Building on critical approaches that understand algorithms in terms of communication, culture and organization, this paper offers the supplementary conceptualization of algorithms as organizational figuration, defined as material and meaningful sociotechnical arrangements that develop in spatiotemporal processes and are shaped by multiple enactments of affordance–agency relations. We develop this conceptualization through a case study of a Danish fintech start-up that uses machine learning to create opportunities for sustainable pensions investments. By way of ethnographic and literary methodology, we provide an in-depth (...) analysis of the dynamic trajectory in and through which the organization gives shape to and takes shape from its key algorithmic tool, mapping the shifting sociotechnical arrangements of the start-up, from its initial search for a viable business model through the development of the algorithm to the public launch of its product. On this basis, we argue that conceptualizing algorithms as organizational figuration enables us to detail not only what algorithms do but also what they are. (shrink)

The purpose of this paper is to present some of the findings (which were reported on more extensively in earlier work) regarding the visibility of gender issues in the literature on selected information and communication technologies (ICTs) with a view to make predictions about potential ethical issues that the application of these ICTs may bring about in the future. On the basis of the analysis of around 100 published sources, which dealt with various aspects of selected ICTs, conclusions have been (...) drawn regarding gender issues and concerns that the applications of these ICTs may cause. The authors' analysis is theoretically informed by critical discourse analysis (CDA) which assumes that texts, both written and spoken, as well as other forms of symbolic representations, are indicative of social practices. Of particular methodological relevance was the survey of methods of text and discourse analysis presented in Titscher et al and especially the application of keyword search as a way to measure the prominence of each investigated method. This approach to literature surveying proved very useful in selecting analytic material: only those published sources on the selected four ICTs have been included in the survey, for which the analysis of keywords, abstracts and indexes of terms indicated authors' interest in gender issues. Findings - First, ICTs such as affective computing, ambient intelligence, and artificial intelligence, have been found to have the potential of positively affecting gender power relations and thus positively affecting gender balance in the areas of labour market related to ICT across EU countries and worldwide. Second, more research on the relationship between gender and ICT design, application and representation is needed, so as to enhance a better understanding of ethical issues resulting from unequal participation of women and men in all aspects of ICT production and implementation, which in itself is an ethical dilemma with which both the ICT business and legislators have to grapple. The paper offers insight into the relationship between the level of attention devoted to particular ICTs by ICT researchers, as evidenced in the reviewed literature, and the likelihood of the application of a particular ICT in the future, which is looked at and assessed from a gender perspective. By studying several cases of expert systems' use, a variety of difficulties were identified as directly depending on specific characteristics of experts and their tasks. This concerns more than the questions: “May experts be replaced by machines?” or “Is experts' knowledge explicable?”. The organisational structure of their work as well as the cyclic, non-plannable way of their task performing have further relevance. The paper introduces the concept of experts' systems to deal with diversities of their expertise and complexities of their (...) work. It draws a distinction between non-monotonic problem solving, exploration, medium and modification, and argues that these modes are not reducible to yet another improved input/output strategy or dialogue style but introduce additional functions supporting the human-computer interaction according to experts' needs. Islamic law employs a classification of acts that divides each into one of five categories, ranging from forbidden to obligatory. When the phonograph became a popular instrument at the end of the nineteenth century, the use of this new machine, which reproduced both the Quran being recited and the song of an unknown woman, had to be categorized. The present article presents the edition for the first time, with translation and analysis, of a fatwa on the permissibility of the phonograph, (...) issued in 1908 by the Meccan scholar ʿAbdallāh Muḥammad Ṣāliḥ al-Zawāwī. Fatwas on phonography by the Indonesian scholar Sayyid ʿUthmān and the later shaykh al-Azhar Muḥammad Bakhīt al-Muṭīʿī are also analyzed. Two European scholars who recorded Quranic phonography are paid attention as well: Christiaan Snouck Hurgronje and Gotthelf Bergsträsser. Their involvement with Quranic sound recording is placed within its historical context. Finally, a short impression is given of what survives of these early recordings. (shrink)

The twelve essays in this collection address questions about justice and social institutions designed to secure it. Some explore the relationship between justice and equality, asking whether societies should strive to eliminate inequalities in their citizens' levels of opportunity or welfare. Some consider whether societies are obligated to provide their less fortunate citizens with some minimum level of subsistence, or whether the provision of such relief is best left to private charitable organisations. Some essays look at the relationship between justice (...) and other values, such as mutual consent, the protection of property rights, or the elimination of exploitation. Others deal with the rules governing specific practices, such as the distribution of health care, the pursuit of academic inquiry and research, or the assignment of punishments. Political theorists study the attributes of desirable social-moral states of affairs. Schaefer (forthcoming) aims to show that "static political theory" of this kind rests on shaky foundations. His argument revolves around an application of an abstruse mathematical theorem -- Kakutani's fixed point theorem -- to the social-moral domain. We show that Schaefer has misunderstood the implications of this theorem for political theory. Theorists who wish to study the attributes of social-moral states of affairs should carry on, safe in the knowledge (...) that Kakutani's theorem poses no threat to this enterprise. (shrink)

I distinguish between three different ideas that have been recently discussed under the heading of 'the intrinsic goods of childhood': that childhood is itself intrinsically valuable, that certain goods are valuable only for children, and that children are being owed other goods than adults. I then briefly defend the claim the childhood is intrinsically good. Most of the chapter is dedicated to the analysis, and rejection, of the claim that certain goods are valuable only for children. It seems to be almost a given of contemporary Anglo-American political philosophy that the just society is obligated to establish and ensure the equality of its members. Debate begins when we come to delineate the forms and limits of the equality society is obligated to underwrite. In this essay I offer the subversive suggestion that equality is not something the just society should aim for. Instead I offer another objective, one which is to be preferred (...) both because it is more attainable and because it is morally more defensible than equality, either as an ideal or as an operative principle. The demand for equality of treatment, of opportunity, or of outcome, is a distraction from morally more significant aims. (shrink)

In this volume Geoffrey Galt Harpham argues for a deeply original view of the relations among ethics, literary study, and critical theory. In thirteen lucid, provocative and often witty essays, Harpham rejects both the optimism of those who see ethics as a way of solving problems about values or principles and the pessimism of those who regard ethics as primarily a cover story for politics. What sort of entitlements should citizens have in a just society? In this book, Rutger Claassen sets out a theory of what he terms 'navigational agency', whereby citizens should be able to navigate freely between social practices. This shows how individuals can be at the same time free and autonomous in striving for their own goals in life, but also embedded in social practices in which they have to cooperate with others. He argues that for navigational agency, people (...) need three sets of core capabilities: those which allow human empowerment in civil society, a decent level of socio-economic subsistence, and political participation in democratic decision-making procedures. In the practice of education and educational reforms today ‘meritocracy’ is a prevalent mode of thinking and discourse. Behind political and economic debates over the just distribution of education benefits, other kinds of philosophical issues, concerning the question of democracy, await to be addressed. As a means of evoking a language more subtle than what is offered by political and economic solutions, I shall discuss Ralph Waldo Emerson's idea of perfectionism, particularly his ideas of the ‘gleam of light’ and (...) ‘genius’, as an alternative mode of thinking of human power. Through this Emersonian lens, a provocative shift will be made from meritocracy and ‘mediocracy’ to aristocracy. Emersonian aristocracy destabilizes balanced measures and prevailing discourse about fairness and justice, and makes us reconsider how to achieve a just society in democracy. As an educational implication, I shall propose the idea of citizenship without inclusion—a vision of education for a democratic society in which we learn to live as and with the Great Man. (shrink)

I examine the foundations of a just society using the lens of decision theory. The conception of just society is from an individual’s viewpoint: where would I rather live if I have an equal chance of being any individual? Three alternative designs for a just society are examined. These are: laissez-faire, maximin and social minimum. Two assumptions about human nature clarify the distinction among three societies. The first assumption is that a representative individual’s utility (...) function is concave. The second assumption recognizes that redistribution to achieve equality reduces total wealth. A rational individual would prefer a society where one is free to maximize one’s expected utility. A social minimum that includes both the provision of essential human needs and equality of opportunity (education, healthcare, access to capital) for a flourishing life emerges as a candidate solution for the basic structure of society. This article critically analyzes Rawls’s attitude toward envy. In A Theory of Justice, Rawls is predominantly concerned with the threat that class envy poses to political stability. Yet he also briefly discusses the kind of envy that individuals experience toward their social peers, which he calls particular envy, and which I refer to as peer envy. He quickly concludes, however, that particular envy would not present a serious risk to the stability of his just society. In this article, (...) I contest this claim by arguing that the principles that structure Rawls’s ideal society are likely to exacerbate particular envy to a politically risky extent. Section 1 reconstructs his account of envy, giving special attention to his belief that competition kindles envy between peers. Section 2 then examines the way in which Rawls often endorses rivalry within the body politic. I argue that the society governed by justice as fairness is, on account of this rivalry, likely to generate a politically problematic degree of particular envy. In Section 3, I invoke ancient Greece as an example of a society that was, as a result of its intense competitiveness, often imperiled by dangerously elevated levels of peer envy. I then survey the key institutional mechanisms by which the ancient Greeks sought to manage this hazardous emotion. It turns out, however, that most of these mechanisms would be unavailable to Rawls insofar as they starkly contravene his principles of justice. I conclude that if Rawlsians wish to establish a society that fosters rivalry, they would do well to reflect on the means by which peer envy can be effectively harnessed. (shrink)

The notion that business organizations are akin to Aristotelian political communities has been a central feature of research into virtue ethics in business. In this article, I begin by outlining this “community thesis” and go on to argue that psychological research into the “just world fallacy” presents it with a significant challenge. The just world fallacy undermines our ability to implement an Aristotelian conception of justice, to each as he or she is due, and imperils the relational equality (...) required for shared participation in communities. In the final section, I offer a description of what Aristotelian community might look like within organizations, and some suggestions about how it may be possible to resist the challenge posed by the just world fallacy. "Crooked people deceive themselves in order to deceive others; in this way the world comes to ruin." This quote from a medieval Confucianist expresses the ethical danger of self-deception. My paper examines the psychological proclivity for self-deception and argues that it lies behind much social and interpersonal injustice. I review Hitler's Mein Kampf, as a premiere example of such cognitive duplicity, and Socratic dialectic, as an example of the cognitive hygiene necessary to combat it. Our competitive, service-oriented societies are taking a toll on the late-modern individual. Rather than improving life, multitasking, "user-friendly" technology, and the culture of convenience are producing disorders that range from depression to attention deficit disorder to borderline personality disorder. Byung-Chul Han interprets the spreading malaise as an inability to manage negative experiences in an age characterized by excessive positivity and the universal availability of people and goods. Stress and exhaustion are not just personal experiences, but social and historical phenomena (...) as well. Denouncing a world in which every against-the-grain response can lead to further disempowerment, he draws on literature, philosophy, and the social and natural sciences to explore the stakes of sacrificing intermittent intellectual reflection for constant neural connection. Many people have been enraged lately by the enormous increases in certain generic prescription drugs. But free marketeers defend these prices by arguing that they simply represent what the market will bear, and in a capitalist society there is accordingly nothing wrong with charging them. This paper argues that such a defense is actually contrary to the very principles that free marketeers claim to embrace. These prices are not only unjust and exploitative, but government interference with them would not (...) render the market less free, at least if what it means for a market to be “free” is properly understood. Everyone, even free marketeers with a libertarian or neoliberal bent, should accordingly be against this kind of profiteering. (shrink)

There is a solid empirical evidence for moral mediocrity: people aim to be about as morally good, and as morally bad, as those around them. This can be good if most people are saints, and very bad if most people are moral monsters. And here we derive an important insight: we can have a just society without just citizens--that is, citizens who act just only from peer pressure, and not from moral reason--provided most people in that (...) society, for whatever reason, happen to act justly. This article develops contractarian business ethics by applying social contract arguments to a specific question: What are the pre-legal (or moral) rights and responsibilities of corporations? The argument uses a hypothetical social contract to show the existence of for-profit corporations in democratic capitalist societies is consistent with Rawls’s fundamental principles of justice. Corporations ought to have recognised their rights to be autonomous, to pursue private purposes, and to engage in economic activities. Corporations have a responsibility to respect the freedom and (...) human rights of all people, and not to interfere with government programs that ensure people have the education and training they need to find and keep corporate employment and that provide a safety-net that prevents destitution. If corporations have any other rights and responsibilities, those rights and responsibilities need to be established by actual social contracts, probably in the form of legitimate democratic processes.
