Economist-philosopher Amartya Sen's writings on social and political issues have attracted wide audiences. Section 2 introduces his contributions on: how people reason as agents within society; social determinants of people's (lack of) access to goods and of the effective freedoms and agency they enjoy or lack; and associated advocacy of self-specification of identity and high expectations for ‘voice’ and reasoning democracy. Section 3 considers his relation to social theory, his tools for theorizing action in society, and his limited degree (...) of attention to work by sociologists and to capitalism and power structures. Section 4 characterizes a style marked by conceptual refinement, emphases on complexity and individuality, including personal individuality, and reformist optimism. Section 5 shows the features from Sections 3 and 4 at work in his conception of personhood that advocates freedom to make a reasoned composition of personal identity. Similarly, Section 6 addresses his conception of public reasoning and neglect of the sociology of democracy. It contrasts the ideal of a reasoning polity with features in many countries. Sen's programmes for critical autonomy in personhood and for reasoned politics play, nevertheless, a normic role, while his analytical formats help investigation of obstacles to more widespread agency, voice, and democratic participation. Actions are uncontroversially public. However, the prevailing model of explanation in the debate about the de se seems to conflict with this fact by proposing agent-specific explanations that yield agent-specific types of action—i.e. types of action that no two agents can instantiate. Remarkably, this point affects both proponents and critics of the de se. In this paper, I present this kind of problem, characterise the proper level of analysis for action explanation compatible with the publicity of (...) action—i.e. the agent-bound level—and suggest that acknowledgement of this level highlights two important amendments of contemporary views. First, sceptics must accept that, when explanation is attitude-involving, the attitudes mentioned in the explanation of action must refer to the agent. Secondly, and perhaps more surprisingly, proponents of the de se should seek for accounts of de se attitudes that are not confined to a specific agent and are, therefore, sharable across agents. This essay explores Hannah Arendt’s contribution to our understanding of the rhetorical as opposed to the aesthetic quality of public speech, with an emphasis upon her conception of opinion and glory. Arendt’s focus on the revelatory quality of public action in speech is widely understood to preclude or seriously limit its communicative aspect. I argue that this is a misunderstanding, and that accepting it would reduce speech not merely to the discussion of a sharply limited set of (...) topics, but to no topics at all. Public action is speech that reveals the speaker as “answering, talking back and measuring up to whatever happened or was done.” Such revelatory speech is most appropriately judged by the standard of the glorious and the inglorious. Because such speech must inform as well as reveals, so does glorious or great speech rise to the level of greatness in part because of what is said, to whom, where, and how. Arendt’s understanding of this is shown to have significant parallels to the ordinary language philosophy of Stanley Cavell. (shrink)

This paper addresses the question of whether and how public action via civil society and/or government can meaningfully shape industry-wide corporate responsibility behaviour. We explore how, in principle, ICR can come about and what conditions might be effective in promoting more ethical behaviour. We propose a framework to understand attempts to develop more responsible behaviour at an industry level through processes of negotiation and coalition building. We suggest that any attempt to meaningfully influence ICR would require stakeholders to (...) possess both power and legitimacy; moreover, magnitude and urgency of the issue at stake may affect the ability to influence ICR. The framework is applied to the retail banking industry, focusing on post-crisis experiences in two countries—Spain and the UK—where there has been considerable pressure on the retail banking industry by civil society and/or government to change behaviours, especially to abandon unethical practices. We illustrate in this paper how corporate responsibility at the sector level in retail banking is the product of context-specific processes of negotiation between civil society and public authorities, on behalf of customers and other stakeholders, drawing on legal and other institutions to influence industry behaviour. Piety is a social virtue. This study argues that piety as devoted action must include dialogue. Piety is an intersubjective act that attends to divine and human realities. This Project Demonstrating Excellence establishes piety as the virtue that requires wider dialogue not strict application of dogma. ;Each chapter is preceded by a Case Study of either a literary or a personal figure that represents characteristics of the virtue of piety. The threads that run through each case study, and the (...) two in Chapter 5, are the social and political aspects of piety. ;Chapters 1 and 2 concentrate upon the human condition as open to theological reality and inspired by philosophical insight. They retrieve systematic positions of Paul Tillich, such as the discovery of ultimacy through theonomous reason, and Hans-Georg Gadamer's hermeneutical interplay of dialectic and historically effected consciousness. ;Chapter 3 is a hermeneutical look at the relationship of tradition and newness in experience that supports social values in human action, as exemplified in the work of Wendell Berry. Chapter 4 looks into the application of open tradition in social and political action, particularly in the Communitarian movement. It depends chiefly on Gadamer's hermeneutics and the understanding of being-in-the-world as a practical activity of care and concern. Others presented are Charles Taylor, Jean Bethke Elshtain, and David Hollenbach. ;Piety as the social virtue of dialogical devoted action is contrary to a popular notion which values the narrow relationship between the devotee and the one receiving devotion. Case studies here of this publicness of piety include Plato's Euthyphro, Virgil's Aeneas, Sophocles' Antigone, the prophets Amos, Hosea, and Micah, Dorothy Day, Vaclav Havel, and Tom Pringle. This study concludes that piety becomes public action in the application of tradition that is perpetually open to new understanding. This is the public action of social justice. In dialogue the human person realizes a certain distinction in creation. This "open tradition" that characterizes dialogical devoted action establishes piety as a social virtue. (shrink)

It is widely agreed that one of the core functions of government is to supply public goods that markets either fail to provide or cannot provide efficiently. I will suggest that arguments for government provision of public goods require fundamental moral judgments in addition to the usual economic considerations about the relative efficacy of markets and governments in supplying them. While philosophers and policymakers owe a debt of gratitude to economists for developing the theory of public goods, (...) the link between public goods and public policy cannot be forged without moral reflection on the proper function and scope of government power. In this paper, we argue that deliberative democrats have too narrow a conception of the political, but that 'activism' as it is normally understood is not sufficiently broad, either. Politics is not reducible to coercion and contestation, but rather to the constitution of our shared world. We contend that active citizenship more often takes the form of working in a rape crisis center or a domestic violence clinic than participating in marches or town meetings.

In the United States, prohibitionist policies are used as the primary approach to combat the negative effect of substance use on society. An extensive academic literature spanning the disciplines of economics, political science, and multiculturalism documents the great social costs of the United States’ “War on Drugs” both nationally and internationally. These costs come with at best marginal effect on substance abuse and other crimes linked to the drug trade. In many cases, there is a reason to believe that these (...) policies exacerbate the problems they aim to address. This article explores psychologists’ ethical commitments to social change concerning such drug policy, given the field of psychology’s expanding commitment to social justice. We examine arguments regarding the boundaries between psychologists’ personal and professional ethics with regard to political participation. Using drug prohibition as an exemplar, we suggest that many psychologists’ political actions and professional ethics may be misaligned. Ultimately, we conclude that the endorsement of prohibitionist drug policies is in direct conflict with the guiding ethical principles put forth by the American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct. This paper challenges the assumptions underpinning James Tooley's earlier critique in this edition of the Journal of the author's negative assessment of market-led forms of educational provision. In particular, the paper highlights Tooley's failure to acknowledge that the pursuit of self-interest within the market place can be self-defeating. The paper concludes by arguing that deliberative public action is a necessary condition for addressing the major predicaments of our time, including those facing education.

One objection to the principle of public reason is that since there is room for reasonable disagreement about distributive justice as well as about human flourishing, the requirement of reasonable acceptability rules out redistribution as well as perfectionism. In response, some justificatory liberals have invoked the argument from higher-order unanimity, or nested inclusiveness. If it is not reasonable to reject having some system of property rights, and if redistribution is just the enforcement of a different set of property rights, (...) redistribution is legitimate if chosen democratically. This article explores two problems with this response. First, there are different ways to describe the set of possible policies, and so different ways to specify the noncoercive default that obtains in the absence of conclusive justification. Second, if the coercive exercise of political power must be conclusively justified, policies that are more coercive ought to require conclusive justification as against policies that are less coercive. These problems about the baseline with respect to which we require public justification raise the question of how we measure coercion, and whether or in what sense there is a presumption against coercion. As such, we can discern public perceptions of the ethics of IVM before its commercial release. This affords advocates of environmentally sustainable, healthy, and just diets with a unique opportunity to reflect on the social desirability of the development of IVM. This work draws upon an (...) analysis of ethical perceptions of IVM in 814 US news blog comments related to the August 2013 tasting of the world’s first IVM hamburger. Specifically, I address three primary questions: How does the public perceive the ethics of IVM development? How acceptable is IVM to the public relative to alternative approaches to reducing animal meat consumption? and What should all of this mean for the ongoing development and promotion of IVM? Several important ethical dilemmas emerge when nurses join a public-sector strike. Such industrial action is commonplace in South Africa and was most notably illustrated by a national wage negotiation in 2010. Media coverage of the proceedings suggested unethical behaviour on the part of nurses, and further exploration is merited. Laws, policies and provisional codes are meant to guide nurses’ behaviour during industrial action, while ethical theories can be used to further illuminate the role of nurses in industrial (...) action. There are, however, important aspects to consider before judging whether nurses act unethically when striking. Following Loewy’s suggestion that the nature of the work, the proceeding commitment of the nurse to the patient, the prevailing situation when the strike is planned and the person(s) who stand(s) to benefit from the strike be considered, coupled with a consideration of the South African historical socio-political context, important aspects of the ethics of nurses’ behaviour in industrial action transpire. ABSTRACT This paper is a case study in public health ethics. It considers whether there is a basis in ethics for political action by health professionals and their associations in response to inhumane treatment. The issue arises from Australia's treatment of asylum seekers and the charge that this treatment has been both immoral and inhumane. This judgement raises several questions of broader significance in bioethics and of significance to the emerging field of public health ethics. These questions (...) relate to the role of health professionals in response to inhumane treatment of people in their charge; to the discipline of public health in light of a growing recognition of its ethical basis; and the role of public health and bioethical associations in response to ethical issues arising in a political context. It is argued that, in serious cases of humanitarian and human rights abuses affecting health and well‐being, there is a case for political action by health professionals, academic and professional institutions, and associations of public health and ethics. Over the last century, droughts have caused more deaths internationally than any other weather- or climate-related disaster. Like other natural disasters, droughts cause significant changes in the environment that can lead to negative health outcomes. As droughts are becoming more frequent and intense with climate change, public health systems need to address impacts associated with these events. Partnering with federal and local entities, we evaluated the state of knowledge of drought and health in the United States through a National (...) Drought and Public Health Summit and a series of subsequent regional workshops. The intended outcome was to develop public health strategies for implementing activities to better support and prepare public health systems for future droughts. The information gathered from this work identified multiple policy and law options to address the public health issues associated with drought. These policy recommendations include the use of public health emergency declarations for drought events, increased usage of preparedness evaluations for drought emergencies, and engagement of drought and climate experts in state and local risk assessments. As drought events are projected to increase in frequency and magnitude with climate change, taking policy action now will help decrease the health impacts of drought and save lives. (shrink)

Corporate social responsibility (CSR) is one of the ways through which companies gain legitimacy. However, CSR actions themselves are subject to public skepticism because of increased public awareness of greenwashing and scandalous corporate behavior. Legitimacy of CSR actions is indeed influenced by the actions of the company but also is rooted in the basic cultural values of a society and in the ideologies of evaluators. This study examines the legitimacy of CSR actions of publicly traded forest products companies (...) as compared to family-owned forest products companies. Results indicate a lower legitimacy for CSR actions of publicly traded companies than for family-owned companies. The study also examines the effect of social responsibility orientation (SRO) of evaluators on the legitimacy accorded to companies' CSR actions. We found that SRO was negatively associated with legitimacy, especially for women. Perceived profitability of companies was negatively associated with legitimacy of CSR actions for publicly traded but not for family-owned companies. (shrink)

A co-founder of the Catholic Worker Movement, its newspaper, and hospitality houses, the writer Dorothy Day promoted public peace nationally and internationally as a journalist, an organizer of public protests, and a builder of associational communities. Drawing upon Hannah Arendt’s conceptions of the role of speech and action in creating the public realm, this paper focuses on several of Day’s most controversial public positions: her leadership of non-cooperation against Civil Defense drills intended to prepare New (...) York City residents to survive a nuclear war; her urging of Catholics to find common cause with the Cuban revolutionary government; and her support for interracial farming communities in the Southern United States. As Arendt asserts about Rahel Varnhagen’s salon in Berlin, by being public meeting spaces hosted in private houses, Catholic Worker communities fostered egalitarian rather than “agonal” politics. Like Gandhi’s newspapers and ashrams as well as “Occupy” communities such as Zuccotti Park, Day’s newspaper was a center for incubating and implementing social reform. The Catholic Worker provided a place where writers could question the official rhetoric of such conflicts as World War II and the Cold War, put forward different interpretations of unfolding events, and chart possible alternatives to establishment agendas. Recent social science research indicates that animal rights philosophy plays the functional role of a religion in the lives of the most committed animal rights advocates. In this paper, I apply the functional religion thesis to the recent debate over the place of direct action animal rights advocacy in democratic theory. I outline the usefulness of the functional religion thesis and explain its implications for theorists that call for deliberative theories to be more inclusive of coercive forms of activism.

In the last two decades, we have seen an increasing display of gestures and language of forgiveness in the public realm. Forgiveness has become a secular phenomenon. What do we mean by forgiveness? What is the role of forgiveness in the public place? Does it have the capacity to enhance the political life and well-being of a community? In The Human Condition, first published in 1958, Hannah Arendt offers an unapparelled reading of political forgiveness, described as a quintessential (...) human faculty for the revitalization of the public and political realm. This paper seeks to investigate the implications of Arendt’s understanding of action and forgiveness for the life of the polis, in particular the promotion of a more hospitable public space. Situated within human capacity to act and to love the other in their uniqueness and despite their trespasses and failures, forgiveness contributes, as this paper seeks to demonstrate, to the enhancement of the political sphere by opening this space to “new beginnings.”. China has a civil procedure for collective litigation, which is dubbed Chinese-style class action, as it differs from the U.S.-style class action in some important ways. Using securities class action as a case study, this Article empirically examines both the quantity and quality of reported cases in China. It shows that the number of cases is much lower than expected, but the percentage of recovery is significantly higher than that in the United States. Based on this, the (...) Article casts doubt on the popular belief that China should adopt the U.S.-style class action, and sheds light on the much-debated issue concerning the relationship between public and private enforcement of securities law. The Article also discusses the future prospects of securities class action in China in light of some recent developments which may provide its functional equivalents, including the regulator-brokered compensation fund and public interest group litigation. This paper emplaces arguments about affirmative action today inside a history of racial harms inflicted by public policy during the last heyday of southern power in Congress in the 1930s and 1940s. Showing how social programs utilized occupational exclusions and administrative decentralization to protect the Jim Crow racial order, it argues that assertive remedies can be found that connect the ambitions for affirmative action announced by President Lyndon Johnson at Howard University in 1965 with the principles enunciated (...) by Justice Lewis Powell in the Baake case in 1978. Abstract Adapted from the six 2010 Star Island Chapel Talks, the paper introduces the readers to contemporary Catholic Social Teaching and its application and implementation, particularly in the fields of environmental justice and human rights. An opening vignette explains how ideas about the common good contributed to the defeat of “Takings” legislation aimed at undoing environmental regulation in the 104th Congress (1995–1996). The teaching is presented as a vision of society centered on the communion of persons and creation rather than (...) a discrete set of principles, with human rights and charity being the twin pillars of an evolving tradition. From around the world, cities and regions, civil society networks and businesses, nongovernmental organizations and institutions for research and learning, and many others, are taking action on climate change. The role of these nonstate and substate actors is increasingly being recognized in the new facilitative climate regime. Political theory to date has been surprisingly silent about the scale and prospects of these actions for low-carbon, climate-resilient, and sustainable transformations. Idil Boran argues provocatively for the need for a widened scope (...) of vision, one that has a broader public life of climate action at its centre. While acknowledging the role of the state and the multilateral process, Boran maintains that social transformation is as deeply and more continuously influenced by the engagement of a wide range of actors below and above the state, whose actions are often locally anchored and inescapably interwoven across borders. Bringing concepts of the public sphere from political theory into contact with leading scholarship on transnational climate governance, Political Theory and Global Climate Action launches an exploration sensitive to changing patterns of practice, focused on diversity of actors, driven to explore historically contingent conditions of possibility, and responsive to questions of equity and justice in the context of transformations. The result is a repositioning of political thought on climate change, engaging political philosophers, scholars of politics and governance, and drivers of climate action worldwide at nonstate and substate levels interested in the social and political meaning of their engagement. Academic publications of empirical public health research often entail recommendations for moral action that address practitioners and policy makers. These recommendations are regularly based on implicit moral judgments with the underlying reasons not explicitly stated. In this paper, we elaborate on the moral relevance of such judgments and the need to explain them in order to account for academic argumentation. We argue for an explicit reporting of bridge principles to increase the transparency of the reporting of public (...) health research. The reporting of bridge principles can inform readers, support them in understanding the relationship between empirical and normative claims in a specific paper, and may pave new ways for the rigorous reporting of empirical research that has moral implications. Furthermore, it can be used to classify studies to systematically address the justification for their argumentation. (shrink)
