We must begin by distinguishing between sciences and empirical fields. The empirical fields are the elementary divisions of the natural world into levels for purposes of examination. The sciences consist in the method of examining those fields, together with the presuppositions and findings of such a method. Throughout this essay, we shall consider only the empirical fields as the subject-matter of the sciences, and the way in which the sciences describe their subject-matter, but not the sciences themselves. Thus the adjective (...) “physical” will be employed, for instance, to describe the physical empirical field, and not “physics” to describe the science. (shrink)

Early and later Confucians, known in Chinese as the “ruists” school of ancient origins, perceived the idea of “harmony” as a fundamental concept that lies at the basis of self-cultivation, society and governance. In modern times this idea still plays in one or another form a dominant note in Chinese politics and social life. The article attempts to search for causes of the significance of “harmony” by focusing on analyzing two pivotal Confucian texts compiled in the Han dynasty, namely, Records (...) of Music [Yue ji 樂記] and Divination of Music [Yue wei 樂緯]. The analysis shows that ruists belonging to Zhou dynasty’s imperial class of music officials, gradually developed the aesthetics of music into a complex idea of "harmony" that contains the highest aesthetical way—“Dao”—which guides both the whole universe as well as the evolution of human society. Ever since the publication of Dohm’s _Ueber die bürgerliche Verbesserung der Juden_ (On the Civil Improvement of the Jews) in 1781, which argued for Jewish political equality on humanitarian grounds, more and more voices joined those demands. Prominent among them was David Friedländer, a friend and disciple of Moses Mendelssohn. One of the leading figures of the Berlin Haskalah, he worked towards establishing equal legal status for Jews in Prussia. Friedländer did not accept the given view of his times, (...) the antithesis of Jew and German. For him only the antithesis Jew–Christian existed and even that he tried to reconcile by finding common ground in a religion of reason, the groundwork of which he laid out in an Open Letter in 1799. What he proposed at that time may have been illusionary, but it certainly met with approval in enlightened Jewish circles. Friedländer therefore not only stands for those who dared to break with the traditions, but also for the generation of those who consciously aimed at the denationalization of traditional Judaism – and thus decided in favour of the confessionalization and the Germanness of the Jews. This study examines the influence of corporate environmental performance on the propensity that auditors issue modified audit opinions and further investigates the moderating effects of internal control and greenwashing. Using a sample of Chinese listed firms, our findings reveal that corporate environmental performance is significantly negatively associated with modified audit opinions, suggesting that auditors applaud environmentally friendly firms. Moreover, internal control reinforces the negative association between corporate environmental performance and modified audit opinions, but greenwashing attenuates the negative effect of corporate (...) environmental performance on modified audit opinions. The findings are robust to various sensitivity tests, and our conclusions are still valid after controlling for the potential endogeneity. Additional tests reveal that corporate environmental performance is negatively associated with modified audit opinions only for firms without audit opinion shopping and corporate environmental performance is significantly negatively associated with both earnings management and audit fees. Before expressing opinions, most people usually consider the standpoint of their friends nearby to avoid being isolated, which may lead to the herding effect. The words of celebrities in social networks usually attract public attention and affect the opinion evolution in the entire network. This process also causes the similar status quo. In this study, we find that the key figures play the guiding roles in public opinions who undertake the group pressure from information amount. Therefore, we build the cost (...) function on opinion changes to study opinion evolution rules for public persons based on the spreading scope of information and information amount. Simulation analysis reveals that the information amount held by agents will affect the converging speed of public opinions, while enhancing the ability of key nodes may no more effective in guiding public opinion. This study was designed to investigate the impact of self-relevance between preschool children and recipients on children’s sharing behavior in dictator games using a forced-choice resource distribution paradigm. Experiment 1: A total of 75 children aged 3-6 years were evaluated in a first-party situation in which they were distributed as recipients and dictators and shared resources with distracting recipients with different extents of self-relevance under three different payoff structures, including non-costly, costly and envy structures. Children could choose between a sharing (...) option and a non-sharing option. The results showed that, in a first-party situation, children aged 3-6 years old typically share more resources with highly self-relevant recipients (friends) than with moderately self-relevant recipients (acquaintances) and lowly self-relevant recipients (strangers) and that they share more resources with moderately self-relevant recipients (acquaintances) than lowly self-relevant recipients (strangers). Experiment 2: A total of 62 children aged 3-6 years old were evaluated in a third-party situation in which they were distributed not as recipients but only dictators, making decisions between the options of sharing more or sharing less with distracting recipients who had different extents of self-relevance under three different payoff structures, such as non-bias, high self-bias and low self-bias. The results showed that, in a third-party situation, children typically share in a similar manner to that of Experiment 1, meaning that children display selective generosity and that the self-relevance between the children and recipients played a key role. Across age groups, this study of preschool children (total N = 137) demonstrates a degree of effect of self-relevance on preschool children’s sharing in first-party and third-party situations, with highly self-relevant recipients receiving a more preferential share in the dictator game than those with low self-relevance, although this effect was stronger in the older preschool children. When incorporating the environment into mental processing (cf., cognitive offloading), one creates novel cognitive strategies that have the potential to improve task performance. Improved performance can, for example, mean faster problem solving, more accurate solutions, or even higher grades at university.1 Although cognitive offloading has frequently been associated with improved performance, it is yet unclear how flexible problem solvers are at matching their offloading habits with their current performance goals (can people improve goal‐related instead of generic performance, e.g., when being (...) in a hurry and aiming for a “quick and dirty” solution?). Here, we asked participants to solve a cognitive task, provided them with different goals—maximizing speed (SPD) or accuracy (ACC), respectively—and measured how frequently (Experiment 1) and how proficiently (Experiment 2) they made use of a novel external resource to support their cognitive processing. Experiment 1 showed that offloading behavior varied with goals: Participants offloaded less in the SPD than in the ACC condition. Experiment 2 showed that this differential offloading behavior was associated with high goal‐related performance: fast answers in the SPD, accurate answers in the ACC condition. Simultaneously, goal‐unrelated performance was sacrificed: inaccurate answers in the SPD, slow answers in the ACC condition. The findings support the notion of humans as canny offloaders who are able to successfully incorporate their environment in pursuit of their current cognitive goals. Future efforts should be focused on the finding's generalizability, for example, to settings without feedback or with high mental workload. (shrink)

Global reproductive landscapes and with them cross-border routes are rapidly changing. This paper examines the reproductive routes and choices of fertility travellers from China to Russia as reported by medical professionals and fertility service providers. Providing new empirical data, it raises new ethical questions on the facilitation of cross-border reproductive travel and the commercialisation of reproductive treatment. The relaxation of the one-child policy in 2014 in China, the increasing demand for ART exceeding the capacity of national fertility clinics and the (...) difficulty of accessing treatment with donor eggs concomitant with a growing economic power of the upper–middle class are shaping the ART industry in Asia in new ways. A new development is Chinese citizens increasingly seeking ART treatment in Russia, which has a long-standing practice of ART governed by a liberal legislation. Furthermore, as China prohibits the export of gametes, Chinese fertility travellers rely on acquiring donor gametes once starting treatment abroad. Clinicians in Russia report three strategies amongst their Chinese patients: One group is using donor eggs of women of Asian appearance living in Russia or is hiring women of resembling appearance from third-party countries to donate their eggs in Russia to create resemblance in their offspring. Another group is buying white donor gametes to create Eurasian mixed children and thus ‘enhance’ their offspring. Providing novel empirical data, this article informs ethical deliberation and raises imminent questions for further research in this understudied geographic region and on cross-border reproductive treatment. This review essay examines the contribution of Legislated Rights (Webber et al, Cambridge 2018) to a central issue in constitutional theory: namely, how the institutional division of labour between the legislature and the judiciary with respect to the task of giving effect to constitutional rights is best understood and conceived. In doing so, the essay situates the work within contemporary scholarship and adopts a broadly comparative lens — a perspective that is mindful of key developments in constitutional law and theory (...) over the past several decades. Ultimately, it is suggested that a critical weakness of the capacity of Legislated Rights to contribute to contemporary debates about judicial review is its lack of engagement with these developments. As a result, the work’s intervention largely misses its mark. It speaks to an outdated view that does not reflect contemporary constitutional practice or scholarship. (shrink)

This article utilises feminist technoscience studies’ notions of bodily ‘materialisation’ and ‘ontological choreographies’, offering a cyborg feminist account of ‘bioavailability’ as embodied becomings, rather than a fixed ontological state of being. Drawn from 2 years’ ethnographic study in in vitro fertilisation clinics in Spain with migrant women who provided eggs to the cross-border in vitro fertilisation industry, this work explores how global understandings of race and inequalities, clinical practices and women’s own emotional and physical labours collectively produce bioavailability. Through examples (...) from observations and interviews in in vitro fertilisation clinics, we examined women’s embodied stories to understand the ways in which bioavailability becomes. The article demonstrates a novel way in which to think about ‘bioavailability’, a concept which has already been of enormous use to the social sciences since its introduction by Lawrence Cohen. We examine recent configurations of bodily extraction in the reproduction–migration nexus that help us rethink the concept of bioavailability. (shrink)

Three questions are generated by the issue of the continuity and consistency of Husserl's presentations of the reduction from his early to his last works: did Husserl himself consider these presentations to be continuous and consistent? Do the texts show these presentations to be continuous and consistent? and, Should these presentations, on philosophical grounds, have been continuous and consistent? My thesis is that all three questions can be answered affirmatively. ;I argue, first, that there is some textual evidence that Husserl (...) himself considered his presentations of the reduction to be continuous and consistent; second, that a reconstruction of the arguments for the reduction in the Ideas, Formal and Transcendental Logic, Cartesian Meditations, and Crisis shows that central elements of both the Cartesian and ontological ways are present in each of these texts; and, finally, that a full and clarified meaning for the reduction requires both Cartesian and ontological components, because each way on its own raises problems only approachable via the other way. ;In critically examining the contrary interpretations of Iso Kern, Ludwig Landgrebe, and David Carr, I respond to arguments that phenomenology is internally inconsistent in its treatment of intersubjectivity, temporality, kinaesthesia, and life-world, by showing that this conclusion rests in each case on the tacit and undefended premise that phenomenology does and must posit a founding domain that is opaque to reflection. I argue that, consistent with the transcendental concept of intentionality, these topics must be approached in terms of phenomena functioning in the experience of the reflecting philosopher. ;I conclude that phenomenology has not been demonstrated to be in principle incapable of addressing these topics, and I propose a meaning for the reduction , involving an interplay of Cartesian and ontological elements, that preserves the transcendental character of Husserl's philosophy. I argue that judgments of what is ‘true in a fiction’ presuppose the Reality Assumption: the assumption that everything that is true is fictionally the case, unless excluded by the work. By contrast with the more familiar Reality Principle, the Reality Assumption is not a rule for inferring implied content from what is explicit. Instead, it provides an array of real-world truths that can be used in such inferences. I claim that the Reality Assumption is essential to our ability to (...) understand stories, drawing on a range of empirical evidence that demonstrates our reliance on it in narrative comprehension. However, the Reality Assumption has several unintuitive consequences, not least that what is fictionally the case includes countless facts that neither authors nor readers could ever consider. I argue that such consequences provide no reason to reject the Reality Assumption. I conclude that we should take fictions, like non-fictions, to be about the real world. (shrink)

This article documents a moment in history when poor and working-class white boys and men are struggling in their schools, communities, and workplaces against the “Other” as a means of framing identities. Drawing on two independent qualitative studies, the authors investigate distinct locations where poor and working-class boys and men invent, relate to, and distance from marginalized groups in an effort to create self. First the authors look at an ethnography of “the Freeway boys,” a community of urban white working-class (...) high school boys who must deal with the economic ravagement of their neighborhood and their insecure place in a world different than that of their fathers. Next, the authors draw from a large-scale survey of young adults to hear how a combined sample of urban poor and working-class white men narrate identities that are carved explicitly out of territory bordered by white women and African American men. Across sites, the authors theorize how high schools and workplaces both, in part, create white masculinities and interrupt them, at a time when white working-class boys and men feel under siege. The author addresses ethical issues involved in the assignment of grades and student evaluations in undergraduate courses. The author prescribes an ethical approach to grade assignment. Instructors, according to the author, should take into account various factors in grading assignment like the student's individual efforts, improvement throughout the course, the student’s general psychological state, and potential disadvantaged starting points in the educational process. Instead of basing grade assignments on judgments from arbitrary criteria or letting them be an expression of power, (...) the author suggests incorporating the variability model into the practice of grade assignment. A conflict within the community of those investigating business ethics is whether decision makers are motivated by an ethics of justice or an ethics of caring. The proposition put forward in this paper is that ethical orientations are strongly related to cultural backgrounds. Specifically, Hofstede's cultural stereotyping using his masculine-feminine dimension may well match a culture's reliance on justice or caring when decisions are made. A study of college graduates from six countries showed that Hofstede's dimension was remarkably accurate in (...) predicating a justice or caring orientation for decision makers from five of the six countries.
