The American Constitution held out the hope that ordinary people were capable of deciding their own fates, and in doing so it immeasurably elevated the dignity of common people. The organization and interplay of the parts that comprise the whole American government exist to provide people the opportunity to govern themselves and, at the same time, reveal the limits of democratic self-rule. The forgetting of these limits is not only destructive to the constitution but the nation as a whole.

Philosophy written in English is overwhelmingly analytic philosophy, and the techniques and predilections of analytic philosophy are not only unhistorical but anti-historical, and hostile to textual commentary. Analytic usually aspires to a very high degree of clarity and precision of formulation and argument, and it often seeks to be informed by, and consistent with, current natural science. In an earlier era, analytic philosophy aimed at agreement with ordinary linguistic intuitions or common sense beliefs, or both. All of these aspects of (...) the subject sit uneasily with the use of historical texts for philosophical illumination. The obligation of a court to follow the law of a superior court is commonly taken to be stronger than the obligation of the higher court to respect its own precedent. The Supreme Court has recently asserted this stronger obligation in the most forceful terms. What follows is an attempt to demonstrate that this is wrong as a matter of policy and as a matter of law.

This book is a selection of papers from a conference which took place at the University of Keele in July 1982. The conference was an extraordinarily enjoyable one, and we would like to take this opportunity of thanking all participants for helping to make it so. The conference was intended to allow scholars working on different aspects of symbolic behaviour to compare findings, to look for common ground, and to identify differences between the various areas. We hope that it was (...) successful in these aims: the assiduous reader may judge for himself. Several themes emerged during the course of the conference. Some of these were: 1. There is a distinction to be made between those symbol systems which attempt, more or less directly, to represent a state of affairs in the world (e. g. language, drawing, map and navigational skill) and those in which the representational function is complemented, if not overshadowed, by properties of the symbol system itself, and the systematic inter-relations that symbols can have to one another (e. g. music, mathematics). The distinction is not absolute, for the nature of all symbolic skills is, in part, a function of the structure of the symbolic system employed. Nonetheless, this distinction helps us to understand some common acquisition difficulties, such as that experienced in mathematics, where mental manipulation of symbols can go awry if a child assumes too close a correspondence between mathematical symbols and the world they represent. 2. Literary-communicational theory offers a foundation for two types of literary criticism whose workings are basically ameliorative: mediating criticism, which seeks to bridge the gaps between writers and readers who are differently positioned; and communicational criticism, which offers an ethical assessment of literary writing as communication. The present article illustrates the processes of mediating criticism, by trying to help its own readers understand the religio-historical sitedness of the early-seventeenth-century English Catholic poet, Sir John Beaumont. More extensively, the article pays attention (...) to Beaumont’s use of cultural memory, as an illustration of communicational criticism. In some of his poems, Beaumont was communicationally exclusive, appealing to past history in a defensive spirit, as part of an effort to purify and strengthen a Catholic identity under threat. Elsewhere, he resorted to cultural memory in communicational gestures that were more inclusive, and of three different kinds. Sometimes his Catholicism went on to the offensive, and he arrogated a common memorial ground in a coercive, missionary spirit. Sometimes his inclusivity may strike a present-day reader as disingenuous, in that it involved a self-disguising, self-betraying acquiescence in the royal court’s dominant, non-Catholic discourse. Sometimes the play of cultural memory was altogether more dialogical in spirit: an inclusiveness which was neither aggressive not self-demeaning, but which invited readers to compare notes in the hope of viable co-existence. _The Undiscovered Dewey_ explores the profound influence of evolution and its corresponding ideas of contingency and uncertainty on John Dewey's philosophy of action, particularly its argument that inquiry proceeds from the uncertainty of human activity. Dewey separated the meaningfulness of inquiry from a larger metaphysical story concerning the certainty of human progress. He then connected this thread to the way in which our reflective capacities aid us in improving our lives. Dewey therefore launched a new understanding of the modern (...) self that encouraged intervention in social and natural environments but which nonetheless demanded courage and humility because of the intimate relationship between action and uncertainty. Melvin L. Rogers explicitly connects Dewey's theory of inquiry to his religious, moral, and political philosophy. He argues that, contrary to common belief, Dewey sought a place for religious commitment within a democratic society sensitive to modern pluralism. Against those who regard Dewey as indifferent to moral conflict, Rogers points to Dewey's appreciation for the incommensurability of our ethical commitments. His deep respect for modern pluralism, argues Rogers, led Dewey to articulate a negotiation between experts and the public so that power did not lapse into domination. Exhibiting an abiding faith in the reflective and contestable character of inquiry, Dewey strongly engaged with the complexity of our religious, moral, and political lives. (shrink)

Rawls and Schmitt are often discussed in the literature as if their conceptions of the political had nothing in common, or even referred to entirely different phenomena. In this essay, I show how these conceptions share a common space of reasons, traceable back to the idea of public reason and its development since the Middle Ages. By analysing the idea of public reason in Rawls and in Schmitt, as well as its relation to their theories of political representation, I show (...) in what way Schmitt's concept of the political cannot be divorced from an idea of justice, while, conversely, Rawls' conception of justice cannot be divorced from a theory of the political. In that way this paper thematizes the internal relation that each theory establishes between justice and power, deliberation and decision, and consensus and disagreement. (shrink)

Political philosophy was once dominated by discussion of the virtues of character and their importance to the good life and the good society. Contemporary political philosophers, however, following the towering influence of John Rawls, have primarily focused on a single virtue of institutions: justice, while largely avoiding controversial claims about the good life. As a result, political philosophy lacks a unified account of the virtues of institutions and the virtues of character. More importantly, we lack an understanding of the (...) connection between the just society and the good life. This book begins to mend this broken seam, which, on reflection, lies at the heart of our deepest political problems. The book’s central argument is that the virtues of character require institutions, while good institutions enable persons to live together virtuously. Political institutions are a necessary precondition for the moral agency exhibited by the virtues. But good institutions enable virtue to grow, while helping to constrain the excesses of vice. On this view, justice emerges primarily as a virtue of character, not institutions. The just person balances conformity to existing institutional norms with practically wise reforms. Ultimately, this book concludes that the just society and the good life are linked through the common good of virtuous activity within the shared institutions of a political community. (shrink)

It is the ancients, and especially Aristotle, who have most influenced the development of ‘virtue ethics’ over the last forty years or so. That influence has manifested itself in various ways: a focus on character as well as or instead of action, a grounding of ethics in common-sense morality, an emphasis on the notion of flourishing. One significant aspect of ancient ethical thought on the virtues is its intellectualism. The Socrates of several of Plato’s dialogues identifies virtue with knowledge, and (...) Aristotle allowed ‘practical wisdom’ to play a role as important as habituated dispositions in his account. This paper challenges the view, commonly held inbiolaw and bioethics, that there can be no proprietaryrights in our own bodies or body parts. Whether thestarting point is the post-intervention informedconsent regime of Article 22 of the Convention ofHuman Rights and Biomedicine or the traditional(exclusionary) understanding of private property it isargued that property in our own bodies or body partsis presupposed. Although these arguments do notdemonstrate that there is property of this kind (forthat, a full-scale justification of the institution ofprivate property (...) would be required), they suggestnevertheless that the commonly held view has animmanent property logic that has not yet been drawnout or appreciated. The study of speech acts has been a flourishing branch of the philosophy of language and linguistics over the last two decades, and John Searle has of course himself made some of the most notable contributions to that study in the sequence of books Speech Acts, Expression and Meaning and Intentionality. In collaboration with Daniel Vanderveken he now presents the first formalised logic of a (...) general theory of speech acts, dealing with such things as the nature of an illocutionary force, the logical form of its components, and the conditions of success of elementary illocutionary acts. The purpose of this article is to explain how an account of proper names can be incorporated into a general account of the intentionality of mind and language. I show that such an account supports the so-Called descriptivist conception of proper names and in so doing I answer the objections of causal theorists.

After brief analyses of (1) Newman’s view of knowledge, (2) his view of science, (3) his view of theology as a science, (4) the primacy of the philosophical habit of mind, and (5) the inherent tension within the scientific community, this article relates Newman’s thought to the twenty-first century, particularly the Second Vatican Council’s Gaudium et Spes (Pastoral Constitution on the Church in the World of Today).

This essay argues that Newman’s theology of justification is a true via media between Roman Catholicism and Protestantism because of its Trinitarian character. While conceding that Newman misunderstood Luther’s theology of justification, this essay explores Newman’s theology of justification through Christ’s divine indwelling in the Holy Spirit. The Holy Spirit is the formal cause of the soul’s justice, because through the Spirit, both Christ’s alien righteousness and an actual inherent righteousness are brought to the soul.Accordingly, justification is a Trinitarian action (...) of “the two hands of God.”. Este artigo reformula a Apologia de Sócrates de Platão como uma peça de oratória forense. Examinando os topoi retóricos utilizados por Platão, demonstro como Platão impele os limites do gênero forense da oratória em direção à criação de uma nova prática discursiva: a filosofia. Inicialmente, o artigo examina o conceito de “gênero” em conexão com a oratória forense. Esboçado a partir do trabalho de Mikhail Bakhtin, Tzvetan Todorov e Andrea Nightingale, o artigo estabelece uma consonância entre as concepções de gênero (...) destes eruditos e aquilo que outros eruditos definiram como “gênero” oratório forense. Assim, o artigo levanta a questão do porquê a Apologia de Platão tradicionalmente ter sido excluída deste gênero. Argumento que certas visões concernentes à presumida historicidade das falas rotuladas como “oratória forense” precisam ser reexaminadas, já que não há evidência clara de que os atenienses requeressem acurácia histórica de discursos que agora classificamos como oratória forense. Ao remover a exigência de historicidade, obtemos um quadro mais preciso do que constitui a oratória forense e porque a Apologia de Platão merece pertença neste gênero. O artigo, então, examina detalhadamente vários topoi retóricos na Apologia. Argumento que, pela manipulação e remodelação de tais topoi, Platão expande e redefine o gênero da oratória forense para incluir a nova prática discursiva da filosofia. O artigo revela como a redefinição platônica dos limites da oratória forense transformaram uma fala jurídica de defesa em um tribunal na condição sine qua non do filósofo e da vida filosófica. Given recent technological advances, we now are able to invade personal privacy as never before. The challenge in the business community is to make the most of the opportunities presented by the growth in communication technology while, at the same time, protecting what remains of individual privacy. The conflict between technological advances and privacy concerns is not new, but it has grown exponentially in recent years, and the development of a data protection scheme in the European Union lends a certain (...) economic urgency to meeting the challenge.Pursuant to a Directive adopted by the European Union, privacy protections throughout the EU must become more stringent and consistent throughout EU member countries. One area of great concern to the United States is the Directive's requirement for certain minimum standards of privacy protection in countries receiving information from member countries. Given the limited protections available in the United States, it does not appear that the United States meets these minimum standards. The purpose of this paper is to critically analyze the existing measurements of global privacy protections and to propose a new model which allows for their comparative evaluation. (shrink)
