Enrique Dussel and John Dewey share commitments to philosophical theory and practice aimed at addressing human problems, democratic modes of inquiry, and progressive social reform, but also maintain productive differences in their fundamental starting point for political philosophy and their use of the social sciences. Dussel provides a corrective to Dewey’s Eurocentrism and to his tendency to underplay the challenges of incorporating marginalized populations by insisting that social and political philosophy begin from the perspective of the marginalized and (...) excluded. Simultaneously, Dewey encourages a modest experimental and fallibilist approach to social transformation that promises more feasible social reforms than Dussel’s approach rooted in phenomenology and the critical social sciences. This book is divided into three parts: in Part I, R. M. Hare offers a justification for the use of philosophy of language in the treatment of moral questions, together with an overview of his moral philosophy of ‘universal prescriptivism’. The second part, and the core of the book, consists of five chapters originally presented as a lecture series under the title ‘A Taxonomy of Ethical Theories’. Hare identifies descriptivism and non‐descriptivism as the two main positions in modern moral philosophy. (...) The former he divides into Naturalism and Intuitionism, and the latter into Emotivism and Rationalism. Hare argues that all forms of descriptivism tend to lead to Relativism because the truth conditions of moral statements are culturally variant. Of the positions discussed, only Hare's own position, a form of Rationalism, which he calls Universal Prescriptivism, meets all of the requirements that an adequate ethical theory should meet. Part III consists of Hare's previously published essay ‘Could Kant have been a Utilitarian?’ (Utilitas 5, 1993). L'objet de ce livre est le rapport complexe et assez conflictuel du socialisme/ communisme avec la religion (ou les religions), comme conséquence de la sécularisation, du développement de la pensée matérialiste-athée et de la critique radicale de la religion par Feuerbach, Marx et tous les autres représentants d'une pensée socialiste, communiste ou athée aux XIXe et XXe siècles. Après avoir abordé la problème de la "guerre" déclarée à la religion, au nom de l'athéisme et de la vision du monde scientifique (...) du matérialisme historique et dialectique, par Lénine, Staline et les bolcheviks, pendant les campagnes anti-religieuses, menées en Union Soviétique, notamment à partir de l'année 1925, ainsi que la situation a priori difficile des Eglises dans les pays satellites de l'URSS, en Europe de l'Est, dans l'après-guerre, l'auteur consacre une partie importante de ce livre à l'analyse de l'amorce d'un dialogue entre marxistes (athées) et chrétiens, dans les pays de l'Est, dans la période 1960 à 1975, en focalisant notamment sur la situation en R.D.A. et sur la contribution importante et originelle à ce dialogue par le philosophe marxiste allemand Ernst Bloch dont le livre Athéisme dans le christianisme (1968) avait été assez favorablement accueilli par certains théologiens protestants progressistes allemands (J. R.I.G. Hughes presents a series of eight philosophical essays on the theoretical practices of physics. The first two essays examine these practices as they appear in physicists' treatises and journal articles. By treating these publications as texts, Hughes casts the philosopher of science in the role of critic. This premise guides the following six essays which deal with various concerns of philosophy and physics such as laws, disunities, models and representation, computer simulation, explanation, and the discourse of physics.

The 1973 archeological discovery of important documents of classical thought known as the Huang-Lao Boshu coupled with advancements in contemporary jurisprudence make possible a reassessment of the philosophies of pre-Qin and early Han China. This study attempts to elucidate the importance of the Huang-Lao school within the intellectual tradition of China through a comparison of the Boshu's philosophical position, particularly its understanding of the relation between law and morality, with the respective views of major thinkers of the period--Confucius, Han Fei, (...) Lao Zi, Zhuang Zi, and to a lesser extent, Shen Dao, Shen Buhai and the authors of the Guan Zi and He Guan Zi. So doing reveals Huang-Lao to be a unique and sophisticated social and political philosophy which, until its expulsion from court by Emperor Wu and subsequent adoption by Daoist religion, served as the ideological foundation for the post-Qin reforms of the early Han. This collection of essays by leading international philosophers considers central themes in the ethics of Danish philosopher Knud Ejler Løgstrup (1905–1981). Løgstrup was a Lutheran theologian much influenced by phenomenology and by strong currents in Danish culture, to which he himself made important contributions. The essays in What Is Ethically Demanded? K. E. Løgstrup’s Philosophy of Moral Life are divided into four sections. The first section deals predominantly with Løgstrup’s relation to Kant and, through Kant, the system of morality in (...) general. The second section focuses on how Løgstrup stands in connection with Kierkegaard, Heidegger, and Levinas. The third section considers issues in the development of Løgstrup’s ethics and how it relates to other aspects of his thought. The final section covers certain central themes in Løgstrup’s position, particularly his claims about trust and the unfulfillability of the ethical demand. The volume includes a previously untranslated early essay by Løgstrup, “The Anthropology of Kant’s Ethics,” which defines some of his basic ethical ideas in opposition to Kant’s. The most glamorous and even glorious moments in a legal system come when a high court recognizes an abstract principle involving, for example, human liberty or equality. Indeed, Americans, and not a few non-Americans, have been greatly stirred--and divided--by the opinions of the Supreme Court, especially in the area of race relations, where the Court has tried to revolutionize American society. But these stirring decisions are aberrations, says Cass R. Sunstein, and perhaps thankfully so. In Legal Reasoning and Political Conflict, (...) Sunstein, one of America's best known commentators on our legal system, offers a bold, new thesis about how the law should work in America, arguing that the courts best enable people to live together, despite their diversity, by resolving particular cases without taking sides in broader, more abstract conflicts. Sunstein offers a close analysis of the way the law can mediate disputes in a diverse society, examining how the law works in practical terms, and showing that, to arrive at workable, practical solutions, judges must avoid broad, abstract reasoning. Why? For one thing, critics and adversaries who would never agree on fundamental ideals are often willing to accept the concrete details of a particular decision. Likewise, a plea bargain for someone caught exceeding the speed limit need not--indeed, must not--delve into sweeping issues of government regulation and personal liberty. Thus judges purposely limit the scope of their decisions to avoid reopening large-scale controversies. Sunstein calls such actions incompletely theorized agreements. In identifying them as the core feature of legal reasoning--and as a central part of constitutional thinking in America, South Africa, and Eastern Europe-- he takes issue with advocates of comprehensive theories and systemization, from Robert Bork to Jeremy Bentham, the father of utilitarianism, and Ronald Dworkin, who defends an ambitious role for courts in the elaboration of rights. Equally important, Sunstein goes on to argue that it is the living practice of the nation's citizens that truly makes law. For example, he cites Griswold v. Connecticut, a groundbreaking case in which the Supreme Court struck down Connecticut's restrictions on the use of contraceptives by married couples--a law that was no longer enforced by prosecutors. In overturning the legislation, the Court invoked the abstract right of privacy; the author asserts that the justices should have appealed to the narrower principle that citizens need not comply with laws that lack real enforcement. By avoiding large-scale issues and values, such a decision could have led to a different outcome in Bowers v. Hardwick, the decision that upheld Georgia's rarely prosecuted ban on sodomy. And by pointing to the need for flexibility over time and circumstances, Sunstein offers a novel understanding of the old ideal of the rule of law. Legal reasoning can seem impenetrable, mysterious, baroque. This book helps dissolve the mystery. Whether discussing the interpretation of the Constitution or the spell cast by the revolutionary Warren Court, Cass Sunstein writes with grace and power, offering a striking and original vision of the role of the law in a diverse society. But this view is patently at odds with the text. Knowledge and opinion are δυνάμεις, "faculties," to be distinguished and defined by their objects, no less than by the state of mind they produce, and Plato clearly states that the fallibility and unclearness of opinion is rooted in (...) the relative unreality of opinables. Interpretive Political Science is the second of two volumes featuring a selection of key writings by R.A.W. Rhodes. Volume II looks forward and explores the 'interpretive turn' and its implications for the craft of political science, especially public administration, and draws together articles from 2005 onwards on the theme of 'the interpretive turn' in political science. Part I provides a summary statement of the interpretive approach, and Part II develops the theme of blurring genres and discusses a variety of research (...) methods common in the humanities, including: ethnographic fieldwork, life history, and focus groups. Part III demonstrates how the genres of thought and presentation found in the humanities can be used in political science. It presents four examples of such blurring 'at work' with studies of: applied anthropology and civil service reform; women's studies and government departments; and storytelling and local knowledge. The book concludes with a summary of what is edifying about an interpretive approach, and why this approach matters, and revisits some of the more common criticisms before indulging in plausible conjectures about the future of interpretivism. I shall understand physical determinism as the doctrine that every physical event has a physical event as its necessary and sufficient cause. This paper seeks to show that no one would be justified in holding this doctrine unless it could be shown to make successful predictions; and that such predictions could only be obtained if we assume the doctrine to be false.

From the O.J. Simpson verdict to peace-making in the Balkans, the critical role of human judgement--complete with its failures, flaws, and successes--has never been more hotly debated and analyzed than it is today. This landmark work examines the dynamics of judgement and its impact on events that take place in human society, which require the direction and control of social policy. Research on social policy typically focuses on content. This book concentrates instead on the decision-making process itself. Drawing on 50 (...) years of empirical research in decision theory, Hammond examines the possibilities for wisdom and cognitive competence in the formation of social policies, and applies these lessons to specific examples, such as the space shuttle Challenger disaster and the health care debate. Uncertainly, he tells us, can seldom be fully eliminated; thus error is inevitable, and injustice for some unavoidable. But the capacity for make wise judgments increases to the extent that we understand the potential pitfalls and their origin. The judgment process for example involves an ongoing rivalry between intuition and analysis, accuracy and rationality. The source of this tension requires an examination of the evolutionary roots of human judgement and how these fundamental features may be changing as our civilization increasingly becomes an information and knowledge-based society. With numerous examples from law, medicine, engineering, and economics, the author dramatizes the importance of judgment and its role in the formation of social policies which affect us all, and issues the first comprehensive examination of its underlying dynamics. We live in a time of moral confusion: many believe there are no overarching moral norms, and we have lost an accepted body of moral knowledge. Alasdair MacIntyre addresses this problem in his much-heralded restatement of Aristotelian and Thomistic virtue ethics; Stanley Hauerwas does so through his highly influential work in Christian ethics. Both recast virtue ethics in light of their interpretations of the later Wittgenstein's views of language. This book systematically assesses the underlying presuppositions of MacIntyre and Hauerwas, finding (...) that their attempts to secure moral knowledge and restate virtue ethics, both philosophical and theological, fail. Scott Smith proposes alternative indications as to how we can secure moral knowledge, and how we should proceed in virtue ethics. (shrink)

Reasons are facts, i.e., they are constituted by facts. Given a popular view that conceives of facts as thin abstract rather than thick concrete entities, the dichotomy between agent-neutral and agent-relative reasons is not particularly problematic. It is argued that it would be preferable if we could understand the dichotomy even if we had a thick noton of fact in mind. It would be preferable because it is better if our notion of a reason is consistent with a wider rather (...) than narrower set of plausible metaphysical views. But, more importantly, it would also be preferable because the thin approach trivializes an interesting issue among practical philosophers. Moreover, as an additional drawback, the thin account is in one respect less appealing than its thick cousin. The latter is not flawless, though.
