The aim of the Directive 2005/29 on unfair commercial practices is to contribute to the proper functioning of the internal market and achieve a high level of consumer protection by way of approximation of the laws, regulations and administrative provisions of Member States relating to the elimination of these practices. As announced to the European Commission’s Green Paper, the Commission felt that the existing regulations in the Member States in that the regard to show significant differences causes legal uncertainty and (...) barriers to the operation of the internal market, including building consumer confidence in cross-border transactions. The advantage of the full unification of the law is to strengthen the autonomy of Community law, the achievement of effectiveness. It is questionable whether it is due to the subject matter which is the maximum harmonization discussed act will actually serve to protect economic interests of the consumer. In particular, it undermines the treaty-legal basis, which clearly is aimed at strengthening the single market. Also changes in the Lisbon Treaty, particularly Article 3 TEU, are aimed at establishing the internal market. In the last judgments, like on 9 November 2010 we find that Directive 2005/29 must be interpreted as precluding a national provision, which lays down a general prohibition on sales with bonuses and is not only designed to protect consumers but also pursues other objectives. Does the new act in consequence of the implementation of the national member states give great scope for the flexible operation and may become an effective instrument of pressure to improve business practices? In this paper, the multifeature fusion music classification algorithm and its simulation results are studied by deep confidence networks, the multifeature fusion music database is established and preprocessed, and then features are extracted. The simulation is carried out using multifeature fusion music data. The multifeature fusion music preprocessing includes endpoint detection, framing, windowing, and pre-emphasis. In this paper, we extracted the rhythm features, sound quality features, and spectral features, including energy, cross-zero rate, fundamental frequency, harmonic noise ratio, and 12 statistical (...) features, including maximum value, mean value, and linear slope. A total of 384-dimensional statistical features was extracted and compared with the classification ability of different emotional features. The deficiencies of the traditional classification algorithm are first studied, and then by introducing confusion, constructing multilevel classifiers, and tuning each level of the classifier, better recognition rates than traditional primary classification are obtained. This paper introduces label information for supervised training to further improve the features of multifunctional fusion music. Experiments show that this information has excellent performance in multifunctional fusion music recognition. The experiments compare the multilevel classifier with primary classification, and the multilevel classification with the primary classification and the classification performance is improved, and the recognition rate of the multilevel classification algorithm is also improved over the multilevel classification algorithm, proving that the excellent performance with multiple levels of classification. In theory and practice, the notion of fairness is far from simple. The principle is often elusive and subject to confusion, even in institutions of law, usage, and custom. In Fairness, Nicholas Rescher aims to liberate this concept from misunderstandings by showing how its definitive characteristics prevent it from being absorbed by such related conceptions as paternalistic benevolence, radical egalitarianism, and social harmonization. Rescher demonstrates that equality before the state is an instrument of justice, not of social utility or (...) public welfare, and argues that the notion of fairness stops well short of a literal egalitarianism. Rescher disposes of the confusions arising from economists' penchant to focus on individual preferences, from decision theorists' concern for averting envy, and from political theorists' sympathy for egalitarianism. In their place he shows how the idea of distributive equity forms the core of the concept of fairness in matters of distributive justice. The coordination of shares with valid claims is the crux of the concept of fairness. In Rescher's view, this means that the pursuit of fairness requires objective rather than subjective evaluation of the goods being shared. This is something quite different from subjective equity based on the personal evaluation of goods by those laying claim to them. Insofar as subjective equity is a concern, the appropriate procedure for its realization is a process of maximum value distribution. Further, Rescher demonstrates that in matters of distributive justice, the distinction between new ownership and preexisting ownership is pivotal and calls for proceeding on very different principles depending on the case. How one should proceed depends on context, and what is adjudged fair is pragmatic, in that there are different requirements for effectiveness in achieving the aims and purposes of the sort of distribution that is intended. Rescher concludes that fairness is a fundamentally ethical concept. Its distinctive modus operandi contrasts sharply with the aims of paternalism, preference-maximizing, or economic advantage. This chapter first outlines the three main phases of the development of the single market, together with the impetus and philosophy underpinning it. The idea behind the original European Economic Community (EEC) Treaty was simple: barriers to free movement of goods, persons, services, and capital would be removed through the use of treaty provisions that prohibited obstacles to free movement. One aspects of the single market have been reformed following the crisis, notably financial services. The legislature is increasingly moving towards (...) the use of regulations, rather than directives, to ensure greater uniformity and maximum as opposed to minimum harmonization to remove the possibility of national variation. The chapter then examines some of the challenges facing the single market. The challenges essentially concern questions of competence, sovereignty and effectiveness. We are now, after some delay, beginning actively to discuss a theme—or is it still a problem?—that has become traditional for Western sociology and political science—namely, totalitarianism. If we start from the firmly established view that construes totalitarianism as a social structure in which the state devours and exercises maximum control over all spheres of the social life of individuals, i.e., a structure based on maximum coercion , we can, it would seem, simply make concrete extrapolations of the (...) existing theoretical model to the countries and regions we have chosen to study. But it seems to me that there are still a number of not fully worked out aspects in the methodology employed to study totalitarianism, and in applied studies this leads either to a pan-totalitarian view of history or to the localization of totalitarianism in a few countries . I think that this situation cannot be "harmonized" in the traditional manner by distinguishing between a "broad" and a "narrow" meaning of the term ‘totalitarianism.’ Hence, rather than trying to "not notice" the methodological problem, I propose dealing with it in all theoretical seriousness. Background Biobanking and genomic research requires collection and storage of human tissue from study participants. From participants’ perspectives within the African context, this can be associated with fears and misgivings due to a myriad of factors including myths and mistrust of researchers. From the researchers angle ethical dilemmas may arise especially with consenting and sample reuse during storage. The aim of this paper was to explore these ethical considerations in the establishment and conduct of biobanking and genomic studies in Africa. (...) Methods We conducted a narrative synthesis following a comprehensive search of nine (9) databases and grey literature. All primary research study designs were eligible for inclusion as well as both quantitative and qualitative evidence from peer reviewed journals, spanning a maximum of 20 years (2000–2020). It focused on research work conducted in Africa, even if data was stored or analysed outside the region. Results Of 2,663 title and abstracts screened, 94 full texts were retrieved and reviewed for eligibility. We included 12 studies (7 qualitative; 4 quantitative and one mixed methods). Ethical issues described in these papers related to community knowledge and understanding of biobanking and genomic research, regulation, and governance of same by research ethics committees, enrolment of participants, types of informed consents, data collection, storage, usage and sharing as well as material transfer, returning results and benefit sharing. ca. Biospecimen collection and storage is given in trust and participants expect confidentially of data and results generated. Most participants are comfortable with broad consent due to trust in researchers, though a few would like to be contacted for reconsenting in future studies, and this would depend on whether the new research is for good cause. Sharing data with external partners is welcome in some contexts but some research participants did not trust foreign researchers. Conclusion Biobanking and genomic studies are a real need in Africa. Linked to this are ethical considerations related to setting up and participation in biobanks as well as data storage, export, use and sharing. There is emerging or pre-existing consensus around the acceptability of broad consent as a suitable model of consent, the need for Africans to take the lead in international collaborative studies, with deliberate efforts to build capacity in local storage and analysis of samples and employ processes of sample collection and use that build trust of communities and potential study participants. Research ethics committees, researchers and communities need to work together to work together to adapt and use clearly defined ethical frameworks, guidelines, and policy documents to harmonize the establishment and running of biobanking and genomic research in Africa. For an object to be multilocated is for it to wholly occupy disjoint spatial regions simultaneously. If multilocation is possible, it is possible that a multilocated particle is wholly located at 1080 distinct locations, such that it constitutes a particle-for-particle duplicate of the actual universe. Such a universe would presumably be perceptually identical to the actual universe. If we take multilocation as possible, we are thus presented with two accounts between which our perceptual evidence cannot adjudicate: one wherein the universe (...) is constituted by many particles and another wherein it is constituted by one radically multilocated particle. Parsimony concerns dictate that the latter is the more rational to accept. Since this is absurd, we should reject that multilocation is possible. Mooney responds to the problem by arguing that distinct location is evidence of non-identity, even if acceptance of the possibility of multilocation entails that this evidence is not decisive. If this is right, then the evidence favors a theory featuring many particles. In this paper, I contend that our commitment to taking distinct location as evidence of nonidentity is motivated by a more fundamental intuition that does not apply in the relevant context. (shrink)

Our research and that of others have raised doubts about the commonly accepted definition of approach motivation, which views it as a positive affective state triggered by positive stimuli. We review evidence that suggests: (a) that approach motivation is occasionally evoked by negative stimuli; (b) that approach motivation may be experienced as a negative state; and (c) that stimuli are unnecessary (...) to evoke approach motivation. Many philosophers of science follow Hempel in embracing both substantive and methodological anti-psychologism regarding the study of explanation. The former thesis denies that explanations are constituted by psychological events, and the latter denies that psychological research can contribute much to the philosophical investigation of the nature of explanation. Substantive anti-psychologism is commonly defended by citing cases, such as hyper-complex descriptions or vast computer simulations, which are reputedly generally agreed to constitute explanations but which defy human comprehension and, as a result, (...) fail to engender any relevant psychological events. It is commonly held that the truth of the substantive thesis would lend support to the methodological thesis. However, the standard argument for the substantive thesis presumes that philosophers’ own judgments about the aforementioned cases issues from mastery of the lay or scientific norms regarding the use of ‘explanation.’ Here we challenge this presumption with a series of experiments indicating that both lay and scientific populations require of explanations that they actually render their targets intelligible. This research not only undermines a standard line of argument for substantive anti-psychologism, it demonstrates the utility of psychological research methods for answering meta-questions about the norms regarding the use of ‘explanation.’. An emerging trend in cognitive science is to explore central epistemological questions using psychological methods. Early work in this growing area of research has revealed that epistemologists’ theories of knowledge diverge in various ways from the ways in which ordinary people think of knowledge. Reflecting the practices of epistemology as a whole, the vast majority of these studies have focused on the concept of propositional knowledge, or knowledge-that. Many philosophers, however, have argued that knowing how to do something is importantly (...) different from knowing that something is the case. Hence, in this paper we turn our attention to people’s concept of knowledge-how. We present data from two experiments that employed a sentence recognition task as an implicit measure of conceptual activation. The data from this implicit measure suggest that, contrary to prominent intellectualist theories of know-how, according to which know-how is a species of propositional knowledge, people’s concept of know-how more closely aligns with anti-intellectualism, the view that knowing how to perform some task consists in having the appropriate skills or abilities. Over twenty years of research have examined the cognitive consequences of positive affect states, and suggested that positive affect leads to a broadening of cognition (see review by Fredrickson, 2001). However, this research has primarily examined positive affect that is low in approach motivational intensity (e.g., contentment). More recently, we have systematically examined positive affect that varies in approach motivational intensity, and found that positive affect high in approach motivation (e.g., desire) narrows cognition, whereas positive affect low in approach motivation (...) broadens cognition (e.g., Gable & Harmon-Jones, Citation2008a; Harmon-Jones & Gable, 2009). In this article we will review past models and present a motivational dimension model of affect that expands understanding of how affective states influence attentional and cognitive breadth. We then review research that has varied the motivational intensity of positive and negative affect and found that affect of low motivational intensity broadens cognitive processes, whereas affect of high motivational intensity narrows cognitive processes. The fundamental unit of assessment in the sociobiology debate is neither a field nor a theory, but a framework of group commitments. Recourse to the framework concept is motivated, in general, by post-Kuhnian philosophy of scientific change and, in particular, by the dispute between E. O. Wilson and R. C. Lewontin. The framework concept is explicated in terms of commitments about problems, domain, disciplinary relations, exemplars, and performance evaluations. One upshot is that debate over such charges as genetic determinism, reductionism, (...) adaptationism, and the biologization of human nature has been vexed. It has lost sight of human sociobiology's central problem, namely to help show that the modern synthesis is complete. (shrink)

A set of constraints forces trade-offs which prevent us from achieving the best possible definitions of the ‘level’ and ‘unit’ of natural selection. This set consists in decisions concerning conflicting pre-analytic intuitions in problematic cases, the relative roles of various conceptual resources in the definitions, which facts need to be accounted for using the definitions, how the relation between selection and evolution orients the definitions, and the relation between the level and unit concepts. Systematic reconstruction and evaluation of leading analyses (...) along these dimensions favors a new functional analysis over Williams’ consequentialist analysis, Sober’s causal analysis, and Dawkins’ teleological analysis. The term 'sociobiology' was introduced in E. O. Wilson's Sociobiology: The New Synthesis (1975) as the application of evolutionary theory to social behavior. Sociobiologists claim that many social behaviors have been shaped by natural selection for reproductive success, and they attempt to reconstruct the evolutionary histories of particular behaviors or behavioral strategies. This survey attempts to clarify and evaluate the aim of sociobiology. Given that a neutral account is impossible, this entry does the next best thing. It takes sociobiology as (...) well as its critics seriously. On the one hand, by demonstrating that current studies of evolution and human behavior are based on Darwin's arguments for evolution (properly updated), we gain a strong rationale for thinking that something closer to sociobiology than to disconnectionism is needed to properly understand human sociality. Nevertheless, this survey reconstructs sociobiology in its best light, according to its aims. Consequently, criticism of sociobiology as it is actually practiced is not ignored or dismissed. This approach reveals what is best about sociobiology, while remaining sensitive to many of the problems it has generated. (shrink)

The present research was designed to test whether the subjective experience of more effort related to more reward valuation as measured by a neural response. This prediction was derived from the theory of cognitive dissonance and its effort justification paradigm. Young adult participants (n = 82) engaged in multiple trails of a low or high effort task that resulted in a loss or reward on each trial. Neural responses to the reward (loss) cue were measured using EEG, so that the (...) event-related potential known as the Reward Positivity (RewP) could be assessed. Results revealed no significant differences between low and high effort conditions on the RewP. However, within the high effort condition, a more subjective experience of effort was associated with a larger RewP. This research extends past research on the effort justification paradigm of cognitive dissonance theory by suggesting that effort justification is associated with an implicit measure of reward valuation. It therefore challenges recent perspectives on dissonance processes that posit that these evaluative changes should only occur on explicit but not implicit measures. (shrink)

ABSTRACTGiven its intimate relationship with the human body and its environment, biotechnology innovation, and more particularly stem cell research innovations as a part thereof, implicate diverse social and moral/ethical issues. This paper explores some of the most important and controversial moral concerns raised by human embryonic stem cell research , focusing on concerns relating to the wellbeing of the embryo and the wellbeing of society . It then considers how and whether these concerns are dealt with in regulatory instruments in (...) Argentina, a southern developing country, examining in particular whether the values underlying these concerns have been translated into practical and effective rules reflective of the primary moral positions advanced. It concludes that Argentina's current state of stem cell research governance fails to consistently reflect the moral positions that have formed and is inadequate given Argentina's activity in this field. In The Adapted Mind (1992), Cosmides and Tooby argue for the thesis that biological evolution endowed the human mind with a system of content‐specific computational mechanisms designed to solve long‐standing adaptive problems humans encountered as hunter‐gatherers, and not just a generalized "capacity for culture" or all‐purpose "learning capacity". I analyze three types of arguments they offer: historical arguments for the rise of content‐Specific psychology; programmatic arguments for the aims, theory, concepts, and methods of their evolutionary approach; and experimental arguments for (...) the content‐dependence of reasoning. Critics of evolutionary psychology object that it is not rigorous science compared to other evolutionary science. Advocates reply that it is rigorous science, and that the critics are uninformed. Still, informed people having opposing preconceptions of what counts as rigor may reach opposing evaluative conclusions. I shall clarify the very idea of rigorous evolutionary histories in relation to the basic objection that “evolution without history” is not rigorous.
