Patient visits are an important opportunity for general practitioners to discuss the risks of smoking and cessation strategies. In Australia, the guidelines on cessation published by the Royal Australian College of General Practitioners represent a key resource for GPs in this regard. The predominant message of the Guidelines is that pharmacotherapy should be recommended as first-line therapy for smokers expressing an interest in quitting. This, however, ignores established evidence about the success of unassisted quitting. Our analysis of the Guidelines identifies (...) a number of potential conflicts of interest which may have affected the advice provided. These include extensive funding by the pharmaceutical industry of sources cited to support the recommendations, and relations between members of the Guidelines Content Advisory Group and the pharmaceutical industry. Recommendations issued by professional bodies have enormous potential impact upon public health and there is a need for the highest levels of scrutiny and transparency in their development. Information about research cited in guidelines should include funding sources, and developers should be free of obvious conflicts of interest. Smoking remains the leading preventable cause of global mortality. Concerns related to pharmaceutical industry funding of research, scientific integrity and recommendations on smoking cessation by medical advisory groups clearly have implications beyond Australia. Italian philosopher Giorgio Agamben—whose work has influenced intellectuals in political theory, political philosophy, legal theory, literature, and art—stands among the foremost intellectual figures of the modern era. Engaging with a range of thinkers from Carl Schmitt and Martin Heidegger to Jacques Rancière and Alain Badiou, Agamben considers some of the most pressing issues in recent history and politics. His work explores the relationship between the sovereign state and the politically marginalized _Homo Sacer_—exiles, refugees, prisoners of war, and others whom the (...) state actively excludes from political participation and full humanity. Further, his critique of the increasing deployment of a “state of exception”—the declaration of a state of emergency that legitimizes the sovereign state’s suspension of law for the public good—as a dominant paradigm for governing has particular power in today’s global political climate. Infused with the spirit of Agamben’s critical self-reflection, this special issue of _SAQ_ examines his seminal works _Homo Sacer_, _The Open_, and _State of Exception_. Some contributors use Agamben’s work to examine the history of abortion law in the West, the history of slavery, and women’s rights. This paper compares two alternative explanations of pragmatic encroachment on knowledge (i.e., the claim that whether an agent knows that p can depend on pragmatic factors). After reviewing the evidence for such pragmatic encroachment, we ask how it is best explained, assuming it obtains. Several authors have recently argued that the best explanation is provided by a particular account of belief, which we call pragmatic credal reductivism. On this view, what it is for an agent to believe a proposition is (...) for her credence in this proposition to be above a certain threshold, a threshold that varies depending on pragmatic factors. We show that while this account of belief can provide an elegant explanation of pragmatic encroachment on knowledge, it is not alone in doing so, for an alternative account of belief, which we call the reasoning disposition account, can do so as well. And the latter account, we argue, is far more plausible than pragmatic credal reductivism, since it accords far better with a number of claims about belief that are very hard to deny. (shrink)

John Rawls' Difference Principle has been well known since his early papers on distributive justice, and has taken on renewed interest with the publication ofA Theory of Justice. The principle is one I find attractive, but I am skeptical of the arguments heretofore put forward in its defence. Here I will outline an entirely different defence which, while it may yield Rawls' desired conclusion, leaves one with a rather different picture from his of the place of the Difference Principle in (...) the theory of distributive justice. The connections between forms of code and coding and the many crises that currently afflict the contemporary world run deep. Code and crisis in our time mutually define, and seemingly prolong, each other in ‘infinite branching graphs’ of decision problems. There is a growing academic literature that investigates digital code and software from a wide range of perspectives –power, subjectivity, governmentality, urban life, surveillance and control, biopolitics or neoliberal capitalism. The various strands in this literature are reflected in the papers (...) that comprise this special issue. They address topics ranging from social networks, mass media, financial markets and academic plagiarism to highway engineering in relation to the dynamics and diversity of crises. Against this backdrop, the purpose of this essay is to highlight and explore some of the underlying themes connecting codes and codings and the production and apprehension of ‘crisis’. We analyse how the ever-increasing intermediation of contemporary life by codes of various kinds has been closely shadowed by a proliferation of crises. We discuss three related aspects of the coupling of code and crisis (signification, performativity and excess) running across these seemingly diverse topics. We and the other contributors in this special issue seek to go beyond the restricted (and often restricting) understanding of code as the language of machines. Rather, we view code qua programs and algorithms as epitomizing a much broader phenomenon. The codes that we live, and that we live by, also tell us about the ways in which the ‘will to power’ and the 'will to knowledge' tend to be enacted in the contemporary world. (shrink)

One of the most interesting jurists of the post-World War II era, Ross [1899-1979] was a legal and moral philosopher, scholar of international law and the leading representative of Scandinavian Legal Realism. This book and On Law and Justice (...) (1958) are his principal works. In Directives and Norms Ross asks whether imperatives (or, to use his term, 'directives') are subject to logic in the same way as indicatives. He shows the difference between indicative and directive discourse and explains the concepts 'directive' and 'norm' as they function in the social sciences, especially in the study of law. A contemporary essay in the Modern Law Review (32:544), though critical of this work, was still impressed by its "clear and convincing account" of these processes. (shrink)

The understanding of the primary-secondary quality distinction has shifted focus from the mechanical philosophers’ proposal of primary qualities as explanatorily fundamental to current theorists’ proposal of secondary qualities as metaphysically perceiver dependent. The chapter critically examines this shift and current arguments to uphold the primary-secondary quality distinction on the basis of the perceiver dependence of color; one focus of the discussion is the role of qualia in these arguments. It then describes and criticizes reasons for characterizing color, smell, taste, sound, (...) and warmth and color as secondary qualities on the basis of our commonsense divisions among sensory modalities; Grice’s proposal for distinguishing among the sensory modalities is focal here. The general conclusion is that reasons for drawing the primary-secondary quality distinction are unconvincing. (shrink)

The study of social norms sprawls across all of the social sciences but the the concept lacks a unified conception and formal theory. We synthesize an account that can be applied generally, at the social scale of analysis, and can be applied to empirical evidence generated in field and lab experiments. More specifically, we provide new analysis on representing norms for application in empirical political science, and in parts of economics that do not follow the recent trend among some behavioral (...) economists to build models of the cognitive and motivational states of individuals taken “one at a time”. Foundational sources for our project are Bicchieri (2006, 2017), Kuran (1995), and Stirling (2012, 2016). From Bicchieri take that a norm exists in a social structure when a significant networked subset of individuals share descriptive and injunctive expectations that it regulates their interactions. From Kuran we take the insight that prevailing norms may come to be widely disliked by participants in networks but survive because norm suppress public displays of disenchantment. From Stirling we apply conditional game theory (CGT) to provide the technical resources for building our model of a norm-regulated social interaction. This chapter examines the spectrum inversion hypothesis as an argument against certain kinds of account of what it’s like to be conscious of color. The hypothesis aims to provide a counterexample to accounts of what it’s like to be conscious of color in non-qualitative terms, as well as to accounts of what it’s like to be conscious of color in terms of the representational content of conscious visual states (which, according to some philosophers, is in turn given an account in (...) non-qualitative terms). I explain the hypothesis’s reasoning in sections 1 and 2. I then take up background issues: since the counterexample provided by the hypothesis is typically given as a possibility rather than an actuality, I briefly discuss the kind of possibility involved in section 3, and the methodologies used to evaluate the plausibility of possibilities in section 4. In section 5, I describe some general considerations that are commonly used against the spectrum inversion hypothesis. I take up attempts to support the hypothesis with findings from color science in section 6. I end with comments skeptical of both the motivation for the spectrum inversion hypothesis and the methodology used to support it. (shrink)

The place and impact of large, elite business schools is hotly debated. Compared to such establishments, little has been written about smaller, regional, community-oriented business schools that serve and interact with their various communities at home or abroad. Focusing on one of the smaller regional business schools in the UK, and incorporating perspectives from further afield, this book seeks to redress that balance. This local focus enables a more holistic understanding of what really goes on in terms of the complex (...) relationships, practices, challenges and contexts at play in such an arena. The book, conceived throughout the Covid-19 pandemic, reverberates with a multiplicity of voices, perspectives and narratives, and reflects a process of collaborative autoethnography and critical friendship. In this paper, we give an account of some of the necessary conditions for an effectively functioning public sphere, and then explore the question of whether these conditions allow for the expression of ideas and values that are fundamentally incompatible with those of liberalism. We argue that speakers who advocate or glorify violence against democratic institutions fall outside the parameters of what constitutes legitimate public debate and may in fact undermine the conditions necessary for the flourishing of free speech and (...) public dialogue more generally. In this paper I analyse the implications of “flattening” the curve for long-term care residents in the Province of Ontario, Canada during the first wave of the SARS-CoV-2/COVID-19 pandemic. I then question what the role of healthcare systems are in the response to public health emergencies and problematize their status as entities in need of protection. The ethical implications of this are discussed in light of potential challenges raised by climate change.

In this incisive political analysis, Kristin Ross thinks through everyday existence across a range of practices-from philosophy to history, from the visual arts to popular fiction-and across the forms taken by collective political action in contemporary struggles. Ross returns to Henri Lefebvre's powerful intuition that ordinary life is both residue and resource, the site of profound alienation and, by the same token, the origin of all emancipatory initiatives and desires.

This book examines the ways that Heidegger, Lacoue-Labarthe, and Nancy adopt and reconfigure the Kantian understanding of "aesthetic presentation." In Kant, "aesthetic presentation" is understood in a technical sense as a specific mode of experience within a typology of different spheres of experience. This study argues that Heidegger, Lacoue-Labarthe, and Nancy generalize the elements of this specific mode of experience so that the aesthetic attitude and the vocabulary used by Kant to describe it are brought to bear on things in (...) general. The book goes beyond documenting the well-known influence of Kant's Critique of Judgment , however, to open up a new way of approaching some of the central issues in post-Kantian thought—including why it is that art, the art work, and the aesthetic are still available as a vehicle of critique even, or especially, after Auschwitz. It shows that a genealogy of contemporary theory needs to look at the question of presentation, which has arguably been a question that has worried philosophy from its very beginning. (shrink)

Guala notes that low-cost punishment is the main mechanism that deters free-riding in small human communities. This mechanism is complemented by unusual human vulnerability to gossip. Defenders of an evolutionary discontinuity supporting human sociality might seize on this as an alternative to enjoyment of moralistic aggression as a special adaptation. However, the more basic adaptation of language likely suffices.

The symptom (which here refers to both the clinical or ‘objective’ sign, that is, the sign that physicians believe cannot lie, and the patient’s subjective revelation of disorder, which is always considered suspect) has been relegated by a number of semioticians to a category of signs often considered of little consequence, a ‘natural’ sign signaling some specific condition or state within the body whose object stands in a strictly biological and securely determined relationship to the symptom. I believe the symptom, (...) however, is deep, rich, and symbolic in every sense, signifying the misadventures of a body impaled by its perceptual skills and history within its own unique Umwelt or sign-world. Unfortunately, the notion of a sign which reflects biologically coded events alone suggests the body is without the ability to think, learn, and produce a story of unlimited semiosis. This should seem especially problematic to those biosemioticians who find analogic codes of much greater importance than the supposedly digital codes of DNA. I suggest that the disordered and disorderly body and the Umwelt within which it survives offer biosemioticians and those who pursue semiotic models in other disciplines an important opportunity to jointly and more fully explore the experienced world of health and illness, a world in which culture and nature are fully interpenetrated.
