Aristotle and Natural Law lays out a new theoretical approach which distinguishes between the notions of 'interpretation,' 'appropriation,' 'negotiation' and 'reconstruction' of the meaning of texts and their component concepts. These categories are then deployed in an examination of the role which the concept of natural law is used by Aristotle in a number of key texts. The book argues that Aristotle appropriated the concept of natural law, first formulated by the defenders of naturalism in the 'nature versus convention debate' (...) in classical Athens. Thereby he contributed to the emergence and historical evolution of the meaning of one of the most important concept in the lexicon of Western political thought. Aristotle and Natural Law argues that Aristotle's ethics is best seen as a certain type of natural law theory which does not allow for the possibility that individuals might appeal to natural law in order to criticize existing laws and institutions. Rather its function is to provide them with a philosophical justification from the standpoint of Aristotle's metaphysics. (shrink)

Introduction For philosophers, the current phase of the debate with which this volume is concerned can be taken to have begun in 1986, when Jane Heal and Robert Gordon published their seminal papers (Heal, 1986; Gordon, 1986; though see also, for example, Stich, 1981; Dennett, 1981). They raised a dissenting voice against what was becoming a philosophical orthodoxy: that our everyday, or folk, understanding of the mind should be thought of as theoretical. In opposition to this picture, Gordon and (...) Heal argued that we are not theorists but simulators. For psychologists, the debate had begun somewhat earlier when Heider (1958) produced his work on lay psychology; and in more recent times the psychological debate had continued in developmental psychology and in work on animal cognition. Conscientious Objection has become a highly contested topic in the bioethics literature and public policy. However, when CO is discussed, it is almost universally referred to as a single entity. Reality reveals a more nuanced picture. Healthcare professionals may object to a given action on numerous grounds. They may oppose an action because of its ends, its means, or because of factors that lay outside of both ends and means. Our paper develops a taxonomy of CO, which makes it possible (...) to describe the refusals of healthcare professional with greater finesse. The application of this development will potentially allow for greater subtlety in public policy and academic discussions – some species of CO could be permitted while others could be prohibited. Substantial research examines the follower consequences of leader alignment of words and deeds, but no research has quantitatively reviewed these effects. This study examines extant research on behavioral integrity and contrasts it with two other constructs that focus on alignment: moral integrity and psychological contract breaches. We compare effect sizes between the three constructs, and find that BI has stronger effects on trust, in-role task performance and citizenship behavior than moral integrity and stronger effects on commitment and OCB than psychological (...) contract breach. These stronger attitudinal consequences run counter to our initial expectations, but they provide evidence of important conceptual distinctions and mechanisms that we articulate. BI theory suggests that BI’s greater performance impact is due to the notion that BI affects communication clarity in addition to attitudes. Results of meta-analytic structural equation modeling are consistent with this proposed dual path of BI’s impact. We highlight avenues for future research on BI and discuss how our findings inform the broader research on leader alignment. (shrink)

Recent developments in the health care industry have precipitated a new wave of interest in expanding the scope of practice for nursing. This is because the Patient Protection and Affordable Care Act, broadly designed to increase access to health insurance, will inevitably result in increased demand for primary care providers. And with compensation for primary care physicians already lagging far behind that of specialists, the role of nurse practitioners is once again receiving increased attention as a viable means by which (...) to ease the pressure for access to health care.But the economics of this trade-off are controversial. On one hand, it sets primary care physicians at odds with specialists; namely, if the ultimate goal is to “bend the cost curve downward,” should specialist compensation be reduced in order to increase spending on primary care? Obesity is a particularly vexing public health challenge, since it not only underlies much disease and health spending but also largely stems from repeated personal behavioral choices. The newly enacted comprehensive health reform law contains a number of provisions to address obesity. For example, insurance companies are required to provide coverage for preventive-health services, which include obesity screening and nutritional counseling. In addition, employers will soon be able to offer premium discounts to workers who participate in wellness programs that emphasize (...) behavioral choices. These policies presume that government intervention to reduce obesity is necessary and justified. Some people, however, argue that individuals have a compelling interest to pursue their own health and happiness as they see fit, and therefore any government intervention in these areas is an unwarranted intrusion into privacy and one's freedom to eat, drink, and exercise as much or as little as one wants. This paper clarifies the overlapping individual, employer, and social interest in each person's health generally to avoid obesity and its myriad costs in particular. The paper also explores recent evidence on the impact of government interventions on obesity through case studies on food labeling and employer-based anti-obesity interventions. Our analysis suggests a positive role for government intervention to reduce and prevent obesity. At the same time, we discuss criteria that can be used to draw lines between government, employer, and individual responsibility for health, and to derive principles that should guide and limit government interventions on obesity as health reform's various elements (e.g., exchanges, insurance market reforms) are implemented in the coming years. We argue that two main accounts of hypocrisy— the deception-based and the moral-non-seriousness-based account—fail to capture a specific kind of hypocrite who is morally serious and sincere "all the way down." The kind of hypocrisy exemplified by this hypocrite is irreducible to deception, self-deception or a lack of moral seriousness. We call this elusive and peculiar kind of hypocrisy, pure hypocrisy. We articulate the characteristics of pure hypocrisy and describe the moral psychology of two kinds of pure hypocrites.

The paper is structured as follows. §1 lays out the worry that the FA analysis fosters a revisionary understanding of emotional values. §2 introduces the distinction between enablers and favourers and how it is pressed into service by Toni to reply to this worry. While I agree that the reply is attractive, since casting emotions in the role of enablers chimes well with how we pre-theoretically understand the relations between emotions and values, I observe that doing so requires that we (...) tackle two connected issues. First, how do emotions function as value enablers? Second, is the resulting picture compatible with the FA analysis? The rest of the discussion is structured around these issues. §3 looks at the role of emotions within the FA analysis so as to specify the kind of enabling role they can play. On this backdrop, I explore in §4 a contrast between how belief relates to truth and how emotions relate to values, a contrast which helps uncover what we are after. A first reaction to this contrast, according to which emotions are value enablers by allowing us to access values, which differ from truth, is examined in §5. I argue that this idea cannot do justice to the key insight of the FA analysis. §6 defends an alternative idea, according to which emotions are enablers in virtue of their attitudinal shapes. In his recent work The Myth of Dialectics John Rosenthal presents a forceful polemic against Hegel and Marxists sympathetic to the Hegelian legacy. The methodology Hegel employed, his metaphysical assertions, his rejection of the principles of formal logic, and the political implications of his standpoint, are all fundamentally incompatible with Marx’s perspective, according to Rosenthal. While Rosenthal grants that Marx did make use of Hegelian motifs in his theory of value, even this is not to Hegel’s credit: the very perversity (...) of Hegel’s thought made it useful for the comprehension of the perversity of capital. In this paper I argue that a close and reasonably charitable reading of Hegel’s Logic reveals a quite different picture of his methodology and ontological commitments from that presented by Rosenthal. While there are profound substantive differences between the Hegelian and Marxian 1 perspectives on capitalist society, it is not the case that Hegel’s Logic is homologous with capital. The Logic provides helpful conceptual resources for a critique of capital. In the final section of the paper five areas are briefly sketched in which Hegelian dialectical logic remains of contemporary interest. (shrink)

Ethics, communication skills, and the law ('practice skills') are important in all aspects of modern health care. Doctors and nurses must be sensitive to the ethical aspects of their work and understand the legal framework within which clinical decisions are made. Well developed skills of communication, with patients, their relatives and other members of the clinical team, are a key feature of good clinical practice Until recently, the important of practice skills has been relatively neglected in health care education. This (...) situation is changing. The UK General Medical Council, for example, has recently identified three aspects as part of the core of the medical course, and the move to degree courses in nursing has led to an increasing focus of practice skills in nurse education. The Oxford Practice Skills Project (OPSP) team have developed a course, within the University of Oxford Clinical School, which covers the teaching of practice skills in an integrated manner. This course is widely recognized as one of the most systematic developments of education in these areas. This manual describes the OPSP course in detail and provides teaching materials. Although developed initially for medical students, it should be helpful to all those involved in teaching ethics, communication skills, and law in health care. In recent publications Paolo Virno and Carlo Vercellone have called attention to Marx’s category of the general intellect in theGrundrisse, and to the unprecedented role its diffusion plays in contemporary capitalism. According to Virno, the flourishing of the general intellect, which Marx thought could only take place within communism, characterises post-Fordist capitalism. Vercellone adds that Marx’s account of the real subsumption of living labour under capital is obsolete in contemporary cognitive capitalism. Both authors regard Marx’s value theory as historically obsolete. (...) I argue that these views rest on a confusion of value and wealth, a neglect of Marx’s account of the role of ‘free gifts’ to capital, an underestimation of the role of the general intellect in the period prior to the rise of post-Fordism/cognitive capitalism, and an underestimation of the restrictions on the diffusion of the general intellect in contemporary capitalism. This article explores the political background to the 1902 Education Act, and argues that Balfour's commitment to the measure was founded more an political expediency than a desire to initiate major educational reform. It concludes that Balfour's interest in education was, at best, lukewarm, at worst, apathetic.

ABSTRACTThe concept of need is often proposed as providing an additional or alternative criterion to cost‐effectiveness in making allocation decisions in health care. If it is to be of practical value it must be sufficiently precisely characterized to be useful to decision makers. This will require both an account of how degree of need for an intervention is to be determined and a prioritization rule that clarifies how degree of need and the cost of the intervention interact in determining the (...) relative priority of the intervention. Three common features of health care interventions must be accommodated in a comprehensive theory of need: the probabilistic nature of prognosis ; the time course of effects; and the fact that the most effective treatments often combine more than one intervention. These common features are problematic for the concept of need. We outline various approaches to prioritization on the basis of need and argue that some approaches are more promising than others. What is the young Marx's attitude towards questions of psychology? More precisely, what is his attitude towards the human mind and its relationship to the body? To deal adequately with this issue requires a consideration of the relationship between Marx and Feuerbach. It also requires some discussion of the thought of Aristotle. For the views of Feuerbach and the young Marx are not at all original. Rather, they represent a continuation of a long tradition which derives ultimately from ancient Greek (...) philosophy, and especially from the philosophy of Aristotle. As is well known, Aristotle's thought with respect to questions of psychology are mostly presented, by way of a critique of the doctrines of the other philosophers of his day, in his De Anima. W.H. Walsh has made the perceptive observation that Aristotle's views might be seen as an attempt to develop a third approach which avoids the pitfalls usually associated with the idealism of Plato, on the one hand, and the materialism of Democritus on the other. It might be argued that there is an analogy between the situation in which Aristotle found himself in relation to the idealists and materialists of his own day and that which confronted Marx in the very early 1840s. For, like Aristotle, Marx also might be seen as attempting to develop such a third approach. The difference is simply that, in the case of Marx, the idealism in question is that of Hegel rather than that of Plato, and the materialism is the ‘mechanical materialism’ of the eighteenth century rather than that of Democritus. This obvious parallel might well explain why Marx took such a great interest in Aristotle's De Anima both during and shortly after doing the preparatory work for his doctoral dissertation – the subject matter of which, of course, is precisely the materialist philosophy of the ancient Greek atomists Democritus and Epicurus. In recent years feminist scholarship has increasingly focused on the importance of the body and its representations in virtually every social, cultural, and intellectual context. Many have argued that because women are more closely identified with their bodies, they have access to privileged and different kinds of knowledge than men. In this landmark new book, Paula Cooey offers a different perspective on the significance of the body in the context of religious life and practice. Building on the pathbreaking work of (...) Elaine Scarry in The Body in Pain, Cooey looks at a wide range of evidence, from the Argentine prison narrative of Alicia Partnoy, to the novels of Toni Morrison and the paintings of Frida Kahlo. Drawing on current social theory and critique, cognitive psychology, contemporary fiction and art, and women's accounts of religious experience, Cooey relates the reality of sentience to the social construction of reality. Beginning with an examination of the female body as a metaphor for alternative knowledge, she considers the significance of physical pain and pleasure to the religious imagination, and the relations between sentience, sensuality, and female subjectivity. Cooey succeeds in bringing forward a sophisticated new understanding of the religious importance of the body, at the same time laying the foundations of a feminist theory of religion. (shrink)

This paper develops the situational model of primate beliefs from the Prior-Lurz line of thought. There is a strong skepticism concerning primate beliefs in the analytic tradition which holds that beliefs have to be propositional and non-human animals do not have them. The response offered in this paper is twofold. First, two arguments against the propositional model as applied to other animals are put forward: an a priori argument from referential opacity and an empirical argument from varieties of working memory. (...) Second, the Prior-Lurz situational model based on state of affairs as opposed to propositions is introduced and defended with two significant modifications. With this model of primate beliefs we can make progress in understanding how other primates can have certain mindreading capacity. (shrink)

The notion that human activity can be characterised in terms of dynamic systems is a well-established alternative to motor schema approaches. Key to a dynamic systems approach is the idea that a system seeks to achieve stable states in the face of perturbation. While such an approach can apply to physical activity, it can be challenging to accept that dynamic systems also describe cognitive activity. In this paper, we argue that creativity, which could be construed as a ‘cognitive’ activity par (...) excellence, arises from the dynamic systems involved in jewellery making. Knowing whether an action has been completed to a ‘good’ standard is a significant issue in considering acts in creative disciplines. When making a piece of jewellery, there a several criteria which can define ‘good’. These are not only the aesthetics of the finished piece but also the impact of earlier actions on subsequent ones. This suggests that the manner in which an action is coordinated is influenced by the criteria by which the product is judged. We see these criteria as indicating states for the system, e.g. in terms of a space of ‘good’ outcomes and a complementary space of ‘bad’ outcomes. The skill of the craftworker is to navigate this space of available states in such a way as to minimise risk, effort and other costs and maximise benefit and quality of the outcome. In terms of postphenomonology, this paper explores Ihde’s human-technology relations and relates these to the concepts developed here. (shrink)

Timothy Williamson’s Knowledge and its Limits has been highly influential since the beginning of this century. It can be read as a systematic response to scepticism. One of the most important notions in this response is the notion of «evidence,» which will be the focus of the present paper. I attempt to show primarily two things. First, the notion of evidence invoked by Williamson does not address the sceptical worry: he stipulates an objective notion of evidence, but this begs the (...) question against his opponent. Second, his related thesis «Evidence equals Knowledge» does not sit well with his own content externalism: he promises to relate epistemology to philosophy of mind, but he fails to live up to this commitment in his crucial chapter on scepticism. Other minor problems concerning evidence will also be discussed in due course. (shrink)

The politics and pedagogy of schooling are becoming more authoritarian, coercive and utilitarian. Reactionary ideologies dressed and patched up with new managerialism (already moribund in the market place) are supplanting progessivist ideas. Even in its own cramped terms the new model will not work. But educationalists should not be content to oppose it with nostalgic stories. Progressivism was always at a loss to cram its ideals within the geography, architecture and timetable of a school day. It is the very structure (...) and context of schooling that needs overhaul. Like most terms in social theory, the term "conservative" is profoundly ambiguous and contested. In the United States today the word is often applied to those who call for an absolute minimum of government interference in capitalist markets. In another meaning it refers to those who insist that social life should center on the preservation of a community’s traditions and cultural values. There is a deep tension between these two viewpoints. Capitalist markets left to themselves radically destabilize established communities, and (...) so preserving cultural traditions and values requires political intervention in economic life. Given this ineluctable tension it is probably best not to use the same term to refer to both positions. In the present paper I shall refer to the former perspective, whose intellectual roots are found in the "classical liberalism" of John Locke and others, as "neoliberalism." The latter perspective will be referred to as "neoconservatism.". (shrink)
