Art militaire au départ, méthode de pensée pour l'action, elle apparaît de plus en plus indispensable dans notre monde moderne. Pourtant, le sens en a été oublié. Aujourd'hui, les décideurs - entrepreneurs, politiques, militaires - sont accaparés par le court terme et la tactique. Atteints (...) de myopie décisionnelle, ils éprouvent des difficultés grandissantes à prendre du recul. Ils ont perdu l'habitude et le goût de la stratégie, qu'ils pratiquent de moins en moins alors qu'elle seule peut apporter des réponses à la complexité du monde et à l'accélération du temps. Il faut entrer en stratégie, utiliser celle-ci pour modeler le présent et bâtir l'avenir. Le but de cet ouvrage est de faciliter cette démarche, de l'éclairer et de la démythifier. The United States Supreme Court has repeatedly insisted that what distinguishes a criminal punishment from a civil penalty is the presence of a punitive legislative intent. Legislative intent has this role, in part, because court and commentators alike conceive of the criminal law as the body of law that administers punishment; and punishment, in turn, is conceived of in intention-sensitive terms. I argue that this understanding of the distinction between civil penalties and criminal punishments depends on a highly controversial proposition (...) in moral theory – namely, that an agent’s intentions bear directly on what it is permissible for that agent to do, a view most closely associated with the doctrine of double effect. Therefore, legal theorists who are skeptical of granting intention this kind of significance owe us an alternative account of the distinctiveness of the criminal law. I sketch the broad outlines of just such an alternative account – one that focuses on the objective impact of legislation on a class of protected interests, regardless of the state’s motivations in enacting the legislation. In other words, even if the concept of punishment is unavoidably intention-sensitive, it does not follow that the boundaries of the criminal law are likewise intention-sensitive, because the boundaries of the criminal law may be drawn without reference to the concept of punishment. I conclude by illustrating the application of this view to a pair of well-known cases, and noting some of its ramifications. (shrink)

Anglo-American criminal law traditionally demands a criminal purpose for an attempt conviction, even when the crime attempted requires only foresight or recklessness. Some legal philosophers have defended this rule by appeal to an alleged difference in the moral character or intentional structure of intended versus non-intended harms. I argue that there are reasons to be skeptical of any such differences; and that even if conceded, it is only on the basis of an unworkable view of criminal responsibility that such a (...) distinction would support a rule restricting attempts to criminal purpose. I defend instead the continuity thesis, according to which attempts are functionally continuous with endangerment offenses: both are legal efforts to regulate unreasonably dangerous conduct. The upshot of the continuity thesis is that there is little substantive difference between attempt and endangerment in principle, no matter how they are labeled in law. (shrink)

For Thomas Aquinas, the creator of natural law is a personal, substantial, and relational God. For Laozi, it is an impersonal, non-substantial, self-manifesting dao. There are similarities, and this article will consider several of them. For Thomas, the act of creation comes from God, and for Laozi the giving birth of the universe is from the dao’s unconditional generosity. Thus it is possible to compare the way in which the world-originating generosity of God generates the moral law and the way (...) in which the self-manifesting dao generates the moral law. In Thomas’s view the natural law is the rational participation of the human being in God’s eternal law. Laozi’s heavenly dao governs all things in the universe, and for this reason human beings and their techniques should comply with dao. Thomas emphasizes human freedom of will and the responsibility to pursue what is good and to avoid what is evil. Laozi emphasizes the objectivity of heavenly dao without any reference to human freedom of will or individual responsibility. With religious Daoism there develops the idea of collective responsibility and the divinization of dao, a point that invites further comparative study of Thomism and Daoism. (shrink)

The Conversation that Descartes had with Burman on April 16, 1648 sheds light on the meaning of the phrase ens reale, which was common in modern scholastic treatises but unusual under his pen, and thus on the Cartesian concept of realitas. Ens verum et reale, such is the object of mathematics: no less real than that of physics, even if it does not exist out of the mind and requires imagination. As for the object of metaphysics, if it is no (...) less real than that of physics and mathematics, it is both existent and unimaginable. The answers given by Descartes that are examined here are significant samples which in addition show the need to re-edit the Conversation in the light of Clauberg's Opera. (shrink)

A parieto-frontal integration theory (P-FIT) model of human intelligence has been proposed based on a review of neuroimaging literature and lesion studies. The P-FIT model provides an important basis for future research. Future studies involving connectivity analyses and an integrative approach of imaging modalities using the P-FIT model should provide vastly increased understanding of the biological bases of intelligence.

Lorsqu’elle apparaît au milieu du XVIIe siècle, l’expression « le moi » vise-t-elle un phénomène nouveau ou son sens est-il réductible aux concepts anciens que sont l’âme, l’esprit, le sujet, l’individu, la personne, etc.? Si les faits de la langue philosophique sont gouvernés par des décisions philosophiques, le moi doit se distinguer de ces concepts. Notre hypothèse est que le rapport ambivalent que le Dasein entretient avec l’ego cartésien peut nous éclairer sur cette distinction. D’une part, en effet, l’ego n’est (...) pas le Dasein, en ce que, se pensant lui-même selon la Vorhandenheit, il reste aveugle au phénomène du monde : de ce point de vue l’ego n’est, dans l’histoire de l’ontologie, qu’un exemple parmi d’autres, tous disqualifiés. D’autre part, le Dasein peut se reconnaître dans l’ego, ne fût-ce qu’au titre de la mienneté : mais cette reconnaissance tourne court, dès lors que l’ego est interrogé, comme tous les étants intramondains, avec la question quid? et non pas avec la question quis?, de laquelle seule part l’analytique existentiale. Or, même si, dans les Meditationes, la première question en vient à se substituer subrepticement à la seconde, c’est bien en demandant quis sum? que l’ego s’interroge initialement lui-même : le déploiement de cette question suffit à distinguer radicalement le moi de l’âme, la conscience, l’individu, etc. – même si l’incapacité de l’ego à saisir son mode d’être comme être-au-monde exclut de voir dans la pertinence de la question initiale plus qu’une indication de la constitution ontologique du Dasein. Il appartiendra en revanche à la description pascalienne de l’existence humaine d’anticiper l’analyse heideggérienne de l’être-au-monde impropre du Dasein.Qui est le moi?Allorché, alla metà del secolo XVII, l’espressione « il me » fa la sua comparsa, essa indicherà un fenomeno nuovo o il suo senso sarà riconducibile a vecchi concetti come quelli di anima, spirito, soggetto, individuo, persona, e cosî via? Se i fatti della lingua filosofica sono governati da decisioni filosofiche, il me si deve distinguere da questi concetti. La mia ipotesi è che il rapporto ambivalente che il Dasein intrattiene con l’ego cartesiano può chiarire questa distinzione. Da una parte, infatti, l’ego non è il Dasein, in quanto, pensandosi secondo la Vorhandenheit, resta cieco al fenomeno del mondo : da questo punto di vista, l’ego non è, nella storia dell’ontologia, che un esempio tra altri, tutti rifiutati. D’altra parte, il Dasein si può riconoscere nell’ego, almeno per l’aspetto della meità : ma questo riconoscimento cade non appena l’ego viene interrogato, come tutti gli enti intramondani, con la questione : quid? e non con la questione : quis?, dalla quale soltanto muove l’Analitica esistenziale. Ora, nelle Meditazioni, anche se la prima questione si sostituisce surrettiziamente alla seconda, è proprio domandandosi quis sum? che l’ego si interroga inizialmente su se stesso : il dispiegarsi di tale questione basta a distinguere radicalmente il me dall’anima, dalla coscienza, dall’individuo e cosî via, anche se l’incapacità dell’ego di conoscere il suo modo di essere come essere-nel-mondo interdice di vedere nella pertinenza della questione iniziale più che un’indicazione della costituzione ontologica del Dasein. Spetterà invece alla descrizione pascaliana dell’esistenza umana anticipare l’analisi heideggeriana dell’essere-nel-mondo inautentico del Dasein. (shrink)

Background Generally, there is unanimity about the value of community engagement in health-related research. There is also a growing tendency to view genetics and genomics research (GGR) as a special category of research, the conduct of which including community engagement (CE) as needing additional caution. One of the motivations of this study was to establish how differently if at all, we should think about CE in GGR. Aim To assess the perspectives of genetics and genomics researchers in Uganda on CE (...) in GGR. Method A cross-sectional qualitative study was conducted at Makerere University and Uganda Virus Research Institute. Twenty-five individuals participated, the majority being male (sixteen). Participants included nineteen genetics and genomics researchers (researchers and research coordinators), two CE officers, three nurses and one nursing counsellor. Data were collected using in-depth interviews and analyzed in a thematic manner using NVivo version 12 Plus. Study findings Thirteen of the respondents had conducted CE in their GGR in either a geographical and disease-specific community. Some respondents said CE principles are the same and there is no need for special consideration for CE in GGR. Others gave ethical issues in GGR that require special consideration for CE in such research and these were categorized into six themes: GGR is new to communities, Difficulty in communicating GGR by the researchers, Genes are shared in communities, Cultural sensitivities against GGR, Community attitude toward GGR, Some GGR studies take long to end, and Negotiation of research benefits. Special considerations for CE when conducting GGR were suggested and categorized into seven themes: creating awareness of GGR in communities, obtaining both community acceptance and individual consent, CE team composition, involve communities in solving GGR challenges, prolong CE in some GGR, develop guidelines for CE in GGR, and legal considerations on GGR. Conclusion GGR was characterized by special issues that require special CE considerations for such research. (shrink)

L'originalité de l'interprétation pascalienne des trois concupiscences selon 1 Jn 2, 16 est double : d'une part, il ne s'agit plus des plaisirs des sens; Pascal abandonne la doctrine janséniste de la délectation, elle-même fondée sur une théorie de l'imitation; d'autre part, cette concupiscence n'est pas tant l'amour du pouvoir que l'amour de la richesse, en tant qu'elle particularise. Le renversement des trois concupiscences en « trois ordres de choses » ne se comprend que si l'on voit que toute la (...) méditation pascalienne est orientée vers sa fin, le quaternaire sapientiel fourni par 1 Cor 1, 30. Ainsi la lecture nécessairement théologique du § 933 interdit d'en faire un modèle partout exportable et de lui attribuer une fonction architectonique pour l'ensemble de l'Apologie. The originality of the Pascalian interpretation of the three kinds of concupiscence according to 1 John 2: 16 is twofold: on the one hand, what is aimed at no longer is the pleasures of the senses; Pascal gives up the Jansenist doctrine of delectation, which was itself founded on a theory of imitation; on the other hand, concupiscence thus redefined no longer is a yearning for power, and becomes a yearning for riches, insofar as it consists in intemizing. The reversal of these three kinds of concupiscence into the « three orders of things » can be understood only if one realises that the whole Pascalian meditation is directed towards its end, namely the sapiential quaternary provided in 1 Corinthians 1: 30. Thus, the necessarily theological reading of § 933 makes it impossible to see it as a universally pertinent model or to ascribe to it an architectonic role in the structure of the Apologia. (shrink)

QUEL MODE D'EXISTENCE ONT LES CONCEPTS, entendons : les classes, les types, les généralités? Y a-t-il des propriétés universelles? Ce que les médiévaux ont appelé les universaux sont-ils des choses " capables d'exister en plusieurs " ou ne sont-ils que dans l'intellect? S'agit-il d'aspects du monde lui-même ou de pures représentations de l'esprit qui confère au monde un ordre? On sait la place que la " querelle des universaux " a occupée tacitement dans la philosophie ancienne, puis explicitement dans la (...) philosophie médiévale, mettant aux prises réalistes et nominalistes. Chacun sait aussi que ce problème, longtemps pertinent pour répertorier écoles et doctrines, fut réduit à un simple appendice des grands systèmes idéalistes post-cartésiens. Mais alors, comment comprendre le regain de faveur des discussions sur la réalité des universaux dans la philosophie contemporaine? S'agit-il de la reprise d'un problème dont la philosophie ne peut pas faire l'économie, même si elle a pu l'occulter? Y a-t-il réellement une pensée commune entre le réalisme d'un Duns Scot et celui d'un Armstrong, ou entre le nominalisme d'un Ockham et celui d'un Goodman? Ces questions ont fait l'objet d'un colloque organisé à l'Université de Caen. La confrontation entre solutions anciennes et solutions contemporaines et le débat entre historiens de la philosophie et philosophes contemporains ne sont pas seulement féconds, ils sont philosophiquement nécessaires. Pascal a revendique l'abandon de l'etude des sciences au profit de celle de l'homme. Qu'entendre par l'etude de l'homme? D'abord la recherche de la nature du moi humain. La fecondite que L'art de persuader accorde au je pense donc je suis, en tant que principe d'une physique entiere, est telle qu'en est deniee toute portee au cogito augustinien. Mais si Pascal prend acte de l'innovation radicale des Meditationes en creant en francais le moi, c'est pour dessaisir ce moi de sa (...) primaute metaphysique et ne le trouver que dans la depravation de la volonte. Le moi donc, mais pas encore l'homme. Ensuite, apres l'echec des Provinciales, le dessein apologetique pascalien consiste a montrer la superiorite de la vraie religion sur les philosophies, qui seule peut rendre raison de la double condition de l'homme. Ce projet s'enracine dans une premiere anthropologie qu'on qualifiera d'abstraite en ce qu'elle a pour objet de definir l'essence contradictoire de l'homme. Enfin, Pascal en vient a envisager les hommes dans leur existence meme. Les deux themes de la gloire (humaine) et du divertissement permettent de caracteriser cette anthropologie existentielle, au terme de laquelle s'eclaire la puissance d'alienation de l'imagination. L'analytique de l'existence humaine constitue des lors ce qu'on appellera la seconde anthropologie de Pascal. (shrink)

In this way what is new in the Beginning, which we think is the shape of the breaking-up, is the old, the oldest. Although Descartes claims for his novelty (‘je serai obligé d'écrire ici en même façon que si je traitais d'une matière que jamais personne avant moi n'eust touchée’, ‘I shall have to write here as if I were dealing with a subject which nobody before me had ever handled’), he keeps coming back ‘to the very prime moment of the Beginning’, to the initial, original Beginning, that of the being: ‘Mit demcogito sumbeansprucht Descartes, Heidegger says at the beginning ofSein und Zeit, der Philosophie einen neuen und sicheren Boden beizustellen’. Now, nothing is more untimely than the inaugural, nothing is more decisive than the foundation: if the relevance of Cartesianismdoesexist, it is the true one, the original one.
