agree that the time has come for new, less fuzzy, concepts. (shrink)

There should not be a material/mental methodological division in the frameworks used by social historians, but rather, a structure/action heuristic division. A survey of methodological approaches to social history becomes possible after clearing confusion between philosophical questions, methodological questions, and theories, as well as presenting a preliminary discussion of philosophical issues pertaining to the study of social history. The five general categories of approaches according to their philosophical foundations are: the empiricist and individualist, the systemic- functionalist, the (...) interpretist, the structuralist and poststructuralist, and relational structurist. All those approaches that adopt methodological structurism are able to overcome fundamental epistemological problems in explaining social history; and so they are able to support a sufficiently powerful methodology for studying how action and structure causally interrelate over time. Social history gains an increasing degree of plausibility and can be labelled "scientific" when it is based on a realist ontology of structures and a commitment to discovering the complex, multileveled, structural reality of the world. In Belief: A Pragmatic Picture, I define “belief” as information poised to guide relatively attentive, controlled action. Though I admit that this is one of several definitions compatible with science and common speech, I mount a pragmatic argument for its adoption as the best means for structuring egalitarian social relations. I here further explicate and defend the pragmatic view of belief in response to my critics.

Philosophy has as much to do with feelings as it does with thoughts and thinking. Philosophy, accordingly, requires not only emotional sensitivity but an understanding of the emotions, not as curious but marginal psychological phenomena but as the very substance of life. In this, the second book in a series devoted to his work on the emotions, Robert Solomon presents a defense of the emotions and of sentimentality against the background of what he perceives as a long history of abuse (...) in philosophy and social thought and art and literary criticism. The title piece reopens a classic debate about the role of sentimentality in art and literature. In subsequent chapters, Solomon discusses not only such "moral sentiments" as sympathy and compassion but also grief, gratitude, love, horror, and even vengeance. He also defends, with appropriate caution, the "seven deadly sins." The emotions, at least some emotions--are essential to a well-lived life. But contemporary cultural life provides broader, more attractive opportunities to do so than have existed at any other point in history. The gentle forms of self-deceit that such experiences require of us, and that so many have regarded as ethically unwholesome or psychologically self-destructive, can in fact serve as vital means to political reconciliation, (...) cultural enrichment, and even (a kind of) utopia. -/- The first half of the book provides a highly schematic definition of simulated experience and compares it with some claims about the nature of simulation made by other philosophers about what it is for one thing to be a simulation of another. The author then provides a critical survey of the views of some major authors about the value of certain specific types of simulated experience, mainly in order to point out the many puzzling inconsistencies and ambiguities that their thoughts upon the topic often exhibit. In the second half of the book, the author defends an account of the positive social value of simulated experience and compares his own position to the ideas of a number of utopian political thinkers, as well as to Plato's famous doctrine of the "noble lie." He then makes some tentative practical suggestions about how a proper appreciation of the value of simulated experience might influence public policy decisions about such matters as the justification of taxation, paternalistic "choice management," and governmental transparency. In this essay, I offer a twofold defense of homelessness. First, I argue that specifiable socio-economic forms of organization that are common among the homeless and that operate at least partially independently of state and philanthropic institutions embody valuable and worthwhile ways to live and to make a living. Second, the norms underlying the current institutional response to homelessness facilitate psychological distress and social fragmentation not just among the homeless but among the housed as well. Confucians think ritual propriety is extremely important, but this commitment perplexes many Western readers. This essay outlines the early Confucian Xúnzǐ’s defense of ritual, then offers a modified defense of ritual propriety as a real virtue, of value to human beings in all times and places, albeit one that is inescapably indexed to prevailing social norms in a non-objectionable way. The paper addresses five likely objections to this thesis, drawing on but going beyond recent Kantian defenses of courtesy and (...) civility. This essay offers a defense of Lukács’s original formulation of the concept of reification, with a particular emphasis on defending the Marxist social-ontological commitments at work in that conception. An attempt will be made to demonstrate that these commitments cannot be summarily dismissed as they have been in Axel Honneth’s “rehabilitation” of the concept. Honneth’s project, it will be argued, consists in an attempt to dispense entirely with the Marxist character of the concept of reification, as well as an (...) attempt to reconstruct the concept in purely normative terms as a “forgetting” of the intersubjective recognition which he takes to be both logically and chronologically prior to the cognition of which reification participates. In outlining this project, a defense of Lukács’s original conception of reification will be offered by means of a critique of Honneth’s criticisms of Lukács’s Marxist commitments. (shrink)

This article considers the proportionality requirement of the self-defense justification. It first lays bare the assumptions and the logic—and often illogic—underlying very strict accounts of the proportionality requirement. It argues that accounts that try to rule out lethal self-defense against threats to property or against threats of minor assault by an appeal to the supreme value of life have counter-intuitive implications and are untenable. Furthermore, it provides arguments demonstrating that there is not necessarily a right not to be killed in (...) defense against theft or minor assaults. While there is a general moral right of self-defense and a general right to life, the scope of these rights depends on certain social facts that—even within a liberal framework—can differ from one society to another. Moreover, the proportionality of self-defense does not depend on the rights of the aggressor alone, but also on a precautionary rule, shaped by the balance of interests of the society in question and aimed at protecting innocent people and other social interests. This rule can protect an aggressor even in cases where he does not have the right to such protection. (shrink)

Is shame social? Is it superficial? Is it a morally problematic emotion? Researchers in disciplines as different as psychology, philosophy, and anthropology have thought so. But what is the nature of shame and why are claims regarding its social nature and moral standing interesting and important? Do they tell us anything worthwhile about the value of shame and its potential legal and political applications? -/- In this book, Julien Deonna, Raffaele Rodogno, and Fabrice Teroni propose an original philosophical (...) account of shame aimed at answering these questions. The book begins with a detailed examination of the evidence and arguments that are taken to support what they call the two dogmas about shame: its alleged social nature and its morally dubious character. A questão que o presente texto visa avaliar é em que medida duas objeções dirigidas contra o liberalismo criam dificuldades para a versão rawlsiana dessa teoria. A primeira objeção diz que as partes responsáveis pela escolha dos princípios de justiça são demasiadamente individualistas e que o raciocínio prático delas é amplamente instrumental. A segunda afirma que o método rawlsiano de justificação da justiça por meio de princípios enfraquece a prioridade de seu formalismo kantiano ao pressupor um compromisso substantivo com uma (...) concepção particular de bem. Estas duas críticas dão suporte à afirmação mais geral de que as teorias liberais não captam adequadamente as demandas da justiça social. No entanto, defendo a tese de que essas objeções falham, ao menos com relação ao liberalismo de Rawls, uma vez que parecem estar baseadas em uma má compreensão de sua proposta. Com relação à primeira objeção, tento mostrar que Honneth e Anderson (2005) parecem se equivocar na reconstrução do ideal de pessoa de Rawls na medida em que desconsideram o desenvolvimento da ideia de personalidade moral em sua teoria. No tocante à segunda, busco argumentar que a objeção de Honneth (1991) até pode ser um problema para o liberalismo, mas não para aquele defendido por Rawls. (shrink)

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Former NAACP chapter head Rachel Dolezal's attempted transition from the white to the black race occasioned heated controversy. Her story gained notoriety at the same time that Caitlyn Jenner graced the cover of Vanity Fair, signaling a growing acceptance of transgender identity. Yet criticisms of Dolezal for misrepresenting her birth race indicate a widespread social perception that it is neither possible nor acceptable to change one's race in the way it might be to change one's sex. Considerations that support (...) transgenderism seem to apply equally to transracialism. Critics of liberalism in the past two decades have argued that the fact that we are necessarily "situated" or "embedded" means that we can not always choose our own ends (for example, our conceptions of the good or our loyalties to others). Some suggest that we simply discover ourselves with these "connections." If correct, this would argue against (Rawlsian) hypothetical contract models and liberalism more broadly, make true impartiality impossible, and give support to traditionalist views like those of Alasdair MacIntyre, (...) Charles Taylor, and Michael Sandel. These same critics argue that liberalism's rejection or neglect of this supposed fact of our moral life has pernicious anti-social affects. I argue that the critics are wrong in both cases, defending what I call "strong voluntarism." In contrast both to recent critics of liberalism and the dominant trend in recent liberal thought, my defense of strong voluntarism allows that we can always choose to accept or reject any end we happen to have but that this does not lead to any pernicious anti-social effects.
