This paper argues that social media companies’ power to regulate communication in the public sphere illustrates a novel type of domination. The idea is that, since social media companies can partially dictate the terms of citizens’ political participation in the public sphere, they can arbitrarily interfere with the choices individuals make qua citizens. I contend that social media companies dominate citizens in two different ways. First, I focus on the cases in which social media companies exercise direct control over political (...) speech. They exercise quasi-public power over citizens because their regulation of speech on social media platforms implies the capacity to arbitrarily interfere with citizens’ democratic contestation in the political system. Second, companies’ algorithmic governance entails the capacity to interfere with citizens’ choices about what mode of discursive engagement they endorse in their relationships with fellow citizens. By raising the cost of deliberative engagement, companies narrow citizens’ choice menu. (shrink)

Contemporary global politics poses urgent challenges – from humanitarian, migratory and environmental problems to economic, religious and military conflicts – that strain not only existing political systems and resources, but also the frameworks and concepts of political thinking. The standard cosmopolitan response is to invoke a sense of global community, governed by such principles as human rights or humanitarianism, free or fair trade, global equality, multiculturalism, or extra-national democracy. Yet, the contours, grounds and implications of such a global community (...) remain notoriously controversial, and it risks abstracting precisely from the particular and conflictual character of the challenges which global politics poses. The contributions to this collection undertake to develop a more fruitful cosmopolitan response to global political challenges, one that roots cosmopolitanism in the particularity and conflict of global politics itself. They argue that this ‘contestatory’ cosmopolitanism must be dialectical, agonistic and democratic: that is, its concepts and principles must be developed immanently and critically out of prevailing normative resources; they must reflect and acknowledge their antagonistic roots; and they must be the result of participatory and self-determining publics. In elaborating this alternative, the contributions also return to neglected cosmopolitan theorists like Hegel, Adorno, Arendt, Camus, Derrida, and Mouffe, and reconsider mainstream figures such as Kant and Habermas. Discourse between pupils represents a core element of citizenship education in England. However, as it is currently presented within the curriculum, discourse adopts the form of the rather broad terms of 'discussion' and 'debate'. These terms are diffuse, and in themselves offer little pedagogical guidance for teachers implementing the curriculum in schools. Moreover, there has been little academic reflection in England as to how theoretical ideas on civic dialogue may usefully inform approaches to pupil discourse. For this reason, how pupils (...) experience discursive learning activities is likely to depend on how individual schools and teachers understand the terms 'discussion' and 'debate' and the way in which this understanding is translated into pupil learning activities. This article explores how recourse to deliberative democratic theory, and in particular to the principle of contestatory deliberative democracy found within recent republican writing, may be useful in helping educators to consider critically the capacities needed for effective civic discourse as a well as the outcomes of pupils' dialogical engagement. The classical model of democracy that Schumpeter criticizes is manufactured out of a variety of earlier ideas, not those of any one thinker or even one school of thought. His critique of the central ideals by which he defines the model--those of the common will and the common good--remains persuasive. People's preferences are too messy and too manipulable to allow us to think that mass democracy can promote those ideals, as he defines them. Should we endorse his purely (...) electoral model of democracy then, and accept that people do not exercise any control over government? Not necessarily. We can expand democracy to include the constitutional and contestatory constraints that people impose on their rulers. We may hope that people can rely on such democratic controls to ensure that government operates by community standards. (shrink)

This article investigates the relationship between popular sovereignty, populism, and deliberative democracy. My main thesis is that populisms resurrect the polemical dimension of popular sovereignty by turning “the people” against the “powerbloc” or the “elite”, and that it is crucial thatthis terrain not be ceded to authoritarian distortions of this basic contestatory grammar. Furthermore, I contend that populist forms of politics are compatible with a procedural and deliberative conception of democracy. Ifirst engage with the assumption that populism (...) and a procedural model of democracy are incompatible, demonstrating that this assumption relies on a conservative bias which tiesthe exercising of communicative power to a “duty of civility”. I then engage with radical-democratic reconstructions of the procedural notion of popular sovereignty which emphasize the unleashing and diversification of peoplehood in communication circuits and the mutual permeability of constitutional politics, parliamentary legislation, and the public sphere. Thirdly, I conclude that populisms are an essential part of communicative power in modern democracies and part of its dialectical structure. (shrink)

ABSTRACT For several decades now, a steady flow of scholarly contributions from both intellectual history and political theory has been reasserting Benjamin Constant as a theorist of liberal democracy. Constant’s visionary understanding of liberal democracy is usually conflated with his understanding of limited popular sovereignty. In this article, I reconstruct Constant’s positive conception of popular sovereignty, i.e. his conception of what popular sovereignty means within its limits and take it as the starting point of an analysis of Constant’s (...) understanding of democracy. I argue that Constant’s understanding of popular sovereignty as ‘the assent of all’ leads to a distinction between ‘governmental authority’ and ‘sovereign power’. The latter is exercised by the individual members of the political community and has features that align with contemporary aggregative and contestatory approaches to democracy. Even though according to this analysis, Constant’s conception of democracy allows for both pluralism and dynamism, those are operative against the background of a more fundamental conservatism: Constant’s understanding of sovereign power is predicated on an institutional status quo. If democracy is to be understood as government by and for the people, popular judgment has to be competent : decision-making procedures need to be both inclusive and effective. In this paper I consider a condition for the competence of the people : the existence of a public sphere propitious to the public contestation of political decisions. By comparing the contestatory (Pettit) and epistemic (Cohen, Estlund) models of democracy, I first show that contestability can only ground democratic (...) legitimacy if popular contestation operates partly via the public sphere. I then claim that that it is unrealistic to expect that the actions of media agents will spontaneously produce an appropriate deliberative context provided that freedom of expression and media pluralism are legally protected, as some suggest (Page). Finally, I conclude that the space for public contestation must be instituted, which implies that the regulatory resources offered by journalistic ethics, social criticism and media law should be exploited. In the intellectual confusion prevailing since the demise of Marxism and “marxism”, the attempt is made to define democracy as a matter of pure procedure, explicitly avoiding and condemning any reference to substantive objectives. It can easily be shown, however, that the idea of a purely procedural “democracy” is incoherent and self-contradictory. No legal system whatsoever and no government can exist in the absence of substantive conditions which cannot be left to chance or to the workings of the (...) “market” but must be posited as objectives of political activity. The confusion results from a deficient understanding of what makes a society and an empty idea of “freedom”. The objective of politics is not happiness, an affair to be left to the individuals, but it certainly is liberty understood as participation in the governance of the polity; it is also the pursuit of the common good, defined as the sum of the prerequisites and facilitations of individual autonomy depending on collective action, and as the realization of commonly agreed collective goals. The republican ideal of non-domination identifies the capacity for arbitrary interference as a fundamental threat to liberty that can generate fearful uncertainty and servility in those dominated. I argue that republican accounts of domination can provide a powerful analysis of the nature of legal and institutional power that is encountered by people with mental disorders or cognitive disabilities. In doing so, I demonstrate that non-domination is an ideal which is pertinent, distinctive, and desirable in thinking through psychological disability. According to some democratic theorists, these counter-majoritarian institutions enjoy democratic legitimacy because they allow the contestation of ill-devised or unjust collective decisions, and hence contribute to the global improvement of democratic results. Based on a reading of Philip Pettit’s work on contestatory democracy and of David Estlund’s epistemic approach, the paper questions the democratic nature of these institutional forms of contestation and shows that, as long as they are not subjected to tighter democratic control, these institutions can be interpreted as ways of contesting democracy rather than as implements for its improvement. This essay aims to show that republicanism does not necessarily preclude the notion of cosmopolitan citizenship. The first part challenges the belief that republican citizenship must be tied to a nationalist reading, therefore reducing its cosmopolitan extension to a mere metaphor. Having argued that the political attributes and philosophical account of the notion of citizenship evolve according to the historical transformation of political communities, our contemporary era renders the notion of cosmopolitan citizenship plausible. Far from being irreconcilable, liberal cosmopolitanism has (...) much to gain from republicanism since a thorough analysis of globalization reveals the limitations of the traditional liberal understanding of electoral and representative democracy. The second part of this article suggests that the republican theory of contestatory democracy enables us to better define the political attributes of cosmopolitan citizenship within a liberal conceptual framework. This chapter develops a civic republican approach to disability justice. It begins by articulating a republican account of liberty as nondomination before showing how such domination can shape the relationships of people with disabilities. This leads to a consideration of whether disability justice can be defined in terms of maximizing or sufficient nondomination. Instead, the chapter provides a civic framework within which republican disability justice can be understood, encompassing both the absence of oppressive relationships and the presence of capabilities of (...) special egalitarian concern. It also considers some specific normative implications of a republican account of disability justice—doubting the suitability of contestatory democracy but pointing toward the merits of self-education and universal basic income. Finally, the objection that this republican approach to disability justice unreasonably denigrates dependence is rebutted. (shrink)

The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. ABSTRACTThis article studies multi-stakeholder initiatives as spaces for both deliberation and contestation between constituencies with competing discourses and disputed values, beliefs, and preferences. We review different theoretical perspectives on MSIs, which see them mainly as spaces to find solutions to market problems, as spaces of conflict and bargaining, or as spaces of consensus. In contrast, we build on a contestatory deliberative perspective, which gives equal value to both contestation and consensus. We identify four types of internal contestation which can (...) be present in MSIs—procedural, inclusiveness, epistemic, and ultimate-goal—and argue that embracing contestation and engaging in ongoing revision of provisional agreements, criteria, and goals can enhance the democratic quality of MSIs. Finally, we explore the implications of this perspective for theorizing about the democratic quality in MSIs and about the role of corporations in transnational governance. (shrink)

The article presents a plebeian strand of republican constitutional thought that recognises the influence of inequality on political power, embraces conflict as the effective cause of free government, and channels its anti-oligarchic energy through the constitutional structure. First it engages with two modern plebeian thinkers – Niccolò Machiavelli and Nicolas de Condorcet - focusing on the institutional role of the common people to resist oppression through ordinary and extraordinary political action. Then it discusses the work of two contemporary republican thinkers (...) – Philip Pettit and John McCormick – and contrasts their models of ‘contestatory’ and ‘tribunician’ democracy. Finally, I incorporate a political economy lens and propose as part of republican constitutionalism not only contestatory and tribunician institutions but also anti-oligarchic basic rules to keep inequality and corruption under control. Intrinsic and extrinsic bads of workplace hierarchies have been widely discussed in the literature on workplace democracy and workplace republicanism. However, a distinctively intrinsic relational bad, epistemic injustice in the workplace, has largely been neglected by both normative theorists of the workplace and theorists of epistemic injustice. This article, by bringing in the insights of Miranda Fricker’s influential conceptualization of epistemic injustice, argues (...) that hierarchical workplaces have contributed to and reinforced both testimonial and hermeneutical injustices in a central activity of most people’s daily lives. This article argues that these injustices are moral wrongs and thus moral injury to the workers. The article concludes by demonstrating that traditional hierarchy is the most epistemically unjust form of hierarchy, while contestatory hierarchy, because of its emphasis on granting the right to the workers to be listened, is less unjust epistemically. This paper reviews the contribution of Hannah Arendt's 1963 monograph, On Revolution, to the theme of this collection: “contestatory cosmopolitanism.” I am critical of normative interpretations of the text that treat it as a wholesale rejection of the French revolutionary tradition and as a tribute either to American constitutionalism, in more liberal readings, or to the council system of direct democracy, in more radical readings. I read it against this doctrinal grain as a dialectical analysis of the modern (...) revolutionary tradition as a whole. I argue that it is more productive for our own purposes and more faithful to Arendt's own approach to read the book as an exploration of the developmental forms of the modern revolutionary tradition, beginning with the “perplexities” present in the modern concept of revolution and then moving on to the more applied and practical “perplexities” involved in the realization of the concept: first in the French Revolution, then in the American Revolution and finally in.. W artykule proponuje się dyskusję z tezami Philipa Pettita zawartymi w książce On the People’s Terms: A Republican Theory and Model of Democracy i artykule „Two Republican Traditions”. Skupiając się na tzw. tradycji włosko-atlantyckiej, Pettit wskazywał na kluczowe dla republikanizmu powiązania etosów sprzeciwu obywatelskiego (contestatory citizenry) i ustroju mieszanego (mixed constitution). Nie jest przypadkiem, że do tak pojętej tradycji republikańskiej Pettit nie zaliczył Jeana-Jacques’a Rousseau, uznanego raczej za prekursora komunitaryzmu. Trudno się jednak zgodzić z prezentowaną przez Pettita klasyfikacją (...) tradycji republikańskiej i — zwłaszcza — jego odczytaniem myśli Rousseau. Przede wszystkim to właśnie ta myśl ukazuje najlepiej, że republikanizm, uosabiający wszak ideę rządów obywatelskich, mógł przyswoić wartości ustroju mieszanego jedynie w sposób doraźny i warunkowy — jedynie dopóty, dopóki sprzyjały one ograniczeniu nieobywatelskich (niewybieralnych) czynników władzy. Trudno też przyjąć tezę Pettita, że zapoczątkowana przez Rousseau teoria zwierzchnictwa ludu musi podważać ideały kultury czujności obywatelskiej. (shrink)

Democracy - hope or illusion? Blooming, failing or declining? Our doubts and hesitation make part of unbending efforts to endorse and explain democracy. Who is right - the custodians of promise or the prophets of decline? The book concentrates on doubts. The author tries to explore «the other side of the moon», emphasizing the role of critical thinking, opposing a main-current optimism. Defending democracy we want to generate hope, but hoping may be a dangerous craft. Protecting our (...) hope we are prone to believe that democracy - even if it is not a full success story - is justified in its nature and out of question. How much do we have to forget to sanction this view? This is, in fact, the main question the book raises. It gives voice to those who never, in their writing on democracy, used a flattering tone. Starting with Greek giants - Plato and Aristotle - up to modern and most recent times, going through a broad field of revealing criticism, leaving us with an unsettling feeling that democracy is rather something to be explained than something to be celebrated. Living in democracy, lamenting its underperformances, we must not overlook a fundamental question - in what part do our disappointments reflect the «art of forgetting», allowing us to cast into oblivion all serious doubts originating in a critical discourse on modernity and democracy? The early nineteenth century saw the demise of the Italian-Atlantic tradition of republicanism and the rise of classical liberalism. A distinct Franco-German tradition of republicanism emerged from the time of Jean-Jacques Rousseau and Immanuel Kant, which differs from the older way of thinking associated with neo-republicanism. This chapter examines the key differences between the Italian-Atlantic and Franco-German traditions of republicanism and places them in a historical context. It first considers classical republicanism and how the ideological ideal of equal freedom as (...) nondomination differs from the twin institutional ideals of a mixed constitution and a contestatory citizenry. It then looks at the classical liberal opposition that arose in response to Italian-Atlantic republicanism. It also discusses the views of Kant and Rousseau about freedom and the role of the citizenry, as well as their theory of the constitution. The absolutist opposition in Jean Bodin and Thomas Hobbes to the institutional ideals of republicanism is also explored. (shrink)
