Cultural values influence how people understand illness and dying, and impact their responses to diagnosis and treatment, yet end-of-life care is rooted in white, middle class values. Faith, hope, and belief in God’s healing power are central to most African Americans, yet life-preserving care is considered “aggressive” by the healthcare system, and families are pressured to cease it.

Abstract. Darwinism has attracted proportionately less attention from Jewish thinkers than from Christian thinkers. One significant reason for the disparity is that the theodicies created by Jews to contend with the catastrophes which punctuated Jewish history are equally suited to address the massive extinctions which characterize natural history. Theologies of divine hiddenness, restraint, and radical immanence, coming together in the sixteenth-century mystical cosmogony of Isaac Luria, have been rehabilitated and reworked by modern Jewish thinkers in the post-Darwin era.

Moral Entanglements: Conserving Birds in Britain and Germany, by Stefan Bargheer, claims that work and play orientations have respectively organized German and British wild bird conservation efforts. The book argues that work and play are nonmoral categories, and—more broadly—that moral justifications for action should be understood as mere post-hoc surface phenomena that contribute little to social action. The new French pragmatic sociology provides conceptual tools to examine how categories like work and play intertwine with logics of moral evaluation that define (...) what activities rightly qualify as each category, what public goods might each yield, and what value ought to be attached to them. With this approach in mind, this review examines Moral Entanglements’ claims, and identifies ways in which moral logics did indeed play a role in establishing different bird conservation styles in each country. The review highlights the broader importance for comparative-historical sociologists to take moral repertoires into account as they reconstruct historical institutional emergence. (shrink)

The texts of Walid Daka, a Palestinian political prisoner incarcerated since 1986, challenge the notion that colonial power ends with decolonization and expose the shortcomings of examining colonial prisons solely through the eliminatory prism of death and deprivation. Studying Daka’s texts, the article presents how the Israeli carceral system has managed to utilize prisoners’ hopes and longings – in their relations with one another, their political actions such as hunger strikes or their building of internal leadership hierarchies, and their affective (...) worlds – to further its own goals. Rather than a pessimistic account, this article critically analyzes Daka’s writings to demonstrate how a first-person study of carceral subjectification can unfold within an activist framework. Daka uses these observations to develop an alternative articulation of decolonization that I term ‘abolitionist decolonization’ as a collective and continued insistence on setting the terms of getting free. By ‘abolitionist decolonization,’ I conjure a difficult conversation between a Fanonian project of never-ending decolonization and a Foucauldian project of never-ending abolition. As such, this critical attitude aims to counter settler-colonial carcerality in ways that will foil the administration’s attempts to reproduce the dangers that the prisoners seek to elude, through the very means they deploy to elude them. The adversarial legal system is traditionally praised for its normative appeal: it protects individual rights; ensures an equal, impartial, and consistent application of the law; and, most importantly, its competitive structure facilitates the discovery of truth – both in terms of the facts, and in terms of the correct interpretation of the law. At the same time, legal representation is allocated as a commodity, bought and sold in the market: the more one pays, the better legal representation one gets. In (...) this article, I argue that the integration of a market in legal representation with the adversarial system undercuts the very normative justifications on which the system is based. Furthermore, I argue that there are two implicit conditions, which are currently unmet, but are required for the standard justifications to hold: that there is (equal opportunity for) equality of legal representation between parties, and that each party has (equal opportunity for) a sufficient level of legal representation. I, therefore, outline an ideal proposal for reform that would satisfy these conditions. (shrink)

Compassion is acknowledged as a key motivational source of prosocial opportunity recognition. This study examines the underlying processes of different types of compassion that lead to prosocial OR interventions designed to solve or ameliorate social problems. Self-compassion is associated with intimate personal experiences of suffering and encompasses a desire to alleviate the distress of others based on common humanity, mental distance and mindfulness. Other-regarding compassion is associated with value structures and social awareness and is based on a desire to help (...) the less fortunate. Using a life-story analyses of 27 Israeli social entrepreneurs, we identified two OR process mechanisms, reflexivity and imprinting. The relationship between these two types of compassion are equifinal, that is, both can lead to prosocial OR; however, the mechanisms differ. We contribute to the literature by showing that compassion serves as an internal enabler based on both cognitive and affective motivations for prosocial OR. We introduce a theoretical perspective that establishes a process model for further research on the role of compassion in identifying and leading prosocial action. (shrink)

I offer a novel distinction between two concepts of competition. The first, parallel competition, is designed to create separate pathways for each competitor wherein they can maximize their performance. The second, friction competition, is designed to facilitate a clash between competitors. Each concept is utilized as an institutional mechanism to generate social benefits. In parallel competition, the social benefit is the result of the aggregation of the independent efforts of each competitor. In friction competition, it emerges from the clash between (...) competitors. I argue that this distinction carries significant normative implications concerning debates over equality, freedom, and democratic institutional design. (shrink)

This study evaluated the potential contribution of extrageniculate visual pathways to oculomotor orienting reflexes in hemianopic patients. It tested whether extrageniculate pathways mediate inhibition of return —a phenomenon characterized by slowed target detections at recently stimulated locations . Because hemianopic subjects cannot overtly respond to stimuli presented within their hemianopic field, we utilized a spatial cueing paradigm that capitalized on the fact that IOR operates in spatiotopic coordinates. Subjects moved their eyes so that a cue and a target presented at (...) the same spatial location were imaged successively onto blind and seeing portions of their retinas. One hemianopic patient showed a similar IOR effect from cues presented within both the seeing and the hemianopic fields. With a second hemianopic patient, only presentations of the cue to the subject's seeing field produced IOR. The explanation for this discrepancy is not evident. These observations highlight both the potential value and the pitfalls inherent in using “blindsight” as a window into human consciousness. (shrink)

Recent years have seen numerous sociological disagreements devolve into heated debates, with scholars openly accusing their peers of being both empirically wrong and morally misguided. While social scientists routinely reflect on the ethical implications of certain research assumptions and data collection methods, the sociology of knowledge production has said little about how moral debates over scholarship shape subsequent research trajectories. Drawing on the new French pragmatic sociology, this article examines how sociologists respond to criticisms of the moral worth of their (...) research. The article outlines three typical responses: (1) accepting the criticism and changing direction completely; (2) accepting the criticism but changing discursive framing to incorporate existing research without being subject to critique; and (3) navigating through the debate by devising new research directions that do not trigger such criticism. To demonstrate, the article looks at how sociologists of religion responded, in their published scholarship, to criticisms of secularization theory as depreciating religious people and spiritual experience. Across the responses, we show that sociologists have included moral considerations in their empirical investigations, and have switched among several diverse moral justifications to address—and also avoid—criticism. We conclude by demonstrating that this model can be extended to other domains of sociological inquiry, including the study of gender-based wage inequality and methodological nationalism. The article highlights the importance of mapping the moral frameworks sociologists use for the sociology of knowledge and the sociology of morality. (shrink)

At a moment when popular discourse is saturated with voices confronting each other about not being critical enough, while academic discourses proclaim to have moved past critique, this provocative book reawakens the foundational question of what 'critique' is in the first place. Roy Ben-Shai inspects critique as an orientation of critical thinking, probing its structures and assumptions, its limits and its risks, its history and its possibilities. The book is a (...) journey through a landscape of ideas, images, and texts from diverse sources - theological, psychological, etymological, and artistic, but mainly across the history of philosophy, from Plato and Saint Augustine, through Kant and Hegel, Marx and Heidegger, up to contemporary critical theory. Along the way, Ben-Shai invites the reader to examine their own orientation of thought, even at the moment of reading the book; to question popular discourse; and to revisit the philosophical canon, revealing affinities among often antagonistic traditions, such as Catholicism and Marxism. Most importantly, Critique of Critique sets the ground for an examination of alternative orientations of critical thinking, other ways of inhabiting and grasping the world. (shrink)

A well-known objection to prioritarianism, famously levelled by Mike Otsuka and Alex Voorhoeve, is that it wrongly ignores the unity of the individual in treating intra-personal cases like inter-personal cases. In this paper we accept that there should be a moral shift between these cases, but argue that this is because autonomy is a relevant consideration in intra-personal but not inter-personal cases, and one to which pluralist prioritarians ought to attend. To avoid this response, Otsuka and Voorhoeve must assume we (...) know nothing about the subjective information of the person being chosen for. But we show that this commits them to two controversial assumptions: that welfare consists in an objective list of goods, and – if one accepts an unorthodox but plausible account of the relationship between risk aversion and rationality – that there is only a narrow range of rational risk aversions. Only prioritarians who accept both these assumptions are on the hook of Otsuka and Voorhoeve’s objection; for all others, the examples have insufficient information, and so lose their sting. This paper presents three basic ideas which are interrelated with one another: 1) The assertion that a single subject unites all the discussions in Sefer Yezirah, from beginning to end: namely, the nature of Wisdom, upon which the world stands (or is suspended); 2) A stylistic-linguistic analysis leading to the division of Sefer Yezirah into three “accounts,” around which are crystallized the style and contents of the book as a whole. The Account of the “Sealing of the Ends” is the (...) latest of these accounts, and was written by the editor of the book, who joined his account with the other two to form a single book; 3) The assertion that the worldview reflected in Sefer Yezirah acknowledges the existence of a secondary power alongside God, that assists Him in the Creation and ongoing existence of the universe (as against doctrines claiming the existence of an additional force in conflict with God). The term I use in this context is binitarianism. In the earliest of the three accounts, that of the Covenant, this power assumes the form of an angel, while in the other two it is more abstract. This paper lays the foundations for this claim but, due to the limitations of this paper, I do not enter into discussion of its far-reaching implications. Background Nurses have an essential role in caring for end-of-life patients. Nevertheless, the nurse’s involvement in the passive euthanasia decision-making process is insufficient and lower than expected. Objectives To explore factors associated with nurses’ intention to be involved in non-treatment decisions (NTD) regarding passive euthanasia decision-making versus their involvement in the palliative care of patients requesting euthanasia, using the Theory of Planned Behavior (TPB) framework. Design A cross-sectional study utilizing a random sample. Participants and research context The study was conducted (...) in one of the largest hospitals in Israel among 125 nurses employed in internal and surgical care wards. Data was collected through face-to-face interviews between March and April 2019. Method A closed structured questionnaire was developed according to TPB instructions. A paired sample t test and two multiple hierarchical regressions were conducted. Variance explained (R2) and the significance of F change were calculated for each regression. The study used the STROBE statement guideline. Ethical considerations The study was approved by the hospital’s Helsinki Committee (#20.11.2017). Findings A paired sample t test revealed that nurses’ involvement in the palliative care of patients requesting passive euthanasia was significantly higher than in NTD regarding euthanasia. Regression analyses revealed that nurses’ position and attitudes explain their intention to be involved in decision-making; attitudes and perceived behavioral control explain nurses’ intention to be involved in the care of patients requesting euthanasia. Conclusions According to the TPB, nurses’ attitudes explained their intention to participate in decision-making regarding passive euthanasia. It is recommended to enhance open discussion of this complex issue to encourage nurses’ willingness to participate in NTD decision-making regarding euthanasia. (shrink)

The success of popular women's fiction requires a mode of analysis that is able to reveal the patterns across this category in order to better understand the appeal of these books. Popular fiction, like chick-lit, can be contradictorily framed as simultaneously constituting one, as well as many genres, if a genre is the codification of discursive properties. It may consist of romances, thrillers, romantic suspense and so forth in terms of its discursive properties, but popular women's fiction will also have (...) a pattern of similarity that cuts across these forms – that similarity, I will suggest, lies in the idea of pleasure as a genre of affect that ties various popular fictions together, thereby acting as a type of imperial genre. Pleasure is so ubiquitous and so diverse across the multiple forms that constitute popular women's fiction that I argue it has become a genre in itself. This is, however, not a genre that limits itself to one particular stylistic form, but rather, as a dynamic social construct, it has become a genre of affect that invokes feelings of pleasure. Nthikeng Mohlele's most recent novel, Pleasure, exemplifies the applicability and plasticity of the concept of pleasure, allowing me to examine this work as a type of fictionalised theory which I then apply to South African chick-lit texts: the Trinity series by Fiona Snyckers and Happiness Is a Four-Letter Word by Cynthia Jele. Mohiele's expansive theorisation of pleasure is inherently local in that it is depicted at the level of experience and imagination; yet it is simultaneously macro and global in the connections made to deeply political circuits of identity-based oppressions and structural inequalities. Mohlele reveals the mobility of pleasure as a genre that offers an opportunity to think through the circuits that connect popular fiction through the lens of African literature. (shrink)

This book explores dialogue as a transformative form of philosophical practice by unveiling the method behind the unique dialogue developed by mystic and thinker Jiddu Krishnamurti (1895–1986). While Krishnamurti himself generally rejected the cultivation of systems and techniques, Shai Tubali argues that there are easily identifiable patterns through which Krishnamurti strove to realize his dialogical aims. For this reason, he refers to this method, whose existence has evaded Krishnamurti’s followers and scholars alike, as the Krishnamurti dialogue. He suggests that (...) these discursive patterns serve to broaden our understanding of the possibilities of philosophical and religious dialogues and further illuminate established forms of dynamic discourse, such as the Socratic method. Inspired by Pierre Hadot’s revolutionary reading of the classical Greco-Roman texts, the author centers his attention on Plato’s Socratic dialogues and the guru–disciple conversations in the Hindu Upanishads, which fall within the scope of what may be termed ‘the transformative dialogue’: dialogues that have been written with the intention of bringing about a transformation in the mind of the interlocutor and reader and reorienting their way of life. This text appeals to students as well as researchers and suggests that the Krishnamurti dialogue is not only a continuation and development of the transformative dialogue, but that it also amalgamates ingredients of classical Western philosophy and South Asian mysticism. Moreover, this type of dialogue encourages readers to revisit the lost practice of transformative philosophy, in that it reveals new pathways of philosophical and religious inquiry that bear thought-provoking practical implications. This study explores how therapists deal with ethical dilemmas in psychotherapy with older adults. Semi-structured interviews were conducted with 14 therapists and analyzed using grounded theory methodology. Findings clustered around three themes: (i) respecting autonomy when interacting with family of vulnerable and dependent older patients; (ii) prioritizing respecting autonomy in risk situations and in suspected financial abuse without impaired judgment; and (iii) prioritizing protecting the patient in risk situations of patients with dementia and of suspected physical abuse or neglect. Recent years have witnessed an intensification of historical and philosophical research on the link between psychotropic drugs and psychiatric theories. For example, Kendler and Schaffner detailed how the dopamine hypothesis of schizophrenia was intimately linked to the dopamine theory of antipsychotic drug action. Here, a related case is explored: the use of antidepressants' neurochemical effects to speculate about the pathophysiology of depression.This rationale was central to American psychiatrist Schildkraut's landmark article on the catecholamine hypothesis of affective disorders. Biomedicine is typically defined as the branch of medicine that is based on the principles of biology and biochemistry. A central tenet for biomedicine is the notion of disease and therapeutic specificity, i.e. the idea of tailored treatments for discrete disorders underpinned by specific pathologies. The present paper is concerned with how notions of disease and therapeutic specificity guide biomedical reasoning. To that end, the author proposes a model – the specificity triad – that draws on late philosopher and physician (...) Ludwik Fleck’s concept of “style of thought” to offer a frame for investigating the intricate process through which links between disorders, mechanisms, and therapeutics are established by biomedicine. Next by applying the specificity triad model to scrutinize research efforts in two discrete areas of medicine—psychiatry and regenerative medicine—this paper seeks to stimulate pertinent discussions in and about biomedicine. These include discussions on the ambiguous epistemic status of psychiatry within contemporary biomedicine, as well as the relationship between developmental biology — historically relatively disjointed from biomedical enterprise — and the burgeoning field of regenerative medicine. Although a great deal of literature has looked at how individuals respond to stigma, far less has been written about how professional groups address challenges to their self-perception as abiding by clear moral standards. In this paper, we ask how professional group members maintain a positive self-perception in the face of moral stigma. Drawing on pragmatic and cultural sociology, we claim that professional communities hold narratives that link various aspects of the work their members perform with specific understanding of the (...) common good. These narratives allow professionals to maintain a shared view of their work as benefitting society and to perceive themselves as moral individuals. As a case study, we focus on the advertising industry, which has long been stigmatized as complicit in exploitative capitalist mechanisms and cultural degradation. We draw on nine total months of fieldwork and seventy-four interviews across three US advertising agencies. We find that advertising practitioners use narratives to present their work as contributing to the common good, depicting themselves as moral individuals who care about others in the process. We analyze three prevalent narratives: the account-driven narrative, which links moral virtue to caring for clients; the creative-driven narrative, which ties caring to the production of meaningful advertisements; and the strategic-driven narrative, which sees caring in finding meaningful relationships for consumers and brands. The Phaedo’s intense preoccupation with the notions of self-liberation and self-transcendence in the face of death is strikingly reminiscent of Hindu and Buddhist philosophies. It is therefore not surprising that comparative philosophers have shown great interest in comparing this particular Platonic work to various South Asian texts: The Phaedo has been compared to the philosophy underlying yoga and Patanjali, The Tibetan Book of the Dead, and Mahāparinibbāṇa Sutta, the canonical account of the Buddha’s final days. Of particular relevance is the (...) Katha Upanishad, which shares with the Phaedo enough common features, both textual and structural and thematic, for a comparative analysis to be fruitful. These striking resemblances enable me to bring important dissimilarities in the dialogical processes into focus— dissimilarities which have much to convey to us philosophically. These dissimilarities demonstrate that although the two traditions engaged in transformative ideas and practices that centered on the liberation of the soul, there is still a substantial difference between the nature of the philosophy celebrated by the Greeks and the mystical thought developed by the Upanishadic sages. The paper suggests a novel methodology for determining the state of legal doctrine on a particular issue by legal scholars. This methodology is inspired by the philosophical field of phenomenology. In particular, the tool of eidetic reduction developed by Edmund Husserl is applied to reach inter-subjectively valid assessments of doctrine. The methodology developed here argues that scholars who wish to discover legal doctrine on a particular issue need to first define general paradigms that explain the relevant legal field. Then, they (...) should develop a hypothesis about the law on the particular issue that concurs with the essential qualities of all these paradigms. Finally, to determine if a hypothesis about the content of the law should be accepted or rejected, it must be checked against legal sources that often include judgments. Reasoning by analogy should be used to learn from judgments with the same policy implications as the doctrine suggested by the hypothesis. The paper offers several heuristics—demonstrated with examples from international law—that can be used to find judgments that have the same policy implications without determining conclusively what these implications are. International courts strive to enhance their legitimacy, that is, they would like the members of the international community to perceive their judgments as just, correct and unbiased even if they do not agree with their specific content. This Article argues that international courts take into account the actors they interact with, the norms they apply, and the conditions they operate under as they try to enhance their legitimacy. It demonstrates strategic behavior towards that end in the judgments of two prominent (...) international courts - the International Court of Justice and the European Court of Human Rights. International courts interact with states under their jurisdiction and with their national courts. International courts try to preserve their legitimacy vis-à-vis states; at the same time, they want to signal that states will comply with them even if they issue judgments states disagree with. International courts can cooperate with national courts and gain legitimacy from interacting with legitimate national courts. The norms that international courts apply constrain their ability to maneuver their judgments in ways that can help their legitimacy, but at the same time help legitimize their judgments. International courts use various tactics to shape their reasoning in order to improve their legitimacy. The behavior of international courts is scrutinized by the domestic public within each state. That public has certain agendas, priorities and preferences. The domestic public’s agenda is a condition that the court must respond to, but sometimes courts can also shape that agenda to their benefit. (shrink)

The paper uses the controversy about liberty between the philosopher Thomas Hobbes and Archbishop John Bramhall to illustrate the conflict between the rhetoric of philosophy and the rhetoric of religion. The first part of the paper introduces initial definitions of these two types of rhetoric. The following three parts deal with three distinct parts of the controversy, as Hobbes and Bramhall define them: to the reader, arguments from scripture, and arguments from reason. The fact that Hobbes and Bramhall themselves divide (...) the arguments into those from scripture and those from reason makes this controversy a good illustration of the conflict between rhetoric of philosophy and rhetoric of religion. The rhetorical perspective exposes the epistemological conflict between philosophy and religion that the philosophical discourse often blurs. It is a conflict that concerns the basic attitude of an individual towards the truth as a believer or as a thinker. The rhetoric of philosophy assumes that human understanding defines the truth and therefore gives priority to arguments from reason as they address that understanding. The rhetoric of religion assumes that truth is beyond human understanding and can only be revealed by faith and therefore gives priority to arguments from scripture as they address human faith. The reader may join the opponents in asking whether human liberty is a philosophical issue and therefore subject to arguments from reason or a theological one, subject to arguments from scripture. There is common agreement that preschool-level science education affects children’s curiosity, their positive approach towards science, and their desire to engage with the subject. Children’s natural curiosity drives them to engage enthusiastically in all forms of exploration. Engaging in scientific exploration necessitates self-regulation capabilities and a wide repertoire of cognitive and metacognitive strategies. The purpose of this study was to examine to what extent preschoolers (aged 5‒6 years) implement nascent inquiry skills, metacognitive awareness, and self-regulation capabilities during play-based scientific exploration (...) tasks. An additional purpose was to investigate the relationships between these capabilities, a relationship not yet investigated in the context of play-based, scientific exploration among young children. The study consisted of 215 preschoolers, from 10 preschools. For this study, we developed two scientific exploration tasks—structured and open-ended. Our motivation was to examine whether preschoolers’ capabilities will differ in the context of structured task which is aligned with the view that young children need guidance and explicit instructions compared to the context of open-ended, play-based task–allowing the children to apply and test their intuitive theories and skills. During performance participants were videotaped. Their verbal and non-verbal responses were analyzed by means of a scoring scheme. The results of a micro-analysis of about 100 hours of video showed that given the opportunity, even without setting explicit goals and instructions, children exhibit inquiry capabilities: they ask questions, plan, hypothesize, use tools, draw conclusions. Asking questions and planning were better manifested during the structured task. Children also manifested higher levels of attention, persistence, and autonomy during the structured task. However, significant higher scores of self-regulation indications were revealed in the context of the open-ended, play-based, exploration task. Moreover, results indicate significant correlations between the five measures of preschoolers’ inquiry capabilities and measures of metacognitive strategic awareness and self-regulation. The results of the present study suggest the importance of combining various learning environments and experiences in early science education that encourage children to engage in structured exploration alongside play-based, open-ended, exploration.
