The medical decision-making process is currently in flux. Decisions are no longer made entirely at the physician's discretion: patients are becoming more and more involved in the process. There is a great deal of discussion about the ideal of ‘informed consent’, that is that diagnostic and therapeutic decisions should be made based on an interaction between physician and patient. This means that patients are informed about the advantages and disadvantages of a treatment as well as alternatives to the treatment; then, (...) based on this information they can decide whether or not they want to undergo the treatment. However, recent studies show that the realisation of the ideal of ‘shared decision-making’ faces a number of difficulties related to the fact that patients are not provided with complete and accurate information. Using the example of breast cancer screening, this article examines the question of whether, in light of these difficulties, the ideal of informed decision-making is only an illusion or whether concrete steps can be taken towards the realisation of this ideal. Hospices consider themselves places that practise a holistic form of terminal care, encompassing physical and psychological symptoms, and also the social and spiritual support for a dying patient. So far, the underlying ethical principles have been treated predominantly in terms of a normative theoretical discussion. The interview study discussed in this paper is a qualitative investigation into general and hospice-related conceptions of morality among full-time and voluntary workers in German inpatient hospices. It examines moral conflicts and efforts leading to their (...) solution. The main ideas identified include moral neutrality towards the patients and their requests, the capability of acceptance, the idea of self-restraint with respect to the dying patient and the principle of respect for the natural course of dying. Essential triggers for moral conflicts were the inadequate education of patients, problems of acceptance in view of incurable disease, and disagreements between members of patients' families. The interviewees expressed their scepticism towards formal institutions of ethical counselling. The study has shown a type of virtue ethics that forms an integral part of the overall concept of hospice care, which cannot be treated separately from a holistic idea of care at the end of life. Purpose The paper aims to investigate whether dissent—within hospices and palliative care units—can be observed with regard to typical characteristics of “good dying”, how statements about dying processes that are not perceived as good are expressed, and finally which ethically significant normative consequences arise from this. Method The study is conducted on the basis of a qualitative interview study in different groups of actors and the relationships of these groups are compared with each other. Results Notions of good and bad (...) dying are articulated—even dissented upon—not so much by the patients and their relatives themselves as by the professional actors. This is connected with the requirements of a practice, which evidently evokes a need for accountability, namely for communicative assurance. Conclusion An abstract designation of “good dying” is in danger of losing sight of the contextual characteristics of the practice associated with it, which can lead to situations that are problematic from an ethical viewpoint. Der Beitrag will der Frage nachgehen, ob innerhalb von Hospizen und Palliativstationen in Bezug auf typische Merkmale des „guten Sterbens“ jenseits von in der Literatur erhobenen Konsensen auch Dissense beobachtet werden können, wie Sterbeverläufe, die als nicht gut betrachtet werden, zu Wort kommen, und schließlich: welche ethisch beachtlichen normativen Konsequenzen sich daraus ergeben.Die Studie wird auf der Grundlage einer qualitativen Interviewstudie in der Befragung unterschiedlicher Akteursgruppen sowie im Vergleich dieser Gruppen durchgeführt.Artikuliert werden – auch dissentierende – Vorstellungen von einem guten (...) und einem schlechten Sterben, und zwar kaum von den Betroffenen und ihren Angehörigen selbst als vielmehr von den professionellen Akteuren. Die Ausprägung einer solchen Semantik hängt mit den Erfordernissen einer Praxis zusammen, die offenbar ein Rechenschaftsbedürfnis in Form von kommunikativer Vergewisserung evoziert.Eine abstrakte Bestimmung des „guten Sterbens“ steht in Gefahr, die kontextuellen Besonderheiten der damit verbundenen Praxis nicht mehr in den Blick zu bekommen, was zu in ethischer Hinsicht problematischen Situationen führen kann. Im Gegensatz zum Idealbild des "mundigen Patienten" zeichnen sich viele Patienten gerade dadurch aus, dass sie die Fahigkeit zur Autonomieausubung vorubergehend oder dauerhaft verloren oder aber gar nicht erst erworben haben. Zu denken ist hier etwa an alte und demente Patienten, an Patienten, die sich aufgrund von Drogen- oder Medikamenteneinwirkung (z. B. auf der Intensivstation) nicht aussern konnen sowie auch an Kinder oder geistig behinderte Patienten. Daher besteht ein grosser Bedarf an ethisch gerechtfertigten und zugleich an der Praxis ausgerichteten Handlungsorientierungen (...) zur Entscheidungsfindung bei nicht einwilligungsfahigen Patienten. Das interdisziplinar angelegte Werk beleuchtet auf medizinethischer und rechtlicher Basis praxisorientiert die Frage sowie die Moglichkeiten, wie in Situationen, die keine eigene Entscheidung durch die Patienten uber die weitere Behandlung ermoglichen, dennoch die Patientenautonomie respektiert werden kann. The authors present a case study involving truth telling responsibilities in the setting of nonepileptic seizures. Specifically, over the course of several suspected nonepileptic seizures, a patient’s seizures stopped after he received a saline flush meant to precede the administration of anti-seizure medication. The patient and his surrogate believed he had received the medication each time, and the team wondered whether they should disclose the truth. Some worried that disclosure would reinforce the suspected psychogenic behavior, exacerbating the patient’s condition. In (...) this way, the case study presents a twist on the traditional truth telling archetype. While most truth telling cases center on navigating cultural differences or worries about emotional harm, this case presented concerns about medical harm in the form of exacerbating the patient’s condition. The authors describe the complex patient-family-team dynamic that preceded this ethical dilemma, describe the case, analyze the ethical issue, and describe the outcome. (shrink)

Liebe und was du willst, das tue! Wollte man diesem beruhmten Satz des Augustinus im Wortlaut folgen, konnte man vermuten, dass vieles in unserer Welt sich normieren lasst, nur nicht die Liebe. Die Liebe scheint ihre eigene Norm zu sein. Tatsachlich jedoch ist kaum ein Feld menschlichen Zusammenlebens so stark reglementiert. Der Autor zeichnet die Geschichte der Ein- und Ausschlusse nach, die Menschen gegenuber der Liebe vorgenommen haben: Was durfte in welcher Gesellschaft und in welcher Zeit Liebe heissen, und was (...) nicht? Und vor allem: Warum durfte etwas einmal Liebe genannt werden und einmal nicht? Auf diese Weise tritt die vielfache Bedingtheit eines so "naturwuchsigen" Phanomens, wie es die Liebe zu sein scheint, zutage. Gleichzeitig hilft die historische Rekonstruktion, zu einer tragfahigen Gestalt einer Ethik der Liebe fur die Gegenwart zu gelangen. Richard Hookers starting point was the question of a new social order, the establishment of which long seemed necessary as a result of the various confessional splits and formation of nation states occurring prior to and during his lifetime. His thoughts on these matters were decisively influenced by one particular political occurrence, one that had important consequences for the formation of modern democracy, the Dutch revolution. So Hooker discusses the normative foundations of society. Each person has the right of freedom (...) of conscience and as a necessary consequence must respect the differing beliefs of others. It is not a question here of simply affirming the existing principle of freedom of religion, but much more a matter of shaping the principle into an enforceable right. This position was complemented by the state guaranteed rights of freedom of assembly and freedom of expression. Criticism of the puritans and of Catholicism expressed in defence of the Anglican church and for the maintenance of the political status quo is thus combined with the fundamental question of the normative basis of modern democracy. The question arising for Hooker from this analysis of the scholastic and puritanical positions is: what may be viewed as law and where does law find it justification? What may the legislature decide upon and what are the boundaries of its application? For Hooker the emphasis of moral theoretical observation has been shifted from behaviour itself to the rules underlying behaviour. With the transition, it is these rules that have been placed under systematic scrutiny and for which justification has been sought. The question is: where do these rules find their justification and what underpins their binding nature? The significance and importance of Hooker's new approach is to be found in the question of the specific function of law and state in light of two facts. Firstly, that it is now possible to question the normative function of values and secondly, that rules may be laid down through the machinery of politics. (shrink)

Die qualitative Interviewstudie mit haupt- und ehrenamtlichen Mitarbeiterinnen und Mitarbeitern konnte zeigen, dass in stationären Hospizen ein Konzept von Selbstbestimmung vertreten wird, welches über rein medizinische Entscheidungen weit hinausgeht. Both Carnap and Quine made significant contributions to the philosophy of mathematics despite their diversedviews. Carnap endorsed the dichotomy between analytic and synthetic knowledge and classified certainmathematical questions as internal questions appealing to logic and convention. On the contrary, Quine wasopposed to the analytic-synthetic distinction and promoted a holistic view of scientific inquiry. The purpose of thispaper is to argue that in light of the recent advancement of experimental mathematics such as Monte Carlosimulations, limiting mathematical inquiry to the domain of (...) logic is unjustified. Robustness studies implemented inMonte Carlo Studies demonstrate that mathematics is on par with other experimental-based sciences. (shrink)

Postcolonial science studies entails ostensibly contradictory critical and empirical commitments. Science studies scholars influenced by Bruno Latour and Isabelle Stengers embrace forms of realist, radical empiricism, while postcolonial studies scholars influenced by Jacques Derrida trace the limits of the knowable. This essay takes their common use of the term cosmopolitics as an unexpected point of departure for reconciling Derrida’s program with Stengers’s and Latour’s. I read Derrida’s critique of hospitality and Stengers’s and Latour’s ontological politics as necessary complements for conceiving (...) a care-oriented subalternist cosmopolitics, a process of composing common worlds that remains attentive to the limits of representation. Do famous athletes have special obligations to act virtuously? A number of philosophers have investigated this question by examining whether famous athletes are subject to special role model obligations (Wellman 2003; Feezel 2005; Spurgin 2012). In this paper we will take a different approach and give a positive response to this question by arguing for the position that sport and gaming celebrities are ‘ambassadors of the game’: moral agents whose vocations as rule-followers have unique implications for their non-lusory lives. According (...) to this idea, the actions of a game’s players and other stakeholders—especially the actions of its stars—directly affect the value of the game itself, a fact which generates additional moral reasons to behave in a virtuous manner. We will begin by explaining the three main positions one may take with respect to the question: moral exceptionalism, moral generalism, and moral exemplarism. We will argue that no convincing case for moral exemplarism has thus far been made, which gives us reason to look for new ways to defend this position. We then provide our own ‘ambassadors of the game’ account and argue that it gives us good reason to think that sport and game celebrities are subject to special obligations to act virtuously. In der vorliegenden Arbeit geht es um Entscheidungsspielräume und Entscheidungsprozesse von hauptamtlichen Hospizmitarbeiterinnen und -mitarbeitern in ethisch relevanten Situationen. Wie sich diese Prozesse und Spielräume konkret in der Praxis gestalten, erforschten wir mittels einer qualitativen Studie, die wir in drei Hospizen in Nordrhein-Westfalen durchführten. Als ethische Haupthandlungsfelder nannten die befragten Pflegekräfte die Medikation in der präfinalen Phase, den Umgang mit terminaler Sedierung und mit der Flüssigkeitszufuhr und Ernährung am Lebensende. Entscheidungen innerhalb dieser Felder werden i. d. R. kollektiv getroffen. Die (...) individuellen Entscheidungsspielräume der Mitarbeiterinnen und Mitarbeiter betreffen hauptsächlich den Pflegestil und das auf den Gast bezogene Zeitmanagement. Die Gestaltung dieser Entscheidungsspielräume hängt dabei häufig weniger von einem Rahmenkonzept ab, wie es Leitbilder oder Ethikkodizes nahelegen könnten, als vielmehr von einer Anspruchsanpassung der Pflegenden in der Praxis, wie es Modelle eingeschränkter Rationalität nahelegen. Damit übernehmen die Pflegekräfte in einem Hospiz eine sich selbst beratende wie korrigierende Funktion in ethischen Fragen, die angesichts des individuellen Sterbens eines Gastes immer wieder von Neuem ausgehandelt werden. In ancient China, a revered Taoist sage named Zhuangzi told many parables. In Existential Psychology and the Way of the Tao, a selection of these parables will be featured. Following each parable, an eminent existential psychologist will share a personal and scholarly reflection on the meaning and relevance of the parable for psychotherapy and contemporary life. The major tenets of Zhuangzi's philosophy are featured. Taoist concepts of emptiness, stillness, Wu Wei (i.e. intentional non-intentionality), epistemology, dreams and the nature of reality, (...) character building in the midst of pain, meaning and the centrality of relationships, authenticity, self-care, the freedom that can come from one's willingness to confront death, spiritual freedom, and gradations of therapeutic care are topics highlighted in this book. Relative essentialism, the view that multiple objects about which there are distinct de re modal truths can occupy the same space at the same time, is a metaphysical view that dissolves a number of metaphysical issues. The present essay constructs and defends relative essentialism and argues that it is implicit in some of the ideas of W. V. Quine and Donald Davidson. Davidson’s published views about individuation and sameness can accommodate the common-sense insights about change and persistence of Aristotle and (...) Kripke. Aristotle and Kripke have to give up unmediated direct reference resting on a unique correct articulation of reality into entities. Davidson has to acknowledge a distinction between descriptions giving accidental and those giving essential features of an object. Quine and Davidson were in a position to be a relative essentialist, but were over-impressed by supervenience. The relative essentialist view of beings developed from Quine and Davidson strongly suggests the Heideggerian distinction between beings and Being, and is the perspective from which analytic philosophy can engage that topic. Relative essentialism also connects analytic philosophy to Derrida’s thinking about differance. (shrink)

This paper investigates the emotional import of literary devices deployed in fiction. Reflecting on the often-favored approach in the analytic tradition that locates fictional characters, events, and narratives as sources of readers’ emotions, I attempt to broaden the scope of analysis by accounting for how literary devices trigger non-cognitive emotions. I argue that giving more expansive consideration to literary devices by which authors present content facilitates a better understanding of how fiction engages emotion. In doing so, I also explore the (...) somatic dimension of reading fiction. (shrink)

This reconsideration of Hume’s classic essay “Of Miracles” via the lens of American pragmatist ways of thinking about history and power shifts our attention from Hume’s epistemic concerns about the legitimacy of witnesses and testimony to his distaste for sacred history, his critical stance regarding the social force of revelation, and his disdain for religious authority. To view Hume’s essay both as an articulation of a critical philosophy of history and as an exercise in moral dynamism (social power or, authority, (...) is a result of epistemic transactions), is to intervene in both Hume studies and Contemporary Pragmatism. In this paper I want to do the following things. First I want to show that in the part of the Theaetetus where the relationship between knowledge and perception is examined, the concept of knowledge that is in question is very clearly characterized. We are left in no doubt as to what is to count as knowing. Secondly I want to unravel in some detail the case that Socrates puts on Protagoras’ behalf where he draws on what Protagoras actually wrote (...) (151 E-152C); as opposed to what he may have taught secretly to his pupils (152C-160D). Thirdly I wish to argue that if we let the dialogue speak for itself, it is manifest that this case put up on Protagoras’ behalf at 151 E-152C is not overthrown; it is not even shaken. (shrink)

This book presents translations of three dialogues Xenophon devoted to the life and thought of his teacher, Socrates. Each is accompanied by notes and an interpretative essay that will introduce new readers to Xenophon and foster further reflection in those familiar with his writing. "Apology of Socrates to the Jury" shows how Socrates conducted himself when he was tried on the capital charge of not believing in the city's gods and corrupting the young. Although Socrates did not secure his own (...) acquittal, he profoundly impressed some listeners who then helped to shape the public perception of philosophy as a noble, if highly idiosyncratic, way of life. In "Oeconomicus," Xenophon relates the conversation Socrates had on the day he turned from the study of natural philosophy to that of moral and political matters. "Oeconomicus" is concerned most directly with the character and purpose of Socrates' political philosophy. Xenophon provides entertaining portraits of Socrates' circle of friends in the "Symposium." In the process, he conveys the source of every individual's pride in himself, thus defining for each a conception of human excellence or virtue. The dialogue concludes with Socrates' beautiful speech on love (eros) and its proper place in the good or happy life. (shrink)
