Sovereignty and the sovereign state are often seen as anachronisms; Globalization and Sovereignty challenges this view. Jean L. Cohen analyzes the new sovereignty regime emergent since the 1990s evidenced by the discourses and practice of human rights, humanitarian intervention, transformative occupation, and the UN targeted sanctions regime that blacklists alleged terrorists. Presenting a systematic theory of sovereignty and its transformation in international law and politics, Cohen argues for the continued importance of sovereign equality. She offers a theory of a (...) dualistic world order comprised of an international society of states, and a global political community in which human rights and global governance institutions affect the law, policies, and political culture of sovereign states. She advocates the constitutionalization of these institutions, within the framework of constitutional pluralism. This article defends the principle of non-establishment against 21st-century projects of political religion, constitutional theocracy and political theology. It is divided into two parts, which will appear in two consecutive issues of Philosophy & Social Criticism, 39(4–5) and 39(6). Part 1 proceeds by constructing an ideal type of political secularism, and then discussing the innovative American model of constitutional dualism regarding religion that combined constitutional protection for the freedom of religious conscience and exercise with the principle of non-establishment. The article (...) analyses the strengths and limits of the ‘separation– accommodation’ frame that became hegemonic in 1st amendment jurisprudence from the 1940s to the 1990s. It challenges the standard caricature of the American model as strictly separationist and privatizing. It then critically assesses two contemporary alternatives to that frame: the integrationist approach and the equal liberty approach. The first, disguised as a concern for pluralism and fairness, challenges ‘separation’ and political secularism in a subtle attack on the non-establishment principle, aimed at drastically narrowing its scope. Successes of this approach in recent Supreme Court jurisprudence and politics have triggered a response by liberal egalitarians. The author addresses this response – the equal liberty model – in part 2, which will appear in Philosophy & Social Criticism 39(6), arguing that although on the right track, it fails to find a middle ground between political secularism and integration. The article proposes a third approach, one that does not throw out the non-establishment baby with the strict separationist bathwater and that wholeheartedly endorses political secularism, a sine qua non for 21st-century constitutional democracy. Equal liberty properly construed can help provide criteria for determining when an accommodation, a regulation or no regulation of religion by the state is appropriate. But it must be supplemented by other values – democratic and civil republican. The article concludes with a typology of the forms of regulation that are warranted under the conditions of the contemporary regulatory state, now the target and prize of politicized religion. After reviewing the literature on current knowledge about consciousness in humans, we present a state-of-the art discussion on consciousness and related key concepts in animals. Obviously much fewer publications are available on non-human species than on humans, most of them relating to laboratory or wild animal species, and only few to livestock species. Human consciousness is by definition subjective and private. Animal consciousness is usually assessed through behavioural performance. Behaviour involves a wide array of cognitive processes that have to be (...) assessed separately using specific experimental protocols. Accordingly, several processes indicative of the presence of consciousness are discussed: perception and cognition, awareness of the bodily-self, self-related knowledge of the environment (including social environment). When available, specific examples are given in livestock species. Next, we review the existing evidence regarding neuronal correlates of consciousness, and emphasize the difficulty of linking aspects of consciousness to specific neural structures across the phyla because high-level cognitive abilities may have evolved independently along evolution. Several mammalian brain structures (cortex and midbrain) are involved in the manifestations of consciousness, while the equivalent functional structures for birds and fishes would likely be the pallium/tectum and midbrain. Caution is required before excluding consciousness in species not having the same brain structures as the mammalian ones as different neural architectures may mediate comparable processes. Finally, specific neurophysiological mechanisms appear to be strongly linked to the emergence of consciousness, namely neural synchrony and neural feedback. Considering the limited amount of data available and the few animal species studied so far, we conclude that different manifestations of consciousness can be observed in animals but that further refinement is still needed to characterize their level and content in each species. Further research is required to clarify these issues, especially in livestock species. (shrink)

En raison du dévoilement de la vérité que ce processus met en œuvre, le patient voit se dégager devant lui la perspective d'un désir dont la nouvelle mesure est infinie. Ce (...) désir avait été comblé par des objets qui, jusque-là, semblaient le satisfaire. Puis, le symptôme surgit, déstabilise, perturbe les petits arrangements que le patient s'était autorisés. Première ou dernière scène de son tragique? Dans le huis clos théâtral qu'est la séance analytique, le patient-acteur reprend et parle toute son histoire. Comme à son insu, il se voit contraint de redéfinir ce qui donne sens à sa vie : sens religieux? sens éthique? Bref, tout ce qui échappe à l'analyse et que, paradoxe imprévisible, elle évoque et convoque... Pourtant, un point restera toujours aveugle pour lui, à l'instar d'Œdipe qui, les yeux crevés, poursuit son chemin. C'est peut-être en ce même point - tragique-aveugle - que l'homme reconnaît sous une lumière nouvelle que son histoire personnelle rejoint la détresse commune et ordinaire de toute l'humanité. Following the September 2001 terrorist attacks on the United States, much support for torture interrogation of terrorists has emerged in the public forum, largely based on the “ticking bomb” scenario. Although deontological and virtue ethics provide incisive arguments against torture, they do not speak directly to scientists and government officials responsible for national security in a utilitarian framework. Drawing from criminology, organizational theory, social psychology, the historical record, and my interviews with military professionals, I assess the potential of an official (...) U.S. program of torture interrogation from a practical perspective. The central element of program design is a sound causal model relating input to output. I explore three principal models of how torture interrogation leads to truth: the animal instinct model, the cognitive failure model, and the data processing model. These models show why torture interrogation fails overall as a counterterrorist tactic. They also expose the processes that lead from a precision torture interrogation program to breakdowns in key institutions—health care, biomedical research, police, judiciary, and military. The breakdowns evolve from institutional dynamics that are independent of the original moral rationale. The counterargument, of course, is that in a society destroyed by terrorism there will be nothing to repair. That is why the actual causal mechanism of torture interrogation in curtailing terrorism must be elucidated by utilitarians rather than presumed. (shrink)

We argue that thought insertion primarily involves a disruption of the sense of ownership for thoughts and that the lack of a sense of agency is but a consequence of this disruption. We defend the hypothesis that this disruption of the sense of ownership stems from a fail- ure in the online integration of the contextual information related to a thought, in partic- ular contextual information concerning the different causal factors that may be implicated in their production. Loss of unity (...) of consciousness, manifested by incoherent subjective experiences is a general phenomenal characteristic of schizophrenia. This loss of coherence has been hypothesized to reflect a generalized deficit of contextual information integration not conveyed by, but related to, a target event. This deficit is manifested across many cog- nitive domains. We argue that it is also manifested in the process of thinking itself, result- ing in causally decontextualized thoughts that are experienced as inserted thoughts. (shrink)

We typically associate sovereignty with the modern state and presuppose the coincidence of political rule, public power, government, legitimacy and jurisdiction with territorially delimited states. We are also used to referencing liberal principles of justice, egalitarian ideals of fairness, republican conceptions of non-domination and separation of powers, and democratic ideas of popular sovereignty, for the standards that should constitute, guide, limit and legitimate the exercise of sovereign power. This Article addresses an important challenge to these principles: the reemergence of theories (...) and claims to jurisdictional/political pluralism on behalf of non-state “nomos groups” within well-established liberal-democratic polities. Theories of jurisdictional political pluralism purport to account for the independent sovereign authority of the corporate religious, while providing a “postmodern,” “permeable,” “pluralist” conception of sovereignty allegedly more appropriate descriptively to twenty-first century reality and more attractive normatively, than the modern statist version. This Article analyzes and assesses these claims. It criticizes the disassociation of the sovereignty concept from publicly accountable power, challenges the displacement of rights-holders from individuals to corporate groups, and offers a different, federal alternative to anachronistic or normatively flawed modern monistic statist conceptions. My purpose is to preserve the key achievements of democratic constitutionalism and to apply them to every level on which government, power, rule, and/or domination is exercised. (shrink)

Published one year after Forget Foucault, In the Shadow of the Silent Majorities may be the most important sociopolitical manifesto of the twentieth century: it calls for nothing less than the end of both sociology and politics. Disenfranchised revolutionaries hoped to reach the masses directly through spectacular actions, but their message merely played into the hands of the media and the state. In a media society (...) meaning has no meaning anymore; communication merely communicates itself. Jean Baudrillard uses this last outburst of ideological terrorism in Europe to showcase the end of the "Social." Once invoked by Marx as the motor of history, the masses no longer have sociological reality. In the electronic media society, all the masses can do—and all they will do—is enjoy the spectacle. In the Shadow of the Silent Majorities takes to its ultimate conclusion the "end of ideologies" experienced in Europe after the Soviet invasion of Hungary and the death of revolutionary illusions after May 1968. Ideological terrorism doesn't represent anything anymore, writes Baudrillard, not even itself. It is just the last hysterical reaction to discredited political illusions. (shrink)

This article argues that it is possible to bring the social sciences into evolutionary focus without being committed to a thesis the author calls ontological reductionism, which is a widespread predilection for lower-level explanations. After showing why we should reject ontological reductionism, the author argues that there is a way to construe cultural evolution that does justice to the autonomy of social science explanations. This paves the way for a liberal approach to explanation the author calls explanatory pluralism, which (...) allows for the possibility of explaining cultural phenomena in terms of different evolutionary processes. This article argues that understanding the dangers and risks of authoritarian populism in consolidated constitutional democracies requires analysis of the forms of pluralism and status anxieties that emerge in civil and economic society, in a context of profound political, socioeconomic, and cultural change. This paper has two basic theses. The first is that when societies become deeply divided, and segmental pluralism maps onto affective party political polarization, generalized social solidarity is imperiled, as is commitment to democratic norms, social (...) justice, and liberal democratic constitutionalism. The second, is that populist political entrepreneurs excel in fomenting social antagonisms by framing shifts in the forms of social pluralism in ways that foster deep political polarization, generalized distrust and a politics of resentment against “elites,” “the establishment,” “the oligarchy,” and “outsiders.” Why populist offers resonate requires a social theoretical analysis of status/solidarity and class issues and a direct response to them. I draw on Polanyi and Habermas to develop an explanatory approach to the current crisis and the populist responses it triggers. I navigate between two inadequate approaches: that of the Hofstadter consensus school which construes status concerns and populism as retrograde, anti-modern, paranoid and meriting no direct response; and that of the neo-Marxist tradition that acknowledges the mobilizing power of “cultural factors” and status anxieties but deems them to be epiphenomena of the deeper story of economic distributive injustice. I reject this assessment and seek to take up the status/solidarity issues in ways that take them seriously, challenge populist framing and provide alternative direct responses to them. I reject the narrative frames of left populists who foment polarization and I try to present an alternative narrative framing for a future democratic politics that draws on the best in politically liberal, constitutionalist, democratic, and socialist traditions. A principal goal of this book is to develop and apply the Situation Semantics framework. Jean Mark Gawron and Stanley Peters adopt a version of the theory in which meanings are built up via syntactically driven semantic composition rules. They provide a substantial treatment of English incorporating treatments of pronomial anaphora, quantification, donkey anaphora, and tense. The book focuses on the semantics of pronomial anaphora and quantification. The authors argue that the ambiguities of sentences with pronouns cannot be adequately (...) accounted for with a theory that represents anaphoric relations only syntactically; their relational framework uniformly deals with anaphoric relations as relations between utterances in context. They argue that there is no need for a syntactic representation of anaphoric relations, or for a theory that accounts for anaphoric ambiguities by resorting to two or more kinds of anaphora. Quantifier scope ambiguities are handled analogously to anaphoric ambiguities. This treatment integrates the Cooper Store mechanism with a theory of meaning that provides both a natural setting for it and a convincing account of what, semantically, is going on. Our encounters with the physical world are filled with miraculous puzzles-wind appears from somewhere, heavy objects float on oceans, yet smaller objects go to the bottom of our water-filled buckets. As adults, instead of confronting a whole world, we are reduced to driving from one parking garage to another. The Child's Conception of Physical Causality, part of the very beginning of the ground-breaking work of the Swiss naturalist Jean Piaget, is filled with creative experimental ideas for probing the most (...) sophisticated ways of thinking in children. This article focuses on the relationship between emotions and passions, on the one hand, and values, needs and rights, on the other. This relationship is indeed central to the social dimension of international politics. In this perspective, the article examines how emotions and passions can be at the same time effects and causes of the extent to which actors feel that their needs and rights are fulfilled or not. In the process, the article also explores the negative and positive features (...) of emotions and passions, and their impact on the nature and dynamics of change in international affairs. Beyond this general approach to emotions and passions in connection with the social dimension of international politics and the questions of values, needs, and rights of actors and change, it concludes with the idea that there is also a contextual dimension to the generic argument developed in the article. Jean-Pierre Dupuy, prophet of what he calls "enlightened doomsaying," has long warned that modern society is on a path to self-destruction. Empathy is thought to play a key role in motivating prosocial behavior, guiding our preferences and behavioral responses, and providing the affective and motivational base for moral development. While these abilities have traditionally been examined using behavioral methods, recent work in evolutionary biology, developmental and cognitive neuroscience has begun to shed light on the neural circuitry that instantiate them. The purpose of this article is to critically examine the current knowledge in the field of affective neuroscience and provide an integrative (...) and comprehensive view of the computational mechanisms that underlie empathy. This study investigates how lack of perceived organizational integrity by managers negatively affects bottom-up improvement-oriented behaviors at lower hierarchical levels. It is expected that expressions of tyrannical leadership by the manager, a self-serving type of leadership, will mediate the relation between POI and job improvement behaviors. Further, this study investigates the role of mimicry of manager behaviors and of other supervisor’s responses to understand how manager tyrannical leadership effect is carried through to the lowest level. Our initial postulate is that (...) non-mimicry provides complex social cues for employees. Following social information processing theory, we expect that incoherent cues increase the salience and negative effects of managers’ tyrannical leadership on job improvement. A three-level study was conducted following a questionnaire survey in a large public safety organization. Participants included 34 managers, 129 supervisors, and 620 employees. Results of multilevel analyses revealed that lack of perceived integrity and tyrannical leadership at the managerial level have far-reaching effects on job improvement at the lowest level. Further, it indicates that the supervisors’ responses at the intermediate level are important mechanisms to understand how the negative effects from the managerial level are transmitted to the employee level. To remain financially viable and continue to accomplish their social missions, nonprofits are increasingly adopting a hybrid organizational form that combines commercial and social welfare logics. While studies recognize that individual organizations vary in how they incorporate and manage hybridity, variation at the level of the organizational form remains poorly understood. Existing studies tend to treat forms as either hybrid or not, limiting our understanding of the different ways a hybrid form may combine multiple logics and how such combinations evolve (...) over time. Analyzing 14 years of data from Canadian nonprofits seeking funding for social enterprise activities, we identify two novel dimensions along which a hybrid form may vary—the locus of integration and the scope of logics. We further find that as the commercial logic became more widespread within the nonprofit sector, variants of the hybrid form shifted from primarily emphasizing the commercial logic to more equally emphasizing both the commercial and social welfare logics and integrating the two logics in multiple ways. Drawing on these findings, we contribute a multi-dimensional conception of hybrid forms and theorize how form-level variation in hybridity can arise from organization-level cognitive challenges that actors face when combining seemingly incompatible logics. We then build on this theorizing to offer an alternative perspective on commercialization of the nonprofit sector as a contextually dependent rather than universal trend. (shrink)

This article is a review of the literature on the subject of how nurses who provide palliative care are affected by ethical issues. Few publications focus directly on the moral experience of palliative care nurses, so the review was expanded to include the moral problems experienced by nurses in the care of the terminally ill patients. The concepts are first defined, and then the moral attitudes of nurses, the threats to their moral integrity, the moral problems that are perceived by (...) nurses, and the emotional consequences of these moral problems are considered in turn. The results show that the moral behaviour of nurses, which is theoretically grounded in commitment to care and to the patient, appears to be shaped by specific processes that lead to engagement or to mental and behavioural disengagement in morally difficult situations. Nurses often appear to fail to recognize the moral dimensions of the problems they experience and also to lack the skills they need to resolve moral problems adequately. Although the findings show that several elements that are beyond the control of nurses, owing to their lack of autonomy and authority, influence their moral experience, intrinsic factors such as feelings of insecurity and powerlessness have a profound effect on nurses’ perceptions and attitudes in the face of moral problems. The moral problems perceived by these nurses are related to end-of-life issues, communication with patients, the suffering of patients, and the appropriateness of the medical treatment. (shrink)

Recently, the ethical rather than just the economic resonance of entrepreneurship has attracted attention with researchers highlighting entrepreneurship and ethics as interwoven processes of value creation and management. Recognising that traditional normative perspectives on ethics are limited in application in entrepreneurial contexts, this stream of research has theorised entrepreneurship and ethics as the pragmatic production of useful effects through the alignment of public—private values. In this article, we critique this view and use Kant's concept of reflective judgement as discussed in (...) his Critique of the Power of Judgement to theorise ethical entrepreneurial practice as the capacity to routinely break free from current conventions through the imaginative creation and use of self-legislating maxims. Through an analysis of the narratives of 12 entrepreneurs, we suggest there are three dimensions to reflective judgement in entrepreneurial contexts: (1) Social Performance; (2) Public Challenge and; (3) Personal Autonomy. Whilst the entrepreneurs were alive to the importance of commercial return, their narratives demonstrated further concern for, and commitment to, standards that they rationally and imaginatively felt as being appropriate. In our discussion, we integrate the findings into existing theoretical categories from entrepreneurship studies to better appreciate ethics within the context of value creation. (shrink)

The Moral Dilemmas of Fighting Terrorism and Guerrilla Groups discusses the most important ethical dilemmas associated with the fight against terrorist organizations and guerilla groups by providing readers with a rigorous, yet accessible analysis of how these forms of violence can be justified and how they ought to be fought by entities targeted by groups resorting to these strategies. When we take a look back at the way Western states have fought terrorist organizations in the last 20 years, it is difficult not to think that these alternatives to war might have been more ethical than the decisions to invade Afghanistan and Iraq in 2001 and in 2003. These cases speak for themselves as they have both led to the death of hundreds of thousands of innocent civilians, which is highly paradoxical in light of the logic that supported these (...) interventions. There is a need to think of alternatives to war that will imply the legitimization of proactive sets of measures that would allow states to effectively prevent terrorist attacks through the use of kinetic force in a limited extent as a way to avoid the terrible and unpredictable effects of wars. Violent Alternatives to War: Justifying Actions Against Contemporary Terrorism engages in a moral discussion of the challenges associated with violent alternatives to war when confronting terrorism and suggests a comprehensive approach to how this form of violence can be legitimized and how it ought to be used against this contemporary threat. Les avancées de la médecine comme ses risques, excès ou dysfonctionnements conduisent à nous interroger sur la primauté affichée du techno-scientisme dans le champ de la santé, sur les idéaux de performance et les idéologies de la toute-puissance rationnelle de la biomédecine. A chaque étape de la recherche, du diagnostic, de la thérapie et du soin, la médecine n'est-elle pas toujours confrontée à la totalité d'un être vivant, à la complexité des pathologies, à l'ambivalence des thérapies, à la singularité personnelle (...) du patient? Pour valoriser pleinement le potentiel de savoirs et de savoirs-faire, issu de ses progrès, la médecine ne devrait-elle pas ré-humaniser l'homme malade, pour mobiliser toutes ses ressources biologiques, psychiques et mentales sans lesquelles la médecine risque de manquer ses buts, la santé d'une personne humaine. This paper aims to connect philosophy of chemistry, green chemistry, and moral philosophy. We first characterize chemistry by underlining how chemists: co-define chemical bodies, operations, and transformations; always refer to active and context-sensitive bodies to explain the reactions under study; and develop strategies that require and intertwine with a molecular whole, its parts, and the surroundings at the same time within an explanation. We will then point out how green chemists are transforming their current activities in order to act upon (...) the world without jeopardizing life. This part will allow us to highlight that green chemistry follows the three aforementioned characteristics while including the world as a partner, as well as biodegradability and sustainability concerns, into chemical practices. In the third part of this paper, we will show how moral philosophy can help green chemists: identify the consequentialist assumptions that ground their reasoning; and widen the scope of their ethical considerations by integrating the notion of care and that of vulnerability into their arguments. In the fourth part of the paper, we will emphasize how, in return, this investigation could help philosophers querying consequentialism as soon as the consequences of chemical activities over the world are taken into account. Furthermore, we will point out how the philosophy of chemistry provides philosophers with new arguments concerning the key debate about the ‘intrinsic value’ of life, ecosystems and the Earth, in environmental ethics. To conclude, we will highlight how mesology, that is to say the study of ‘milieux’, and the concept of ‘ecumeme’ proposed by the philosopher and geographer Augustin Berque, could become important both for green chemists and moral philosophers in order to investigate our relationships with the Earth. abstract Much of the literature on torture in recent years takes the position of denouncing the barbarity of torture, while allowing for exceptions to this veto in extreme circumstances. The ticking‐bomb argument, where a terrorist is tortured in order to extract information of a primed bomb located in a civilian area, is often invoked as one of those extreme circumstances where torture becomes justified. As the War on Terrorism intensifies, the ticking‐bomb argument has become the dominant line of reasoning used (...) by both academics and policy advisers to justify a legalized, state‐sponsored program of torture. This paper argues for the unconditional refutation of any attempt to justify torture, without exceptions. We argue against the consequentialist reasoning of the ticking‐bomb argument not from a deontological position, but on consequentialist grounds. Empirical evidence suggests that the institutionalization of torture practices creates serious problems. Torture interrogation fails to fulfil its initial purpose as a low‐cost life saver, while its long‐term potential is the devastation of democratic institutions. (shrink)

In physics, one is often misled in thinking that the mathematical model of a system is part of or is that system itself. Think of expressions commonly used in physics like “point” particle, motion “on the line”, “smooth” observables, wave function, and even “going to infinity”, without forgetting perplexing phrases like “classical world” versus “quantum world”.... On the other hand, when a mathematical model becomes really inoperative in regard with correct predictions, one is forced to replace it with a new (...) one. It is precisely what happened with the emergence of quantum physics. Classical models were superseded by quantum ones through quantization prescriptions. These procedures appear often as ad hoc recipes. In the present paper, well defined quantizations, based on integral calculus and Weyl–Heisenberg symmetry, are described in simple terms through one of the most basic examples of mechanics. Starting from probability distribution on the Euclidean plane viewed as the phase space for the motion of a point particle on the line, i.e., its classical model, we will show how to build corresponding quantum model and associated probabilities or quasi-probabilities distributions. We highlight the regularizing rôle of such procedures with the familiar example of the motion of a particle with a variable mass and submitted to a step potential. (shrink)
