The wishes of registered organ donors are regularly set aside when family members object to donation. This genuine overruling of the wishes of the deceased raises difficult ethical questions. A successful argument for providing the family with a veto must (a) provide reason to disregard the wishes of the dead, and (b) establish why the family should be allowed to decide. One branch of justification seeks to reconcile the family veto with important ideas about (...) respecting property rights, preserving autonomy, and preventing harm. These arguments are ultimately unsuccessful. Another branch of arguments is consequentialist, pointing out the negative consequences of removing the veto. Whether construed as concerning family distress or as a potential drop in the organs available, these arguments are unsuccessful; the first fails to recognize the tremendous distress associated with waiting for an organ, while the second has little supporting evidence. A final section considers and rejects whether combining some of the arguments just examined could justify the family veto. We should thus remove the family veto in organ donation. (shrink)

A number of bioethicists have been critical of the power of the family to “veto” a patient’s decision to posthumously donate her organs within opt-in systems of organ procurement. One major objection directed at the family veto is that when families veto the decision of their deceased family member, they do something wrong by violating or failing to respect the autonomy of that deceased family member. The goal of this paper is to make (...) progress on answering this objection. I do this in two stages. First, I argue that the most plausible interpretation of what happens when a person registers as an organ donor in an opt-in system is that she gives her consent to the state to posthumously remove her organs for transplantation purposes. Call this the Authorization Account. Second, given the Authorization Account, I argue by analogy that when families veto an individual’s decision to donate and the individual’s organs are not in the end removed, neither the doctors nor the family violate the individual’s autonomy in any morally objectionable sense. Call this the Nonremoval Thesis. I argue that since the Nonremoval Thesis is true, we do not violate or fail to respect the autonomy of registered donors when we fail to remove their organs because their family has objected. This article tackles the current deficit in the supply of cadaveric organs by addressing the family veto in organ donation. The authors believe that the family veto matters—ethically as well as practically—and that policies that completely disregard the views of the family in this decision are likely to be counterproductive. Instead, this paper proposes to engage directly with the most important reasons why families often object to the removal of the organs of a loved one (...) who has signed up to the donor registry—notably a failure to understand fully and deliberate on the information and a reluctance to deal with this sort of decision at an emotionally distressing time. To accommodate these concerns it is proposed to separate radically the process of information, deliberation and agreement about the harvesting of a potential donor's organs from the event of death and bereavement through a scheme of advance commitment. This paper briefly sets out the proposal and discusses in some detail its design as well as what is believed to be the main advantages compared with the leading alternatives. (shrink)

Many people move house at some point during their childhood and not rarely more than once. While relocations are not always harmful for under-aged children, they can, and frequently do, cause great disruption to their lives by severing their social ties as well as any attachments that they might have to their neighbourhood, town, or wider geographical region, with long-lasting psychological effects in some cases. Since it is increasingly recognised within normative philosophy as well as within Western societies that older (...) minors should have the final say over certain issues that significantly affect their lives (think, for instance, of custody disputes, decisions about whether to get specific vaccinations or use contraceptives), this raises the question: Can it be morally incumbent upon parents to give their minor children a veto over family relocation? This article argues that the answer is affirmative. Specifically, it suggests that such duties exist if and only if (i) parents are not morally required to either relocate their families or stay put, (ii) the stakes of the decision about a family relocation are fairly low, and (iii) the children have the competence to make these decisions, as many older minors do. This article highlights the often overlooked fact that doctors who respect a bereaved family's veto of a deceased patient's organ donation are complicit in the deaths of those who would have benefited from the organs in question. Respecting the veto violates the dying wish of the patient, is against the spirit of the law and contributes to the deaths of other patients.

Wilkinson’s discussion of the individual and family consent to organ and tissue donation is to be welcomed because it draws attention to the “incoherent hybrid” of the current position.1 I wish to highlight some areas of his discussion and propose that, in a situation of posthumous organ and tissue donation, the cadaver has no individual rights and family rights should under no circumstances automatically outweigh the potential transplant recipients’ right to a life-saving treatment.Transplant immunobiology and clinical transplantation is (...) a revolutionary area of medicine and has saved thousands of lives. In the UK, between 1 April 2004 and 31 March 2005, organs from 752 people who died were used to save or dramatically improve many people’s lives through 2242 transplants.2 In the US, 23 506 transplants were performed between January and October 2005 from 12 084 donors.3 Information from available databases shows that demand for organs, cells and tissues has outstripped the supply. As of 18 January 2006, 6553 people are still waiting for transplants in the UK and there are 90 636 waiting list transplant candidates in the US.2,3 As of 01 January 2006, there are 15 977 people active on the Eurotransplant waiting list.4 It is likely that non-compulsory posthumous donation of organs has resulted in the loss of many thousands, possibly many …. The ethics of deceased organ procurement (OP) is supposedly based on individual consent to donate, either explicit (opt-in) or presumed (opt-out). However, in many cases, individuals fail to express any preference regarding donation after death. When this happens, the decision to remove or not to remove their organs depends on the policy’s default option or on family preferences. Several studies show that in most countries the family plays a significant and often decisive role in the process of decision-making (...) for OP. Depending on the country, the family may be allowed to take different kinds of actions in different situations, and this may be granted either by law or by clinical practice only. This adds much complexity to the usual classification of consent policies in two categories: opt-in and opt-out. Here we propose a novel and comprehensive taxonomy of the models of consent for OP according to three variables: (1) the deceased’s wishes, if any, (2) family wishes, if any, and (3) default policies. By analysing these models of consent, we show that they rely on at least three different concepts of autonomy: individual autonomy, relational autonomy, and family autonomy. In light of this analysis, we discuss the ethical debates surrounding two policy approaches: presumed consent and family veto. (shrink)

abstract This paper examines, from a philosophical point of view, the ethics of the role of the family and the deceased in decisions about organ retrieval. The paper asks: Who, out of the individual and the family, should have the ultimate power to donate or withhold organs? On the side of respecting the wishes of the deceased individual, the paper considers and rejects arguments by analogy with bequest and from posthumous bodily integrity. It develops an argument for posthumous (...) autonomy based on the liberal idea of self‐development and argues that this establishes a right of veto over donation. It claims, however, that whether the family's power to veto would conflict with posthumous autonomy rights depends on how it comes about. On the side of respecting the family's wishes, the paper first considers an argument from family distress. This supports a contingent, non‐rights‐based reason for the family's power that is trumped by the deceased's rights. It then outlines and criticises an argument based on family autonomy. The conclusion is that the individual has the right to veto the family's wish to donate and that, while the family has no right to veto the individual's wishes to donate, it can legitimately acquire this power and has done so in practice. The current position on the deceased’s consent and the family’s consent to organ and tissue donation from the dead is a double veto—each has the power to withhold and override the other’s desire to donate. This paper raises, and to some extent answers, questions about the coherence of the double veto. It can be coherently defended in two ways: if it has the best effects and if the deceased has only negative rights of veto. Whether the (...) double veto has better effects than other policies requires empirical investigation, which is not undertaken here. As for rights, the paper shows that it is entirely possible that individuals have a negative right of veto but no positive right to compel acceptance of their offers. Thus if intensivists and transplant teams turn down the deceased’s offer, they do not thereby violate the deceased’s right. This leaves it open whether non-rights based reasons—such as avoiding bad publicity or distress —require intensivists and transplant teams to turn down or accept the deceased’s offer. This, however, is beyond the scope of this paper. The current position may or may not be wrong, but it is at least coherent. (shrink)

The annual UK potential donor audit captures families’ reasons for not consenting to donation of their deceased family members’ organs . Given that many families’ refusals and vetoes are based on false beliefs, cognitive bias and misunderstanding, it is incumbent upon doctors, nurses and transplant coordinators to invest sufficient time to facilitate informed consent or authorization. While such families are distressed, organ donation rates could be substantially improved if they were made aware of any mistaken beliefs, using recently suggested (...) criteria for the ethical use of persuasion . This article examines some of the reasons for refusal of donation and suggests ways to help families make better decisions. It emerges that the use of persuasion is ethically essential in order to prevent families making decisions that they may come to regret. (shrink)

The Western focus on personal autonomy as the normative basis for securing persons’ consent to their treatment renders this autonomy-based approach to informed consent vulnerable to the charge that it is based on an overly atomistic understanding of the person. This leads to a puzzle: how does this generally-accepted atomistic understanding of the person fits with the emphasis on familial consent that occurs when family members are provided with the opportunity to veto a prospective donor’s wish to donate (...) after she has died and her organs are being considered for harvesting? It is argued in this paper that this charge can be met and this puzzle dissolved once it is recognized that autonomy is an inherently social concept. (shrink)

This paper starts by discussing Alan Brudner's overall project: the project of inclusivity. It argues that the idea of inclusivity is problematic both conceptually and normatively, for three reasons. First, it is not clear that Brudner's aim to provide a unified theory of the liberal constitution is either possible or desirable. Second, Brudner assumes but does not adequately demonstrate the need for public justification of the liberal constitution. Third, Brudner does not sufficiently explain who should have a veto over (...) his final theory. The paper then turns to Brudner's analysis of sex and family, and argues that his position on these matters is one that liberals would reject. In the case of marriage, Brudner’s conclusions may be compatible with liberalism but the arguments supporting them are not. In the case of abortion, neither argument nor policy is compatible with liberalism. Either his position requires that we attribute differential status to human persons, in direct contravention of the fundamental equality of moral worth that liberalism accords to all individuals. Or it requires that we override the rights of individuals by asserting that their own self-authorship is less important to them than a symbol of their personal relationship, a judgment that profoundly undermines individual autonomy. Simone Weil is one of the major religious writers of the twentieth century. Hers is a unique blend of spiritual experience, social concern, and philosophical theory. She had marvelous command of the Western philosophical tradition, yet she also had profound insights into Oriental philosophies. Since its publication in France, Veto's book has been considered by most scholars as the standard work on Simone Weil. Now this important book is available in English. It is the only available reconstruction of the (...) entire philosophy of Simone Weil. It operates out of the perspective of the spiritual concerns of her maturity, yet it never fails to return to the issues and the positions of the early texts. It carries out the reconstruction according to some major philosophical themes, but gives its due share to the French thinkers' social and political preoccupations as well. The book is erudite, yet simple, written in a clear, concise and yet often eloquent language. (shrink)

Mais c'est avec Hegel et Schelling que l'idéalisme postkantien se donne la tâche de ressourcer la dogmatique chrétienne à partir d'une ontothéologie spéculative. Hegel laisse d'admirables Leçons sur la philosophie de la religion, Schelling (...) construira sa Philosophie Positive à partir des " données " de la mythologie et de la révélation. Ce recueil, issu des travaux d'un colloque au Centre de Recherches sur Hegel et l'Idéalisme allemand de l'Université de Poitiers, rassemble des textes d'auteurs belges, français, allemands, italiens, libanais, luxembourgeois et américains. Ils traitent aussi bien des grands idéalistes que de leurs prédécesseurs essentiels. P. Valenza étudie Jacobi et Reinhold, J. Lambinet parcourt la voie qui va de Paracelse et de Boehme à Schelling. This article deals with the relationship between the creator of psychoanalysis, Sigmund Freud, and the Latvian-born Chilean professor of physiology – and endocrinologist and anthropologist – Alejandro (or Alexander) Lipschütz. Up till now, the historiography of psychoanalysis in Chile has ignored the existence of this relationship, that is to say, the fact that there exists an interesting exchange of correspondence as well as references to Lipschütz in some important works published by Freud and in Freud’s correspondence with the Hungarian psychoanalyst (...) Sándor Ferenczi. There are also references to works on psychoanalysis carried out by Lipschütz in Chile. The Freud–Lipschütz relationship allows us to examine two interesting topics in contemporary historiographical approaches to psychoanalysis. First, it permits us to reflect on the connections that Freud and Ferenczi sought to establish between psychoanalysis and biology (endocrinology in particular) as a strategy to address criticism of the scientific foundations of psychoanalysis and, therefore, to help legitimize psychoanalysis in the field of science. Second, the relationship between Freud, working in a culturally influential city such as Vienna, and Lipschütz, working in a ‘peripheral’ country such as Chile, paves the way to reflect on the consequences of a history of psychoanalysis written from the perspective of the ‘margins’. This is a history that focuses not on regions where early industrialization and modernization processes, along with an important academic and scientific tradition, help explain the interest in and reception of psychoanalysis, but on regions where different sets of conditions have to be examined to explain appropriation and dissemination processes. And the second Schelling brings the notion back into philosophical theology via the manifestation of God affirming his personality by renouncing his own being in favour of the being of the world. Gabriel Marcel a été l'un des plus grands penseurs du XXe siècle. Antérieurement et parallèlement à la Phénoménologie, il a élaboré une philosophie concrète où il traite avec une grande rigueur conceptuelle des notions que la métaphysique de l'Occident n'a pas su ou voulu thématiser. Opposant être et avoir, problème et mystère, dénonçant les erreurs et les travers de l'objectivation, il pense et repense, grâce à une seconde réflexion, la philosophie morale aussi bien que l'univers de l'intersubjectivité. Il soumet à (...) un nouvel éclairage la fidélité, la trahison, le don. Il analyse avec profondeur la famille, le mariage, la paternité. Contre l'arrière-fond des totalitarismes de son temps, il énonce inlassablement la pertinence et la validité des vertus de l'individu. Penseur chrétien, il présente des méditations d'une nouveauté inentamée sur la foi, sur l'immortalité, sur Dieu comme le Toi absolu. Dans les quatre décennies qui ont suivi sa disparition, la grande figure de Gabriel Marcel a subi une éclipse, voire un quasi-oubli. Or tout récemment, cette pensée riche et profonde recommence à attirer. Après l'édition d'une partie de sa correspondance, la parution des actes d'un colloque et d'un important recueil d'études sur sa philosophie, le livre de Miklos Vetö se veut une introduction systématique aux thèmes majeurs de ce socratisme chrétien. Dans l’Introduction de son édition critique des Conférences de Stuttgart (2è édition, 2009), Miklos Vëto présente les sources et les grands thèmes de l’écrit schellingien. Il explique ici que les germes et les prémisses de la Spätphilosophie sont déjà contenus dans les Conférences. Ces leçons ont surtout été étudiées comme un exposé par excellence de l’anthropologie schellingienne. Or on peut montrer qu’elles sont aussi un moment privilégié du cheminement de Schelling vers la monstration de la transcendance de Dieu.

The culmination of a lifetime’s preoccupation with crucial human concerns too often curiously marginalized by the history of philosophy, The Expansion of Metaphysics sheds new light on freedom and the will by making the phenomenon of novelty philosophically intelligible. On représente traditionnellement l'idéalisme allemand comme le déploiement en ligne droite d'une pensée. L'apriorisme de la Critique, repensé par Fichte, élargi sur les univers de la nature et de l'art par le jeune Schelling, trouve son accomplissement dans l'Encyclopédie de Hegel. Selon une autre vision, minoritaire, la conclusion de l'idéalisme allemand est à chercher dans la remise en question de l'ontologique hégélienne par le second Schelling. Cette opposition peut et doit être dépassée. L'œuvre de Kant qui est à l'origine de (...) cette spéculation contient les ressorts et légitime les développements des deux voies. De la première qui, à travers l'instauration fichtéenne d'une métaphysique de la subjectivité aboutit à la souveraineté de la raison hégélienne, savoir du particulier, du concret, philosophie de l'histoire. De la seconde qui, pensant l'existence, la finitude, le mal redécouvre la transcendance et comprend la nécessaire fondation de la Raison par son autre. Le premier tome de cette réinterprétation intégrale de l'idéalisme allemand traitait surtout de Kant et de l'essentiel de la Doctrine de la Science fichtéenne. Le second tome est consacré à Hegel et, après un excursus sur Boehme et l'étude du second Fichte, à Schelling. Le système hégélien est déployé comme une logique des contenus, aboutissant d'abord à la philosophie de l'histoire, ensuite au Savoir Absolu. Quant aux philosophies intermédiaires et tardives de Schelling, elles naissent avec la doctrine du Fondement pour s'accomplir dans le Savoir Positif. Celui-ci pense la Mythologie et la Révélation, déduit l'Essence de l'Existence, retrouve Dieu à partir de la Factualité Primordiale. Complétant son parcours dans l'Encyclopédie hégélienne et les philosophies négative et positive de Schelling, l'idéalisme allemand apparaît comme l'une des plus hautes expressions de la métaphysique occidentale. Le présent volume rassemble des études consacrées à la philosophie contemporaine. Cette philosophie est née comme réaction et réponse aux positivismes et aux scientismes, mais également aux mises en question du Système et de l'Universel par Nietzsche. Dans l'aire anglo-américaine, elle est surtout représentée par la pensée du Procès, dans l'aire 'continentale' par la Phénoménologie. Elle re-pense à nouveaux frais des thèmes pérennes de la métaphysique comme le temps et l'espace, le bien et le mal, l'individu, l'amour, Dieu. Les auteurs (...) dont traitent les textes de ce recueil ont été souvent en rapport, au moins conceptuel, les uns avec les autres, mais certains d'entre eux sont isolés, paraissent comme des météorites. A. Whitehead, H. Bergson, M. Heidegger, G. Marcel, L. Gondos-Grünhut, H. Arendt, S. Weil, M. Merleau-Ponty, J.-L. Marion sont des penseurs originaux, profonds, même si tous ne sont pas bien connus ou reconnus. L'historiographie philosophique peut ne pas leur attribuer une importance égale, mais précisément, ce volume n'a pas l'ambition de présenter même une ébauche d'histoire de la philosophie contemporaine. Il se veut et il n'est effectivement qu'un ensemble d'éclats, il ne dévoile qu'un paysage de lumières non-coordonnées entre elles. (shrink)

Sans doute, la Wissenschaftslehre de 1813 restée fragment contient maintes formulations percutantes, auparavant inconnues et les Tatsachen des Bewußtseins de 1813 présentent selon un autre (...) ordre -- et d'une manière bien plus agréable, plus lisible -- la plupart des grands thèmes du cours de 1812. Toutefois, ce texte demeure l'ultime formulation autorisée de l'idéalisme fichtéen, un ouvrage de grande maturité, qui expose avec fermeté et brio le processus du savoir transcendantal. Ici aussi le philosophe dit et redit avoir accédé à une clarté jusqu'alors inconnue dans l'exposé, mais en ce qui concerne le sujet de cet exposé, il reste le même. Fichte croit dire la même chose depuis 1794 même s'il pense le dire mieux chaque année. Or l'historiographie reste plus que sceptique à l'égard des prétentions de l'auteur et elle ne voudrait pas lui concéder la continuité des thèmes et des thèses à travers le fil des ans. On lui reproche une espèce de rupture avec le projet transcendantal de ses commencements, on le prend pour le représentant d'un idéalisme théiste, d'une mystique spéculative.
