To date, B&S researchers have pursued their normative aims through strategic and moral arguments that are limited because they adopt a rational actor behavioral model and firm-level focus. I argue that it would be beneficial for B&S scholars to pursue alternate approaches based on critical realism (CR) and neoinstitutional theory (IT). Such a shift would have a number of benefits. For one, CR and IT recognize the complex roots of firm behavior and provide tools for its investigation. Both approaches (...) also note the importance of social context and IT, in particular, points to tangible sites where changes in (and outcomes of) corporate practices can be assessed. CR also has an emancipatory ethos which harkens a role for scholars in social change, while IT provides mechanisms to ground this ethos in tangible activities that go beyond appealing to managers’ strategic or moral sensibilities. This paper examines two issues related to research of certified fair trade goods. The first is the question of how agendas for fair trade research should be developed. The second issue is the existence of major gaps in the fair trade literature, including the study of the particular features of fair trade practice in individual northern countries. In taking up the first of these issues, the paper proposes that normative analysis should provide the basis for developing research agendas. Such (...) an approach is important to ensure that the necessary types of questions to make normative judgments and policy decisions are posed and that biases that tend to favor mainstreaming practices in the generation of knowledge are minimized. In chapter one I will try to reconstruct a plot, or a hidden agenda, in the discussion in ethics between the beginning of the twentieth century and 1958, the year of a decisive turning point in ethics, both Anglo-Saxon and Continental, and strangely enough also the year of the beginning of the end of the Cold War, of post-Tridentine Catholicism, and perhaps something else. My hypothesis will be that there are two similar starting points for the Anglo-Saxon and the (...) Continental twentieth-century discussion, the philosophies of Henry Sidgwick and Friedrich Nietzsche, both expressions of some kind of ethical scepticism, and that a third, somewhat analogous starting-point could be found in Émile Durkheim, the proponent of the dream of the morale laïque. I will discuss how far the diagnosis formulated by Karl-Otto Apel of a kind of ‘parallel convergence' between existentialism and analytic philosophy, based on the shared division of facts and values that eventually justified two kinds of 'decisionism' is useful in making sense of the agenda of the discussion. In the second chapter I will discuss the reasons for two parallel U-turns around 1958 which brought back traditional schools of normative ethics, 'deontologism' and utilitarianism, as well as the reasons for criticism to both schools from the heterogeneous alignment of virtue ethics. In the third chapter I will discuss the remarkable phenomenon of the emergence, starting with the Sixties or the early Seventies, of ‘applied’ ethics. I examine the reasons, both theoretical and political, for the revival, the point to which applied ethics may look as a grand return of a casuistic and natural law way of thinking, or in Alan Donagan’s words a case of “reverse subversion” of the modern secular world by traditional Scholastic ways of thinking, and the difficult coexistence between general normative ethics and procedures for settling issues in a ‘reasonable’ way while dissent on issues of principle is as alive as ever. Then I try to draw a provisional moral. My suggestions are that (i) casuistry is more alive than ever; (ii) natural law thinking is more alive than ever; (iii) moral dilemmas never arise; (iv) moral dissent is treatable, with the right strategy; (v) practical philosophy does not need the same degree of exactness as the theoretical sciences but this is no obstacle to its working in practice. Principia Ethica set the agenda for analytical metaethics. Moore’s unrelenting focus on fundamentals both brought metaethics into view as a potentially separate area of philosophical inquiry and provided a model of the analytical techniques necessary to pursue it.1 Moore acknowledged that he wasn’t the first to insist on a basic irreducible core of all ethical concepts. Although he seems not to have appreciated the roots of this thought in eighteenth-century intuitionists like Clarke, Balguy, and Price, not to mention sentimentalists (...) like Hutcheson and Hume, Moore gave full marks to Sidgwick. Abstract:This paper outlines three conceptions of the relationship between normative and empirical business ethics, views we refer to asparallel, symbiotic, andintegrative. Parallelism rejects efforts to link normative and empirical inquiry, for both conceptual and practical reasons. The symbiotic position supports a practical relationship in which normative and/or empirical business ethics rely on each other for guidance in setting agenda or in applying the results of their conceptually and methodologically distinct inquiries. Theoretical integration countenances a deeper merging (...) ofprima faciedistinct forms of inquiry, involving alterations or combinations of theory, metatheoretical assumptions, and methodology. Distinguishes and shows how one can coherently affirm distinct human rights agendas rooted in distinct conceptions of human rights, each with its own normative aim and institutional and discursive field of application.

In this paper I distinguish between three conceptions of human rights and thus three human rights agendas. Each is compatible with the others, but distinguishing each from the others has important theoretical and practical advantages. The first conception concerns those human rights tied to natural duties binding all persons to one another independent of and prior to any institutional context and the violation of which would “shock the conscience” of any morally competent person. The second concerns the institutional conditions necessary (...) and sufficient for particularist legal and political obligations to take on prima facie moral force so that the members of different polities face one another in an asymmetric moral relationship, with each side having a rightful claim to political self-determination. The third concerns those human rights arising exclusively as a matter of positive international law out of the voluntary undertakings of legitimate polities within the international order. Each of these different conceptions is tied to a different human rights agenda. The second is tied to the struggle to realize recognitional norms of legitimacy within the international order. The third is tied to the ongoing effort to incorporate into positive international law through voluntary initiative an ever expanding moral consensus between legitimate polities. The first is tied to the emerging practice of humanitarian intervention and system of international criminal liability. Thus, while all human rights share certain features – they’re universal, and so on – human rights differ in important ways. Attending to these differences would likely improve both the theory and practice of human rights. (shrink)

My dissertation explores the foundations of ethics—the question of whether and where practical justification comes to an end. What reason do we have to be moral? Is the fact that something is pleasurable at least a defeasible reason to pursue it, and if so, why? I argue that the only way to answer such questions is to look at what is constitutive of action. Nonnormative facts about the nature of agency can ground the normative authority of reasons for action. (...) Recently, an influential group of externalists about reasons for action have argued that normativity is sui generis and cannot be further explained. Recently, too, many of the most prominent internalists to offer an explanation of normative force have merely assimilated the problem to one about motivational force. I argue that neither position is satisfactory. We need answers to our practical questions, and externalism has none to offer beyond brute intuitions. A purely motivational internalism, on the other hand, seems to fall well short of a normative theory. Appeals to facts about motivation do not answer the question of what we have reason to do; they bypass it in favor of the question of what we are going to do. Fortunately, there is a middle way that combines the best of both views: constitutivism. An account of practical normativity based on action’s constitutive aim can explain both how we are governed or moved by reasons and how those reasons have genuine, objective authority. The constitutive aim of action sets the agenda for practical reasoning, and considerations that engage this aim are the ones that bring such reasoning to a close. They settle the practical question of what to do. But if, as I maintain, the normative question of what I ought to do (or what I have reason to do) seeks considerations that bear on the practical question of what to do, then answers to the latter are ipso facto answers to the former. In this way, nonnormative facts about what closes practical deliberation can ground fully normative facts about what we have reason to do. (shrink)

In this paper we outline a theory of normative functionality aimed at understanding the nature of adaptive systems as globally structured, integrated systems. More specifically, the account is concerned with understanding the process relations constitutive of such systems. The explanatory agenda of this approach includes the following questions.

These organizations seek to achieve social missions through business ventures. Yet social missions and business ventures are associated with divergent goals, values, norms, and identities. Attending to them simultaneously creates tensions, competing demands, and ethical dilemmas. Effectively understanding social enterprises therefore depends on insight into the nature and management of these tensions. While existing research recognizes tensions between social missions and business ventures, (...) we lack any systematic analysis. Our paper addresses this issue. We first categorize the types of tensions that arise between social missions and business ventures, emphasizing their prevalence and variety. We then explore how four different organizational theories offer insight into these tensions, and we develop an agenda for future research. We end by arguing that a focus on social-business tensions not only expands insight into social enterprises, but also provides an opportunity for research on social enterprises to inform traditional organizational theories. Research on the challenges facing African women entrepreneurship and the impact of the coronavirus disease 2019 (COVID-19) pandemic is scant. This article explored the challenges and the impact of COVID-19 on African women-owned businesses and the effect thereof on the 17th goal of the African Union (AU) Agenda 2063. African women entrepreneurs experience many social inequalities, ranging from cultural norms to family to legal and regulatory measures to accessing finance. The COVID-19 pandemic exacerbated these challenges as many African women (...) entrepreneurs have been forced out of business because of measures taken by African governments to halt the spread of the disease. The article reviewed current literature on African women entrepreneurs and the impact of the COVID-19 pandemic using two databases and is based on a total of 104 published articles. The article provided a foundation for post-COVID-19 policy directives in Africa. The authors recommend measures to mitigate these challenges and discuss strategies for policymakers to re-position African women entrepreneurs for the post-COVID-19 era towards achieving AU Agenda 2063 and realising the Africa we all want. Contribution: The study aligns with the United Nations Sustainable Development Goal of ending poverty in Africa and the AU Agenda 2063 goal of achieving gender equality and empowerment of all women and girls to achieve the Africa we all want. ABSTRACT:I here advance a critical research agenda for the political perspective of corporate social responsibility (Political CSR). I argue that whilst the ‘Political’ CSR literature is notable for both its conceptual novelty and practical importance, its development has been hamstrung by four ambiguities, conflations and/or oversights. More positively, I argue that ‘Political’ CSR should be conceived as one potentialformof globalization, and not as aconsequenceof ‘globalization’; that contemporary Western MNCs should be presumed to engage in CSR for instrumental reasons; that (...) ‘Political’ CSR should be associated with a corresponding ‘political’ model of corporate governance; and that both a ‘Rawlsian’ and ‘Habermasian’ perspective of Political CSR are different from ‘Political’ CSR. In concluding, I use these four critiques to identify a number of areas within which increasingly robust and sophisticated positive and normative theories of Political CSR are required. (shrink)

ABSTRACT Research ethics is the most developed aspect of bioethics in Africa. Most African countries have set up Institutional Review Boards (IRBs) to provide guidelines for research and to comply with international norms. However, bioethics has not been responsive to local needs and values in the rest of the continent. A new direction is needed in African bioethics. This new direction promotes the development of a locally‐grounded bioethics, shaped by a dynamic understanding of local cultures and informed by structural and (...) institutional problems that impact the public's health, as well as cognisant of the salient contribution of social sciences and social epidemiology which can bring a lasting impact on African local communities. In today's post‐Structural Adjustment Africa, where healthcare has been liberalized and its cost increased, a bioethics agenda that focuses essentially on disease management and clinical work remains blind in the face of a structural marginalization of the masses of poor. Instead, the multidimensional public health crisis, with which most African countries are confronted, calls for a bioethics agenda that focuses primarily, but not exclusively, on health promotion and advocacy. Such an approach to bioethics reckons with the macro‐determinants of health and well‐being and places clinical and research ethics in the broader context of population's health. The same approach underscores the need to become political, not only by addressing health policymaking processes and procedures, but also by becoming an advocacy forum that includes other constituencies equipped with the potentialities to impact the population's health. A great deal of constructivist international relations research on norms focuses on the diffusion of liberal human rights values. In contrast, this article analyzes how critics seek to undermine human rights principles in contexts where human rights norms are increasingly hegemonic. It argues that when norm challengers are frustrated by the institutionalization of human rights, they engage in transnational strategies to pursue their agendas. In norm proxy war, actors patronize surrogates in locales where norms are weak in the hope that (...) victories abroad will reverberate internationally and at home. This dynamic is illustrated by American evangelical sponsorship of political homophobia in Uganda, culminating in that country’s draconian anti-LGBT legislation. When norms are resisted through outsourcing, actors contract out human rights violations in an effort to erode norms through practice, as evidenced by patterns of extraterritorial detention and extraordinary rendition to torture in the post-9/11 “Global War on Terror.” Identifying these patterns broadens understanding of potential pathways of norm contestation. PurposeThe purpose of this paper is to attempt to resolve some unclarity about the nature and character of intercultural information ethics (IIE).Design/methodology/approachBy survey of some of the relevant literature, the paper identifies and explains the distinctive projects of IIE. In addition, to facilitate the achievement of these projects, the paper attempts to identify the most fruitful metaphysical and meta‐ethical assumptions about truth and moral truth. In particular, to identify and determine which of objectivist theories of truth and morality or intersubjectivist (...) theories of truth and morality provides a better theoretical foundation for IIE.FindingsTwo projects are identified: a descriptive project and a normative project. It is argued that moral objectivism provides a better foundation for the normative (project than moral intersubjectivism (or, as it is sometimes called, normative cultural relativism) in the sense that objectivism provides a more solid ground for the principle grounding the normative project – namely that agreement among cultures on principles of information ethics is good or desirable. In other respects, it is concluded that moral objectivism and moral intersubjectivism do equally well in grounding the normative project.Originality/valueThe paper is the first to compare the two methodological approaches and points in the direction of the most fruitful approach to take in pursuing IIE. The new inter-disciplinary eclecticism championed by many philosophers of science has generated a heterogeneous family of science studies projects. Philosophers who favor an inter-disciplinary approach face many problems if they are to successfully forge a hybrid science studies that does not violate their integrity as philosophers in particular, they must isolate an intellectual space in which traditional agendas, such as the concern for the clarification of concepts, can hold court. In this paper, I outline what I regard as a new (...) brand of HPS, one that is deeply rooted in the history of the exact science. The virtue of this New HPS, I will submit, is that it furnishes philosophers of science with a fresh perspective from which to carry on philosophy's classic normative mission. (shrink)

Concerns about the risks of unmitigated greenhouse gas emissions are growing. At the same time, confidence that international policy agreements will succeed in considerably lowering anthropogenic greenhouse gas emissions is declining. Perhaps as a result, various geoengineering solutions are gaining attention and credibility as a way to manage climate change. Serious consideration is currently being given to proposals to cool the planet through solar-radiation management. Here we analyze how the unique and nontrivial risks of geoengineering strategies pose fundamental questions at (...) the interface between science and ethics. To illustrate the importance of integrated ethical and scientific analysis, we define key open questions and outline a coupled scientific-ethical research agenda to analyze solar-radiation management geoengineering proposals. We identify nine key fields of coupled research including whether solar-radiation management can be tested, how quickly learning could occur, normative decisions embedded in how different climate trajectories are valued, and justice issues regarding distribution of the harms and benefits of geoengineering. To ensure that ethical analyses are coupled with scientific analyses of this form of geoengineering, we advocate that funding agencies recognize the essential nature of this coupled research by establishing an Ethical, Legal, and Social Implications program for solar-radiation management. Science, engineering and technology are still male-dominated fields, and thus all over Europe much effort is expended on activities which, it is hoped, will lead to a sustainable gender balance. Scholarly work has frequently focused on the topic of how to motivate women to enter SET fields or to choose a corresponding education. In contrast to this one-sided approach, recent scholarly contributions have begun to emphasize the vital role of gendered structures and indirect exclusion mechanisms of technological institutions and their (...) professional self-understandings which discourage women from entering or staying in SET organizations. In particular, taken-for-granted knowledge as a mechanism for maintaining specific norms and values is considered a primary hindrance towards more inclusive and less oppressive organizational cultures. Since this taken-for-granted knowledge is often implicit, a primary goal of research can be said to make the invisible visible. Thus this article presents selected empirical results of a research project which makes use of an investigative tool called mind-scripting. Here the aim is to identify the main barriers, in terms of unquestioned taken-for granted knowledge, currently hindering an open and critical review of gendered structures and gender codes in the SET field, or in organizations in general, particularly with respect to professional norms. There are different possibilities for defining the areas for the application of ethics to engineering. They range from descriptive analysis of engineers’ relationship to moral criteria and extend to normative issues on how engineers should design more “sustainable” technology. In this paper, a frame of reference is proposed, which makes it possible to elaborate in a transparent manner goals for analysis of the scope of ethics in engineering. Its point of departure is marked by two questions: 1) which types (...) of situation in the practice of engineering require ethical reflection? and 2) to what extent are engineers expected to assume moral responsibility in the practice of their profession? The answers to both of these questions presuppose reflection on the societal processes of setting definitions and of making ascriptions. Understanding these processes of societal “construction” of demands for ethical reflection in engineering and of engineers’ moral responsibilities should be an important objective of the analysis of ethics in engineering. Bottom lines and codes provide a corporation with guidelines for dealing with the inside and outside world. Bottom lines have the oldest papers through Frederic Taylor's Scientific Management, dated beginning 20th century. Codes came into existence in its midst with the emerging sustainability agenda, referring both to technical detail and human judgement. Corporate codes present themselves as a policy document with collective rules handed down by way of a top-down approach. Since an effective code is dependent on the motivation (...) of individual employees, this article proposes the additional view of a bottom-up approach. By sharing values in concrete work employees become co-owners of the code. Top-down and bottom-up approaches thus emerge in a complementary relationship. A relevant organisational context would be a parallel structure of action and reflection, thus facilitating balanced thinking in the sustainability domain and contributing to an 'ethical calibre' or 'moral standard' of a corporation. The very idea of human resource management raises ethical considerations: What does it mean to us as humans for human beings to be managed as resources? Intriguingly, the field of ethics and HRM remains underdeveloped. Current approaches to HRM fail to place ethical considerations as their central warrant. This article, building on Greenwood (J Bus Ethics 36(3):261–279, 2002), argues for a deeper analysis of ethical issues in HRM, indeed for a differentiated ethical perspective of HRM that sets normative deliberations (...) as its prime task. By identifying a distinct ethical approach to HRM that is unashamedly normative and socio-politically embedded, two objectives can be achieved. First, mainstream and critical approaches will be challenged to take ethical issues in HRM more seriously. Second, a dedicated forward-looking research agenda for the ethical analysis of HRM will be advanced. (shrink)

Is liberalism adaptable enough to the ecological agenda to deal satisfactorily with the challenges of anthropogenic climate change while leaving its normative foundations intact? Compatibilists answer yes; incompatibilists say no. Comparing such answers, this article argues that it is not discrete liberal principles which impede adapatability, so much as the constructivist model (exemplified in Rawls) of what counts as a valid normative principle. Constructivism has both normative and ontological variants, each with a realist counterpart. I argue (...) that normative constructivism in the Rawlsian mode, whatever its strengths elsewhere, is markedly ill‐equipped to deal with the particular normative challenges posed by climate change – and that that these doubts holds regardless of which stance is adopted as its ontological corollary. Resources for Feminist Research, Vol. 3, No. 4, pp. 44-45, 1985 In this brief article, written in 1984 and published the following year, Lucinda Vandervort sets out a comprehensive agenda for enforcement of sexual assault laws in Canada. Those familiar with her subsequent writing are aware that the legal implications of the distinction between the “social” and “legal” definitions of sexual assault, identified here as crucial for interpretation and implementation of the law of sexual assault, are analyzed at length (...) in “Mistake of Law and Sexual Assault: Consent and Mens Rea” (1986), published at (1987-88) 2(2) Canadian Journal of Women and the Law, 233 309. In that article the author argued that most mistakes about consent are not mistakes about a “fact” that may sometimes negative mens rea, but are actually mistakes about the law that afford accused no excuse under either Canadian common law or statutory criminal law. She argued further that consent must be interpreted as “voluntary agreement” and must be affirmatively and unequivocally communicated in order to operate as an effective waiver of a person’s legal right to be free from interference with his or her bodily integrity. That article was a central reference point in the consultations leading to the 1992 amendments to the sexual assault provisions in the Canadian Criminal Code and in some key decisions by the Supreme Court of Canada in sexual assault cases in the 1990’s. As a result of a gradual transformation of theoretical analysis of the law of mens rea and consent in Canada, culpable awareness is now understood by many jurists and criminal law theorists quite differently than it was twenty-five years ago. As Vandervort acknowledged in her 1984 Agenda for Action, however, clarity in legal theory and legal doctrine is no guarantee of how sexual assault laws will operate in practice. Theory and practice, doctrine and its implementation, often diverge. This phenomenon is still seen in some decisions taken at the trial, pre-trial, and pre-charge stages in sexual assault cases. Police, prosecutors, and many trial judges, like accused, may often be influenced by traditional attitudes about sexual consent and mistaken about the law of consent. Accordingly, in her recent work Vandervort re-visits and re-examines the exercise of discretion by police, prosecutors, and the judiciary. An example is her 2009 article “Legal Subversion of the Criminal Justice Process? Judicial, Prosecutorial and Police Discretion in R. v. Edmondson, Kindrat and Brown” in Sexual Assault Law, Practice & Activism in a Post-Jane Doe Era, edited by Elizabeth Sheehy (Ottawa: University of Ottawa Press, 2012). In this and some of her other recent work, the distinctions between social and legal norms and questions of fact and law, previously analyzed with the objective of clarifying the law, are used to control the effects of social ignorance and partiality in the handling of sexual assault complaints by decision-makers in the criminal justice system at trial and pre-trial. Lucinda Vandervort’s published and unpublished legal and philosophical writings on sexual assault and sexual assault law illustrate the development of a socio-legal scholar’s “Agenda for Action” into a principled, pragmatic, open-ended exercise in “institutional design.” Across two centuries, from the revolutionary era of the 18th century to the present, other radical egalitarians would recognize both the impetus for the project and many features of the political and cultural resistance to it. The rapid, recent emergence of new medical knowledge models has engendered a dizzying number of new medical initiatives, programs and approaches. Fields such as evidence-based medicine and translational medicine all promise a renewed relationship between knowledge and medicine. The question for philosophy and other fields has been whether these new models actually achieve their promises to bring about better kinds of medical knowledge—a question that compels scholars to analyze each model’s epistemic claims. Yet, these analyses may miss critical components that (...) explain how these models actually work and function. Using the case of translational medicine, this paper suggests that analyses which treat these models as a primarily epistemic interventions miss the way that new approaches are increasingly shaped by specific financial and commercial agendas. Ultimately, social epistemological analyses that are attentive to market forces are required to make sense of emerging bioscientific research models, which are increasingly tethered to or a manifestation of increasingly financialized models of science research and innovation. The power exercised by technology companies is attracting the attention of policymakers, regulatory bodies and the general public. This power can be categorized in several ways, ranging from the “soft power” of technology companies to influence public policy agendas to the “market power” they may wield to exclude equally efficient competitors from the marketplace. This Article is concerned with the “data power” exercised by technology companies occupying strategic positions in the digital ecosystem. This data power is a multifaceted power that (...) may overlap with economic (market) power but primarily entails the power to profile and the power to influence opinion formation. While the current legal framework for data protection and privacy in the EU imposes constraints on personal data processing by technology companies, it ostensibly does so without regard to whether or not they have “data power.” This Article probes this assumption. It argues that although this legal framework does not explicitly impose additional legal responsibilities on entities with “data power,” it provides a clear normative indication to do so. The volume and variety of data and the reach of data-processing operations seem to be relevant when assessing both the extent of obligations on technology companies and the impact of data processing on individual rights. The Article suggests that this finding provides the normative foundation for the imposition of a “special responsibility” on such firms, analogous to the “special responsibility” imposed by competition law on dominant companies with market power. What such a “special responsibility” might entail in practice will be briefly outlined and relevant questions for future research will be identified. (shrink)

The purpose of this paper is to assess the emergence of the pirate movements in the European Union. Our goal is to sketch the steps towards a research agenda for this grassroots political movement which gained momentum since 2009. To attain our goal we showed the re-signification of the concept of piracy in the debate around intellectual property and its institutional settlement. Afterwards we analysed the big political themes of several European Pirate Parties and their struggle to follow the (...) preferences of the median voter. We concluded with a set of hypotheses of which the most important is that the pirates will inscribe neither to the left nor to the right part of the political spectrum. (shrink)

This article sets out the case for a mutual cross-fertilisation of normative cosmopolitan thought and the field of comparative political theory. Its argument is that both are useful to the other if their primary claims are warranted. Comparative political theory needs coherence about what distinguishes its enterprise and makes it truly comparative across traditions and normative cosmopolitanism needs transcultural validation of its normative ideal of human community and moral universality. The cosmopolitan agenda exploring comparative views of (...) inclusion and exclusion and universality in the context of a global harm principle provides the field in which the necessary cross fertilisation can occur. Why do physicians have financial conflicts of interest? They arise because society expects physicians to act in their patients’ interest, while simultaneously, financial incentives encourage physicians to practice medicine in ways that promote their own interests or those of third parties. Because physicians’ clinical choices, referrals, and prescriptions affect the fortune of third parties, these third parties may offer physicians financial incentives to make income-driven clinical choices. In the past, physicians and scholars typically conceived of conflicts of interest as an (...) ethical issue to be resolved according to individual judgment or professional and organizational norms. However, society can mitigate or eliminate conflicts of interest by changing financial and organizational arrangements in medicine. Applications of artificial intelligence/machine learning in health care are dynamic and rapidly growing. One strategy for anticipating and addressing ethical challenges related to AI/ml for health care is patient and public involvement in the design of those technologies – often referred to as ‘co-design’. Co-design has a diverse intellectual and practical history, however, and has been conceptualized in many different ways. Moreover, AI/ml introduces challenges to co-design that are often underappreciated. Informed by perspectives from critical data studies and critical digital (...) health studies, we review the research literature on involvement in health care, and involvement in design, and examine the extent to which co-design as commonly conceptualized is capable of addressing the range of normative issues raised by AI/ml for health care. We suggest that AI/ml technologies have amplified and modified existing challenges related to patient and public involvement, and created entirely new challenges. We outline three pitfalls associated with co-design for ethical AI/ml for health care and conclude with suggestions for addressing these practical and conceptual challenges. (shrink)

This study explores the institutional logics and socialization experiences of STEM doctoral students in the context of the current American economic narrative that is specific to science and technology. Data from qualitative interviews with 36 students at three research universities first reveals a disconnect between a well-established national science and technology policy narrative that is market-oriented and the training, experiences, and perspectives of science and engineering doctoral students. Findings also indicate science and engineering doctoral students mostly understand entrepreneurship and innovation (...) in the contexts of funding research activities and creating social impact, which parallel rather than oppose dominant academic values and norms. Based on the findings, we contend that it is both possible and prudent for universities and graduate programs to pursue strategies that align science and engineering doctoral education with the current national economic agenda and support the personal, professional values and perspectives of students without coming in conflict with the scientific core of the academy. In this article I raise a number of issues concerning John McDowell’s widely influential revisionist reading of Kant. These have to do with what I see as his failure – despite ambitious claims in that regard – to overcome the various problematic dualisms that dogged Kant’s thought throughout the three Critiques. Moreover, as I show, they have continued to mark the discourse of those who inherit Kant’s agenda in this or that updated, e.g., ‘linguistified’ form. More specifically, I argue (...) that McDowell’s ‘new’ reading amounts to no more than a series of terminological shifts or substitutions, such that (for instance) the well-known problem with explaining how ‘sensuous intuitions’ can be somehow synthesised with ‘concepts of understanding’ is replaced – scarcely resolved – by an equally opaque and question-begging appeal to Kantian ‘receptivity’ and ‘spontaneity’. My essay goes on to discuss a number of kindred dichotomies, among them that of nature and ‘second nature’, all of which can basically be seen as resulting from the normative deficit entailed by McDowell’s particular kind of half-way naturalizing project. I conclude that this project shows insufficient regard to the history of post-Kantian continental thought, in particular the similar problems faced by ‘subjective’ and ‘objective’ idealists like Fichte and Schelling. Human resource management (HRM) is underpinned by, and contributes to, the business ethics of the organization. Opportunities available to men and women as managers, and the role of managers more broadly, are critical in shaping business ethics in contemporary organizations. Research on women in management therefore provides an important lens through which to understand the institutional and cultural context of HR ethics as part of the business ethics of a country. To date, women in management in China remains an under-charted (...) topic of research in the HRM field. Extant research and recommendations on the improvement of the position of women in management in China focus primarily on women themselves from a traditional, gender norm angle, instead of challenging the political and patriarchal system or any institutionalized discriminatory practice. This is, in part, due to the absence in China of a critical feminism approach or feminist movement, as found in Western societies, and the continuing strong influence of the state and media in portraying women’s (stereotypical) image. There is significant room for research capacity building in scholarship on women in management research, for example, and through cross-fertilization of different disciplines and more rigorous research design and execution. This paper provides a critical analysis of extant literature on women in management and the ideologies underpinning it, and offers some suggestions for future research and conceptualization. The notion of extant social contracts (ESC), which was the original contribution that Tom Dunfee provided to contractualist business ethics (CBE) and Integrated Social Contracts Theory (ISCT) more specifically, has commanded less research attention to date than one would expect based on its apparent empirical face validity and its disciplinary spanning potential. This article attempts to revive the ESC concept in both normative and positive research at the intersection of business, management, and ethics and law. After identifying three features (...) that positively distinguish ESC from ISCT, this article argues that the yet unrealized conceptual potential of ESC is most likely to be cashed out when it is applied to the field of private international business regulation and when it is conceptually connected to the legitimizing perspective of institutional theory. This paper examines two issues related to research of certified fair trade goods. The first is the question of how agendas for fair trade research should be developed. The second issue is the existence of major gaps in the fair trade literature, including the study of the particular features of fair trade practice in individual northern countries. In taking up the first of these issues, the paper proposes that normative analysis should provide the basis for developing research agendas. Such (...) an approach is important to ensure that the necessary types of questions to make normative judgments and policy decisions are posed and that biases that tend to favor mainstreaming practices in the generation of knowledge are minimized. In a recent examination of the origins of ordinal utility theory in neoclassical economics, Robert D. Cooter and Peter Rappoport argue that the ordinalist revolution of the 1930s, after which most economists abandoned interpersonal utility comparisons as normative and unscientific, constituted neither unambiguous progress in economic science nor the abandonment of normative theorizing, as many economists and historians of economic thought have generally believed. Rather, the widespread acceptance of ordinalism, with its focus on Pareto optimality, simply represented the (...) emergence of a new neoclassical research agenda that, on the one hand, defined economics differently than had the material welfare theorists of the cardinal utility school and, on the other, adopted a positivist methodology in contrast to the less restrictive empiricism of the cardinalists. This article presents a conceptual investigation of the intellectual debates on the normative destination of China, which have intensified since the mid-1990s when both liberalism and the New Left emerged under the Chinese backgrounds of the spreading of marketization and the maintaining of political authoritarianism.1 The investigation, however, is not an attempt to systematically examine those debates, which, as usual in the Chinese intellectual style of the twentieth century, often freely and arbitrarily cross various issue-areas and mix very different (...) concepts. Instead, this article interprets and criticizes the debates with its own political and academic concerns , which are reflected in two questions: First, how does liberty originate from a society that traditionally and practically has had little liberty? Second, how can such liberty be, whereas it has been given to birth or substantial growth from whatever soils and by whatever paths, sustained, expanded, and institutionalized in the society? This paper argues that it is necessary to focus on gender rather than exclusively on women in discussions on global poverty eradication. It argues firstly, that the drivers of poverty are complex and multifaceted leading to a least two different forms of deprivation – transitory and structural poverty – each requiring different forms of analysis and treatment. Transitory poverty can arise as a consequence of an event or shock that would diminish an individual’s capacity to retain or secure employment and (...) where a State lacks an appropriate form of social protection. Structural poverty, on the other hand, arises where groups are excluded from the workforce on a more permanent basis due to a wide variety of factors of discrimination such as sex, race, ethnicity, and age. Focusing on the sex of an individual alone cannot explain why some are more likely to experience different forms of poverty than others. Policies that protect women against transitory poverty, such as care related allowances, are not sufficient to eradicate structural poverty. Secondly, structural poverty prompts an examination of gender roles and relations. Unlike the category of ‘women’, the concept of gender demands consideration of a wider range of intersecting factors that influence life chances. The structure of contemporary gender relations, where women continue to experience higher levels of violence, and carry the greatest burden of responsibility for non-market based production activities, create the social conditions where domination and dependence thrive, and where persistently high rates of poverty seem inevitable. Such circumstances are generated by human agency. Thus, thirdly, it argues that these circumstances can and should be changed through human action. Knowledge of these circumstances gives rise to moral obligations for both men and women to avoid upholding values and practices that lead to domination and dependence as a matter of basic justice. The public purse is responsible for funding almost all autism spectrum disorders (ASD) research in Canada (as per Canadian Institutes of Health Research [CIHR]) and for providing some of the existing services and supports for this population. In this article, we consider various reasons why Canada should be concerned to ensure a more equitable distribution of relevant public funding for ASD research than is currently the case to meet the express needs and interests of the diversity of autism stakeholders. As (...) such, we report data to show that CIHR-supported ASD research from the period of 2000–2010 demonstrates a bias focussed on the aetiology of the condition revealing a disproportionate emphasis on only two (Biomedical and Clinical) out of the four research pillars avowed by CIHR, with a comparative lack of fiscal resources committed to Health Systems and Services and Population and Public Health research. We advance certain normative and prudential reasons for funding more Health Systems and Services and Population and Public Health ASD research in Canada. In our view, this would seem to follow from CIHR’s official mandate ‘as a flexible mechanism that will continually align health research funding with changes in the manner in which health problems and opportunities are identified, understood and addressed’. ABSTRACTThe financial crisis of 2008 was unforeseen partly because the academic theories that underpin policy making do not sufficiently account for uncertainty and complexity or learned and evolved human capabilities for managing them. Mainstream theories of decision making tend to be strongly normative and based on wishfully unrealistic “idealized” modeling. In order to develop theories of actual decision making under uncertainty, we need new methodologies that account for how human actors often manage uncertain situations “well enough.” Some possibly helpful (...) methodologies, drawing on digital science, focus on the role of emotions in determining people's choices; others examine how people construct narratives that enable them to act; still others combine qualitative with quantitative data. Toulmin is famously seen as the progenitor of informal logic and the related theory of argument and is first among many who seek to move the study of argument away from its roots in formal, especially mathematical, logic. Toulmin’s efforts, however, have been substantively criticized by Harvey Siegel, among others, for failing to offer the sort of foundation that, according to Siegel, even Toulmin sees to be required lest the theory of inquiry fall to impotent relativism. What I will attempt (...) to indicate in this paper is, that although Toulmin is correct in rejecting mathematical logic as standardly construed as an adequate theory of argument, and logical empiricist constructions as an adequate basis for the philosophical understanding of science, there is a significant role for metamathematics in the new logic. In particular, I will show how a formal model based on mature physical science rather than arithmetic furnishes crucial support to Toulmin, furnishing philosophical metaphors that afford the foundational support required for normativity and the clarification of key logical concepts required for a robust normative theory of argument in the context of inquiry. This article discusses the pros and cons of the creation of a separate Ukrainian standard of the Russian language. Owing to the centralist and elitist history of the Russian standard language, the high variant of Russian that is used in Ukraine does not significantly differ from that of Russia, if at all. Low varieties, by contrast, are quite heterogeneous. The standardization of “Ukrainian Russian” would thus be very problematic at all stages: the selection of norms and their codification, the implementation (...) and elaboration of the new norms. All these steps would not only require considerable funding; in the long run, it would also undermine the status of Ukrainian as Ukraine’s sole state language. (shrink)
