Regulatory schema has shifted from government to governance-based systems. One particular form that has emerged at the international level is the multi-stakeholder voluntary code of conduct (MSVC). We argue that such codes are not only simply mechanisms by which various stakeholders attempt to govern the action of the corporation but also systems by which each stakeholder attempts to gain or retain some legitimacy goal. Each stakeholder is motivated by strategic legitimacy goal to join the code, and once a member, is (...) also required to assist in maintaining the institutional legitimacy of the code, resulting in “networked legitimacy.” We begin our analysis of these systems by first exploring the growth and structure of such MSVCs, and then building an analytical framework using strategic and institutional legitimacy as they apply to such MSVCs. We contribute to the codes of conduct literature by developing the construct of networked legitimacy from strategic and institutional legitimacy. We then apply our framework to the United Nations Global Compact, one of the predominant MSVCs today. In doing so, we: (1) demonstrate how different stakeholders are pursuing different types of legitimacy through their participation in the code, (2) examine the specific opportunities and risks in terms of what we have called “networked legitimacy” posed by the institutional design of actual MSVCs, and (3) create an argument for three pillars supporting the legitimacy of MSVCs. Despite several criticisms surrounding the DSM classification in psychiatry, a significant bulk of research on mental conditions still operates according to two core assumptions: a) homogeneity, that is the idea that mental conditions are sufficiently homogeneous to justify generalization; b) additive comorbidity, that is the idea that the coexistence of multiple conditions in the same individual can be interpreted as additive. In this paper we take autism research as a case study to show that, despite a plethora of criticism, psychiatric (...) research often continues to operate in accordance with this model. Then we argue that such a model runs into problems once facts about comorbidity are taken into account. Finally, we offer some suggestions on how to tackle the challenge raised by comorbidity and its impact on heterogeneity. To do so, we explore transdiagnostic stratification accounts and network models to show that combining these approaches can move us in the right direction. (shrink)

Parahacerlo se replantea la relación entre la obra de Platón y la de los poetas, cambiando el foco de atención de su famosa censura a las representaciones teatrales, para iluminar (...) su empleo de mecanismos dramatúrgicos articulados con planteamientos éticos y políticos. We examine whether a taxpayer’s decision to choose a taxpayer-favorable characterization of income is associated with contextual and individual dimensions of that decision. Using a 2 × 2 factorial experimental design, we manipulate the prevailing social norm on whether there is a general belief that a specific form of income should be characterized as a capital gain or as ordinary income, and the group affiliation on whether the individual is making a tax characterization decision as a sole proprietor or as (...) a member of a group practice. Moreover, we measure participants’ fairness perception of characterizing the income as capital gains versus ordinary. We study the decisions of 180 graduate business and accounting students from two US business schools to explore these dimensions using a tax-ambiguous income situation. Results indicate that both contextual and individual dimensions impact taxpayer decisions. Specifically, the social norm and fairness perception of characterizing income as capital gains affects the likelihood of choosing such a characterization. Being a sole proprietor or a member of a group practice does not have any significant main effect. However, relative to all other conditions, taxpayers are most likely to characterize income as capital gains when both the social norms are for capital gains characterization and when the taxpayer is a member of a group practice. Results remain largely robust to a variety of alternative explanations. We conclude the paper with a discussion of our findings and their implications for tax policy, enforcement, and research. The paper addresses the problem of imaginative resistance in science, that is, why and under what circumstances imagination sometimes resists certain scenarios. In the first part, the paper presents and discusses two accounts concerning the problem and relevant for the main thesis of this study. The first position is that of Gendler (Journal of Philosophy 97:55–81, 2000), (Gendler, in: Nichols (ed) The Architecture of the Imagination: New essays on pretence, possibility and fiction, Oxford University Press, New York, 2006a), (Gendler & (...) Liao, in: Gibson, Carroll (eds) The routledge companion to philosophy of literature, Routledge, New York, 2016), according to which imaginative resistance mainly concerns evaluative scenarios, presenting deviant moral attitudes. The second account examined is that of Kim et al. (in: Cova, Réhault (eds) Advances in experimental philosophy of aesthetics, Bloomsbury, London, 2018), who insisted on the link between imaginative resistance on the one hand and counterfactual and counterdescriptive scenarios on the other. In the light of both theories, this paper discusses the importance of addressing the problem of imaginative resistance in the scientific enterprise in the light of some mechanisms of embodied simulation, based on the activity of mirror neurons and investigated within the framework of the Embodied Simulation Theory. A substantial body of experimental evidence has demonstrated that labels have an impact on infant categorization processes. Yet little is known regarding the nature of the mechanisms by which this effect is achieved. We distinguish between two competing accounts: supervised name‐based categorization and unsupervised feature‐based categorization. We describe a neurocomputational model of infant visual categorization, based on self‐organizing maps, that implements the unsupervised feature‐based approach. The model successfully reproduces experiments demonstrating the impact of labeling on infant visual categorization reported in (...) Plunkett, Hu, and Cohen (2008). It mimics infant behavior in both the familiarization and testing phases of the procedure, using a training regime that involves only single presentations of each stimulus and using just 24 participant networks per experiment. The model predicts that the observed behavior in infants is due to a transient form of learning that might lead to the emergence of hierarchically organized categorical structure and that the impact of labels on categorization is influenced by the perceived similarity and the sequence in which the objects are presented. The results suggest that early in development, say before 12 months old, labels need not act as invitations to form categories nor highlight the commonalities between objects, but they may play a more mundane but nevertheless powerful role as additional features that are processed in the same fashion as other features that characterize objects and object categories. Some philosophers claim that perception immediately and prima facie justifies belief in virtue of its phenomenal character (Huemer, Skepticism and the veil of perception. Rowman & Littlefield, Lanham, 2001; Pryor, There is immediate justification. In: Steup M, Sosa E (eds) Contemporary debates in epistemology. Blackwell, London (2014), pp. 181–202, 2005). To explain this special justificatory power, some appeal to perception’s presentational character: the idea that perceptual experience presents its objects as existing here-and-now (Chudnoff, Intuition. Oxford University Press, Oxford, 2013; Berghofer, (...) Husserl Stud 34(2):145–170, 2018). As some philosophers have noted, if perception justifies in virtue of its presentational character alone, the kind of content perception has should not matter for perceptual justification; more precisely, it should not matter whether perceptual content is propositional or not (e.g., Smithies, The epistemic role of consciousness. Oxford University Press, Oxford, 2019; Kriegel, Australas J Philos, 2021). However, most philosophers tend to resist this conclusion, holding that perception must be propositional in order to justify, on the ground that all our model of justification are propositional (e.g., Gauker, Philos Perspect 26(1):19–50, 2012). This paper challenges this claim. The paper consists of a negative and a positive part. In the negative part, I discuss and reject the master argument for the propositionality of perception; the conclusion is that propositional content is neither sufficient nor necessary to explain perception’s justificatory power. In the positive part, I take this conclusion seriously and outline an objectual model of perceptual justification. I define objectual attitudes as mental states whose content is not a full proposition, but a sub-propositional representational item, such as the representation of objects, properties, and kinds (Grzankowski and Montague, Non-propositional intentionality. Oxford University Press, Oxford, 2018), and show that it is plausible that some perceptions and some beliefs are attitudes of this kind. I then argue that objectual perceptual experiences have the right kind of phenomenal character and the right kind of structure to serve for immediate prima facie justification. Several theories propose that one of the core functions of inner speech (IS) is to support subjects in the completion of cognitively effortful tasks, especially those involving executive functions (EF). In this paper we focus on two populations who notoriously encounter difficulties in performing EF tasks, namely, people diagnosed with schizophrenia who experience auditory verbal hallucinations (Sz-AVH) and people within the Autism Spectrum Conditions (ASC). We focus on these two populations because they represent two different ways in which IS can (...) fail to help in EF tasks, which can be illustrative for other mental conditions. First, we review the main components of EF (Section 1). Then we explain the functions that IS is taken to perform in the domain of EF (Section 2) and review the evidence concerning problems about EF in the two populations of our study: Sz-AVH (Section 3) and ASC (Section 4). After this we further detail our account about what a properly functioning IS can do for both populations and how different IS profiles may impact EF performance: in the case of Sz-AVH, the uncontrolled and intrusive character of IS negatively affects EF performance, whereas in ASC, EF is not sufficiently supported by IS, given the tendency in this population to present a diminished use of IS (Section 5). We finally briefly discuss Attention Deficit/Hyperactivity Disorder (ADHD) and Developmental Language Disorders (DLD). (shrink)

The contemporary State power is concentrated in the hands of the legislative, executive and judicial powers, which is traditionally referred to as the principle of the division of State power. The separation of State power and the attribution of the function of the interpretation and application of statutory law to courts were like “letting the genie out of the bottle”. Having started with a mechanical application of the statutory law, the courts, armed with various doctrines on interpretation of law, have (...) in the meantime started creating rules themselves and turned into rivals to the legislator. In addition to having started making the law, the courts have also begun exerting control over both the legislative (constitutional justice) and the executive (administrative justice) powers. The acknowledgement of the fact that by interpreting and applying the law, the court is simultaneously making it, gives rise to a host of questions, e.g.: if the court is the guardian of law, who is the guardian of the court? How to separate the interpretation of law from its creation? If the court acts as a lawmaker, then maybe in future, the court will turn into a sole lawmaker?, etc. (shrink)

In this paper I will discuss the extent to which Umberto Eco’s Semiotics maintains the unstable and oscillatory equilibrium between conflicting matrices that is proper to humorous thinking and ambiguous figures such as the famous duck-rabbit illusion and Penrose’s impossible trident. To do so I shall summon the concept of bisociation (Koestler 1964): though never an item of Eco’s own philosophical toolbox, bisociation plays an important role in the creation of some of Eco’s most innovative theoretical contributions, insofar as they (...) result from a possible/impossible graft between Structuralism and Pragmatism. For each, the question will be whether the implant produces self-consistent theoretical amalgams, or whether some degree of contradiction inevitably remains to generate the abovementioned duck-rabbit effect. I shall then analyse the role that such residual incongruities play in a theory that thrives on the self-voiding logic of humorous short-circuits. (shrink)

In this paper, I defend a tripartite metaphysics of intentional mental states, according to which mental states are divided into subject, content, and attitude, against recent attempts at eliminating the attitude component (e.g., Montague, Oxford studies in philosophy of mind, 2022, 2, Oxford University Press). I suggest that a metaphysics composed of only subject and content cannot account for (a) multisensory perceptual experiences and (b) phenomenological differences between episodes of perception and imagination. Finally, I suggest that some of the motivations (...) behind the rejection of the attitude component can be accommodated within the tripartite framework. (shrink)

This is a comprehensive analysis of the idea of libertas and its conflicting uses in the political struggles of the late Roman Republic. By reconstructing Roman political thinking about liberty against the background of Classical and Hellenistic thought, it excavates two distinct intellectual traditions on the means allowing for the preservation and the loss of libertas. Considering the interplay of these traditions in the political debates of the first century BC, Dr Arena offers a significant reinterpretation of the political struggles (...) of the time as well as a radical reappraisal of the role played by the idea of liberty in the practice of politics. She argues that, as a result of its uses in rhetorical debates, libertas underwent a form of conceptual change at the end of the Republic and came to legitimise a new course of politics, which led progressively to the transformation of the whole political system. Il presente articolo si propone di seguire il percorso della tradizione dell’Epistola ai Pisoni di Orazio in Europa e in Italia tra Sette e Ottocento, con particolare attenzione al contesto storico-culturale di riferimento e agli specifici ambienti di ricezione. Il tema è certo ampio e necessiterebbe di una trattazione più distesa e articolata di quella che questa sede può offrire: la prospettiva sarà, dunque, limitata ad alcune specifiche considerazioni sull’argomento. Il lavoro si sofferma primariamente sui diversi meccanismi di traduzione e (...) ripresa che interessano l’opera oraziana tutta. Tra questi si rintracciano molteplici filoni: a partire dalla ricerca biografica, passando attraverso la vivace sfera dell’imitazione e della parodia, per approdare alle rielaborazioni musicale e pittorica. L’analisi giunge così a concentrarsi in particolare sull’Ars poetica, della quale si seguono le fila della diffusione e si ripercorrono gli episodi della fortuna in Italia, dove la ricezione dell’opera si lega alla questione linguistica ai tempi estremamente attuale. Sensibili all’influsso oraziano si rivelano tanto grandi nomi del panorama culturale italiano, quanto intere correnti letterarie, come l’Arcadia, oltre a docenti – sempre più interessati a una corretta lettura dell’opera da parte dei propri studenti – nonché semplici amatori. Funge, infine, da addentellato di uno studio che sarebbe, altrimenti, meramente descrittivo, un’ipotesi in merito a un possibile legame tra gli ambienti di diffusione dell’Ars poetica tipici di ciascuno dei due secoli. Dall’analisi condotta sui dati disponibili si evidenzia, infatti, una continuità di interessi tra arcadici e docenti riconducibile a una “discendenza educativa” di questi ultimi dai primi. (shrink)

Although ontogeny cannot recapitulate phylogeny, a two-level model of the acquisition of language will be here proposed and its implication for the evolution of the faculty of language will be discussed. It is here proposed that the identification of the cognitive requirements of language during ontogeny could help us in the task of identifying the phylogenetic achievements that concurred, at some point, to the acquisition of language during phylogeny. In this model speaking will be considered as a complex ability that (...) arises in two different steps. The first step of competence widely relies on a bodily-based format of knowledge. The second step relies on more abstract meta-representations and implies high-level socio-cognitive skills. It is hypothesized that in order to reach the second level of language competence, symbolic communication and interaction with a cultural community are needed. Hence, the origins of species-specific human complex language and cognition are in both the brain and culture. Moreover, in this model, data from the embodied language research will be discussed in the light of a usage-based account of language. (shrink)

We tested the plausibility of a cognitive-emotional model to understand the effects of messages framed in terms of gain, non-loss, non-gain, and loss, and related to the health consequences of red/processed meat consumption. A total of 544 Italian participants reported their attitude toward reduced red/processed meat consumption and intention to eat red/processed meat. One week later, participants were randomly assigned to four different message conditions: gain messages focused on the positive health outcomes associated with low meat consumption; non-loss messages focused (...) on the avoided negative health outcomes associated with low meat consumption; non-gain messages focused on the missed positive health outcomes associated with high meat consumption; loss messages focused on the negative health outcomes associated with high meat consumption. After reading the messages, participants answered a series of questions regarding their emotional and cognitive reactions to the messages, their evaluation of the messages, and again their attitude and intention toward red/processed meat consumption. Comparing different multivariate linear models under the Bayesian approach, we selected the model with the highest plausibility conditioned to observed data. In this model, message-induced fear influenced systematic processing, which in turn positively influenced message evaluation and attitude, leading to reduced intention to consume red/processed meat. Vice versa, message-induced anger reduced systematic processing, which in turn negatively influenced message evaluation, and led to no effect on attitude and intention. The comparison among message conditions showed that gain and non-loss messages activated integrated emotional and cognitive processing of the health recommendation, while loss and non-gain messages mainly activated emotional shortcuts toward attitude and intention. Overall, these results advance our comprehension of the effects of message framing on receivers' attitudes and intentions. (shrink)

We consider embeddings of structures which preserve spectra: if g: M → S with S computable, then M should have the same Turing degree spectrum (as a structure) that g(M) has (as a relation on S). We show that the computable dense linear order L is universal for all countable linear orders under this notion of embedding, and we establish a similar result for the computable random graph G. Such structures are said to be spectrally universal. We use our results (...) to answer a question of Goncharov, and also to characterize the possible spectra of structures as precisely the spectra of unary relations on G. Finally, we consider the extent to which all spectra of unary relations on the structure L may be realized by such embeddings, offering partial results and building the first known example of a structure whose spectrum contains precisely those degrees c with c′ ≥T 0″. Computability theory is the mathematical theory of algorithms, which explores the power and limitations of computation. Classical computability theory formalized the intuitive notion of an algorithm and provided a theoretical basis for digital computers. It also demonstrated the limitations of algorithms and showed that most sets of natural numbers and the problems they encode are not decidable (Turing computable). Important results of modern computability theory include the classification of the computational difficulty of sets and problems. Arithmetical and hyperarithmetical hierarchies and (...) the Turing degrees provide important measures of the level of such difficulty. There are uncountably many Turing degrees and they are partially ordered. These classifications are used in contemporary research to investigate the complexity of problems in modern computable mathematics, for example, regarding structures and their properties. (shrink)

Bortolotti argues that we cannot distinguish delusions from other irrational beliefs in virtue of their epistemic features alone. Although her arguments are convincing, her analysis leaves an important question unanswered: What makes delusions pathological? In this paper I set out to answer this question by arguing that the pathological character of delusions arises from an executive dysfunction in a subject’s ability to detect relevance in the environment. I further suggest that this dysfunction derives from an underlying emotional imbalance—one that leads (...) delusional subjects to regard some contextual elements as deeply puzzling or highly significant. Leśniewski permet de développer un point de vue original sur certaines propriétés fondamentales du temps logique. In his Democratic justice and the social contract, Weale presents a distinctive contingent practice-dependent model of ‘democratic justice’ that relies heavily on a condition of just social and political relations among equals. Several issues arise from this account. Under which conditions might such just social and political relations be realised? What ideal of equality is required for ‘democratic justice’? What are its implications for the political ideal of citizenship? This paper focuses on these questions as a way to critically reconsider (...) Weale’s model. After presenting Weale’s procedural constructivism, I distinguish his model from an institutional practicedependent model, one salient example of which is Rawls’s political constructivism. This distinction allows for a formulation of the social and political equality required for justice in each case. The contingent model assumes that an equality of ‘status’ will generate just social practices, yet it fails to recognise that an equality of ‘role’ is also important to ensure citizens’ compliance. The paper ultimately seeks to show that the contingent model is insufficient to ensure that just social practices will become stable. (shrink)

Negation can be considered a shared social action that develops since early infancy with very basic acts of refusals or rejection. Inspired by an approach to the embodiment of concepts known as Multiple Representation Theories, the present paper explores negation as an embodied action that relies on both sensorimotor and linguistic/social information. Despite the different variants, MRT accounts share the basic ideas that both linguistic/social and sensorimotor information concur to the processes of concepts formation and representation and that the balance (...) between these components depends on the kind of concept, the context, or the performed task. In the present research we will apply the MRT framework for exploring negation in Italian sign language. The nature of negation in LIS has been explored in continuity with the co-speech gesture where negative elements are encoded through differentiated prosodic and gestural strategies across languages. Data have been collected in naturalistic settings that may allow a much wider understanding of negation both in speech and in spoken language with a semi-structured interview. Five LIS participants with age range 30–80 were recruited and interviewed with the aim of understanding the continuity between gesture and sign in negation. Results highlight that negation utterances mirror the functions of rejection, non-existence and denial that have been described in language acquisition both in deaf and hearing children. These different steps of acquisition of negation show a different balance between sensorimotor, linguistic and social information in the construction of negative meaning that the MRT is able to enlighten. According to several researchers, core affect lies at the foundation of our affective lives and may be characterized as a consciously accessible state combining arousal (activated-deactivated) and valence (pleasure-displeasure). The interaction between these two dimensions is still a matter of debate. In this paper we provide a novel hypothesis concerning their interaction, by arguing that subjective arousal levels modulate the experience of a stimulus’ affective quality. All things being equal, the higher the arousal, the more a given stimulus would be (...) experienced as pleasant (or unpleasant). While marshaling some preliminary evidence in favor of this hypothesis, we also show how it might be relevant in reframing our conception of depressive disorders (i.e., major and bipolar depression). Writing about the history and politics of epidemics and pandemics requires stepping into a historiography that is expansive, transnational, and slotted into specific historical periods. This essay considers the main debates in this expansive historiography and highlights the strengths and limitations of dominant historiographical approaches to the study of epidemics and pandemics. This essay also interrogates the framing of three thematic periods, or categories, commonly identified by historians and social scientists in analyses of epidemics and pandemics: categories of “colonial health,” (...) “international health,” and “global health.” As this essay underscores, scholarship often analyzes epidemics and pandemics through overlapping and complex historical temporalities involving colonization, decolonization, and globalization. However, this approach is often constrained by the limitations of existing archives and the overwhelming focus of published scholarship on dominant institutions, scientific and political figures, and specific disease outbreaks that are commonly associated with categories of “colonial health,” “international health,” and “global health” from the late nineteenth to the present. As a result, scholarship may include linear narratives that flatten or generalize the legacies of epidemics and pandemics. The links between pathogens and pathologies are not linear, however, and colonial structures of power, disease tropes, and surveillance doctrines often persist across time and space. This essay ultimately seeks to challenge and complicate these dominant framings and categories from within. This approach highlights the connectedness—and complex continuities and discontinuities—in the political, economic, social, and scientific perceptions of and approaches to epidemic and pandemic risks.
