We use tools from evolutionary game theory to examine how power might influence the cultural evolution of inequitable conventions between discernible groups (such as gender or racial groups) in a population of otherwise identical individuals. Similar extant models always assume that power is homogeneous across a social group. As such, these models fail to capture situations where individuals who are not themselves disempowered nonetheless end up disadvantaged in bargaining scenarios by dint of their social group membership. "This book presents a distinctive version of a contractarian approach to law and justice. The work argues that law and justice are social norms that arise from a process of social evolution, and are binding only if and to the extent that they are mutually beneficial. It explicitly rejects accounts of law and justice that are based on morality, on the basis that morality itself is only legitimately founded on mutual advantage, But it also rejects most existing versions of contractarianism, (...) which are based on ideas of hypothetical agreements by rational contractors, in favour of an approach that is based on actually existing social norms, but advocates critically examining these norms and discarding those that are not truly mutually beneficial. The first half of the book develops the approach, while the second half explores some of its implications for law. It argues for a left-libertarian approach to property, an approach largely based on the common law of tort, contract and criminal law, and a rejection of most statutory law, which is based not on mutual advantage but rather on benefiting some at the expense of others. However, it ultimately recognises that there are those who want a more extensive state than this approach allows, and advocates a strong form of federalism to allow this, provided robust exit rights are provided"--. This article discusses various arguments for and against treating equality as a fundamental norm in law and political philosophy, combining prior arguments to the effect that equality is essentially an empty idea with arguments that treat it as a non‐empty but mistaken value that should be rejected. After concluding that most of the arguments for treating equality as a fundamental value fall victim to one or both of these arguments, it considers more closely arguments made by philosophers such as Ronald (...) Dworkin and Thomas Nagel that base a duty of promoting equality on the fact that governments impose a legal order on persons without their consent. It concludes that these arguments are mistaken: if the legal order imposed by government is justified then imposing it is not wrongful and generates no duty of equal treatment, while if that order is not justified no requirement of equality of treatment would cure the lack of justification. It concludes that equality should not be a value in law or political theory, but in some cases other considerations may justify particular rules that are sometimes mistakenly thought to be based on equality. In a systematic investigation of national art histories, Bernard Smith’s Place, Taste and Tradition: A Study of Australian Art since 1788, first published in 1945, would likely emerge as an Ur-text of the genre. The book’s rewriting of Australian art history within a Marxist tradition of ‘culturalist’ criticism was a major advance on the available models. Its success stems in no small part from its judicious and balanced account of how social forces intersect. The book privileges economic production as a (...) primary force, as does any Marxian text deserving of the name, but no more than it privileges cultural production and reception as primary forces. This article explores the implications of the Harm Principle, modified to accommodate recent criticisms by Arthur Ripstein, for theories of distributive justice. It concludes that the resulting Sovereignty Principle leads to a left-libertarian theory of justice that is based not on egalitarianism but rather on considerations internal to the Principle itself. This theory avoids criticisms of incoherence that have been rightly applied to other recent versions of left-libertarianism, and supports a requirement of substantial redistribution without necessarily precluding further redistribution for (...) reasons other than those of justice. This paper contributes to the underdeveloped field of experimental philosophy of science. We examine variability in the philosophical views of scientists. Using data from Toolbox Dialogue Initiative, we analyze scientists’ responses to prompts on philosophical issues (methodology, confirmation, values, reality, reductionism, and motivation for scientific research) to assess variance in the philosophical views of physical scientists, life scientists, and social and behavioral scientists. We find six prompts about which differences arose, with several more that look promising for future research. Research integrating the perspectives of different disciplines, or interdisciplinary research, has become increasingly common in academia and is considered important for its ability to address complex questions and problems. This mode of research aims to leverage differences among disciplines in generating a more complex understanding of the research landscape. To interact successfully with other disciplines, researchers must appreciate their differences, and this requires recognizing how the research landscape looks from the perspective of other disciplines. One central aspect of these disciplinary (...) perspectives involves values, and more specifically, the roles that values do, may, and should play in research practice. It is reasonable to think that disciplines differ in part because of the different views that their practitioners have on these roles. This paper represents a step in the direction of evaluating this thought. Operating at the level of academic branches, which comprise relevantly similar disciplines (e.g. social and behavioral sciences), this paper uses quantitative techniques to investigate whether academic branches differ in terms of views on the impact of values on research. Somewhat surprisingly, we find very little relation between differences in these views and differences in academic branch. We discuss these findings from a philosophical perspective to conclude the paper. (shrink)

While top-down descriptors have received much attention in explaining corruption, we develop a grassroots model to describe structural factors that may influence the emergence and spread of an individual’s (un)ethical behavior within organizations. We begin with a discussion of the economics justification of the benefits of competition, a rationale used by firms to adopt structural aides such as the ‹stacking’ practice that was implemented at Enron. We discuss and develop an individual-level theory of planned behavior, then extend it to the (...) dyadic level in an internally competitive organization, and finally extend the dyadic model to the social network. We apply social network theory to predict favorable and unfavorable conditions for the emergence and diffusion of an intraorganizational instance of unethical behavior and find that network conditions favoring the suppression of the emergence of unethical behavior also promote its diffusion. For illustrative purposes, we utilize examples from Enron’s internally competitive structure to embed our arguments in a real world context and bring reality to our theorizing. For millennia, idleness and laziness have been regarded as vices. We're all expected to work to survive and get ahead, and devoting energy to anything but labor and self-improvement can seem like a luxury or a moral failure. Far from questioning this conventional wisdom, modern philosophers have worked hard to develop new reasons to denigrate idleness. In Idleness, the first book to challenge modern philosophy's portrayal of inactivity, Brian O'Connor argues that the case against an indifference to work and effort (...) is flawed--and that idle aimlessness may instead allow for the highest form of freedom. -/- Idleness explores how some of the most influential modern philosophers drew a direct connection between making the most of our humanity and avoiding laziness. The aim is to discover a principle governing the formation of the dream. Now dreaming has an analogy with consciousness in that it is a seeming-consciousness. Meanwhile consciousness exhibits a tripartite structure consisting of understanding oneself to be situated in a world endowed with given properties, the mental processes responsible for the state, and the concrete perceptual encounter of awareness with the world. The dream analogues of these three elements are investigated in the hope of discovering the source of the (...) kinship between dream and consciousness. The dream world proves to be a logically impossible world, limited by nothing more than sheer narratability. The internal world of the dreamer is notable for the limitlessness of the scope allotted to the imagination, together with the presence of two important phenomena encountered in waking consciousness: a measure of interiority, and the positing of a world. Finally, the dream further replicates consciousness in so far as we seem in dreaming concretely to experience our physical surrounds in the form of perceptual imagining. These properties play their part in enabling the dream to be a seeming-consciousness. At the same time they are such as to necessitate its not being consciousness. It is proposed that in the light of these properties, and those composing the state of consciousness, the dream simply is the imagining of consciousness. (shrink)

This paper focuses on 3 features of Freyenhagen's Aristotelian version of Adorno. (a) It challenges the strict negativism Freyenhagen finds in Adorno. If we have morally relevant interests in ourselves, it is implicit that we have a standard by which to understand what is both good and bad for us (our interests). Because strict negativism operates without reference to what is good, it seems to be detached from real interests too. Torture, it is argued, is, among other things, a violation (...) of those interests. (b) Freyenhagen identifies the “impulse” in Adorno as an untutored yet moral reaction to morally demanding situations. The plausibility of this primitivism and its compatibility with Adorno's general worries about immediacy are considered. (c) The disruptive character of Adorno's version of the categorical imperative, its willingness to complicate action through wholesale reflection on the norms of what we are committing ourselves to, is set in contrast with Freyenhagen's Aristotelian claim that certain notions, such as “humanity,” cannot be intelligibly questioned.
