This paper offers an explanation of how collaboration leads to abstract and flexible problem solving. We asked the individual and paired subjects to indicate 3/4 of 2/3 of the area of a square sheet of paper and found that (1) they primarily folded or partitioned the paper rather than algorithmically calculating the answer, (2) they strongly tendened to backtrack and confirm their proto‐plans on externalized traces such as creases on the paper, and (3) only the paired subjects shifted to the (...) mathematical strategy in their second trials. Based on these results, we propose that two factors, individuals' activeness in choosing and confirming the initial strategies and the frequent role exchange between task‐doing and monitoring in collaborative situations, interact in collaboration to generate various solutions differing in the degree of abstraction, which are then reflected upon by the participants to lead them to abstraction. Situated normativity is the ability of skilled individuals to distinguish better from worse, adequate from inadequate, appropriate from inappropriate, or correct from incorrect in the context of a particular situation. Situated normativity consists in a situated appreciation expressed in normative behaviour, and can be experienced as a bodily affective tension that motivates a skilled individual to act on particular possibilities for action offered by a concrete situation. The concept of situated normativity has so far primarily been (...) discussed in the context of skilled unreflective action. In this paper, we aim to explore and sketch the role of the concept of situated normativity in characterising more reflective forms of normativity. The goal of the paper is two-fold: first, by showing more reflective forms of normativity to be continuous with unreflective situated normativity, we bring these reflective forms into the reach of embodied accounts of cognition; and second, by extending the concept of situated normativity, new light is thrown on questions regarding reflective forms of cognition. We show that sociomaterial aspects of situations are crucial for understanding more reflective forms of normativity. The main purpose of this paper is to shed light on Pierre Bourdieu’s conception of language. Although he has dedicated a significant part of his work to the study of language and even though his analysis of language has been extensively discussed in the literature, almost no attention has been paid to the fact that Bourdieu’s account of language is based on a number of ontological presuppositions, that is, on a set of universal assumptions about the very nature of language. (...) This article aims to fill this gap in the literature by offering a detailed overview of 10 key features which, from a Bourdieusian point of view, can be regarded as inherent in language. On the basis of this enquiry, the study seeks to demonstrate that—contrary to common belief—there is not only a Bourdieusian sociology of language but also a Bourdieusian philosophy of language, which provides a useful theoretical framework for examining the unavoidable conditions of the real speech situation. The paper draws to a close by reflecting on the flaws and limitations of Bourdieu’s approach to language. (shrink)

After some preliminary distinctions, this paper will discuss the merits of higher-order representational theory and same-order theory. A distinction will be introduced between a intrinsic conception of consciousness and a representational variant . It will be argued that the SOIT account of 'non-reflective self-awareness' can be applied to understanding aspects of psychopathology. However, a closer look at specific aspects of schizophrenic experience reveals that we might need to widen the scope of and 'situate' the SOIT of non-reflective selfawareness.

In Critique and Disclosure: Critical Theory between Past and Future , Nikolas Kompridis proposes a new model of critique for critical theory based on the unlikely alliance he constructs between Habermas and Heidegger while seeking to avoid the philosophical shortcomings of both. Focusing on his accounts of ‘receptivity’, arguably the central concept in his new model of critique, I argue sympathetically that although his rejection of some and appropriation of certain features of Habermas' theory serve his philosophical aims, his allegiance (...) to Heidegger’s ontology would thwart his interest in receptivity as an alternative model of critique stressing the interpretation of meaning and learning over validity and rationality. Kompridis must be attentive to the conditions that enable or constrain receptivity, yet this is a theoretical move unavailable to him within his Heideggerian framework. To secure the work learning performs in his critical model Kompridis must relinquish ontology and cultivate an approach situating receptivity in the political and socially contingent contexts in which it is conditioned. It is often held that to have a conscious experience presupposes having some form of implicit self-awareness. The most dominant phenomenological view usually claims that we essentially perceive experiences as our own. This is the so called “mineness” character, or dimension of experience. According to this view, mineness is not only essential to conscious experience, it also grounds the idea that pre-reflective self-awareness constitutes a minimal self. In this paper, we show that there are reasons to doubt this constituting role (...) of mineness. We argue that there are alternative possibilities and that the necessity for an adequate theory of the self within psychopathology gives us good reasons to believe that we need a thicker notion of the pre-reflective self. To this end, we develop such a notion: the Pre-Reflective Situational Self. To do so, we will first show how alternative conceptions of pre-reflective self-awareness point to philosophical problems with the standard phenomenological view. We claim that this is mainly due to fact that within the phenomenological account the mineness aspect is implicitly playing several roles. Consequently, we argue that a thin interpretation of pre-reflective self-awareness—based on a thin notion of mineness—cannot do its needed job within, at least within psychopathology. This leads us to believe that a thicker conception of pre-reflective self is needed. We, therefore, develop the notion of the pre-reflective situational self by analyzing the dynamical nature of the relation between self-awareness and the world, specifically through our interactive inhabitation of the social world. Explicitly considering human values in the design process of socio-technical systems has become a responsibility of designers. It is, however, challenging to design for values because (1) relevant values must be identified and communicated between all stakeholders and designers and (2) stakeholders’ values differ and trade-offs must be made. We focus on the first aspect, which requires elicitation of stakeholders’ situated values , i.e. values relevant to a specific real life context. Available techniques to elicit knowledge and requirements from (...) stakeholders lack in providing the context and means for reflection needed to elicit situated values as well as an explicit concept of value. In this paper we present our design of a tool to support active elicitation of stakeholders’ values and communication between stakeholders and designers. We conducted an exploratory user study in which we compared the suitability of methods used in social sciences for (1) eliciting situated values, (2) supporting people’s expressions of values and (3) being implemented in value elicitation tool. Based on the outcomes we propose a design for a value elicitation tool that consists of a mobile application used by stakeholders for data collection and in-situ self-reflection, and a website used collaboratively by designers and stakeholders to analyse and communicate values. It is commonly believed that philosophica l comparison depends on having some common measure or standard between and above the compared parts. The paper is to show that the foregoing common belief is incorrect and therewith to inquire into the possibility of cross-cultural philosophical comparison. First, the ‘comparison paradox’ will be expounded. It is a theoretical difficulty for the philosophical tendency represented by Plato’s theory of Ideas to justify comparative activities. Further, the connection of the comparative paradox with the obstacles (...) met by cross-cultural philosophical comparisons will be demonstrated. It will be shown that to attribute the difficulty of cross-cultural comparisons to incommensurability of traditions is irrelevant and misleading. It is to be argued that the original possibility of comparison depends on the ‘comparative situation’, i.e., the mechanism of meaning-production that functions in a non-universalistic and anonymous way. A philosophical paradigm does facilitate the attendance of such a situation, but it is also possible for the situation to emerge between paradigms in a gamesome way. Accordingly, the genuine comparison at issue will not originate primarily and merely on the level of concepts and propositions, but can only be achieved through inter-paradigmatic conditions, where we have the sharp awareness of a paradigm’s boundary from which we can attempt to achieve situational communication with another paradigm. In light of this, the perspective of a philosophical comparison differs not only from the traditional or universalistic one, but also from Gadamer’s hermeneutics, such as the doctrine of ‘fusion of horizons’. Most research on animal self-awareness focuses on the question of what self-awareness is, however, the present study addresses the question of what self-awareness is for. It is argued that different forms of self-awareness are needed for conspecific collaboration in different types of animal societies. In the order of the increasing level of fluidity in conspecific cooperation, animal societies are divided into three main types: caste society, individualized society, and alliance society. Accordingly, three forms of self-awareness are differentiated: awareness of one’s (...) kinship relations in the caste society, awareness of one’s ranking place in the individualized society, and awareness of one’s situational roles in the alliance society. Unlike the awareness of kinship and ranks, which is genetically or associatively determined, role awareness is a form of reflective self-awareness acquired by taking the perspectives of others for contingent collaboration with conspecifics in transient situations. : Bioethical discussion of justice in health care has been much enlivened in recent years by new developments in the theory of rationing and by the emergence of a strong communitarian voice. Unfortunately, these developments have not enjoyed much in the way of close engagement with feminist-inspired reflections on power, privilege, and justice. I hope here to promote interchange between "mainstream" treatments of justice in health care and feminist thought.

This paper presents methodological reflections on power sharing and shifts of power in various interview situations. Narratives are said to be shaped by our attempts to position ourselves within social and cultural circumstances. In an interview situation, power can be seen as something that is created and that shifts between the interviewer and the interviewed. Reflexivity is involved when we as interviewers attempt to look at a situation or a concept from various perspectives. A modified form of discourse analysis inspired (...) by subject positioning was used to reflect on power relations in four different interview situations. The analyses indicate that reflection on the power relations can lead to other forms of understanding of the interviewee. The main conclusion that can be drawn from this study is that power relations are created within an interview situation and therefore it is important to be aware of dominant perspectives. Researchers and nurses face the challenge of constantly raising their level of consciousness about power relationships, and discursive reflexivity is one way of doing this. Thus, reflexivity is an important part of the qualitative research process. (shrink)

First, Bethany Henning explores a neglected dimension of Dewey's thought. In particular, the book inquires into the dimension of the unconscious and tries to develop what she considers an "implicit" "theory of the unconsciousness" or of the "aesthetic unconscious" in Dewey's philosophy. Then, (...) based on all of the above, it provides a diagnosis and possible solution to a problem with philosophers and with American culture.The neglected dimension of Dewey's thought that Henning explores highlights the ways in which Dewey foresaw what feminist thinkers have said, and recent scientific accounts of human life and thinking are confirming: What we "feel" (what is "qualitative," "ineffable," and "noncognitive") is key to how to think and how to live (guidance and meaning). It has therefore been puzzling to me (along with John McDermott, Tom Alexander, Mark Johnson, and a few others) why even Dewey scholarship has to a large extent neglected exploring this aspect of his thought. Frustrated with Bertrand Russell, Dewey says that "Mr. Russell has not been able to follow the distinction I make between the immediately had material of non-cognitively experienced situations and the material of cognition—a distinction without which my view cannot be understood" (LW 14:33; emphasis added).More importantly, by neglecting this insight and these aspects of his thought, we have failed to utilize one of the most important resources to diagnose sociopolitical-moral problems today! This is what I have been trying to do in recent years, and I see Dr. Henning as trying to do the same. She is not just providing a theory of the unconscious for the sake of speculation, but she does so with instrumental intent, in the hope that it will help us better approach a concrete social-cultural problem we suffer in our society, a topic to which I will return. Is there, in Dewey, a conception of aesthetic and religious experience that can be understood as an "implicit theory of the unconscious"?(b). Even if there is one, do we need one? For what purpose?(c). What would we miss if we were to say what needs to be said and explored by Henning by using different terms/concepts and avoiding the possible misunderstanding and dangers of making reference to "the unconscious"?(d). Would Henning agree that the problematic aversion or repression in American culture that concerns us is more than that of the unconscious, the qualitative, body, and nature that form the focus of her book?(e). Henning agrees that we need more than art and "deep" psychology to ameliorate the problems that concern us. What is this "more"? How?In regard to (b), I can think of one good purpose, which Henning develops in Dewey and the Aesthetic Unconscious: to engage in a dialogue with psychoanalysis and contemporary philosophies that draw from psychoanalysis and feminism (e.g., Kristeva) or, in general, other academics concerned with the same problems. I also wondered as I was reading the book why Henning does not put Carl Jung in dialogue with Dewey as well, just as a matter of curiosity. But I wonder, if we need to develop a "theory of the unconsciousness" or of the "aesthetic unconsciousness" to both make a contribution to the "depth" of lived experience (La Vida) and also deal with the social-cultural problems that concern us.There are dangers with talking about or making reference to "the" unconsciousness or "the" aesthetic unconsciousness and theorizing about them. The problem is that it comes across as a noun, and not as way of participating in La Vida or nature, that is continuous in a significant way with what is more conscious and more cognitive: we are at any time more or less conscious. But Henning seems aware of all of this. She is careful enough to make clear that she is acknowledging continuity, but I confess to "feeling" uncomfortable sometimes with her reference to that... This systematic and functional position has become necessary in view of rich and deep insight into social functions of religion in building African cultural identity in a globalized world. This exploratory survey makes use of literary, sociological and historical methods and analyzed through culture centred approach. The title of the encyclical means on principles of Christian practical wisdom, the truths concerning the pursuit in this life of our supernatural end. Leo was also referring to the regnative prudence of the pontifical office, directing citizens qua baptized. Even if the direction is about political morality, the prudential directives presuppose sanctifying grace and a supernatural end. In other words, such prudence is here proffered under the formality of the New Law.1In the concrete, directing those who have sanctifying grace to right [End Page 971] judgment and action regarding what belongs or does not belong to Caesar is not easily given or received. The lines and entanglements are contingent and fluid. At a consistory immediately after World War II, Pope Pius XII remarked that the triumph of democratic forms of government has at least one advantage: "The distinction between the Church and even the democratic State becomes increasingly clear."2 Divine providence includes two comprehensive communities, polity and ecclesia, which differ in their respective origin and end. In the thick of events, they are not always so clear. For the better part of two millennia, ecclesial and civil governments look very much alike from an institutional and sociological point of view. They share families, languages, costumes, arts and sciences, banks, moral principles, the same contemporary media—indeed, even sharing the same laws and international protocols. The theory of affective intelligence dichotomizes challenging situations into threatening and risky ones. When people perceive a familiar threat, they tend to be dogmatic and partisan, since they are mobilizing decisive action based on habitual behaviors and nearly instinctual perceptions that have proved their worth in similar situations. When facing a novel risk, however, people tend to become more open‐minded and deliberative, since old solutions do not apply. An experiment with students' reactions to challenges to their opinions about a divisive (...) political issue suggests that, indeed, democratic citizens display the different competencies that are demanded by these two different types of situation. The actual conduct of political campaigns, too, can be expected to reflect the differences between trying to guard against defections from one's side by encouraging the appearance of routine partisan combat, and trying to promote defections from the other side by prompting anxiety, hence open‐minded deliberation. Numerous authors have defended the rough idea that it is irrational to fail to conform to one’s judgments about what it would be rational to do, or what doxastic states it would be rational to be in. This chapter examines rational reflection principles as an attempt to implement this idea in contexts of uncertainty about what credence distributions are rational. After outlining some problems with Old Rational Reflection, the chapter discusses what seems like a well-motivated fix, New Rational (...) Reflection. It is argued that an intuitive way of trying to motivate the principle fails, and that it faces counterexamples. To say the least, the principle imposes substantial and controversial constraints on the kinds of epistemic situations it is possible to be in. A more general problem is that rational reflection principles seem doomed to take seriously certain kinds of uncertainty about what is rational, but not others. (shrink)

Humans have distinctive powers of reflection: no other animal seems to have anything like our capacity for self-examination. Many philosophers hold that this capacity has a uniquely important guiding role in our cognition; others, notably Hilary Kornblith, draw attention to its weaknesses. Kornblith chiefly aims to dispel the sense that there is anything ‘magical’ about second-order mental states, situating them in the same causal net as ordinary first-order mental states. But elsewhere he goes further, suggesting that there is something (...) deeply misleading about reflection’s first-person view of cognition. This chapter takes a closer look at the conditions under which reflection is misleading. Even if humans are the only reflective animals, we are no longer the only creatures that can be questioned about their claims. Chatbots can also be asked to explain themselves, and by studying the conditions under which they produce clarification as opposed to confabulation, we can develop a non-skeptical account of the epistemic value of reflection. I argue that this capacity naturally supports the distribution of complex problem solving among multiple agents. (shrink)

In this paper, we investigate how data about public preferences may be used to inform policy around the use of controversial novel technologies, using public preferences about autonomous vehicles (AVs) as a case study. We first summarize the recent ‘Moral Machine’ study, which generated preference data from millions of people regarding how they think AVs should respond to emergency situations. We argue that while such preferences cannot be used to directly inform policy, they should not be disregarded. We defend an (...) approach that we call ‘Collective Reflective Equilibrium in Practice’ (CREP). In CREP, data on public attitudes function as an input into a deliberative process that looks for coherence between attitudes, behaviours and competing ethical principles. We argue that in cases of reasonable moral disagreement, data on public attitudes should play a much greater role in shaping policies than in areas of ethical consensus. We apply CREP to some of the global preferences about AVs uncovered by the Moral Machines study. We intend this discussion both as a substantive contribution to the debate about the programming of ethical AVs, and as an illustration of how CREP works. We argue that CREP provides a principled way of using some public preferences as an input for policy, while justifiably disregarding others. (shrink)

Reflection has been proclaimed as a means to help physicians deal with medicine’s inherent complexity and remedy many of the shortcomings of medical education. Yet, there is little agreement on the nature of reflection nor on how it should be taught and practiced. Emerging neuroscientific concepts suggest that human thought processes are largely nonconscious, in part inaccessible to introspection. Our knowledge of the world is fraught with uncertainty, ignorance and indeterminacy, and influenced by emotion, biases and illusions, including (...) the illusion of not having illusions. Neuroscience also documents that lifelong learning processes may hone nonconscious cognition to high levels of sophistication, allowing rapid and precise perceptions, judgments and actions in complex situations. We argue that knowledge of mechanisms underlying human thought may be useful in designing educational programs to foster desired attributes such as curiosity, critical self-awareness and intuitive acumen in medical professionals. The juxtaposition of neuroscientific insights with ideas from Kant on reflective judgement, van Manen on tact, and Aristotle on phronésis, supports a concept of reflection that manifests as wise practice. We suggest that reflection in medical education should be an imperative for educators seeking to guide learners to manage the complexity and “messiness” of medical practice, and a role-modelling mode of medical practice characterized by self-correcting behaviors that culminate in good and right professional actions. a framework that develops and empowers students by engaging them in a process of continual improvement, responding to diverse situations, providing stimuli for learning, and giving anchors for mediation. The pedagogy of reflection relates to dialogue not only from a theoretical historical context but also by way of example
that is, it offers empowering dialogues within the traditional (...) teacher-training framework. This chapter outlines the importance of the pedagogy of reflection in the multicultural educational space of the preservice education field in Israel, analyzing the first university PDS model. The pedagogy of reflection in the context of the educational dialogue of educators is outlined as a tool for student empowerment, achieved through a community of learners who dedicate space to the development of their whole personality within the profession, taking a moral stance toward the educational discourse, minimizing judgmentalism and prejudice, creating national/gender equality with the goal of examining the fundamental question of educational performance, and reinforcing their sense of organizational belonging within the system. In these contexts, the chapter is based on the elements of dialogical philosophy exemplified in the thought of Burbules, Nelson, Isaacs, Bohm, and Heckmann and the reflective basis of educational and organizational performance exemplified in the writings of van Manen. The chapter also presents two examples from a project in which teaching units based on dialogue and reflection were developed within a dialogic community that represents in its very being collective empowerment, the possibility of coping with problems that are too large for an individual to solve on his/her own, and an alternative to sealed and alienated organizations. The paper explores whether the method of reflective equilibrium (RE) in ethics and political philosophy should be individual or public in character. I defend a modestly public conception of RE, in which public opinion is used specifically as a source of considered judgments about cases. Public opinion is superior to philosophical opinion in delivering judgments that are untainted by principled commitments. A case-based approach also mitigates the methodological problems that commonly confront efforts to integrate philosophy with the investigation of popular (...) attitudes. The notion of situation is here developed based on the study of a data corpus elaborated during an experience with a practicum training model centred on writing and the construction of the professional situation by a subject-actor-author of the situation, in interaction with others, in the context of (...) nurse training. The analysis and interpretation of data brings to light a complex and unique unit, constructed in the space-time of a professional practice, a process during which several states succeed one another. The critical moment in action characterizes this unit; it is central to the process, mobilizing reflection in action, internal deliberation, and action-related decision. Philosophers often find themselves in disagreement with contemporary philosophers they know full well to be their epistemic superiors on the topics relevant to the disagreement. This looks epistemically irresponsible. I offer a detailed investigation of this problem of the reflective epistemic renegade. I argue that although in some cases the renegade is not epistemically blameworthy, and the renegade situation is significantly less common than most would think, in a troublesome number of cases in which the situation arises the renegade is (...) blameworthy in her disagreement with recognized epistemic superiors. I also offer some thoughts on what it would mean for philosophical practice for us to refrain from being renegades. Finally, I show how a new kind of radical skepticism emerges from modest theses regarding the renegade. (shrink)

This paper explores an initially attractive principle connecting beliefs in general with beliefs about what beliefs are rational. The principle turns out to be violated by intuitively rational beliefs in some situations. The paper lays out some options for reacting to this fact.

This chapter aims to deepen Donald Schön’s insight about jazz playing as an example of what he calls “reflection-in-action” (RiA) by situating this notion within the enactive view of humans as linguistic bodies. Our main claim is that the knowl-edge or skills displayed by expert jazz musicians must be understood as aural and communicative in nature. After presenting the notions of RiA and linguistic bodies, we develop our view through a critical discussion of four statements from Schön’s passage on (...) jazz musicianship, before wrapping up and clarifying the position we are advocating. This way, we suggest a revised version of Schön’s concept, which we call “reflection in communicative jazz action.". (shrink)

Many view cancellation as a method for holding influential personalities accountable for bad behavior, while others think cancelling amounts to censorship and bullying. I hold that neither of these accounts are worth pursuing, especially if the aim is social progress. In this paper, I offer a situated account of cancellation and cancel culture, locating the phenomenon in our exclusionary history while examining the social dynamics of belief. When we situate cancel culture, we can see how problematic instances of cancelling (...) are embedded in ignorance. While combatting ignorance appears to call for a remedy rooted in feminist standpoint epistemology, there are risks in adopting naive practices of deference. Applying criticisms of epistemic injustice and adopting Táíwò’s elite capture framework, I explain how well-intentioned cancelling can work against social movements. Since epistemic trust mechanisms discourage self-reflection and belief revision, the relevant tactics for enacting social change—coalition politics and education—seem out of reach. I conclude by sketching cancel culture as a diagnostic tool: cancellation can be used appropriately in marginalized communities, but when it comes to combatting ignorance among privileged folks, we should view cancel culture as a method for determining where our social institutions are failing us. My aim in this paper is to provide an account of practical judgement, for Kant, that situates it within his theory of judgement as a whole—particularly, with regards to the distinction between the determining and reflecting use of judgement. I argue that practical judgement is a kind of determining judgement, but also one in which reflecting judgement plays a significant role. More specifically, I claim that practical judgement arises from the cooperation of the reflecting power of judgement with the faculty (...) of reason—the former assisting the latter in the application of its principle. I conclude by considering a possible role for feeling in practical judgement. (shrink)

The article analises from the perspective of the concept of ‘processuality’ proposed by Andrew Smirnov, as well as in comparison with Kant’s categorical imperative, the concept of ‘reflection’ and its role in the ethical teaching of the outstanding Iraqi Sufi al-Haris al-Muhasibi (VIII-IX centuries). Reflection is an integral component of the mystic’s continuous observation of his thoughts and intentions. The latter is the main tool for cleansing the soul and heart on a person’s path to God. The ‘additional’ (...) tools used in the study are Smirnov’s logical-semantic theory and Kant’s ethical teaching goal is to show the fundamental difference between the ideological paradigm of al–Muhasibi as a representative of Afro-Asian civilization from the paradigm of Kant as a representative of Western European civilization. The contrast of two ethics – ‘procedural’ (al-Muhasibi) and ‘substantial’ (Kant) – leads us to the theory of four types of civilization-specific mentality developed by Andrew Paribok. This article can and should be considered as a demonstration of how the method of Pskhu’ ‘situational hermeneutics’ works, according to which the researcher has the right to use those intellectual theories (sometimes irrelevant to each other) that help him in a concise form to clearly and unambiguously convey to the reader the meaning of the phenomenon under study (concept / text). The world currently faces the highest number in recorded history of people fleeing from war and violence. Refugee-hosting countries in the western part of the world experience the effects of global issues more than ever and face dealing with humanitarian logistics for refugees on an unprecedented scale. These countries continuously optimize their policies regarding refugees by navigating between obligations toward the Geneva Refugee Treaty, manageability of the situation, and worries of their citizens voiced through public opinion. The issue can be (...) considered a wicked problem because of its unpredictability, complexity, and global scale. Presuppositions about human flourishing affect the interpretation of well-being in refugee policies. In this article, we reflect on refugees’ experiences with Dutch asylum policies, analyzing these experiences through the theoretical lenses of Abraham Maslow, Manfred Max-Neef, and Herman Dooyeweerd. We learn from Maslow the importance of providing information for the satisfaction of basic needs; from Max-Neef we learn that, with the sole exception of the need for subsistence, all fundamental needs are equally important; and from Dooyeweerd we learn that trust, though often overlooked, is important for refugee well-being. This review essay examines the contribution of Legislated Rights (Webber et al, Cambridge 2018) to a central issue in constitutional theory: namely, how the institutional division of labour between the legislature and the judiciary with respect to the task of giving effect to constitutional rights is best understood and conceived. In doing so, the essay situates the work within contemporary scholarship and adopts a broadly comparative lens — a perspective that is mindful of key developments in constitutional law and theory (...) over the past several decades. Ultimately, it is suggested that a critical weakness of the capacity of Legislated Rights to contribute to contemporary debates about judicial review is its lack of engagement with these developments. As a result, the work’s intervention largely misses its mark. It speaks to an outdated view that does not reflect contemporary constitutional practice or scholarship. (shrink)

Context: The idea to write this paper sprang up in a casual conversation that led to the question of how the word “experience” would be translated into German. Distinctions between the German “Erleben” and “Erfahren,” and their intricacies with “Erkennen” and “Anerkennen,” soon led to the conviction that this was a thread worth pursuing. Problem: Much has been written about the nature of experience, but there is little consensus, to this day, regarding the role of consciousness in the process of (...) experiencing. Although RC acknowledges the significance of tacit or sensorimotor knowledge in the individual’s practical operating, it cannot admit it as a basis to the formation of conceptual structures that, by definition, are conscious. Method: Drawing from our backgrounds in epistemology and psychology, and a shared interest in Piaget’s psychogenetic approach, we investigate the origins and development of human experience, in this case the mastery of space, time, causation, and object-permanency. We focus on how “noticeable encounters” are gauged, reflected upon, and ultimately worked through, consciously or unconsciously, by the “experiencer.” Results: A child’s abilities to enact a certain action pattern in a given situation no more demonstrates a re-presentation of the pattern than does recognition in the case of objects. In his studies with children, Piaget has shown that the Kantian categories of space, time object, and “causality” are co-constitutive of the child’s own motion – and its felt impact – as a means to make the world cohere. Of importance here are the concepts of “effective causality,” felicitous encounters, and agency. Implications: Understanding the circumstances under which some “lived” events, whether self-initiated or striking as if out of nowhere, become noticeable and able affect a person’s life is a daunting task. This joint essay is no more than a conversation-starter and an invitation to further explore the intricacies between agency and causation, sensation and cognition, and, yes, motions and emotions in the making of consciousness itself. This article explores the role scientists at the National Cancer Institute, a US federal science agency, played in researching and testing vaccines against the human papillomavirus. Drawing upon archival sources and oral history interview data, I challenge narratives that attribute the design of HPV vaccines to profit motive. Instead, I show that the researchers who developed the technology attempted to construct ethical approaches to vaccine development based on the values that emerged from their situated environments of technological, organizational, and (...) institutional constraint. I argue that interpretations of “translational research” native to the NCI influenced these researchers’ efforts to design and test HPV vaccines. The organizational culture of translational research emerging in the NCI positioned intramural research as a countervailing and supplementary force to market-oriented translational research and development. Over time, NCI researchers’ conceptions of the Institute’s role allowed them to develop understandings of ethical HPV vaccine research as oriented toward addressing cervical cancer health disparities, especially in developing nations. NCI scientists’ understanding of their role in serving the public good through continued HPV vaccine innovation reflects the material and political economic environment they faced at different historical junctures that constrained the possibilities for innovation and ethical action. Distinguished gerontologists, ‘guardians of later life’ who had long kept age and ageism at the heart of their work, were asked by the author why the turn to ageism had not been able to raise age consciousness more effectively in the media or the public. Their frank responses constitute a valuable archive of reflections about how intersectional concepts and activist passions develop in an emerging and contentious multi-disciplinary field. The essay further situates their learned critiques in the history of age (...) studies over the last 30 years. Among the sorrowful and galvanizing revelations provoked by the Eldercide of the COVID-19 era is this: ‘ageism’ has become widely recognized as a keyword not only good to think with but necessary to act on. I begin by noting the disparate legacies of Thomas Hobbes (1588?1679) and Bishop Joseph Butler (1692?1752). I suggest that part of the reason Butler's arguments in Fifteen Sermons Preached at Rolls Chapel (2nd ed. 1729) have been comparatively neglected by contemporary philosophers is due to the genre in which they are presented, i.e. the sermon. Like other non-standard genres of philosophical writing (dialogue, disputatio, meditation, etc.) both the genre and the purpose towards which Butler puts it have become unfashionable in (...) contemporary philosophy, and, as a result, the subtlety of Butler's arguments are not fully appreciated. I attempt to rectify this situation by, first, explaining the general, complex purpose of Fifteen Sermons, and, second, by explaining the specific purpose of Sermon XI, ?Upon the Love of Our Neighbour? (the one sermon that has attracted sustained attention). In the first section of the paper I argue that the general purpose of Fifteen Sermons is as much rhetorical as it is philosophical, and that these are subsidiary to Butler's pastoral function first in relation to his congregation at Rolls Chapel and second to his readers. In particular, Butler portrays reflection as an essential condition for human virtue, and the sermons, which contain a theory of deliberation (or conscience) and virtue, are intended to encourage autonomous agency and guide it around certain traps of specious reflection. In the second section, I argue that the most serious trap is identified in Sermon X, ?Upon Self-Deceit,? the sermon prior to Sermon XI. In particular, the arguments in Sermon XI that are directed against universal selfishness are designed primarily to critique specious forms of practical deliberation, not theoretical accounts of psychological egoism. And moreover, because the preacher was wise, he still taught the people knowledge; yea he gave good heed, and sought out, and set in order many proverbs. The preacher sought to find out acceptable words: and that which was written was upright, even words of truth. The words of the wise are as goads, and as nails fastened by the masters of assemblies, which are given from one shepherd. And further, by these, my son, be admonished: of making many books there is no end; and much study is weariness of the flesh. Let us hear the conclusion of the whole matter: Fear God, and keep his commandments: for this is the whole duty of man. For God shall bring every work into judgement, with every secret thing, whether it be good, or whether it be evil (Ecclesiastes 12, 9?14). (shrink)

In A Theory of Justice, John Rawls defines a hypothetical contract situation and argues rational people will agree on reflection it is fair to contractors. He solves the rational choice problem it poses by deriving two lexically-ordered principles of justice and suggests the derivation justifies the principles. Its soundness aside, just what justificatory force does such a derivation have?On one view, there is no justificatory force because the contract is rigged specifically to yield principles which match our pre-contract moral (...) judgments. Rawls provides ammunition for this claim: “By going back and forth, sometimes altering the conditions of the contractual circumstances, at others withdrawing our judgments [about what is just] and conforming them to principle, I assume that eventually we shall find a description of the initial situation that both expresses reasonable conditions and yields principles which match our considered judgments duly pruned and adjusted.”.
