Part Five is in considerable need of revision. There have been many developments in medicine and health care that present serious moral challenges to the teachings of the Church. The recommendations below include new emphasis on palliative care and hospice, the right of Catholics to receive the sacraments and visits from the family during illness, further safeguards to protect those in a persistent vegetative state, the immorality of voluntary stopping of eating and drinking (VSED), the permissibility of do (...) not resuscitate (DNR) orders, the limited use of palliative sedation, and the requirement that the standards for determining death be rigorously applied by medical professionals. Other minor recommendations seek to bring greater clarity to the existing directives. (shrink)

As a legitimate authoritative directive is a second-order reason, it defeats conflicting reasons by a process of exclusion. Nonetheless, a legitimate authoritative directive can be defeated by more weighty reasons, including, as I argue in this paper, the more weighty reasons it excludes. This is part of a value pluralist conception of authority, according to which there is no general rule for the resolution of conflicting reasons. And I advance this argument in response to the work of Joseph Raz. (...) Although Raz is a value pluralist, he posits a general rule for the resolution of some conflicts: namely, that an exclusionary reason cannot be defeated by a (more weighty) reason it excludes. This represents a weak version of value pluralism. My argument is that Raz does not succeed in his efforts to show that this general rule either better ensures conformity with reason or that it is justified by commitment to autonomy. (shrink)

The first part of this paper surveys five perspectives in Kant’s philosophy on the quantity of retribution to be inflicted on wrongdoers, ordered by two dimensions of difference – whether they are theoretical or practical perspectives, and the quantity of retribution they prescribe: (1) theoretical zero, the perspective of theoretical philosophy; (2) practical infinity, the perspective of God and conscience; (3) practical equality, the perspective of punishment in public law; (4) practical degrees, the perspective we adopt in private (...) relations to others and (5) practical zero, a perspective I argue is entailed by Kant’s doctrine of strict right, which is his justification of coercing compliance with public law. Kant acknowledges 1–4 but not 5. The second part draws on Kant’s account of the burden of proof in criminal law to argue that Kant is wrong to adopt 3 in responding to criminals, and that we ought to adopt 5 instead. (shrink)

While discussing how the grounded theory mediod has been situated during the five moments of qualitative research history, a detailed analysis is offered of die differences between the classic mode of die mediod and Strauss and Corbin's reformulation of the mediod. Such differences include: philosophical perspectives, paradigm of inquiry, intended product, dieoretical underpinnings, procedural steps and claims of rigour. Reasons for Strauss. and Corbin's elaboration of the mediod are suggested, widiin an historical context.

This paper proposes a five-part empirical typology of interconnections of race and class. We describe the mechanisms whereby (1) race is a form of class relation; (2) race relations and class relations reciprocally affect each other; (3) race acts as a sorting mechanism into class locations; (4) race acts as a mediating linkage to class locations; and (5) race interacts with class in determining other outcomes. Rather than insisting on one or another mechanism as the overarching framework for (...) conceptualising the interconnections between race and class, we propose a theoretical integration of all five within a functionalist model. The model reconciles the empirical effects of race variables with a class-functionalist explanation of race. Our typology of interconnections is useful for situating concrete empirical phenomena, and our theoretical integration of those interconnections offers a coherent explanatory system that captures the recursive causality of race and class. In the following workshop commentary, I present these five kinds of deterrence and explain them in light of recent developments in the academy and industry. I argue for analytical congruence between all (...) three novel concepts, since they aim to alter the behaviour of actors by adding a social cost in response to breaking norms and conventions. Throughout, I argue that we are beginning to understand how cyber deterrence works, both in theory and practice, and when all concepts are taken together, they become more than the sum of their parts. Optimization, in general, is regarded as the process of finding optimal values for the variables of a given problem in order to minimize or maximize one or more objective function(s). Brain storm optimization (BSO) algorithm solves a complex optimization problem by mimicking the human idea generating process, in which a group of people solves a problem together. The aim of this paper is to present hybrid BSO algorithm solutions in the past 5 years. This study could be divided into two (...) parts: strategies and applications. In the first part, different strategies for the hybrid BSO algorithms intended to improve the various ability of the original BSO algorithm are displayed. This paper illuminates primary epistemic functions of teleological characterizations in ecology through discussion of the historical and conceptual origins of the theoretical branch of ecology (§§1–2). I subsequently defuse enduring confusions about the use of teleological characterizations in ecology; with a focus on recent critical arguments by Sagoff in this journal (Sagoff, Synthese 193:3003–3024, 2016) and some other places (e.g., his Sagoff, Ethics, Policy, and Environment 16:239–257, 2013 and Sagoff, Studies in History and Philosophy of Science Part C, 2017) (...) The paper then culminates by collecting five generalizable novel insights attained through the forgoing discussion and outlining avenues for follow-up work that can build on the arguments laid out in this paper (§4). This commentary further explores some of the ethical issues raised by Prof. Peter Singer in his Lanson Lecture “Pandemic Ethics: Five Lessons”. In the first part, I distinguish a prioritarian approach to the allocation of scarce medical resources, from the utilitarian one advocated by Singer. I suggest that the prioritarian view better matches common intuitions about fair distribution, even though it likely needs to be balanced with other principles if it is to have plausibility in contexts like vaccine (...) allocation. In the second part of the commentary, I take a global perspective (as Singer himself does regarding the ethics of lockdowns), and highlight the controversial implications of adopting a fully cosmopolitan ethical outlook when deciding how to distribute Covid-19 vaccines. I also raise justice-related concerns about Singer’s proposal to use well-being as a single metric for evaluating public health policies. (shrink)

There is now a general consensus that Xunzi's criticism of Zisi and Mengzi for advocating wu Xing 五行 is explained by the excavated text known as Five Conducts, but the five conducts play no significant role in the Mengzi. This article aims to determine more precisely what the Mengzi and Wu xing have in common, while also making sense of the ways in which they diverge. The first part of the article analyzes the distinction between goodness and (...) de 德. The anthology presents a selection of methodological writings pub lished by Polish logicians after World War 11. All the papers belong to what may be called Logical Methodology or Logical Theory of Science. The epithet 'logical' characterizes rather the general point of view than the particular methods employed by the authors. Apart from articles which make an essential use of different formal methods, there are many which do not involve any formal apparatus whatsoever. The problems the papers deal with may (...) be characterized as problems of the general methodology of empirical science. The papers do not consider the methodological problems of formal knowledge, and, as a rule, they are concerned with empirical science as a whole and not with some of its specific branches. The topics covered by the selected writings include the main issues and controversies discussed within the contemporary methodology of science. A considerable part of the anthology is con cerned with the semantics of empirica1languages and considers problems such as interpretation of observational and theoretical terms, analyticity, empirical meaningfulness, etc. Another group of papers deals with the problem of induction and examines various ways of its justification. Some articles discuss the nature and the status of methodology itself. By analyzing various interplays that the zoological treatises posit between, on the one hand, the form and end of each species and, on the other hand, its material and efficient causes, Pellegrin reveals the astounding depth of Aristotle’s affinity with modern biology.In consideration of the millennia-spanning distance between Aristotle and the emergence of modern biology in the nineteenth century, Pellegrin first of all seeks to establish that he may call Aristotle a biologist without committing anachronism. After a lengthy discussion of hypothetical necessity, Pellegrin uses PA 1.1’s distinction between formal nature and material nature to suggest that Aristotle recognizes an “ontological autonomy” of material nature, by which he seems to mean that matter has certain properties independent of any form. Linking Aristotle to Darwin, he argues that for Aristotle the perfection of each species consists in its fitness for (everlasting) survival. The end-directed formal nature of the species must negotiate with its autonomous material nature in order to secure for it an advantageous condition that guarantees its permanence but inevitably comes at the expense of certain disadvantages. For example, birds have no ears because they need extra matter for feathers (see PA 2.12).Shifting the focus to a crucial difference between Aristotle and modern biology, chapter 3 investigates the unity of Aristotelian natural science and biology’s place within it. Pellegrin finds analogies between Aristotle’s explanations of sexual reproduction, spontaneous generation, and Meteorology ’s account of the formation of inanimate homoiomerous matter (for example, metals, minerals). Sexual reproduction (clearly involving a material, formal, efficient, and final cause) is more causally complex than spontaneous generation (which according to Pellegrin has no preexisting final cause and only a quasi-formal cause), yet we understand spontaneous generation only by analogy with sexual reproduction, which is for Aristotle explanatorily prior. Spontaneous generation, in turn, is marginally more complex than the formation of homoiomerous matter (which also has only a quasi-formal cause and, further, no final cause at all), yet we understand the latter only by analogy with spontaneous generation and sexual reproduction. Pellegrin concludes that all natural science is united insofar as “material-efficient causality concerns all natural realities,” living and nonliving alike; however, because Aristotle in each case explains the less complex by analogy with the more complex, the teleological study of fully developed living things is explanatorily primary within his natural science. In this way, Aristotle stands in stark contrast to modern natural science, in which biology is explanatorily posterior to chemistry and physics.Chapter 4 qualifies the explanatory priority of complex organisms by challenging any notion of an Aristotelian scala naturae. In this pilot qualitative study 13 clinical bioethicists from across Canada were interviewed about their experiences of conflicts of interest and/or conflicting interests in their professional roles. The interviews generated five composite cases. Participants reported being significantly impacted by these experiences both personally and professionally.

In the Roman Republic, in the case of the death of both consuls or a situation which made it impossible to proceed with the election of their successors, the Senate would decide to establish an interregnum. For that the senators chose several persons of patrician dignity from among their midst, and awarded them the auspices and the signs of magisterial power. The interreges had the task of preparing for the elections of new consuls and hold the electoral assembly. Although the (...) interreges had been chosen by the Senate, rather than elected by the People, and were in power for a short period, they resembled extraordinary magistrates. The interrex was appointed by the senator with auspices; likewise, the magistrate was elected in accordance with the will of the gods. As well as the auspices and the attributes of magisterial power, the interreges were provided with anius agendi cum patribus et cum populoand could summon the People to the centuriate assembly. In an epistle to C. Trebatius Testa, written in January 53, Cicero ironically said that, with such a large number of interreges, an experienced lawyer could use them to prepare a defence in civil suits by asking each interrex for two adjournments to obtain legal assistance. Interreges, albeit as part of a jest, were seen here as holders of some civil jurisdiction. Referring to Asconius' clarification that a certain M. Lepidus was appointed interrex because he had been elected as a curule magistrate, Theodor Mommsen concluded that every interrex was regarded as magistrate. In fact, Asconius means here that Lepidus held a curule magistracy in addition to his being interrex. Nevertheless, the notion of extraordinary magistrate has been frequently applied to the interrex by modern scholars. When interreges periodically appeared at the head of the Republic as holders of auspices and of the signs of the highest power for five days, the Romans became accustomed to thinking that the interreges received supremacy for that period. This paper explores the issue of democracy and the role of the democratic classroom in the development of society in general, and the way in which educators understand and deal with diversity in particular. The first part of the paper explores different meanings of democracy and how they can be manifested in the classroom. We argue that the idea of a ‘democratic classroom’ is far too broad a category; democracy is defined in action and can have realist or pragmatic (...) characteristics, elitist or pluralist roots. The realist form of social education was championed by political scientist Charles Merriam, while a social educative process more dependent on pragmatic problem solving was pursued by educational philosopher John Dewey and those who followed in his theoretical wake. The history of democracy in the United States, and the battles of how to import different meanings of democracy into the classroom over the course of the 20th century is explored, suggesting that the educational establishment has a tendency to adopt more realist/elitist forms of civic education. We present five ‘democratic’ classrooms with different characteristics to illustrate the different characteristics social education can exhibit. In the second part of the paper we discuss the relationship between different types of democratic classrooms and issues of race/ethnicity/culture. (shrink)

Salvation is an important part of the Christian faith. In the acronym, TULIP shows the principle that salvation is certain. A sovereign God saves humans. John Calvin has a soteriological concept that focuses on God's sovereignty. Calvin's soteriological thinking is contained in the TULIP acronym formulation of salvation. At present there are problems with the environment, a great deal of environmental degradation has led to a relational disharmony. Such conditions require responses from people who have been saved so that (...) the concept of Cosmic Missiology is an important thing to put forward. Then are there any doctrinal formula implications of the TULIP acronym that can be implemented to realize a motivation for doing a cosmic mission? Through this article, a review will be carried out to see the implications of the five points of Calvinism and their implementation for cosmic missiology. (shrink)

Philosophers have long noticed the similarity of identity over time and identity across worlds. Despite this similarity, analogous views on these matters are not always taken equally seriously. Four-dimensionalism is one of the most well-known accounts of identity over time. There is a clear modal analogue of four-dimensionalism, on which objects are modally extended and their trans-world identity is a matter of having distinct modal parts located in different possible worlds. Yet this view, which we might call ‘five-dimensionalism,’ is (...) rarely discussed or defended, in comparison to its temporal counterpart. I argue that five-dimensionalism is at least as plausible as four-dimensionalism and deserves serious consideration as an account of trans-world identity. The strategy is to show that arguments typically used in defence of four-dimensionalism can be adapted to defend five-dimensionalism as well. A powerful consideration in favour of four-dimensionalism is the fact that it provides an elegant and unified solution to a variety of puzzles concerning material coincidence. I show that such puzzles come in equally troubling modal varieties and that five-dimensionalism provides an equally unified and elegant solution to them. (shrink)

Euthyphro is frequently dissected for its philosophical dilemmas regarding god’s love’s relation to holiness, and whether justice is a part of the holy or the converse. But how can we understand it as a literary whole? This paper exhibits five ways in which it can be so understood: Euthyphro is the subjectivist patsy (both a literalist and divine command theorist) playing against Socrates’ natural law-like moral objectivity; the dialogue is elenchic because the dilemmas are true; the dialogue is (...) elenchic, but the dilemmas are false; the dialogue produces a double irony; the irony is in the existence of the dialogue. This book uses mathematical models of language to explain why there are certain gaps in language: things that we might expect to be able to say but can't. For instance, why can we say I ran for five minutes but not *I ran to the store for five minutes? Why is five pounds of books acceptable, but *five pounds of book not acceptable? What prevents us from saying *sixty degrees of water to express the temperature of (...) the water in a swimming pool when sixty inches of water can express its depth? And why can we not say *all the ants in my kitchen are numerous? The constraints on these constructions involve concepts that are generally studied separately: aspect, plural and mass reference, measurement, and distributivity. In this book, Lucas Champollion provides a unified perspective on these domains, connects them formally within the framework of algebraic semantics and mereology, and uses this connection to transfer insights across unrelated bodies of literature and formulate a single constraint that explains each of the judgments above. Whereas professional persuasion is a means to an immediate and instrumental end, ethical persuasion must rest on or serve a deeper, morally based final end. Among the moral final ends of journalism, for example, are truth and freedom. There is a very real danger that advertisers and public relations practitioners will play an increasingly dysfunctional role in the communications process if means continue to be confused with ends in professional persuasive communications. Means and ends will continue to be confused unless (...) advertisers and public relations practitioners reach some level of agreement as to the moral end toward which their efforts should be directed. In this article we advance a five-part test that defines this moral end, establishes ethical boundaries that should guide persuasive practices, and serves as a set of action-guiding principles directed toward a moral consequence in professional persuasion. The TARES Test consists of five principles: Truthfulness, Authenticity, Respect, Equity and Social Responsibility. Background Positivism is sometimes rejected for the wrong reasons. Influential textbooks on nursing research and in other disciplines tend to reinforce the misconceptions underlying these rejections. This is problematic, since it provides students of these disciplines with a poor basis for making epistemological and methodological decisions. It is particularly common for positivist views on reality and causation to be obscured. Objectives and design The first part of this discussion paper identifies and explains the misconceptions about positivism as they appear (...) in two influential textbooks. The second part pinpoints five mistakes these misconceptions easily result in when the researcher adopts an epistemological and methodological standpoint. What is already known about the topic? There are several impeccable descriptions of positivism in nursing research literature; but a relatively large number of inaccurate or confused views of positivism appear in the nursing research literature as well. Mistakes of the kind identified in this paper have been noted before—for instance, in Shadish. What this paper adds: This paper provides a detailed analysis of two particularly common and influential misconceptions about positivism. It traces the historical roots of these misconceptions and characterizes them more carefully than many earlier attempts have done. The paper shows how and why these misconceptions affect epistemological and methodological decisions negatively, regardless of one’s interest in positivism. (shrink)

In concluding section 2, chapter VI of part II of [6], Duhem claimed:... the physicist can never subject an isolated hypothesis to experimental test, but only a whole group of hypotheses...... when the experiment is in disagreement with his predictions, what he learns is that at least one of the hypotheses constituting this group is unacceptable and ought to be modified; but the experiment does not designate which one should be changed'.

There is at least one immediate sense in which legal discourse is perspectival: it qualifies acts and facts in the world on the basis of rules. Legal concepts are for the most part constituted by rules, both in the sense that rules define these concepts’ semantic content and that, in order to engage with legal practice, we must act according to those rules, not necessarily complying with them but at least having them in mind. This is the distinctive perspective (...) of law: however, it would be misleading to think that this is the only perspective we can have in legal discourse. That of rule-constituted legal concepts is the fundamental perspective -- the inevitable presupposition of most legal assertions -- but other perspectives are possible on top of this fundamental background: perspectives on law, stemming from the basic perspective of law. -/- In this paper, I will try to argue that some different perspectives regarding law can be accounted for by analyzing different kinds of concepts that emerge in connection with legal institutions. My argument will consist of three steps as follows. First, I will explain how legal concepts are constituted by rules, referring in this regard to John Searle’s analysis of institutional concepts as it emerges in his Making the Social World, of 2010, and amending this analysis according to some criticisms that in 1986 Neil MacCormick had raised against Searle with specific reference to the legal domain. -/- Second, I will show that there are some kinds of concepts relevant for an institution which are not captured by Searle’s analysis in terms of constitutive rules, even if this is amended according to MacCormick’s criticisms. This I will do by considering the game of chess as a simple system of rule-constituted concepts (concepts such as 'checkmate,' 'bishop,' 'king'). I will consider four examples of perfectly legitimate assertions regarding a match of chess -- these being (1) ‘I won’; (2) 'you made a good attack'; (3) 'you are cheating'; (4) 'you made good use of the first-move advantage,' and I will show that, while the first three assertions can be analyzed in terms of concepts (those of 'victory,' 'attack,' and 'cheating') which are not constituted by the rules of chess but are rather common to several different competitive games, being typical of the broader practice of competitive game-playing of which chess is an instance, the fourth assertion includes a concept (that of 'first-move advantage') which is peculiar to chess, just like a rule-constituted element, but is not constituted by the rules of chess. This analysis will lead to a new categorization of institutional concepts. Apart from rule-constituted institutional concepts, which are the only ones recognized by Searle, in order to account for cases (1), (2), and (3) I will distinguish between three kinds of meta-institutional concepts, namely, goal-oriented, mode-oriented, and value-oriented meta-institutional concepts, and then I will introduce the category of para-institutional concepts to account for case (4). -/- Finally -- and this is the third step of my argument -- I will explain how these different kinds of institutional concepts appear when we adopt different perspectives on the institutional frameworks we deal with. This will lead us to a categorization of possible perspectives regarding law that corresponds to the previous one regarding concepts. There is first a structural perspective regarding the instantiation of institutional elements which clearly involves rule-constituted institutional concepts -- as when we say 'I am making a will.' There is then a teleological perspective regarding the goal of our institutional acts which calls into question goal-oriented meta-institutional concepts -- as when we say 'I wrote that will in order for you to have a distinctive right to my property.' Then, we can adopt a strategical perspective regarding some peculiar ways in which institutional acts can be performed, and this has often to do with mode-oriented meta-institutional concepts -- as when we say 'the Labour Party is making parliamentary obstructionism so that the Government will fall before the enactment of the labour reform,' or 'workers start today a work-to-rule action.' Clearly, we can also adopt an evaluative perspective over institutional facts or acts, and here typically value oriented meta-institutional concepts emerge -- as when we say 'that rule is clearly unjust' or 'that contract is unfair.' Finally, we can limit ourselves to a descriptive perspective on phenomena which are peculiar to a given institutional setting, and here para-institutional concepts are often useful -- as when we say 'the Italian electoral system before 1990 led to a sort of reform paralysis' or 'a strict use of the criterion requiring proof beyond any reasonable doubt can be expected to entail a low conviction rate.'.
