Hegel's India presents all of Hegels writings on and about India. It is remarkable how much effort Hegel expended on what he ultimately characterized merely as fantastic, subjective, wild, dreamy, frenzied, absurd, and repetitive. If Indian art, religion, and philosophy, are so grossly inadequate, what explains his life-long fascination in this unparalleled way? This reinterpretation of Hegel argues that Indian thought haunted Hegel, representing a sort of nemesis to his own philosophy.

This article places Friedrich Nietzsche’s call to trans-valuate values into a wider historical panorama, hearkening back to ethical orientations within both the Archaic and the Attic Greek world with respect to the unity of the virtues. It is argued that the unity of cognitive and bodily excellence, so central to the Greek world, and culminating in Aristotle’s ethics, functioned inchoately as the measure according to which Nietzsche evaluated values. Extrapolating from the phenomenon of rival perceptions regarding the paradigmatic sculpture of (...) Rodin’s The Thinker—both from the time of its creation and in our own day—the article concludes by suggesting that moral philosophies alienated from the demand of the unity of physical and cognitive virtues might indeed be subject to the devastating critique that Nietzsche had advanced. As in any authentic dialogue, the introduction and the conclusion each claim victory for one of the sides by changing the very terms and rules of the dialogue, picturing it as a confrontation between emancipatory universalism and inefficient particularism, or as a split between hypocrisy and truth. The global justice debate has been raging for forty years. Not merely the terms and conditions, but, more deeply, the epistemic, existential and ethical grounds of the international relations of persons, states and institutions are being determined, debated and negotiated. Yet the debate remains essentially a parochial one, confined largely to Western intellectuals and institutional spaces. An Introduction to the field is therefore still urgently required, because it remains necessary to include more ‘global’ voices into this debate of worldwide reach (...) and significance. The book addresses this need in two closely related ways. In Part I, it introduces the main contours of the debate by reproducing three of the most fundamental and influential essays that have been composed on the topic — essays by Peter Singer, Thomas Pogge and Thomas Nagel. In Part II, it makes a decisive critical intervention in the main stream of the debate through exposing the participation deficit afflicting the theorization of global justice. This part begins with a well-known essay by Amartya Sen, who famously referred to the ‘parochialism’ of the global justice debate in making a break with the Rawlsian paradigm that has dominated the field until now. Finally, a series of lively essays newly composed for this volume reflect on the possibilities for deparochializing global justice opened up by Sen’s work in this area. Since the 1980s, developed countries, led by the United States and the countries of the European Union, have sought to incorporate intellectual property rights provisions into global trade agreements. These countries successfully negotiated the World Trade Organization's 1994 Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), which required developing countries to adopt intellectual property provisions comparable to developed countries. In this manuscript, we review the policy controversy surrounding TRIPS and examine the two main ethical arguments articulated in its support (...) — a theory of natural rights and a utilitarian argument. We contend that these theories provide insufficient bases for an intellectual property rights regime that compromises access to essential medicines in the developing world. While the policy community has engaged in active debate around the policy effects of TRIPS, scholars have not thoroughly considered the full ethical underpinnings of those policy arguments. We believe that a more robust understanding of the ethical implications of the agreement should inform policy discussions in the future. (shrink)

When one says, “I had a desire to have a glass of water and this was followed by my action to fetch the glass of water” then the common sense observation would assume that one’s mind caused this action. In this paper, I assume that there is a mind or there are ‘mental states’ which either belong to an enduring self or constitute a selfless stream of consciousness. I will provide the debate between Advaita Vedanta and Abhidharma Buddhism to present (...) this tension between enduring self and selfless stream of consciousness clearly. However, the aim of this paper is to look at how the mind is assumed to have causal powers. Is this assumption valid or not? Jaegwon Kim presents three problems that arise out of this assumption: “mental anomalism,” content externalism and causal exclusion. I shall look at these problems in detail in part I. In part II, I shall provide Buddhist arguments in favour of mind especially consciousness that can escape the reductionist arguments formulated by Kim by looking at the recent debates in contemporary physics especially quantum mechanics. Our concern in this paper lies with a common argument from racial discrimination to realism about races: some people are discriminated against for being members of a particular race (i.e., racial discrimination exists), so some people must be members of that race (i.e., races exist). Error theorists have long responded that we can explain racial discrimination in terms of racial attitudes alone, so we need not explain it in terms of race itself. But to date there has been little detailed (...) discussion of whether it is better to explain racial discrimination in terms of race or in terms of racial attitudes alone. Our goal is to offer a novel and detailed argument in defense of explaining racial discrimination in terms of racial attitudes alone, by attending to the neglected phenomenon of misperception discrimination, which involves differential treatment due to misperceived race. We argue that the discriminatory action in misperception cases must be explained in the same way as cases where (according to the realist) the victim’s race is accurately perceived. Thus, the victim’s actual race cannot provide the best explanation. The main upshot of our argument is that explanatory arguments from racial discrimination to realism about race fail. (shrink)

Violence risk assessment tools are increasingly used within criminal justice and forensic psychiatry, however there is little relevant, reliable and unbiased data regarding their predictive accuracy. We argue that such data are needed to (i) prevent excessive reliance on risk assessment scores, (ii) allow matching of different risk assessment tools to different contexts of application, (iii) protect against problematic forms of discrimination and stigmatisation, and (iv) ensure that contentious demographic variables are not prematurely removed from risk assessment tools.

Bhakti is a remarkable existential tendency that shows itself in the rich expanse of the tradition originating from the Vedas. Recognized as a prize possession of the religions, philosophies, and culture of India, it has often won fascination and admiration from students of Eastern heritage. However, its nature, role, and history remain misunderstood and have not received all the attention they deserve. Its role as a gatherer of life, love, thought, and the divine is missed in its partial characterizations as (...) “Hindu devotion” or “divine love” or “theism implicit in polytheism.” Its status as a perennial thematic concept of the Indian civilization is missed when its pervasiveness is overlooked by the cultural historians preoccupied primarily with its periodic eruptions. This paper unravels the diverse strands in the manifestations of the Prevention of Terrorism Act (POTA, 2002), focusing not only on law’s words, i.e. the rules, principles and procedures, and its interpretations in judgments, but also on its effects. Adopting the violence of jurisprudence approach, it eschews the dichotomy between law and violence, examining the ‘effects of legal force’, in particular, the ways in which law becomes an integral part of the organization of state violence. Through an examination of the (...) unfolding of POTA and laws dealing with ‘organized crime’ and ‘unlawful activities’ (Unlawful Activities Prevention Act, 1967, 2005), the trajectory of specific cases and judgments by Trial Courts, the High Courts and the Supreme Court, this paper shows how through an interlocking of the ordinary and extraordinary, anti-terror laws erode both the procedural and substantive aspects of the rule of law, become the terrain where permutations in alliance politics and configuration of power are played out, and assume an antagonistic notion of politics which seeks resolution through the elimination and externalization of difference. Extraordinary laws, it argues, are manifestations of a politics of negation. Processes that prolong the lives of such laws, and procedural interlocking and intermeshing that seek to give them permanence, are symptomatic of a deepening of the politics of negation. (shrink)

The Chinese rites controversy is typically characterized as a religious quarrel between different Catholic orders over whether it was permissible for Chinese converts to observe traditional rites and use the terms tian and shangdi to refer to the Christian God. As such, it is often argued that the conflict was shaped predominantly by the divergent theological attitudes between the rites-supporting Jesuits and their anti-rites opponents towards “accommodation.” By examining the Jesuit missionary Kilian Stumpf's Acta Pekinensia—a detailed chronicle of the papal (...) legate Charles-Thomas Maillard de Tournon's 1705–6 investigation into the controversy in Beijing—this article proposes that ostensibly religious disputes between Catholic orders consisted primarily of disagreements over ancient Chinese history. Stumpf's text shows that missionaries’ understandings of antiquity were constructed through their interpretations of ancient Chinese books and their interactions with the Kangxi Emperor. The article suggests that the historiographical characterization of the controversy as “religious” has its roots in the Vatican suppression of the rites, which served to erase the historical nature of the conflict exposed in the Acta Pekinensia. To the best of our current understanding, quantum mechanics is part of the most fundamental picture of the universe. It is natural to ask how pure and minimal this fundamental quantum description can be. The simplest quantum ontology is that of the Everett or Many-Worlds interpretation, based on a vector in Hilbert space and a Hamiltonian. Typically one also relies on some classical structure, such as space and local configuration variables within it, which then gets promoted to an algebra of (...) preferred observables. We argue that even such an algebra is unnecessary, and the most basic description of the world is given by the spectrum of the Hamiltonian and the components of some particular vector in Hilbert space. Everything else—including space and fields propagating on it—is emergent from these minimal elements. (shrink)

The aim of this article is to return to the concept of bricolage as theorized in 1962 by the French anthropologist Claude Lévi-Strauss and examine its presence and utility in the art and architectural history of the twentieth century. While Lévi-Strauss was the first theorist to present bricolage as an analogy for the creation of mythical thought among indigenous cultures, the concept has seen a wide range of conceptual, methodological and practical applications across different fields, including design, visual arts, urban (...) planning and the built environment. This article will examine the applicability of bricolage as a technical metaphor for the creative process and its relevance to artistic creation by tracing its trajectory over the course of the twentieth century. It will evaluate the significance of objects and events of ‘everyday life’ in the creative practices of contemporary artists, and draw attention to the emerging role of the architect as bricoleur or improviser, to conclude that it was the art of the ‘ordinary’ that gave creative inspiration to twentieth-century artists and architects to engage with the materiality and past experiences of the world. Early intervention aims to identify children or families at risk of poor health, and take preventative measures at an early stage, when intervention is more likely to succeed. EI is concerned with the just distribution of “life chances,” so that all children are given fair opportunity to realize their potential and lead a good life; EI policy design, therefore, invokes ethical questions about the balance of responsibilities between the state, society, and individuals in addressing inequalities. We analyze a corpus of (...) EI policy guidance to investigate explicit and implicit ethical arguments about who should be held morally responsible for safeguarding child health and well-being. We examine the implications of these claims and explore what it would mean to put the proposed policies into practice. We conclude with some remarks about the useful role that philosophical analysis can play in EI policy development. (shrink)

This essay argues that the concept of ‘racial capitalism’ can help us understand the connections between seemingly disparate parts of Voltaire’s extensive corpus of work. It contends that even though the Enlightenment’s racial politics abounded with contradictions and ambivalences, Voltaire stood out from his contemporaries. While the connections between his polygenism – the theory that humans of different races were created separately – and material investments in colonial commerce have long been debated by radical historians, this essay suggests that Voltaire’s (...) views about race’s relationship to labour were transformed by France’s colonial losses during the Seven Years’ War. The uniqueness of Psychiatry as a medical speciality lies in the fact that aside from tackling what it considers as illnesses, it has perchance to comment on and tackle many issues of social relevance as well. Whether this is advisable or not is another matter; but such a process is inevitable due to the inherent nature of the branch and the problems it deals with. Moreover this is at the root of the polarization of psychiatry into opposing psychosocial and biological (...) schools. This gets reflected in their visualization of scope, in definitions and in methodology as well. Whilst healthy criticism of one against the other school is necessary, there should be caution against hasty application of one's frame of reference to an approach that does not intend to follow, or conform to, one's methodology. This should be done within the referential framework of the school critically evaluated, with due consideration for its methods and concepts. Similarly, as at present, there is no evidence to prove one or the other of these approaches as better, aside from personal choice. We can say so even if there is a strong paradigm shift towards the biological at present. A renaissance of scientific psychoanalysis coupled with a perceptive neurobiology which can translate those insights into testable hypotheses holds the greatest promise for psychiatry in the future. This suggests the need for unification of diverse appearing approaches to get a more comprehensive and enlightened worldview. It requires a highly integrative capacity. Just as a physicist thinks simultaneously in terms of particles and waves, a psychiatrist must think of motives, emotions and desires in the same breath as neurobiology, genetics and psychopharmacology. However, the integration must be attempted without destroying the internal cohesiveness of the individual schools. This will give a fair chance for polarization in which a single proper approach in psychiatry could emerge, which may be a conglomerate of diverse appearing approaches of today, or one which supersedes the rest. A synthesis of cognitive psychology and neuroscience offers the greatest promise at present. (shrink)

In this article I focus on the `Mother' image in Sikh scripture, and explore her as the source of creation and wisdom. My re-imagining of the divine in Sikhism will offer a counter-balance to the prevailing androcentric attitudes and interpretations of malestream scholarship, and I also hope it will be a step towards counteracting the sexism festering within Sikh homes and the larger society.

Abstract:This article examines the use of astronomical chronology in Jesuit and secular works of history between the mid-seventeenth and mid-eighteenth centuries. It suggests that the highly visible adoption of astronomical records in historical scholarship in Enlightenment Europe by Nicolas Fréret and Voltaire was entangled with debates about Chinese chronology, translated by Jesuit missionaries. The article argues that the missionary Martino Martini's experience of the Manchu conquest of China was crucial in shaping his conception of history as a discipline.
