Why should sovereign states obey international law? What compels them to owe allegiance to a higher set of rules when each country is its own law of the land? What is the basis of their obligations to each other? Conventional wisdom suggests that countries are too different from one another culturally to follow laws out of mere loyalty to each other or a set of shared moral values. Surely, the prevailing view holds, countries act simply out of self-interest, and they (...)

The study aimed to comprehensively overview the experiences encountered by public school employees during the recruitment, selection, and placement (RSP) process within the DepEd Bohol Division. Employing a qualitative-descriptive research design, the researchers utilized a phenomenological approach to delve deeply into these experiences, shedding light on the nuances and intricacies of the division's RSP process. As Lambert et al. (2013) described, qualitative- descriptive studies aim to provide a comprehensive and detailed summary of specific events experienced by individuals or groups in (...)

We present an experiment designed to investigate three different mechanisms to achieve impartiality in distributive justice. We consider a first-person procedure, inspired by the Rawlsian veil of ignorance, and two third-party procedures, an involved spectator and a detached observer. First-person veiled stakeholders and involved spectators are affected by an initially unfair distribution that, in the stakeholders’ case, is to be redressed. We find substantial differences in the redressing task. Detached observers propose significantly fairer redistributions than veiled stakeholders or involved spectators. (...)

    Ending Tyranny in Iraq.Fernando R. Tesón - 2005 - Ethics and International Affairs 19 (2):1-20.
The war in Iraq has reignited the passionate humanitarian intervention debate. President George W. Bush surprised many observers in his second inaugural address when he promised to oppose tyranny and oppression, and this in a world not always willing or ready to join in that fight. Humanitarian intervention is again on the forefront of world politics.

The article deals with the chances of illustration of Mohammed: is it forbidden to depict Mohammed in the Islam? What the history or the religion say about it? The following sentences try to get a brief but deep approaching to that issue, underlying the importance that just a few time ago when several problems related to misunderstanding and hatred set the Muslim world in front of the Western people as violent in a behavior that no one could share.

Abstract The article addresses three aspects of the humanitarian intervention doctrine. It argues, first, that the value of sovereignty rests on the justified social processes of the target state ? the horizontal contract. Foreign interventions, even when otherwise justified, must respect the horizontal contract. In contrast, morally objectionable social processes (such as the subjection of women) are not protected by sovereignty (intervention, of course, may be banned for other reasons). In addition, tyrants have no moral protection against interventions directed at (...)

The study employed a mixed research design, combining both descriptive-qualitative and descriptive- quantitative methods. The qualitative phase involved conducting in-depth interviews and focus group discussions with relevant stakeholders involved in records management. On the other hand, the quantitative phase utilized survey questionnaires to gather data from relevant stakeholders to determine the acceptability of the proposed MIS among end-users.

The Japanese philosophy of myth during the early Shōwa era.Fernando Wirtz - 2023 - History of European Ideas 49 (8):1220-1235.
In this article, I seek to present some examples of the philosophy of myth in Japan during the early Shōwa era (1926–1945), especially in works by Tanabe Hajime, Kihira Tadayoshi, Isobe Tadamasa, Kōsaka Masaaki and Miki Kiyoshi. While the concept of myth is closely linked to the question of nationality, I intend to show that the philosophical concept of myth is also related to a fundamental ambiguity that prevents an absolutisation of myth and offers specific conceptual tools for a critique (...)

On the Importance of Questioning Within the Ideal Model of Critical Discussion.Fernando Leal - 2020 - Argumentation 34 (4):405-431.
Both questions as abstract objects and the speech acts, here called requests, by which we ask them play an enormous role in all argumentative practices. Nonetheless, there is hardly a proper systematic treatment of questions and requests in current argumentation theories. This paper is a first attempt at providing such a systematic treatment. This is achieved by following the ideal model of a critical discussion as elaborated over the years by the Amsterdam school of pragma-dialectics. After introducing the distinction between (...)

The book explores Peirce's non standard thoughts on a synthetic continuum, topological logics, existential graphs, and relational semiotics, offering full mathematical developments on these areas. More precisely, the following new advances are offered: (1) two extensions of Peirce's existential graphs, to intuitionistic logics (a new symbol for implication), and other non-classical logics (new actions on nonplanar surfaces); (2) a complete formalization of Peirce's continuum, capturing all Peirce's original demands (genericity, supermultitudeness, reflexivity, modality), thanks to an inverse ordinally iterated sheaf of (...)

Mittel as a Process: Saigusa Hiroto’s Philosophy of Technology and the Question of Culture.Fernando Wirtz - forthcoming - Journal of East Asian Philosophy:1-23.
This article introduces the little-studied figure of Saigusa Hiroto, a twentieth century Marxist philosopher who reconstructed the history of technical thought in Japan. The article focuses on Saigusa’s thought between 1939 and 1942, contextualizes his thinking in relation to the technology controversy of the 1930s and presents his critique of the dualism between spiritual and technological culture. Saigusa defines technology as a “means as a process” and not a skill or system of things. The author argues that Saigusa’s notion of (...)

Brainhood, anthropological figure of modernity.Fernando Vidal - 2009 - History of the Human Sciences 22 (1):5-36.
If personhood is the quality or condition of being an individual person, brainhood could name the quality or condition of being a brain. This ontological quality would define the `cerebral subject' that has, at least in industrialized and highly medicalized societies, gained numerous social inscriptions since the mid-20th century. This article explores the historical development of brainhood. It suggests that the brain is necessarily the location of the `modern self', and that, consequently, the cerebral subject is the anthropological figure inherent (...)

Character and Everydayness: The Bottom-Up Historical Epistemology of Tosaka Jun.Fernando Wirtz - forthcoming - Journal of East Asian Philosophy:1-22.
This paper attempts to examine how the concept of character in Tosaka’s philosophy presents us with the distinctive features of a situated epistemology. To do this, I will make comparative, although by no means exhaustive, use of the work of Heinrich Rickert. I will not attempt to argue that Rickert was Tosaka’s main interlocutor; however, I will show that the concept of character can be understood as a response to one of the challenges posed by the neo-Kantian philosopher: how can (...)

This paper explores the notion of cosmotechnics in the context of the history of Latin American philosophy. Since the nineteenth century, Latin American philosophy has developed through an ongoing confrontation between conceptions of “civilization and barbarism.” This tension in turn has impacted the relationship between Latin American philosophy and technology. Consequently, a certain “absence of technique” is visible as a recurring topos in Latin American philosophies. To overcome this apparent absence, this paper criticizes the notion of mestizaje using Silvia Rivera (...)

This paper explores the concept of myth in two books written by Kōsaka Masaaki, The Historical World and Philosophy of the Nation. In both, myth appears as a central moment in the transition from primitive to modern societies. The role of myth is closely related to Kōsaka’s notion of nature, since one goal of his reflection is to show how history is supported by the “substratum” of nature. In this sense, he also distinguishes between the natural and historical aspects of (...)

Global justice and trade: A puzzling omission.Fernando R. Teson & Jonathan Klick - manuscript
Economists generally agree that free trade leads to economic growth. This proposition is supported both by theoretical models and empirical data. Further, while the empirical evidence is more limited on this question, the general consensus among economists holds that trade restrictions are likely to hurt the poor. Even if the latter consensus turns out to be wrong, if free trade leads to superior growth, governments would have more resources to redistribute to the poor. It is surprising then that philosophers and (...)

A questionnaire in which the subjects are asked about the reasons for their decision shows that, at least in this case, moral motivations carry a heavy weight in the decision: the majority of dictators give the money for reasons of a consequentialist nature.
