With populations aging worldwide, the need for appropriate and just public policy related to old age is critical. Elder law scholars can support the creation of such policy by advancing the theoretical understanding of the relationship between law and aging — understanding that can help policymakers identify and prioritize goals, and evaluate potential interventions. This Article aims to provide a framework for this work by distilling the core theoretical questions at the intersection of law and aging. It also (...) challenges common assumptions that could pose a barrier to developing a more robust theory of law and aging. Specifically, it argues that scholarship in this area will be most fruitful if it recognizes that the study and practice of “elder law” are intertwined but not a single unified field, that “preferential” treatment of older adults can be a form of discrimination, and that old age is not a universal human experience. Abductive reasoning involves finding the missing premise of an “unsaturated” deductive inference, thereby selecting a possible _explanans_ for a conclusion based on a set of previously accepted premises. In this paper, we explore abductive reasoning from a structural proof-theory perspective. We present a hybrid sequent calculus for classical propositional logic that uses sequents and antisequents to define a procedure for identifying the set of analytic hypotheses that a rational agent would be expected to select as _explanans_ when presented with an (...) abductive problem. Specifically, we show that this set may not include the deductively minimal hypothesis due to the presence of redundant information. We also establish that the set of all analytic hypotheses exhausts all possible solutions to the given problem. Finally, we propose a deductive criterion for differentiating between the best _explanans_ candidates and other hypotheses. (shrink)

Together with the volume “Inquiries in philosophical pragmatics: Theoretical developments,” this book collects selected contributions to the conference Pragmasophia II held in Lisbon in 2018. The eleven essays of this volume focus on how a linguistic structure or expression manifests a pragmatic phenomenon, and are ordered considering their relationship with the specificity of the context. The first three papers, devoted to the topics of prototype-based generalizations, scalar implicatures, and temporal ordering, propose new insights into pragmatic phenomena considering linguistic behavior (...) independent of the social activity in which it is placed. In the last papers, the analytical and empirical goal becomes predominant. Artificial intelligence (AI) is becoming part of the everyday. During this transition, people’s intention to use AI technologies is still unclear and emotions such as fear are influencing it. In this paper, we focus on autonomous cars to first verify empirically the extent to which people fear AI and then examine the impact that fear has on their intention to use AI-driven vehicles. Our research is based on a systematic survey and it reveals that while individuals are largely afraid of (...) cars that are driven by AI, they are nonetheless willing to adopt this technology as soon as possible. To explain this tension, we extend our analysis beyond just fear and show that people also believe that AI-driven cars will generate many individual, urban and global benefits. Subsequently, we employ our empirical findings as the foundations of a theoretical framework meant to illustrate the main factors that people ponder when they consider the use of AI tech. In addition to offering a comprehensive theoretical framework for the study of AI technology acceptance, this paper provides a nuanced understanding of the tension that exists between the fear and adoption of AI, capturing what exactly people fear and intend to do. This book showcases the history and theory of pragmatism and its alignment to the sensibilities of contemporary analytic philosophy. It does this not only by describing its mode of operation and explaining its legitimating rationale, but also by substantiating its claims by a series of instructive case studies. The unifying insight of this approach is that the natural criterion of merit within any goal-oriented enterprise—be its orientation practical or cognitive—pivots on its contribution to the effective and efficient realization of the (...) aims at issue. The aim of this volume is to describe and illustrate this broadened conception of pragmatism as a far-reaching and many-sided approach to philosophical inquiry. Theoretical considering apart, it offers a variety of case studies to illustrate the range and fertility of this approach. The zetetic turn in epistemology raises three questions about epistemic and zetetic norms. First, there is the relationship question: what is the relationship between epistemic and zetetic norms? Are some epistemic norms zetetic norms, or are epistemic and zetetic norms distinct? Second, there is the tension question: are traditional epistemic norms in tension with plausible zetetic norms? Third, there is the reaction question: how should theorists react to a tension between epistemic and zetetic norms? Drawing on an analogy to practical (...) philosophy, I develop a focal point view to resolve these motivating questions. On the focal point view, traditional epistemic norms and zetetic norms answer different types of normative questions. There is nevertheless a familiar type of evaluative tension between traditional epistemic norms and zetetic norms, but this tension is an unavoidable feature of the normative landscape and not a sign that traditional epistemic norms need revision. But if traditional epistemic norms are not zetetic norms, then in what sense is zetetic epistemology a project for epistemologists? I conclude by articulating a sense in which some nontraditional epistemic norms are zetetic norms, and in which zetetic epistemology is an important part of the study of theoretical rationality. This volume reflects the development and theoretical foundation of a new paradigm for critical thinking based on inquiry. The field of critical thinking, as manifested in the Informal Logic movement, developed primarily as a response to the inadequacies of formalism to represent actual argumentative practice and to provide useful argumentative skills to students. Because of this, the primary focus of the field has been on informal arguments rather than formal reasoning. Yet the formalist history of the field is (...) still evident in its emphasis, with respect to both theory and pedagogy, on the structure and evaluation of individual, de-contextualized arguments. It is our view that such a view of critical thinking is excessively narrow and limited, failing to provide an understanding of argumentation as largely a matter of comparative evaluation of a variety of contending positions and arguments with the goal of reaching a reasoned judgment on an issue. As a consequence, traditional critical thinking instruction is problematic in failing to provide the reasoning skills that students need in order to accomplish this goal. Instead, the goal of critical thinking instruction has been seen largely as a defensive one: of learning to not fall prey to invalid, inadequate, or fallacious arguments. (shrink)

The speech act of inquiry is generally treated as a default kind of asking questions. The widespread norm states that one inquires whether p only if one does not know that p. However, the fact that inquiring is just one kind of asking questions has received little to no attention. Just as in the declarative mood we can perform not only assertions, but various other speech acts, like guesses or predictions, so in the interrogative mood we can also make (...) various speech act types. I propose a speech-act-theoretic account of a distinct kind of question that I label exam questions. According to the proposed account, one performs an exam question p only if (i) one has access to the answer to p, and (ii) one does not officially know whether the hearer knows the answer to p. Exam questions satisfy all the necessary requirements of being a distinct kind of speech act. Additionally, my proposal contributes to the recent expansion of the normative approach to a variety of speech acts. (shrink)

It is the aim of INDICES to document recent explorations in the various fields of philosophical logic and formal linguistics and their applications in other disciplines. The main emphasis of this series is on self-contained monographs covering particular areas of recent research and surveys of methods, problems, and results in all fields of inquiry where recourse to logical analysis and logical methods has been fruitful. INDICES will contain monographs dealing with the central areas of philosophical logic (extensional and intensional (...) systems, indexical logics, non-classical logics, philosophy of logic, etc.) as well as studies in which these systems are applied to specific issues in philosophy, in the formal semantics of natural languages, the foundations of linguistic theory, in computational linguistics, and in theoretical computer science. Constructive type theory was first presented in 1970, by the Swedish logician Per Martin-Lof. It has become one of the main approaches used in the foundations of mathematics and computer science. But it has remained relatively unknown among linguists and philosophers, although it provides a considerable extension of the concepts and techniques of logic. The book first gives an introduction to type theory from the point of view of linguistics and the philosophy of language. Type theory is then applied in the areas of quantification, anaphora, temporal reference, and the structure of text and discourse. By virtue of the type-theoretical concepts of proof object and context, various phenomena of dependence and progression in language can be discussed in precise terms, and several well-known problems can be solved. Epistemology is more than the theory of knowledge. Its range of concern includes not only knowledge proper but also rational belief, probability, plausibility, evidentiation, and not least, erotetics, the business of raising and resolving questions. Aristotle indicated that human inquiry is grounded in wonder; when matters are so out of the ordinary we puzzle about the reason why and seek for an explanation. With increasing sophistication, the ordinary as well as the extraordinary excites the intellect, so that questions gain (...) an increasing prominence within epistemology. Inquiry Dynamics focuses on the phenomena and theory of rational inquiry, focusing on its concern for questions and their management. An introductory chapter lays the groundwork of the book's deliberations, followed by chapter 2, explaining the basic concepts involved in the abstract logic of questions and answers and sets out the generic fundamentals of the domain. Chapters 3 and 4 expound the theoretical principles that characterize the field of question epistemology in general, clarifying the fundamental themes and theses of the subject. Chapters 5 through 9 then explore the landscape of question epistemology within science. Rescher seeks to show that there are limits-restrictions of basic principle-to our ability to resolve scientific questions. The concluding chapter argues in particular that the grand goal of an ultimate theory, one resolving all explanatory questions, has to be approached with great caution. Throughout Rescher emphasizes that a question-oriented approach to the process of inquiry serves to highlight the inherent limitations of the cognitive project. Rescher's question-oriented treatment of epistemology proceeds in the tradition of Kant and stands in decided contrast to the dominant knowledge-oriented approach originating with Descartes. He demonstrates that a concern for the issue of plausible question resolution is a necessary component of the epistemological enterprise. Philosophical inquiry into pregnancy, childbirth, and mothering is a growing area of interest to academic philosophers. This volume brings together a diverse group of philosophers to speak about topics in this reemerging area of philosophical inquiry, taking up new themes, such as maternal aesthetics, and pursuing old ones in new ways, such as investigating stepmothering as it might inform and ground an ethics of care. The theoretical foci of the book include feminist, existential, ethical, aesthetic, phenomenological, social (...) and political theories. These perspectives are then employed to consider many dimensions of pregnancy, childbirth, and mothering, which are of central importance to human existence, but are only rarely discussed in philosophical cannons. I respond to H. M. Collins's claim (1985, 1990, 1993) that experimental inquiry cannot be objective because the only criterium experimentalists have for determining whether a technique is "working" is the production of "correct" (i.e., the expected) data. Collins claims that the "experimenters' regress," the name he gives to this data-technique circle, cannot be broken using the resources of experiment alone. I argue that the data-technique circle, can be broken even though any interpretation of the raw data produced by (...) techniques is theory-dependent. However, it is possible to break this circle by eliminating dependence on even those theoretical presuppositions that are shared by an entire scientific community through the use of multiple independently theory-dependent techniques to produce robust bodies of data. Moreover, I argue, that it is the production of robust bodies of data that convinces experimentalists of the objectivity of their data interpretations. (shrink)

Knowledge translation has been widely taken up as an innovative process to facilitate the uptake of research-derived knowledge into health care services. Drawing on a recent research project, we engage in a philosophic examination of how knowledge translation might serve as vehicle for the transfer of critically oriented knowledge regarding social justice, health inequities, and cultural safety into clinical practice. Through an explication of what might be considered disparate traditions, we identify compatibilities and discrepancies both within the critical tradition, and (...) between critical inquiry and knowledge translation. The ontological and epistemological origins of the knowledge to be translated carry implications for the synthesis and translation phases of knowledge translation. In our case, the studies we synthesized were informed by various critical perspectives and hence we needed to reconcile differences that exist within the critical tradition. A review of the history of critical inquiry served to articulate the nature of these differences while identifying common purposes around which to strategically coalesce. Other challenges arise when knowledge translation and critical inquiry are brought together. Critique is one of the hallmark methods of critical inquiry and, yet, the engagement required for knowledge translation between researchers and health care administrators, practitioners, and other stakeholders makes an antagonistic stance of critique problematic. While knowledge translation offers expanded views of evidence and the complex processes of knowledge exchange, we have been alerted to the continual pull toward epistemologies and methods reminiscent of the positivist paradigm by their instrumental views of knowledge and assumptions of objectivity and political neutrality. These types of tensions have been productive for us as a research team in prompting a critical reconceptualization of knowledge translation. (shrink)

Many schools of Indian philosophy stress the importance of knowledge on the path to liberation, but what kind of knowledge is meant? Is it the kind of knowledge that can be had through philosophical thinking, through a path of intellectual inquiry? In this presentation I will sketch the position of Niścaldās, a late Advaita Vedāntin whose magnum opus, The Ocean of Inquiry, though not well known today, was once referred to by Vivekananda as having “more influence in India (...) than any that has been written in any language within the last three centuries.” For Niścaldās, the central practice on the path to liberation is inquiry, an intellectual process of raising and removing doubts which, I argue, is closely related to the dialectical method employed throughout Indian philos­ophy. The practice of inquiry presupposes a high level of moral and spiritual qualifications, but once these qualifications are met, philosophical thinking itself becomes, for Niścaldās, a spiritual practice. This practice is the chief means for bridging the gap between purely theoretical awareness and a deeper, liberating knowledge. (shrink)

In an environment characterized by the emergence of new and diverse (and often opposed) philosophical efforts, there is a need for a conception of philosophy that will promote the exchange and critical consideration of divergent insights. Depending upon the operative conception, philosophical efforts can be viewed as significant, insightful and instructive, or unimportant, misguided and not real philosophy. This paper develops John Dewey's conception of philosophy as a mode of inquiry in contrast with Bertrand Russell's conception of philosophy as (...) a mode of analysis. I argue that while Russell's analytic conception of philosophy justifies the dismissal of non-analytic philosophies, Dewey's conception of philosophy provides a theoretical framework for the comparison, evaluation and interaction of alternatives. The conceptual and methodological contributions of Marxist aesthetics from Eastern European countries like Hungary, Yugoslavia, Poland, Czechoslovakia, Bulgaria, Romania, and East Germany were productive and significant despite various hurdles faced concerning institutionalization, legitimization and differing theoretical abuses. In its mode of inquiry and discursive practices, Eastern European Marxist aesthetics is both similar and dissimilar to its Western, Soviet, Russian and Chinese counterparts. The specificity here is the function of a unique geographical and socio-historical context, as well as interaction (...) with other contemporary paradigms of thought. The innovative impulses of Eastern European Marxist aesthetics affected six scholarly domains: aesthetics of praxis, theory of realism, critique of modernity, semiotics, theory of genre and cultural theory. This paper provides a general survey of the intellectual achievements of Eastern European Marxist aesthetics across these six domains and will show how this theoretical tradition has influenced the modern history of ideas. Young people around the world show considerable engagement with climate change. How can education draw on this engagement in order to benefit students and society? In this article, we discuss how inquiry-based dialogues can support students’ development in their societal engagement. We argue that such dialogues should include real-world problems involving disagreement, which promote students’ agency. We elaborate on qualities of dialogues, such as developing argumentation and perspectives together through respect, attentive listening and recognition of others’ viewpoints. Central (...) class='Hi'>theoretical perspectives include inquiry-based dialogues and students’ lived democracy. This research draws on data from a classroom activity where 15–16-year-old students in Norway investigate controversial issues related to electrifying offshore oil platforms. The students are in a learning situation, and the teacher wants them to learn about climate change and the oil industry and the skills and attitudes needed to participate in inquiry-based dialogues. The dialogues show that students bring knowledge, opinions and attitudes from outside school, characteristics that are crucial for students’ engagement. We discuss how teachers can facilitate students’ further engagement by addressing multiple aims of inquiry-based dialogues. (shrink)

Good Science is an account of psychological research emphasizing the moral foundations of inquiry. This volume brings together existing disciplinary critiques of scientism, objectivism, and instrumentalism, and then discusses how these contribute to institutionalized privilege and to less morally responsive research practices. Harman distinguishes between two uses of the term “logic”: as referring either to the theory of implication or to the theory of reasoning, which are quite distinct. His interest here is reasoning: a process that can modify intentions and beliefs. To a first approximation, theoretical reasoning is concerned with what to believe and practical reasoning is concerned with what to intend to do, although it is possible to have practical reasons to believe something. Practical considerations are relevant to whether (...) to engage in theoretical inquiry into a given question, the extent of time and other resources to devote to such inquiry, and whether and when to end such inquiry. Simplicity and conservatism play a role in theoretical reasoning that can be given a practical justification without allowing wishful thinking into theoretical reasoning, a justification that can also be given a non-practical interpretation. The notion of a community of inquiry has been treated by many of its proponents as being an exemplar of democracy in action. We argue that the assumptions underlying this view present some practical and theoretical difficulties, particularly in relation to distribution of power among the members of a community of inquiry. We identify two presuppositions in relation to distribution of power that require attention in developing an educational model that is committed to deliberative democracy: (1) openness (...) to inquiry and readiness to reason, and (2) mutual respect of students and teachers towards one another. Our contention is that these presuppositions, presented as preconditions necessary to the creation of a community of inquiry, are not without ideological commitments and dependent upon the ability of participants to share power. Using group dynamic theories and the ideas of Hannah Arendt, we argue that behaviours commonly interpreted as obstacles to dialogue or reflective inquiry could provide opportunities for growth. In this paper we examine theoretical utility arguments in metaphysics. While philosophers claim a procedural continuity with science when using such arguments, we argue that examining famous instances from the history of science expose their fundamental flaws. We find that arguments from theoretical utility invoke considerations that are not truth conducive and that justifications for claims that a theory possesses theoretical virtues often assume the truth of the theory such virtues are supposed to support. Instead of adopting the top-down view of the first volume, this collection of eleven chapters starts from the analysis (...) of linguistic data – which include texts and discourses in different languages, different types of dialogues, different types of interactions, and different modes for expressing meaning – looking for the regularities that govern our production and processing. The chapters are ordered according to their relationship with the themes and methods that define the field of pragmatics. Within the community of inquiry literature, the absence of the notion of genuine doubt is notable in spite of its pragmatic roots in the philosophy of Charles Sanders Peirce, for whom the notion was pivotal. We argue for the need to correct this oversight due to the educational significance of genuine doubt—a theoretical and experiential understanding of which can offer insight into the interrelated concepts of wonder, fallibilism, inquiry and prejudice. In order to detail these connections, we (...) reinvigorate the ideas of Peirce by borrowing the language and concepts of Albert Camus, at the same time demonstrating their unlikely congruence. In particular, we argue for the necessity of genuine doubt along with the need for the presence of a diversity of prejudices as a starting point for genuine inquiry. (shrink)

This dissertation explores and argues for the import of the imagination (Phantasie) in Edmund Husserl's phenomenological method of inquiry. It contends that Husserl's extensive analyses of the imagination influenced how he came to conceive the phenomenological method throughout the main stages of his philosophical career. The work clarifies Husserl's complex method of investigation by considering the role of the imagination in his main methodological apparatuses: the phenomenological, eidetic, and transcendental reductions, and eidetic variation - all of which remained ambiguous (...) despite his extensive programmatic discussions. The work illuminates and clarifies aspects of the Husserlian phenomenological method never before explored. -/- In order to clarify Husserl's eidetic method of inquiry, I propose a new way of thinking about the imagination - as direct intuitive presentation (eigentliche anschauliche Vorstellung) and as horizonal-nexic level of consciousness exhibiting the neutrality, freedom, and possibility as its essential features. Following Husserl's studies of the imagination, I propose a three-level model of consciousness (realizing, imagining, and eidetic) and explore the dynamic flexibility of each level (as horizon within which acts such as judgments or memories can unfold). This model of consciousness allows for a rethinking of the sources and conditions for the possibility of eidetic phenomenological inquiry - topics Husserl was mostly silent about. -/- Through a rethinking of the model of consciousness, I propose a tight and substantial relationship between the natural (everyday) and artificial (methodological, theoretical) attitudes. I argue that the structure and systems of possibilities pertaining to the artificial attitude - i.e., our actual as well as possible methodological tools - are structurally and well as informationally bound to the structure and system of possibilities pertaining to the natural attitude. In order to explore the nature of the relationship between these two attitudes I argue that we must take a closer look at the structure and abilities of imagining consciousness - the sole nexic-horizonal level that can function both naturally and artificially. This insight regarding the nature of consciousness clarifies Husserl's transcendental idealism in its intimate connection to the everyday. Understanding Husserl's philosophical stance is thus purged of all possibility of mistakenly labeling it as entailing immanent detachment, solipsism, or Platonic idealism. (shrink)

This paper inspires new questions, possibilities, and challenges for the scientific study of spirituality, and other experiential phenomena. First, the authors offer a refreshing conceptualization of spirituality, one that is similar to that proposed for, and supported by recent neuroscientific study of, religious experience. To what extent are spirituality and religious experience similar at the neural descriptive level? How might they be different? Second, the authors draw creatively upon Weak Quantum Theory to suggest a potentially useful and powerful theoretical (...) model—generalized entanglement—to account for/describe spirituality, parapsychology, and possibly other experiential phenomena. This framework has potential not only to legitimize the study of such phenomena within 'mainstream science' , but also guide new scientific inquiry on spirituality and other experiential phenomena. To what extent, though, must 'scientific' paradigms and assumptions be re-imagined to pursue such studies? Ultimately, this paper raises challenging questions regarding the identity of 'science' today, the answers to which are needed to forward meaningful inquiry of spirituality . What is the 'job' of 'science' today ? Do all 'sciences' hold the same set of assumptions/have the same interpretive limits? To what extent is 'mainstream science' monolithic? (shrink)

This is the first of two papers addressing Browning’s “Designation, Characterization, and Theory in Dewey’s Logic” (2002) where he distinguishes a series of pre-theoretical and theoretical stages for developing a theory of logic. The second of these two papers will recommend a modified version of this scheme of stages of inquiry into inquiry. The present paper recounts Browning’s original version of these stages and the ramifications of not clearly distinguishing them. I respond to Browning’s claim that (...) in Burke 1994 I made two such mistakes of not properly distinguishing theoretical and pre-theoretical stages of inquiry into inquiry. (shrink)

Epistemic nihilism for inquiry is the claim that there are no epistemic norms of inquiry. Epistemic nihilism was once the received stance towards inquiry, and I argue that it should be taken seriously again. My argument is that the same considerations which led us away from epistemic nihilism in the case of belief not only cannot refute epistemic nihilism for inquiry, but in fact may well support it. These include the argument from non-existence that there are (...) no non-epistemic reasons for belief; the linguistic argument that epistemic norms of belief are needed to capture the semantics of ordinary epistemic talk; and the argument from theoretical roles that epistemic norms are needed to play key theoretical roles for rational belief. I conclude by sketching an alternative Gibbardian picture on which norms of inquiry are all-things-considered norms governing action. (shrink)

In this paper I examine the epistemic function of agent-based models of scientific inquiry, proposed in the recent philosophical literature. In view of Boero and Squazzoni’s classification of ABMs into case-based models, typifications and theoretical abstractions, I argue that proposed ABMs of scientific inquiry largely belong to the last category. While this means that their function is primarily exploratory, I suggest that they are epistemically valuable not only as a temporary stage in the development of ABMs of (...) science, but by providing insights into theoretical aspects of scientific rationality. I illustrate my point with two examples of highly idealized ABMs of science, which perform two exploratory functions: Zollman’s ABM which provides a proof-of-possibility in the realm of theoretical discussions on scientific rationality, and an argumentation-based ABM, which provides insights into potential mechanisms underlying the efficiency of scientific inquiry. Written over the course of the 1980s and 1990s, these essays trace the literary turn in educational research toward forms of literary journalism, critical storytelling, and postmodern narrative. The articles are presented as biographical evidence of the author's ongoing quest for forms of educational research that are well-suited to the enormously complex nature of educational encounters. There is a long standing controversy in education as to whether education ought to be teacher- or student- centered. Interestingly, this controversy parallels the parent- vs. child-centered theoretical swings with regard to good parenting. One obvious difference between the two poles is the mode of communication. “Authoritarian” teaching and parenting strategies focus on the need of those who have much to learn to “do as they are told,” i.e. the authority talks, the child listens. “Non-authoritarian” strategies are anchored in (...) the assumption that youngsters ought to be encouraged to develop their natural interests and talents and hence that it is important to allow the children to do the talking and that adults listen. Both strategies seemed flawed due to the absence of the inherent wisdom of its opposing view. This chasm can be overcome. The Community of Inquiry, a pedagogical method used in Philosophy for Children, demands a method of communication which is able to bridge this gap. A Community of Inquiry is neither teacher-centered and controlled nor student-centered and controlled, but centered on and controlled by the demands of truth. Truth is absolutely essential to this method; it is only because of progress toward truth that participants are ultimately convinced of the fruitfulness of the process. Truth, however, is a hard taskmaster; it places severe restrictions on participants and puts exacting demands on the facilitator. These inherent restrictions and demands are too often underplayed, overlooked and sometimes seemingly overtly denied by those who, quite correctly emphasize that ultimately this method depends on maintenance and enhancement of student autonomy. This underrating of the role of the facilitator has led to a severe undervaluing of this otherwise brilliant pedagogical method, but worse, it has left novice teacher/facilitators ill prepared to utilize this method successfully.
