Assim que nascemos, estamos fadados a viver em desamparo. Em paralelo com a teoria de Judith Butler, pretendemos fazer a relação do desamparo psíquico tratado por Freud com o conceito de (...) precariedade e os laços de interdependência presentes na obra da autora, que mostra como a interdependência revela o nosso estado de precariedade em comum. What is immediately strange about Sartre’s controversial preface to Fanon’s The Wretched of the Earth is its mode of address. To whom is this preface written? Sartre imagines his reader as the colonizer or the French citizen who recoils from the thought of violent acts of resistance on the part of the colonized. Minimally, his imagined reader is one who believes that his own notions of humanism and universalism suffice as norms by which to assess the war for independence in (...) Algeria and similar efforts at decolonization. Sartre’s address to his audience is direct and caustic: “What does Fanon care whether you read his work or not? It is to his brothers that he denounces our old tricks”. At one point, he seems to take his implied readers aside, addressing the preface to them directly. (shrink)

Research on corporate social responsibility has traditionally focused on managerial discretion and stakeholders’ influence. This study extends current research by addressing the effect of family firms and institutional owners on CSR performance, namely, CSR strengths and concerns. Based on stewardship theory and the socioemotional wealth perspective, we propose that family firms are more likely to value CSR performance. Next, drawing from multiple agency theory, we predict that institutional owners, unlike family owners, will influence a firm’s CSR performance differently. We tested (...) our hypotheses using a sample of 153 firms from 1994 to 2006 and found general support for our hypotheses. A higher percentage of family owned equity and the presence of a family CEO are found to increase CSR strengths, whereas transient institutional owners have an opposite effect. The presence of a family CEO and founding family are found to reduce CSR concerns. Contrary to our predictions, dedicated institutional owners are positively associated with CSR concerns. (shrink)

Julia Kristeva attempts to expose the limits of Lacan's theory of language by revealing the semiotic dimension of language that it excludes. She argues that the semiotic potential of language is subversive, and describes the semiotic as a poetic-maternal linguistic practice that disrupts the symbolic, understood as culturally intelligible rule-governed speech. In the course of arguing that the semiotic contests the universality of the Symbolic, Kristeva makes several theoretical moves which end up consolidating the power of the Symbolic and paternal (...) authority generally. She defends a maternal instinct as a pre-discursive biological necessity, thereby naturalizing a specific cultural configuration of maternity. In her use of psychoanalytic theory, she ends up claiming the cultural unintelligibility of lesbianism. Her distinction between the semiotic and the Symbolic operates to foreclose a cultural investigation into the genesis of precisely those feminine principles for which she claims a pre-discursive, naturalistic ontology. Although she claims that the maternal aspects of language are repressed in Symbolic speech and provide a critical possibility of displacing the hegemony of the paternal/symbolic, her very descriptions of the maternal appear to accept rather than contest the inevitable hegemony of the Symbolic. In conclusion, this essay offers a genealogical critique of the maternal discourse in Kristeva and suggests that recourse to the maternal does not constitute a subversive strategy as Kristeva appears to assume. Foucault proposes at the end of the first volume of The History of Sexuality to shift the focus of sexual studies from sex-desire to bodies and pleasures. This article seeks to establish what he means by this shift, how he proposes it be made, and what the consequences are for thinking about sexuality together with `sex'. Foucault's shift involves a historiographical claim about the superability of the recent past, and can be read as an effort to relegate the concerns about (...) sexual difference and kinship to the past, and to establish a contemporary field for sexuality that involves bodies without history, pleasures without sex. The article suggests a way around this questionable historiographical assumption and marks a different departure for a Foucauldian study of sexuality. It also seeks to highlight some of the contemporary tensions between feminist and lesbian and gay studies, especially queer studies, in light of this reading of Foucault. (shrink)

Derek Parfit argues that fission is prudentially better for you than ordinary death. But is having more fission products with good lives prudentially better for you than having just one? In this paper, we argue that it is. We argue that, if your brain is split and the halves are transplanted into two recipients (who both have good lives), then it is prudentially better for you if both transplants succeed than if only one of them does (other things being equal). Interpreters of the Phaedo often cite the Pythagorean context of the dialogue as a source of influence on the demanding conception of philosophy defended therein. Sandra Peterson offers a striking account of that influence: the Pythagorean sympathies of Socrates's interlocutors lead him to defend a conception of philosophy that captures their commitments, but that he himself rejects. Call this the Strong Influence Thesis. Peterson defends SIT by attempting to demonstrate a mismatch between the conception of philosophy espoused by Socrates in (...) the Apology and ‘true philosophy’ as described in the Phaedo. Assessing this defence thus requires a detailed examination of both sides of the comparison. This paper undertakes that task. I argue that when the beliefs and norms that define both philosophical lives are correctly understood, the appearance of a significant mismatch fades away. As an intellectual, economic, political and legal project, neoliberalism is not directed towards the rolling back of the state as an aim in itself. While its deregulatory tendencies, its commodification of public services and the undermining of systems of social welfare superficially suggest a generalised reduction in state power, it has been clear from the early 1980s that one of neoliberalism’s primary concerns has been the authoritarian reshaping of state power to engineer particular social outcomes, whether in criminal justice, the (...) disciplining of organised labour, the militarisation of national territory and migration, or the extension and deepening of regimes of austerity. This article introduces the recent work of Maurizio Lazzarato, who has argued that the asymmetrical creditor-debtor relationship is now the archetype of contemporary, neoliberal social relations. Ultimately, Lazzarato’s perspective tends to exaggerate the totalising powers of finance capital and leads him to endorse a form of political voluntarism, which fails to address the role of the neoliberal state as a site for forms of authoritarianism which are not solely generated by the debt relation. As a response, it will be suggested that aspects of Nicos Poulantzas’s concept of ‘authoritarian statism’ can be used to both strengthen our understanding of the authoritarian characteristics of the neoliberal state, and to imagine possibilities for resisting its expressions of power. Following a series of undercover sting operations organized by Live Action at several Planned Parenthood clinics in 2008, there has been renewed interest in truthfulness and lying from the perspective of St. Thomas Aquinas. Some scholars have used these stings as an opportunity to criticize Aquinas’s position on lying, while others have defended the position of the Angelic Doctor. What implications does this renewed discussion of truthfulness and lying have on medical practice? Although deception in medicine has long been the (...) subject of scholarship, an authentic Thomistic analysis may shed new light on the issue and renew support for truthfulness in medicine while still permitting the prudent masking of the truth for the patient’s benefit. Richard Kraut argues that Neo-Aristotelian ethics should include a com­mitment to “diluted hedonism,” according to which the exercise of a developed life-capacity is good for S only if and partly because S enjoys it. I argue that the Neo-Aristotelian should reject diluted hedonism for two reasons: first, it compro­mises the generality and elegance of the initial developmentalist account; second, it leads to mistaken evaluations of some of the most important and ennobling capacities and activities in human life. Today, it is becoming increasingly common for companies to harness the spirit of play in order to increase worker engagement and improve organizational performance. This paper examines the ethics of play in a business context, focusing specifically on the phenomenon of workplace gamification. While critics highlight ethical problems with gamification, they also advocate for more positive, transformative, and life-affirming modes of organizational play. Gamification is ethical, on this view, when it allows users to reach a state of authentic happiness or (...) _eudaimonia._ The underlying assumption, here, is that the ‘magic circle’ of play—a sphere that exists entirely for its own sake—should be protected in order to secure meaningfulness at work. However, we argue that this faith in play is misguided because play, even at its most autotelic, is ethically ambivalent; it does not lead inexorably to virtuous work environments, but may in fact have an undesirable impact on those who are playing. Our study thus contributes to research on the ‘dark side’ of organizational play, a strand of scholarship that questions the idea that play always points toward the good life. (shrink)

One of the issues with introducing animal rights law is whether the problem is quantitative or qualitative, whether it can be achieved by working within existing legal paradigms or whether it requires a new set of paradigms. The answer is fundamental: a quantitative problem can be solved by applying more of the same solutions, while a qualitative problem requires completely different solutions. The qualitative camp can be represented by, say, Professor Gary Francione, demanding not only rights for animals but that (...) they have personhood and are no longer considered “property.” The quantitative approach can be finely represented by Professor David Favre, who has argued for many years that we can make progress by developing existing legal principles to give some rights to some animals, and he does so eloquently in his new book. He is clear in his view that progress is, and can continue to be, made with a series of steps, as he puts it, “climbing the slippery slope toward personhood” (p. viii).His case is supported by looking backward—progress made in establishing the rules governing humans in their relationships with animals—as well as forward to developments that will support continuing improvement in the lives of animals, not least the potential for technology (for example, through cell- and plant-based meat). At the same time, he also rightly rejects the concepts of animal welfare and animal rights being at odds, let alone either of them being a panacea for better lives for animals.One aspect of animal law that Favre believes does need to change is that of property status. As he says, the status of animals as personal property is “critical to the future of animal law” (p. 25). In general, the solutions have been largely binary—that animals simply cannot be property for them to have meaningful rights or that animals can be property and still have rights. The former makes intuitive good sense (and is consistent with the objectives of the human abolitionist movements) but would have enormous effects on economic activity throughout the world. The latter is appealing because it does not change the current paradigm, so can be developed more easily.Favre's premise is that we are moving toward rights for animals, so we need to find a way of integrating animals into the current legal system rather than having to destroy and reconstruct the legal system. His ingenious solution is to propose a fourth category of property, alongside real, personal, and intellectual property: “living property.”Within this category, he envisages using the common law concept of the trust to provide equitable “self-ownership,” where an animal has equitable “ownership” while a human retains legal “ownership.” He then connects this concept to adaptations in other aspects of law that start to recognize the selfhood of animals, creating a platform onto which broader and deeper rights for animals can develop, such as the status of “animalhood” (p. 72) and the corresponding legal right of consideration before decisions are made by the state affecting an animal's fundamental interests (such as continuing to be alive). By putting animals in a separate class—rather than uncomfortably leaving them in personal property—he creates a possible route for animal rights that seems less paradigm-busting than removing them from being property altogether.Drawing on evidence from criminal law, tort law, equity (trusts), property law, and family law, he shows how in many places—with a focus on states in the United States—existing laws are being adapted (“green shoots” p. 81) to recognize that animals are more than personal property, in ways that cannot be explained simply through the growth of regulations. For example, family law is starting to recognize that in the division of matrimonial assets, companion animals cannot be treated simply like any other personal property such as a table or a car based on who paid for them. Because animals are “living property,” the courts should take account of other aspects, such as who cared for the animals and who looked after them. Similarly, the concept of extending trust law so that an animal can be the beneficiary of a trust—in the same way as a human can be but inanimate personal property cannot—shows that the law can understand that companion animals can play a large emotional role in our lives (as well as we in theirs), such that we want to ensure proper care for them after we die.The book raises important issues. First, it is intentionally about domestic animals, with their close links with humans, so the potential for laws to engage is much easier than with, say, farmed animals. The danger with solutions that focus on domestic or charismatic animals (e.g., dogs, chimpanzees, elephants) is that the arguments may be pertinent essentially only to those species and therefore hard to apply to animals of less charismatic species, say in a factory farm (but who are present in much greater numbers and generally badly treated in comparison). He “leaves for another day” (p. 32) the discussion about other animals. Hopefully that day will come, as it would be interesting to see how Favre could extend his concept to animals for whom the public has less affection and less appreciation of their capacities (and for whom the prospect of death is much more real and imminent).Secondly, public support for these ideas about living property may simply not be present. If there is not a sufficient groundswell of support for changing the status of animals, then whether one proposes changing it to not-property or “self-owned” property doesn't matter (if someone doesn't like needles, it doesn't matter whether the needle you propose to use is big or small). This may be too pessimistic, of course (people can be helped to overcome a fear of needles, and one way to start is with small needles). Perhaps the law should start with small changes to recognize at least a few animals—their sentience, their capacities for pleasure and pain, their emotions and preferences, their potential for autonomy—and build public support from there.There is also the underlying and more radical point about whether these ideas—the trust for a beloved companion set up by the human, the divorce settlement that doesn't just give the companion to the party who paid for them—are actually bringing about changes for animals as such or are simply adapting laws to help humans, recognizing human needs, and do not actually change the status of animals. The ends are still humans, and the means are still animals.This is not intended to paint a bleak picture: The more bluntand uncompromising part of the animal rights movement that has been focused on the qualitative problem has hardly been successful at getting animal rights laws passed anywhere in the world, so everything that moves us closer to a better, richer, more thoughtful view of animals will help. Favre's approach has ingenuity, shows good sense, and has the potential to bring about real animal rights. The themes and cases in this book that show how courts and legislatures are becoming more aware of the sentience of at least some animals, as well as proposing a middle path in the debate about animals as property, are important in the journey toward recognition of animal rights. Reclaiming the Wilderness: Contemporary Dynamics of the Yiguandao by Sébastien Billioud offers a fieldwork-based inquiry into the nature and transmission processes of a growing transnational religious movement as it attempts to "reclaim the wilderness" of mainland China. This group emerged as a prominent millenarian redemptive society in the first half of the 20th century in mainland China, before it was driven away to Taiwan as an illegal secret society by the anti-religion campaign of the Communist regime. Semantic formulations of various moral realisms and nonrealisms are to be categorized not only by their differing metaphysical commitments, e.g., realism's rejection of relativism, dummett's antirealism and nihilism, but also by certain of their linguistic commitments. relevant linguistic commitments involve giving priority in the explanation of moral language to, variously, reference, truth conditions, inferential role or illocutionary force. the latter two are illustrated, respectively, by a social pragmatism resembling rorty's and a noncognitivism such as hare's.

Better health requires sectors like housing and education, and healthcare, to collaborate. That needs three strategies. Make full use of waivers to foster experimentation. Use techniques to encourage agencies at all levels to work together. And use new incentives to foster local partnerships.

Personal life events of a chief executive officer can generate tensions between the CEO’s right to personal privacy and the desire of shareholders for information. Such circumstances can create information asymmetry between the executive management and the shareholders of a firm, a situation likely to produce unfavorable pressures on an organization’s stock price. Failure to fully disclose material personal life events can impact the decision-making actions of the CEO, causing the stock price of the firm to vacillate as a result (...) of rumors and other informational uncertainties. These vacillations in stock price may impact a firm’s liquidity, increase the cost of capital, and affect long term returns to shareholders. We draw upon the ethical leadership and signaling theory literatures to demonstrate how a firm can reduce stock price volatility through a CEO making non-required disclosures that reduce information asymmetry. Refined intellectualism holds that although an agent’s actions always follow his rationally-produced choices of what is best, those choices can be influenced by non-rational motivational states. Through a contrast with the Protagoras, I argue that RI is not only clearly endorsed in the Phaedo but also central to the philosophical ethic defended in that dialogue. This result raises problems for prevailing developmentalist interpretations of Plato’s moral psychology.
