O presente trabalho tem por objetivo fornecer uma resposta à crítica direcionada pelo jurista Fábio Konder Comparato ao formalismo jurídico de Kant. Explicarei porque essa crítica se equivoca quando identifica, na Doutrina do Direito de Kant, uma Teoria do Direito incompleta e insatisfatória. Para tanto, pretendo mostrar que o propósito do filósofo alemão não era apresentar uma teoria do direito, mas sim uma Metafísica do Direito. O que explica, por conseguinte, a razão para o direito ter sido concebido como um (...) conceito puro. Além disso, a fim de determinar o significado do formalismo jurídico, ocupar-me-ei da crítica hegeliana ao suposto formalismo ético de Kant, bem como da resposta a essa crítica. (shrink)

É inegável o dilema acerca da compreensão dos direitos humanos numa perspectiva universal, diante dos desafios das diversidades culturais. Embora seja prudente que existam valores que devam ser considerados universais, não podemos fechar os olhos paras as diferenças. Tal é a reconstrução necessária acerca do atual paradigma de direitos humanos. Produz-se, pois, uma nova cultura de amplitude dos direitos e das compreensões voltadas para a afirmação das diferenças. Esse processo de gestação pode ser traduzido numa política de resistência cultural, associada (...) à ideia de isonomia, que requer tratamento igual, no sentido do respeito aos direitos de todos. A filosofia, em seu horizonte intercultural e ético, enfrenta esse desafio de reunir experiências culturais diferentes para conduzir um que fazer de acordo com as circunstâncias históricas dos sujeitos da práxis. No primeiro passo, serão apresentados o cenário e os desafios da nossa época � marcada por grandes perplexidades e contradições. Mais precisamente, defenderá que o principal resultado da crítica à psicologia racional (enquanto doutrina da alma) foigarantir a possibilidade lógica do “eu numênico”. Isso permitiu que o homem fosse pensado como agente livre, capaz de fazer algo de si mesmo, superando sua condição demero produto da natureza. Este artigo pretende mostrar que e como ocorrem, na Doutrina da virtude de Kant, problemas relativos aosentido e referência dos juízos e conceitos fundamentais dessa obra, isto é, problemas semânticos. Tendo em vistaesse fim, explicitaremos de forma breve o desenvolvimento dessa problemática na filosofia prática de Kant e, em seguida, realizaremos a análise da Doutrina da virtude a partir do ponto de vistasemântico, a fim de identificar os mencionados problemas e as soluções fornecidas por Kant para estes problemas. -/- This (...) paper intends to show what and how problems related to the sense and reference of the fundamental judgments and concepts in Kant's Doctrine of virtue happen, that is, semantic problems. In order to perform this end, I shortly make explicit the development of this problematic in Kant's practical philosophy and, soon after, we will accomplish the analysis of the Doctrine of virtue from the semantic point of view, in order to identify the mentioned problems and the solutions supplied by Kant for these problems. In a recent article in Argumentation, O’Keefe (Argumentation 21:151–163, 2007) observed that the well-known ‘framing effects’ in the social psychological literature on persuasion are akin to traditional fallacies of argumentation and reasoning and could be exploited for persuasive success in a way that conflicts with principles of responsible advocacy. Positively framed messages (“if you take aspirin, your heart will be more healthy”) differ in persuasive effect from negative frames (“if you do not take aspirin, your heart will be less healthy”), (...) despite containing ‘equivalent’ content. This poses a potential problem, because people might be unduly (and unsuspectingly) influenced by mere presentational differences. By drawing on recent cognitive psychological work on framing effects in choice and decision making paradigms, however, we show that establishing whether two arguments are substantively equivalent—and hence, whether there is any normative requirement for them to be equally persuasive—is a difficult task. Even arguments that are logically equivalent may not be information equivalent. The normative implications of this for both speakers and listeners are discussed. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Notes and Discussions :REFLECTIONS ON THE HISTORY OF SCIENCE Every discipline worthy of a name deserves to be criticized periodically, asked to explain its objects and assess its march. The history of science is no exception. Indeed, criticism at this juncture should be all the more welcomed since the subjcct has now won its place in the curriculum of Anglo-Saxon educational institutions, particularly in the United States where Ph.D. (...) program offerings are multiplying almost faster than students. 1 The pioneering days of the 1930's and 1940's are past--if not totally forgotten--and men of the "second generation" like myself who received their training in the 1950's will gain much from having their methodological presuppositions questioned. Curiously enough, there has been little discussion of this kind in print for the last decade, with the exception of articles published in Poland and Russia, where the discipline is passing through its own pioneering crisis.2 In the West, the older debates stirred up largely by British Marxists are nowadays generally disregarded and have had surprisingly little productive effect upon the field. Within the last few years, the most effective methodological discussions have stemmed from Karl Popper and his generally brilliant lot of disciples. Dr. Joseph Ag~ssi, now Associate Professor of Philosophy at the University of Illinois and a member of this group, recently wrote a deliberately provocative essay entitled "Towards an historiography of science." a Agassi begins it with the arresting statement that the study of the history of science is "in a lamentable state" and ends with the implicit suggestion that an examination of the historiography of science is one of the most revealing ways to discover the discipline's failings. For Agassi, it is clear that the root of the historian's problems has been a false set of philosophical premises about the nature of science, and of its history as well. He finds that the discipline has suffered from two diseases named "inductive philosophy " and "conventionalist philosophy," for which there is a major new panacea, Popper's "critical philosophy of science." This refreshingly straightforward argument provides the essay with a ready-made structure, at the same time as it infuses it throughout with a polemical tone. Because of this tone and because of the importance of Agassi's message, he deserves to be answered. On one subject, I cannot agree more with Agassi--the need for a critical examination of the hisComell, Harvard, and the University of Wisconsin have a long-standing tradition of graduate study in the history of science. In the last few years, they have been joined by: the Case IImtitute of Technology; Indiana; Johns Hopkins; M.I.T.; Princeton ; the Universities of California (Berkeley and U.C.L.A.), Kansas, Oklahoma, Pennsylvania, and Washington; and Yale. Just as they assume scientific theories to have emerged from the collection of evidence, they expect that the piling up of historical facts strung along a time-axis adds up to history. As Agassi sagely observes, historians of science, like other induetivists, delude themselves into the belief that such an approach guards them from subjectivity and prejudice. There is a prima facie conflict between the semantical theory of direct reference and an intuitively plausible view often called 'individualism'. Direct reference theory is the view that certain expressions pick out their referent directly, without any intervening semantical mechanism. In order to describe the meaning of a sentence which contain such an expression, we have to mention the referent itself. Individualism is a view that mental states are individuated without reference to the subject's environment, either social or physical, and (...) therefore without mentioning an external object of reference. ;I argue that there is no conflict because it is a mistake to carry over the results of a semantical theory into a theory of mental content. My argument ultimately relies on a certain understanding of the difficult notions of mental content and linguistic meaning, gained in part by a close analysis of the historical context in which the theory of reference emerged out of the parallel work in the theory of intentionality. Fundamentally, the elucidation of these concepts is the principal aim of the dissertation, rather than the dismantling of an apparent conflict between two currently accepted views. ;There are two ways in which the conflict may be thought to arise. One argument relies on the identification of linguistic meaning with mental content. Against this I argue that we cannot hold both direct reference and the thesis, crucial to the argument, that linguistic meaning is identical to the thought-content of a competent. The short argument for conflict, therefore, fails. ;The second argument for the conflict is less direct. There are some thoughts, called De Re, which are said to constitute a direct connection between thinker and object. It is often thought that such thoughts are the ones attributed correctly using directly referential expressions. But what we attribute in such cases are just mental states whose attribution essentially involves the extra-mental objects of thought themselves, pace individualism. I argue that this argument depends on a conception of De Re, inherited from W. V. O. Quine, which mistakenly collapses issues of mental content with those of thought-attribution. (shrink)

Following with the discovery of the electron by J. J. Thomson at the end of the nineteenth century a steady elucidation of the structure of the atom occurred over the next 40 years culminating in the discovery of nuclear fission in 1938–1939. The significant steps after the electron discovery were: discovery of the nuclear atom by Rutherford (Philos Mag 6th Ser 21:669–688, 1911 ), the transformation of elements by Rutherford (Philos Mag 37:578–587, 1919 ), discovery of artificial radioactivity by Joliot-Curie (...) and Joliot-Curie (Comptes Rendus Acad Sci Paris 198:254–256, 1934 ), and the discovery of the neutron by Chadwick (Nature 129:312, 1932a , Proc R Soc Ser A 136:692–708, 1932b ; Proc R Soc Lond Ser A 136:744–748, 1932c ). The neutron furnished scientists with a particle able to penetrate atomic nuclei without expenditure of large amounts of energy. From 1934 until 1938–1939 investigations of the reaction between a neutron and uranium were carried out by E. Fermi in Rome, O. Hahn, L. Meitner and F. Strassmann in Berlin and I. Curie and P. Savitch in Paris. Results were interpreted as the formation of transuranic elements. After sorting out complex radio-chemistry and radio-physics O. Hahn and F. Strassmann came to the conclusion, beyond their belief, that the uranium nucleus split into smaller fragments, that is nuclear fission. This was soon followed in 1939 by its theoretical interpretation by L. Mietner and O. Frisch. (shrink)

This study examines the place of the Philosophical Society of the University of Vienna (1888-1938) in the evolution of the history of philosophy in Austria up to the establishment of the Vienna Circle in 1929. I will examine three aspects of the relationship between the Austrian members of the Vienna Circle and the Philosophical Society which has been emphasized by several historians of the Vienna Circle: the first aspect concerns the theory of a first Vienna Circle formed mainly by H. (...) Hahn, P. Frank and O. Neurath; the second aspect is the contention that the missing link between the Vienna Circle and the Bolzano tradition in Austria is Alois Höfler, a student of Brentano and Meinong; I will finally examine the link they established between the annexation of the Philosophical Society to the Kant-Gesellschaft in 1927 and the founding of the Vienna Circle in 1929. I will argue that this institution played a key role in the history of philosophy in Austria and is partly responsible for the formation of the Vienna Circle. (shrink)

Viktor D. Kudryavtsev-Platonov is one of the most prominent representatives of Russian religious-academic philosophy of the second half of the nineteenth century whose theory of cognition bears an imprint of the Kantian theoretical philosophy. Kudryavtsev was not only thoroughly familiar with the Königsberg thinker’s work, but offered a critically reinterpreted version of Kant’s teaching on space, time and categories of understanding. But was the Russian philosopher original in his reading and critique of Kant? In his later works Kudryavtsev often cites (...) the works of Friedrich Adolf Trendelenburg whose works turn out to be very close to the Russian philosopher. Could it be that Kudryavtsev read Kant through Trendelenburg’s optics? To answer this question consistently I give outlines of Trendelenburg’s and Kudryavtsev’s theories of cognition and compare their views on the basis of the sources. I then draw on archive materials to characterise Kudryavtsev’s acquaintance with the works of Kant and Trendelenburg. It turns out that Kudryavtsev was well-versed in Kant’s philosophical ideas already in the early years of his teaching activities — but not from primary sources, but largely through German historical-philosophical renderings. I establish similarities between the teachings of Trendelenburg and Kudryavtsev on space, time and the categories of understanding and their critique of the relevant Kantian teaching. Finally, Kudryavtsev’s early manuscripts attest to his acquaintance with Trendelenburg’s ideas. I conclude that Trendelenburg influenced Kudryavtsev’s own theory of cognition, a fact that should be borne in mind when reading the Russian philosopher’s epistemological works. (shrink)

Suppose that two competing norms, N1 and N2, can be identified such that a given person’s response can be interpreted as correct according to N1 but incorrect according to N2. Which of these two norms, if any, should one use to interpret such a response? In this paper we seek to address this fundamental problem by studying individual variation in the interpretation of conditionals by establishing individual profiles of the participants based on their case judgments and reflective attitudes. To investigate (...) the participants’ reflective attitudes we introduce a new experimental paradigm called the Scorekeeping Task. As a case study, we identify the participants who follow the Suppositional Theory of conditionals (N1) versus Inferentialism (N2) and investigate to what extent internally consistent competence models can be reconstructed for the participants on this basis. After extensive empirical investigations, an apparent reasoning error with and-to-if inferences was found in one of these two groups. The implications of this case study for debates on the proper role of normative considerations in psychology are discussed. (shrink)

In the wake of Locke’s Essay, empiricists faced the challenge of giving an empiricist account of the origins of moral knowledge. Locke did not rise to this challenge and relied on revelation as the source of moral knowledge. Other empiricists, including Hume and Hutcheson, opted for either emotivism or subjectivism. Clarke and others opted for rationalism and non-naturalism. In contrast, Catharine Cockburn’s meta-ethics combined Locke’s empiricism with naturalism. She held that moral good is natural good and that natural good is (...) known just as any other matters of natural fact are known: empirically. Cockburn’s position was unusual for its time, and the full originality and appeal of her meta-ethical position have not been fully appreciated. (shrink)

There are four main claims to the book associated with these four parts, each of which is divided into sub-themes. Thus, one can denote a number of inevitably controversial ideas advanced by (...) the book. In clarifying the nature of these claims, I can initially respond to some of the main points advanced by various of the helpful review essays in this symposium.Framing the Argument of the BookThe first part of the work posits that there is a fundamental developmental continuity between Old and New Testament revelation, wherein God is revealed first to Israel as the one Creator, and subsequently in Jesus Christ as three distinct persons, the eternal Father, Son, and Holy Spirit.1 This revelation is in turn received in the pre-Nicene era of the early Church, principally under a twofold conceptual format, according firstly to a model of God as a single transcendent subject of wisdom who sends his Word into the world in human nature, and inspires the prophets by his Spirit (the apologists' monotheistic model, exemplified by Justin Martyr) and, secondly, to [End Page 569] a model of economic Trinitarian activity, of the Father, Son and Spirit, who are each divine and one in being, active in sacred history (Irenaeus).2 Nicene Trinitarian authors sought in various ways to find a deeper concordance of the two approaches, one of which emphasized more the immanent unity of God (potentially tending toward a danger of Sabellianism) and the other of which emphasized real distinction of persons active in the economy (potentially tending toward the danger of subordinationism).3 Pro-Nicene figures like Athanasius, Gregory of Nazianzus, and Augustine, among others, paved the way for a mature doctrine of immanent Trinitarian life, in which God was understood to be characterized, mysteriously, by eternal processions of the Word and the Spirit who originate from the Father, and receive from him the plenitude of their deity or divine nature, and thus are equally and identically the one God.4 God is mysteriously three persons who are truly one both in essence and being.The second part of the book is concerned with the theological exploration of what it means to speak of God as one, and of the divine nature of God. This determination of Christian theological wisdom stems from a threefold exigency: first, to uncover the inner unity of revelation itself, as indeed the Israelite revelation of the divine unity and the oneness of God the transcendent Creator is thematic to both Testaments;5 second, to consider the preconditions of Nicene orthodoxy, as indeed the claim that the three persons in God are one in essence or nature presupposes that there is a nature of God that is one common to the three persons;6 third, to consider what must be said about the inner life of God as truth and love, as a precondition for thinking about the processional life of the Word and Spirit, who are immanent distinct persons in God who receive and possess this fullness of life but who do not divide this one eternal life in God or cause it to evolve due to their relational proceeding.7I argue that a consideration of God's nature as simple, perfect, good, eternal, immutable, and so forth is essential to any theology that takes the biblical revelation of the unity and transcendence of God seriously, and therefore confesses the revelation of the Trinity integrally.8 Furthermore, regarding [End Page 570] the apophatic contours of this form of reflection, I hold that it is precisely in order to guarantee the kind of circumspect avoidance of "non-biblical speculation" about positive knowledge of God outside of Christ that it is necessary to qualify rightly how God is not identifiable with creation and thus remains unknown in his inner divine nature and eternal life apart from and outside of his divine self-disclosure in the revelation of the Old and New Testaments. Aesthetic responsivity and the phenomenology of arts processes reflect integrative self-world engagements, and are informative about the nature of the world and our biology in ways that are often not be made evident through scientific research. Akins’ and Hahn’s research regarding human trichromatic visual perception brings together the art of photography, neuroscience, and psychophysics, along with analyses of perspectives on vision in science and philosophy, to invoke anti-reductive, holistic understandings of how we see colour. We bring aesthetics and the (...) phenomenology of arts processes to bear in exploring creaturely re-sponsivity to the complex inter-relational dynamics of light perception, and o˙er reflective metaphors for human engagements that challenge Darwinian utilitarian conceptions. We argue that attending to aesthetic and phenomenological aspects of experiences is essential to understanding how the shared circuits of cognition and sensory-motor engagement shape our perceptive responsive interactions. In this paper, new evidence is presented for the assumption that the reason-relation reading of indicative conditionals ('if A, then C') reflects a conventional implicature. In four experiments, it is investigated whether relevance effects found for the probability assessment of indicative conditionals (Skovgaard-Olsen, Singmann, and Klauer, 2016a) can be classified as being produced by a) a conversational implicature, b) a (probabilistic) presupposition failure, or c) a conventional implicature. After considering several alternative hypotheses and the accumulating evidence from other studies as (...) well, we conclude that the evidence is most consistent with the Relevance Effect being the outcome of a conventional implicature. This finding indicates that the reason-relation reading is part of the semantic content of indicative conditionals, albeit not part of their primary truth-conditional content. (shrink)

For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. Biodiversity is a valuable resource that supports sustainability within agricultural systems, yet in contradiction to this agriculture is recognised as a contributor to biodiversity loss. Agricultural advisory services are institutions that support sustainable agricultural development, employing a variety of approaches including farmer discussion groups in doing so. This study evaluates the impact of a farmland biodiversity management (FBM) communication strategy piloted within Irish farmer discussion groups. A sensemaking lens was applied in this objective to gain an understanding of how this (...) strategy could create an actionable space for FBM promotion amongst farmers. The strategy was piloted with six Irish dairy farmer discussion groups, after which focus groups were conducted with members of these groups. Additionally, baseline and endline surveys were completed by the members to determine their knowledge, attitude and on-farm practices relating to FBM. Analysis of the focus group data identified that the communication strategy supported the affordance of sensemaking with respect to FBM. Analysis of the data from the baseline and endline surveys relating to knowledge, attitudes and practices found that engaging with the communication strategy promoted farmers to improve their attitude in relation to FBM. Results from this study provide important lessons for agricultural advisory services to support farmers in incorporating FBM into the overall management of their farms and, in turn, to promote the improvement of farmland biodiversity and contribute to a sustainable future. How do people evaluate causal relationships? Do they just consider what actually happened, or do they also consider what could have counterfactually happened? Using eye tracking and Gaussian process modeling, we investigated how people mentally simulated past events to judge what caused the outcomes to occur. Participants played a virtual ball‐shooting game and then—while looking at a blank screen—mentally simulated (a) what actually happened, (b) what counterfactually could have happened, or (c) what caused the outcome to happen. Our findings showed (...) that participants moved their eyes in patterns consistent with the actual or counterfactual events that they mentally simulated. When simulating what caused the outcome to occur, participants moved their eyes consistent with simulations of counterfactual possibilities. These results favor counterfactual theories of causal reasoning, demonstrate how eye movements can reflect simulation during this reasoning and provide a novel approach for investigating retrospective causal reasoning and counterfactual thinking. In the book The Stolen Bible: From Tool of Imperialism to African Icon (2016) the author provided a detailed analysis of Robert Moffat’s translation practice. In this article the author takes that analysis further, using the theoretical framework provided by Nathan Esala in this PhD thesis and forthcoming book, namely ‘translation as invasion’. Esala traces the colonial history of Africa-based translation practice, theorising the practice as ‘translation as invasion’. This article draws on Esala’s theorising in re-analysing Moffat’s translation practice among (...) the BaTlhaping. The article then goes on to argue for forms of decolonial ‘re-translation’, focussing on two forms of decolonial translation, Contextual Bible Study (CBS) as translation (as advocated by Esala) and Julius Nyerere’s use of indigenous Tanzanian poetics for translating the gospels. The article uses Michel Foucault’s notion of ‘heterotopic space’ and Sithembiso Zwane’s notions of ‘invigorated space’ and ‘invented space’ to theorise CBS and Nyerere’s poetics as forms of decolonial space for African-led re-translation, with potential implications for African community-based participatory development. Contribution: The article demonstrates how translation as a form of colonial invasion is practised by the missionary Robert Moffat, and how such forms of translation are being resisted through indigenous African reception of the Bible through re-translation practices. When it comes to fulfilling our basic duties to distant others, we in the affluent world face a motivation gap; we consistently fall short of bearing even moderate costs for the sake of helping others secure basic minimums to which they are entitled. One response to the motivation gap is to cultivate in affluent populations a greater concern for distant others; cultivating such concern is the goal of ‘sentimental cosmopolitanism’. Two approaches to sentimental cosmopolitanism currently dominate the literature, a compassion-based (...) and a complicity-based approach, respectively. In this paper, I argue for the promise of reciprocity as an alternative motivator of cosmopolitan concern. I further argue that a sense of obligation to distant others, grounded in our participation in an ongoing system of reciprocal exchange, can be cultivated within a thus-far overlooked sphere of cosmopolitan sensitization, namely the market. I make the case for the market as an appropriate site for cosmopolitan sensitization, and further argue that multinational corporations are, for several reasons, well-positioned to bear the political responsibility of sensitizing affluent populations to the significance of their participation in a cooperative economic scheme shared with distant others. This paper, then, makes a novel contribution to debates on cosmopolitan sentiment, as well as to the emerging literature on corporations’ political responsibilities. This is a translation from Bulgarian into English of Nikolai Lossky’s “Razlichniiat smisul na dumata intuitsiia” (“The Different Senses of the Word Intuition”), published in the Sofianite journal Filosofski pregled (Philosophical Review), 1931, year III, book 1, pp. 1–9. In this article, solicited by the journal’s editor-in-chief, the Bulgarian philosopher Dimitar Mihalchev, Lossky surveys the different ways in which the word “intuition” (intuitsiia) has been used throughout the history of philosophy: Kant, Fichte, Schelling, Hegel, Friedrich Jacobi, Ivan Kireevski, Alexei Khomyakov, (...) Vladimir Solovyov, Bergson, Husserl, and Hans Driesch. Lossky then situates his own use of the word within this philosophical tradition and compares his intuitivism with gnoseologies similar to his own, namely, those of Semyon Frank, Johannes Rehmke, Max Scheler, Paul Linke, Dimitar Mihalchev, the English realists (Samuel Alexander and John Laird), the American realists (Edwin Holt, Walter Marvin, William Montague, Ralph Perry, Walter Pitkin, and Edward Spaulding), and the Neo-Scholastic Josef Gredt. As such, the article makes a valuable addendum to his Obosnovanie intuitivizma (The Foundation of Intuitivism) (1906) and provides a helpful synopsis of his theory of knowledge, which, in accordance with the Russian terminological tradition, he calls “gnoseology”. Reasoning with conditionals is central to everyday life, yet there is long-standing disagreement about the meaning of the conditional. One example is the puzzle of so-called missing-link conditionals such as "if raccoons have no wings, they cannot breathe under water." Their oddity may be taken to show that conditionals require a connection between antecedent ("raccoons have no wings") and consequent ("they cannot breathe under water"), yet most accounts of conditionals attribute the oddity to natural language pragmatics. We present an experimental (...) study disentangling the pragmatic requirement of discourse coherence from a stronger notion of connection: probabilistic relevance. In lieu of an abstract, here is a brief excerpt of the content:The De Auxiliis Controversy, Molinism, and Physical Premotion:The Christological Implications*Pachomius Walker O.P.From 1582 until 1607, the de Auxiliis controversy consumed much of the attention of Dominicans, Jesuits, and the Papacy.1 The controversy began in 1582 at Salamanca when a Scholastic debate entertained the question of [End Page 607] how Christ's sacrifice was both free and meritorious.2 The Jesuit, Prudencio de Montemayor, claimed that if Christ had been commanded to (...) lay down his life and be crucified, then his action was not free and, therefore, not meritorious.3 The Dominicans, on the other hand, resolved the question of Christ's merit and freedom using what would later come to be known as physical premotion.4 In a word, the de Auxiliis controversy has Christological roots. Even though the controversy quickly engaged other, related questions, a successful adjudication of these conflicting positions must have reference to the Christological truths implicated in the controversy.5 [End Page 608] The goal of this present study, therefore, is to exposit the Christological implications of the de Auxiliis controversy in an effort to reexamine the conflicting proposals about grace.Historically, in order to resolve the confusion about the God-man, the partisans of the debate needed to clarify their differing principles regarding God and man generally. As was soon apparent, however, the parties of the debate had contradictory understandings of basic philosophical principles.6 The participants in the controversy engaged other topics such as man's freedom, God's foreknowledge of future contingents, and predestination.7 It is understandable, therefore, that when Domingo Báñez († 1604), one of Montemayor's principal interlocutors, submitted his list of theses that summarized Montemayor's position, many of them dealt with questions other than those of Christ's merit.8Eventually, the controversy centered upon Luis de Molina's Concordia after its publication in 1588.9 The Concordia became the focus and [End Page 609] touch-point for the debate, since various parties aligned themselves based on their support for or condemnation of the work. The papal Congregation de Auxiliis (1594–1607), initially convoked by Pope Clement VIII, analyzed Molina's work and the positions contained therein. This, again, helped specify the debate. To keep the relevant parties focused and to make clear the lineaments of the controversy, it was helpful to have a standard text to which all parties had reference. Questions about God's grace and man's freedom were concretized through specific questions about Molina's approach to grace, God's knowledge, and predestination and whether his positions agreed with Thomas, Augustine, the Fathers of the Church, and Church councils. Hence, the Controversy de Auxiliis, which began by dealing with questions of Christology, resulted in a debate about the Molinist position as described in the Concordia.The subsequent years of the controversy have retained much of the same breadth: grace, freedom, God's foreknowledge, and predestination.10 The original impetus for the debate—Christology—can many times be overlooked or seen as a historical curiosity11 On one level, passing over the [End Page 610] Christological issues is reasonable: Molina's Concordia was first published after the lines of the debate had already been formed, and thus it is not a work of Christology. Following from sweeping law reforms across the global health landscape, there is a need to prepare the next generation to advance global health law to ensure justice for a healthier world. Educational programs across disciplines have increasingly incorporated the field of global health law, with new courses examining the law and policy frameworks that apply to the new set of public health threats, non-state actors, and regulatory instruments that structure global health. Such interdisciplinary training must be expanded throughout the world (...) to prepare future practitioners to strengthen global health law — ensuring a foundation for global health in legal studies and law and global health studies. Meeting this imperative for global health law teaching — establishing academic courses and textbooks on global legal responses to shared health threats — will be necessary to support students to address the global health challenges of the future.
