In a recent judgment1 the Court of Protection was highly critical of health professionals for continuing to provide clinically-assisted nutrition and hydration in the face of disagreement about the patient’s best interests, without seeking to resolve the issue. This hearing had been set up specifically to consider whether GU’s dignity had been properly protected, and if not why not, given concerns raised by the Official Solicitor about what she considered to be “a complete abrogation of responsibility to consider properly or (...) at all, and to determine whether it was in GU’s best interests and therefore lawful to continue to give him an invasive medical treatment, CANH.” In April 2014, at 63 years old and living in Thailand, GU sustained severe injuries after suffering from an electrocution accident. He sustained a cardiorespiratory arrest with a significant delay before cardiopulmonary resuscitation was started and was unconscious and unresponsive. In September 2014 he was transferred to the UK. In August 2018, GU’s brother made a request for a best interests decision concerning the continuation of CANH. The family met to discuss this and all except GU’s son, agreed that continuing CANH was not in GU’s best interests. In view of the fact that there was not unanimity among the family, a decision was made that CANH should continue. Commenting on this decision, Mr Justice Hayden said ‘the apparent assumption that in the face of family disagreement ‘ therefore will continue to be cared for by nursing staff ” is a troubling non sequitur’ and stressed that ‘family dissent to a medical consensus should never stand in the way of an incapacitated patients’ best interests being properly identified’. In parts of the world, discussion regarding COVID-19 has shifted towards endemicity, and questions of living with, rather than directly battling, the virus. As a result, ethical questions are being refocussed. The imperative is beginning to shift towards what we can learn from the pandemic, and how we can better prepare for future global outbreaks. Among the questions that need to be addressed is what Covid-29 has taught us about how research can be conducted ethically during major global public health (...) emergencies. It is widely accepted that research has an essential role to play in improving the effectiveness of health interventions in major public health crises.1 Even before COVID-19, a special series published in The Lancet highlighted the critical role of research in humanitarian crises, and lamented the paucity of good data on the effectiveness of health interventions in these particularly demanding contexts.2 The impact of expedited vaccine research on the mortality, morbidity and global disruption of the COVID-19 pandemic would be difficult to exaggerate. But it is clear that one important driver of vaccine hesitancy was public concern about the speed with which research into the vaccines was undertaken and hence the reliability of the data concerning their safety.3 Although for understandable reasons, the focus of attention on ethical research during the COVID-19 pandemic has been on vaccines and anti-virals, research in public health emergencies involves a wide range of activities designed to generate evidence, including social science research – which can be particularly critical in understanding barriers to vaccine uptake for example – along with epidemiological studies and health systems research. As the COVID-19 vaccine roll out continues apace, in the higher-income countries at least, concerns remain about the level of vaccine coverage in some health and social care settings. Although most countries have seen a relatively high uptake of vaccination against COVID-19 among staff, there continue to be some pockets of hesitancy. The risk of outbreaks in settings with potentially very vulnerable patients has led some governments across Europe to consider, or to introduce, measures compelling healthcare staff to be vaccinated. The justifiability of mandating the vaccination of healthcare professionals is a longstanding question but it has come to the fore in recent months following a resurgence of cases of COVID-19 and the prevalence of the more transmissible Delta variant. In deciding whether the introduction of a mandate is appropriate, states have to balance a range of ethical and practical considerations. A voluntary approach, backed up with education, respects healthcare workers’ autonomy to make private healthcare decisions, which is valued highly in liberal democracies. However, healthcare professionals also have an obligation to ensure that they do not present a risk of harm to their patients. Similarly, healthcare providers have a responsibility to take appropriate steps to minimise the risk of infection. Alongside balancing these rights and responsibilities, governments must also consider the potential consequences and risks of enforcing vaccine uptake. For example, there are concerns that a coercive approach could deepen mistrust and resentment among people who are genuinely fearful or hesitant. Moreover, a large number of refusals and the subsequent imposition of sanctions, such as suspension or redeployment, could affect the ability of providers to staff necessary services. ### Challenge to the abortion act 1967 dismissed In September, the High Court dismissed a judicial review of the Abortion Act 1967 that sought a judgement of incompatibility with the European Convention on Human Rights.1 The case focused on a clause in the Act which permits abortion in England, Scotland and Wales after 24 weeks if there is a substantial risk that, if the child were born, it would suffer from ‘such physical or mental abnormalities as to be seriously handicapped’. The case was brought by three parties: Heidi Crowter, a 24 year old woman living independently with Downs Syndrome and a campaigner for disability rights; a 2 year old boy with DS; and his mother who, when pregnant with him, felt pressure to terminate the pregnancy. The claimants sought a declaration that the clause was incompatible with the right to life; freedom from torture, inhuman or degrading treatment; right to private and family life; and protection from discrimination. Further to this it was also argued that the Act does not permit abortion on the basis that an unborn child has been diagnosed with a non-fatal fetal disability such as DS and that such abortions should not be funded by the state. In dismissing the claim, the judges focused on the ‘margin of appreciation’ that the European law allows domestic states on this issue and the fact that a foetus has never been deemed to have personhood status under the ECHR. The judges noted the ability to provide for a disabled child would vary significantly and that some conditions would only be found late in a pregnancy, after 24 weeks. This Handbook is the first comprehensive survey of a rapidly expanding sub-field in archaeology, the study of the present and recent past. It seeks to explore the boundaries of this emerging area, to develop a tool-kit of concepts and methods, which are applicable to this new sub-field, and to suggest important future trajectories for research.

Although activated spinal cord glia contribute importantly to neuropathic pain, how nerve injury activates glia remains controversial. It has recently been proposed, on the basis of genetic approaches, that toll-like receptor 4 may be a key receptor for initiating microglial activation following L5 spinal nerve injury. The present studies extend this idea pharmacologically by showing that TLR4 is key for maintaining neuropathic pain following sciatic nerve chronic constriction injury. Established neuropathic pain was reversed by intrathecally delivered TLR4 receptor antagonists derived (...) from lipopolysaccharide. Additionally, -naltrexone, -naloxone, and -naloxone, which we show here to be TLR4 antagonists in vitro on both stably transfected HEK293-TLR4 and microglial cell lines, suppressed neuropathic pain with complete reversal upon chronic infusion. Immunohistochemical analyses of spinal cords following chronic infusion revealed suppression of CCI-induced microglial activation by -naloxone and -naloxone, paralleling reversal of neuropathic pain. Together, these CCI data support the conclusion that neuron-to-glia signaling through TLR4 is important not only for initiating neuropathic pain, as suggested previously, but also for maintaining established neuropathic pain. Furthermore, these studies suggest that the novel TLR4 antagonists -naloxone and -naloxone can each fully reverse established neuropathic pain upon multi-day administration. This finding with -naloxone is of potential clinical relevance. This is because -naloxone is an antagonist that is inactive at the -opioid selective receptors on neurons that produce analgesia. Thus, these data suggest that -opioid antagonists such as -naloxone may be useful clinically to suppress glial activation, yet -opioid agonists suppress pain. (shrink)

There is increasing interest in the need to address the ethical dilemmas related to the engagement of adolescents in sexual and reproductive health research. Research projects, including those that address issues related to STIs and HIV, adverse pregnancy outcomes, violence, and mental health, must be designed and implemented to address the needs of adolescents. Decisions on when an individual has adequate capacity to give consent for research most commonly use age as a surrogate rather than directly assessing capacity to understand (...) the issues and make an informed decision on whether to participate in research or not. There is a perception that adolescents participating in research are more likely to be coerced and may therefore not fully comprehend the risk they may be taking when engaging in research. This paper examines the various ethical issues that may impact stakeholders' decision making when considering engaging adolescents in SRH research in Nigeria. It makes a case for lowering the age of consent for adolescents. While some experts believe it is possible to extrapolate relevant information from adult research, studies on ethical aspects of adolescents' participation in research are still needed, especially in the field of sexual and reproductive health where there are often differences in knowledge, attitudes and practices compared to adults. The particular challenges of applying the fundamental principles of research ethics to adolescent research, especially research about sex and sexuality, will only become clear if more studies are conducted. In June 2021, the BMA published its report on moral distress and moral injury in UK doctors.1 The report includes definitions of the terms ‘moral distress’ and ‘moral injury’ as well as a summary of how the concepts have developed over time. There is also an analysis of the BMA’s pan-profession survey of moral distress and moral injury of doctors in the UK, the first of its kind. The impact of COVID-19 and recommendations for tackling moral distress also feature. Many (...) may be unfamiliar with the concepts of ‘moral distress’ and ‘moral injury’. These terms are relatively new, and debate is ongoing in academic circles on the best way to understand them.2 Some use the terms interchangeably. The BMA defines moral distress as the psychological unease generated where professionals identify an ethically correct action to take but are constrained in their ability to take that action. Even without an understanding of the morally correct action, moral distress can arise from the sense of a moral transgression. More simply, it is the feeling of unease stemming from situations where institutionally required behaviour does not align with moral principles. This can be as a result of a lack of power or agency, or structural limitations, such as insufficient staff, resources, training or time. The individual suffering from moral distress need not be the one who has acted or failed to act; moral distress can be caused by witnessing moral transgressions by others. Moral injury can arise where sustained moral distress leads to impaired function or longer-term psychological harm. Moral injury can produce profound guilt and shame, and in some cases also a sense of betrayal, anger and profound ‘moral disorientation’. It has also been linked to severe mental health issues. Professor Körner's Experience and Conduct , like many other notable entities, is divided into three parts. Part I contains accounts of what Körner calls factual and constructive logic, some remarks on the logic of maxims and their consistency and adequacy, a chapter on probabilistic thinking, and another on preference theory. Part II contains chapters on the logic of action, on attitudes, upon the distinction between regulative and evaluative standards of conduct, on morality, justice, welfare, prudence, legality, and what Körner calls (...) ‘idealizations’. Part III, on the epistemology and metaphysics of practical thinking, contains chapters on rationality, evidence, moral pluralism and a final chapter on moral guidance. People unacquainted with moral philosophy suppose that its business is to tell us the difference between right and wrong. Many moral philosophers, unfortunately, seem to agree with them, to the extent, at any rate, of taking it for granted that there is some one divison of actions into two classes, which division is of some especial or even unique significance. Actions, they have supposed, are either right or wrong. If they are right, then they must and ought to be done, (...) and to do them is our duty. If they are wrong, then they must not and ought not to be done, and it is our duty not to do them. If we do what is right, and do this because it is right, and not just because it suits us, then we have performed a morally good action, and we deserve praise or commendation. If we have done something which is wrong, then we have performed a morally bad action, and deserveblame, and possibly punishment. Finally, a man manifests his moral goodness by performing, from a sense of duty, those actions which belong to the first class, and omitting those which belong to the second class; since there are no other ways in which actions may be classified morally, he has ample oppo tunity for exercising his talents, and the morally good man, or the conscientious man, or the dutiful man, becomes the archetype of what a man ought to be. But our freedom is also circumscribed by lack of physical and mental strength or skill, including that of knowing how to manage other human beings. Other factors limiting our freedom are our ignorance, our passions and our habits. This paper brings empirical and theoretical studies of ethical leadership into conversation with one another in an effort to determine the antecedent to perceived ethical leadership. Employing a Levinasian perspective, I argue that ethical leadership entails being faced with the impossible task of realizing the needs of many individual others. For this reason, I argue, perceived ethical leadership is grounded in an employee’s perception that a leader struggles to make decisions based on the conflicting demands placed upon her. More important (...) than the result of a leader’s decision is the degree to which the leader demonstrates concern for the well-being of others in her decision-making process. I ground my discussion through reference to results of empirical studies on behaviors associated with ethical leadership, including Brown, Treviño, and Harrison, Kalshoven, Den Hartog, and De Hoogh, and Treviño, Hartman, and Brown. I identify several mediating factors which may influence employee perception of ethical leadership, proposing avenues for further research which can help to clarify the relationship between concrete leadership behaviors and perceived ethical leadership. This paper presents a moral argument in support of the view that the mind is a nonphysical object. It is intuitively obvious that we, the bearers of conscious experiences, have an inherent value that is not reducible to the value of our conscious experiences. It remains intuitively obvious that we have inherent value even when we represent ourselves to have no physical bodies whatsoever. Given certain assumptions about morality and moral intuitions, this implies that the bearers of conscious experiences—the objects (...) possessing inherent value—are not physical objects. Reports of ethical lapses in the business world have been numerous and widespread. Ethical awareness in business education has received a great deal of attention because of the number and severity of business scandals. Given Sarbanes-Oxley legislation and recent Association to Advance Collegiate Schools of Business International’s (AACSBI) recommendations, this study examined respective websites of Securities and Exchange Commission (SEC) regulated public companies and AACSBI-accredited business schools for ethical policy statement content. The analysis was accomplished by classifying ethical expressions into (...) a framework consisting of the attributes of thematic content and focus/themes partially based on the 2004 research of Gaumnitz and Lere. Findings indicate that public companies have been diligent in presenting website ethical content that closely follows authoritative recommendations. Business schools appear not to have prioritized such disclosure to the extent done so by public companies. Although there was improvement between two samples taken in 2005 and 2007, this study provides evidence that many accredited business schools have little or no disclosed ethical expectations in their mission, vision, goals, or other similar types of statements on their websites. The idea that emotional experience is capable of lending immediate prima facie epistemic justification to evaluative belief has been amassing significant philosophical support in recent years. The proposal that it is my anger, say, that justifies my belief that I’ve been wronged putatively provides us with an intuitive and naturalised explanation as to how we receive immediate and defeasible justification for our evaluative beliefs. With many notable advocates in the literature, this justificatory thesis of emotion is fast becoming a central (...) facet in how we conceive of the emotions’ epistemic role with respect to our everyday lives. Interestingly, however, despite the fact that the justificatory thesis is fundamentally an epistemological proposal, comparatively little of the philosophical literature has been dedicated to exploring the epistemological avenues through which emotions might be capable of delivering such an epistemic yield. Accordingly, the central purpose of this thesis is to provide a novel and thorough analysis of how emotional experience might be capable of playing this justificatory role. Here, I present and evaluate three broad models of emotional justification: emotional dogmatism, emotional reliabilism, and agent-based views. Emotional dogmatist views, I argue, fail in virtue of being vulnerable to over-generalisation worries and problematic commitments to the contents of emotional awareness. Emotional reliabilism, while possessing the resources to avoid some objections, is vulnerable to worrisome clairvoyance-style challenges which establish the insufficiency of emotional reliability for epistemic justification. Finally, having learned our lessons from the shortcomings of these views, I argue that an agent-based theory grounded in the development of learned emotional competences provides the most plausible account of how emotional experience can epistemically justify evaluative belief. This discussion, I believe, will both illuminate contemporary discussions of the justificatory thesis of emotion found in the literature, and provide novel insight into the epistemic capacities of the emotions. Many Christians take an exclusivist stance on the nature and access of salvation. This essay explores the realist assumptions often found behind such exclusivist views and presents an alternative understanding of Christian salvation that is inclusivistic, irrealistic, and pluralistic.

This essay takes on two challenges to universal pluralistic antirealism (UPA). One of those challenges is successful, so the universality of UPA is not entirely plausible. However, I propose that the best way to remain as close to the spirit of UPA is to be a theist. God is the only thing that needs to be outside the universal claim of UPA. However, even God is what God is partially within human noetic schemes. Since God is “in the mix” with (...) humans in terms of being a concept-user, God’s presence can solve the other challenge to UPA. UPA is thus replaced by nearly universal pluralistic antirealism (NUPA). The difference between UPA and NUPA, in the end, is not very great. (shrink)

In an influential paper, James Lenman argues that consequentialism can provide no basis for ethical guidance, because we are irredeemably ignorant of most of the consequences of our actions. If our ignorance of distant consequences is great, he says, we can have little reason to recommend one action over another on consequentialist grounds. In this article, I show that for reasons to do with statistical theory, the cluelessness objection is too pessimistic. We have good reason to believe that certain patterns (...) of action will tend to have better consequences, and we have good reason to recommend acting in accordance with strategies based on those advantageous patterns. Out-of-network air ambulance bills are a pernicious and financially devastating type of surprise medical bill. Courts have broadly interpreted the Airline Deregulation Act to preempt most state attempts to regulate air ambulance billing abuses, so a federal solution is ultimately needed. However, in the absence of a federal fix, states have experimented with a variety of approaches that may survive preemption and provide some protections for their citizens.

Of the later dialogues of Plato, the Sophists stand out. This article highlights the concept of sophist as propounded by Plato. A didactic approach runs through the text. Socrates harps on the relation between sophist, philosopher and a statesman. Are they three different or they are the same. The basic idea that Plato wants to convey is, both features highlight some of the key enigmas of the dialogue: What is the relation between the outer and middle parts? How seriously are (...) we to take the outer part? And is there a genuine, and successful, attempt to say what the sophist is? The article focuses on two key problems discussed and solved in the middle part: the late-learners' problem, and the problem of false statement. The article also discusses communion of kinds and Plato's idea of the four quartets. (shrink)

I defend the thesis that most or all perceptual experiences are infused with imaginative contributions. While the idea is not new, it has few supporters. I begin by developing a framework for the underlying debate. Central to that framework is the claim that a perceptual experience is infused with imagination if and only if there are self-generated contributions to that experience that have ampliative effect on its phenomenal and directed elements. Self-generated ingredients to experience are produced by the subject as (...) opposed to being received from the world. Some form of stored content is an obvious starting point. Ampliative effects are aspects of perceptual experience that outstrip the content the senses get from the world. This conceptual framework is applied to three case studies: object-sameness and object-kind recognition (section 2), memory colour (section 3), and perceptual constancy and amodal completion (section 4). If the three cases and my overall analysis are accepted (a substantive if), then we have a forceful inductive argument for perception being infused with imagination. (shrink)

This book provides the first general account of the works of the Latin writer Apuleius, most famous for his great novel the `Metamorphoses' or `Golden Ass'. Living in second-century North Africa, Apuleius was more than an author; he was an orator and professional intellectual, Platonist philosopher, extraordinary stylist, relentless self-promoter, as well as a versatile author of a remarkably diverse body of other work, much of which is lost to us.

This chapter outlines the basic elements that underwrite Kant's cosmopolitanism. In doing so, the chapter looks at the moral principles behind Kant's cosmopolitanism and the problem of Kant's cosmopolitan teleology, and develops a brief overview of Kant's more coherent principles of cosmopolitan law. It makes a connection between Kant's critical philosophy and the moral foundations of his cosmopolitanism. By framing Kant's overall cosmopolitan vision, this chapter further explores Kant's theory of history and suggests that it is based on a problematic (...) teleology. The chapter concludes by linking the various aspects of Kant's cosmopolitanism into a single coherent narrative that provides a basis for future developments. (shrink)

Nobody in this debate questions the point that neuroeconomics remains full of potential, and little else as yet. If so, that really is progress of sorts. I was getting afraid that we would have to open nominations for the Captain Ahab Award for obsessive work on the promotion of neuroeconomics.

The medial prefrontal cortex (mPFC) has been the subject of intense interest as a locus of cognitive control. Several computational models have been proposed to account for a range of effects, including error detection, conflict monitoring, error likelihood prediction, and numerous other effects observed with single-unit neurophysiology, fMRI, and lesion studies. Here, we review the state of computational models of cognitive control and offer a new theoretical synthesis of the mPFC as signaling response–outcome predictions. This new synthesis has two interacting (...) components. The first component learns to predict the various possible outcomes of a planned action, and the second component detects discrepancies between the actual and intended responses; the detected discrepancies in turn update the outcome predictions. This single construct is consistent with a wide array of performance monitoring effects in mPFC and suggests a unifying account of the cognitive role of medial PFC in performance monitoring.
