Can Aristotle’s idea of practice be made fruitful for music pedagogical action in schools? That this is the case is repeatedly asserted in the music pedagogical discussion. This article takes up this assertion and develops a proposal for class music making based on Aristotle’s theory of action.

It is not quite as easy to see that there is in fact no formula of this modal language having the same truth conditions (in terms of S5 Kripke semantics) as (1). This was rst conjectured by Allen Hazen2 and later proved by Harold Hodes3. We present a simple direct proof of this result and discuss some consequences for the logical analysis of ordinary modal discourse.

We see a systematic set of cut-free axiomatisations for all the basic normal modal logics formed by some combination the axioms d, t, b, 4, 5. They employ a form of deep inference but otherwise stay very close to Gentzen’s sequent calculus, in particular they enjoy a subformula property in the literal sense. No semantic notions are used inside the proof systems, in particular there is no use of labels. All their rules are invertible and the rules cut, weakening and (...) contraction are admissible. All systems admit a straightforward terminating proof search procedure as well as a syntactic cut elimination procedure. (shrink)

This paper examines the impact of the recent financial crisis on the relation between a firm’s risk and social performance using a sample of non-financial U.S. firms covering the period 1991–2012. We find that the relation between SP and risk is significantly different in the crisis period compared to the pre-crisis period. SP reduces volatility during the financial crisis. The risk reduction potential of SP is mainly due to the strengths component of SP. Since the relation of risk is stronger (...) with SP strengths than SP concerns, this implies an asymmetric relation between these SP components and a firm’s risk. Specifically, strengths act as a risk reduction tool during an adverse economic environment. (shrink)

I thought the paper by Kai-yee Wong and Chris Fraser was fascinating and insightful. Two things I especially appreciated are the clarity with which they summarize my views. I think they are quite fair and accurate. Second, I appreciate their suggestion that the way to deal with the practical problem of weakness of will has much to do with the role of the Background in shaping our actions. I think they are especially on the right track when they say that (...) the improvement of Background skills may actually narrow the range of real options for action, (p. 21) nonetheless, they do not decrease freedom. As they say, “It is a process of strengthening the self, and the agent is likely to experience the concomitant restriction of ‘live’ options not as a limitation but as strength of character.” (p. 21). That seems to me very much on the right track. What they are suggesting, and it is a powerful addition to my own writings, is that we should not just think of the Background as facilitating languages, games and social practices generally, but for morality as well (p. 23). This study examined lexical bundles used differently by Chinese and American PhD students of linguistics in their dissertation abstracts. Two corpora were built, with each having 700 dissertation abstracts produced by Chinese and American PhD students of linguistics, respectively. The study then used lexical analysis software to retrieve frequently used three-word LBs, from which LBs having different frequencies at a significant level across the two corpora were identified and termed as bundles used differently. BUDs were then categorized and analyzed manually (...) in terms of structure, function, and distribution in rhetorical moves. The major findings were: 57.14% of the frequently used LBs were BUDs, of which 90.67% had occurrences in both corpora. The BUDs distributed inequivalently across categories and moves, with the text-oriented category and the move of Result having the most BUDs; and BUDs exhibited two major patterns: the Chinese and American students filled different constituents into structurally and functionally similar constructions, and used LBs of dissimilar functions to fulfill the same communicative purposes. These findings indicate that variations in LB use have a high pedagogic value and confirm the need for using corpora to identify and teach core genre-specific vocabularies to second/foreign language learners. We first look at an existing infinitary sequent system for common knowledge for which there is no known syntactic cut-elimination procedure and also no known non-trivial bound on the proof-depth. We then present another infinitary sequent system based on nested sequents that are essentially trees and with inference rules that apply deeply inside these trees. Thus we call this system “deep” while we call the former system “shallow”. In contrast to the shallow system, the deep system allows one to give (...) a straightforward syntactic cut-elimination procedure. Since both systems can be embedded into each other, this also yields a syntactic cut-elimination procedure for the shallow system. For both systems we thus obtain an upper bound of φ20 on the depth of proofs, where φ is the Veblen function. (shrink)

The sense of agency is a basic feature of our subjective experience. Experimental studies usually focus on either its attributional aspects or on its motoric aspects. Here, we combine both aspects and focus on the subjective experience of the time between action and effect. Previous studies [Haggard, P., Aschersleben, G., Gehrke, J., & Prinz, W.. Action, binding and awareness. In W. Prinz, & B. Hommel, Common mechanisms in perception and action: Attention and performance. Oxford: Oxford University Press] have shown a (...) temporal attraction in the perceived times of actions and effects, but did directly not study the relation between them. In three experiments, time estimates of an interval between an action and its subsequent sensory effect were obtained. The actions were either voluntary key press actions performed by the participant or kinematically identical movements applied passively to the finger. The effects were either auditory or visual events or a passive movement induced to another finger. The results first indicated a shortening of the interval between one’s own voluntary action and a subsequent effect, relative to passive movement conditions. Second, intervals initiated by observed movements, either of another person or of an inanimate object, were always perceived like those involving passive movements of one’s own body, and never like those involving active movements. Third, this binding effect was comparable for auditory, somatic and visual effects of action. Our results provide the first direct evidence that agency involves a generalisable relation between actions and their consequences, and is triggered by efferent motor commands. (shrink)

The purpose of this article is to examine empirically the impact of environmental certification on firm financial performance (FP). The main question is whether there is a "green premium" for certified firms, and, if so, for what kind of certification. We analyze the short-run and the long-run stock price performance using an event-study methodology on a sample of Canadian and U.S. firms. The results of short-run event abnormal returns indicate that forest certification does not have any significant impact on firm (...) FP regardless of the certification system carried out by firms. Unlike the short-run results, the long-run post-event abnormal returns suggest that forest certification has, on average, a negative impact on firm FP. However, the impact of forest certification on firm FP depends on who grants the certification, since only industry-led certification (Sustainable Forestry Initiative, Canadian Standards Association and ISO14001) are penalized by financial markets, whereas non-governmental organizations—led Forest Stewardship Council certification is not. Successful innovations are deemed to be necessary requisites for enterprise success. On the other hand, works council participation and employee participation are judged differently as either fostering employee and enterprise benefits or only the former or even none. Both forms of participation have found diverging theoretical and empirical argumentations regarding innovations. Here, we argue and show empirically that both forms of participation deliver positive contributions to innovation success, economically and employee-related, substantiated with qualitative reports from 36 process innovation cases and (...) quantitative data from 44 cases. Qualitative case analyses reveal different profiles of works council participation depending on the innovation type. Independent of the innovation types, more successful innovations are marked by more intensive participation. Quantitative examinations of a causal model with path analysis specify how this is achieved: works council and employee participation further the growth of appropriate knowledge and the former also raises the coordination capability; both are essential preconditions for innovation success. A direct impact of works councils on innovation success complements the indirect effects. The slightly modified path analysis explains 53% of the innovation success variance. (shrink)

This pathbreaking work argues that the major intellectual trend in China from the seventeenth through to the early nineteenth century was Confucian ritualism, as expressed in ethics and classical learning. Through the performance of rites, the early Qing scholars believed they could cultivate Confucian virtues and achieve social order. The author shows how Confucian ritualism, with its emphasis on lineage, became a broad movement of social reform that stressed conformity and clearly prescribed rules of behavior, expressed notably in the growing (...) cult of female chastity. It begins with the work of Baumgarten and covers all the major writers on German aesthetics that follow, including Kant, Schiller, Schelling, Hegel, Nietzsche, Heidegger, Gadamer and Adorno. The book offers a clear and non-technical exposition of ideas, placing these in a wider philosophical context where necessary. Current International Criminal Law (ICL) suffers from at least four fairly serious theoretical shortcomings. First, as a starting point, the concept and meaning of ICL in its different variations must be clarified (‘the concept and meaning issue’). Second, the question of whether and how punitive power can exist at the supranational level without a sovereign (‘the ius puniendi issue’) must be answered in a satisfactory manner. Third, the overall function or purpose of ICL as opposed to national criminal law (‘the (...) overall function issue’) must be more convincingly explained. Fourth, the purposes of punishment in ICL, as opposed to the traditional purposes discussed in national criminal law, must be elaborated (‘the purposes of punishment issue’). There is a partly vertical and partly horizontal relationship between these issues. It is, for example, of course impossible to reflect upon ius puniendi, overall function and purposes of punishment without having clarified the concept of ICL in the first place. Also, a treatment of overall function and purposes of punishment seems to be predicated on the justification of the ius puniendi. Indeed, the lack of a satisfactory answer to the ius puniendi issue is maybe the most important theoretical weakness of current ICL. This article therefore aims to demonstrate that a supranational ius puniendi can be inferred from a combination of the incipient supranationality of the world order (understood normatively as an order of values) and the concept of a world society composed of world citizens whose law—the ‘world citizen law’ (‘Weltbürgerrecht’)—is derived from universal, indivisible and interculturally recognized human rights predicated upon a Kantian concept of human dignity. The incipient world order and the world society are represented by the international community (to be understood as a community of values) which becomes the holder of the ius puniendi. (shrink)

Previous studies have highlighted the communicative limitations of artistic visualizations, which are often too conceptual or interpretive to enhance public understanding of (and volition to act upon) scientific climate information. This seems to suggest a need for greater factuality/concreteness in artistic visualization projects, which may indeed be the case. However, in this paper, we synthesize insights from environmental psychology, the psychology of art, and intermediate disciplines like eco-aesthetics, to argue that artworks—defined by their counterfactual qualities—can be effective for stimulating elements (...) of environmental consciousness. We also argue that different artworks may yield different effects depending on how they combine counter/factual strategies. In so doing, we assert that effective artistic perceptualization—here expressed asaffectivization—exceeds the faithful translation of facts from one mode to another, and cannot be encapsulated in a single example of un/successful art. Many find the prospect of death distressing at least partly because they believe that death deprives its subject of life’s benefits. Properly qualified, the belief is surely true. But should its truth lead us to conclude that there is something dreadful or awful about death, something that merits distress?

The rapid spread of judicially-enforced constitutional rights has been one of the most dramatic developments in modern law. This book argues that there is now a global model for how such rights should function, and develops an original, philosophically grounded, account of their nature and scope.

For some modal fixed point logics, there are deductive systems that enjoy syntactic cut-elimination. An early example is the system in Pliuskevicius [15] for LTL. More recent examples are the systems by the authors of this paper for the logic of common knowledge [5] and by Hill and Poggiolesi for PDL[8], which are based on a form of deep inference. These logics can be seen as fragments of the modal mu-calculus. Here we are interested in how far this approach can (...) be pushed in general. To this end, we introduce a nested sequent system with syntactic cut-elimination which is incomplete for the modal mu-calculus, but complete with respect to a restricted language that allows only fixed points of a certain form. This restricted language includes the logic of common knowledge and PDL. There is also a traditional sequent system for the modal mu-calculus by Jäger et al. [9], without a syntactic cut-elimination procedure. We embed that system into ours and vice versa, thus establishing cut-elimination also for the shallow system, when only the restricted language is considered. (shrink)

Drawing on insights of thinkers in the natural rights tradition, Draper analyzes numerous hypothetical cases including those involving a runaway trolley, then seeks to determine if killing civilians in war is ever justified. In his consideration of this issue he avoids appealing to the principle of double effect. Having considered hypothetical cases at length, he leaves it to others to decide if any option to go to war is justifiable. In this regard he himself is sceptical.

Fine bases his influential conception of essence on a particular account of definitions. And he complements it with a specific account of analyticity. I will argue that Fine's conception of relative analyticity confuses the idea of a sentence's being true in virtue of a term's definition with the idea of a sentence's being true in virtue of a term's meaning. His idea that correct definitions specify essential properties of meanings is mistaken. The correctness of definitions can only be assessed by (...) reference to the actual usage of the terms involved. The resulting conception of definitions leads to a deflationary interpretation of claims about essences. (shrink)

A recent judgment by a lower court in Germany brought the problem of ritual male circumcision to the consciousness of the wider public and legal academia. This essay weighs in on this emerging discussion and argues that ritual male circumcision is not covered by parental authority. It first considers and dismisses the best interest of the child test, which is the most widely used test of parental authority in legal practice. Instead, the essay proposes what it terms the autonomy conception (...) of parental authority, according to which parental authority must be exercised such as to ensure that the child will become an autonomous adult. While parents may raise their child in line with their ethical, including religious, convictions, respect for his autonomy requires that this be done in a way that allows the child to later distance himself from these values; this implies, among other things, that irreversible physical changes are impermissible. Stephen Barker (The Philosophical Quarterly, 47 (1997), pp. 195–211) has presented a new argument for a pure material implication analysis of indicative conditionals. His argument relies crucially on the assumption that general indicatives such as ‘Every girl, if she gets a chance, bungee‐jumps’ are correctly analysed as having the formal structure (for all x)(if x gets a chance, x bungee‐jumps). This paper argues that an approach first proposed by David Lewis must be pursued: the ‘if’‐clause in these sentences restricts the (...) quantifier. Only the Lewis‐style analysis can deal with sentences involving non‐universal quantifiers such as ‘Most letters are answered if they are shorter than 5 pages’. I show that Barker's reasons for rejecting the restrictor analysis are not cogent and that the restrictor analysis connects widely with recent work in natural language semantics. (shrink)

In this paper, we discuss three probabilistic arguments for the existence of multiple universes. First, we provide an analysis of total evidence and use that analysis to defend Roger White's "this universe" objection to a standard fine-tuning argument for multiple universes. Second, we explain why Rodney Holder's recent cosmological argument for multiple universes is unconvincing. Third, we develop a "Cartesian argument" for multiple universes. While this argument is not open to the objections previously noted, we show that, given certain highly (...) plausible assumptions about evidence and epistemic probability, the proposition which it treats as evidence cannot coherently be regarded as evidence for anything. This raises the question of whether to reject the assumptions or accept that such a proposition cannot be evidence. (shrink)

The 21st century has been revolutionary for the field of clinical genomics, with major advancements and breakthroughs over the years. It is now considered an instrumental tool in clinical and preventive medicine and has been used on a day-to-day basis to complement current clinical practice. However, with advancements in genomics comes greater bioethical concerns, which becomes increasingly complex with more cutting-edge technology. Some of the major ethical concerns include obtaining informed consent, possibility for genetic enhancements and eugenics, genomic equity and (...) potential discrimination and cloning. It is imperative that we appreciate the benefits of genomic medicine in complementing traditional practices, identify and address the ethical concerns with relation to the practice of genomic medicine, and to ensure a common goal of improving human lives. With these in mind, the practice of genomics can have maximum impact in the collective health of the population, with greater benefit to all. (shrink)

This article examines how Muslim religious scholars find space within political and legal discourses to deal with thorny issues such as rebellion. It takes as its case study a treatise by Ibn al-Jawzī regarding the permissibility to curse the second Umayyad caliph Yazīd b. Muʿāwiya. Although written to address the cursing of Yazīd, the treatise also speaks to questions regarding rulership and rebellion. Overall, the article argues that Ibn al-Jawzī adopted a juristically prudent approach to rebellion against an unjust and (...) sinful ruler which synthesizes various elements of the Sunni caliphate discourse and the Islamic legal discourse on the treatment of rebels. This allowed him to shift the debate from one on the permissibility of rebellion to one on the question of legitimacy, thus enabling him to justify actions against Yazīd without overtly condoning the act of rebellion. This article examines how migrant and immigrant sex workers have been rendered invisible before the courts and parliament in the reform of laws regarding sex work in Canada. A discourse analysis of the expansive legal record in the Bedford case and the transcripts of Parliamentary debates and testimony before Standing Committees confirm the lack of nuanced discussion on how criminal law reform could impact migrant and immigrant sex workers. As such, while the case of Bedford and the resulting change in (...) the law made by Parliament have been celebrated as a win for some sex workers as an acknowledgment, recognition and judicial validation of experiences by legal institutions of sex workers, a sub-group of women – migrant and immigrant sex workers – remain in the shadows. This article examines how law excludes migrant and immigrant sex workers; it is a starting point for research on how migrant and immigrant sex workers may participate in future legal reform. Analysts have generally offered two explanations for China's no-devaluation policy during the Asian financial crisis. The first is China's good economic fundamentals and the renminbi is not fully convertible. The second is China's foreign relations' imperative. China was endeavouring to seek favourable entry conditions into the WTO and improve relations with its Asian neighbours. At the same time it sought to exploit the undercurrent of resentment in Asia towards the role played by the US during the crisis. Policy making in (...) China has become more institutionalized in the post-Deng era, but these explanations ignore the role of China's domestic bureaucratic actors in exchange rate policy making. This paper examines the exchange rate regime preferences of China's key economic ministries and their influences in exchange rate policy making and argues that Party leaders were able to adopt a no-devaluation policy throughout the crisis because China's key economic ministries actively supported or acquiesced to that policy. Hitchcock advances a diachronic Dutch Book argument (DDB) for a 1/3 answer to the Sleeping Beauty problem. Bradley and Leitgeb argue that Hitchcock’s DDB argument fails. We demonstrate the following: (a) Bradley and Leitgeb’s criticism of Hitchcock is unconvincing; (b) nonetheless, there are serious reasons to worry about the success of Hitchcock’s argument; (c) however, it is possible to construct a new DDB for 1/3 about which such worries cannot be raised.

According to Hume’s principle, a sentence of the form ⌜The number of Fs = the number of Gs⌝ is true if and only if the Fs are bijectively correlatable to the Gs. Neo-Fregeans maintain that this principle provides an implicit definition of the notion of cardinal number that vindicates a platonist construal of such numerical equations. Based on a clarification of the explanatory status of Hume’s principle, I will provide an argument in favour of a nominalist construal of numerical equations. (...) The neo-Fregean objections to such a construal will be examined and rejected. And the implications of the nominalist construal for the use of numerals and for the understanding of ontological questions for the existence of numbers will be spelled out. (shrink)
