In this paper, I sketch a Kantian account of duties of rescue, which I take to be compatible with Kant’s theory. I argue that there is in fact no “trumping relation” between imperfect and perfect duties but merely that “latitude shrinks away” in certain circumstances. Against possible demandingness objections, I explain why Kant thought that imperfect duty must allow latitude for choice and argue that we must understand the necessary space for pursuing one’s own happiness as entailed by Kant’s justification (...) of one’s duty to promote other’s happiness. Nevertheless, becoming worthy of happiness has always priority over one’s own happiness, even when circumstances are such that we cannot secure our own happiness without seriously neglecting more pressing needs of other persons. I conclude that Kant’s moral theory calls for complementation by the political and juridical domain. Implementing just political institutions and creating satisfactorily well-ordered societies create an external world which is friendlier to our attempts to reconcile moral integrity and a happy human life. En este artículo, sostendré que Kant no sólo propuso una versión secular de la posesión común de la tierra, sino que también se diferenció de forma radical de la concepción iusnaturalista de sus predecesores. Propongo que la revisión kantiana del derecho cosmopolita se dirige al mismo problema que el derecho de necesidad de Grocio, a saber, la implausibilidad de asumir derechos adquiridos absolutos cuando (...) esto contradice la razón por la que se introducen esos mismos derechos. Sin embargo, mientras que Grocio pretendió excusar violaciones de la propiedad privada en casos de necesidad, Kant limitó su discusión al derecho de rechazar la entrada de personas en un territorio. Muestro que para Kant, negar la ocupación del espacio que puede salvar la vida a otro ser humano que está, en principio, tan legitimado como cualquier otro a tener un derecho en la tierra está en contradicción con la justificación misma del derecho territorial de los Estados. In this paper, I analyze the least discussed of Kant’s four examples of duty in the first section of his Groundwork to the Metaphysics of Morals: the gout sufferer who is no longer motivated by natural interest in his long-term wellbeing, and is thus in a unique position to secure his own happiness from duty. This example has long been wrongly interpreted as a failure of prudential rationality, as recently illustrated by Allen Wood’s reading of that example. -/- I argue (...) that the gout sufferer example is meant to illustrate a violation of a duty to the self and should not be confused with mere prudential failure. The example also helps us understand the line between prudential reason and duties to the self. I show that given Kant’s conception of happiness as an indeterminate concept and his hedonistic account of non-moral ends, it can sometimes be more rational from the perspective of empirical practical reason to choose short term over long-term wellbeing when long term wellbeing seems uncertain in regard to expected pleasure. In other words: Kant’s account of empirical practical reason does not rule out as irrational choosing short term pleasure at the expense of long-term wellbeing. However, this is precisely why the gout sufferer’s long-term happiness can be directly morally required and so becomes the content of a duty to the self. To explain how there can be a direct duty to promote our own happiness under certain circumstances I also elucidate Kant’s distinction between direct and indirect duties. (shrink)

This paper explores the alleged role of a conception of human nature for Kant’s justification of the duty to leave the state of nature and the related right to coerce others to enter the civil condition in the Doctrine of Right (1797). I criticise the interpretation put forward by Byrd and Hruschka, according to which Kant’s postulate of public right is a preventive measure based on a “presumption of badness” of human beings. Although this reading seems to be supported by (...) § 42 of the Doctrine of Right, I shall argue that the paragraph neither offers a justification of why we have a duty to leave the state of nature, nor explains why individuals are allowed to coerce others to do so. I offer an alternative interpretation of § 42 by focusing on the difference between formal and material violations of right and argue that the rationale behind the postulate of public right is the idea that remaining in the state of nature is a formal violation of the concept of right. It is therefore not prudential reason that authorizes us to coerce others to enter the lawful condition. (shrink)

ABSTRACTDid Kant believe we need a world government? It has been a matter of controversy in Kant scholarship whether Kant endorsed the creation of a world state or merely a voluntary federation of states with no coercive power. I argue that Kant's main concern was with a global juridical condition, which he regarded as a rational requirement given the equal freedom and equality of individuals. However, he recognized that implementing this rational ideal requires sensitivity to contingent aspects of world politics. (...) I will argue that Kant offers an ideal theory not disentangled from realist considerations and that he adopts what I will call methodological realism: the attempt to realize the requirements of Right in a world governed by its own laws and mechanisms. I will illustrate this interpretation with Kant's discussion of the right of nations. The confusion in regard to Kant's actual position on the matter, I will argue, is a direct consequence of Kant's methodological realism. The... (shrink)

This doctoral thesis analyzes the systematic role of Kant’s conception of happiness in his moral, legal and political theory. Although many of his conclusions and arguments are directly or indirectly influenced by his conception of human happiness, Kant’s underlying assumptions are rarely overtly discussed or given much detail in his works. Kant also provides different and apparently incompatible definitions of happiness. This research explores the domains of Kant’s practical philosophy in which his conception of happiness plays a systematic role: the (...) relation between the natural need of human beings to pursue happiness and the ends-oriented structure of the human will; Kant’s anti-eudaimonism in ethical theory; Kant’s claim that we have an indirect duty to promote our own happiness and the problem that under certain circumstances, the indeterminacy of happiness makes it not irrational to choose short term satisfaction at the costs of one’s overall, long term happiness, given Kant’s conception of non-moral choice as expectation of pleasure; Kant’s justification of the duty to adopt the happiness of others as our ends and the latitude and eventual demandingness of this duty; finally, since Kant also subsumes subsistence needs and welfare under the concept of happiness of individuals, I also engage with the question of state provision for the poor in the Kantian Rechtsstaat and explore Kant’s conception of equity or fairness as an alternative to the traditional minimalist and the welfare interpretations of the Kantian state. In this paper, I provide an interpretation of the latitude of wide duties by analyzing Kant’s reinterpretation of Horace’s adage insani sapiens nomen habeat; aequus iniqui - ultra quam satis est virtutem si petat ipsam (the wise man has the name of being a fool, the just man of being iniquitous, if he seeks virtue beyond what is sufficient”, MS VI: 404n., 409 and 433n) and his criticism of Aristotle’s doctrine of the mean. In support of my interpretation I also (...) analyze Kant’s distinction between lying and reticence in his correspondence with Maria von Herbert and between openheartedness and reticence in the Religion. I argue that since there is no upper limit to the extent we may realize moral ends it may be morally permissible to take one’s prudential considerations into account when deciding how to comply with wide duties. In contrast, the deliberate disregard of one’s permissible prudential interests may reflect what Kant calls a fantastic conception of virtue, according to which agents vainly believe that they can completely achieve virtue in this life. I call attention to the fact that for Kant the wise (sapiens) is also a prudens, a person who does not think fantastically in matters of virtue and consequently does not attempt to “maximize virtue” at the expense of one’s permissible prudential interests as a finite being. Kant is probably one of the most misunderstood philosophers in the history of Western thought. Some of the most well-known and pervasive objections to Kant’s practical philosophy often rest on considerable misunderstandings of his central theses or a poor and superficial reading of his work. A common misconception is that in Kant’s practical philosophy there is no place or role for human happiness. In Happiness in Kant’s Practical Philosophy: Morality, Indirect Duties, and Welfare Rights, Alice Pinheiro Walla (...) dispels this misunderstanding by elucidating Kant’s conception of happiness (understood in broadly hedonist terms) and showing that, for Kant, the pursuit of happiness plays an important role in our personal and collective lives. This means that, far from endorsing an ascetic ideal of the moral agent, as it is commonly thought, Kant’s system embraces an ideal of the human life in which there is significant space, and even a duty, to pursue pleasurable endeavours. Somehow surprisingly, in Pinheiro Walla’s reading, Kant’s ethics is arguably less demanding than standard interpretations of Aristotelian and Utilitarian ethical theories. (shrink)

Talvez, se dispostos isoladamente, tais elementos não provocariam o impacto no leitor, altamente proveitoso quando se pensa o conjunto do livro. A História torna-se arte, em sua plenitude, pelo encantamento que se processa em escritas como essa. Isso ocorre porque a obra de Chiara Frugoni, respeitada medievalista italiana, inova ao confrontar (...) narrativas imagéticas relacionando-as com o simbólico, o metafórico e o místico. Essa escolha metodológica é facilmente explicável: para se compreender a imagem medieval, torna-se fundamental investigar suas dimensões ideológicas, seus significados culturais e suas funções estéticas. Apenas assim, defende Frugoni, poder-se-ia projetar uma análise histórica que, agregando saberes entrelaçados, se desdobra automaticamente em temas como imaginário coletivo, formas de devoção e práticas religiosas. In its first part, this paper deals with some passages of the Eneads in which the notions of consciousness and unconsciousness may be found. In spite of not having terms that correspond exactly to these in Greek, it is clear that Plotinus had very refined notions related to them, going up to indicate that consciousness might not be the epistemological function that defines humans. The multiple aspects of the phyché hyposthesis in Plotinus enables this separation between consciousness and the essence (...) of men. In its second part, this paper describes cosmological elements of the notions of consciousness and unconsciousness in Plotinus, since the celestial bodies are admitted as living beings. This paper indicates, finally, some problems related to astrology in Plotinus concerned with the notion of consciousness of the stars. (shrink)

In this paper, we recover the idea cast by Graham Priest to our ears in 2000: That it was possible to experience Ontological Paraconsistency in life. He had, back then, as a translation of his thinking, a painting by Escher: The stairs could be going up or down, and one could not tell where they were going by simply examining the painting. The most obvious argument as to why that was not an instance of Ontological Paraconsistency found in reality was (...) that the perspective from which you would have to stare at the painting to see something different would be different too, so that it was impossible that we were getting up and down at the same time, that is, from the same perspective. That would happen with anything we picked in this world. We recently found something that does not entirely belong to this world, however, something that could finally satisfy the requirements of Priest, and therefore prove to us that there is a place for Ontological Paraconsistency. We observe that the paraconsistent robot, Emmy (Abe et al., 2006), is an application of the Non-ontological Paraconsistency, which we always believed to be passive of existence, but we here talk about another type of paraconsistency, which would be intrinsic to the being. The purpose of this paper is then providing a definite answer to the questions: Is there any real life instance of Ontological Paraconsistency? Is Ontological Paraconsistency a useful concept in terms of logical theories? (shrink)

According to the received view in the literature on homonymy and polysemy representation, there is a difference between how polysemes and homonyms are represented in our mental lexicons. More concretely, the received view holds that whereas the meanings associated with a homonymous expression are (mentally) represented in separate lexical entries, the meanings associated with a polysemous expression are represented together in a single lexical entry. It is usually argued that this is the picture that is supported by the growing body (...) of empirical evidence coming from psycholinguistics. Empirical studies of ambiguity processing and resolution consistently show that polysemous expressions enjoy various processing advantages compared to homonyms, and the received view is generally taken to be required in order to explain these results. The aim of this paper is not only to show that this is not the case but also, and more fundamentally, that the received view falls far short of explaining the available data to a sufficient degree. As a result, the received view is caught up in an explanatory dilemma that I dub the Continuum Puzzle. I then claim that the best way to escape this puzzle is to give up the received view’s core thesis in favor of an alternative view consistent with the empirical evidence. Reaching such an alternative will require rejecting the following pervasive but ill-motivated assumption: Differences in ambiguity processing and resolution can only be explained by there being some corresponding differences in the architecture of our mental lexicons. The paper explores whether the method of reflective equilibrium (RE) in ethics and political philosophy should be individual or public in character. I defend a modestly public conception of RE, in which public opinion is used specifically as a source of considered judgments about cases. Public opinion is superior to philosophical opinion in delivering judgments that are untainted by principled commitments. A case-based approach also mitigates the methodological problems that commonly confront efforts to integrate philosophy with the investigation of popular (...) attitudes. This conception of RE is situated in relation to alternative accounts, including those of Daniels, Rawls, and Wolff and de-Shalit. (shrink)

This piece continues an exchange between David Beaver and Jason Stanley, on the one hand, and Alice Crary, on the other, to which Beaver’s and Stanley’s “Neutrality” (immediately above) is a contribution. All three authors agree that the critique of ideology, propaganda, and oppressive structures should not be conceived as eliminating socially-situated perspectives and subjectively-mediated sensibilities from an allegedly neutral discursive space. Their exchange began with Crary’s 2018 article, “The Methodological as Political: What’s the Matter with ‘Analytic Feminism’?” which (...) attacks appeals to neutrality, including one Crary finds in Stanley’s 2015 book, How Propaganda Works, for obscuring a pivotal methodological insight of radical feminist thought, namely, that feminism’s political radicalism is complemented by a “methodological radicalism that involves making use of the practical power of ethically non-neutral resources, conceived as in themselves cognitively authoritative” (Crary 2018: 47). This new reply argues that Beaver’s and Stanley’s practice-based image of language, while at first seemingly aligned with this rejection of neutrality as an ideal for political discourse, fails to fully respond to her original complaint. The ideal of neutrality is problematic, not only in masking social location, but in wrongly impugning as ‘non-cognitive’ or ‘irrational’ critical resources drawn from socially-situated perspectives—the sorts of perspectives to which notable strands of feminist theory give voice precisely for their cognitive value. The current piece claims that to address this further danger it is necessary to go beyond Beaver’s and Stanley’s study of meaning and critically examine engrained philosophical assumptions about how to construe logical notions such as objectivity and truth. It closes by suggesting that, within philosophy of language broadly conceived, the tradition of ordinary language philosophy provides a more promising source of resources and illumination for struggles to make gender-based and overlapping forms of structural bias socially visible. The question of forgiveness in politics has attained a certain cachet. Indeed, in the fifty years since Arendt commented on the notable absence of forgiveness in the political tradition, a vast and multidisciplinary literature on the politics of apology, reparation, and reconciliation has emerged. To a novice scouring the relevant literatures, it might appear that the only discordant note in this new veritable symphony of writings on political forgiveness has been sounded by philosophers. There is a more-than-healthy cynicism directed at (...) what many philosophers see as an uncritical promotion of forgiveness, which – they fear – risks distorting and cheapening forgiveness as a moral ideal, on the one hand, and ignoring the moral and political values of justice, accountability and the cessation of harmful relationships, on the other. Are philosophical fears about the dangers of thinking about forgiveness in political terms warranted – or do they perhaps depend in part on conceptual conservatism regarding what exactly political forgiveness might be? I argue that most, if not all, standard objections to political forgiveness emerge from theoretical reliance on a picture of forgiveness I will call the Emotional Model. Once we make conceptual space for descriptions of forgiveness in performative and social terms, the concept is more easily adapted to a political account without at least some of the risks feared by philosophers. Philosopher Ludwig Wittgenstein had an enormous influence on twentieth-century philosophy even though only one of his works, the famous Tractatus Logico-Philosophicus, was published in his lifetime. Beyond this publication the impact of his thought was mainly conveyed to a small circle of students through his lectures at Cambridge University. Fortunately, many of his ideas have survived in both the dictations that were subsequently published, and the notes taken by his students, among them Alice Ambrose and the late Margaret Macdonald, (...) from 1932 to 1935. These notes, now edited by Professor Ambrose, are here published, and they shed much light on Wittgenstein's philosophical development. Among the topics considered are the meaning of a word and its relation to common usage, rules of grammar and their relation to fact, the grammar of first person statements, language games, and the nature of philosophy. Bien común y ciudadanía en una era emotivista: la política identitaria como vector de crisis y renovación del debate público Este artículo analiza los conceptos de ciudadanía y bien común, considerando la crisis del debate público provocada, entre otras causas, por una distorsión de las políticas identitarias, en el contexto del emotivismo moral moderno. Para ello, este trabajo adopta la metodología de la revisión bibliográfica para desarrollar un análisis teórico de conceptos centrales de la filosofía práctica contemporánea, abarcando diversas referencias, (...) como MacIntyre, Lilla, Taylor, Finnis, Sandel y Kymlicka. Tras presentar el diagnóstico de MacIntyre sobre el ethos emotivista moderno como factor de insolubilidad de las controversias morales y la crítica de Lilla a la despolitización causada por el atomismo de las políticas identitarias, se estudian las condiciones para la rehabilitación teórica de los conceptos de ciudadanía y bien común, a partir de una ética aristotélica y comunitaria relativa a la razón práctica, en virtud de la cual la amistad cívica es relevante para equilibrar las diferencias dentro de una unidad política mayor. La conclusión es que las políticas de identidad pueden salvaguardarse si se ponderan con el concepto de bien común, para así superar las contradicciones emotivistas del debate público. (shrink)

Nasir-i Khusraw is a major literary figure in medieval Persian culture. He was a Muslim philosopher, poet, travel writer, and Ismaili da'i who lived a thousand years ago in the lands known today as Afghanistan, Iran, and Tajikistan. Although known in the West mainly for his Safarnama, or travelogue, which describes his seven-year journey from Khurasan, in the eastern Islamic lands, to Cairo, the city of the Fatimid imam-caliphs, his poetry and ideas are less familiar. Yet, over the centuries, Persian-speaking (...) lands have consistently ranked him as one of the finest poets of all time. But today, even among those who know Nasir-i Khusraw's poetry, few understand the philosophical and Ismaili concepts the poet expounds. And while mystical and epic genres of Persian poetry are memorized and studied, the genre of philosophical poetry in Persian remains basically unexplored. This collection of studies seeks to redress the balance. Originally presented at a conference at the School of Oriental and African Studies (SOAS), University of London in 2005 to commemorate the millenary of Nasir-i Khusraw's birth, the papers published here examine his poetry both for philosophical meaning and poetic method. They address a variety of topics, ranging from metaphysics, cosmology, and ontology to prophecy, as well as rhythm and structure, and analysis of individual poems and authorship. (shrink)

Images of nature abound in the practice of international environmental law but their significance in law is unclear. Drawing on visual jurisprudence, and interpretative methods for visual art, this book analyses photographs for their representations of nature's aesthetic value in treaty processes that concern world heritage, whales and biodiversity. It argues that visual images should be embraced in the prosaic practice of international law, particularly for treaties that demand judgements of nature's aesthetic value. This environmental value is in practice conflated (...) with natural beauty, ethical and cultural values, and displaced by economic and scientific values. Interpretations of visual images can serve instead to critique and conceive sensory, imaginative and emotional appreciations of nature from different cultural perspectives as proposed by philosophers of environmental aesthetics. Addressing questions of value and the visual, this landmark book shows how images can be engaged by nations to better protect the environment under international law. (shrink)

As obstetric medicine has become more sophisticated, so Caesarean section (CS) has become safer. It is now seen as equally safe or, in some circumstances, safer than vaginal birth. Under the new National Institute for Clinical Excellence (NICE) guidelines on CS that were published in November 2011, requests for CS are to be given more weight. Women requesting CS can no longer be seen as compromising their control over birth. Rather, they are merely exercising their power, with the new guidelines (...) offering them an increasing role in the decision-making process regarding how they give birth. However, these new guidelines also present new problems, bringing the rights of patients and obstetricians into conflict. In order to mediate these tensions, a virtue-based approach to obstetric ethics is needed as a supplement to the rule- and right-based guidance provided by NICE. (shrink)

Is there a role for aesthetic judgements in science? One aspect of scientific practice, the use of thought experiments, has a clear aesthetic dimension. Thought experiments are creatively produced artefacts that are designed to engage the imagination. Comparisons have been made between scientific (and philosophical) thought experiments and other aesthetically appreciated objects. In particular, thought experiments are said to share qualities with literary fiction as they invite us to imagine a fictional scenario and often have a narrative form (Elgin 2014). (...) But philosophical discussions of aesthetics in science have focused mainly on the epistemic role of beauty and elegance when it comes to theories and mathematical proofs, and thought experiments have been widely overlooked. My aim in this chapter is to address how the aesthetic choices scientists make in the design of a thought experiment contribute to its function: to communicate, convince, or explain a theory or phenomenon. A key issue is whether any aesthetic features in science provide anything beyond catching our attention, or are at best, a mere heuristic aid. I respond to accounts that argue this way and show how formulation is important in scientific thought experiments and, similarly to literary fictions, there is more than one way of interpreting a thought experiment scenario. I end by considering which literary examples are most appropriate when making comparisons with thought experiments. As a result, the difference between representations in art and science raised in current discussions is not as stark as it has been made out to be, and science is a more heterogeneous practice than has been allowed. Part of the value of thought experiments in scientific practice includes the qualities they share with literary works. (shrink)

Those who wish to defend the role of aesthetic values in science face a dilemma: Either aesthetic language is used metaphorically for what are ultimately epistemic features, or aesthetic language is used literally but it is difficult to see the importance of such values in science. I introduce a new account that gets around this problem by looking to an overlooked source of aesthetic value in science: the relation between form and content. I argue that a fit between the content (...) of a thought experiment, and the way in which that content is formulated, can have important epistemic pay offs through contributing to scientific understanding.
